3.1 UTILITIESThis section addresses the provision of utilities in the City of Manteca, including water, wastewater(sewer),stormwater,solidwaste,electricity,andnaturalgas.

3.1.1 WATERSERVICESThissectiondescribestheCityofManteca’swaterdemands,watersupplies,waterdistributionsystem,andwaterquality.

REGULATORYFRAMEWORKSTATE

CaliforniaDepartmentofHealthServicesTheDepartmentofHealthServices,DivisionofDrinkingWaterandEnvironmentalManagement,overseestheDrinkingWaterProgram.TheDrinkingWaterProgramregulatespublicwatersystemsandcertifiesdrinkingwatertreatmentanddistributionoperators.Itprovidessupportforsmallwatersystemsandforimproving their technical,managerial, and financial capacity. It provides subsidized funding forwatersystemimprovementsundertheStateRevolvingFund(“SRF”)andProposition50programs.TheDrinkingWaterProgramalsooverseeswaterrecyclingprojects,permitswatertreatmentdevices,supportsandpromoteswater system security, and oversees theDrinkingWater Treatment and Research Fund forMTBEandotheroxygenates.

ConsumerConfidenceReportRequirementsCaliforniaCodeofRegulations(CCR)Title22,Chapter15,Article20requiresallpublicwatersystemstoprepareaConsumerConfidenceReportfordistributiontoitscustomersandtotheDepartmentofHealthServices.TheConsumerConfidenceReportprovidesinformationregardingthequalityofpotablewaterprovided by the water system. It includes information on the sources of the water, any detectedcontaminants in thewater, themaximumcontaminant levels setby regulation, violationsandactionstakentocorrectthem,andopportunitiesforpublicparticipationindecisionsthatmayaffectthequalityofthewaterprovided.

UrbanWaterManagementPlanningActThe Urban Water Management Planning Act has as its objectives the management of urban waterdemandsandtheefficientuseofurbanwater.Underitsprovisions,everyurbanwatersupplierisrequiredtoprepareandadoptanurbanwatermanagementplan.An“urbanwatersupplier”isapublicorprivatewatersupplierthatprovideswaterformunicipalpurposeseitherdirectlyorindirectlytomorethan3,000customersorsupplyingmorethan3,000acre-feetofwaterannually.Theplanmustidentifyandquantifytheexistingandplannedsourcesofwateravailabletothesupplier,quantifytheprojectedwateruseforaperiodof20years,anddescribethesupplier’swaterdemandmanagementmeasures.Theurbanwatersupplier should make every effort to ensure the appropriate level of reliability in its water servicesufficienttomeettheneedsofitsvariouscategoriesofcustomersduringnormal,dry,andmultipledryyears.TheDepartmentofWaterResourcesmustreceiveacopyofanadoptedurbanwatermanagementplan.

SenateBill(SB)610andAssemblyBill(AB)901The State Legislature passed SB 610 and AB 901 in 2001. Bothmeasuresmodified the UrbanWaterManagementPlanningAct.

SB610requiresadditionalinformationinanurbanwatermanagementplanifgroundwaterisidentifiedas a source of water available to an urban water supplier. It also requires that the plan include adescriptionofallwatersupplyprojectsandprogramsthatmaybeundertakentomeettotalprojectedwateruse.SB610requiresacityorcountythatdeterminesaprojectissubjecttoCEQAtoidentifyanypublicwatersystemthatmaysupplywatertotheprojectandtorequestidentifiedpublicwatersystemstoprepareaspecifiedwatersupplyassessment.Theassessmentmustinclude,amongotherinformation,anidentificationofexistingwatersupplyentitlements,waterrights,orwaterservicecontractsrelevanttothe identifiedwatersupply fortheproposedproject,andwaterreceived inprioryearspursuanttotheseentitlements,rights,andcontracts.AB901requiresanurbanwatermanagementplantoincludeinformation,totheextentpracticable,relatingtothequalityofexistingsourcesofwateravailabletoanurbanwatersupplierovergiventimeperiods.AB901alsorequiresinformationonthemannerinwhichwater quality affects water management strategies and supply reliability. The bill requires a plan todescribeplanstosupplementawatersourcethatmaynotbeavailableataconsistentlevelofuse,totheextentpracticable.Additionalfindingsanddeclarationsrelatingtowaterqualityarerequired.

SenateBill(SB)221SB221addsGovernmentCodeSection66455.3,requiringthatthelocalwateragencybesentacopyofanyproposedresidentialsubdivisionofmorethan500dwellingunitswithinfivedaysofthesubdivisionapplicationbeingacceptedascompleteforprocessingbythecityorcounty.ItalsoaddsGovernmentCodeSection66473.7,establishingdetailedrequirementsforestablishingwhethera“sufficientwatersupply”existstosupportanyproposedresidentialsubdivisionsofmorethan500dwellings, includinganysuchsubdivisioninvolvingadevelopmentagreement.Whenapprovingaqualifyingsubdivisiontentativemap,the city or county must include a condition requiring availability of a sufficient water supply. Theapplicablepublicwatersystemmustprovideproofofavailability.Ifthereisnopublicwatersystem,thecityorcountymustundertaketheanalysisdescribedinGovernmentCodeSection66473.7.Theanalysismustincludeconsiderationofeffectsonotherusersofwaterandgroundwater.

LOCAL

CityofMantecaUrbanWaterManagementPlan(2015)Thepurposeofthe2015UrbanWaterManagementPlanistoensureefficientuseofurbanwatersuppliesintheCityofMantecaandpromoteconservation.TheUWMPdiscussesnotonlytheavailabilityofwaterbutalsowateruse,reclamation,andwaterconservationactivities.TheUWMPcomplieswiththeUrbanWaterManagementPlanningAct(UWMPAct)(CaliforniaWaterCode[CWC]Section10610etseq.).

CityofMantecaWaterMasterPlan(2005)TheCity’s2005WaterMasterPlan includesasummaryof theCity’ssystem-widewaterdemands, theplanningcriteriausedtodeterminewatersystemdemands,theCity’swaterdistributionsystemmodel,ananalysisoftheCity’swatersystem,andasummaryofexistingandfuturewatersystemfacilities.

PublicFacilitiesandServicesElementGOAL PF-7.Maintain an adequate level of service in the City’swater system tomeet the needs ofexistingandprojecteddevelopment.

POLICYPF-P-4.Securesufficientsourcesofwatertomeettheneedsoftheexistingcommunityandplannedresidentialandcommercialgrowth.

POLICYPF-P-5.Citywillcontinuetorelyprincipallyongroundwaterresourcesforitsmunicipalwaterinthenearterm,willparticipateintheregionalimprovementstodeliversurfacewatertoaugmenttheCity'sgroundwatersupply.

POLICYPF-P-6.TheCityshalldevelopnewwatersourcesasnecessarytoservenewdevelopment.

POLICY PF-P-7. The City shall develop newwater storage facilities andmajor distribution lines asnecessarytoservenewdevelopment.

POLICYPF-P-8.TheCitywillprovidewaterforfuturedevelopmenttomaintainabalanceofjobsandhousing.

POLICY PF-P-9. City water services shall not be extended to unincorporated areas except inextraordinarycircumstances.ExistingcommitmentsforCitywaterserviceoutsidetheCitylimitsshallcontinuetobehonored.

POLICYPF-P-10.DevelopmentofprivatewaterwellswithintheCitylimitsshallbeallowedonlywheretheCitymakes a finding that it cannot feasibly providewater service. Such systems shall only beallowedtobeuseduntilsuchtimeasCitywaterservicebecomesavailable.

POLICY PF-P-11. The City will develop and implement water conservation measures as necessaryelementsofthewatersystem.

POLICYPF-P-12.TheCityshallcontinuetoassessawaterdevelopment feeonallnewcommercial,industrial, and residentialdevelopment sufficient to fundsystemwidecapacity improvements. Thewaterdevelopmentfeescheduleshallbeperiodicallyreviewedandrevisedasnecessary.

POLICYPF-P-13.Ensurethatallnewdevelopmentprovidesforandfundsafairshareofthecostsforadequatewaterdistribution,includinglineextensions,easements,andplantexpansions.

POLICYPF-P-14.TheCityshallcontinuouslymonitorwaterflowsthroughtheCity’swatersystemtoidentify areas of potential water loss and cases of under billing for water service and shall makeimprovementsinthesystemsasnecessary.

POLICYPF-P-15.TheCityshallmonitorwaterqualityregularlyandtakenecessarymeasurestopreventcontamination.

POLICYPF-P-16.TheCityofMantecashall includeagroundwateranalysisasatechnicalanalysisofwater system capacity in the update of the Public Facilities Implementation Plan (PFIP), and shallprepare an environmental analysis in the PFIP that addresses the quality and availability ofgroundwater.

POLICY PF-P-17. The City of Manteca shall consider incremental increases in the demands ongroundwatersupplyandwaterqualitywhenreviewingdevelopmentapplications.

ResourceConservationElement-WaterConservationGOAL RC-2.Maximize the beneficial uses ofwater by recyclingwater for irrigation and other non-potableuses.

POLICYRC-P-1.TheCityshallcontinuetoimplementwaterconservationstandardsforallcommercialandindustrialdevelopment,andforallexistingandnewresidentialdevelopment.

POLICYRC-P-2.TheCityshallexplorepotentialusesoftreatedwastewaterwhensuchopportunitiesbecomeavailable.

POLICYRC-P-3.TheCityshallprotectthequantityofManteca’sgroundwater.

POLICY RC-P-4. The City shall require water conservation in both City operations and privatedevelopmenttominimizetheneedforthedevelopmentofnewwatersources.

POLICYRC-P-5.DevelopmentofprivatewaterwellswithinthecitylimitsshallbeallowedonlywheretheCitymakesafindingthatmunicipalwaterservice isnotreadilyandfeasiblyavailable,andsuchprivatewellsystemsshallonlybeallowedtobeuseduntilsuchtimeasCitywaterservicebecomesavailable.

POTABLEWATERSYSTEMTheCity’swaterserviceareaiscontiguouswithCitylimits.In2015,theCityservedapproximately21,400connections,andtheCity’sannualpotablewaterusewas11,235acre-feet/year(AFY),whichequatestoanaveragedailyuseof10milliongallonsperday(mgd)(Kennedy/JenksConsultants,2016).

TheCity’spotablewaterdistributionwatersystemisshownonFigure3.1-1.TheCity’distributionsystemis suppliedby surfacewater fromSouthSan Joaquin IrrigationDistrict’s (SSJID’s) SouthCountyWaterSupplyProgram(SCWSP)andgroundwaterwells.FourturnoutsdeliversurfacewaterfromSSJIDtotheCitysystem,designatedM1,M2,M3andM4.Fifteenpotablegroundwaterwellssupplythedistributionsystem,and32irrigationwellsprovidenon-potableirrigationsupplytoparksandotherirrigatedareas(Manteca,2017).Thesystemhasasinglepressurezonewithapproximately250milesofwatersystempipeline.Therearethreegroundlevelstoragetanks:thetankattheSSJIDM2turnoutonLathropRoad(1MG),thetankattheSSJIDM3turnoutonWestYosemiteAvenue(1MG),andtheAthertonDrivewaterstoragetank(3.7MG).TheM2andM3tanksareusedtobalancethedifferencebetweenSSJIDdeliveriesandCityuse,whiletheAthertonDrivetankbalancesthedifferencebetweenCitysupplyanddemand.

