In exercIse of the powers conferred under sectIon 4 of the emergency powers Act, chApter 88 for the purposes of sectIon 17 of the constItutIon, the cAbInet of grenAdA mAkes the followIng regulAtIons–
(Gazetted3rdSeptember,2021).
1. Citation and commencement.—(1)TheseRegulationsmaybecitedasthe
EMERGENCYPOWERS(COVID-19)(NO.3)REGULATIONS,2021.
(2)TheseRegulationsshallcome into forceon the4thdayofSeptember,2021andexpireat11:59p.m.onthe21stdayofSeptember,2021.
2. Scope and application.—(1)TheseRegulationsshallnotapplyinthecaseofamedicalemergency.
(2)Regulation4shallnotapplyinthecaseofapersonwhoistravellingoutofthejurisdiction,inrespectofthedateoftravel.
(3) Where there is any inconsistency between the provisions of theseRegulationsandthePublicHealth(COVID-19)Regulations,2020,theprovisionsoftheseRegulationsshallprevailtotheextentoftheinconsistency.
3. Definitions.IntheseRegulations–
“curfewperiod”meanstheperiodofcurfewunderregulation4(1)and(2);
“essentialworker”means–
(a) amemberoftheRoyalGrenadaPoliceForce;
(b) a worker of the National Disaster ManagementAgency, or anypersonauthorisedbytheNationalDisasterManagementAgency;
(c) anofficerofHerMajesty’sPrison;
(d) anofficeroftheCustomandExciseDivision;

(e) anofficeroftheAccountant-General’sDivision;
(f) anofficeroftheMinistryofSocialServices;
(g) anofficeroftheOfficeofthePrimeMinister;
(h) anofficeroftheMinistryofNationalSecurity;
(i) anofficeroftheMinistryofAgriculture;
(j) a worker, director or manager of waste disposal and sanitationcompanies;
(k) aworker,directorormanagerofanyhospitalorhealthcare,medical,residentialcareestablishmentorfacility;
(l) aworker,directorormanageroftheAirportsAuthorityandPortsAuthority;
(m)an officer essential to the operations of the water sector or theelectricitysector;
(n) an officer essential to the operations of the telecommunicationsectororanyothersectorencompassingtheprovisionofelectroniccommunications;
(o) anofficeressentialtotheoperationsofanyprintorelectronicmediahouse;
(p) a private caregiver for the elderly or disabled, as authorised inwritingbytheCommissionerofPolice;and
(q) a registered or bona fide fishermen or farmer, as authorised inwritingbytheCommissionerofPolice;
(r) the Registrar of the Supreme Court, the Resident Judges of theSupremeCourtandtheMagistrates;
(s) theworkersoftheGovernmentPrinter;
(t) aworkerorofficerofanyotherDepartmentorMinistryorofficerorcategoryofofficersorworkersas–

(i) in the case of public officers, directed by the Secretary to theCabinet;
(ii) in anyother case, approved inwritingby theCommissioner ofPolice,
andanyotherofficerorcategoryofofficersasdirectedbytheSecretarytotheCabinet;
“grocerystore”includesasupermarketandashopthatsellgroceries.
4. Restriction on freedom of movement.—(1) Subject to sub-regulation (2),beginningat7:00p.m.onthe4thdaySeptember,2021acurfewshallbeimposeddailyfromthehoursof7:00p.m.andendingat5:00a.m.thefollowingday,andduringthisperiod everyperson shall remain confined to their placeof residence (inclusiveoftheiryardspace)toavoidcontactoutsideofhisorherhousehold,exceptasprovidedintheseRegulationsorasmaybeauthorisedinwritingbytheCommissionerofPoliceinconsultationwiththeChiefMedicalOfficer.
(2)Notwithstandingsub-regulation (1), there shallbeacurfewduring thefollowingperiods–
(a) from5:00p.m.onFridaythe10thdayofSeptember,2021to5:00a.m.onMonday13thSeptember,2021;
(b) from5:00p.m.onFridaythe17thdayofSeptember,2021to5:00a.m.onMonday20thSeptember,2021,
andduringthoseperiodseverypersonshallremainconfinedtotheirplaceofresidence(inclusiveoftheiryardspace)toavoidcontactoutsideofhisorherhousehold,except–
(i) forthepurposesofbeingvaccinatedortestedforCOVID-19;
(ii) asprovidedintheseRegulations;or
(iii)asmaybeauthorisedinwritingbytheCommissionerofPoliceinconsultationwiththeChiefMedicalOfficer.
(3)Freedomofmovementmaybeexercised–
(a) from5:00 a.m. to 6:59p.m. eachday in accordancewith theseRegulations,subjecttoparagraph(b);and

