Order No. 17/102-2009 HRM-I (1) Dated, Panchkula 3- 2

Whereas Sh. Yoginder Singh Sharma & others (56 Petitioner) Masters/

Mistresses, C&V and JBT teachers filed CWP No. 8382 of 1995 in the Hon'ble High

Court for quashing the offensive part with regard to 'Regular as appearing in the

para 1(1)of Government letter dated 07-08-1992 (Annexure P-3)and the clarification

given against point no.3 in the respondent Government letter dated 14-06-1994

(Annexure P-4) being a discriminatory and violative of Articles 14 and 16 of the

Constitution of India and a writ of mandamus directing the respondents to f5,ve

benefit of additional increments in terms of Government letter dated 07-08-1992

(Annexure P-3) after taking in to account the adhoc service rendered by the

petitioner before their regularization. The Hon'ble High Court decided the above cited

writ petition vide order dated 04-07-2008 in terms of orders passed in CWP No. 7862

of 2006 titled as Hanumant Singh & others Versus State of Haryana and others

declared today. The operative part of the order dated 04-07-2008 passed in CWP No.

7862 of 2006 by the Hon'ble Punjab and Haryana High Court is reproduced below:

"Adhoc/ work charged service followed by regular service shall not

be counted for the purposes of grant of higher pay scale / benefit of

Assured Career Progression Scheme on completion of 8/18 or 10/20

years of service.Adhoc/ work charged service followed by regular service shall be

counted for the purposes of grant of additional increment in

running scale of completion of 8/18 or 10/20 years of service.

3. Adhoc/ work charged service followed by regular service shall be

counted for the pension and seniority."Against the above cited order of the Hon'ble High Court, special Leave petition

No. 11962 of 2010 was preferred by the State of Haryana in the Hon'ble Supreme

Court and the same is pending before the Hon'ble Supreme Court. In the meantime,

the petitioners have filed COCP No. 84 of 2013 in the Hon'ble High Court which is now

listed for hearing on 15-02-2013.In compliance of orders of the Hon'ble High Court, the seniority list of master

cadre of the year of 2006 as it stood on 01-01-2006 has been reviewed. It is

worthwhile to mention here that 45 petitioners are C&V & JBT teachers and their

appointing authority is District Elementary Education Officer, therefore their

seniority shall be fixed at the District level. The concerned District Elementary

Education Officer, Gurgaon have already been directed to implement the

passed by the Hon'ble Court and provide all benefits subject to the outcome t;,-

No. 11128 of 2009 titled as State of Haryana Versus Hanumant Singh which is

pending in the Hon'ble Supreme Court of India on similar grounds/facts filed by the

State of Haryana .

(i) In pursuance of orders passed in CWP No. 8382 of 1995 decided on 04-07-

2008 by the Hon'ble High Court, the seniority of the petitioners at Sr. No. 4, 6, 20, 22,
