3. Announcements. John welcomed Tom Austin, Abell Elevator, as a new member of the committee 4. Adoption of Agenda. The committee adopted the agenda as posted on the website. 5. Approval of Minutes. The minutes from the December 19, 2011 conference call were adopted. 6. Personnel. Committee members were asked to review the Government Affairs Committee roster (Attachment 1) rosters and advise Amy of any corrections needed. John Karnash indicated that he would reach out to Pete Salavantis to discuss re-engagement with the committee.

7. NEII Government Affairs Committee Legislative Assignments. The committee was asked to review the GAC Legislative Assignments document posted on the website and advise Amy of any necessary corrections. John provided a general description of the process of state monitoring to give Tom and overview of how the GAC operates.
8. Schindler Elevator Corp. Legislative Monitoring Assignments.
(a) California – Ellen Widess is due to be confirmed 2/28/12. We are putting together a working group to discuss use of circular letters and other key issues in CA. Information was provided that the portable rides group in CA went to court over the use of circular letters. In addition, the GAC discussed the need to clarify the Leacox brothers representation of Otis versus the industry on the circular letter issue in order to move forward effectively. (b) Delaware. No update at this time. (c) Florida – Legislation to limit the applicability of A17.3 is under consideration. Amy and Brian will draft a letter to submit NEII opposition. (d) Georgia – The state is considering moving elevator inspection to the Department of Agriculture. No position on this proposal was discussed. (e) Idaho – NEII testified in opposition to a bill that would limit the application of A17.3. The bill, however was passed by the House committee. (f) Indiana – The state has begun discussions of 2012 IBC adoption. (g) Iowa – A Buy America bill is under consideration. (h) Louisiana – A meeting was held with Rep Wilmott, industry folks and other interested parties on developing a MEL bill for consideration. Amy will be meeting with Rep. Wilmott, EIWPF and local IUEC rep in March to discuss provisions of such a bill. Also, NEII provided a couple of suggestion for lobbyists to assist with this effort in LA. (i) Michigan – The Chief Inspector, Cal Rogler, has asked for a representative to sit on the code committee. John will follow-up with Lou Bialy. (j) New Jersey. No update at this time. (k) North Carolina. No update at this time. (l) Ohio – The state adopted A17.1 (2010), including references to A17.7. (m) Pennsylvania. No update at this time. (n) Virginia – Several Buy American bill under consideration. (o) Wisconsin – Continued hearing on licensing issues.
9. Otis Elevator Co. Legislative Monitoring Assignments. (a) Arkansas. No update at this time. (b) Connecticut. No update at this time. (c) District of Columbia – Feb. 22 will be a meeting of the Industrial Trades Board. (d) Kansas. No update at this time. (e) Maryland – Legislation is pending in the House and Senate to expand the numbers of seats on the Board and create a limited license for accessibility work. NEII® testified on the different bills, as well as in front of the Elevator Board on key issues. Betsy and Amy are attending a legislative dinner next week with key committee members, hosted by our lobbyists.

(f) Massachusetts – We submitted a letter in opposition to proposed amendment to rules related to installation and maintenance. (g) Missouri – The Elevator Board has gone into high gear after almost a year of dormancy. Many issues of concern were raised (some which were not expected) during the January meeting. There is a meeting of the Board tomorrow, but no draft recommendation on issues has been circulated. Will keep GAC posted. (h) Nevada – The Department stakeholder meeting to review the elevator regulations is scheduled for March 1. Peggy is drafting bullet points on industry issues and will circulate to GAC for review/comment. (i) New Hampshire. No update at this time. (j) New York – Amy did a comparison of a recent bill to the MEL. The bills are very similar, except that the NY proposal would significantly increase the penalties. Peggy will distribute the penalties section of the bill for review. Peggy will follow-up with Stateside to get additional information on the potential for this bill to move. NEII® may provide comments, depending on feedback. (k) New York City – Continued concerns about rules increasing fines. NYC has become more aggressive in this area, with some fines being imposed retroactively. Betsy will organize a working group to meet and discuss the issue facing us in NYC and explore strategies to resolve. All companies were asked to provide Betsy with names of their local people for NYC. (l) Oklahoma – Working with the EIWPF to oppose efforts that would gut the Elevator Safety Act. (m) Oregon. No update at this time. (n) Rhode Island. No update at this time. (o) Vermont. No update at this time. (p) Washington – Whistleblower bill has been resurrected and passed the Senate. We did not receive a Stateside alert until after the fact. We are in the process of hiring a lobbyist in WA to help kill or at least modify the bill before final passage..
10. ThyssenKrupp Elevator Corp Legislative Monitoring Assignments.
(a) Alaska. No update at this time. (b) Arizona. No update at this time. (c) Hawaii – Our bill to create a separate fund for elevator fees and secure seed funding for the program are moving through the process. We have testified in both the House and Senate. In addition, a bill to allow third party inspectors was introduced and NEII® provided comments in support. (d) Kentucky – The repeal of all safety codes without corresponding adoption of replacements has been resolved. Related to A17.7, the Inspection Supervisor said that the PBC will not be specifically adopted, but included by reference. (e) Minnesota. No update at this time. (f) Mississippi. MEL legislation has been introduced in both the House and the Senate. We will be providing comments to Gregg Rogers. (g) Puerto Rico. No update at this time. (h) South Carolina. No update at this time. (i) Texas – Has begun process for administrative rules to implement licensing requirements passed by legislature last year. (j) Utah. No update at this time.

