The meeting was called to order at 6:30 PM by Mr. Jeff Stumbo. Let the record show that all board members were present at this meeting; those being Mr. Jeff Stumbo, Ms. Linda Gearheart, Dr. Chandra Varia, Ms. Rhonda Meade, and Ms. Sherry Robinson. Also present was Mr. Henry Webb, Superintendent. Mr. Stumbo welcomed everyone present to the meeting, reminding those wanting to address the board to sign the clipboard at the front. Mr. Webb asked those present to remember Christopher Shepherd, board employee who just lost his life while having a moment of silent reflection, “Why are we here?” Mr. Webb read the Agenda into the record, noting that there were no changes to the Agenda, it is as is. ORDER NO. 17486 Agenda

Ms. Meade made the motion and Ms. Gearheart seconded the motion to adopt the Agenda as is.

There was an affirmative vote by all board members present to approve the motion. The motion carried.

PRESENTATION: Mr. Greg Guess presented certificates for the Energy

Star School’s to the following schools: Adams Middle School Allen Elementary School Prestonsburg Elementary School Betsy Layne High School PRESENTATION: Mr. Jerry Butcher, Principal at Prestonsburg High

School had a Power Point Presentation (See Attachment). COMMENTS TO THE BOARD:

1. Dr. Varia, Board Member; expressed her pleasure in the attendance for the 2012 School Year. 2. Mr. Henry Webb, Superintendent; communicate that two Academic teams

went to Academic Camp this summer. ORDER NO. 17487 Report of the Superintendent (Item 5-A)

Ms. Meade made the motion and Dr. Varia seconded the motion to receive the Report of the Superintendent.

There was an affirmative vote by all board members present to approve the motion. The motion carried.

ORDER NO. 17488 Utility Report (Item 5-B)

Dr. Varia made the motion and Ms. Gearheart seconded the motion to receive the Utility Report for Prestonsburg High School.

There was an affirmative vote by all board members present to approve the motion. The motion carried.

Ms. Meade made the motion and Dr. Varia seconded the motion to receive the Architect’s Update on Special Projects currently under construction.

There was an affirmative vote by all board members present to approve the motion. The motion carried.

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to approve the minutes for the June 25, 2012 regular meeting held at Stumbo Elementary School.

Board Policy 9.4232. Students shall not be permitted to use or possess any tobacco product, electronic cigarettes, lighters, and matches on property owned or operated by the Board to include Board-owned vehicles on the way to and from school or during school-sponsored trips and activities. Students who violate these standards shall be subject to penalties set forth in the local code of acceptable behavior and discipline. For purposes of this policy, the term parent also includes the person serving as guardian.

Consequences for students engaging in the prohibited behavior shall be provided in the Student Code of Conduct handbook. ORDER NO. 17494 KSBA Policy Update (Item 6-E)

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to approve the agreement between Mountain Comprehensive Care Center and Floyd County Schools for provision of School-Based Therapy Services for 2012-2013 School Year.

KRS 158.440 and 160.290. In the past, mental health services to students may have been limited due to difficulties that families experience with transporting children to appointments at MCCC. Students who had transportation and for whom appointments were scheduled during the school day were absent from school for a day or a portion thereof. Providing therapy services on-site address both issues. Availability of MCCC staff members has also increased awareness of services available to students (and family members) that may have a need for mental health services. The number of sites served is directly related to availability of qualified MCCC therapist. There will be no direct cost to Floyd County Schools associated with this agreement. Therapeutic services will be billed to each child’s medical card, insurance, or to any grant monies available at MCCC. Therapists are provided a room in which to work at each school served. ORDER NO. 17498 Central KY Psychological Services (Item 6-I)

ORDER NO. 17500 Special Needs Student Transportation (Item 6-K)

707 KAR 1:320 Individual Education Programs, Section 1. Individual Education Programs (Statutory Authority: KRS 156.070 (1), 156.160, 157.220, 157.224, 157.260, and 167.015). Approval is sought to enter into a contractual agreement with the [aren’t of a student with special health needs. The student has significant physical needs that necessitate special transportation of this type at this time. the parent has been transporting the student for a number of years on a contractual basis to reduce the amount of time the student spends traveling to and from school in order to address significant documented health concerns. If services continue the entire year, the cost will be approximately $4,000 (based on current reimbursement rate) and will be funded through IDEA funds.