(b) atnotimeintheperiodsspecifiedundersub-regulation(2)duringwhich periods there shall be nomovement, except as providedtherein.
(4) Notwithstanding sub-regulations (1) and (2), an essential worker ispermittedfreedomofmovementforthepurposeofundertakingaserviceessentialtotheiroperations.
(5)Notwithstandingsub-regulations(1)and(2),theCommissionerofPolicein consultationwith the ChiefMedical Officermay grant written permission to apersonorbusinesstooperateduringthecurfewperiod.
5. Shelter in place.InanefforttopreventthespreadofCOVID-19,everypersonshall remain confined to their place of residence (inclusive of their yard space) toavoidcontactoutsideoftheirfamilyexcept–
(a) essentialworkersreportingtowork;
(b) workersreportingtoworkinaccordancewithregulation9or10;
(c) for essential travel to an establishment, business or office exemptedunderregulation9(1);
(d) allMembers of Parliament, theAttorney-General and theDirector ofPublicProsecution;
(e) for outdoor exercise,whether aloneor togetherwith familymemberslivingunder thesameroof,notexceedinganhourandahalfperdaybetweenthehoursof5:00a.m.to6:00p.m.
6. Requirement to wear masks in public.—(1)Nopersonshall,withoutreasonableexcuse,beinapublicspacewithoutwearingafacemask,faceshieldorfacecoveringinamannerthatcovershisorhermouth,noseandchin.
(2)Nopersonshall,withoutreasonableexcuse,beinamotorvehiclewithanother personoutside of his or her householdwithoutwearing a facemask, faceshieldorfacecoveringinamannerthatcovershisorhermouth,noseandchin.
(3)Where the person under this regulation is a child accompanied by anindividualwhohasresponsibilityforthechild,theindividualshallprovideandensurethatthechildhasandwearsthefacemask,faceshieldorfacecoveringasrequiredbythisregulation.

(4)Theowner or operator of anybusiness, establishment or officewhichprovidesgoodsorservicestothepublicshallensurethatamemberofthepublicisnotpermittedentryto,ordoesnototherwiseremainwithin,anyenclosedspacewithinthepremisesofthebusiness,establishmentoroffice,unlessthememberofthepubliciswearingafacemask,faceshieldorfacecovering,inamannerthatcovershisorhermouth,noseandchin.
(5)Sub-regulations(1)to(4)shallnotapplyto–
(a) childrenundersevenyearsofage;
(b) anemployeeoragentofthepersonresponsibleforthebusiness,establishmentorofficewithinanareadesignatedfortheemployeeoragentandnotforpublicaccess,orwithinorbehindaphysicalbarrier,ifthereisnootherpersonintheareaandsubjecttosuchguidelinesmadebytheMinistryofHealth;and
(c) those circumstances provided for in guidelines made by theMinistryofHealth.
(6) For the purposes of sub-regulations (1) and (2), the circumstances inwhichapersonhasareasonableexcuseincludewhere–
(a) thepersoncannotputon,wearorremoveafacemask,faceshieldorfacecovering–
(i) because of any medical, physical or mental illness orimpairment,ordisabilitythatinhibitshisorherabilitytowearafacemask,faceshieldorfacecovering;or
(ii) withoutseveredistress;
(b) theperson is travellingwith,orprovidingassistance to,anotherpersonandsuchotherpersonreliesonlip-readingtocommunicatewiththefirstperson;
(c) the person removes his or her face mask, face shield or facecoveringtoavoidharmorinjury,ortheriskofharmorinjury,tohimselforherselforothers;
(d) thepersonistravellingtoavoidinjury,ortoescapeariskofharm,anddoesnothaveafacemask,faceshieldorfacecoveringwithhimorher;

