KELAB GOLF NEGARA SUBANG

GENERAL BYE-LAWS

INTERPRETATION

BYE-LAWS Shall mean the general bye-laws herein contained and such amendments as may be

approved by the COMMITTEE from time to time.

COMMITTEE Shall mean the Management Committee elected by the members of the Club, referred to as

such in short.

APPROVAL Approval or permission of the COMMITTEE shall be vested in the Captain and such

Members of the COMMITTEE, the Manager and such persons as may be authorized by

the Captain UNLESS approval or permission of the whole COMMITTEE is intended.

CLUB OR KGNS Shall mean Kelab Golf Negara Subang, referred to as such in short.

MEMORANDUM Shall mean the Memorandum of Association of the Club.

ARTICLES Shall mean the Articles of Association of the Club.

MEMBERS Shall mean Ordinary Members unless specifically stated otherwise.

THE SECRETARY Shall include the General Manager, and any person appointed to perform the duties of

Secretary temporarily.

WRITING Shall include printing and lithography or reproducing words in a visible form.

Words importing the singular number shall include the plural number, and vice versa, and words importing the

masculine gender where appropriate shall include the feminine gender.

Words importing persons shall include corporations.

The interpretation of the meaning of any word, clause or bye-law by the COMMITTEE Shall be final.

PART 1 – MEMBERSHIP

CANDIDATES FOR MEMBERSHIP:

1. The name and particulars of a candidate for membership shall be submitted in the Club’s official Application

Form by his Proposer or Seconder in person for registration with the General Manager or such other officer

of the Club as may be appointed by the COMMITTEE.

2. Save in special circumstances the COMMITTEE shall not consider a candidate’s application for membership

unless both the proposer and seconder shall,

(i) have been members of the Club for at least 2 years;

(ii) have not been suspended by the COMMITTEE for whatever reason and whatever period of time in the

preceding 12 calendar months; and

(iii) have not nominated more than 2 candidates in a year.

3. (i) Ordinarily a candidate for membership shall not be considered for election until a period of two months

have elapsed from the date of his name being registered UNLESS the COMMITTEE have approved

such shorter period. Subject to due compliance with the prescribed formalities and to Bye-Law 4, every

application for membership shall be considered by the COMMITTEE in order of its receipt by the Club.

However, priority shall be given to serving government officers.

3. (ii) A child who has been registered with the Club for not less than 2 years by his/her parents may apply,

upon reaching the age of 18 years, to the Club for Ordinary Membership and be placed on the waiting

list, subject to the Bye-Laws of the Club existing at the time of application.

4. At any time before his election the name of a candidate for membership may be withdrawn:-

(i) by the candidate;

(ii) by the proposer or seconder; or

(iii) by the Committee

For the purpose of ARTICLE 10 a withdrawal by the Committee shall amount to rejection if the Committee at

the time of recording such withdrawal so declare but not otherwise.

5. The cessation of membership under ARTICLE 25 of proposer or seconder of a candidate for membership :

(i) in the event of cessation under paragraph (a) or (b) of such Article shall nullify such candidature unless

within seven days of such cessation any other Member shall become the proposer or seconder (as the

case may be) of the candidate;

(ii) in the event of cessation under paragraph (c) of such Article, shall not affect such candidature.

(iii) in any other event shall nullify the candidature.

6. The procedure for election of candidate shall be as follows :

(i) a list of the candidates for election shall be given to all members of the Committee at least three clear

days before the meeting of the Committee for election.

(ii) at the meeting of the Committee for election members of the Committee wishing to vote for the election

of all or any of the candidates on the list shall do so by a show of hands, unless a poll is requested prior

to the voting by at least two members of the Committee present in person.

(iii) If at least five members of the Committee have voted in favour, all the candidates on the list except

those against whom any objection is made shall be elected;

(iv) any member of the Committee wishing to object to the election of any candidate shall state his objection

and reasons therefore and such objection shall be discussed by the Meeting;

(v) a candidate against whom any objection has been made shall:-

(a) be elected if at least five members of the Committee vote for him and not more than two vote

against him;

(b) be rejected if two or more vote against him;

(c) come up for election at the next meeting if less than five vote for him and less than two vote against

him;

(vi) written notice of the results of an election shall be given to the affected candidates within 30 days from

the date of the meeting at which such election takes place.

(vii) at the discretion of the Committee a newly elected candidate may not be confirmed unless he has paid

his entrance fee and all other dues in full and has also been introduced and obtained signatures of all

Committee Members present, normally by his proposer or seconder, within such period of time or at

such specially arranged introduction night as the Committee may decide. Those who fail to attend after

3 invitations without valid reasons may have their membership application revoked. The above

conditions do not apply to Term, Corporate and Junior members and are to be stated during the

interviews and in the offer letters.

(viii) all newly elected members are issued temporary cards until they have attended an introduction night.

Until such time, they are not eligible to use the golfing facilities. The above condition does not apply to

Term Members, Corporate Members and Junior Members, except that Junior Members who fail to

attend three subsequent Introduction Nights shall have such privilege revoked. (Ordinary Members

who joined before 1/1/1998 are exempted from attending introduction night – MC meeting 26/11/08)

7. Pending confirmation as laid down in Bye-Law 6 (vii), a newly elected member shall enjoy such rights and

privileges as may be accorded to him by the Committee from time to time except that such newly elected

member shall have no vote or voice in the affairs or management of the Club. He shall pay a fee equivalent to

the normal monthly subscription as well as such other fee that would be applicable to him if were a

confirmed member. All newly elected member would be issued temporary cards and will not be eligible to

collect their permanent membership cards and utilize the golfing facilities until such time.

8. In addition, a newly elected member shall pay for a Club Tie and a Club Blazer at such amounts as the

Committee may from time to time decide, prior to confirmation as laid down in Bye-law 6 (vii). Failure to do

so may result in the membership of such newly elected member being revoked at the discretion of the

Committee.

ENTRANCE FEE :

9. (i) The entrance fee for membership shall be RM25,000 or such larger sum as the Committee may at any

time decide, subject to Article 39 (Approved at EGM 15.2.2004).

(ii) The whole entrance fee or part thereof shall be paid in advance, as prescribed by the Committee from

time to time, by candidates for membership.

(iii) The whole entrance fee or part thereof, as the case may be, shall be refunded to unsuccessful candidates.

(iv) The entrance fee shall not be refunded to a confirmed member on his ceasing to be a member for any

reason whatsoever including a member who subsequently acquires the status of Honorary Membership

under Bye-Law 15 or under ARTICLE 11.

SUBSCRIPTIONS :

10. (i) The subscription payable by all members shall be RM100 per month or such larger sum as the Committee

may decide subject to Article 39 (EGM 15.2.2004).

(ii) Subscriptions shall be due on the first day of the month in respect of which they are payable.

(iii) A member (including lady members and privileged persons) on reaching the age of 70 years and who has

been a member for not less than 15 years, whichever is the later, shall on application, be exempted from

paying monthly subscription. (Approved by MC meeting on 26.5.1994 and AGM 26.6.1994).

(iv) A Junior member pursuing first degree course studying in foreign countries may on application and

approval from the Committee, be allowed to pay an annual subscription of RM200/- per calendar year,

provided that he/she shall pay a monthly subscription for the month(s) when he/she uses the club

facilities.

(v) All Ordinary Members who are studying or posted overseas (outside Asean countries) for a minimum

period of two years, may on application and approval from the Committee, be allowed to pay 50% of the

monthly subscription of an ordinary member at the current prevailing rate. Application shall be made in

the prescribed form, together with supporting documents as proof. (MC Meeting 3.1.2007).

REFUNDABLE DEPOSIT :

11. (i) All new members shall deposit with the Club a sum of RM2,000/- or such larger sum as the Committee

may decide to be applied to all members, except for Honorary Members. Where a member fails to pay

the deposit with such period of time as may be stipulated by the Committee for its payment, the

Committee may in its absolute discretion withdraw all credit facilities of the member with the Club

(EGM 15.2.2004).

(ii) The said deposit or any part thereof may at the absolute discretion of the Committee be utilized to settle

any outstanding account of a member with the Club. Where by reason of such utilization the said deposit

is completely or partially depleted a member shall on receiving notification of the same from the

Committee within such period as may be stipulated therein reimburse the Club the total sum so utilized.

Where a member fails to reimburse the Club within the said stipulated time, the Committee may in the

exercise of its absolute discretion unconditionally or subject to such terms and conditions as it deems fit

withdraw all credit facilities of the member with the Club.

(iii) If for any reason whatsoever any member shall cease to be a member of the Club he shall be entitled to a

refund in full, free of interest, of the said deposit or such part thereof as has not been applied by the

Committee pursuant to its above mentioned powers.

12. DEVELOPMENT FUND

All new members shall pay a Development Fund of RM2,000/- or such larger sum as the Committee may at

any time decide (EGM 15.2.2004)

13. INTER-CLUB SURCHARGE

All members including privileged persons shall pay an inter-club surcharge of RM2/- per month (AGM

25.6.1989). Senior members who are 70 years and above shall be exempted from paying inter-club

surcharge. (MC meeting 3.1.2007).

PART II – PRIVILEGED PERSONS

GENERAL :

14. (i) Every privileged person shall be bound by the Memorandum and Articles of Association of the Club, by

these Bye-Laws and by any other regulations as may be approved by the Committee, for the time being

in force.

(ii) Every privileged person shall be subjected to the control of the Committee and shall conform to the

lawful requirements and directions of the Committee.

(iii) The Committee shall have power to withdraw from any privileged person individually or from any class

of privileged persons as a class either for a definite period or indefinitely or permanently all or any of the

privileges accorded to such privileged persons or class of privileged persons. Such power shall be

exercisable whether or not the privileges arise in the rights of a Member.

(v) Privileged persons shall be divided into the following classes:-

A. Honorary Members (subject to Article 11)

B. Distinguished Persons.

C. Associate Members.

D. Visiting Members.

E. Members of the Family.

F. Lady Members.

G. Junior Members.

H. Corporate Members.

I. Newly Elected Members (refer Bye-Laws 6, 7 & 8).

J. Term Members.

K. Spouses of Deceased Members (MC 1/3/06)

HONORARY MEMBERS :

15. (i) The Committee may elect any person to be an Honorary Member of the Club. An Honorary Member

shall enjoy all the rights and privileges of membership of the Club, except that he or she shall have no

voice or vote in the affairs or management of the Club nor shall he or she be eligible to serve on the

Committee or Sub-Committee of the Club without the prior approval of the Club in writing. An

Honorary Member shall be exempted from entrance fee, subscription and any other fees in respect of

spouse and children, except for actual expenses incurred by themselves.

(ii) Such Honorary Members shall be issued with a special membership number for the use of the Club’s

facilities.

NOTE : The above is subject to and shall not restrict the rights and privileges of an Honorary

Member so classified under ARTICLE 11.

DISTINGUISHED PERSONS :

16. The hospitality of the Club may be extended by the Committee to distinguished persons on such terms and

over such period as the Committee may think fit.

ASSOCIATE MEMBERS :

17. (i) The Committee may enter into reciprocal arrangements with any other club or clubs upon such terms and

conditions as the Committee may think fit.

(ii) The members of any such other club, while in the Wilayah or Selangor shall be Associate Members of

the Club and shall be entitled to enjoy and make use of the amenities and facilities of the Club upon the

terms and conditions arranged between the Committee and such other club.

VISITING MEMBERS :

18. (i) Any Member may introduce his/her friends as Visitors by entering the Visitor’s name and his/her own,

as introducer, in the Visitors Book kept in the Club House. Upon such introduction the persons

introduced shall be admitted as Visiting Members for such day or days stated in the Visitor’s Book

provided that no person may be admitted as a Visitor for a total period of more than three months in any

calendar year.

(ii) All fees incurred on account of Visiting Members for the use of certain facilities of the Club as may be

permitted by the Committee from time to time shall be debited to the Introducer’s A/C; provided that if a

Visiting Member does not play golf or use any of the Club’s Golfing, Swimming and Sporting facilities,

no fee shall be payable (M/C Meeting 26.11.1985).

(iii) Introduction in the manner aforesaid is essential whether or not any fee prescribed by the Committee

from time to time shall be payable.

(iv) Unless expressly permitted by the Committee a member may only introduce one Visiting Member on

any occasion for play of golf on any of the Club’s Golf Courses; provided that any visiting member

intending to use the Club’s golfing facilities on any Public Holiday, Saturday or Sunday shall obtain the

prior written permission of the Committee.

(v) Unless expressly permitted by the Committee, no Visiting Members whether resident within the Federal

Territory KL, Selangor or Elsewhere shall have access to or be entitled or allowed to use any of the

Club’s Golfing facilities on any Saturday, Sunday or Public Holiday.

(vi) The Committee may at its sole discretion from time to time restrict or suspend this Bye-Law or its

operation in such manner as it thinks fit.

MEMBERS OF THE FAMILY :

19(i) Legal spouses of Members shall be privileged members and shall be permitted to use the Club House

and shall be permitted to take part in the game of golf or other athletic sport or past-time promoted by

the Club and shall be permitted to use the Club’s swimming pool provided that any restriction

applicable to any Members shall also apply to the respective spouses.

