IT IS ALWAYS BETTER TO SWIM WITH THE TIDE

A person had to swim to other side of the river little distance upstream.He has two options.First to swim towards the target up the stream.Second to swim with the stream and reach the other side little down and walk along the bank to reach the target. First option will be certainly difficult where as the second one not only easy but also enjoyable.Even the water on the body will get drained and wet clothes will get dried during the refreshable walk along the banks.

There nothing to fear about when an inevitable situation arises.CPA WHICH ONCE APPEARED AS A DRAGGER ABOVE OUR HEAD IS NOT THAT MUCH FEARSOME NOW AFTER OUR IMA STARTED PPLSSS.So will be Clinical Establishment Act,Standard Treatment Protocol,Hospital Accreditation and Grading,Insurance and Preferred Private Network Tariff etc. Please be assured that our State IMA on the negotiating track with respective implementing authorities unlike CPA. Even in CPA there is a possibility now with a court verdict that our Tamil Nadu Medical Council to accept and act like a Medical Tribunal, for which we had been pleading for long time,by enquiring into all consumer cases against doctors and hospital by arranging peer review and pronouncing there was any medical negligence or not.Award of compensation which TNMC does not possess can be done by Consumer Forum.

Believing in IMA and strengthening it is the only option to tide over all crisis in our medical profession which we have taken by choice and not by chance.It is the duty of the IMA leaders to strive to fulfill the needs and expectations of our medical profession and decisions of the majority of the members rather than their own. It requires a great courage not only to stand and shout but also sit and listen.Inputs from a core team has great value than an individual brain.

For every problem that is forced on us, there is always a suitable solution from IMA.But we have to realise that each one of us is answerable and accountable in the changing scenario.it is high time to implement EMR and develop a net working among NHB Hospitals rather than thinking as competitors.

Those who are willing to a change a little, flourish and those who are adament ,perish.

It is always better to swim with a tide that too when a life saving jacket (IMA) is with every one.

I Thank every member and branches who donated funds for the Kashmir flood relief. IMA TNSB collected Rs 4 lakhs and sent to the IMA Disaster Relief fund, New Delhi. Also I request further donations for the Orissa and Andra Pradesh storm. We had a grand Nursing Home Board Meet at Marthandam on October 5th. Also we have another Nursing Home Board Meet at Erode on November 16th 2014.Global Hand Washing Day-October 15th

Global Hand Washing Day October 15th is organized by IMA TNSB. Pamphlets, Power Point Presentation are sent to every branch to demonstrate for the Schools children. I appreciate the branch who have sent the report about the Global Hand Washing Day- IMA Erode, IMA Kancheepuram, IMA Coimbatore, IMA Namakkal, IMA Dharapuram, IMA Chettinad, IMA Karur, IMA Perambur, IMA Tambaram, IMA Tirunelveli, IMA Vellore, IMA Virudhunagar, IMA Tirupur. nearly one lakhs students participated in the global Hand washing day of our state. It is a Milestone in our activity. IMA TNSB organised the Press meet at Erode on Global Hand Washing Day.Diabetes/Hypertension Awareness Program

We are having a week long program of hypertension/diabetes detection, free camp starting from 14th to 20th November for free BP/Sugar check-up along with height weight . The collected data shall be presented to the Government of Tamil Nadu for its health activities as well as to the IRDA for statistical purpose. I invite every branch, Hospital, Clinic to participate in this program. This is yet another program of IMA TNSB is doing to reach out the public especially for the detection of non communicable diseases.RNTCP Workshop

I congratulate nearly 32 branches who have conducted the CME on RNTCP, I wish remaining branches also to take initiative to conduct the CME on RNTCP. Recently Bihar Chief Minister Jitan Ram Manjhi gave statement that he will cut off Doctors hands if they deny to treat poor patients. Such Statement deeply hurts every doctors and directly or indirectly stimulating anti social elements to instigate there to attack on Doctors. On one side, we are given awards against ours in crores of rupees, with other hand would be chopped. This is the high time that we all unite and fight. Already our head centre written to Bihar Chief Minister Jitan Ram Manjhi against his statement.

TIME has come to change consumer protection Act because it has done more harm to public than good. It has erased the Doctor - Patient relationship - Escalated the cost of treatment sowed the seeds of suspicion and fear for the both patient and doctors alike.

All small and medium hospitals must be service providers for cashless treatment of course with proper grading.

Insurance companies must cut their profits and help us to serve the public. Governments - Politicians and - Bureaucracy - If they call my profession noble profession - then I must be treated with nobility and place me at a higher plateform then other service providers. Or otherwise if you say I am on par with other service providers don’t impose extra morality and higher ethical restrictions on me than for other providers. I want to know whether I am a male or female and I don’t want any ambiguity any more!

Tamilnadu clinical establishment registration and regulation Act must confine itself to registration and punishment for non registration because Hon. madras High court Benchhas entrusted the job of regulation and standardization of hospitals both Government and Private to Tamilnadu Medical Council by its recent Judgement on 21.08.2014.

Let us work for the above agenda progress may be slow but we are sure to win when ALL OUR HEADS AND HANDS JOIN TOGETHER.