(e) if it is reasonably necessary for the person to eat or drink, thepersonremoveshisorherfacemask,faceshieldorfacecoveringtoeatordrink;
(f) thepersonhastoremovehisorherfacemask,faceshieldorfacecoveringtotakemedication;
(g) arequestismadeofthatpersontoremovehisorherfacemask,faceshieldorfacecoveringtemporarilyforsecurityandidentificationpurposesifnecessaryforthepurposeofreceivingservices;or
(h) the circumstances are provided for in guidelines issued by theMinistryofHealth.
(7)Subject to theexemptions insub-regulation(5) (b),anemployeeshallwearafacemask,faceshieldorfacecoveringwhenworkinginanenclosedpublicspace.
(8)Sub-regulation(1)doesnotapplytoapersononabeach,riverorpublicpark,ifheorshemaintainsphysicaldistancingofnolessthansixfeet(6ft.)toanypersonoutsideofhisorherhousehold.
7. Physical distancing and sanitisation protocols for establishments.—(1)Everyestablishmentshall–
(a) ensure thatallcustomersandstaffmaintainphysicaldistancingofnoless than six feet (6ft.) in or outside their business, establishment oroffice;
(b) determinethenumberofpersonsthatmaybepermittedinthebusiness,establishment or office at any one time by permitting one person foreverythirtysquarefeet(30sq.ft.)ofstorespace;
(c) place distance markers six feet (6 ft.) apart, indicating where eachcustomermuststandonalineatacheckoutpoint;and
(d) placedistancemarkerssixfeet(6ft.)apartontheoutsideofthebusiness,establishment or office, indicatingwhere customersmust standwhilewaitingtoenterthebusiness,establishmentoroffice.
(2) Every business, establishment or office, including operators of motoromnibuses,hiringcarsandtaxis,shalladministerorensuresanitisationofthehandsofeverypersonuponentryintothebusiness,establishmentoroffice.

(3) Employees of a hospital or health care, medical, residential careestablishmentorfacilityandmembersoftheRoyalGrenadaPoliceForceshalltakereasonablestepstocomplywiththerequirementsundersub-regulations(1)and(2),unlessitisreasonablyimpracticable.
8. Work remotely from home.—(1)A business, establishment and officemaycontinue its businessoperationsby allowing its employees towork remotely fromhome utilising virtualmeans, unless their employees are permitted towork underregulation9or10ortheiremployeesareessentialworkers.
(2)Where a business is unable to continue its business operations by itsemployees working remotely from home, the business shall suspend or cease itsoperations.
9. Operation of establishments, businesses and offices.—(1)Everyestablishment,businessandofficeshallremainclosedexceptforthefollowing–
(a) offices of the Government, Statutory Bodies and State-ownedEnterprises;
(b) wholesaleor retailgrocery storesandcommercialbakeries,operatingbetweenthehoursof6:00a.m.and5:00p.m.;
(c) manufacturesand suppliers,whichmayoperatebetween thehoursof6:00a.m.and5:00p.m.;
(d) offices of registered medical practitioners, dental practitioners andopticians,operatingbetweenthehoursof6:00a.m.and5:00p.m.andbyappointmentonly;
(e) hospitalsandmedicalfacilities;
(f) medicalsupplyestablishments,operatingbetweenthehoursof6:00a.m.and5:00p.m.;
(g) pharmacies,operatingbetweenthehoursof6:00a.m.and5:00p.m.andwithonlypick-upanddeliveryservices;
(h) gasstations,operatingbetweenthehoursof6:00am.and5:00p.m.;
(i) hardwarestores,operatingbetweenthehoursof6:00a.m.and5:00p.m.andwithonlypick-upanddeliveryservices;