(ii) The widow/widower of a deceased Member who was exercising the privileges provided by Bye-Law

19(i) may continue to use the Club as a Privileged Person upon application and approval of the

Committee, subject to a payment of an administration fee, monthly subscription and all expenses

incurred.

20. (i) Children of Members shall be privileged members and shall also be admitted to the privileges permitted

to spouses under Bye-Law 19 provided that any restriction applicable to any Member shall also apply to

the respective children and provided further that children under the age of 12 may not play golf and may

not take part in any golf competition of the Club without the prior approval of the Committee. All legally

adopted children under 21 years old are privileged members. (MC meeting 3.5.2006)

(ii) For the purpose of this Bye-Law the expression ‘children’ shall mean only children below the age of 21

who are fulltime students or who are below school going age.

(iii) Children eligible to exercise privileges under this Bye-Law shall be deemed to do so unless written

notice to the contrary is given to the Secretary.

21. Children of 21 years and above shall not be permitted into the Club House or upon the Club premises except

as permitted by these or any other Bye-Law or regulation approved by the Committee.

22. Spouses and children of Honorary Members shall be entitled to exercise the privileges permitted the spouses

and children of Members under Bye-Laws 19, 20 & 21 and shall be exempted from all fees.

LADY MEMBERS :

23. (i) As a result of the resolution passed at the EGM held on 15/2/2004, that the dual categorization of

membership by sexes be terminated, there shall be no more admission of new Lady Members. All

existing Lady Members may apply to convert their status to Ordinary Membership by paying the full

entrance fee for Ordinary Membership at the prevailing rate less the amount of entrance fees already paid

by her on her admission as a Lady Member. (Those existing Lady Members who apply to convert their

status within the two years from 26/6/2005 to 25/6/2007 will only need to top up to RM15,000.)

(ii) The subscription payable by all Lady Members shall be RM80/- per month or such larger sum as the

Committee may decide subject to Article 39. (AGM 27/6/2004)

(iii) A Lady Member who subsequently becomes married:-

(a) shall continue to exercise her privilege as though she is still a single lady; and

(b) if entitled under Rule 23 (iv) below, may apply to the Committee to extend the same privilege under

Bye-Laws 19, 20 and 21 to her legal husband and children, such extension of the privilege to be

granted at the discretion of the Committee and subject to the payment of full entrance fee for

Ordinary Membership then prevailing less the amount of entrance fees already paid by her on her

admission as Lady Member (Approved at M/C Meeting on 28.4.1994).

(iv) A Lady Member admitted after the 1st day of July 1994 shall not be entitled to make any application to

the Committee under Rule 23(iii)(b). (Approved at MC Meeting on 28.4.1994).

JUNIOR MEMBERS :

(Approved at M/C Meeting on 24.11.1993)

24. (a) Subject to these Rules, a child between the ages of 18 and 21 years who has been registered with the

Club for not less than 2 years may be proposed, seconded and elected as a Junior Member in the manner

provided for the election of Members. Such application must be submitted between 17 years 6 months

and 18 years old.

(b) A Junior Member shall be proposed by his/her parent who:-

(i) must be a Member of the Club before 3.5.2006;

(ii) is not in arrears of any payment to the Club;

(iii) is not precluded under Rule 24 (c) below from proposing a Junior Member; and

(iv) shall guarantee the payments of all debts and liabilities due by the Junior Member of the Club.

(c) (1) Any Member elected and confirmed after 1.1.1994 shall not be eligible to propose:-

(i) more than one of his lawful children to be a Junior Member; and

(ii) any child to be a Junior Member for a period of five (5) years from the date of his

confirmation as a member of the Club.

(2) Any Member elected after 3.5.2006 shall not be eligible to propose any child to be a Junior Member.

However, this condition does not apply to those Lady Members who exercise the option to convert to

Ordinary Members before 25.6.2007.

(d) Junior Membership applicants are to attend a briefing session with the Membership Sub-Committee

before their applications can be considered by the Committee. Should any Junior applicant be away for

study purposes or residing overseas, the Proposer is required to write and inform the Club of the

applicant’s status. The Committee may approve his membership and he shall be required to attend the

briefing session when he is back in the country.

(e) A Junior Member shall:-

(i) have no voice or vote in the affairs or management of the Club;

(ii) not be eligible to be a member of the Committee, or of any Sub-Committee.

(iii) not be entitled to propose or second any person for membership of the Club, or to introduce a visitor;

(iv) be eligible to play in the monthly medals and normal club competitions.

25. A Junior Member shall pay a monthly subscription of RM40/-. (AGM 27.6.2004)

26. A Junior Member, when elected, shall pay an entrance fee equal to half the entrance fee for a Member which

is non-refundable on him/her ceasing to be a member for any reason whatsoever. `

27. A Junior Member on reaching the age of 21 years will cease to be a Junior Member and shall on application

and payment of the balance of the entrance fee then in force for membership to be transferred without further

election to full membership provided that he/she shall have been a Junior Member or candidate for Junior

Membership for a period of three years or such shorter period as may be approved by the Committee.

CORPORATE MEMBERS PURSUANT TO ARTICLE 36:

28. (i) REGISTER

The Committee shall keep a Register of Bodies entitled to nominate Corporate Members in accordance

with these Bye-Laws.

(ii) DEFINITIONS

In these By-Laws:-

‘Registered Corporation’ means a body registered in the Register provided in Bye-Laws 28 (i).

‘Corporate Right’ means the Registered Corporation’s right to nominate a corporate member.

‘Corporate Member’ means a member enjoying privileges at Kelab Golf Negara Subang.

(iii) LIMITATION OF PRIVILEGES

Save for such corporate right, a Registered Corporation shall have no voice or vote in the affairs or

management of the Club or any right whatsoever.

(iv) QUALIFICATION

The following shall be eligible to be listed as a Registered Corporation:-

(a) any company incorporated with limited liability in Malaysia and having its registered office in

Malaysia.

(b) such other bodies as the Committee may from time to time approve.

(v) APPLICATION

Anybody wishing to become a Registered Corporation shall apply on the prescribed form. Such

application shall be considered by the Committee who may approve or reject the same without giving

any reason for such approval or rejection.

(vi) FEES

A Registered Corporation shall pay registration fee of Ringgit Fifteen Thousand (RM15,000/-) only for

each Corporate Right it wishes to hold. Such payment shall entitle the Registered Corporation to be

registered as such for a period of three (3) years commencing from the date of registration PROVIDED

that a Registered Corporation shall not hold more than three (3) Corporate Rights at any one time.

(vii) MAXIMUM NUMBER OF CORPORATE RIGHTS

The total number of Corporate Rights at any time shall be at the discretion of the Committee but shall

not at any one time exceed two hundred (200).

(viii) NOMINATION OF CORPORATE MEMBERS

A Registered Corporation shall be entitled to nominate one person to enjoy corporate privilege for

each corporate right it holds. Such nomination shall be in writing and shall be subject to approval of the

Committee. The Committee shall be entitled to reject such nomination without giving any reason for

such rejection.

(ix) WITHDRAWAL

A Registered Corporation may at any time by written notice withdraw its nomination in respect of its

Corporate Members. Such withdrawal shall be made in writing and shall only be effective from the time

of receipt of such notice by the Club. All fees paid are not refundable except stated otherwise.

(x) SUBSTITUTION

A Registered Corporation may by notice in writing nominate a person to replace an existing Corporate

Member in substitution of the same provided that substitution in respect of each Corporate Member shall

not be done more than once in any six months.

(xi) SUBSCRIPTION AND DUES FOR PERSONS NOMINATED UNDER CORPORATE MEMBERSHIP

All persons who are members by virtue of these Bye-Laws whether nominated originally or by way of

substitution or because of the withdrawal of a person by a Registered Company shall be liable to pay all

entrance fees, subscriptions and such other dues as the Committee may from time to time decide,

authorize or sanction.

TERM MEMBERS PURSUANT TO ARTICLE 36 :

29. (i) Subject hereto there shall be created a new class of membership called ‘Term Members’. Such

Membership shall be only for a period of two years renewable for further periods of one or two years at

the discretion of the Committee and upon payment of the requisite entrance fee applicable.

(ii) PRIVILEGES

(a) A Term Member shall enjoy all the rights and privileges of membership of the Club except that he shall

have no voice or vote in the affairs or management of the Club nor shall he or she be eligible to propose

any application for membership to the Club or in any election of the Club or serve upon any Committee

or Sub-Committee of the Club.

(b) Such Term Members shall be issued with a special membership number for use of the Club facilities.

(iii) ENTRANCE FEE AND SUBSCRIPTION

(a) A person admitted under this Bye-Law shall pay an entrance fee of Ringgit Ten Thousand (RM10,000/-)

only or such larger sum as the Committee may from time to time decide. Such fee shall not be refunded

on cessation of membership for any reason whatsoever.

(b) The Subscription payable by Term Members shall be that payable by the Ordinary Members of the Club.

(c) Subscription shall be due on the First day of the period in respect of which it is payable.

(iv) ADMISSION AND ELECTION OF TERM MEMBERS

(a) The procedure applicable to election of Ordinary Members shall apply to the admission of Term

Members under the General Bye-Laws of the Club.

(b) No person below the age of 21 years shall be admitted under this Bye-Law.

(v) GENERAL

(a) Term Members shall be bound by the Memorandum and Articles of Association of the Club and the Bye-

Laws and other Regulations of the Club for the time being in force.

(b) Every Term Member shall be subject to the control of the Committee and shall conform to the lawful

requirements and discretions of the Committee.

(c) The Committee shall have the power to withdraw from a Term Member either for a definite period or

permanently all or any of the privileges accorded to such Term Member if in the opinion of the

Committee the Term Member is guilty of a breach of any of the provisions of the Memorandum and

Articles of Association or any Bye-Laws or Regulations for the time being in force.

SPOUSES OF DECEASED MEMBERS PURSUANT TO ARTICLE 36: (MC meeting 1/3/2006)

30. (i) Subject hereto there shall be created a new class of membership specifically applicable to spouses and

children of deceased ordinary members.

(ii) PRIVILEGES

(a) A member under this class shall enjoy all the rights and privileges of membership of the Club

except that he/she shall have no voice or vote in the affairs or management of the Club nor shall

he/she be eligible to propose or second any application for membership to the Club or in any

election of the Club’s Committee. He/she is also not eligible to sign in guests to the Club, except

for food and beverage facilities.

(b) Such members shall be issued with a special membership number and card for use of the Club

facilities.

(iii) QUALIFICATION

(a) Must have been registered by the deceased member at least five (5) years before the date of his/her

death;

(b) A valid documentary evidence of his/her death shall be produced;

(c) All outstanding debts due to the Club by the deceased member must have been settled.

(iv) ADMISSION & FEE

(a) Qualified spouses may then submit their applications not later than 3 months of the date of death,

to the Club in the normal manner.

(b) A processing fee of RM10/- is chargeable on application.

(v) SUBSCRIPTION

A person admitted under this Bye-Law shall pay the same monthly subscription as that payable by the

Ordinary Member of the Club which shall be due on the first day of the period in respect of which it is

payable. If the deceased member was a senior member, the ordinary member monthly subscription

shall apply unless she has reached the age of 70 and above when she will be exempted from such

payment.

(vi) SPECIAL PROVISION

(a) A privileged person admitted under this Bye-Law shall, under pain of being expelled, notify the

Club immediately upon becoming married.

(b) A privileged person admitted under this Bye-Law shall cease to be so and removed from the

Register of Privileged Persons:-

(i) in the event of his/her marriage;

(ii) if he/she resigns;

(iii) if elected and accepted honorary membership of the Club;

(iv) if elected as an Ordinary Member of the Club; and

(v) in the event of his/her death.

(vii) GENERAL

(a) Privileged Persons shall be bound by the Memorandum and Articles of Association of the Club

and its Bye-Laws and other Regulations for the time being force.

(b) Every Privileged Person shall be subject to the control of the Committee and shall conform to the

lawful requirement and discretion of the Committee.

(c) The Committee shall have the power to withdraw from a Privileged Person either for a definite

period or permanently all or any of the privileges accorded to such a person if in the opinion of the

Committee the person is guilty of a breach of any of the provisions of the Memorandum and

Articles of Association or any Bye-Laws or Regulations for the time being in force.

(viii) CHILDREN OF DECEASED MEMBERS

(a) Children of deceased members whose spouses have been admitted under this Bye-Law as

Privileged Persons may be permitted the use of the Club’s amenities and facilities provided they

had been registered with the Club by the deceased member at least five (5) years before his/her

death.

(b) For the above purposes children under the age of 12 years must be accompanied by the Privileged

Person concerned whilst those aged between 12 and 21 will on application be issued with special

cards which will have to be produced on demand when in the Club’s premises and using its

facilities.

(c) All children admitted under this Bye-Law are also bound by Regulation (vii) above and the

Privileged Persons concerned shall be held responsible and accountable for all actions and for any

breach of the Club’s Rules and Regulations by any of the children under their charge.

(d) Children referred to under this Bye-Law shall cease to be accorded the privileges afore-mentioned

upon reaching the age of 21 years or termination of the membership of the Privileged Person

concerned whichever is the earlier.

(ix) All persons who had previously been admitted under Bye-Law 22 which had since been rescinded shall

henceforth be covered by this Bye-Law.