WATERSYSTEMSUPPLIESAsnotedabove,theCity’stwoprimarysupplysourcesaresurfacewater,purchasedfromtheSSSJID’sSCWSP,andlocalgroundwater.TheCityalsousesrecycledwaterforirrigation,anddustcontrol.Onanannualbasis,theCity’sgoalistoprovide53percentoftheCitypotablewatersupplyfromsurfacewaterand47percentfromgroundwater(Kennedy/JenksConsultants,2016).

SurfaceWaterSupplyIn2005,theSSJIDcommissionedtheNickC.DeGrootWaterTreatmentPlant(WTP)fortheSCWSPtoprovidetreatedsurfacewaterfromtheStanislausRivertoseveralcitiesinSouthSanJoaquinCounty.ThecitiesofManteca,Lathrop,Escalon,andTracyhaveagreementstopurchasetreatedsurfacewaterfromthe SCWSP, but onlyManteca, Lathrop and Tracy currently receive treated surfacewater (Provost &PritchardConsultingGroup,2016).In2015,theCitypurchased5,596acre-feet(AF)ofsupplyfromSSJID(Kennedy/JenksConsultants,2016).

TheCityofMantecahasacurrentPhase1allotmentof11,500AFY,buthasnothistoricallyuseditsfullallotmentofsurfacewater,duetosystemconstraintsand,morerecently,StateandSSJIDsupplylimitsinresponse to the drought. Future expansion of the SCWSP will increase the City’s maximum Phase 2allotment to 18,500 AFY, but there are currently no plans to bring additional capacity online

(Kennedy/Jenks Consultants, 2016). The City does not anticipate using the full amount of its SCWSPallotmentuntil2025(CityofManteca,2016).

TheSCWSPprovidestreatedsurfacewaterfromtheStanislausRiverundera300,000AFYentitlement.However,theentitlementisdependentonNewMelonesReservoirinflowandissubjecttocurtailmentindryyears.Normalwaterdeliveriesareprovidedwhen theNewMelones inflowsexceed600,000AFY.Wheninflowsarelessthan600,000AFY,thesupplyissharedequallybetweenSSJIDandOakdaleIrrigationDistrict, which also holds a 300,000 AFY entitlement. The SCWSP participants’ agreement with SSJIDrequiresthatmunicipalandagriculturaluserssharesurfacewaterreductionsequally.

AnexaminationofestimatedNewMelones Inflowfrom1885to2010, included inSSJID’s2015UrbanWaterManagementPlan,indicatesthefullentitlementtoSSJIDhasbeenavailableabout80percentofthetime.Theaveragereductionindryyearsbetween1885and2010was11percent.Thelowestsupplyonrecordwas225,000AFinboth2014and2015(Provost&PritchardConsultingGroup,2016).

GroundwaterSupplyTheCityownsandoperates15potablegroundwaterwellsand32irrigationwells.Thewellsrangeindepthfrom 190 feet to 400 feet (Kennedy/Jenks Consultants, 2016). Shallower wells have more nitrogencontamination and are thus typically used for irrigation. The City currently plans to construct twoadditionalpotablewaterwells,Wells28and29(CityofManteca,2016).

TheCity’sannualpotablegroundwaterproductionincreasedwithdemanduntil2005,reachingapeakof14,900 AFY in 2004. Commissioning of theWTP in 2005 decreased groundwater use considerably. Inaddition,theCityhasshiftedfrompotablewaterusetoirrigationwaterusewhereverpossible,toreducepotable water demand and groundwater treatment costs. In 2015, the City’s annual groundwaterproductionwas 7,249 AFY, of which 5,639 AFYwas for potable use and 1,610 AFY for irrigation use(Kennedy/JenksConsultants,2016).

Wells currently in operationwithin the City service area, but not owned by the City, include privatedomesticwells,agriculturalwells,wellsforschoolirrigationownedbytheMantecaUnifiedSchoolDistrictandirrigationwellsownedbySSJID,amongothers.CaliforniaDepartmentofWaterResources(DWR)wellcompletionreportscitedintheCity’s2015UWMPindicatethatapproximately1,000waterwellshavebeenconstructedwithintheGeneralPlanareasincerecordkeepingbeganinthe1960’s,butitisnotclearwhetherthesecontinuetobeinservice(Kennedy/JenksConsultants,2016).

GroundwaterwithintheCity’sserviceareaissuppliedfromtheEasternSanJoaquinCountyGroundwaterSub-basin(ESJCGB)oftheSanJoaquinValleyGroundwaterBasin.AccordingtoDWR,thegroundwaterbasin is in overdraft, with historical declines averaging 1.7 feet per year. Past estimates of safegroundwateryieldfromthebasinhaveindicatedthatpumpingatorbelowoneacre-footperacreperyear(AF/AC/YR)ofCitylandissustainable.TheCitytargetsthissustainableyield,butitisimportanttonotethatthetotalgroundwaterpumpingoccurringwithinCityboundariesincludesCity-ownedmunicipalwells,City-ownedparkirrigationwells,andirrigationanddomesticwellsownedandoperatedbyothers.Whileallof theCity’smunicipalwellshavehistoricallybeenmetered, the irrigationwellswerenotallmetered until 2015 and groundwater pumping data for other wells is incomplete. Therefore, theestimatedsafeyieldfortheCity’swellsincludessomeuncertainty.Withtheintroductionofsurfacewatersupplies, as discussed above, and conservation measures, withdrawals have declined, stabilizinggroundwaterlevelsintheMantecaarea(Kennedy/JenksConsultants,2016).

The 2014 Sustainable Groundwater Management Act (SGMA) enacted groundwater legislation inCaliforniathatrequirestheformationofGroundwaterSustainabilityAgencieswhowillberesponsiblefordevelopingGroundwaterSustainabilityPlanstomanagegroundwaterbasins.TheCityplanstoplayanactiveroleinlocalGSAformation(Kennedy/JenksConsultants,2016).

RecycledWaterRecycledwater isproducedat theCityofManteca’sWastewaterQualityControlFacility (WQCF).TheWQCF is a tertiary treatment facility. The City has historically used secondary treated, undisinfectedrecycledwatertoirrigatefoddercropsonCity-ownedandleasedlands.Annualcropusagehasaveragedabout1,000AFY,butusageisexpectedtodecreaseovertimeaslandisdeveloped.Since2015,theCityhasused tertiary treatedrecycledwaterat fill stations fordustcontrolatconstructionsites.By2020,constructionwaterusageisexpectedtobeabout30AFY(Kennedy/JenksConsultants,2016).

TheCityiscurrentlydevelopingaReclaimedWaterFacilitiesMasterPlan,thatwillidentifyplansforthephaseddevelopmentanduseoftertiarytreatedrecycledwateroverthenext20to25years.ThedraftplanevaluatedtheuseofrecycledwastewaterforirrigationofCityparks,publicareas,otheropenspacesanda golf course tooffset currentpotablewater and irrigationwell use. Theestimatedpotential forrecycledwateruseforlandscapeirrigationisjustunder2,200AFYby2040(Kennedy/JenksConsultants,2016).

CURRENTANDPROJECTEDWATERDEMANDSANDSUPPLIESTheCity’s2015UWMPdocuments2015andprojectedfuturewaterdemandsandsuppliesthrough2040,asshowninTable3.1-1(Kennedy/JenksConsultants,2016).

Waterdemandprojectionsweredevelopedassuminga2.3percentperyearpopulationgrowthrate,withwateruseprojectedfroma2013baseline,themostrecentyearofnormalwaterusepriortothedrought.ProjectionsfactorinwaterusereductionsmandatedbyCalifornia’s2009WaterConservationAct(SBX7-7),whichrequirethattheCity’spercapitawaterusenotexceed179gallonspercapitaperday(GPCD)by2020.TheCity’s2013percapitawaterusewas justunder200GPCD,while theCity’s2015percapitawaterusewas137GPCD,duetowaterconservationregulationsineffectduringthe2014-2015drought(Kennedy/JenksConsultants,2016).

TheCity’sUWMPusedpopulationestimatesfromtheStateofCaliforniaDepartmentofFinance,whichindicatesthatthepopulationoftheCitywasjustover72,000peoplein2015.Thepopulationrelyingonthe City’s supply was projected to increase to over 127,700 people by 2040, with a correspondingestimatedwateruseof29,770AFY.

Water supplies to meet future demands include surface water purchased from SSJID, City producedgroundwaterandrecycledwater.TheCity’swatersupply isprojectedto increasebyabout37percentfrom2015to2040,primarilyduetoimplementationofPhase2oftheSCWSP.FutureCitygroundwaterpumpingisestimatedbasedonthesafeyieldforallgroundwaterpumpingwithintheCity’splanningarea,less estimated groundwater pumping by other users. Recycled water demand projections assumeddecreaseduseovertimeofwaterforcropirrigation,andimplementationofatertiary-treatedirrigationsupplyby2040.

InMay 2016, Governor EdmundG. Brown, Junior, signed ExecutiveOrder B-37-16 (ExecutiveOrder),MakingWaterConservationaCaliforniaWayofLife.TheExecutiveOrderdirectedDWRtoworkwiththeStateWaterResourcesControlBoard(StateWaterBoard)todevelopnewwaterusetargetsaspartofapermanentconservationframeworkforurbanwateragencies.Thetargetswillbuilduponrequirementsestablishedinthe2009WaterConservationAct,butwillstrengthenstandardsforindoorresidentialpercapitawateruse,outdoorirrigation,commercial, industrialandinstitutional(CII)wateruse,andwaterlostthroughleaks.DWRwillbeestablishinginterimwaterusetargetsby2018,withfinalstandardstobepublishedby2021.Agencieswillneed todemonstrateprogress towardsachieving final compliance in2025(DWR,2017).

Whilethe2015UWMPwateruseprojectionsarethebestavailablecurrently,wateruseprojectionswillbere-evaluatedinfutureUWMPupdates,basedonthenewregulations.IftheCity’sgrowthprojectionsand/orallocationoflanduseareupdatedbasedonthecurrentGeneralPlanupdate,thentheabilitytoservenewgrowthmayneedtobere-evaluated.

3.1.2 WASTEWATERThissectiondescribestheCityofManteca’swastewaterinfrastructure,wastewaterflows,treatmentplantpermitrequirements,andpreviousinfrastructureplanning.WastewaterserviceisprovidedbytheCityofManteca via their network of collection infrastructure and the Wastewater Quality Control Facility(WQCF),which is located at 2450West YosemiteAvenue. TheWQCFprovides services to the City ofManteca,CityofLathrop,andRaymusVillageinSanJoaquinCounty.

KEYTERMSEffluent:Inthecontextofwastewatertreatmentplants,effluentiswastewaterthathasbeenthroughatreatmentprocesstoremovepollutionandundesirableconstituentsfromthewater.