(j) hotels,therestaurantsofwhichmayofferonlytakeawayorroomservice;
(k) banks,creditunionsandmoneyservicesbusinesses,operatingbetweenthehoursof6:00a.m.and5:00p.m.;
(l) commercialportsandrelatedbusinesses,operatingbetweenthehoursof6:00a.m.and5:00p.m.,subjecttoanyvariationbythePortsAuthority;
(m)airports;
(n) commercialcourierflights;
(o) foodvendorsand restaurantsofferingdrive-thruor takeawayservicesonly,operatingbetweenthehoursof6:00a.m.and5:00p.m.;
(p) registeredorbona fidefishermen,farmersandbutchersengagedintheirbusiness;
(q) veterinariansengagedintheirtrade,operatingbetweenthehoursof6:00a.m.and5:00p.m.;
(r) accountantsengagedintheirtrade,operatingbetweenthehoursof6:00a.m.and5:00p.m.andbyappointmentonly;
(s) insurancecompanies,operatingbetweenthehoursof6:00a.m.and5:00p.m.andbyappointmentonly;
(t) law offices and attorneys-at-law engaged in their trade, operatingbetweenthehoursof6:00a.m.and5:00p.m.andbyappointment;
(u) works of construction for urgent plumbing, electrical, roof repairs orother emergency repairs for a home or business, and other works ofconstructionasauthorisedbythePermanentSecretarywithresponsibilityforWorksinaccordancewithallconditionstosuchauthorisation;
(v) laundromats,operatingbetweenthehoursof6:00a.m.and5:00p.m.;
(w) landscapersandgardenersengagedintheirbusiness,operatingbetweenthehoursof6:00a.m.and5:00p.m.;
(x) flowershops,operatingbetweenthehoursof6:00a.m.and5:00p.m.andwithonlypick-upanddeliveryservices;

(y) companiesofferingpaydayloans,operatingbetweenthehoursof6:00a.m.and5:00p.m.;
(z) businesseslicensedtoprovidesecurityguardservices;
(aa)theSaintGeorge’sUniversity;
(bb)suchotherbusinessesorundertakingsasmaybespecificallyexemptedinwritingbytheCommissionerofPolice,
providedthattheowneroroperatoroftheestablishmentspecifiedinparagraphs(a)to(bb)shall–
(i) complywithphysicaldistancingandsanitisationprotocolsinaccordancewithregulation7;
(ii) comply with any other conditions imposed by the Commissioner ofPoliceonthedirectionoftheCabinet;
(iii)comply with the requirements to wear masks in accordance withregulation6;and
(iv)besubjecttoregulation4(2).
(2) If the manager, owner, other person in charge or employee of anyestablishment, business or office exempted under sub-regulation (1), aids, abetsor facilitates the contravention of these Regulations, the establishment shall beimmediatelyclosedwithoutprejudicetoanyotherpenaltyinlaw.
(3)Thereshallbenoconsumptionofalcoholinorinthevicinityofanyshop,grocerystoreorestablishmentorinanypublicplace.
10. West Indies Associated States Supreme Courts and Magistrate’s Courts.—(1)Subject tothePracticeDirectionsof theEasternCaribbeanSupremeCourt, theWestIndiesAssociatedStatesSupremeCourtshallremainaccessibleandshalladheretophysicaldistancingandsanitisationprotocolsinaccordancewithregulation7.
(2)SubjecttorulesornoticesmadeorissuedpursuanttotheMagistratesAct,Chapter177,theMagistrate’sCourtshallremainaccessibleand–
(a) shall adhere to physical distancing and sanitisation protocols inaccordance with regulation 7, including the conduct of virtualhearings;and