31. TRANSFERABILITY OF MEMBERSHIP

Any ordinary member may transfer his or her ordinary membership to any other person subject to the

following conditions:-

(i) That the member has been an ordinary member for not less than ten (10) years, PROVIDED always that

the Committee shall have the discretion to waive this requirement, taking into account the special

circumstances, which special circumstances shall be solely determined by the Committee;

(ii) That the proposed transferee is acceptable to the Management Committee for membership of the Club

in accordance with the relevant provisions in these Articles and Bye-Laws relating to Admission to

Membership;

(iii) That the ordinary member pays the Club, upon election of the proposed transferee as an ordinary

member an administrative fee equivalent to 20% of the prevailing entrance fee if the proposed

transferee is the spouse or a child of the Member, or 40% of such entrance fee in all other cases;

(iv) That, if the ordinary member has been deregistered as a member under Bye-Laws governing member’s

accounts, he or she may transfer his or her membership upon his or her reinstatement.

(v) That, if the ordinary member is undergoing suspension, he or she may transfer his or her membership

only upon completion of his or her period of suspension.

PART III – LIABILITIES OF MEMBERS, ETC

32. (i) The proposer and seconder of a candidate for membership shall be jointly and severally liable for all

debts and other liabilities to the Club which may have been incurred by such candidates, who may be

elected as laid down in Bye-Law 6, for such period as the Committee may decide from time to time.

(ii) A member introducing a Visiting Member shall be responsible for his conduct and shall be liable for all

debts and liabilities to the Club which may have been incurred by the Visiting Member as such during the

period of his/her introduction.

(iii) Every Member, Honorary Member, shall in addition to the debts and liabilities to the Club which may be

incurred by himself be liable for all debts and other liabilities to the Club which may be incurred by the

spouse and children.

PART IV – COMMITTEES, ETC

THE COMMITTEE:

33. The Committee may meet together for the dispatch of business adjourn and otherwise regulate their meetings,

subject to the Article and By-Laws, as they think fit.

34.Written notice of every meeting shall be sent to all members of the Committee at least three clear days before

the date of such meeting.

35.The President, Vice-President or in his absence the Captain, shall be chairman at all Committee meetings. If at

any meeting neither the President, the Vice-President nor the Captain is present within five minutes after the

time appointed for holding the same, members of the Committee present may choose one of their number to

be Chairman of the Meeting.

36. In the absence of any provisions to the contrary, five members of the Committee shall form a quorum.

37. (i) Questions arising at any meeting shall be decided by a majority of votes. In case of an equality of votes

the Chairman shall have a second or casting vote.

(ii) A resolution posted to all members of the Committee and agreed to in writing by a majority of them shall

have the same effect as a resolution duly carried at a formal meeting of the Committee.

38. The Secretary and such other persons approved by the Committee shall attend all Committee meetings and

shall keep in a book to be provided for the purpose a record of the proceedings of such meetings. Such record

shall be submitted to the next or a subsequent meeting of the Committee for confirmation as a true record

subject to any amendments or corrections agreed at such subsequent meeting. In the absence of the Secretary

the members of the Committee present may appoint a substitute for the meeting.

38A. QUALIFICATIONS OF CANDIDATES TO THE COMMITTEE (AGM 17.6.2007)

No person shall be a candidate for election to the Committee unless:-

i. he has been a Member of the Club for at least a period of five (5) years before the date of the

Annual General Meeting of the election year;

ii. he is a Malaysian Citizen resident in Malaysia;

iii. he has not reached the age of 70 years as at the date of nomination;

iv. he is not prohibited under Section 130 or 304 of the Companies Act,1965;

v. he is not indebted to the Club so as to be liable to be debarred under Article 45 of the Articles

of Association in the preceding three (3) years prior to the date of nomination;

vi. he is not a bankrupt;

vii. he is not found to be a lunatic or of unsound mind;

viii. he has not been convicted of any criminal offence; and

ix. he has not at any time after 17 June 2007 subjected to any disciplinary action which has

resulted in a suspension/expulsion.

38B. NOMINATION OF CANDIDATES

Every nomination of a candidate for election to the Committee:-

a. shall be in writing and in the prescribed form, duly signed by the proposer and seconder;

b. shall name only one (1) candidate and his consent endorsed thereon subject to the candidate

signing a declaration that he is a qualified candidate under Bye-Law 35A;

c. must be received by the Secretary at least seven (7) days before the date of the Annual General

Meeting of the election year.

38C. ELECTION SUB-COMMITTEE

a. For the proper supervision over the conduct of the election of the members of the Committee

in any election year, there shall be constituted at least two (2) months prior to the date of the

Annual General Meeting of an election year an Election Sub-Committee. The Election Sub-

Committee so constituted shall ipso facto dissolve on the date falling one (1) month after the

date of the Annual General Meeting of the relevant election year unless otherwise notified in

writing by the Committee prior to such date.

b. The Election Sub-Committee shall consist of three (3) Members of the Club, which shall be

appointed by the Committee for the purpose herein.

c. The meetings of the Election Sub-Committee shall be chaired by the Chairman of the Election

Sub-Committee, who shall be a member nominated by the Committee. The Chairman of the

Election Sub-Committee so appointed shall have the right to appoint an alternate member

from amongst the members of the Election Sub-Committee to chair any meetings of the

Election Sub-Committee in his stead.

d. The Election Sub-Committee has the duty to ensure that all nominated candidates are

qualified to stand for election in the relevant election year, that nominations received by it

have been properly made, and generally, complies with the rules of conduct of the election as

may be determined in these Bye-Laws and by the Election Sub-Committee.

e. The Election Sub-Committee shall have power and authority to do any of the following in the

proper performance of its duties and functions:-

i) to fix and determine the rules of conduct of the elections and to provide the

necessary procedures and safeguards for the relevant election year;

ii) to prepare all necessary nomination and ballot papers and other documentation; and

iii) to circulate all necessary information to the members of the Club in respect of the

elections.

f. No member of the Election Sub-Committee shall be or permit himself to be a candidate for

any position in the election of members of the Committee in the election year in which the

Election Sub-Committee was constituted.

VICE-CAPTAINS:

39. The Committee may on the recommendation of the Captain appoint a maximum of two Vice-Captains who

shall during the absence of the Captain have the same powers of the Captain provided that the Captain shall

notify the Vice Captain(s) of his intended absence in writing. If two Vice-Captains are appointed, the Captain

shall nominate the 1st and 2nd Vice-Captains.

SUB-COMMITTEES:

40. (i) The Committee shall within one month after each Annual General Meeting appoint various Sub-

Committees as they may deem necessary.

(ii) The Committee may also from time to time appoint such other Sub-Committee(s) as necessary.

(iii) The number of Sub-Committees shall be at the discretion of the Committee who shall appoint the

respective Chairman.

(iv) The Captain shall be ex-officio member of all Sub-Committees.

(v) Each Chairman shall appoint the members of his own Sub-Committee who shall be confirmed by the

Committee.

41. Sub-Committees shall have such powers and duties as may be assigned to them by the Committee and shall

be responsible to the Committee in all respects. Without prejudice to the generality of the foregoing, no Sub-

Committee shall expend money or incur liability without the authority of the Committee if the amount to be

expended is more than RM1,000/- for any item.

42. Sub-Committees may meet together for the despatch of business adjourn and otherwise regulate their

meetings subject to the Articles and By-Laws of the Club and any regulations of the Committee.

43. The Convenor shall be the Chairman at the meetings. In the absence of the Chairman the members of the

Sub-Committee present may choose one of their number to be Chairman of the Meeting.

44. Questions arising at any meeting shall be decided by a majority of votes. In case of an equality of votes the

Chairman shall have a second or casting vote.

45. A resolution posted to all the members of a Sub-Committee and unanimously agreed by them in writing shall

have the same effect as a resolution duly carried at a formal meeting of such Sub-Committee.

46. In the absence of any provision to the contrary, two members of a Sub-Committee shall form a quorum.

PART V - GENERAL

47. (i) The Club House shall be open daily from 6.30 a.m. to 10.00 p.m.

(ii) The Committee may at any time and from time to time by notice, whether generally or for a particular

occasion, alter, extend or restrict the above hours.

(iii) The Captain or a member of the Committee may for particular occasions exercise the powers of the

Committee as to extension under the preceding paragraph.

(iv) Subject as aforesaid all Members or privileged persons remaining in the Club House after the closing

time shall sign their names in the book provided for that purpose and shall pay a late fee of RM2/- for the

first hour or part thereof and RM3/- for every subsequent hour or part thereof after the first hour during

which they so remain.

48. (i) The Committee may at any time and from time to time by notice reserve the whole or any part or parts of

the Club House, the golf courses, the tennis and squash courts, the swimming pool and premises in

connection therewith and any other part of the Club’s premises for any purpose whatsoever for such

period or periods and subject to such provisions and limitations as to entry thereon whether by Members

or privileged persons or any other persons or class of persons and whether upon terms and payments or

otherwise as the Committee may think fit.

(ii) In particular and without derogation from the generality of the powers aforesaid, the same may be

exercised in connection with competitions, tournaments, exhibitions, matches, fetes, galas, celebrations

and entertainments and functions of all kinds, and shall include the loan or hire of the Club’s premises or

any part thereof.

49. The Committee may in like manner at any time and from time to time by notice close the whole or any part

or parts of the Club House and the Club’s premises for the purpose of repair, renewal or conservation thereof

or for the observance of any solemnity or celebration or as a mark of respect or to meet the requirements of

any particular occasion as the Committee may think fit.

50. Suggestions may be entered by Members in the book provided for the purpose, and shall be dealt with by the

Committee.

51. No Member or privileged person shall reprimand any Club servants. In the event of any fault being found a

complaint may be made in writing to the Secretary by a Member or a privileged person.

52.No Member or privileged person shall give money or gratuity to a servant of the Club under any

circumstances whatever, except as may be specifically permitted by the Committee.

53. Any Member or privileged person breaking or injuring the property of the Club shall pay to the Club cost of

making good the damage. The amount of such cost shall be assessed by the Committee, whose decision shall

be final.

54. No Member or privileged person shall bring a dog into the grounds or premises of the Club. Any Member or

privileged person, whose dog is found in the grounds or premises of the Club shall be deemed to have

brought it there and shall be liable, unless he or she satisfies the Committee to the contrary, to a minimum

fine of RM10/- for each offence. Such fine shall be imposable by the Committee.

55. The Club shall not be liable for the loss of or damage to any property or article whatsoever brought upon or

deposited in the club premises or precinct in any manner whatsoever by any Member or Privileged Person.

56. All entrance fees, subscriptions, payments, fines or damages payable or imposable under the Bye-Laws shall

be a debt or liability to the Club and shall be recoverable from any Member or privileged person who is liable

for the same, whether primarily or otherwise, under the Bye-Laws.

57. Unless specially permitted, private servants are not permitted in the Club buildings.

58. With effect from 1.1.1994, if it is known by the Club that any Member is adjudged a bankrupt, such a

Member will be given a show cause letter requiring the Member to explain or justify to the Committee as to

why the Member should not be suspended from using the Club’s facilities. Such a Member will be given

three months from the date of the show-cause letter to explain or to justify to the Committee. If the

Committee is of the opinion that the Club may be exposed to liabilities, the Committee may suspend such

Member from using the facilities and such suspension shall remain in force for so long as the Member

remains a bankrupt. (Approved at M/C meeting on 24.11.1993, confirmed on 29.12.1993 and appeared in

Nov/Dec’93 Berita Subang).

59.Members shall at all time furnish and supply the Club with all information, particulars and photographs as

may be required by the Club from time to time for the maintaining and updating of its records of its members

and their families. Any member who defaults, neglects or omits to comply with such requirements when so

required or provides false information and particulars to the Club shall be liable to disciplinary action and

may be fined, suspended and /or expelled.

BYE-LAWS GOVERNING CHILDREN

In the exercise of the powers conferred under Article 36 of the Article of Association of Kelab Golf Negara

Subang the Management Committee hereby make the following bye-laws regulating the control of Children of

all members and other persons using the Club. These bye-laws shall be subject to all the General Bye-Laws of

the Club for the time being in force.

1. DEFINITION:

‘Children’ shall mean children from the age of 12 to 17 years. ‘Young Children’ shall mean children under

the age of 12 years.

2. LIMITATION:

No children below the age of 18 years shall be permitted into the Billiard Room or the Club Premises except

as permitted by these or any other Bye-Laws.

3. LIABILITY:

Parents bringing into the Club children below the age of 18 years, shall do so at their own risk and without

liability of any sort on the part of the Club and shall be entirely responsible for the acts and conduct of such

children.

4. SUPERVISION:

Parents must exercise sufficient supervision over their young children at all times whilst in the Club

Premises.

5. SUSPENSION:

Upon complaint regarding the conduct of any children of a member, the Management Committee may on

being satisfied that there has been a breach of the Club Rules or Bye-Laws, temporarily withdraw the

facilities conferred on the child by these or any other Bye-Laws.

6. POOL AREA:

Children and young children may use the pool areas subject to the Swimming Pool Bye-Laws. Young

Children must leave the pools by 7.00 p.m., children aged 12 to 15 years by 7.30 p.m., and children aged 16

and 17 years may remain in the pool until 8.00 p.m. or such later time permitted by the Swimming Pool Bye-

Laws if accompanied by an adult member.