NPDES:Waterpollutiondegradessurfacewatersmakingthemunsafefordrinking,fishing,swimming,andother activities. As authorized by the Clean Water Act, the National Pollutant Discharge EliminationSystem (NPDES) permit program controls water pollution by regulating point sources that dischargepollutantsintowatersoftheUnitedStates.Pointsourcesarediscreteconveyancessuchaspipesorman-madeditches.Individualhomesthatareconnectedtoamunicipalsystem,useasepticsystem,ordonothaveasurfacedischargedonotneedanNPDESpermit;however,industrial,municipal,andotherfacilitiesmustobtainpermitsiftheirdischargesgodirectlytosurfacewaters.

WWTP:Wastewater treatment plant. Treatment ofwastewatermay include the following processes:screeningtoremovelargewaste items;gritremovaltoallowsand,gravel,andsedimenttosettleout;primary sedimentation where sludge can settle out of the wastewater; secondary treatment tosubstantiallydegradethebiologicalcontentofthesewage;tertiarytreatmenttoraisethequalityoftheeffluentbeforeitisdischarged;and,discharge.

REGULATORYFRAMEWORKFEDERAL

CleanWaterAct(CWA)/NationalPollutantDischargeEliminationSystem(NPDES)PermitsTheCWAisthecornerstoneofwaterqualityprotectionintheUnitedStates.Thestatuteemploysavarietyof regulatory and non-regulatory tools to sharply reduce direct pollutant discharges into waterways,financemunicipalwastewatertreatmentfacilities,andmanagepollutedrunoff.Thesetoolsareemployedtoachievethebroadergoalofrestoringandmaintainingthechemical,physical,andbiologicalintegrityofthenation’swaterssothattheycansupport“theprotectionandpropagationoffish,shellfish,andwildlifeandrecreationinandonthewater.”

TheCWAregulatesdischargesfrom“non-pointsource”andtraditional“pointsource”facilities,suchasmunicipal sewageplants and industrial facilities. Section402of theAct creates theNPDES regulatoryprogramwhichmakesitillegaltodischargepollutantsfromapointsourcetothewatersoftheUnitedStateswithoutapermit.Pointsourcesmustobtainadischargepermitfromtheproperauthority(usuallyastate,sometimesEPA,atribe,oraterritory).NPDESpermitscoverindustrialandmunicipaldischarges,discharges fromstormsewer systems in larger cities, stormwaterassociatedwithnumerouskindsofindustrialactivity,runofffromconstructionsitesdisturbingmorethanoneacre,miningoperations,andanimalfeedlotsandaquaculturefacilitiesabovecertainthresholds.

Permitrequirementsfortreatmentareexpressedasend-of-pipeconditions.Thissetofnumbersreflectslevelsofthreekeyparameters:(1)biochemicaloxygendemand(BOD),(2)totalsuspendedsolids(TSS),

and(3)pHacid/basebalance.Theselevelscanbeachievedbywell-operatedsewageplantsemploying"secondary" treatment.Primary treatment involves screeningandsettling,while secondary treatmentusesbiologicaltreatmentintheformof"activatedsludge."

Allso-called"indirect"dischargersarenotrequiredtoobtainNPDESpermits.Anindirectdischargerisonethatsends itswastewater intoacitysewersystem,so iteventuallygoestoasewagetreatmentplant.AlthoughnotregulatedunderNPDES,"indirect"dischargesarecoveredbyanotherCWAprogramcalledpretreatment."Indirect"dischargerssendtheirwastewaterintoacitysewersystem,whichcarriesittothemunicipalsewagetreatmentplant,throughwhichitpassesbeforeenteringsurfacewater.

STATE

StateWaterResourcesControlBoard/RegionalWaterQualityControlBoardInCalifornia,allwastewatertreatmentanddisposalsystemsfallundertheoverallregulatoryauthorityoftheStateWaterResourcesControlBoard(SWRCB)andthenineCaliforniaRegionalWaterQualityControlBoards(RWQCBs),whoarechargedwiththeresponsibilityofprotectingbeneficialusesofStatewaters(ground and surface) from a variety of waste discharges, including wastewater from individual andmunicipalsystems.TheCityofMantecafallswithinthejurisdictionoftheCentralValleyRWQCB.

TheRWQCB’sregulatoryroleofteninvolvestheformationandimplementationofbasicwaterprotectionpolicies.Thesearereflected in the individualRWQCB’sBasinPlan,generally in the formofguidelines,criteriaand/orprohibitionsrelatedtothesiting,design,construction,andmaintenanceofon-sitesewagedisposal systems. The SWRCB’s role has historically been one of providing overall policy direction,organizationalandtechnicalassistance,andacommunicationslinktotheStatelegislature.

TheRWQCBsmaywaiveordelegateregulatoryauthorityforon-sitesewagedisposalsystemstocounties,cities or special districts. Although not mandatory, it is commonly done and has proven to beadministrativelyefficient.Insomecases,thisisaccomplishedthroughaMemorandumofUnderstanding(MOU),wherebythelocalagencycommitstoenforcingtheBasinPlanrequirementsorotherspecifiedstandardsthatmaybemorerestrictive.TheRWQCBsgenerallyelecttoretainpermittingauthorityoverlargeand/or commercialor industrialon-site sewagedisposal systems,dependingon thevolumeandcharacterofthewastewater.

The City’s current NPDES Permit,which regulates thewastewater effluent quantity and quality upondischarge,wasissuedbytheCentralValleyRegionalWaterQualityControlBoardandisOrderR5-2006-0094andOrder5-01-251.

Porter-CologneWaterQualityControlActThe Porter-CologneWaterQuality Control Act is California’s statutory authority for the protection ofwaterquality.UnderthePorter-CologneAct,theStateisrequiredtoadoptpolicies,plans,andobjectivesthatwillprotecttheState’swatersfortheusebyandenjoymentofCalifornians.InCalifornia,theStateWater Resources Control Board (SWRCB) has the authority and responsibility for establishing policyrelatedtotheState’swaterquality.RegionalauthorityisdelegatedbytheSWRCBtoaRegionalWaterQuality Control Board (RWQCB). The Porter-Cologne Act authorizes the SWRCB and RWQCB to issueNPDESpermits.

Under theCentralValleyRegionalWaterQualityControlBoard (CVRWQCB)NPDESpermit system,allexistingandfuturemunicipalandindustrialdischargestosurfacewaterwithinthecitywouldbesubjectto regulation. NPDES permits are required for operators ofmunicipal separate storm sewer systems,

constructionprojects,andindustrialfacilities.Thesepermitscontainlimitsontheamountofpollutantsthatcanbecontainedineachfacility’sdischarge.

LOCAL

CityofMantecaMunicipalCodeTheCityofMantecaMunicipalCode,Title13(PublicServices)Chapter13.12(SewerConnectionCharges),Chapter13.14(SewerCapacityCharges),andChapter13.16(SewerServiceCharges)containregulationsassociatedwithsewermanagement.

Title 13 (Public Services), Chapter 13.38 (Public Facilities Implementation Program Fees), Section13.38.050 (Establishment of a Sewer Fee) requires developers of property to pay a sewer facilitydevelopmentfee.

UtilityMasterPlansTheCityofMantecamaintainsavarietyofMasterPlandocumentsthatguidethedesign,development,and maintenance of the utilities within the city limits. These include:Wastewater Collection SystemMasterPlan (2012),WastewaterQualityControlFacilityMasterPlanUpdate (2006),andaSewerRateStudy(2008).

CityofMantecaGeneralPlanThe existing City ofManteca General Plan Public Facilities Element identifies the following goals andpoliciesrelatedtowastewaterservices:

PublicFacilitiesandServicesElement-SewerGOALPF-8.MaintainanadequatelevelofserviceintheCity’ssewagecollectionanddisposalsystemtomeettheneedsofexistingandprojecteddevelopment.

POLICYPF-P-18.EnsurewastewatercollectionandtreatmentforalldevelopmentintheCityandthesafedisposalofwastes.

POLICY PF-P-19. The Citywillmaintain capacity to process combined residential, commercial, andindustrialflow.

POLICYPF-P-20.TheCityshalldevelopnewsewagetreatmentandtrunklinecapacityasnecessarytoservenewdevelopment.

POLICY PF-P-21. City sewer services will not be extended to unincorporated areas, except inextraordinary circumstances. Existing commitments for sewer service outside the city limits shallcontinuetobehonored.

POLICYPF-P-22.DevelopmentofindividualsepticsystemsmaybeallowedonlywheretheCitymakesafindingthatitcannotfeasiblyprovidepublicsewerservice,andsuchsystemsshallonlybeuseduntilsuchtimeasCitysewerservicebecomesavailable.SuchsystemsshallmeettheminimumstandardsoftheSanJoaquinCountyHealthDepartment.

POLICY PF-P-23. The City shall establish and maintain a growth management plan to ensure thedevelopmentofabalancedmixofresidential,commercial,industrial,andpubliclanduses.

POLICYPF-P-25.TheCitywillmaintaintheabilitytohandlepeakdischargeflowwhilemeetingStateRegionalWaterQualityControlBoardStandardsasestablishedinthecurrentNPDESPermit.

WASTEWATERSYSTEMTheCity’ssewerserviceareaiscontiguouswithCitylimits,andisdividedintonorth,southandcentralsewersheds.Themunicipalwastewatercollectionsystemincludes242milesofsewermainsand19pumpstations(CityofManteca,2017).Thecollectionsystemincludesgravityflowpipesrangingfrom6-inchto60-inchdiameter,andforcemainsfrom6-inchto24-inchdiameter(EDAW,2007).

The existing collection system generally serves the developed portions of the City, withmajor trunksewerslocatedinthecoreoftheCity(thecentralsewershed),approximatelyboundedbyStateRoute120tothesouth,AustinRoadtotheeast,LathropRoadtothenorth,andAirportWaytothewest.TheCity’ssewersystemisshownonFigure3.1-2.

WASTEWATERQUALITYCONTROLFACILITYMunicipalwastewateristreatedattheCity’sWastewaterQualityControlFacility(WQCF),whichtreatsmunicipal sanitary sewage from the City of Manteca, portions of Lathrop, and Raymus Village, justnortheastofManteca.

TheWQCFislocatedsouthwestofdowntownMantecaon22acresownedbytheCity.TheWQCFtreatsmunicipalwastewaterfromtheCityofMantecaandtheCityofLathrop,andseasonallyacceptsindustrialfoodprocessingwasteeffluentfromEckertColdStorage(Nolte,2007).Percontractualagreement,8.42mgdofplantcapacityisallocatedtotheCityofMantecaand1.45mgdisallocatedtotheCityofLathrop(EDAW,2007).TheWQCFtreatsanaveragedryweatherflow(ADWF)ofabout6mgdandhasanaveragedryweatherdesigncapacityof9.87mgd.Thefacility’scurrentNPDESpermitiscurrentlysharedbetweentheCityandDutraFarms,Inc.andiseffectiveuntilMay2020(CARWQCB,2015).TheanticipatedbuildoutADWFwithinareasservedbytheWQCFis27mgd(EDAW,2007).

TheWQCFisanactivatedsludgetertiarytreatmentplant.Thefacilityincludesaninfluentpumpstation,and primary, secondary and tertiary treatment facilities. Primary treatment at theWQCF consists ofaerated grit removal and primary sedimentation. Secondary treatment at the facility consists ofnitrification and denitrification in activated sludge aeration basins and subsequent secondarysedimentation.Undisinfectedsecondaryeffluentiseitherstoredforagriculturaluseina15-milliongallonpondorblendedwithfoodprocessingwasteandapplieddirectlyontheagriculturalfieldsownedbytheCity(190acres)andDutraFarms,Inc.(70acres)(CARWQCB,2015).