ORDER NO. 17501 SBARC (Item 6-L)

707 KAR 1:320 Individual Education Programs, Section 1 Individual Education Programs and Section 5 contents of IEP; KAR 1:350 Placement Decisions, Section 1 Placement Decisions (Statutory Authority: KRS 156.070 (1), 156.160, 157.220,

157.224, 157.260, and 167.015). SIGHTS is a collaborative educational and mental health program designed to provide a therapeutic environment for children whose emotional, social, and educational needs cannot be met in less restrictive settings. The programs’ target population includes children whose primary needs are emotional/social in nature. SIGHTS represent the most intensive (day treatment) program currently available to Floyd County students. Only children who demonstrate a clear inability to function successfully in less intensive and restrictive school settings will be considered for admission. Programs are operating at McDowell Elementary School, Adams Middle School, and the Renaissance Learning Center.

ORDER NO. 17503 Health Care Professionals (Item 6-N)

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to approve contracting with Home Health Care Services of Pikeville, KY to place health care professionals in the District for 2012-2013.

KRS 160.190 Duties and Powers of the Board and 707 KAR 1:320 Individual Education Program, Section 6. The district has students who for the 2012-2013 school year require specific health care services in order to receive a free appropriate public education. The district will bill Medicaid on actual cost depending upon the rate of pay for the professional performing the service at a rate of 73% of the district cost. This is based on a rate of $30.00 an hour. The contractor requires one month prepayment for services. Any funds not used in a month will be applied toward the next month.

ORDER NO. 17504 Policies 03.1232 and 03.1223 (Item 6-O)

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to approve the second reading of Amendments to Policies 03.1232 (Certified Sick Leave) and 03.1223 (Classified Sick Leave).

01.11. This is the first part of a plan to enhance employee compensation and benefits and was presented at the budget meeting in May. This change will permanently provide one (1) additional sick day to every full time employee in the district and create the employee Attendance Incentive Program.

ORDER NO. 17505 Coco-Cola Equipment (Item 6-P)

BOE Policy 01.1. The district has accepted the proposal from Coca-Cola to provide soft drinks. Part of the process is the placement of equipment to distribute the soft drinks via vending machines. This agreement has been reviewed by the board attorney and amended per his direction.

ORDER NO. 17507 Highland Regional Medical Center Agreement (Item 6-R)

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to approve the limited contract for services Memorandum of Agreement between Mountain Comprehensive Care Center and Floyd County Schools for Therapeutic Rehabilitation Services known as SIGHTS Program for 2012-2013 School Year.

There was an affirmative vote by all board members present to approve the motion. The motion carried.

KRS 156.502 and KRS 158.838. Approve limited contract for services with Highland Regional Medical Center (with Debbie Ousley, RN, MSN, CDE (Certified Diabetic Educator) as service Provider) for the 2012-2013 school year to meet student health needs and comply with Kentucky Regulatory Statutes. The cost of the initial Glucagon injection training session for each participant is $25.00. A fee of $25.00 will be charged for follow-up training, if it is needed. The number of participants trained depends upon the need and it is, therefore, difficult to predict a total amount. The cost for training will be taken from the Health Services budget of the general fund. Consideration will be given if a Principal requests the training of more than two staff members.

ORDER NO. 17508 Registered Nurse Service (Item 6-S)

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to approve the agreement between Floyd County Health Department and Floyd County Schools to provide Registered Nurse in several schools for the 2012-2013 School Year.

KRS 160.190 Duties and Powers of the Board: 01.11. The agreement with the Floyd County Health Department (FCHD) is an opportunity to develop a partnership to “enhance” the delivery of health services for the children of Floyd County. The agreement is to expand the program to several schools. The goal of the program is to expand services into all Floyd County Schools as determined by the success of the program. No budgetary cost to the district. Student insurance will be billed where applicable. The Floyd County School System agrees to provide space, phone service and access to bathroom facilities.

ORDER NO. 17509 Hepatitis B & Flu Vaccinations (Item 6-T)

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to approve the contract with Floyd County Health Department for Hepatitis B and Flu Vaccinations for the 2012-2013 School Year.

OSHA regulations. Hepatitis B vaccines are to be offered to any employee whose job duties would put them at risk to exposure to blood and other body fluids or post exposure. The flu vaccine is offered to employees who request this service. Approximately fifteen thousand ($15,000.00) dollars.

ORDER NO. 17510 Criminal Background Check (Item 6-U)

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to approve paying $10 criminal background check fee for all school volunteers.

KRS 161.148. Beginning July 1, 2012, the state will charge schools $10.00 for every criminal record requested. Volunteers are required to have a criminal background check. The Administrative Office of the Courts (AOC) has been covering the cost for nearly 20 years but, due to a budget reduction of $16.2 million, will now be passing part of the cost on to the schools and school districts. The $10 fee is discounted from the $20 for other customers of AOC. Districts have the option of either paying the fee or passing it on to the volunteer to pay. The estimated cost to the district will be $10,000. During the 2011-2012 school year, the district had 773 volunteers but the number has been as high as 1,000 in prior years.