(b) the persons employed within the public service shall workremotelyfromhomeasfarasreasonablypracticable.
11. Education instruction.—(1) Educational institutions may only operate asauthorised by the Minister with responsibility for Education which may includeoperationsremotelybyutilisingvirtualmeans.
(2)Allday-carecentresshallbeclosed.
(3) For the avoidance of doubt, sub-regulation (1) does not restrict anyactivityreferredtothereinbyelectronicorvirtualmeans.
(4) This regulation shall not apply in respect of the campus of the SaintGeorge’sUniversity.
12. Religious instruction.—(1)Allplacesofreligiousinstructionshallbeclosed.
(2) For the avoidance of doubt, sub-regulation (1) does not restrict anyactivityreferredtothereinbyelectronicorvirtualmeans.
13. Restriction on social activities and funerals.—(1)Nopersonshallhostorattendanysocialactivityofanydescription,includingawedding.
(2)Nopersonshallhostorattendafuneralceremony–
(a) hostingmorethantwentypersonsinadditiontotheofficiantandessentialmortuarystaff;or
(b) commencingearlierthan9:00a.m.,concludinglaterthan12noon,orlastingformorethanonehour.
(3) For the avoidance of doubt, there shall be no wakes or happy houractivities.
14. Restriction on beaches and rivers.—(1)Subjecttoregulation4(2),beachesandriversmaybeaccessedasfollows–
(a) between the hours of 5:00 a.m. and 10:00 a.m., except in a periodspecifiedunderregulation4(2);
(b) forswimmingandexerciseonly;and

(c) witheverypersonmaintainingphysicaldistancingofno less thansixfeet(6ft.)toanypersonoutsideofhisorherhousehold.
(2)Thereshallbenopicnic,partyorothergatheringatabeachorriver.
15. Restriction on domestic travel.—(1)InrespectoftravelbetweentheislandofGrenadaandtheislandofCarriacou,nopersonshallofferforhireorseektotravelonanyvessel,whetherbyairorbysea,except–
(a) fortransportoffreight;
(b) inthecaseofapersonwhoistravellingoutofthejurisdiction;or
(c) fortravelessentialfortrade,
andwiththeapprovalofthePortsAuthorityortheAirportAuthority,asthecasemaybe.
(2) In respect of travel between the island of Grenada and the island ofCarriacou,nopersonshallenteravesselunlessheorshehassubjectedhimselforherselftoarapidtestandtheresultoftherapidtestisnegative.
(3)Forthepurposesofthisregulation,“rapidtest”meansanIgM/IgGrapidtestconductedtodiagnosewhetherapersonhasbeeninfectedwithSARS-CoV-2orCOVID-19.
(4) For the avoidance of doubt, this regulation does not apply to travelbetweentheislandofCarriacouandtheislandofPetitMartinique.
16. Restriction on road traffic.—(1)Nopersonshalldriveavehicleonanypublicorprivateroadexceptforapurposeexemptedunderregulation2(2)or5.
(2)TheRoyalGrenadaPoliceForceshallhavepowerstostopanyvehicleandinquireastothepurposesforwhichthatvehicleisbeingutilised,andtoarrestanyonefoundinviolationofthisrestriction.
(3)Forthepurposesofthisregulation,“vehicle”includesamotorvehicleormotorbike.
17. Public transportation.—(1)Fortheavoidanceofdoubt,regulations6(2)and7shallapplyinrespectofeverymotoromnibus,hiringcarandtaxi,andeverypersontravellinginanymotoromnibus,hiringcarortaxishallpractisegoodhandhygieneandpropersanitarybehaviourandwearafacemask,faceshieldorfacecovering.