Secondary effluent not used for crop demands undergoes tertiary treatment, including rapidmixing,flocculation,clothmediafiltration,andultravioletlight(UV)disinfection.Treatedtertiaryeffluentiseitherpumpedtoatruckfillstationforconstructionvehiclestoreceiverecycledwaterforconstructionpurposesordischargedyear-roundthrougha36-inchdiameterpipeintotheSanJoaquinRiver(CARWQCB,2015).As thepracticeofdischarging to fields isgraduallyphasedoutdue to landdevelopment,effluentwillincreasinglybedivertedtotheRiver(CityofManteca,2016).

TheCityisplanningtoexpandthefacilityfromthecurrentlypermitted9.87mgdto27mgdbybuildout.ThevariousWQCFfacilitiesaredesignedtobeexpandedinphases,basedonfuturegrowth.Proposedtreatment improvements identified in the2007WQCFMaster Plan includeexpansionof theprimary,secondaryandtertiarytreatmentfacilities,expansionofthesolidshandlingsystemsandexpansionoftheco-generation system to generate electricity from methane produced during the treatment process(EDAW,2007).

TheWQCFiscurrentlyundergoingexpansionstothesolidshandlingstreamstoprovideincreasedcapacitytomeet permitted requirements and new State regulations. Improvements include new facilities forreceivingFats,Oils,andGreases(FOGs),andreceivingfoodwasteseparatedfromthesolidwastestreams.TheseparationofthesematerialsisrequiredbyStateregulationsandisanticipatedtoprovideadditionalenergygenerationintheformofbiogasfromtheWQCF(CityofManteca,2016).

CURRENTANDPROJECTEDWASTEWATERFLOWSHistorically,wastewaterflowstotheMantecaWQCFhaveincreasedasthepopulationandcommercialandindustrialactivityhasgrown.ADWFwas4mgdin1991,5.81mgdin2003,and6mgdinDecember2005(EDAW,2007).Since2007,averagedailyinfluentflowtotheWQCFhasremainedrelativelyconstant,rangingfromalowof6.1mgd(2008)toahighof6.3mgd(2011)(CityofManteca,2017b).ThehighestdailydischargereportedbetweenJune2010andApril2014was10.5mgd(CARWQCB,2015).1

No recent flow projections were available for this Background Report. The 2007WQCFMaster PlanreportedwastewaterflowprojectionsfortheCityofMantecaof19.5mgdby2023and23mgdbybuildout(Nolte Associates, 2007). Projections were based on wastewater generation factors developed fromhistoricalstudies,anddevelopedbasedondifferenthouseholddensitiesfordifferentresidentiallandusecategories.Assumingasimilarlevelofdevelopmentasanticipatedinthe2007WQCFMasterPlan,futurewastewaterprojectionsareanticipatedtobelowerthanthoseestimatedinthe2007WQCFMasterPlanbecauseofexistingandpendingwateruseefficiencyregulationsthatwillreduceindoorwateruseandwastewaterflows.

FederalEmergencyManagementAgency(FEMA)SanJoaquinCountyisaparticipantintheNationalFloodInsuranceProgram(NFIP),aFederalprogramadministeredbyFEMA.ParticipantsintheNFIPmustsatisfycertainmandatedfloodplainmanagementcriteria. The National Flood Insurance Act of 1968 has adopted as a desired level of protection, anexpectation that developments should be protected from floodwater damage of the IntermediateRegionalFlood(IRF).TheIRF isdefinedasafloodthathasanaveragefrequencyofoccurrenceontheorder of once in 100 years, although such a flood may occur in any given year. Communities areoccasionallyauditedbytheDepartmentofWaterResourcestoinsuretheproperimplementationofFEMAfloodplainmanagementregulations.

NationalPollutantDischargeEliminationSystem(NPDES)NationalPollutantDischargeEliminationSystem(NPDES)permitsarerequiredfordischargesofpollutantstonavigablewatersoftheUnitedStates,whichincludesanydischargetosurfacewaters,includinglakes,rivers,streams,bays,theocean,drystreambeds,wetlands,andstormsewersthataretributarytoanysurfacewaterbody.NPDESpermitsareissuedundertheFederalCleanWaterAct,TitleIV,PermitsandLicenses,Section402(33USC466etseq.)

The RWQCB issues these permits in lieu of direct issuance by the Environmental Protection Agency,subject to review and approval by the Environmental Protection Agency Regional Administrator. ThetermsoftheseNPDESpermits implementpertinentprovisionsoftheFederalCleanWaterActandtheAct’s implementing regulations, including pre-treatment, sludgemanagement, effluent limitations forspecific industries,andanti-degradation. Ingeneral, thedischargeofpollutants is tobeeliminatedorreducedasmuchaspracticablesoastoachievetheCleanWaterAct’sgoalof“fishableandswimmable”navigable(surface)waters.Technically,allNPDESpermitsissuedbytheRWQCBarealsoWasteDischargeRequirementsissuedundertheauthorityoftheCWA.

TheseNPDESpermits regulatedischarges frompubliclyownedtreatmentworks, industrialdischarges,stormwater runoff, dewatering operations, and groundwater cleanup discharges. NPDES permits areissuedforfiveyearsorless,andarethereforetobeupdatedregularly.Therapidanddramaticpopulationand urban growth in the Central Valley Region has caused a significant increase in NPDES permitapplicationsfornewwastedischarges.Toexpeditethepermitissuanceprocess,theSWRCBhasadoptedseveralgeneralNPDESpermits,eachofwhichregulatesnumerousdischargesofsimilartypesofwastes.The SWRCB has issued general permits for stormwater runoff from industrial and construction sitesstatewide.StormwaterdischargesfromindustrialandconstructionactivitiesintheCentralValleyRegioncanbecoveredunderthesegeneralpermits,whichareadministeredjointlybytheSWRCBandRWQCB.

AnewPhaseIISmallMunicipalSeparateStormSewer(MS4)GeneralPermitwasadoptedbytheStateWater Resources Control Board on February 5, 2013 became effective July 1, 2013. The Permit hasnumerousnewcomponentsandtheCityisrequiredtoimplementthesecomponentsinstagesoverthefive-yearperiodofthePermit.

DepartmentofWaterResourcesTheDepartmentofWaterResources’ (DWR)majorresponsibilities includepreparingandupdatingtheCaliforniaWaterPlantoguidedevelopmentandmanagementoftheState'swaterresources,planning,designing, constructing, operating, andmaintaining the StateWater Resources Development System,protectingandrestoringtheSacramento-SanJoaquinDelta,regulatingdams,providingfloodprotection,

assistinginemergencymanagementtosafeguardlifeandproperty,educatingthepublic,andservinglocalwaterneedsbyprovidingtechnicalassistance. Inaddition,theDWRcooperateswithlocalagenciesonwater resources investigations; supportswatershedand river restorationprograms;encourageswaterconservation;exploresconjunctiveuseofgroundandsurfacewater;facilitatesvoluntarywatertransfers;and,whenneeded,operatesaStatedroughtwaterbank.

CaliforniaWaterCodeCalifornia’s primary statute governing water quality and water pollution issues with respect to bothsurfacewatersandgroundwateristhePorter-CologneWaterQualityControlActof1970(Division7oftheCaliforniaWaterCode)(Porter-CologneAct).ThePorter-CologneActgrantstheStateWaterResourceControlBoard(SWRCB)andeachoftheRWQCBspowertoprotectwaterquality,andistheprimaryvehicleforimplementationofCalifornia’sresponsibilitiesundertheFederalCleanWaterAct.ThePorter-CologneAct grants the SWRCB and the RWQCBs authority and responsibility to adopt plans and policies, toregulatedischargestosurfaceandgroundwater,toregulatewastedisposalsitesandtorequirecleanupof discharges of hazardous materials and other pollutants. The Porter-Cologne Act also establishesreporting requirements for unintended discharges of any hazardous substance, sewage, or oil orpetroleumproduct.

EachRWQCBmustformulateandadoptawaterqualitycontrolplan(BasinPlan)foritsregiontheregionalplansaretoconformtothepoliciessetforthinthePorter-CologneActandestablishedbytheSWRCBinitsStatewaterpolicy.ThePorter-CologneActalsoprovidesthataRWQCBmayincludewithinitsregionalplanwaterdischargeprohibitionsapplicabletoparticularconditions,areas,ortypesofwaste.

TheWaterCodeSection13260requiresalldischargersofwastethatmayaffectwaterqualityinwatersofthestatetoprepareandprovideawaterqualitydischargereporttotheRWQCB.Section13260a-cisasfollows:

(a) Each of the following persons shall file with the appropriate regional board a report of thedischarge,containingtheinformationthatmayberequiredbytheregionalboard:

(1)Apersondischargingwaste,orproposingtodischargewaste,withinanyregionthatcouldaffectthequalityofthewatersofthestate,otherthanintoacommunitysewersystem.

(2)Apersonwhoisacitizen,domiciliary,orpoliticalagencyorentityofthisstatedischargingwaste,orproposingtodischargewaste,outsidetheboundariesofthestateinamannerthatcouldaffectthequalityofthewatersofthestatewithinanyregion.

(3)Apersonoperating,orproposingtoconstruct,aninjectionwell.

(b)Noreportofwastedischargeneedbefiledpursuanttosubdivision(a)iftherequirementiswaivedpursuanttoSection13269.

(c)Eachpersonsubjecttosubdivision(a)shall filewiththeappropriateregionalboardareportofwastedischarge relative toanymaterial changeorproposedchange in thecharacter, location,orvolumeofthedischarge.

WaterQualityControlPlanfortheCentralValleyRegionTheWaterQualityControlPlanfortheCentralValleyRegion(BasinPlan)includesasummaryofbeneficialwateruses,waterqualityobjectivesneededtoprotecttheidentifiedbeneficialuses,andimplementationmeasures.TheBasinPlanestablisheswaterqualitystandardsforallthegroundandsurfacewatersofthe

region.Theterm“waterqualitystandards,”asused intheFederalCleanWaterAct, includesboththebeneficialusesof specificwaterbodiesand the levelsofquality thatmustbemetandmaintained toprotectthoseuses.TheBasinPlanincludesanimplementationplandescribingtheactionsbytheRWQCBandothersthatarenecessarytoachieveandmaintainthewaterqualitystandards.

TheRWQCBregulateswastedischargestominimizeandcontroltheireffectsonthequalityoftheregion’sgroundandsurfacewater.Permitsareissuedunderanumberofprogramsandauthorities.Thetermsandconditionsof thesedischargepermitsareenforced throughavarietyof technical, administrative,andlegalmeans.Waterqualityproblems in the regionare listed in theBasinPlan,alongwith thecauses,wheretheyareknown.Forwaterbodieswithqualitybelowthelevelsnecessarytoallowallthebeneficialuses of thewater to bemet, plans for improvingwater quality are included. The Basin Plan reflects,incorporates,andimplementsapplicableportionsofanumberofnationalandstatewidewaterqualityplansandpolicies,includingtheCaliforniaWaterCodeandtheCleanWaterAct.