We have had a successful NHB meeting at Marthandam on 5-10-2014 around 180 delegates participated. Let me take this opportunity to thank our state leaders as well as members of IMA Marthandam for making the event a success. Our special thanks goes to the immediate past national president Dr.K.Vijayakumar. Working with him was very enlightening as to how to do micro planning of an event. Our thanks also goes to vice president Dr.Balaganraja and immediate past secretary

IMA NHB in association with diabetologist association of India southern chapter with Dr. A. Pannerselvam as its nodal person has come up with a novel project of reaching out to the general public by announcing a week long program of hypertension/diabetes detection free camp starting from 14-11-2014. NHB requests its members to help by declaring any single day from 14-11-2014 to 20-11-2014 for free BP/Sugar checkup along with height weight and BMI. A BMI chart and another chart are available in our website. The collected data shall be presented to the government of Tamilnadu for its health activities as well as to the IRDA for statistical purposes. We hope this exercise will ultimately help NHB along with members to be projected as the largest single health service provider with social conscience. The ultimate aim is to project NHB as a organization like CII which can negotiate with governments both central and state for the rights of its members. Please include your paramedical staff under the supervision of duty doctor.

Food for thought

I have a suggestion in this regard. Gone are the days when one doctor with sufficient practice builds up a small hospital and runs it as his own with minimum facilities. Today consumer courts and general public expect a wide variety of facilities and the latest infrastructure .Can one man do all this? On other side the numbers of doctors of the same speciality have been on the rise. Too many hands ask for food that is too little. What is the solution? I suggest doctors of the same speciality join together and start a center of excellence of their own speciality with all facilities. They can have their own individual practice but admit the patients in this center where the patient will get all the modern facilities. The investment is collective and hence do not hurt any one. Greetings! Happy to communicate to you all through TIMA News letter. 11th para medical zonal meet was well organised by Marthandam IMA and it was well attended . Our sincere thanks to Dr.Vijayakumar, Dr.Balaganraja, Dr.jayalal who guided the Efficient IMA team under the presidentship of Dr.ThambiVijayakumar, Sec D r . M a h i l a n , O r g S e c D r . K a n n a n , Dr.Radhakrishnan et all . Apart from regular Tips for Quality Health care and work shop, this time we had Panel discussion on “Bridging the

Gap—Paramedics and management”. It was very interesting and was a platform to discuss either sides Plus and Minuses. More and more such discussions will sort out problems and will be a motivating factor for new aspirant to take up this job and continue in this profession.

An IMA Para medical course Results has been published and Convocation was held at Coimbatore on 26th October. It was a grand show with nearly 350 graduated students went on a ceremonial parade with Convocation robes on and carrying candles was a feast for our eyes. The value of this will multiply in cases of emergency. 2. Actual denial: If the doctor is confident that no negligent act was committed, complete denial that the injury has been caused due to negligence would be a complete defense.3. Delegation of duties: The defense will be different in different situations, and there will also be situations which will not fall in any predetermined category of situations. i] If duties are delegated to a qualified assistant, partner, lab attendant or nursing staff competent to handle the given situation, there is no liablity on the doctor. ii] There are some duties that can be delegated to a competent and qualified assistant , partner, lab attendent or nursing staff but in case of negligence, both the delegatee and the delegator will be considered negligent. iii] There are some fundamental duties that cannot be delegated. [e.g.] A radiologist cannot delegate his duty of writing reports.For member's attention::Any reports or content of important judgements written by our PPLSS office bearers in the 'TIMA NEWS' is for the awareness and prevention of such prooven negligent act among our members. No report will contain the name of any member but only incidents will be given. If any member got mentally hurt by such remarks which is unintentional and we feel sorry for such happenings, and we will see to that such incidents will not happen in future.

Warm greetings, I do not know how many of you have gone through the model prescription sheet given in Tima News September 2014. If you have not gone through it, please look at it now and think whether the given notes are relevant or not. Your criticisms are welcome! We must thank advocate Mr. A. Rajendran B.Sc., B.L., of Trichy who is appearing for PPLSSS cases in Trichy for the past 7 years for his notes sent to me titled “underlying issues in medical negligence cases”. Following is the brief note of his letter. Because of series of ligations, medical community, instead of concentrating in medical skill and challenge, they undergo serious mental agony, pain, distrust and dejection resulting in avoiding medically complicated cases apprehending legal action in consumer forum (A true state of medical profession today).Supreme Court Bench, consisting of Justice A.K. Ganguly (about whom we read in news papers a few months ago) interpreted the Dr. Jacob Mathew's case in a different way, thereby forebearing the consumer forums from referring the consumer complaints of medical negligence to a committee of experts of Government Medical Institutes before entertaining the complaints regarding maintainability. This led to consumer forums admitting the consumer complaints of negligence straight away and thus making the medical professionals to prove that they have adopted or followed the known and accepted medical procedures to the satisfaction of the forum. To prove as above, following are essential. 1. Meticulously written case sheet2. A brief discharge summary containing diagnosis, investigation, treatment and follow up in a concise format.3. An informed consent – consent given with understanding about what is informed to him or her. We thank him for understanding our difficulties and giving right advice.As a part of this process of keeping medical records correctly, we have given a copy of the sample outpatient prescription. From next issue we will write about case sheet records.

BCCC viewed the complaints pertaining to the episode dtd. 17.08.2014 of the programme “ Neeya Naana” on Star Vijay. The Council decided not to interfere with the channel’s right to free speech and expression. It, however, directed the channel to be mind full of any content that could be offensive to a section of society. Content concerning real issues should have a balanced perspective.