7. SQUASH AREA:

Children may only enter the area as permitted by the Squash Bye-Laws. Young children may only enter the

area if accompanied and under the constant supervision of an adult member.

8. DINING:

Children and young children may accompany their parents for lunch in the Dining Hall. For the convenience

of all members, parents with very young children should use the restaurants facilities at the Family Terrace

and Poolside Terrace.

9. GUESTS:

Children and young children are not permitted to bring guests to the Club.

10. CHIT SIGNING:

Young children are not permitted to sign chits. Children may only be permitted to sign chits if they have been

duly authorised by their parents in writing.

11. CLUB STAFF:

Under no circumstances shall children and young children be permitted to reprimand any Club servants.

BYE-LAWS GOVERNING CAR STICKERS & CAR PARKS

1. A Member is entitled to a maximum of 2 stickers and may apply for additional stickers subject to due

compliance with the terms of these Bye-Laws. The Club stickers are issued for identification purposes and do

not confer upon vehicles bearing such stickers an automatic right of entry into the Club.

2. Every application for a sticker must be made by the Member submitting to the Club a completed application

form prescribed by the Club. The form must be supported by a photocopy of the vehicle registration card in

respect of an application for additional stickers.

3. Upon approval of an application, a Member shall be issued the stickers applied for only after he has paid such

cost therefor as may from time to time be determined by the Management Committee and also such other

dues as may then be due from him to the Club. The Club may issue new stickers to replace any lost stickers

by imposition of a penalty not exceeding the cost then applicable to a new additional sticker.

4. A Member must collect his car sticker(s) from the Club either personally or through a duly authorised

representative.

5. Members shall display the valid club stickers on the front windscreen of their vehicles for easy identification.

6. Members are responsible for the safe custody of the stickers issued to them. These stickers must be returned

to the Club without any refund of the cost:

(a) when they dispose of their vehicle (s); or

(b) when they cease to be members of the Club; or

(c) on demand by the Club.

7. The Club may at its absolute discretion refuse entry to the Club’s premises by any vehicle whether or not

such vehicle bears a Club sticker.

8. All vehicles permitted to enter the Club shall be parked in the respective designated lots or as directed by any

Club employee or security personnel. For clarity, car park lots designated as Management Committee lots are

reserved for the President, the Vice-President, the Captain and members of the Management Committee only.

Only vehicles with current Club stickers are allowed to park at the designated lots for Members regardless

whether the vehicles belong to Members or otherwise or driven by Members.

9. All drivers of any vehicles entering into the Club premises (whether bearing any Club stickers or otherwise)

must obey these Bye-Laws, observe all rules of etiquette and accord due courtesy to Members and other

visitors to the Club, not cause any obstruction to any party and comply with all such other regulations as may

be enforced by the Club from time to time.

10. Without prejudice to any other rights or remedies available to it including the right to take disciplinary action

against any infringing Member, the club may impose a fine of up to RM50.00 for each instance of

contravention, on any Member or other person who breaches any of these Bye-Laws or any other regulations

as to parking or the control of any vehicle within the Club that may from time to time be in force. Vehicle

belonging to any Member or person if found to be indiscriminately or wrongfully parked, will be clamped.

The vehicle will only be released upon paying a RM50.00 fine.

11. The Club shall not be liable under any circumstances to any persons (including its Members) for any personal

injury or death or for any loss or damage of or to any vehicle, its accessories or contents or to any other

property whatsoever while such vehicle is in any part of the Club’s premises.

BYE-LAWS GOVENING MEMBERS’ ACCOUNTS

MEMBERS’ STATEMENT OF ACCOUNTS:

1. Members’ Accounts are payable upon presentation of the monthly statement and shall be paid within 21

days of the presentation date.

2. Any Member who defaults in making full payment within the 21 days’ period stated in Rule 1 above,

shall be served with a REMINDER requiring him to settle his overdue amount within 14 days of the

date of such reminder.

3. Any member who defaults in making full payment within 14 days of the date of REMINDER shall

have his name placed on the DEFAULTERS’ LIST which shall be posted on the notice board at the

main lobby and at such other notice boards of the Club as the Finance Sub-Committee may from time

to time decide.

4. On the same day a notice in writing shall be sent to the defaulting member notifying him of the action

taken and requiring him to settle in full all monies owing to the Club within 7 days of the date of

posting of such notice.

5. If a defaulting member does not settle in FULL all monies due to the Club, including an administrative

charge imposed under Rule 6 below, within 7 days from the day of posting of the Defaulter Notice

Letter, a notice in writing to show cause why his name should not be removed from the Register of

Members pursuant to Article 45 shall be sent to him at his last known address via A.R. registered mail.

DEFAULTERS:

6. An Administrative charge of RM100 per each default shall be imposed on any Member whose name

has been listed on the DEFAULTERS’ LIST and posted in accordance with Rule 3 above. This shall be

paid prior to the reinstatement of credit facilities with the Club.

7. In accordance with Article 45 a Member shall be debarred from participating in any of the privileges,

amenities and facilities of the Club for the duration of the period his name is listed in the

DEFAULTERS’ LIST.

8. Any Member who participates in any of the privileges, amenities and facilities of the Club knowing that

he is so debarred shall be liable to disciplinary action.

MODE OF PAYMENTS:

9. Payment towards member’s account shall be made in cash, cheque or any other acceptable mode as

may be determined by the Finance Sub-Committee from time to time.

10. Only current cheques may be tendered as payment and the Club may at its discretion give credit for

the same subject to the clearance of cheques.

11. In the event that a cheque has been dishonoured on presentation, the Club shall notify the Member

concerned in writing by A.R. registered Mail that:-

(a) any credit given under 10 has been reversed upon dishonour of the cheque;

(b) he is required to replace the dishonoured cheque within 7 days of the date of such notification;

(c) a charge of RM50/- has been levied pursuant to Rule 12;

(d) as no actual payment has been made, Rule 3 or Rule 5 as the case may be, shall apply should

the member fail to comply with (b) above and paid the levy in (c) above.

12. A charge of RM50/- for each dishonoured cheque shall be imposed on any Member who paid in any

cheque which is dishonoured due to the following reasons:-

(a) not arranged for; or

(b) insufficient funds; or

(c) such other reasons for dishonour as may be determined by the Finance Sub-Committee from

time to time.

LATE PAYMENT CHARGES:

13. A Member shall be levied a late payment charge not exceeding 1.5% per month on any outstanding

account due to the Club which is more than 60 days (2 months) overdue after the end of any particular

month.

14. Such levy shall be in addition to and without prejudice to any other actions or remedies that may be

available to the Club under any of the above rules.

TERM MEMBERS:

15. The Club shall require additional deposit from Term Members if their expenditure for the month

exceeds their current deposit.

16. The additional deposit required (rounded to the nearest RM100/- shall be the difference between twice

the average of the last 3 months expenditure and the current deposit.

DEREGISTERED MEMBERS:

17. Deregistered members may appeal for reinstatement within three months from the date of deregistration

after paying in full the outstanding amount.

18. Deregistered members whose appeals or reinstatement has been successful, are required to pay an

additional refundable deposit of RM2,000 and all monies due to the Club in full as specified by the

Management Committee from time to time.

GENERAL:

19. Notwithstanding that the Club may have delayed due to administrative and practical reasons in enforcing

these Rules or that the Club has granted indulgence to any Member, the Club shall not be held to have

waived these Rules or condoned or acquiesced to any default or breach of these Rules by any Member and

the Club may at any time thereafter enforce all or any of these Rules or the remedies conferred or available

under these Rules and any delay or the indulgence granted shall not be held to prejudice the Club’s right to

strict enforcement of these Rules.

BY-LAWS GOVERNING USE OF FRUIT MACHINES

(Approved at MC meeting 27/4/98)

1. Only Members of the Club and their spouses, but except those prohibited by the Ministry of Finance are

allowed in the Fruit Machine Room.

2. All Members and/or their spouses entering the Fruit Machine Room must sign the Machine Room Register.

3. No guests are permitted in the Fruit Machine Room whether or not they engage in playing the machines.

4. Terms are strictly cash and no. I.O.U. are permitted.

5. Members of the Club may pay with their personal current cheques up to an amount of RM1,000/- only.

Postdated and/or non-personal cheques are strictly forbidden. Any member paying by cheque must make the

cheque payable to Kelab Golf Negara Subang and write on the reverse of the cheque, his/her full name and

membership number. This facility is provided only for members wishing to play the Fruit Machine. The Duty

Officer/Operator has the authority to refuse this facility to any member and/or their spouses without assigning

any reason thereof.

6. In the event that a cheque has been dishonoured on presentation, the Club shall notify the Member concerned

in writing by A.R. Registered Mail that he is required to replace the dishonured cheque within 7 days of the

date of such notification. In the event of non-compliance, the matter shall be referred to the Disciplinary

Committee. Further, the amount will be charged to the Member’s account.

A penalty charge of RM100/- for each dishonoured cheque shall be imposed on any Member who paid in any

cheque which is dishonoured for the following reasons:-

(a) not arranged for, or

(b) insufficient funds, or

(c) any other reasons or determined by the Finance Sub-Committee.

The said charge shall be charged to the Member’s accounts and the Member shall be barred from using this

cheque cashing facility for a period of 6 months.

7. No coins shall be taken out of the Fruit Machine Room unless they are less than RM20/- in total. Coins in

excess of this amount should be exchanged for currency notes.

8. Coins will only be supplied to Members who have registered their names in the Fruit Machine Room Register

and have a machine to play.

9. Pay-out will be made according to the number of coins registered in the machine.

10. It is the responsibility of the Members to ensure the number of coins inserted is correctly registered before

pulling the handle.

11. Machines may not be reserved by or on behalf of any Member. Duty Officer/Operator is instructed to remove

any article left on a machine as token of reservation. A member shall not play on more than one machine

while other members are waiting.

12. A husband and wife are required to play only one machine when others are waiting to play a machine.

13. Members must under no circumstances switch off, interfere with, or otherwise abuse, any machine, and

should report any malfunctions to the duty staff.

14. If a machine:

(a) short pays,

(b) over pays,

(c) fails to pay,

(d) fails to register, and

(e) is faulty in any other manner it shall deemed to be out of order and the staff on duty shall switch it off and

declare it ‘out of order’. No play shall resume until it has been attended to.

15. Staff on duty are not permitted to allow free pull whenever he opens and checks the machine. Free pull will

only be allowed in accordance with the number of stuck coins.

16. These Bye-Laws shall be prominently displayed in the Fruit Machine Room.

BYE-LAWS GOVERNING THE SWIMMING POOL

1. DEFINITIONS:

(a) ‘Committee’ means the Management Committee of Kelab Golf Negara Subang (KGNS).

(b) ‘Sub-Committee’ means the Recreation Sub-Committee.

(c) ‘Pool’ means the Kelab Golf Negara Subang swimming pool, swimming pool fixtures and the

surrounding area within five feet from the edge of the pool.

(d) ‘Ladies’ shall include all ladies exercising privileges under the rules of Kelab Golf Negara Subang.

(e) ‘Children’ shall include children of members exercising privileges under the rules of KGNS irrespective

of their age.

(f) ‘Coach’ means the officer appointed by the Committee for the purpose of management and control of the

pool or any officer for the time being authorised by the coach to exercise control of the pool on his behalf.

2. AUTHORITY:

These Bye-Laws are sanctioned by the Committee and supersede all previous Bye-Laws governing the pool.

3. POOL-HOURS:

The pool shall be opened on all days of the week from 6.30 a.m. - 9.00 p.m. or at such other times as

prescribed by the Committee.

4. ADMISSION:

The facilities at the pool are available only to members and their guests who have been registered and

obtained the required authorisation at the reception counter of KGNS.

5. REGISTRATION

All pool users (member/guest) must register themselves before entering the pool/s.

6. MAIDS

Maids looking after children at the swimming pool must be registered as guests and pay the guest fee. As

long as they are within five feet from the edge of the pool they are considered as pool users.

7. MAIN POOL

The main pool shall be reserved for swimmers who are able to swim without any assistance. Swimming

directions in the main pool shall be lengthwise only from 6.30 a.m. to 9.30 a.m. and 6.30 p.m. to 9.00 p.m.

on all days of the week.

8. THE POOLS

Children who cannot swim must be under close supervision or accompanied by an adult in the children’s

pool as well as the main pool.

9. ATTIRE

All swimmers must wear proper swimming attire and must shower before entering the pools.

10. TOWELS

Towels taken from the changing room must be returned.

11. HYGIENE

Persons suffering from infections or contagious disease of any kind are not permitted in the pools.

12. PLUNGING/DIVING

Plungers/divers must ensure that the pool is clear before plunging/diving in.

13. GAMES/HORSEPLAY

Games of any kind or horseplay in and/or around the pools are prohibited.

14. LANGUAGE AND BEHAVIOUR

Persons at the pool must not at any time use language which is indecent or act in an offensive manner or

interfere with any officer or employee employed by the Committee in the proper execution of these duties.

15. PROHIBITIONS

(a) Smoking is forbidden in any part of the pool areas.

(b) Refreshments are not allowed in the pools or around the pool decks.

(c) Members or guests may not throw anything into the pools and, in particular, parents must ensure that

children abide by this rule. Balls, toys, tubes, floats, flippers or other articles are not permitted in the

main pool. Children unable to swim may use rubber or plastic rings or arm-rings in the children’s pool.

