Resume of work transacted by the Madras Legislative Assembly from 16th to

31st August 1968. ---------

PROROGATION

The Third Session of the Madras Legislative Assembly was prorogued with effect

from 2nd April 1968.

The Fourth Session of the Fourth Madras Legislative Assembly commenced on 16th August and the Assembly was adjourned sine die on 31st August 1968.

I. RESIGNATION OF OFFICE OF SPEAKER

On 16th August 1968, Hon. Deputy Speaker announced to the House that -

(i) Under clause (b) of Article 179 of the Constitution of India, Thiru Si. Pa. Aditanar had resigned his office as Speaker of the Legislative Assembly with effect from the afternoon of the 12th August 1968.

(ii) Under clause (I) of Article 180 of the Constitution of India, while the Office of Speaker is vacant, the duties of the Office shall be performed by the Deputy Speaker; and

(iii) Thiru Si.PA. Aditanar had sent a letter thanking the Members of the Assembly for the co-operation extended by them in the discharge of his duties.

II.SITTINGS OF THE ASSEMBLY

The Legislative Assembly met for 13 days during the period (16th to 31st August 1968) and in terms of hours, it sat for 66 hours and 26 minutes.

III. OBITUARY REFERENCES

On 16th August, 1968, the Hon. Deputy Speaker announced to the House the demise of the following persons on the dates noted against each:-

1 Thiru W.S. Sreenivasa Rao, former M.L.A. 4th April 1968.

2 Thiru A.V. Thomas, former M.L.A. 12th May 1968.

3 Thiru A. Neasmony, former M.L.A. Ist June 1968.

On 19th August 1968, the Hon. Deputy Speaker announced to the House the demise of Thiru T. Veluchami, former M.L.A. on 10th August 1968.

The Members stood in silence for a minute as a mark of respect to the memory of the deceased.

IV. PANEL OF CHAIRMEN

On 16th August 1968, the Hon. Deputy Speaker announced the following Panel of Chairmen for the Fourth Session of the Fourth Madras Legislative Assembly:-

V.QUESTIONS

During the period,. 217 Starred Questions and 2 Short Notice questions were

answered on the floor of the House. Answers to 145 Unstirred Questions were laid on the Table of the House.

VI.STATEMENT BY THE MINISTER

On 23rd August 1968, Hon. Thiru K.A. Mathialagan, Minister for Food made a

statement correcting the answer to a Supplementary Question put by Thiru V.K. Kothandaraman to Starred Question No. 164 by Thiru S. Ramachandran and Thiru N. Kittappa answered on the floor of the House on 7th March 1968.

VII. ADJOURNMENT MOTIONS

IX. STATEMENT UNDER RULE 82 OF THE ASSEMBLY RULES

On the 24th August 1968, Hon. Thiru M. Karunanidhi, Minister for Public Works

made a statement in regard to the talks held by him at Delhi on the 'Hemavathi Project' in Mysore State.

X. FINANCIAL BUSINESS

The First Supplementary Statement of Expenditure for the year 1968-69 was presented to the Legislative Assembly by Hon. Thiru C.N.Annadurai, Chief Minister on the 17th August 1968 and it was discussed and voted on 19th August 1968.

The appropriation bill relating to the first supplementary statement of expenditure for

XII. RESOLUTION

A. OFFICIAL

(i) Hon. Thiru. C.N. Annadurai, Chief Minister, moved the following resolution on 17th August 1968:-

WHEREAS the President of India has, in accordance with Article 3 of the Constitution of India, referred to this House, a Parliamentary Bill entitled "The Madras State (Alteration of Name ) Bill, 1968 fully set out in the Schedule hereto, for expressing the views of this House thereon;

This House declares its considered opinion that the proposals contained in the said Bill be and the same are hereby approved in entirely, in wording and substance;

AND this House further desires that the said Bill be introduced in Parliament, and passed into law as expeditiously as possible.

The following amendments to the resolution were moved:-

Thiru M.P. Sivagnanam moved that for the words 'Tamil Nad' whatever they occur in the Bill, the words 'Tamizh Nadu' shall be substituted.

