The woman, who works as a hotel maid, told

officers that she wanted to spend the night at a

hotel where she had previously worked.

About 2:30 a.m., Graves drove the woman to

the hotel, where she went to her room alone

and fell asleep, authorities said.

Fifteen minutes later, the woman heard knocking and opened the door.

"The defendant entered the room, grabbed the victim forcibly and pushed her onto the

bed," Sgt. Craig Storlie, a San Jose police internal affairs investigator, wrote in an affidavit.

Graves then "took off parts of his uniform with the exception of his bulletproof vest,"

climbed on top of the struggling woman and raped her, Storlie wrote.

The woman reported the incident in October, prompting an investigation by San

Jose police.

"Physical evidence corroborates the victim's allegations," and the woman identified Graves

as the attacker, prosecutors said.

Graves surrendered Monday and was booked into county jail, San Jose police said. He

posted $100,000 bail and is on paid administrative leave.

"We take enormous pride in the quality of our law enforcement officers in this county,"

District Attorney Jeff Rosen said. "Although rare, on-duty misdeeds bestow an unjustified

blight on the stellar reputation of our hard-working peace officers. The defendant will be

held accountable for his unlawful actions."

Police Chief Larry Esquivel called the case one that "tugs at our integrity," but added that

"it is an isolated incident."

Dash cams and body cams that are on 100% of the time while on duty. Random review of footageby civilian review committee. Discipline for being an jack hole to the public, including breakingtraffic laws without an emergency. Automatic termination if they take them off while on duty. Goodcops still get to be good cops. Bad cops are watched all of the time and will be caught. They arepublic servants, not overloards.

@pc487 I would like to add that in any criminal trial, the judge would have to advisejurors to take into consideration the credibility of police testimony if not backed upwith video evidence if the officers' bodies/cars are equipped with cams. The witnesswould have to convince the jury that the cam was not turned on for a VERY goodreason.

100% of the time? Even when they're using the toilet? Or on a lunch break, and say,on the phone talking to their spouse? I think that even officers have a right to someprivacy.

The ONLY isolated incident is when these scumbags don't get away with what they do to humanbeings ALMOST EVERY DAY. The are jealous of the higher life form that is a human being.

As a long time resident of San Jose I really dislike the turn the police department is taking. Haveyou seen the recruitment ad they aired recently? Aside from terrible production values and atotally hokey quality, it showed a team of battle dressed cops descending on a warehouse likeNavy Seals looking for Bin Laden and they heroically arrest an old man with a gun. The kind ofpeople they are trying to attract are those that want to be armed to the teeth and feel superior tothe people they... » more

@fladabosco And what kind of horrible, crappy, putrid, amateurish, idiotic numbnutsdecided that viafoura was good technology? What garbage. Those of us with SiliconValley experience know that the problems with viafoura are from either laziness, lackof care, poor leadership and just low quality standards, both from viafoura andanyone who would use their technology. Just the worst.

This police officer's behavior is beyond comprehension, is unforgiveably reprehensible, and is justflat out spiritually and socially immoral. This guy needs to be incarcerated with the worse of theworse, and let prison justice mete out its justice. The only pension reform that needs to beadopted is outright forfeiture whenever ANY PSO is convicted of felonious crimes.