ORDER NO. 17511 Tutor Position (Item 6-V)

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to approve creating a classified tutor position for Allen Central High School for the 2012-2013 School Year.

Allen Central High School requests to utilize ESS funds, Gear-Up Funds, and Title I Funds to hire a classified tutor position to work with students who are targeted for Career and College Readiness Interventions in Math, Reading, and Language Arts.

ORDER NO. 17512 Fundraiser (Item 6-W)

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to approve fundraiser for Allen Elementary School with Bumblebee Marketing for 2012-2013 School Year.

Board Policy 09.33 – all school-wide fundraising activities must be approved by the board. The funds raised during this event allow Allen Elementary School to purchase replacements for aging audio-visual equipment, computer peripherals, etc. it also allows Allen Elementary to help support extra-curricular trips and equipment needs. In the past, Allen Elementary has bought lockers, bleachers for the football field, playground equipment, banners for the buildings, etc.

ORDER NO. 17513 Criminal Background Check Service (Item 6-X)

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to approve the agreement between Floyd County Schools and Kentucky State Police for criminal background check services.

BOE Policy 01.11 General Powers and Duties of the Board. Floyd County Schools requires those working with the students to pass a criminal background check before working and/or volunteering with the students. There is not fee charged by the Kentucky State Police.

ORDER NO. 17514 Administrative Office of the Courts (Item 6-Y)

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to approve the agreement between Floyd County Schools and the Administrative Office of the Courts for Criminal Background Check Services.

BOE Policy 01.11 General Powers and Duties of the Board. A $10.00 fee will be paid by those wanting a criminal background check. To use the AOC to process criminal background checks, a prepaid account is required. As each background check is done, there will be a deduction from this account. Floyd County Schools will recoup the cost by charging those individuals $10.00 for the background check.

ORDER NO. 17515 PLATO (Item 6-Z)

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to approve the license agreement between Floyd County Schools and PLATO Learning, Inc. for Credit Recovery Software and Services.

BOE Policy 01.11 General Powers and Duties of the Board. Floyd County Schools has used Plato Recovery Software for the past two years at Renaissance Learning Center. Several students need to have the opportunity to make up individual classes when needed. Students will be able to catch up on classes missed due to failure or transfer, immediately upon need. Title I funds will be used to purchase the program.

ORDER NO. 17516 District Organizational Chart (Item 6-AA)

ORDER NO. 17517 FY 2012 Pre-Audit Annual Financial Report (Item 6-BB)

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to receive the FY 2012 Pre-Audit Annual Financial Report.

KRS 160.290 BOE Policy 01.11. The Pre-audit AFR is the financial report before adjustments for accounts payables (prior year billings) and accounts receivable (prior year receipts) are booked and any adjustments that may be necessary per the audit. Audit adjustments include accounting for and booking amounts in the Worker’s Compensation Self-Insurance reserve, sick leave payable reserve, and others as the auditor deems necessary. This report is only submitted for review and does not require any board action.

ORDER NO. 17518 Change Order #2 (Item 6-CC)

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to approve Change Order No. 2 for Allen Central High School Re-Roof Project (BG# 12-122).

Capital Construction Process 702 KAR 4:160. Consider/approval of Change Order No. 2 for the Allen Central High School Re-Roof Project (BG# 12-122). Staff and architect recommend approving Change Order #2. By approving the change order, it will extend contract of the Bri-Den Company, Inc. by four (4) weeks. The extra work will involve relocating a drain, also six (6) rooftop curbs, and cover holes in the decking with metal. This action will reduce the amount of penetrations in the roof, which will reduce potential leak issues. No additional cost.

ORDER NO. 17519 Student Handbook (Item 6-DD)

Mr. Stumbo made the motion and Ms. Gearheart seconded the motion to approve the draft for the Student Handbook and Code of Conduct for the 2012-2013 School Year.

The Floyd County Board of Education must approve any revisions and/or updates to comply with Kentucky Department of Education guidelines. KRS 160.295 and KRS 160.290 give the responsibility for the operation of Floyd County Schools to the local school board. The 2012-2013 Student Handbook and Code of Conduct reflects policies and procedures of Floyd County Schools and communicates other essential information. Adoption of the Student Handbook and Code of conduct as revised for the 2012-2013 school year is recommended. The estimated cost of printing copies for distribution will be approximately $10,000 and will come from the general fund.