(k) West Virginia – The industry continues to have licensing issues in the state. We have been working with the EIWPF to craft a legislative solution. We have agreed to allow LULAs to be included under a limited accessibility licenses, but recognize that this is an exception to our overall position on licensing.
11. KONE Inc. Legislative Monitoring Assignments. (a) Alabama. No update at this time. (b) Colorado. No update at this time. (c) Illinois – Working on the extension of the Elevator Act, which is set to expire in 2013. Khanh provided draft language to define a “major elevator company,” which the GAC approved for use. Khanh also outlined a proposal to rotate the Board Chair position so that no group could hold the seat for two consecutive terms, which was also accepted by the GAC. A bill has surfaced to provide additional exemptions for fraternal or vet groups to extend certificate of operations in those facilities to three years. (d) Chicago – The city has begun efforts to rewrite ordinances. (e) Maine No update at this time. (f) Montana. No update at this time. (g) Nebraska – Several bills held over from last year, as well as a new bill introduced to move the elevator inspections under the state Fire Marshall. The bills from last year are dead, with only the new bill expected to move. NEII working on proposed amendments to define the elevator division, etc. under the Fire Marshall. (h) New Mexico – Efforts on hold to draft an MEL bill until later this year. (i) North Dakota. No update at this time. (j) South Dakota. No update at this time. (j) Tennessee – Amy is going to Nashville to continue work with EIWPF on our bill. Meetings with key legislators have been scheduled for March 6-7. (k) Wyoming. No update at this time.
12. Performance Based Code (PBC) Project.
(a) Target state discussion. i. California – Dan Leacox indicated that Debbie Tudor is interested in meeting to discuss the remaining issues related to the PBC. ii. Washington, DC – Currently on hold. iii. Georgia – The Chief Inspector indicated action is expected in 2012, but we have seen no movement to date. iv. Massachusetts – Bob Rodophele is working to schedule a meeting with key policymakers to discuss this issue. vi. Michigan – Cal Rogler indicated a potential willingness to hold a briefing on the PBC. Lou will keep us informed.
(b) Website Review Group. Amy reported efforts on hold until after the peak of the state legislative season and will resume this summer.
(c) Amy indicated that the 50-State A17.1/A17.7 report and PBC adoption chart had not been updated since our January GAC/CCC meeting.
13. 2012 Lobbist Contract Update. Amy provided the GAC with an overview of current contracts, noting that all have been signed.

14. Model Elevator Law.
(a) The committee was asked to review the MEL Activity Chart updated by Gregg Rogers and posted on the GAC website.
(b) The committee was asked to review the State Activity Chart (Attachment 2) updated by Amy. It was noted that there was a typo in one of the columns that Amy will address.
15. Communication Tools. (a) MEL Tutorial for the website. Amy will work with Betsy Ceriello to develop various products that we can use for internal and external discussions. Draft will be provided to the GAC for review/comment. (b) New GAC Communication Tools. Amy will be participating in the NEII® Communications Committee later this week and will bring draft materials to the GAC for review.
16. GAC Budget Review.
(a) 2012 Budget. John provided an overview of our budget for Tom as the GAC reviewed the most recent numbers. (Attachment 3)
17. New Business.
(a) Meeting with EIWPF on 2010 finances. John indicated that he has received a copy of the financials, but has not been able to set a meeting date yet.
18. Next Meeting Dates.
(a) GAC conference call April 17, 2012 from noon-2pm (b) NEII® Board meeting April 24, 2012 in Morristown, NJ. (c) GAC conference call May 18, 2012 from 3pm-5pm.