Thepurposeofthischapteristoestablishminimumstormwatermanagementrequirementsandcontrols toprotectandsafeguardthegeneralhealth,safetyandwelfareofthepublicresiding inwatersheds within the city of Manteca. This chapter seeks to meet that purpose through thefollowingobjectives:

A.Minimizeincreasesinstormwaterrunofffromanydevelopmentinordertoreduceflooding,siltationandstreambankerosionandmaintaintheintegrityofdrainagechannels;

B. Minimize increases in non-point source pollution caused by storm water runoff fromdevelopmentthatwouldotherwisedegradelocalwaterquality;

C.Minimizethetotalannualvolumeofsurfacewaterrunoffthatflowsfromanyspecificsiteduringandfollowingdevelopmenttonotexceedthepre-developmenthydrologicregimetothemaximumextentpracticable;andD.Reducestormwaterrunoffratesandvolumes,soilerosionandnon-pointsourcepollutionwherever possible, through storm water management controls and to ensure that thesemanagementcontrolsareproperlymaintainedandposenothreattopublicsafety.(Ord.1253§1,2004)

TITLE13CHAPTER13.28SECTION13.28.060DISCHARGESINVIOLATIONOFINDUSTRIALORCONSTRUCTIONACTIVITYNPDESSTORMWATERDISCHARGEPERMIT.

A.AnypersonsubjecttoanindustrialNPDESstormwaterdischargepermitshallcomplywithallprovisionsofsuchpermit.Proofofcompliancewithsaidpermitmayberequiredinaformacceptabletothedirectoruponinspectionofthefacility,duringanyenforcementproceedingoractionorforanyotherreasonablecause.B. Any person subject to a construction activityNPDES stormwater discharge permit shallcomply with all provisions of such permit. Proof of compliance with said permit may berequiredinaformacceptabletothedirectorpriortoorasaconditionofasubdivisionmap,siteplan,buildingpermitordevelopmentorimprovementplan;uponinspectionofthefacility;during any enforcement proceeding or action; or for any other reasonable cause. Prior toissuanceofaconstructionpermitacopyoftheNoticeofIntent(NOI)andtheStormWaterPollutionPreventionPlan(SWPPP)shallbesubmittedtothecity.(Ord.1253§1,2004).

UtilityMasterPlansTheCityofMantecamaintainsavarietyofMasterPlandocumentsthatguidethedesign,development,andmaintenanceoftheutilitieswithinthecity limits.This includestheCity’sStormDrainMasterPlan(2013).

CityofMantecaGeneralPlanTheexistingCityofMantecaGeneralPlanPublicFacilitiesElementidentifiesthefollowingpoliciesrelatedtostormwateranddrainage(foradditionalpoliciesandinformationspecificallyrelatedtofloodingseeSection4.4Flooding):

PublicFacilitiesandServicesElement-MajorDrainageGOALPF-9.MaintainanadequatelevelofserviceintheCity’sdrainagesystemtoaccommodaterunofffromexistingandprojecteddevelopmentandtopreventpropertydamageduetoflooding.

POLICYPF-P-26.TheCityshallcontinuetocompletegapsinthedrainagesysteminareasofexistingdevelopment.

POLICYPF-P-27.TheCityshallrequirethededicationandimprovementofdrainagedetentionbasinsasaconditionofdevelopmentapprovalaccordingtothestandardsoftheDrainageMasterPlan.Theresponsibilityforthededicationandimprovementofdetentionbasinsshallbebasedontheproratedshareofstormwaterrunoffresultingfromeachdevelopment.

POLICYPF-P-28.Stormdrainagesystemswithinnewdevelopmentareasshallincludeopendrainagecorridors where feasible to supplement or replace an underground piped drainage system. Thedrainagesystemswouldprovideforshort-termstormwaterdetention,stormwaterconveyanceforstormwatersexceedinga10-yearevent,stormwaterqualitytreatment,bikeandpedestrianpaths,and visual open space within neighborhoods. The width and length of the corridors would bedeterminedbythestormwatermanagementrequirements.Thedrainagesystemswouldprovideapedestrianconnectionbetweenparksandaccesstoopenspacefromresidentialneighborhoods.Theneighborhoodswouldbedesignedwithhomesorientedto, rather thanbackingontheopenspacecorridor.

STORMWATERANDFLOODCONTROLTheCityofMantecaoperatesandmaintainsa stormdrain system tocontrol stormwaterandprotectresidentsandbusinessfromflooding.TheCitysystemincludesapproximately150milesofpipelines,52pump stations and 54 detention basins (City of Manteca, 2017). SSJID owns a complex network ofirrigationlateralsanddrainsthatrunwithintheCitylimitstowhichtheCitypumpsstormwater,whichisconveyedtotheSanJoaquinRivereitherdirectlyorviatheFrenchCampOutletCanal.Figure3.1-3showstheCityandSSJIDsystems.

AnagreementbetweentheCityandSSJIDrequiresthattheCitymonitorstormwaterdischargestoSSJIDfacilities tomake sure that facilities capacities are not exceeded. The City is also required to controlstormwaterqualitytomeetapplicableregulations.Theagreementhasbeeninplacesince1975,andwasmostrecentlyamendedin2006(CityofManteca,2013).

ThedetentionbasinsareusedtodetainstormwatertoattenuatepeakflowsbeforepumpingdrainageflowsintoSSJIDfacilities.Whererequired,tomeetNPDESpermitrequirements,stormwateristreatedpriortoreleasetonaturalwaterbodieswithinthearea.Treatmentisprovidedatdetentionbasinsites,orbyon-sitesourcecontrol.MostoftheCity’spumpstationspumpfromdetentionbasinsintotheSSJID

lateralsanddrains.TheCitysystemalsoincludes10waterlevelmonitoringstationsthatareusedtoobtainreal-timewaterlevelmeasurementsatcriticallowpointsinthesystem,topreventflooding.ThestormdrainsystemismonitoredandcontrolledremotelythroughSCADA(CityofManteca,2013).

TheCity’s stormwater detention basins are designedbasedon a 10-year, 48-hour duration storm forurbanizedareasanda10-year,24-hourdurationstormforruralareas.Detentionbasinsarerequiredtobeemptiedovera96-hourperiod(CityofManteca,2013).

FLOODINGANDFLOODPLAINMAPPINGTheFederalEmergencyManagementAgency(FEMA)identifiesSpecialFloodHazardAreas(SFHA).FEMApublishes Flood Insurance Rate Maps that depict the floodplains. Flooding and flood hazards areaddressedingreaterdetailinSection4.4.TheFEMA100-yearfloodplainisshownonFigure4.4-1.

STORMWATERINFRASTRUCTUREPHOTOGRAPHSPhotographsof theSprecklesBMXParkanddetentionbasinandtheTesoroParkdetentionbasinandpumpstationareprovidedbelow.

Most detention basins in the City, such as this one atSpreckles BMX park, seek to utilize space in non-floodseasonsforrecreationalpurposes.StormwaterpumpsattheSprecklesBMXParkdetentionbasinaresizedfor48-hourdischargeofeventslessthana10-yearstorm.Thelateststormdrainmasterplanincreasesthetimelimitfordischarge of the 10-year event to 96-hours and newerbasindesignsholdwaterlonger.

Above-groundstormwaterpumpstations likethisoneatTesoroParkaregraduallybeingreplacedwithbelow-gradesubmersiblepumps.

3.1.4 SOLIDWASTEThe City ofManteca SolidWaste Division (SWD) provides solid waste hauling service for the City ofManteca.SWD’sservices includeresidentialandcommercial trashpick-up,residentialandcommercialrecyclingpick-up, greenwastepick-up, andhazardouswaste collections. Solidwaste fromManteca isprimarily landfilledattheForwardSanitaryLandfill, locatednortheastofManteca.Other landfillsusedincludeFoothillSanitaryandNorthCounty.

KEYTERMSClassIlandfill:Alandfillthatacceptsfordisposal20tonsormoreofmunicipalsolidwastedaily(basedonanannualaverage);oronethatdoesnotqualifyasaClassIIorClassIIImunicipalsolidwastelandfill.

ClassIIIlandfill:AlandfillthatisnotconnectedbyroadtoaClassIlandfilloralandfillthatislocatedatleast50milesfromaClassIlandfill.ClassIIIlandfillscanacceptnomorethananaverageofonetondailyofashfromincineratedmunicipalsolidwasteorlessthanfivetonsdailyofmunicipalsolidwaste.

Transferstation:Afacilityforthetemporarydepositionofsomewastes.Transferstationsareoftenusedasplaceswherelocalwastecollectionvehicleswilldeposittheirwastecargopriortoloadingintolargervehicles.Theselargervehicleswilltransportthewastetotheendpointofdisposalortreatment.

REGULATORYFRAMEWORKFEDERAL

ResourceConservationandRecoveryActTheResourceConservationandRecoveryAct(RCRA)wasenactedin1976toaddressthehugevolumesofmunicipalandindustrialsolidwastegeneratednationwide.Afterseveralamendments,thecurrentActgovernsthemanagementofsolidandhazardouswasteandundergroundstoragetanks(USTs).RCRAwasanamendmenttotheSolidWasteDisposalActof1965.RCRAhasbeenamendedseveraltimes,mostsignificantlybytheHazardousandSolidWasteAmendments(HSWA)of1984.RCRAisacombinationofthe first solid waste statutes and all subsequent amendments. RCRA authorizes the EnvironmentalProtectionAgency(EPA)toregulatewastemanagementactivities.RCRAauthorizesstatestodevelopandenforce their own waste management programs, in lieu of the Federal program, if a state's wastemanagement program is substantially equivalent to, consistent with, and no less stringent than theFederalprogram.

The Act hasestablished a waste management hierarchy, as follows: Source Reduction; Recycling; Composting;Transformation;andDisposal.

AB341(75PercentSolidWasteDiversion)AB 341 requires CalRecycle to issue a report to the Legislature that includes strategies andrecommendationsthatwouldenablethestatetodivert75percentofthesolidwastegeneratedinthestatefromdisposalbyJanuary1,2020,requiresbusinessesthatmeetspecifiedthresholdsinthebilltoarrangeforrecyclingservicesbyJanuary1,2012,andalsostreamlinesvariousregulatoryprocesses.

SB1374(ConstructionandDemolitionWasteMaterialsDiversion)Senate Bill 1374 (SB 1374), Construction and Demolition Waste Materials Diversion Requirements,requires that jurisdictions summarize their progress realized in diverting construction and demolitionwastefromthewastestreamintheirannualAB939reports.SB1374requiredtheCIWMBtoadoptamodelconstructionanddemolitionordinanceforvoluntaryimplementationbylocaljurisdictions.

AB2176(Montanez,Chapter879,Statuesof2004)Thislawrequiresthelargestvenuefacilitiesandevents(asdefined)ineachcityandcountytoplanandimplementsolidwastediversionprograms,andannuallyreporttheprogressofthoseupontherequestof their local government. In turn, local jurisdictions must report to the CIWMB waste diversioninformationforthetop10percentofvenuesandeventsbywastegeneration.