(2)Nopersonshalleatordrinkwhiletravellinginanymotoromnibus,hiringcarortaxi.
(3)Operatorsofmotoromnibuses,hiringcarsandtaxismayonlyoperateasauthorisedbytheCommissionerofPoliceactingonthedirectionoftheCabinet.
(4) In this regulation, “motor omnibus”, “hiring car” and “taxi” have themeaningsassignedundertheRoadTrafficAct,Chapter289A.
18. Restriction on visitation.Nopersonshallvisitorbepermittedtovisit–
(a) anyplaceofquarantineorisolationstation;
(b) a patient in a hospital or residential care establishment or facility,includinganelderlynursinghome;
(c) ahospital;or
(d) adetaineeinaprison.
19. Mandatory reporting and isolation.—(1)Anypersonwhoisexhibitinganyflu-like symptoms shall immediately notify a police station in his or her parish inaccordancewiththeParishBoundariesAct,Chapter224.
(2)Anypersonwhohasobservedthatanyotherpersonisexhibitingflu-likesymptoms shall notify a police station in his or her parish in accordancewith theParishBoundariesAct,Chapter224.
(3)Anypersonwhoknowinglymakesafalsereportforthepurposesofsub-regulation(2)shallbeguiltyofanoffence.
(4)Anypersonwho is askedby anyofficial of theMinistry ofHealth tosubmithimselforherselftoanytestingforCOVID-19shallsubmittosuchtesting.
(5)AnypersonwhoisdirectedbytheMinistryofHealthtosubmithimselforherselftoself-isolationorquarantineshallcomplywiththedirection.
(6) For the purposes of this regulation, the Ministry of Health shall becontactedusingtheCOVID-19Helplinesattelephonenumber458-4787or538-4787.
20. Powers of the Chief Medical Officer.WhereitappearstotheChiefMedicalOfficer thatabusiness,establishmentorofficeisnotcomplyingwith theprotocolsunder thePublicHealth (COVID-19)Regulations,2020,SRONo.59of2020, the

ChiefMedicalOfficermaydirecttheclosureofthebusinessorestablishmentforaperiodnotexceedingsevenbusinessdays,tofacilitatethetrainingofthemanagementandstaffinordertoensurethatthebusiness,establishmentorofficecomplieswiththePublicHealthprotocols.
21. Duty and powers of Police Force.—(1)Itshallbethedutyofeverypoliceofficer to enforce (using reasonable force if necessary) compliance with theseRegulations and with any order, instruction or condition lawfully made, given orimposedbyanyofficerorotherpersonundertheauthorityoftheseRegulations,andforsuchpurposeanypoliceofficermayenteranypremiseswithoutawarrant.
(2)AnypoliceofficermayarrestwithoutawarrantanypersonwhomheorshehasreasonablecausetobelievehascommittedanoffenceagainsttheseRegulations.
22. Penalty.—(1) A person who contravenes or fails to comply with theseRegulations,oranydirectionforthepurposesoftheseRegulations,shallbeguiltyofanoffenceand,onsummaryconviction,isliabletoafinenotexceedingonethousanddollarsandtoimprisonmentforatermnotexceedingtwelvemonths.
(2)Withoutprejudicetosub-regulation(1),apersonwhocommitsanoffenceisliableonserviceofafixedpenaltynoticebyapoliceofficer,ifthepersonsochooses,toafixedpenaltyoffivehundredandfiftydollars.
23. Fixed penalty notice.—(1)Whereapoliceofficerhasreasontobelievethatapersonhascommittedanoffencespecifiedunderregulation22(1),thepoliceofficermaydirectthepersontostatehisorhertruenameandplaceofresidenceandserveuponthepersonafixedpenalty.
(2)A person who refuses to comply with sub-regulation (1) commits anoffence.
(3)Whereapoliceofficerhasservedafixedpenaltynoticeuponaperson,thepoliceofficershall–
(a) chargethepersonwiththecommissionofanoffence;and
(b) notifythepersonthat,ifheorshedoesnotwishtobeprosecutedfor theallegedoffence incourt,heor shemaypay to theclerkoftheMagistrate’sCourtinthedistrictinwhichtheoffencewascommittedthefixedpenaltyprescribedfortheoffenceinthefixedpenaltynoticewithinthetimespecified.