Thiru S. Balasubramaniam moved that in paragraph 2 of the Resolution for the words

'in entirely in wording and substance' the following may be substituted:-

"Subject to the amendment that wherever the words 'Tamil Nad' occur the word 'Thamizhagam' may be substituted".

The above amendments were not pressed by the members in view of the Government

amendment below moved by Hon. Chief Minister which was put and carried:- "for paragraph 2, substitute the following:-

This House recommends that for the words 'Tamil Nad' wherever they occur in the said Bill, the words 'Tamil Nadu' shall be substituted, and subject to this modification this House declares its considered opinion that the proposals contained in the said Bill be and the same are hereby approved."

The resolution as amended below was unanimously adopted:

WHEREAS the President of India has, in accordance with Article 3 of the Constitution of India, referred to this House, a Parliamentary Bill entitled "The Madras State (Alteration of Name) Bill, 1968 fully set out in the Schedule hereto, for expressing the views of this House thereon;

AND this House further desires that the said Bill be introduced in Parliament, and passed into law as expeditiously as possible.

(ii) Hon.Thiru A. Govindasamy, Minister for Agriculture, moved the following resolution on 26th August 1968.

"That the following draft of a rule to be issued by the State Government under Section 7 of the Cotton Transport Act, 1923 (Central Act III of 1923), amending the rules issued under the said action, be approved as required by action 8 of the said Act.

DRAFT RULE

In exercise of the powers conferred by section 7 of the Cotton Transport Act, 1923 (Central Act III of 1923), the Governor of Madras hereby makes the following amendment to the rules issued with the late Food and Agriculture Departement G.O.Ms. No. 2295, dated the 7th December 1950, published as Notification No.51 at pages 575 to 583 of Rules Supplement to Part I of the Fort St. George Gazette, dated the 26th December 1950, as subsequently amended:-

AMENDMENTS In rule 10.-

(a) in clause (iii) for the words "Annas eight", the words "Paise fifty" shall be substitued.

(b) in clause (iv) for the words "Annas four", the words "Paise Twenty-five" shall be substituted: 2. In the Annexure,-

(a) in Form 'A',-

(i) for paragraph I, the following paragraph shall be substituted, namely:-

"I/We, the undersigned hereby beg to apply for a general single licence under the Cotton Transport Act, 1923 (Central Act III of 1923), available for the period(1) - for the importation by rail/road/river/sea of not exceeding (2)- bales/maunds of - (State here whether ginned cotton, unginned cotton (Kapas ,cotton waste or cotton seeds) into the protected area known as (3)- notified in the Government Notification, Development Department, No. 278, dated the 19th September 1928, as subsequently amended at (4)- from (5) --- station through ---(mention here the route by which the cotton is to be transported from one non-protected area to another non-protected area under license in Form GG) for the purpose of manufacture in licenses mill or mills only/export by the licensee to (6)----- I/We so beg to apply for a certified copy of the license (as required by the said Act)";

"that the following draft of a rule to be issued by the State Government under Section 7 of the Cotton Transport Act, 1923 (Central Act III of 1923), amending the rules issued under the said section be approved as required by section 8 of the said Act".

The resolution was put and carried.

B. NON-OFFICIAL

(i) On 22nd August 1968, the discussion on the following resolution already moved by Thiru P.G. Karuthiruman on 29th November 1967 was resumed.

"This House recommends to the Government that with a view to increase food production, along with schemes for land reclamation and building a special fund for minor irrigation, the levy system of procurement be adopted and suitable incentive to the farmers be given."

The above resolution was put and lost.

(ii) On 29th August 1968, Thiru K.R. Nallasivam moved the following resolution:-

"This House is of opinion that the statement of property, income and expenditure of the Members of the Legislative Assembly and Ministers from the date of their election be presented to the Assembly annually".

On the assurance given by the Hon. Minister for Law and Co-operation that the Government are prepared to bring to either legislation or set up a convention according to the decision taken by the Members of the Assembly as expeditiously as possible the resolution was by leave of the House withdrawn.