Alargeeventisdefinedas:

1. Servesanaverageofmorethan2,000individualsperdayofoperation(bothpeopleattendingtheeventandthoseworkingatit—includingvolunteers—areincludedinthisnumber);and

2. Chargesanadmissionpriceorisrunbyalocalagency.

Thebillspecificallyincludespublic,nonprofit,orprivatelyownedparks,parkinglots,golfcourses,streetsystems,orotheropenspacewhenbeingusedforanevent,including,butnotlimitedto,asportingeventorafleamarketinadditiontoeventsthatmeetbothoftheabove.

Alargevenueisdefinedas:

• A permanent facility that annually seats or serves an average ofmore than 2,000 individualswithinthegroundsofthefacilityperdayofoperation(bothpeopleattendingtheeventandthoseworkingatit—includingvolunteerstoo—areincludedinthisnumber).

Venues include,butarenot limited toairports, amphitheaters, amusementparks, aquariums, arenas,conferenceorciviccenters,fairgrounds,museums,halls,horsetracks,performingartscenters,racetracks,stadiums,theaters,zoos,andotherpublicattractionfacilities.

Act of 1991 (§42900-42911 of the Public Resources Code) directs the California Integrated WasteManagementBoard(CIWMB)todrafta“modelordinance”relatingtoadequateareasforcollectingandloading recyclable materials in development projects. The model ordinance requires that any newdevelopment project, for which an application is submitted on or after September 1, 1994, include“adequate, accessible, and convenient areas for collecting and loading recyclable materials.” Forsubdivisionsofsinglefamilydetachedhomes,recyclingareasarerequiredtoserveonlytheneedsofthehomeswithinthatsubdivision.

CaliforniaGreenBuildingStandardsCode(CALGreen)CALGreenrequiresthediversionofatleast50percentoftheconstructionwastegeneratedduringmostnewconstructionprojects(CALGreenSections4.408and5.408)andsomeadditionsandalterationstononresidentialbuildingprojects.

LOCAL

CityofMantecaMunicipalCode,Chapter8.12Chapter8.12oftheMunicipalCoderegulatesthemanagementofgarbage,recyclables,andotherwastes.Chapter 8.12 sets forth solid waste collection, disposal, and diversion requirements for residential,commercial,industrial,andotherusesandaddressesyardwaste,hazardousmaterials,recyclables,andotherformsofsolidwaste.

MantecaMunicipalCode,Chapter8.14.020:MandatoryMultifamilyRecyclingOwnersofmultifamilycomplexesareobligatedtoutilizeManteca’srecyclingserviceandallowfortheconvenientlocationofrecyclingcontainers.ThelocationofrecyclingcontainersmustbeapprovedbytheOffice of the Director of PublicWorks and the containers must remain in the agreed upon locationexcludingscheduledwastecollectiondates.

MantecaMunicipalCode,Chapter8.14.030:CommercialBusinessRecyclingCommercialbusinessesthatproducetwoormorecubicyardsofrecyclableorgreenwasteitemsperweekmustutilizeManteca’swastecollectionservices.TheplacementofrecycleandgreenwastecontainersrequireapprovalbytheOfficeoftheDirectorofPublicWorks.

MantecaMunicipalCode,Chapter8.14.050:ConstructionandDemolitionRecyclingTheMantecaMunicipalCodeConstructionandDemolitionRecyclingSectionappliestoallcontractorsonall city construction and demolition projects. Itmandates that all concrete, cleanwoodwaste, brick,asphalt,andscrapmetalberecycledwhenthetotalareaoftheprojectsurpassesfivethousandsquarefeet.Therecyclableitemsmustbeseparatedonsiteandstoredinrecyclingcontainerstoberetrievedbythe City of Manteca Solid Waste Division or a permitted resource recovery collector. Constructionrecycling containersmust only contain recyclablematerial. WASTECOLLECTIONSERVICESThe City of Manteca Public Works Department, Solid Waste Division provides solid waste collectionservicesfortheMantecaarea.TheSolidWasteDepartmentworkstomeetcommercialandresidentialdemands ina lowcostandenvironmentallyconsciousmanor.Thedepartment’s teamofdrivers,yardpersonnel,superintendent,andofficestaffhelpsresidentsandbusinessesreducewastegenerationandutilizediversiontechniques.Mantecaprovidesthefollowingsolidwasteservices:

• Residentialrecyclingpickeduponabi-weeklyschedule• Residentialbi-weeklycurbsidepickupofcompostmaterials• Residentialweeklycurbsidepickupoftrash• LeafandChristmastreepickup• Oilcollectioncontainerspickeduponaweeklybasis• Commercialrecycling• HouseholdHazardousWastecollection

Residentialtrashiscollectedeveryweek,whilerecycleandyardwastearecollectedeveryotherweekonanalternatingbasis.Residentialcollectionservicefeesdependonthegarbagecartsizeandcustomerscanchoosefrom32gallon,64gallon,or96galloncarts.TheCitywillcollectuptothree32-gallonbagsofextragarbageinadditiontotherefusecartifeachbaghasan“extrarefuse”sticker.ThesestickersareavailableattheCity’sSolidWasteOfficeandFinanceOffice.SpecialcollectionforlargeamountsofwastecanbearrangedthroughtheSolidWasteDepartment.Feesforthisservicearedeterminedonsite.Non-scheduledpickupservicesareavailableforanadditionalcharge.

Commercial-sizeanddrop-boxcontainersareavailableforrentalbyresidentsandbusinesses.Commercialcontainersrangefromtwotosixcubicyardsanddrop-boxcontainersrangefromtentofortycubicyards.Thesecontainerscanbelocatedon-propertyorcurbside.

Afterthewasteiscollected,LovelaceTransferStationisusedtoprocessandshipthematerialtoitsfinaldestination.TheLovelaceTransferStationisownedandoperatedbySanJoaquinCountyandalsoservesmostofsouthSanJoaquinCounty.RecyclablesaretransportedtoasmallTransferStationadjacenttoForward Landfill where they are loaded onto larger trucks and taken to Sacramento Recycling. ThemajorityofManteca’ssolidwasteislandfilledattheForwardSanitaryLandfill, locatednorthofFrenchCampRoad.FoothillSanitaryLandfillandNorthCountylandfillarealsoemployed,buttoamuchlesserdegree.

Aspartofafoodtoenergyproject,Manteca’sfoodwastewillsoonbetransportedtoabiogasconversionfacility.A“turboseparator”willbe installedat theLovelaceTransferstation tomechanicallyseparatefoodwaste frommunicipal solidwaste. Truckswill ship the separated foodwaste to theWastewaterQualityControlFacilitywhereitwillbeconveyedtodigesters.ThefoodwastewillthenbecompostedandthenaturalgasfromthedecompositionprocesswillbeusedtopowerManteca’ssolidwastecollectiontrucks.Thisprojectisstillintheplanningphasebutoncecompleted,itisexpectedtoincreasediversionrates,decreaseManteca’sdieselusage,andkeeplongtermmunicipalservicerateslow.

WASTEDISPOSALFACILITIES

ForwardSanitaryLandfillForwardSanitaryLandfill,ownedbyForwardIncorporated/AlliedWasteNorthAmerica,islocatedona567-acrepropertyoffofAustinRoad.ThecurrentForwardLandfillwascreated in2002by joiningtheformerForward, Inc.Class II landfillwith theadjacentAustinRoadClass IIISanitaryLandfillpreviouslyownedbytheCityofStockton.Combiningthetwolandfillswasaccomplishedbyfillingintheairspacebetweenthelandfills,employinglowerbasegrades,andexpandingthehoursofoperation.

ThecurrentForwardLandfillsiteincludesamaterialsrecoveryfacilityandtransferstation.Thematerialsrecovery composts food waste and process wood waste for diversion purposes. The transfer stationreceivesManteca’srecyclingandloadsitontolargertruckstobetransportedtoSacramentoRecycling.Forward,Inc.alsooperatesalandfillgas-to-energy(LFGTE)plantonthenorthwestportionofthesitetocontrolairpollutionandmitigatefirehazardfromthemethanegasreleasedbyanaerobicmicroorganismsduringthedecompositionprocess.PG&Epurchases760kilowattsperhourofelectricalpowergeneratedbyForwardLandfillunderalongtermcontract.

The support facilitiesatForwardLandfill includescalehouses,waterproductionwells, agroundwaterextractionandtreatmentsystem,sedimentationanddetentionponds,andleachateevaporationbasins.

Forward landfill is the only Class II facility in San Joaquin County designed to accept both designatedwastessuchascontaminatedsoilaswellasinertmunicipalsolidwaste.Thefacilityisclosedtothegeneralpublicandallwastedeliveriesarescheduledinadvanceandpre-screened.Acceptedwastesincludegreenmaterials,sludge(biosolids),asbestos,tires,industrial,andmixedmunicipal.

Althoughthetotalacreageofthesite is567,theallotteddisposal footprint is355acrestoallowforaboundary between the facility and surrounding developments. The current constructed WasteManagementUnitscopeis288acresandtheremainingallottedlandisusedforotherlandfillactivitiessuchassoilborrowandstorageuntilitisconvertedtoWasteManagementUnits.Naturallandelevationsatthesiteare30to40feetabovemeansealevelandthelandfillispermittedreachheightsupto210feetabovemeansealevel.

Forwardlandfill isprojectedtoclosein2020atcurrentacceptanceratesduetoreachingitspermittedsizeparameters.Toincreasethelifespanofthelandfill,Forward,Inc.isplanningtoexpanditsdisposalfootprintfromabout355acresto366acres.Thisexpansionwouldinvolvetherelocationof3,200feetoftheSouthBranchoftheSouthForkofLittleJohnsCreekandincreasingthecurrentlandfillcapacityfromabout20millionCY(asofFebruary2014)toabout27.7millionCY.

onlargetrucksthatcaneachholdupto22tonsofmaterial.Lovelaceispermittedtoreceive1300tonsofwasteperdayandhaveatrafficvolumeof1280vehiclesperdaybuttheaveragedailytonnagereceivedislessthanhalfofthisamount.

Thisstationacceptswastefromthegeneralpublic intheformofagriculturalwaste,cabovercampers,campershells,dismantledcampertrailerslessthan25feetinlength,commercialandhouseholdwaste,construction/demolitionwaste,tires,andwhitegoodssuchasrefrigerators,freezers,andairconditioningunits.Thetransferstationisnotpermittedtoacceptanyliquidwastesludge,anywasterequiringspecialhandling,designatedwastes,orhazardouswastes. These itemsmustbe taken to San JoaquinCountyHazardousWasteFacilitylocatedattheStocktonAirport.

HAZARDOUSWASTEDISPOSAL TheSanJoaquinCountyHazardousWastefacilityislocatedona2-acresiteat7850RABridgefordStreetinStockton.Thehazardouswastefacilityisavailableforpublicdrop-offofhazardouswastesonThursdaythroughSundaywiththeexceptionofconditionallyexemptsmallquantitygenerators,whichareacceptedbyappointmentonly.Thefacilityisfreeofcharge,howeversomeconditionsdoapply.Hazardouswastesaccepted by this facility include paint, oil, antifreeze, pool chemicals, fertilizers, batteries, cleaningproducts,medicalsharps,andmedicines.