Swimmers under supervised sessions are permitted to use kicking boards. Plastic/rubber and non-toxic

boys may be used by toddlers in the children’s pool.

16. LOSS AND DAMAGE

The Committee shall at no time be liable for any loss or damage to any article of value or otherwise lost or

damaged through negligence, default or criminal act of any employee or agent of the Committee or

otherwise.

17. GUESTS

All guests must sign in by 5.00 p.m. on weekends and public holidays only 20 guests are allowed by 1.00

p.m. and 20 guests after 1.00 p.m.

18. POWER TO REGULATE SWIMMING

The Sub-Committee or the General Manager may at any time at their discretion:

(a) Suspend swimming and request swimmers out of the water.

(b) Close the pool or suspend swimming in the pool in the event of a breakdown of plant and equipment,

poolside lighting or in any emergency which may arise.

19. PENALTY

Any person who violates any of the Bye-Laws set out herein shall be dealt with by the Disciplinary Sub-

Committee of KGNS.

20. MATTERS NOT PROVIDED FOR

Any matter which needs decision of which no provision has been made by the Bye-Laws shall be

determined by the Sub-Committee or the General Manager.

21. COMPLAINTS/SUGGESTIONS

All complaints or suggestions must be made in writing to the General Manager/Secretary of KGNS.

BYE-LAWS GOVERNING BILLIARDS

1. PLAYING HOURS:

Playing hours shall be from 2.00 p.m. to 10.00 p.m. daily or at such other times as may be allowed by the

Sub-Committee from time to time.

2. CHILDREN:

Children under the age of 12 are not allowed in the Billiard Room. Those under the age of 16 are not

permitted to enter unless accompanied by an adult member.

3. PROHIBITION:

Children under the age of 16 are not permitted to use the Billiard tables except when with an adult member

who shall be responsible for all damages. After 6.00 p.m. irrespective of their age have no standing and must

give way to members.

4. CLUB SESSIONS:

The Committee at any given time can reserve the Billiard table(s) for competitions and other uses.

5. PLAYING TIMES ALLOWABLE FOR EACH GAME:

For all games, the playing time allowed is 40 minutes per game or on completion of each game whichever is

earlier.

6. REGISTER:

All players must register themselves before playing.

7. GUESTS:

(a) Members introducing guests to play must enter the necessary particulars in the Visitors’ register at the

RECEPTION and pay such levy as may be prescribed by the Committee. Each member is allowed to

introduce only one guest each time.

(b) Members are NOT PERMITTED to introduce guests after 5.00 p.m. on Weekdays, the whole of

Saturdays, Sundays and Public Holidays, unless prior approval has been obtained from the Management

Committee or General Manager.

8. GENERAL:

(a) No smoking is permitted over the Billiard tables.

(b) Dress is informal.

(c) Silence is to be observed during play.

(d) Complaints should be reported to the General Manager, Recreation Executive or such other person

nominated by the Committee.

(e) Any member damaging the Billiard tables or its cloth shall, at the discretion of the Committee, pay the

cost of the replacement or repair of same. The amount of such cost shall be assessed by the Committee

whose decision shall be final.

(f) No play should commence without a Billiard Steward (Marker) being present.

(g) Members are obliged to produce their membership cards when requested by any member of the

Management Committee or such authorised personnel.

9. INFRINGEMENT:

The Disciplinary Committee may, after due inquiry, suspend player on the Billiard tables for any

infringement of these Bye-Laws.

BYE-LAWS GOVERNING SQUASH

1. The Game of Squash to be played on the courts is as defined by the Constitution and Rules of the Squash

Rackets Association of Malaysia.

2. The Squash area include courts, galleries and access to the courts and is for use by members, privileged

persons, guests and others authorised from time to time by the Management Committee and within the

general framework of the Club’s rules.

3. Playing times from 7.00 a.m. to 10.00 p.m. daily subject to change by the Management Committee from time

to time.

4. Each Court is booked on a half-hour basis.

5. Members must be physically present to book a court.

6. Only one court may be booked in any one day by a member and his opponent.

7. Members making bookings are obliged to produce their membership card when requested by any member of

the Management Committee or such other authorised personnel.

8. On the spot booking at the Squash area may be made through the sports attendant on duty, or such other Club

Staff nominated by the Management Committee.

9. Any court not taken up within 5 minutes will be made available to others. Members making the original

booking who are absent will incur a fine of RM5/- each, unless cancellation is made at least one (1) hour

before commencement of time booked.

10. Booking for solo play is strictly not allowed.

11. All court bookings will be registered on the bookings board with names of both players. All players must also

register before playing.

12. Children below 12 years may not book courts but may play on available courts and will have to vacate the

courts immediately when required by members, unless booked by their parents who must be present at the

squash area.

13. Booking will not be allowed at times declared as sessions for Club play by the Management Committee. Due

notice will be given for sessions declared for Club play.

14. The Management Committee may cancel bookings for breach of these rules or if courts are needed for special

events.

15. Children 10 years and below are not permitted in the Squash area unless accompanied by an adult.

16. Guests may only be introduced on weekdays before 5.00 p.m. Each member is entitled to introduce one

guest. Guests introduced must be registered at the Reception in the Squash Guest Register.

17. After 5.00 p.m. on weekdays and on Saturdays, Sundays and Public Holidays guests may be introduced

subject to the prior approval of the Management Committee or General Manager.

18. Attire for squash are white and/or light pastel shaded shorts, trousers, skirts and T-shirt or shirt, socks and

non-marking rubber-soled shoes.

19. Only non-marking balls are to be used.

20. Food, drinks and cigarette smoking are not permitted in the Squash area.

21. The Disciplinary Sub-Committee may take disciplinary action against any person who infringes the Squash

Bye-Laws. Appeals may be made to the Management Committee.

22. Complaints and suggestions shall be in writing to the General Manager or Recreation Executive of the Club.

23. The Club will not be liable for any loss or injury through the use of the Squash area.

24. These Bye-Laws are subject to change by the Management Committee from time to time.

BYE-LAWS GOVERNING TENNIS

1. These Bye-Laws shall take effect immediately.

2. Children under the age of 12 may not use or play on the tennis courts without the permission of the

Committee.

3. No person, other than the General Manager, Recreation Executive or such other authorised personnel shall

have authority to instruct the Sports Attendant (or any person) to open courts for play.

4. (a) Playing times from 7.00 a.m. to 10.00 p.m. subject to change by the Committee from time to time.

(b) all players must register in the book provided at the courts before commencing play.

5. The Committee may at its discretion permit ALL OR ANY of the courts to be booked in advance. In the

event of such booking being authorised, it shall be carried out in the manner so prescribed, provided that:-

(a) members must be physically present to book a court;

(b) no court may be booked for a duration of more than one (1) hour (unless it is being booked for

competitions);

(c) no member may book more than one court on any one day (this includes members in a group of 4

persons). A court shall be booked by at least 2 members whose particulars shall appear in the book at the

Club’s Reception provided for this purpose;

(d) a court which has not been taken by such member booking it within 5 minutes of the due time is deemed

to be cancelled. Any member who then takes the court, is booked by him for the remainder of the time;

(e) a non-member or guest may be allowed to play provided he is introduced by a member. If allowed, the

host will be charged the fee prescribed. However, Members are not allowed to bring their guests during

weekends and Public Holidays or after 5.00 p.m. on any day unless prior approval of the Committee or

General Manager has been obtained.

6. The Management Committee shall at its discretion designate a certain day of the week as Club Day. The

purpose of a Club Day, in view of the limited number of courts, is to allow a greater number of members a

chance to play and to encourage tennis players to mix and socialise. The rules on a Club Day are as follows:-

(a) No singles may be played when there are other players waiting;

(b) Any four players may play a doubles match and only a short set of 6 games are allowed. After the set,

they must vacate and give way to the next four players.

7. After 6.00 p.m. Members’ children have no standing and must give way to members, unless playing with an

adult member of the Club.

8. Any play (including practice) of any sort is prohibited while the player is not properly dressed. Tennis shoes

with white T-shirts/light pastel shaded or trousers or skirts must be worn. However, coloured trimmings on

white background are allowed.

9. No person other than members of the Committee, the General Manager or the Recreation Executive shall be

authorised to give instructions to the sports attendant (or any person) on any matter concerning the use of the

courts.

10. The conduct and control of all tournaments, competitions and matches shall be in the hands of the Recreation

Sub-Committee who may fix the dates and times of play for the same, the terms and conditions thereof, entry

thereof, the handicaps of competitors and all other matters in connection therewith as the said

Sub-Committee shall think fit; the said Sub-Committee shall have power to reserve all or any number of

courts as may be necessary for tournaments, competitions and matches.

BYE-LAWS GOVERNING THE GYMNASIUM

1. The Gym shall be open on all days of the week from 7.00 a.m. - 10.00 p.m. or at such other times as

prescribed by the Committee.

2. The facilities at the gym are available only to members and privileged members. Guests and children under

the age of fifteen (15) years are not allowed in the gymnasium.

3. Users are to conduct themselves in a proper manner. There should be no horsing around while on training.

4. All bags and other belongings are not allowed in the gym. They must be left in the lockers in the changing

rooms.

5. No golf shoes are allowed in the gym. Suitable attire includes track suits, leotards, sport shorts, singlets,

t-shirts and sports shoes.

6. Food is strictly not allowed in the gym while sports drinks brought in must be in leak-proof containers.

7. Smoking is strictly prohibited.

8. Members are to seek clarification on the use of gym equipment before use, and to return all equipment to the

original places after use. Users are to ensure that all equipment are treated with care and to wipe sweat off the

equipment after use.

9. Towels available at the reception are not to be brought out of the gym.

10. Users with medical problems are to consult the doctor before use.

11. The management and staff will not be held responsible for any injuries or mishaps that may occur in the gym

during usage by Members either through negligence/or ignorance.

BYE-LAWS GOVERNING KARAOKE

1. VENUE

The Karaoke Room or such other venue in the Club as the Committee may designate from time to time.

2. DAY AND TIME OF THE KARAOKE SESSIONS

2.1 Karaoke will be available every day from 12.00 p.m. and ending at 12.00 midnight.

2.2 The Social Sub-Committee may at its discretion allow the Karaoke at any time before 12.00

p.m.

3. ELIGIBILITY

Unless otherwise provided, Karaoke Sessions are STRICTLY for members and family members 12

years old and above.

4. DRESS CODE

No shorts

No slippers

No caps

No sweaty shirts

No golf shoes

5. REGISTRATION/BOOKING PROCEDURES TO SING

5.1 A member can register to sing only if the member is present in person at the Karaoke Session

and shall complete the Song Request Slip (“Request Slip”) and hand over the Request Slip

(preferably with at least 3 preferred songs written therein together with the member’s Discs (if

any) to the Attendant/person-in-charge.

5.2 Registration/booking to sing made for and on behalf of a member, or by proxy or by phone

calls or verbally or by any other mode or manner, save and except as stipulated in Clause 5.1

above, is strictly prohibited.

5.3 When the name of the member is called upon to sing by the Attendant/Person In-charge as and

when that member’s turn arises and in the event that member is not present in person in the

Karaoke Room for whatever reasons, that member’s right to sing shall be forfeited after the

Attendant/Person in-charge has repeated that member’s name twice over the microphone.

That member’s turn to sing thereafter shall only take place after the completion of the full

cycle queue.

5.4 A member who has registered to sing shall render the song himself or with other member(s)

(at that member’s invitation only). Under no circumstances whatsoever shall that member be

substituted with other member(s) to sing in that member’s place/slot whether by invitation or

otherwise.

5.5 The member shall notify the Attendant/Person in-charge of the member’s intention to cease

singing for the evening to facilitate the deletion of the member’s name from the queue-list.

6. MICROPHONE/EQUIPMENT

6.1 The member shall after singing return the microphone forthwith to the designated

microphone-holder provided.

6.2 A member using the cordless microphone shall after singing forthwith return the said

microphone to the Attendant/Person in-charge personally, failing which the member shall be

fully responsible for the cost of the microphone if the same is lost or damaged for any

reason(s) whatsoever as a result of the member’s failure to comply as herein provided.

6.3 No member shall under any circumstance interfere with or otherwise abuse any of the

Karaoke equipment. The member shall be responsible to make good in full to the Club the

cost of the loss or damage caused by that member/guest to the Karaoke equipment. The

decision by the Management Committee as to the amount/cost of the damage shall be final.

7. RESPONSIBILITY/AUTHORITY OF THE SOCIAL SUB-COMMITTEE

7.1 All activities, events, competitions, socials and such activities relating to Karaoke whether in-

house, inter-clubs or otherwise will be organized, conducted and handled by the Social Sub-

Committee.

7.2 The Social Sub-Committee is authorized to determine whether a singer is a member. The

singer shall comply with the request made to the singer by the Social Sub-Committee. In the

event the singer is found to be a non-member, his singing shall cease forthwith unless

accompanied by a member as guest/s.

7.3 No member shall reprimand:-

(a) another member; and/or

(b) the Attendant/Person in-charge

for any infringement of the Bye-Laws. Any dispute, disagreement or complaint whether

arising out of these Bye-Laws or in connection with or arising from or pertaining to the

Karaoke and/or the Attendant shall be referred to the Social Sub-Committee or any Social

Sub-Committee member present who shall decide on such dispute, disagreement or complaint.