(4)Apersonuponwhomafixedpenaltynoticeisservedmaydeclinetobedealtwithunder regulations23 to27andwhereheor she fails topay thefixedpenaltywithinthetimespecifiedinthefixedpenaltynotice,orwithinsuchfurthertimeasmaybeallowedinaparticularcase,hisorherconductconstitutesadeclinationtobedealtwithunderregulations23to27.
(5)Apoliceofficershallserveafixedpenaltynoticepersonallyuponapersonallegedtohavecommittedanoffencespecifiedunderregulation22(2)andshallsendaduplicateofthefixedpenaltynoticetotheMagistrate’sCourtofthedistrictinwhichtheoffenceisallegedtohavebeencommitted.
(6)Wherethefixedpenaltyisnotpaidwithinthetimespecifiedinaccordancewithregulation25(2),theduplicatesenttotheMagistrate’sCourtundersub-regulation(5)shallconstituteacomplaintlaidbeforetheMagistratetoinstituteproceedingsinaccordancewiththeCriminalProcedureCode,Chapter72B.
(7)AfixedpenaltynoticeshallbesignedbythepoliceofficerandshallbeinthemannerspecifiedundertheSchedule,specifyingthefollowing–
(a) thedate,timeandplaceofserviceofthefixedpenaltynotice;
(b) the provision of theseRegulations creating the offence alleged,and such particulars of the offence as are required under theseRegulations;
(c) theamountofthefixedpenalty;
(d) thetimewithinwhichthefixedpenaltymaybepaidinaccordancewithregulation25(2);and
(e) theclerkoftheMagistrate’sCourttowhom,andtheaddressatortowhich,thefixedpenaltymaybepaidorremitted.
24. Payment of fixed penalty.—(1)PaymentofthefixedpenaltyshallbemadetotheclerkoftheMagistrate’sCourtasstatedinthefixedpenaltynotice,andshallbedealtwithinthesamemanneraspaymentofafineimposedforanoffenceundertheCriminalProcedureCode,Chapter72B.
(2)Paymentofthefixedpenaltyshallbeaccompaniedbythefixedpenaltynoticewhichshallbecompletedbythepersoninthemannerprescribed.

25. Payment of fixed penalty precludes prosecution.—(1)Apersonuponwhomafixedpenaltynoticeisservedmaypaythefixedpenaltyinaccordancewiththefixedpenalty notice.
(2)Thetimewithinwhichafixedpenaltyispayableisthirty-onedaysfromthedateofthefixedpenaltynotice.
(3)Where the fixed penalty is paid in accordancewith the fixed penaltynotice,nopersonshall thenbe liable tobeconvictedfor theoffenceforwhichthefixedpenaltynoticewasservedandthecomplaintlaidbeforetheMagistrateshallbenullandvoid.
26. Certificate of payment or non-payment of fixed penalty.Inanyproceedingsfor an offence specified under regulation 22 (2), a certificate that payment of thefixedpenaltywasorwasnotmadetotheclerkoftheMagistrate’sCourtbythedatespecifiedinthecertificateshall,ifthecertificatepurportstobesignedbysuchclerk,besufficientevidenceofthefactsstated,unlessthecontraryisproved.
27. Consequence of failure to pay.Whereafixedpenaltyisnotpaidwithinthetime specified in accordancewith regulation 25 (2), proceedings in respect of theoffencespecified in thefixedpenaltynoticeshall thereafterproceed in themannerprescribedbytheCriminalProcedureCode,Chapter72B.
28. Repeal and transitional provisions.—(1)TheEmergencyPowers(COVID-19)(No.2)Regulations,2021,SRONo.35of2021isherebyrepealed.
(2) Every approval granted under regulation 7 of the Emergency Powers(COVID-19)(No.2)Regulations,2021isherebyrevoked.
(3)Fortheavoidanceofdoubt,thereremainsineffectacurfewfrom9:00p.m. on the 3rd day of September, 2021 and ending 5:00 a.m. on the 4th day ofSeptember,2021.