(iii) On 29th August 1968, Thiru C. Govindarajan moved the following resolution.

"This House recommends to the Government that as the introduction of automation in the Government offices, Industrial Establishment and Private Sector Industries will reduce the employment opportunities in the Country and will reduce the number of posts in existence and pave the way for retrenchment, no permission or support be given to the introduction of automation in Tamil Nadu".

On the same day, Thiru V.K. Kothandaraman moved the following resolution.

"This House recommends to the Government, that no support or permission be given to the introduction of automation in Tamilnadu, as its introduction in the institutions under the private and public sectors will increase the unemployment problem in the Country:.

Both the resolutions were taken up together for discussion and the discussion was not concluded.

XIII. GOVERNMENT MOTIONS

(1) On 26th August 1968, Hon. Thiru V.R. NEDUNCHEZHIYAN, Minister for Education and Industries, moved-

"That the proposal of the State Government under sub-section (3) of section 65 of the Electricity (Supply) Act 1948, (Central Act LIV of 1948), to fix the maximum amount which the Madras State Electricity Board may at any time have on loan under sub-section (I) of the said section as fifty-five crores of rupees; to be approved".

The motion was put and carried.

2. On the same day HON. THIRU. S.MADHAVAN, Minister for Law and Co-operation, moved the following motion--

"The following draft of a rule proposed to the made by the Governor of Madras under sub-section (2) of section 4 of the Madras, Motor Vehicles (Taxation of Passengers and Goods) Act, 1952 (Madras Act XVI of 1952), amending the Schedule to the said Act, be approved."

DRAFT RULE

In the Schedule to the Madras Motor Vehicles (Taxation of Passengers and Goods) Act, 1952, after sub-rule (3) of rule I, the following sub-rule shall be added, namely:-

(4) The composition fee payable under section 4 in respect of transport vehicles which are normally kept in Kerala State and permitted to ply in Madras State under Short Term Licenses issued under the arrangements between the two States, shall be as follows:-

3. On the same day HON. THIRU. S. MADHAVAN, Minister for Law and Co-

operation, moved the following motion:-

"The following draft of an amendment to the rules in Schedule V to the Madras City Municipal Corporation Act, 1919 (Madras Act IV of 1919), proposed to be made with effect on and form the Ist July 1966, by the Governor of Madras under sub-section (3) of section 347 of the said Act, be approved."

DRAFT

In exercise of the powers conferred by sub-section (3) of section 347 of the Madras City Municipal Corporation Act, 1919 (Madras Act IV of 1919), the Governor of Madras hereby makes the effect on and from the Ist July 1966, the following rule altering Schedule V to the said Act.

RULE

In Schedule V to the Madras City Municipal Corporation Act, 1919 (Madras Act IV of 1919) after rule 5, the following rules shall be inserted, namely:-

"5-A Expenditure on the payment of the election expenses including the cost of the preparation and revision of the electoral rolls, the conduct of elections to the Corporation Council and the maintenance of the election establishment, is obligatory subject to special directions that the State Government may issue, by notification".

Explanation- The cost of maintenance of the election establishment shall include the pay, leave allowances and pension, if any, of the officers and servants of the Government or of any other authority, employed in the preparation and revision of the electoral roll and in the conduct of the elections.

5. B. The State Government shall determine every year the amount of the election expenses every year the amount of the election expenses referred to in rule 5-A and their determination shall have priority over all the other charges except charges for the service of authorized loans and the expenses specified in sub-section (1) of section 43.”

4. On 17th August 1968, HON. THIRU V.R. NEDUNCHEZHIYAN, Minister for Education and Industries, moved-

“That under Rule 21(3) of the Legislative Assembly Rules, item (5) in the Agenda be taken up before item (4).”

The motion was put and carried.

5. On 26th August 1968, HON. THIRU A.GOVINDASAMY, Minister for Agriculture moved that under rule 21(3) of the Madras Legislative Assembly Rules, item (iv) in the Agenda for the day be taken up before item(iii)

The motion was put and carried.

