The property is zoned R-2 Single Family Residential. Single family residences are located adjacent to the property and are also zoned R-2.

Notification requirements for this application have been satisfied. A legal notice was published in a local newspaper and signs posted on the property as required. Neighboring residents were notified.

Staff Analysis

The variances allows the existing detached garage, which is 18 feet wide and 22 feet deep, to be replaced at the same size. Because the proposed garage is located outside the rear 30 feet of the lot, the garage must comply with the required setback. Section 7 .3, Table 3 requires a minimum interior side yard setback of7.3 feet, which is 10% ofthe lot width at the building line. The encroachment will be 2.3 feet into the required side yard setback.

The second variance allows the detached garage to be located 8 feet from the principal building. Section 11.4.A.5 requires detached accessory building be located a minimum of 10 feet from the principal building.

Board Action

If the Board decides to act favorably on the variance requests, the proposed motion would be as follows:

1335 GOOD AVENUE- DOMINIC VECCHIO

VARIANCES ARE GRANTED ONLY WHEN THE APPLICATION HAS SATISFACTORILY RESPONDED IN WRITING TO THE FOLLOWING FACTS (a-c) AND HAS DEMONSTRATED WITH EXHIBITS AND EVIDENCE THAT THESE FACTS TRULY EXIST:

a) The strict application of terms of the Zoning Ordinance will result in undue h.ardship.

The ordinance requires that an accessory structure adhere to the same setback requirement that would be applicable to a SFR when that structure is located outside the rear yard of the lot. On this very irregularly shaped property, the existing detached garage is located in the only possible place on the lot for such a structure. It is parallel to the front property line, similar to the residence, and is located less than 5 feet from the north side property line. Since the lot's rear yard is on an angle, there is some additional space for the home to expand towards the south side of the lot, however the garage is right on the rear yard setback. The proposed project seeks to replace the existing non-conforming garage with a new (slightly smaller) structure that will be in essentially the same location. The north sideyard will be increased slightly to 5.00 feet (from the present 4.82 feet), however it is not possible to provide the required 7.30-foot setback (10% of the lot's width) and still maintain the required 10.00-foot building separation. Currently the garage exhibits a setback to the attached frame shed (at the rear of the home) of less than 10.00 feet and with the new garage this setback will be maintained at approximately 8.00 feet. So the proposal seeks to maintain the garage's current approximate location. The hardship for this property is directly related to the irregular conditions associated with the property since compliance with 1 requirement (the 7.30-foot sideyard) violates another (the 10.00-foot separation), and visa versa.

b) The plight of the owner is due to unique circumstances.

The uniqueness that the owner faces on this property is related to the irregular shape of the lot. There is no opportunity on the property to locate a detached garage that will comply with the ordinance required setbacks. The replacement of the existing garage, in the same (slightly smaller) footprint is the owners approach to needing an updated garage while understanding that an expanded structure would require additional zoning relief. It is also important to notice that the proposed size, at 18.00 feet x 22.00 feet, is small for a standard size garage.

c) The variance, if granted, will not alter the essential character of the locality.

Since the proposed project is only going to replace an existing garage, of the same size and in the same location as the current structure, there will be no impact to the character of the locality as a result of this variation's approval. The two structures are essentially the same as what the neighbors have been exposed to since the original garage's construction.