Such decision by the Social Sub-Committee or the Social Sub-Committee member shall be

final unless reversed by the Social Sub-Committee or the Management Committee as the case

may be.

7.4 Any matters arising for which no provision has been made by these Bye-Laws shall be

determined by the Social Sub-Committee or by any member of the Social Sub-Committee if

present. Such decision by the Social Sub-Committee or the Social Sub-Committee member as

the case may be, shall be final, conclusive and binding on the member concerned unless

reversed by the Social Sub-Committee or the Management Committee as the case may be.

8. GUESTS

8.1 Members shall register their guests in accordance with the Rules of the Club.

8.2 Each member is only allowed to sign in one guest per day.

8.3 The guests are strictly prohibited from singing without the members other than as provided for

in clause 8.4 hereof.

8.4 The guests are allowed to sing not more than three songs per session, unless there are no

members waiting, on designated days as decided by the Management Committee. The

members bringing the guests shall be charged at a per guest-singer fee as determined by the

Management Committee.

8.5 Members shall be fully responsible for the behaviour and conduct of their guests at all time in

and around the Club and/or during the Karaoke Sessions and/or elsewhere.

9. BREACH AND SANCTION

Any member who refuses to comply with any of these Bye-Laws or who after having been warned by a

Social Sub-Committee member for a breach of these Bye-Laws commits the same breach or persists to

commit the breach shall be subject to sanction and disciplinary action provided by any of the Rules of

the Club with regard to conduct of members.

10. LIABILITY

The Social Sub-Committee shall not be responsible or be liable for any personal injuries, death, loss or

damage whatsoever or howsoever caused to any person(s).

11. SMOKING

Smoking is strictly prohibited in the Karaoke room.

12. FOOD

Only snack/finger food is allowed in the Karaoke Room.

13. COMPLAINTS/SUGGESTIONS

All complaints and suggestions concerning Karaoke shall be made in the complaint book or in writing

to the General Manager.

BYE-LAWS GOVERNING FOOD & BEVERAGE SECTION

A) Eagle’s Nest

1. Operation hours:

Lunch : 12.00 noon to 2.30 p.m. - Last order shall be placed by 2.00 p.m.

Dinner : 6.30 p.m. to 10.00 p.m. - Last order shall be placed by 9.30 p.m.

2. Dress Code: No shorts

No slippers

No caps

No sweaty shirts

No collarless shirts

3. Members who bring their minors must ensure they do not cause any annoyance to other diners,

otherwise services will be denied.

4. No mobile phone is to be used in the Eagle’s Nest.

B) Bilik Buaya

1. Operation hours: Daily from 4.00 p.m. to 12 midnight.

2. Dress Code: No shorts

No slippers

No caps/hats

No singlets

No sweaty shirts

No collarless shirts

3. The Committee may at any time and from time to time by notice, alter, extend or restrict the above

hours.

4. Subject as aforesaid all members or privileged persons remaining in the Bilik Buaya after the closing

time shall pay the overtime of the staff for the first hour or part thereof, which they so remain, till not

later than 2.00 a.m.

5. Members are only allowed to keep their unconsumed liquor up to a maximum of 1 litre in the Bilik

Buaya for a maximum of 3 months. After which the unconsumed portion must be consumed or

removed by the members concerned, failing which the bottles will be confiscated by the Club.

6. No person below 18 years of age is permitted in the Bilik Buaya.

C) Golfers’ Terrace

1. Operation hours: Daily from 6.30 a.m. to 10.00 p.m.

Last order shall be placed by 9.30 p.m.

2. Dress Code: No singlets

Shorts not more than six inches above the knees

No Japanese slippers

No clogs

D) Family Terrace

1. Operation hours: Daily from 8.00 a.m. to 10.00 p.m.

3. No liquor is to be served in the Family Terrace.

4. Smoking is not permitted in the Family Terrace.

E) Pizza Corner

1. Operation hours: Monday – Friday 11.30 a.m. – 3.00 p.m.

5.30 p.m. – 10.00 p.m.

Saturday – Sunday 10.00 a.m. – 10.00 p.m.

F) Poolside Terrace

1. Operation hours: Daily from 7.00 a.m. to 10.00 p.m.

Last order shall be placed by 9.30 p.m.

2. No wet clothes and swimming attire are allowed in the Poolside Terrace.

G) Dewan Tunku

1. Dress code for Inter-Club functions: No shorts

No slippers

No collarless shirts

No caps

No sweaty shirts

2. Smoking is not permitted in the Dewan Tunku.

H) The Committee may designate certain areas at other F&B outlets as no smoking areas. Signs shall be

posted and members shall abide by these signs.

I) All liquors brought into the Club premises either for personal or social functions are subjected to a

corkage charge at a quantum determined by the Committee from time to time.

J) “Duty Not Paid” liquors are not permitted in the Club premises.

BYE-LAWS GOVERNING THE USE OF CHANGING ROOMS

1) Strictly no smoking in the changing room.

2) No golf bags/ golf clubs or trolleys shall be brought into the changing room.

3) All personal effects or belongings, including golf shoes must be kept inside the lockers.

4) No firearms or dangerous weapons are permitted into the changing room.

5) Towels issued from the counter must be returned to the counter after use, failing which a levy of RM 15.00

per towel will be imposed.

6) Day lockers are meant for day use only, and all belongings must be removed by 10.00 p.m. on the same day.

Members failing to return the day lockers’ keys will be liable to a fine of RM10.00 per day. If the key is lost

a sum of RM35.00 will be debited to the member’s account.

7) No property of the Club available for the use by golfers may be taken out from the changing room.

8) Any member breaking or damaging the property of the changing room shall pay the Club the cost of making

good the damage. This amount shall be assessed by the Committee whose decision shall be final.

9) The Club is not responsible for any loss or damage to items or property kept in the lockers.

10) Visitors/ Guests must return the daily locker’s key and towel to the attendant after use, failing which the

deposit of RM50.00 will be forfeited.

11) Any infringement of the above will be strictly dealt with by the Disciplinary Committee.

BYE-LAWS GOVERNING DISCIPLINARY PROCEDURES

1. In these Bye-Laws unless the context otherwise requires:

“Articles” means the Articles of the Club.

“Chairman” means the Chairman of the Sub-Committee and shall include the Deputy Chairman acting in

accordance with Rule 2(b).

“Committee” means the Management Committee of the Club.

“Club” means Kelab Golf Negara Subang (Company No. 8047-P).

“General Manager” means the General Manager of the club or his deputy or assistant.

“Member” means any member of the Club.

“Panel” means the Preliminary Investigation Panel set up to conduct preliminary investigation of any

complaint concerning the conduct of any member that may constitute an infringement of the articles or Bye-

Laws of the club.

“Sub-Committee” means the Disciplinary Sub-Committee of the Club.

2. (a) The incoming Committee shall appoint a Disciplinary Sub-Committee comprising a Chairman and a

Deputy Chairman from amongst the members of the Management Committee and not more than seven

(7) other members of the Club as may be recommended by the Chairman and such Sub-Committee shall

be delegated with the powers of discipline of the club, in accordance with Article 35 of the Articles.

(b) The Sub-Committee may act notwithstanding any vacancy and in the case of a vacancy, the Committee

may appoint and fill such vacancy as may be recommended by the Chairman.

(c) The General Manager or his assistant shall act as secretary and shall be responsible for recording the

minutes of all disciplinary proceedings including the testimony of any witnesses and shall also be

responsible for preparing any report of such inquiry in the event of any appeal by a dissatisfied member.

(d) In addition to the requirements stipulated below, the General Manager shall assist the Sub-Committee in

such manner as may be requested by the Chairman from time to time in connection with any disciplinary

matter.

3. The Chairman and any two (2) Sub-Committee Members shall constitute a quorum.

4. Each Sub-Committee shall hold office until the next Sub-Committee is appointed.

5. (a) The Sub-Committee shall meet from time to time for the despatch of business as may be determined by

the Chairman.

(b) The Chairman shall preside at the meetings of the Sub-Committee and shall exercise all the functions

and powers provided under these Rules. In the absence of the Chairman, or in the event the Chairman is

unable to act, the Deputy Chairman shall act and carry out the functions of the Chairman.

6. (a) The Chairman shall appoint six members of the Club (other than the 7 members appointed to the Sub-

Committee) to the Panel who together with the General Manager shall constitute the Panel. Each

member appointed to the Panel shall hold office until the next Panel is appointed. In the case of a

vacancy, the Chairman may appoint and fill such vacancy.

(b) The General Manager and any two members of the Panel shall constitute a quorum and the members

shall elect any one of the two members to be Chairman of the Panel.

7. Any complaint concerning the conduct of any member that may constitute an infringement of the Articles,

Rules or Bye-Laws of the Club shall be made either:-

(a) in the complaint book kept at the reception counter or such other places designated by the Committee

for such purposes; or

(b) in writing sent to the Sub-Committee through the General Manager or such other person(s) designated by

the General Manager for that purpose.

8. (a) On receipt of any complaint, the Panel shall conduct an investigation to determine whether there is any

ground to support the complaint. The Panel shall endeavour to complete such investigation within (30)

days from the receipt of any complaint, provided that the period of 30 days may be extended as the

circumstances required, at the discretion of the Panel.

(b) At the end of the investigation if the Panel find that the matter does not justify any inquiry, they will

dismiss the complaint and inform the parties concerned that the complaint is dismissed. If the

complainant is not satisfied with the conclusion, he may request for a review of the

complaint by the Disciplinary Sub-Committee.

9. In cases where the Panel finds there are grounds to support the complaint, the General Manager shall write to

the member concerned to attend in person at an inquiry on a date to be fixed to show cause why disciplinary

action should not be taken against him.

10. At least seven (7) days prior written notice of any inquiry shall be given to the parties concerned. If a party

has been given adequate notice and fails to attend an inquiry without reasonable cause acceptable to the Sub-

Committee, then the Sub-Committee may proceed with such inquiry in his absence and make such order

pursuant to Rule 16 as they deem fit after such inquiry.

11. At the commencement of an inquiry, the General Manager shall outline the complaint made. The Chairman

shall thereupon explain to the member the nature of the alleged infringement and invite him to plead. If he

admits the infringement, he shall be given a chance to explain and/or to plead in mitigation. Thereupon the

Sub-Committee may adjourn the inquiry to decide on the punishment.

12. (a) If the member does not admit the allegation, the inquiry shall proceed with the hearing of the

witness/witnesses called by the General Manager. The member shall be given the opportunity to cross-

examine the witness.

(b) The Chairman and/or any Sub-Committee Member may examine any witness (including the

complainant) during any stage of the hearing. If there is fresh evidence arising from such examination,

the member shall be given the opportunity to cross-examine the witness but he shall confine the cross-

examination to fresh issues only.

(c) After hearing all the witnesses called by the General Manager, the Sub-Committee shall decide whether

the complaint has been substantiated. If the complaint is not substantiated or there is a doubt in the

matter, the Sub-Committee shall dismiss the complaint and discharge the member.

13. (a) If the complaint has been substantiated, the member shall be asked to state his case and call his

witnesses. If he tenders any written statement, such statement shall form part of the record of the

proceeding.

(b) The member and/or his witnesses may be cross-examined by the Chairman and by any member of the

Sub-Committee.

(c) At the end of the case by the member, he may submit his case or leave the matter for the Sub-Committee

to decide.

14. If the Sub-Committee decides at the end of the hearing that the member has exculpated himself, the Sub-

Committee shall discharge him. If the Sub-Committee decides that the member has not exonerated himself,

the Sub-Committee shall give him an opportunity to plead in mitigation before making any order under Rule

16.

15. The Sub-Committee may make any order pursuant to Rule 16 immediately at the end of the inquiry or may

reserve its decision and communicate such decision to the member in writing at a later date.

16. The Sub-Committee may make any of the following orders:

(a) Warning and/or reprimand; and/or

(b) Suspension from any Club activities for a period not exceeding thirty six (36) months for any single

violation; or

(c) Expulsion from the Club.

17. When a member is suspended or expelled from the Club, such suspension or expulsion shall only take effect

at the end of 14 days of the date that the order is conveyed.

18. Any member who is dissatisfied with any order of the Sub-Committee made against him may apply for a

review or appeal to the Committee in writing, stating his ground(s) for review or of appeal. Such application

or appeal shall be lodged by the member through the General Manager with a copy thereof extended to the

Chairman of the Sub-Committee within fourteen (14) days of the date that the order is conveyed to him

pursuant to Rule 16.

19. When an application or appeal has been presented, the Committee shall consider the grounds of

application/appeal upon the written report of the inquiry conducted by the Sub-Committee. The Committee is

at liberty to review the case either in the presence of the member and the Sub-Committee or in the absence of

either of them at a meeting of the Committee they shall absolutely deem fit. For purposes hereof, the report

of the Sub-Committee shall be accepted as a true and correct record of the inquiry.

20. The Committee may:-

(a) quash, set aside, vary, decrease or add to the punishment or confirm the decision of the Sub-Committee;

(b) make any other decision or order which in their opinion ought to have been made by the Sub-Committee;

and/or

(c) make such further or other order as they shall absolutely deem fit.

