REZONING APPLICANT'S RESPONSE STANDARDS GOVERNING THE EXERCISE OF THE ZONING POWER
(A) Yes, approval the submitted Rezoning Application will permit a use that is suitable in view of the use and development of adjacent and nearby property. The Property is currently splitwzoned C-2 and RM and is adjacent to land zoned for commercial uses. The proposed development would provide an appropriate transitional land use from more intense commercial/retail uses along the Scenic Highway and Sugarloaf Parkway corridors to less intense single-family detached uses to the west and northwest.
(B) No, approval of the submitted Rezoning Application will not adversely affect the existing use or usability of any of the nearby properties. Rather, the proposed development would complement existing commercial and residential uses.
(C) In light of the size, location, layout, topography, and natural features of the property and in conjunction with the nature of surrounding development, the Applicant submits that the subject Property does not have reasonable economic use as currently zoned.
(D) No, approval of the submitted Rezoning Application will not result in an excessive or burdensome use of the infrastructure systems. The Property has frontage on both Scenic Highway and Old Snellville Highway with access to utilities.
(E) Yes, approval the submitted Rezoning Application would be in conformity with the policy and intent of the Gwinnett County 2040 Unified Plan. Mixed-uses including multifamily residential uses are specifically encouraged in the Community Mixed-Use Character area.

Mahaffey Pickens Tucker, LLP submits this Letter of Intent and attached rezoning application (the "Application") on behalf of Southeast Capital Companies, LLC (the "Applicant") for the purpose of requesting the rezoning of an approximately 20.18-acre tract of land located on the westerly side of Scenic Highway (State Route 124) just north of its intersection with Sugarloaf Parkway (the "Property"). The Property is currently split-zoned C-2 and RM and is located in the Community Mixed-Use Character Area as set forth on the Gwinnett County 2040 Unified Plan Future Development Map. As set forth in the attached Application, the Applicant is requesting the rezoning of the Property to create a mixed-use development with approximately 298 multifamily residential homes in addition to commercial/retail uses on an adjacent tract which is already zoned C-2 and is not included in this Application.
The Proposed development is compatible with surrounding land uses and is in accordance
with the policies of the C?winnett . County 2040 Unified Plan (the "2040 Plan"). The surrounding area includes a diverse mix of land uses including residential, commercial/retail, industrial, and institutional. To the north along Scenic Highway are assorted commercial uses including automotive repair and mini-storage. Also to the north of the Property is the Gwinnett County Public Schools Fleet and Grounds Maintenance Facility. To the west are the Still Lake duplex community zoned RM and the Sugarloaf Manor subdivision, which is zoned RZT. The JM Tull Gwinnett Family YMCA is adjacent to the Property to the south as are additional commercial/retail uses along Scenic Highway and at the Scenic Highway/Sugarloaf Parkway intersection. According to the 2040 Plan, the "Community Mixed-Use character area is intended for activity nodes and connecting areas located along major corridors" such as Scenic Highway and Sugarloaf Parkway. As Scenic Highway and Sugarloaf Parkway are both classified as Principal Arterial Roadways on the Gwinnett County Long Range Road Classification Map, the Property and surrounding area qualifies as a "node" as defined in the 2040 Plan. The 2040 Plan specifically encourages "Medium-Scale Mixed-Use Developments" including apartments~ retail, and/or office uses as "potential development types" within the Community Mixed-Use Character
Area.

facades, and high-quality building materials. The proposed community would include a large, central amenity space with a resort-style pool and patio/outdoor lounge area. This central amenity area would also include grilling stations, fire pits, and other outdoor socialization opportunities. A large clubhouse includes a fitness center, resident common area, and the leasing office. Pocket parks and dog walking areas are designed throughout the development to provide additional recreational space and a wetland and associated natural area near Scenic Highway would provide additional opportunities for outdoor activities such as bird watching. Residents would also have convenient access to Alexander Park which is just to the south of the Property across Sugarloaf Parkway and provides an even wider range of outdoor recreation opportunities such as disc golf, 2. 7 miles of paved and unpaved trails, and even fishing.
Accordingly, the Applicant is proposing to rezone the Property from the existing C-2 (General Commercial) and RM (Multi-Family Residence) zoning classifications to the RM-24 (Multifamily Residence) zoning classification as set forth in the Gwinnett County Unified Development Ordinance (the "UDO") in order to acconunodate the development of a multifamily residential community with approximately 298 units. The Applicant is also requesting a slight buffer reduction in the northwesterly portion of the Property where adjacent to land zoned R-75 . Here, the UDO requires a 50-foot natural undisturbed buffer. The Applicant is still proposing to provide a SO~foot wide buffer, but is requesting that 25 feet of that buffer be a landscaped buffer which allows grading and replanting to a buffer standard. At less than 15 units per acre, the density of the proposed development falls well below the UDO' s maximum of 24 units per acre established for the RM-24 zoning classification. Moreover, the proposed development would in many ways be less intense than a large commercial center which is allowed under the Property's current zoning. Further, the proposed residential development provides an appropriate transition of land uses from more intense commercial development along the Scenic Highway corridor to medium density single-family detached homes to the west and northwest.
The proposed community is also compatible with the more general County-wide policies set forth in the 2040 Plan. Chapter 4 of the 2040 Plan provides that there are "fundamental questions" as to "how and where [Gwinnett] will house its future residents.,, In addressing how housing needs and desires are continually evolving, the 2040 Plan notes that "nearly 3/4 of our housing units,, are single-family detached homes built from the 1980s to the 2000s. The 2040 Plan has identified this "over-reliance on detached single-family homes" as a ('major threat to our future success" and encourages a diversification of housing types across the County to address this issue. The 2040 Plan also acknowledges demonstrated shifts in housing preferences and provides that "younger people are broadly driving changes in how housing has historically been viewed. While owning a traditional suburban detached single-family home will continue to be very desirable, younger generations are looking for more types of housing product options and for flexibility that ownership is not able to provide." Additionally, nearly fifty percent of households in Gwinnett are one- or two-person households. According to the 2040 Plan, this fact

alone shows that "Gwinnett needs more variety in housing types than currently exists."
Therefore, in order to diversify housing types and meet existing and future demand for non
single-family detached housing, the 2040 Plan encourages multi-family developments in certain
Character Areas such as the Community Mixed-Use Character Area. The proposed development
fits squarely within the policies of the 2040 Plan.