6. HON. THIRU V.R. NEDUNCHEZHIYAN, Minister for Education and Industries, moved the following motions on 21st, 23rd, 26th, 28th and 31st August 1968.

“That sub-rule (3) of rule 41 of the Madras Legislative Assembly Rules, in so far as it requires that not more than two matters shall be raised under Rule 41 at the same sitting be suspended.”

The motion was put and carried.

XIV. NO-CONFIDENCE MOTION AGAINST THE MINISTRY

On 20th August 1968, Hon. Deputy Speaker announced to the House that Thiru P.G. Karuthiruman and three other members had given notice of a motion under Rule 55 of the Assembly Rules expressing want of confidence in the Ministry headed by Hon. Thiru C.N. Annadurai.

The Deputy Speaker declared that leave was granted to make the motion since more than twenty-four members stood up in support of the motion.

On 23rd August 1968, Thiru P.G. Karuthiruman moved the following motion:-

“This House expresses its want of confidence in the D.M.K. Ministry headed by Hon. Thriu C.N. Annadurai for the following reasons:-

1. Unsettled industrial and labour policy which has led to stagnation resulting in unprecedented unemployment among the skilled and unskilled labourers failure to attract enterpreneurs to invest in new industries due to labour unrest such as strikes and lockouts.

2. Failure of the Government to provide economic and incentive price to the farmers due to wrong procurement policy of Government.

3. Fire accidents in slums on a large scale in many parts of the State leading to the

sufferings of the poor people and the failure of the Government to prevent such recurrence and the failure of the Government to detect the culprits who are responsible for the offence and the failure of the Government to construct and provide fire proof houses as promised in spite of huge amount of money having been collected from public as donations.

4. The fast deteriorating situation in law and other resulting in the flouting of a

establishment authorities and the growing tendency amongst the very people who are responsible for law and order taking a partisan attitude, Failure of the Government to tackle the dispute between students and State Transport Workers resulting in a large scale fight between them resulting in great sufferings to students. Preventing them from pursuing their studies. The indiscriminate shooting resorted to by the police in different parts of the State.

5. The orgy of violence unleashed by the Police on Ist August 1968 on the peaceful

Youth Congress Marchers who were unprotected and inoffensive resulting in untold causalities like breaking their limbs and heads of persons numbering over 500.

6. Failure of the Government to render proper accounts regarding the collections for

Second World Tamil Conference made by Governmental authorities using pressure and coercion and the failure to have the accounts audited by a competent authority, namely, Accountant and Auditor-General.

7. Failure of the Government to check the ruling party men from interfering in day-to-

day administration thus resulting in partisan favoritism and nepotism which has led to the gross inefficiency of the Government machinery.

8. The questionable conduct of the Hon. Minister for Co-operation in using the

Governmental agencies in collecting huge sums of money from the public and co-operative institutions by coersive methods for the purpose of putting up a hospital in his native village which does not deserve to have a hospital of this size under ordinary circumstances.

9. Failure of the Government to check the growth of fissiparous tendencies like the

formation of a “Sena” like Tamil Sena which may lead ultimately to be disintegration of the country.

10. The irreligious attitude taken by Government in ordering the removal of the pictures

of gods, goddesses and saints from Government buildings which has wounded the feelings of the people at large and the Government servants.

11. And the failure of the Government to enforce prohibition policy strictly allowing

numerous illicit distillations and the failure to detect and book the offenders under the prohibition law.”

The discussion on the above motion took place on 23rd,24th, 26th, and 28th August 1968. Forty members participated in the discussion and the Hon. Chief Minister replied.

On the 28th August 1968, the No Confidence motion moved by Thiru P.G. Karuthiruman was put to vote and the House divided as follows:-

Ayes --- 37 Noes -- 156 Neutrals -- Nil.

The motion was declared lost.