The powers aforesaid may be exercised by the Committee notwithstanding that the notice of application for

review/appeal may be to a part only of the Sub-Committee’s decision.

21. Pending the results of the hearing of any such application for review or appeal against the decision made by

the Sub-Committee, the suspension or expulsion order shall be held in abeyance.

22. The decision of the Committee shall be final. In the event that the Committee confirms any order of

expulsion made by the Sub-Committee, the expelled member shall be entitled, where an appropriate request

in writing has been made, to require the Committee to convene an extraordinary general meeting in

accordance with the provisions of the Articles of Association of the Club.

KGNS GOLF RULES

NAME

These rules shall be called the “KGNS GOLF RULES”

INTERPRETATION

THE CLUB OR KGNS - Shall mean Kelab Golf Negara Subang.

GOLF RULES - Shall mean KGNS Golf Rules.

THE COMMITTEE - Members of the Management Committee and such other persons so authorised by the

Management Committee, including the Competitions, Rules & Handicapping Sub-Committee and such other

Sub-Committees formed under the authority of the Management Committee.

MEMBERS – Include ordinary, privileged and junior members as decided by the Management Committee or

otherwise specifically stated.

LADY GOLFERS – Include junior golfers unless stated otherwise.

JUNIOR MEMBERS – Golfers between the ages of 18 and 21 years.

PUTRA COURSE - The 18-hole golf course comprising the Agong’s Nine and Tunku’s Nine.

KELANA COURSE - The 18-hole golf course comprising the Sultan’s Nine and the Tun’s Nine.

PUBLIC HOLIDAYS - Shall mean only gazetted National, Selangor and Federal Territory holidays.

R & A RULES LIMITED - Shall mean the R & A Rules Limited.

USGA – Shall mean the United States Golf Association.

CLUB HANDICAP - Shall mean a handicap computed in accordance with the USGA Handicap System and

certified by the Chairman of the Handicapping Committee or such other persons authorised by the Committee.

PERMISSION - Shall mean permission by the Management Committee unless otherwise specifically stated.

KGNS GOLF RULES / BYE-LAWS

These GOLF RULES cancel and supersede all previous GOLF RULES and shall be in force with immediate

effect by virtue of the authority delegated to the COMPETITION SUB-COMMITTEE under the General Bye-

Laws of the Club sanctioned by the MANAGEMENT COMMITTEE. The Management Committee reserves the

right to amend or delete part or all of any rule whenever necessary.

RULE 1 – RULES OF GOLF

The Rules of Golf as approved by the R & A Rules Limited and the United States Golf Association (R&A Rules

Limited & USGA) together with these GOLF RULES shall apply to all forms of play of golf and to all club

competitions unless otherwise expressly laid down by the Committee in a particular match or competition.

RULE 2 - IDENTIFICATION

(a) Members - An official golf identification tag (supplied at cost) shall be displayed in a conspicuous part of

the golf bag by all members while utilising the Club’s golf courses and shall be made available for inspection

upon request by any member of the Committee or such other authorised personnel.

(b) Visitors - Visitors belonging to a club with reciprocal arrangement and duly authorised non-members whilst

utilising the Club’s golf courses, shall be required to display the appropriate visitor’s tag in the same manner

mentioned in RULE 2(a).

RULE 3 - ELIGIBILITY TO PLAY

(a) All golfers shall be entitled to play in any of the Club’s golf courses, subject to RULE 3(b).

(b) In order to expedite play, male golfers with handicap from 19 to 24 are encouraged to tee-off from the white

teeing ground on Weekends/Public Holidays at the Putra Course except in Competitions. Golfers (men &

ladies) without a valid Club Handicap or whose handicap is above 24 shall not be entitled to play on the

Putra Course (unless during competitions when prior permission has been obtained from the Committee).

(c) Restricted members shall not be entitled to play on the Putra Course on Saturdays, Sundays and Public

Holidays for a period of two years from the date of their election as members of the Club except those with a

club handicap of 18 and below.

Note: However, privileged members converted to Ordinary Members are not subjected to the

restriction under RULE 3 (c).

Not more than one restricted member in a single flight shall be allowed to play on the Putra Course on

Saturdays, Sundays and Public Holidays. Restricted members may be permitted to participate in any

competition or match approved by the Committee.

(d) Lady golfers shall play from the red tee-markers only on the Putra Course unless permission has been

obtained from the Committee. They may tee-off from either the white or red teeing ground on the Kelana

Course. Lady golfers with handicap of 25 and above are not permitted to play on the Putra Course except in

competitions.

Note: Members who joined the club after 1st May 1999 are not permitted to use the Club’s golfing

facilities until they have attended the ‘Introduction Night’ which is compulsory. Club blazers

must be worn on such occasion and are applicable to proposers and seconders as well.

(e) Any visitor belonging to any club having reciprocal arrangements with Kelab Golf Negara Subang may use

the Club’s golfing facilities up to a maximum of 10 times in any one calendar year PROVIDED ALWAYS

that such a visitor MAY NOT exercise his rights under the reciprocal arrangements to play golf if:-

i) He or she resides in SELANGOR or WILAYAH, or

ii) He or she has two or more places of residence and one of which is in SELANGOR or WILAYAH,

whether temporary or otherwise.

It is compulsory for all reciprocal members to engage caddy/caddies (i.e. One Buggy & One Caddy).

(f) Non-Members - Unless otherwise expressly permitted by the Committee, non-members of the Club shall not

be permitted to play on the Putra Course on Saturdays, Sundays and Public Holidays, and may only play on

the Kelana Course, except in so far as they are permitted to participate in any competition or match approved

by the Committee.

However, members shall be permitted to introduce a maximum of THREE non-members on each occasion

on weekdays and ONE non-member on Saturdays, Sundays and Public Holidays, at such fee applicable, and

shall ensure that the Visitors’ Book is duly completed before such visiting non-members utilise the Club

premises or golf courses.

Any member who introduces a visiting non-member shall be liable to the Club for all monies due to the Club

and shall also be responsible for the proper conduct and due observance of the Local Rules and / or such

other Rules of the Club by such visiting non-member.

It is compulsory for all members’ guests to engage the services of the Club caddies with or without

buggies, unless due to shortage/with Committee’s approval.

Guests may only play in the company of a member unless approval is obtained from the Committee to do

otherwise.

A maximum of 10 guests per day on each course may be permitted on Saturdays, Sundays and Public

Holidays, subject to the discretion of the Committee.

RULE 4 - MEMBERS PLAYING TO CLUB HANDICAP

The Club subscribes to the USGA Handicap System.

(a) Members - Any member whose handicap has been computerised at 36 or below for men and 40 or below for

ladies shall be entitled to apply for a Handicap Test upon returning at least 10 (ten) 18-hole score cards.

(b) Members joining from other clubs shall be entitled to apply for a Handicap Test / Familiarisation round

provided that they properly submit certified records from such other club their last twenty 18-hole scores

together with the appropriate course and slope ratings. Such certified scores shall become part of the

members’ scoring record at KGNS.

(c) Handicap Test / Familiarisation Round - Applications shall be made in the Handicap Test Book at the

Golf Department. Authorised testers will carry out handicap tests / familiarisation rounds after the applicant

has attended the Golf Rules Seminar.

(d) Assignment of Handicaps - Official club handicap shall be assigned by the Captain to successful members

on completion of their handicap test. Such assigned club handicap shall remain in force unless and until they

are withdrawn at the sole discretion of the Committee.

(e) Club Competitions - All Club competitions are under the control of the Committee, which reserves the right

to change / alter any date and cancel, or modify any competition rules. Members with a club handicap shall

be entitled to participate in any club competition or match. All competitions and matches shall be governed

by the Rules of Golf mentioned in RULE 1 above.

(f) USGA Handicap Index - All club handicaps shall be in accordance with the USGA Handicap System and

shall be under the full authority and control of the Committee who may assign or withdraw any handicap.

(i) Handicap Adjustment (Reduction/Augmentation) - Reduction of Handicap Index on Exceptional

Tournament Scores. (Note: The following procedure was implemented from 1st January, 1994). The

Committee shall reduce the handicap of a player who scores better in competitions than in informal

games, as per Section 10-3 of the USGA Handicap System.

(ii) A player’s handicap shall also be reduced when normal computation methods produce a handicap

obviously too high for the individual’s ability due to a various reasons.

Examples:

(a) A player whose improvement in the game is too rapid to be handled equitably by the standard

method.

b) A player whose home course handicap increases by 3 or more strokes due to posting of numerous

away scores, and subsequent scores at home clearly indicate that his increased handicap is too high.

c) A player who does not turn in all scores or otherwise does not observe the spirit of the USGA

Handicap System. The Committee shall determine the quantum and duration of the adjustment.

d) A player with substantiated evidence of long illness or medical reasons may have the handicap

reviewed upwards upon approval of the Captain.

(iii) Handicap Withdrawal - In extreme cases of a player who repeatedly fails to meet the player’s

responsibilities under the USGA Handicap System, withdrawal of the handicap is recommended and the

routine process of obtaining new handicap is required.

(g) Members of Multiple Clubs - Members belonging to two or more clubs and having different handicaps at

different clubs shall use the lowest USGA Handicap when competing in any club competition or match.

(h) Disqualification - It shall be the member’s sole responsibility before the start of any handicap competition or

match to ensure that his or her handicap is recorded correctly on the official list and / or on the scorecard

issued to him or her by the Committee. If a player plays off a higher handicap, he or she shall be disqualified

from the handicap competition or match. If a player plays off a lower handicap than his or her current official

lowest handicap, the score and / or result of the competition or match shall stand.

(i) Scorecards - Members must return their scorecards upon completion of 9 or 18 holes duly checked and

signed by the player, including for unfinished rounds with reason. Failure to do so shall be subjected to such

action by the Committee as it sees fit and may result in withdrawal or suspension of such member’s Club

handicap. 18-holes scores played at courses outside KGNS shall be submitted together with the date, time,

course and slope ratings.

RULE 5 - COURSE CONTROL

(a) The Committee shall have control over the courses of the Club and may open or close any or all of them,

determine the usage of buggies, whether for particular class of play or for particular occasions or reasons

otherwise as the Committee may think fit. In cases of emergencies, the Captain or any Management

Committee member assigned by him or in their absence the General Manager / Golf Manager may exercise

the powers of the Committee.

(b) Commencement of Play

(i) All players must register and be verified at the Registration Centre of all particulars including their

handicap and golf insurance before commencing play on any of the courses.

(ii) The commencement of normal play shall begin only from the 1st and 10th tee at the Putra Course and

the Kelana Course.

(iii) Official tee-off time for the Putra Course is first light but NOT earlier than 6.45 a.m. and is usually

signalled with the sound of siren. Ordinary members shall have priority before 7.30 a.m. on weekdays.

(iv) Official tee-off time for the Kelana Course is first light but NOT earlier than 6.45 a.m. on all days and

is usually signalled with a sound of siren. Ordinary members shall have priority before 7.30 a.m.

(v) A flight must comprise at least 2 ordinary members, to be allowed to tee-off before 7.30 a.m. on both

courses.

(vi) Players commencing play on either the Putra Course or the Kelana Course are advised to continue play

on the second nine at the same course.

(vii) Official tee-off times for Weekends and Public Holidays on the Putra Course shall be regulated by the

Official Starting Times mentioned below (except approved matches or competitions):-

Morning - 7.30 a.m. to 9.29 a.m.

Afternoon - 12.00 p.m. to 1.59 p.m.

Evening - 4.16 p.m. onwards

Should there be delay on Official Starting Times due to inclement weather, the Official Booked Times

shall remain. The flight that missed their Booked Time shall follow immediately after the last Booked

Time Flight in order of sequence.

(c) Flight Leader

(1) The Flight Leader must be a member of KGNS. In a flight consisting of more than one member, the

lowest handicapper shall be the Flight Leader. In case of equal Handicaps, the more senior member

with respect to age will be the Flight Leader.

(2) The flight leader shall be responsible and liable for the control and conduct of his flight mates

during the course of play and to ensure his flight mates:-

(i) Carry sand pails before commencement of play or in cases where buggies are used in the

flight, there are sufficient sand pails in the buggies; to advise using sand to fill divots, repair

ball marks, rake bunkers and hit a ball according to normal ball position sequence.

(ii) Clock the time of commencement, cross over (if applicable) and end of play on the score card

to be submitted to the Club at the end of play.

(iii) In keeping up with the flight in front and take the necessary actions as described in RULE

5(e), if the flight has dropped a hole behind the front flight.

(iv) Do not tee off or take s shot while players ahead are within range.

(v) Do not cause injuries to any player ahead who is within range.

(vi) Properly attired, mannerism, adhere parking policies of trolleys/buggies and ensure their

caddies abide by the Club rules.

(3) For a flight without a KGNS member, the lowest Handicapper shall be the Flight Leader. In the

case of equal handicaps, the more senior player with respect to age shall be the Flight Leader.

(4) The flight leader shall if requested by the Panel, provide details of any infringement of RULE 10 of the

Club Bye-Laws in regard to conduct by any member of his/her flight in writing or appear in person, if

called to provide oral evidence of any such infringement by the Disciplinary Sub-Committee.