InFebruary2006,itbecameillegalforresidentsandsmallbusinessestodisposeofuniversalwasteinthetrashduetoadecisionbytheDepartmentofToxicSubstanceControlandtheCaliforniaIntegratedWasteManagementControl.Universalwasteisatypeofhazardouswastecontainingmercuryorotherheavymetalsthatcanreleaseneurotoxinsintotheenvironmentifnotdisposedofproperly.Almostanyproductwithacircuitboardisconsidereduniversalwaste.Otheruniversalwasteitemsincludebatteries,motoroil,mercurythermostats,fluorescentlights,cathoderaytubedevices(computermonitors,televisions),andmercurythermometers.Theseitemsarebannedfromlandfillsandrequirespecialhandling.MostoftheseitemsareacceptedatbothLovelaceTransferStationandtheCountyHazardouswastefacility.E-wastenotacceptedbythesetwofacilitiesconsistsofcomputers,TVs,andprinters,whichmustbetakentotheCityOfMantecaSolidWasteOffice.

Californialimitsthetransportationofhazardouswastesto15gallonsor125poundspervehiclebutthenumber of tripsmade per day is not regulated. Single containers cannot be over 5 gallons.Mantecaprovidesresidentswithfree5quartmotoroilcollectioncontainersuponrequest.Theycanbeleftoutcurbsidenexttotrashcartsoncollectiondaystobepickedupfornoextracharge.

SOLIDWASTEGENERATIONRATESANDVOLUMESTheCaliforniaDepartmentofResourcesRecyclingandRecovery(CalRecycle)tracksandmonitorssolidwastegenerationratesonapercapitabasis. PercapitasolidwastegenerationratesandtotalannualsolidwastedisposalvolumesfortheCityofMantecabetween2010and2014areshowninTable3.1-2below.

As shown in the Table 3.1-2 above, the per capita waste generation rate decreased from 4.9 to 4.7lbs/person/day over the 5 year (2010-2014) period, however, the total annual disposal tonnage inManteca increasedby2,490tonsover the2010to2014timespan.With thepassageofSB1016,percapita disposal rate is used to determine the diversion progress of a city and not the jurisdictionaldiversionrates.Therefore,apopulationincreaseresultinginthegenerationofmoreoverallcitywastedoesnotaffectthejurisdiction’sabilitytomeetitswastegoals.TheCity’swastedisposalratetargetsareshowninTable3.1-3.

LANDFILLCAPACITYForwardLandfillispermittedtoaccept46,080tonsofsolidwasteperweek,nottoexceed8,668tonsperday.Theaveragedailydisposal is620tonsperday.Theallotteddisposalarea is354.5acres,and it isdesignedtohold51,040,000cubicyardsofinertordesignatedwastes.Themaximumdepthofthelandfillis7feetbelowmeansealevelandthepermittedheightisnogreaterthan210feetabovemeansealevel.The remaining capacity is23.7million cubic yards,which isexpected tobe filledby2021.TheCityofMantecalandfillsaresummarizedinTable3.1-4.

UponclosureofForwardLandfill,FoothillandNorthCountylandfillscannotbecomethemainlocationofManteca’ssolidwastebecausetheircurrentallottedmaximumdailythroughputissignificantlylowerthanthe620 tons thatForward landfill receivesonadailybasis.TheCityofMantecamust secureanotherlocationofwastedisposalinpreparationofForwardLandfill’sclosure.

3.1.5 ELECTRICITYANDNATURALGAS

REGULATORYFRAMEWORKSTATE

PublicUtilitiesCommissionTheCaliforniaPublicUtilitiesCommission(PUC)istheprimaryStateagencythatregulatesprivatelyownedpublic utilities in California. These utilities include telecommunications, electricity, natural gas,water,railroad,railtransit,andpassengertransportationcompanies.AprimaryroleofthePUCistoauthorizeutilityratechanges.Italsoestablishesservicestandardsandsafetyrules,monitorsthesafetyofutilityandtransportationoperations,prosecutesunlawfulmarketingandbillingactivities,andoverseesthemergerandrestructureofutilitycorporations.

BioenergyActionPlan–ExecutiveOrder#S-06-06ExecutiveOrder#S-06-06establishestargetsfortheuseandproductionofbiofuelsandbiopower,anddirects State agencies to work together to advance biomass programs in California while providingenvironmentalprotectionandmitigation.Theexecutiveorderestablishesthefollowingtargettoincreasethe production and use of bioenergy, including ethanol and biodiesel fuels made from renewableresources:produceaminimumof20%ofitsbiofuelswithinCaliforniaby2010,40%by2020,and75%by2050.TheexecutiveorderalsocallsfortheStatetomeetatargetforuseofbiomasselectricity,includingbiomasscogenerationfacilities.

SenateBill14andAssemblyBill64PriortothepassageofSB14andAB64in2009,Californialawrequiredinvestor-ownedutilities(IOUs)andenergyserviceproviders (ESPs)to increasetheirexistingpurchasesofrenewableenergyby1%ofsales per year such that 20% of their retail sales, as measured by usage, are procured from eligiblerenewable resources (including biomass cogeneration) by December 31, 2010. This is known as theRenewablePortfolioStandard(RPS).

SB14andAB64requireIOUs,POUs,andESPstoincreasetheirpurchasesofrenewableenergysuchthatatleast33%ofretailsalesareprocuredfromrenewableenergyresourcesbyDecember31,2020.ForIOUsandESPs,thisisrequiredonlyifthePUCdeterminesthatachievingthesetargetswillresultinjustandreasonablerates.

Title24Title 24, Part 6, of the California Code of Regulations is also known as California’s Energy EfficiencyStandardsforResidentialandNonresidentialBuildings.Title24wasestablishedin1978inresponsetoalegislativemandatetoreduceCalifornia’senergyconsumption.Thestandardsareupdatedperiodicallytoallowconsiderationandpossible incorporationofnewenergyefficiencytechnologiesandmethods.The 2008 Energy Efficiency Standards went into effect on January 1, 2010. Title 24, Part 11, of theCalifornia Code of Regulations establishes the California Green Building Standards Code (CalGreen).Initially,thecoderequirementswerevoluntary;however,CalGreenbecamemandatoryin2011.CalGreenaddressesfiveareasofgreenbuilding:1)planninganddesign,2)energyefficiency,3)waterefficiencyandconservation, 4) material conservation and resources efficiency, and 5) environmental quality. Themandatory requirements are separated into non-residential and residential projects. 3.2 PUBLICSAFETYThis section addresses the provision of public safety services in the City of Manteca, including fireprotection,lawenforcement,andotherlocalsafetyprovisions.

3.2.1 FIREPROTECTIONTheManteca Fire Department is responsible for the primary provision of fire service and emergencymedical response for the City of Manteca and its residents. The Manteca Fire Department servesapproximately71,164residentsthroughoutapproximately17.2squaremileswithintheCitylimits.TheManteca Fire Department operates out of four facilities that are strategically located in the City ofManteca.TheMantecaFireDepartmentisheadquarteredinStation242locatedat1154S.UnionRoad.ThisbuildingservesastheFireDepartmentheadquartersandtheFirePreventionBureau.FiretrainingandemergencymedicalservicesaremanagedoutofStation241.Apparatusincludesfourengines,fourreserveengines,oneladdertruck,onemediumrescueunit,oneUSARrescuetrailer,eightstaffvehicles,twopick-uptrucks,andapubliceducationtrailer.

REGULATORYFRAMEWORKSTATE

CaliforniaOccupationalSafetyandHealthAdministrationInaccordancewithCaliforniaCodeofRegulationsTitle8Sections1270"FirePrevention"and6773"FireProtectionandFireEquipment"theCaliforniaOccupationalSafetyandHealthAdministration(Cal/OSHA)hasestablishedminimumstandardsforfiresuppressionandemergencymedicalservices.Thestandardsinclude,butarenotlimitedto,guidelinesonthehandlingofhighlycombustiblematerials,firehosesizingrequirements,restrictionsontheuseofcompressedair,accessroads,andthetesting,maintenance,anduseofallfirefightingandemergencymedicalequipment.

TheStateofCaliforniapassedlegislationauthorizingtheOfficeofEmergencyServices(OES)toprepareaStandard Emergency Management System (SEMS) program, which sets forth measures by which ajurisdiction should handle emergency disasters. department access, fire hydrants, automatic sprinkler systems, fire alarm systems, fire and explosionhazards safety, hazardous materials storage and use, provisions intended to protect and assist fireresponders,industrialprocesses,andmanyothergeneralandspecializedfire-safetyrequirementsfornewand existing buildings and the surrounding premises. The Fire Code contains specialized technicalregulationsrelatedtofireandlifesafety.

CALIFORNIAHEALTHANDSAFETYCODEStatefireregulationsaresetforthinSections13000etseq.oftheCaliforniaHealthandSafetyCode.Thisincludesregulationsforbuildingstandards(asalsosetforthintheCaliforniaBuildingCode),fireprotectionand notification systems, fire protection devices such as extinguishers and smoke alarms, high-risebuildingandchildcarefacilitystandards,andfiresuppressiontraining.

NFPA1710The NFPA 1710 Standards are applicable to urban areas and where staffing is comprised of careerFirefighters.Accordingtotheseguidelines,acareerfiredepartmentneedstorespondwithinsixminutes,90percentofthetimewitharesponsetimemeasuredfromthe911calltothetimeofarrivalofthefirstresponder.

Thestandardsaredividedasfollows:

• Dispatchtimeofoneminuteorlessforatleast90percentofthealarms

• TurnouttimeofoneminuteorlessforEMScalls(80secondsforfireandspecialoperationsresponse)

• Fireresponsetraveltimeoffourminutesorlessforthearrivalofthefirstarrivingenginecompanyatafireincidentandeightminutesorlesstraveltimeforthedeploymentofaninitialfullalarmassignmentatafireincident

• Eightminutesorlesstraveltimeforthearrivalofanadvancedlifesupport(ALS)(4minutesorlessifprovidedbythefiredepartment

FIREPROTECTIONSERVICES

MantecaFireDepartmentTheManteca Fire Department is responsible for the primary provision of fire service and emergencymedical response for the City of Manteca and its residents. The Manteca Fire Department servesapproximately72,000residentsthroughoutover17squaremileswithintheCitylimits(seeFigure3.2-2).TheMantecaFireDepartmentoperatesoutoffourfacilitiesthatarestrategicallylocatedintheCityofManteca.TheMantecaFireDepartmentisheadquarteredinStation242locatedat1154S.UnionRoad.ThisbuildingservesastheFireDepartmentheadquartersandtheFirePreventionBureau.FiretrainingandemergencymedicalservicesaremanagedoutofStation241.Apparatusincludesthreeengines,threereserveengines,oneladdertruck,onemediumrescueunit,oneUSARrescuetrailer,eightstaffvehicles,twopick-uptrucks,andapubliceducationtrailer.

TheMantecaFireDepartmentmaintainsagoalfortheinitialcompanyofthreefirefighterstoarriveonscene for fire and emergency medical service (EMS) incidents within five minutes 90% of the time(ResponseEffectiveness).In2014,theDepartmentaverageda4:18responsetimeCity-wideandwasonscenewithinfiveminutes77%ofthetime.In2015,theDepartmentaverageda4:40responsetimeCity-wide.Additionally,in2015,6,615callsweremadetotheDepartment,whichisthegreatestnumberofcallsinthehistoryoftheMantecaFireDepartment.1

The Department is not currently meeting the Response Effectiveness goal. In May of 2016, theDepartment arrived on-scene within 5 minutes approximately 66% of the time.2 The percentagecontinues to decline. The Department has recently seen increased calls and expanded areas ofcoverage.TocombattheincreasedcallsinthesouthernareasofManteca,theDepartmenthasrecentlystaffeda“Rescue”inDistrict2.TheadditionalunitwillhelprelievethesignificantcallvolumeinsouthManteca.