XV. THE MADRAS STATE ELECTRICITY BOARD ANNUAL FINANCIAL

STATEMENT FOR THE YEAR 1968-69

The discussion on the Annual Financial Statement for 1968-69 and the Supplementary Financial Statement for 1967-68 of the Madras State Electricity Board initiated by the Hon. Minister for Education and Industries, was taken up in the Assembly on 16th,17th,30th and 31st August 1968. Forty-six members took part in the discussion, Hon. Minister for Education and Industries replied to the Debate.

XVI. PRIVILEGE MATTERS

(1) On 23rd August 1968, Thiru R.N. Ranganathan raised a matter of privilege in regard

to the premature publication of notice as well as contents of the No Confidence Motion in the Press. The Hon. Deputy Speaker reserved his ruling on 29th August,1968, the Hon. Deputy Speaker ruled out that there was no breach of privilege but only breach of convention.

He, however, added that inview of the statement of the Leader of the Opposition that

he had not given the statement to the Press and as such, he was not responsible for the publication, the matter was dropped.

(2) On 30th August 1968, the Hon.Deputy Speaker referred suo motu to the Committee of Privileges for examination and report certain statement made by Dr. H.V. Hande against the ruling of the Chair during question time.

(3) On the same day, the Hon. Deputy Speaker gave his ruling on the privilege matters

raised by Thiru N.S.V. Chithan and Thiru S. Balasubramaninan in regard to the disclosure to the Press by the Hon. The Minister for Public Works, the talks held by him at Delhi with the Chief Minister of Mysore and the Central Minister for Irrigation and Power in regard to “Hemavathi Project”.

(4) On 30th August 1968, Thiru S. Balasubraminan raised a privilege issue against the

Hon. Minister for Public Works on the ground that the Minister has given wrong information to the House on 24th August 1968 by saying that Thiru. K.R. Nallasivam Leader of the S.S.P., has agreed that no discussion on the proposed Hemavathi Project is necessary in the House after the statement under rule 82 by the Hon. Minister, Hon. Deputy Speaker observed that there is no basis for the privilege issue.

(5) On 30th August 1968, the House referred to the Privileges Committee the matter of privilege raised by Hon. Thiru M.Karunanidhi in regard to the alleged incorrect statement made by Thiru S. Balasubramanian while raising a privilege matter on the same date.

(6) The House also referred to the Privileges Committee on the same day the matter of

privilege raised by Thiru S. Balasubramanian against the Editor and Publisher of the daily “Kaditham” in regard to certain passages published in the issue,dated 27th August 1968 under the caption “Satta Sabai Enna Neethi manrama”.

(7) On 31st August 1968, Thiru Ere. Elamvazhuthi raised a matter of privilege against the

Editor and Publisher of the daily ‘Swadesamitran’ in regard to the Editorial published in its issue, dated 30th/31st August 1968 under the caption ‘Maintain Dignity’ commenting on the speech of the Hon. The Chief Minister on the No-Confidence Motion on 28th August1968, based on incorrect reports.

(8) On the same day, Thiru. R.N. Ranganathan raised a matter of privilege in regard to

the report of the Chief Minister’s speech made in the House on 28th August 1968 in ‘Navamani’, dated 29th August 1968 and the reported speech of Thiru C. Subramanyam, President, Tamil Nadu Congress Committee at a public meeting held on August 29, 1968, at Mylapore, Madras in the daily ‘Navasakthi’ dated 30th August 1968 and the reported speech of Thirumathi Anandanayaki in the ‘Navasakthi’, dated 31st August 1968, and the Editors and Publishers of Navamani and Navasakthi.

(9) Thiru K.R. Gnanasambandam raised on the same day a matter of privilege against the

Editor and Publisher of the Tamil daily ‘Jayaberigai’ in regard to its report in its issue, dated 30th August 1968 reflecting on the conduct of the Chief Minister in the Legislative Assembly.

The Hon. Deputy Speaker reserved his ruling on the above privilege issues.

On 24th August 1968, Thiru K.Vinayakam, Chairman, Committee on Government Assurances, presented the Third Report (Fourth Assembly) of the Committee.