(d) Bad Weather - Play on the course shall be regulated by the use of siren signals to signify as follows:-

One continuous blast of 1 minute - Stop Play

Two continuous blasts of 1 minute - Abandon Play

A series of short blasts - Resume Play

(e) Pace of Play - A flight place in the field is directly behind the flight in front and not merely in front of the

flight behind. The flight leader is responsible for his/her flight in keeping up with the flight in front. If a

flight has dropped a hole behind the front flight, it must either:

(i) close the gap with the front flight without further delay,

or

(ii) allow the following flight through.

If no corrective action is taken by the offending flight, the course marshal or any officer on duty will take the

necessary action including escorting the offending flight out of the course. Players are expected to assist and

cooperate with the officials and course marshals at all times without any delay / argument.

Overtaking - A flight is permitted to overtake the flight immediately ahead, when the front flight stops after

9 holes, or at any halfway/drink hut, for any reason whatsoever. The flight that stops shall lose its position

and will follow the flight/flights immediately ahead should the flight behind has not reached the green.

(f) Advance / Current Booked Flights

1) Agong’s Nine (Advance Booking)

a) Registration will be opened 7 days in advance from about 6.30 a.m.

b) Registration must be made in person (no registration by phone).

c) A flight may be booked with only one member’s particulars recorded but this member must be

present and play on this flight.

d) A booked flight may be cancelled not later than 12.00 noon one day before the flight.

e) Flights booked are not transferable.

f) Any booked flight which is subsequently cancelled, may be replaced, with priority for those on the

Reserve List.

Penalty for breach of Rule 5(f)(1)(c), (d), (e) or (f) is a RM40.00 fine per flight, charged to the member

who did the registration.

2) Tunku’s Nine (Current / Day Booking)

a) Registration will be opened from 6.30 a.m. at the Golf Service Centre on Saturdays, Sundays and

Public Holidays for morning and afternoon play.

b) A member present at the Club may register a flight.

c) The member registering the flight must play in that flight. In the case of no show, a RM40.00 fine

will be imposed on the person registering the flight.

3) Daily Booking System - Weekdays (Agong’s & Tunku’s Nine) Booking shall be made at the Starter’s

Hut and minimum 3 golfers must be present at the Tee-Box. If any golfer in a flight is found making a

double booking, the whole flight will lose their tee-off time priority.

RULE 6 - PRIORITY AND STANDING

Subject to His Majesty the Yang DiPertuan Agong, the Sultan and the Yang Di Pertua Negeri’s Royal

Prerogative, priority and standing on the course shall be subject to the following regulations unless otherwise

expressly determined by the Management Committee.

a) The President, Vice-President and Captain shall have absolute priority on the course at all times.

b) Three-ball and four-ball matches shall have equal standing and priority for all official starting times and

shall have priority over matches starting on other than official starting times except as provided in RULE

6 (c).

c) Course Closure for maintenance work on weekdays are as follows:-

d) Priority for crossover is as follows:-

(i) Putra Course - A crossover flight has priority over a new flight provided the flight has not lost its

place on the course. The last crossover time priority for weekdays cease after 11.45 am for Morning

golfing session and after 4.15 pm for Afternoon golfing session. Starters will allow a new flight to

register and tee-off ahead of a crossover flight should they find the new flight ready to play before

the crossover flight leaves the last green for their second nine and when the flight ahead is clearly out

of range. This rule does not apply on weekends and public holidays.

(ii) Kelana Course - Priority for crossover on the Kelana Course for all days will be on an alternate

basis, i.e. flights playing their second nine will have to allow a new flight to play ahead of them, if

the new flight is already registered as waiting.

(Note: In case of uncertainties / disputes, the starter’s ruling is final.)

RULE - 7 PRESERVATION OF THE COURSE, ETC.

a) No player shall cause any damage to any part of the putting greens by whatever means such as moving in

such a manner as to drag his/her feet, or by throwing any club thereon. The player must ensure that he/she or

his/her caddy does not damage any part of the golf course.

b) All players shall ensure that they or their caddies replace / fill divots, rake bunkers, repair pitch marks and

carry a sand-filled pail.

c) Golf bags and trolleys are prohibited on the tee-boxes and on the greens / collars.

d) Buggies shall be kept away from tee-boxes and at least 10 metres from around the putting greens.

(Note: A member who breached RULE 7 twice within a period of six months, shall be suspended for

one month from playing golf on both courses)

RULE 8 - PRACTICE RANGE RULES

a) Operating Hours - 7.00 a.m. to 10.00 p.m. daily from Mondays to Sundays including Public Holidays

except on Fridays, the Driving Range is closed for weekly Stock Check from 7.00 a.m. to 1.00 p.m.

b) Practice Area - Play shall be on tier which has been marked by tee markers. There shall not be any play in

front or more than one club length behind the markers. Play from the tier is only permitted towards the

range. Play to the green and bunkers are not permitted. In the event of rain and practice is not possible on the

tier, members may use the top cement tier by using the rubber golf mats only or as and when directed by the

driving range staff.

c) Practice Balls - Practice Range balls are not allowed to be taken outside the driving range area and this

includes all other practice areas / greens.

d) Signing - Members shall sign for the balls immediately and a maximum of 100 balls is allowed per issue.

STRICTLY NO CASH TRANSACTION.

e) Guests - Members introducing guests are responsible for their registration, practice fee, purchase of range

balls and conduct. Latest time for members to sign in guests is at 7.00 p.m.

f) Children -

Below 18: Do not have priority during peak hours.

(5.00 p.m. to 7.00 p.m.)

Below 13: Not permitted to enter the Practice Range Area unless: -

i) Prior permission has been given by the Committee to do so unaccompanied.

ii) Accompanied by parent / guardian for the purpose of practicing golf; or

iii) Accompanied by Golf Professional or Assistant for the purpose of taking golf lessons.

g) Golf Lessons - To be conducted by Golf Professionals or Assistants only. Any lesson / demonstration

conducted by other golf professionals must get prior approval from the Committee.

h) Attire - Gentlemen: Dress - Tee shirts with collar / mock turtleneck and sleeves (tucked in).

Trousers, pants or shorts (not more than six inches above the knees).

Ladies : Dress - Tee shirts with collar / mock turtleneck and sleeves (tucked in).

Trousers, pants, skirts or shorts (not more than four inches above the

knees).

Shirt must be tucked in at all times. Ladies fashions that are designed to be worn out for

golf, must not be less than 4 inches below the belt line. Tops should have collar and

sleeves. Proper ladies golf mock turtle collar are permissible.

Footwear - Proper golf shoes.

Note: Jogging shorts / pants, pants / shorts with denim / jeans materials and flowery

beach shorts are not allowed.

PLEASE OBSERVE RULES AND ETIQUETTE AT THE PRACTICE RANGE.

MEMBERSHIP CHECKS WILL BE DONE PERIODICALLY.

RULE 9 - REGISTRATION

a) Registration of normal play - All golfers are required to register their full particulars prior to

commencement of normal play at the Putra Course and Kelana Course; and prior to using the Driving Range,

at all times. A register will be provided for this purpose. Failure to register may result in loss of playing

privileges.

b) Issue and return of scorecards - Scorecards will be issued to each golfer/flight and must be properly

completed and signed by every golfer concerned and dropped into the boxes provided without delay upon

completion of a round.

c) Deployment of Caddies – The particular class of caddies will be allocated to a golfer where possible if so

requested. Caddies may be dispatched to a particular tee-box prior to tee-off if so requested by the golfer.

All members are allowed to reserve caddies of their choice. However, such caddies must be registered with

the Club. In addition to the normal fees, an administration fee will be charged as follows:

RM5.00 - Caddie for 9 holes

RM10.00 - Caddie for 18 holes

d) Hiring of Buggies - Members may also hire buggies for their normal play and certain competitions as

approved by the Sub-Committee. Members are however encouraged to hire caddie if available.

Note: No person below the age of 18 years shall drive buggies.

e) Personal effects and valuables - All golfers are advised NOT to keep any personal effect and valuables in

their golf bags or buggies at any time in order to avoid any possible misunderstanding arising from any loss.

f) Competitions - The above rules will also apply during any Club, private or major golf tournament unless

specifically superseded by any rule of a particular competition.

RULE 10 - CONDUCT

Golfers shall at all times conduct themselves in a gentleman and lady-like manner befitting members of the Club.

Every golfer must:-

10.1 Register before playing on any course.

10.2 *Display authorised golf bag tag.

10.3 Not declare a false handicap to play on any course.

10.4 Not deliberately conceal being a Restricted Member in order to play on the Putra Course.

10.5 Not use another member’s name to play on any course.

10.6 Tee-off only from designated tee box areas on any course.

10.7 Not tee-off or take a shot while players ahead are within range.

10.8 Avoid causing injuries to any player ahead who is within range.

10.9 Refrain from making unnecessary loud noise or use abusive language to the annoyance of the other

players.

10.10 Not throw clubs or balls to the annoyance of other players.

10.11 Not cause any damage to any part of the course with whatever instrument (e.g. clubs, golf shoes, etc.).

10.12 Avoid abusing and threatening or refusing to obey request / direction from any staff.

10.13 Submit duly signed scorecard after completion of play.

10.14 Not deliberately return or submit scorecard with incorrect scores.

10.15 Play in any interclub game after being selected, except with notification.

10.16 Not play two (2) or more balls on the course except when allowed by the rules of golf.

10.17 Stop playing after the siren indicating stopping play has been sounded.

10.18 Not engage any caddie without authority.

10.19 *Pay any caddie engaged only using the caddie chits provided.

10.20 Not join a two-ball flight at any stage of the game on courses reserved for two-ball flights.

10.21 *Not share clubs or golf bag with another golfer.

10.22 *Not allow non-golfers or other golfers to accompany him in any round of golf when they are not

registered to play.

10.23 Not be found cheating by deliberately moving any ball for a better lie; deliberately replacing lost ball to

avoid penalty; etc.

10.24 Not fail to observe these Golf Rules or any other rules and bye-laws of the Club.

Note: Exceptions on the above rules depicted by (*) may be allowed when prior permission has been

granted by the Committee.

RULE 11 - ATTIRE

The proper attire for golfers on the golf course, driving range or practice greens shall be:

Men

Headgear (Optional) Cap / Hat / Visor

Dress Sports shirt with collar / mock turtleneck and sleeves (tucked in). Trousers / pants or shorts

should not be more than 6 inches above the knees. Jogging shorts / pants and pants/shorts with

denim / jeans materials and flowery / batik beach shorts are not allowed.

RULE 12 - GOLF RULES FOR CHILDREN:

(a) Children (12-18 years) who have passed KGNS Handicap Test are allowed to:

(i) Play on the Kelana Course at all times.

(ii) Play on the Putra Course on weekdays with handicap 24 and below.

(iii) Play on Putra Course on weekends and public holidays with the following conditions:

(a) Handicap 18 and below.

(b) Adult member has to come and book the flight for them.

(c) They must be accompanied by the adult member who booked the flight.

(b) Children (12-18 years) who have not passed KGNS Handicap Test are allowed to:

(i) Play on the Kelana Course on Mondays at all times.

(ii) Play on the Kelana Course on Tuesdays to Fridays, and must tee-off before 4.30 p.m. or after 6.00 p.m.

(iii) They are not allowed to play on the Kelana Course on weekends and Public Holidays.

(c) Children below 12 years

Are allowed to play only on the Kelana Course from Monday to Friday (excluding Public Holidays) and

must tee-off before 4.30 p.m. or after 6.00 p.m., 11.30 a.m. to 2.30 p.m. on Weekends (excluding Public

Holidays) and must be accompanied by either the Golf Professional, their parents or adults with valid

handicap in their rounds.

(d) All children below 18 are allowed to play on the Kelana Course accompanied by their parents on weekends

and Public Holidays and must tee-off between 11.30 a.m. and 2.30 p.m. (except during competitions).

(e) All children golfers must be properly attired

Rubber shoes or sneakers may be used if they have difficulty in getting golf shoes of their sizes.

Note: Children below the age of 18 years are not permitted to drive Buggies.

RULE 13 - LITTER

All golfers are advised to dispose their rubbish (including cigarette butts) in the bins provided. The penalty for

littering is RM50.00 fine. Disciplinary action can also be taken against offenders.

RULE 14 –

a) INTER-CLUB MATCHES (MEN)

(i) Priority given to ordinary members unless specifically allowed.

(ii) Members selected must play in both matches.

(iii) Selection is on first-come-first-served basis.

(iv) Members selected must attend lunch / dinner after the game and be dressed appropriately (Only long pants

and shoes are allowed in Dewan Tunku, Eagle’s Nest and Bilik Buaya).

(v) Members selected must wear designated KGNS Inter-Club T-shirts.

(vi) When the number of members is under-subscribed, only then will the ‘R’ Members and Term Members be

selected.

(vii) Members who are found to be absent from any inter-club matches, or not abiding by the above rules without

any valid reason, will be banned for the next two (2) inter-club matches.

b) INTER-CLUB MATCHES (LADIES)

(i) Open to all lady members.

(ii) Selection is on first-come-first-serve basis.

(v) Ladies who are found to be absent from any Inter-club matches, or not abiding the above rules without any

RULE 15 - PENALTY FOR BREACHING ANY OF THE ABOVE RULES

Any golfer found breaching any of the above rules shall be liable to disciplinary action.
