S. 1)., April 4.— The question involving the validity of the election law passed at the last ses- sion of the South Dakota lenislaiure, known as the caucus law. was heard before Judge Marquis, judge "f tin* Third judicial circuit, yesterday, and was decided valid and not conflicting with the constitut ion on any of tnc points of content 1011. Althounh the law makes no pro- vision for meeting certain expenses accniinn through furnishing the priming supplies. pavmenl of judges of election, etc.. the court held that the countv o.jni ilj issioiit*is were liable for payment of blanks, etc.. while the judne- of elections should be paid by the chairmen of the central com- mittee of the respective parties. The action was brought before the court by Attorneys Hanten and Loucks on behalf of the Democratic state central committee, .John H. B. llanten being secretary of the said committee t The plea was lor an order restrain- ing the couuty auditor to take any steps it) orderiuu supplies or to assist in any manner in carrying out the provisions of the slate CJUCUS law on the grounds of the law being uncon- stitutional and therefore null and void. The legal talent in this political battle was States Attorney II. G. Iluiidredmark, representing -I. 1'. McLaughlin, the county auditor, against whom .Mr. llanten would have the writ of prohibition issued, and he was hacked by C. 10. Winsor of Sioux Kails, Ivan W. Goodner of I'lerre and Guy Iv Kel ley of i'.rook- tngs. The last three named having been employed by Chairman Frank Crane of the Republican state cen- tral committee. Opposed to them was Mr. Hanten. alone, as attorney petitionei in behalf of the Democratic state central committee.