OnSeptember11,2013,FireStationNo.4openedinnorthwestManteca.FireStationNo.4wasonefactorthathelpedtoimproveboththeaverageresponsetimeandthepercentofresponseeffectivenessin2014.

TheconstructionofFireStationNo.5,whichisplannedinsoutheastManteca,willhaveasimilarimpacton response timesand responseeffectiveness.TheconstructionandstaffingofFireStationNo.5willallowtheCitytheabilitytoachievethefullalarmstandardoutlinedbyNFPA1710forthefirsttimeintheCity’s History; thiswill directly affect the ISO rating, enhance service to the citizens ofManteca, andimprovethedepartment’sabilitytoobtaingrants.

ISORATINGThe Insurance Services Office (ISO) Public Protection Classification Program currently rates the FireDepartmentasTHREEonascaleof1to10,with1beingthehighestpossibleprotectionratingand10beingthelowest.TheISOratingmeasuresindividualfireprotectionagenciesagainstaFireSuppressionRatingSchedule,which includessuchcriteriaasfacilitiesandsupportforhandlinganddispatchingfirealarms, first-alarmresponseand initialattack,andadequacyof localwatersupply for fire-suppressionpurposes.TherecentconstructionandstaffingofFireStationNo.4aswellastheimminentconstruction

Lathrop-MantecaFireDistrictThe Lathrop Manteca Fire District provides fire protection services to the City of Lathrop and thesurroundingruralarea,aswellasmostofManteca’sSOI(seeFigure3.2-2).TheTheLathrop-MantecaFireDistrict staffs four firestationswithcareerpersonnelaswellasvolunteer firefighters.Thedistricthasdevelopedintoaproactivefire&emergencyresponseorganizationthatcoversalmost100squaremilesandover30,000residents.

RiponConsolidatedFireDepartmentTheRiponConsolidatedFireDistrictprovidesfireprotectionandemergencymedicalservicestotheCityofRiponandsurroundingarea.TheRiponConsolidatedFireDepartment’sserviceareaincludesthemostsoutheasternportionoftheCityofMantecaandtheeasternportionsofManteca’sPlanningArea(seeFigure3.2-2).

3.2.2 LAWENFORCEMENTThe Manteca Police Department (MPD) provides law enforcement and police protection servicesthroughoutthecity.

ORGANIZATIONTheMPDisorganizedintotwodivisions:OperationsandServices.Additionally,theMPDoperatesaPublicAffairsUnit.Forbudgetingpurposes,theMPDisorganizedintothefollowingprograms:administration,patrol,investigations,supportservices,dispatch,codeenforcement,jailservices,andanimalservices.

OperationsDivisionTheOperationsDivisionisthelargestdivisionoftheDepartment.Itincludesalluniformedofficersandtheirsupportteams.TheunitsincludedintheOperationsDivisionarepatrol,traffic,communityserviceofficers,SWAT,crisisresponseteam,mountedpatrol,canine,andbombsquad.

ServicesDivision TheServicesDivisionincludesalltheteamsandunitsthatsupportthelinepolicefunctionoftheMPD.TheseteamsincludeDispatch,Records,PropertyandEvidence,CrimeAnalysis,andAnimalServices,aswellasDetectives,SchoolResourceOfficers,GangUnit,andManteca’sStreetCrimesUnit(SCU),whichisthedepartment’sproactivenarcoticandstreetcrimesuppressionunit.

TheMPDalsohasseveralveryactivevolunteergroups.ThePoliceExplorers,Citizen’sPoliceAcademygraduates,PoliceReserves,andtheSHARPsallowmembersofthecommunityofallagesandexperiencetogivebacktothecommunitythroughvolunteering.

PublicAffairsUnitTheMPD’sPublicAffairsOfficer(PAO)worksdirectlywiththeChiefofPoliceonissuesthataffecttheMPDandcommunity. Inaddition tobeingacommunity liaison, thePAOworkswith thepublic inprovidingcurrentinformationregardingissueseffectingManteca.Thisisdonebyworkingwithlocalnewsmediaoutlets, issuing information bulletins and conducting neighborhoodmeetings, and by using the localgovernmentchannelforaprogramcalledStreetBeat.InadditiontoassistingtheChiefofPolice,thePAOalso coordinates several crime prevention programs to include the Citizen Police Academy, DrugAwarenessEducation,andvariousworkplace-trainingprogramssuchasWorkplaceViolencePrevention.The PAO also coordinateswith other city offices special projects and does site plan reviews for newcommercial and residential projects using a process called CPTED (Crime Prevention throughEnvironmentalDesign).

QuimbyActTheQuimbyAct(CaliforniaGovernmentCodeSection66477)statesthat“thelegislativebodyofacityorcountymay,byordinance,requirethededicationoflandorimposearequirementofthepaymentoffeesinlieuthereof,oracombinationofboth,forparkorrecreationalpurposesasaconditiontotheapprovalof a tentative or parcelmap.” Requirements of theQuimbyAct apply only to the acquisition of newparklandanddonotapplytothephysicaldevelopmentofnewparkfacilitiesorassociatedoperationsandmaintenance costs. POLICYPF-P-47. TheCity shalluse jointdevelopmentofparkanddrainagedetentionbasins in thedevelopmentofneighborhoodparks.

POLICYPF-P-52. TheCity shall endeavor to identify, acquire, anddeveloponeormore communityparksasdefinedintheParksandRecreationMasterPlan.

POLICY PF-P-53. All new residential development will be required to pay a park acquisition andimprovementfee,basedonproviding5acresper1,000residents,tofundsystem-wideimprovements.

POLICYPF-P-54.TheCityshallrequiretheprovisionofprivateopenspaceandrecreationalfacilitiesaspartofnewresidentialdevelopments.

POLICY PF-P-55. The City shall not discourage the expansion of private commercial recreationalfacilities.

ThisCityofMantecahassixdevelopedCommunityParksites,totalingapproximately78acres.

Neighborhoodparks:Neighborhoodparksserveasthefocalpointofneighborhoodcommunities,thehubfor both physical and social activities in a recreational setting that should be primarily passive.Appropriatelydesignedneighborhoodparksactas“pulsepoints”withinthecity.Theyarespacesthatdevelop a sense of placewhile at the same time evolve to reflect the neighborhood they represent.Neighborhoodparksactascriticalbuildingblocksofthecity’simageandassistindevelopinganoverallsenseofcommunityandsecurity.Theyalsoserveascriticalnodesandaccesspointsinthecity-widegreenspacenetwork.Neighborhoodparksaregenerally5to7acres. Amenitiesatneighborhoodparksmayinclude ball fields, basketball, volleyball, bocce ball, and tennis courts, small picnic areas, playgroundequipment,restroomfacilities,waterplayfeatures,andbarbeques.

ThisCityofMantecahas49NeighborhoodParks,totalingapproximately213acres.

Specialuseparks:TheSpecialUseParksallowforflexibilityinprovidingrecreationalresourcesthroughoutthecity-wideparkspacenetwork.Thisclassificationisintendedtoaccommodatespecialcircumstances,unique site characteristics, etc. in park, trail, and recreation resources. These types of resources adddiversitytotheparknetworkandaccommodateavarietyofnon-traditionalrecreationamenitiesbeyondthestandardneighborhood,andcommunity,parkclassifications.

TheCityofMantecahas10SpecialUseParks/Facilitiestotalingapproximately91acres,includingamajormulti-userecreationtrailthatcoversover3.5milesofterrain.

CITYPARKSTheCitycurrentlymanagesmorethan483acresofparks,facilities,trailsandrecreationlands,including382acresofcommunity,neighborhood,andspecialuseparksandthe101-acreMantecaParkGolfCourse.The locationofparkswithintheCity isshownonFigure3.3-1. Table3.3-1summarizestheCity’sparkfacilitiesbycategory.

When the acreage is broken down into functional categories, the City currently has 212.73 acres ofNeighborhoodParkland.TheParksandRecreationMasterPlanidentifiedasmallcurrentdeficitof5.67acres intheNeighborhoodParkscategory. This isapproximatelytheequivalentofoneNeighborhoodPark,andwillbesatisfiedwiththecompletionofEvansEstatePark.InthecategoryofCommunityParkacreage,thecurrentquantityof78.46acresexceedsthecity’sgoalofoneacreper1,000population.InthecategoryofSpecialUseFacility/Parks,theCity’s90.94acresofparklandsforspecialusesexceedstheCity’sgoalofoneacreper1,000population.

Inaddition,theCity’sParksandRecreationMasterPlanidentifiedadditionalfacilityneedsrequiredbyyear2035.Acumulativetotalofapproximately130acresofNeighborhoodParklanddevelopmentwouldberequired,aswellasatotalofapproximately38.5acresofCommunityParkland,and26acresofSpecialUseFacility/Parklands.Thisamountisapproximateandcouldbemetbyacombinationofutilizingexistingundevelopedparklandandacquiringnewparklandtodevelop.

ParksandRecreationamenitiesincludeseveralbaseballandsoftballdiamonds,sportsfields,picnicareas,barbecues,playgroundsandtotlots,over3milesofClass1bikeandpedestrianpath,lightedtenniscourts,aBMXbicycletrack,askatepark,an18-holemunicipalgolfcourse,andapublicswimmingpool(withtotpool).

Existingrentalfacilitiesinclude:

Onaregionalscale,theCityislocatedintheSacramento-SanJoaquinDelta(Delta),whichcontainsseveralrecreationalareasandfacilities,primarilyforwater-basedrecreation.RegionalCountyparksneartheCityinclude the 9.85-acreDos Reis Regional Park and the 3.7-acreMossdale Crossing Regional Park, bothlocatedalongtheSanJoaquinRiver.MossdaleCrossingParkislocatedonthewestsideofInterstate5.Eachoftheseparks includesboat launchramps,picnic/barbequeareas,andchildren’splayareas.DosReisRegionalParkalsohascamping facilities.Also in thevicinity is theHavenAcresMarina,aprivatemarinalocatedontheSanJoaquinRivernorthofDosReisRegionalPark.ThisfacilityprovidesriveraccesstotheSanJoaquinRiverandincludesparkingareas,aboatramp,and10boatberths.

LeroyF.GreeneSchoolFacilitiesActof1998(SB50)The“LeroyF.GreeneSchoolFacilitiesActof1998,”alsoknownasSenateBillNo.50orSB50(Chapter407,Statutesof1998),governsaschooldistrict’sauthoritytolevyschoolimpactfees.Thiscomprehensivelegislation,togetherwiththe$9.2billioneducationbondactapprovedbythevotersinNovember1998known as “Proposition 1A,” reformed methods of school construction financing in California. SB 50institutedanewschool facilityprogrambywhichschooldistrictscanapply forStateconstructionandmodernizationfunds.Itimposedlimitationsonthepowerofcitiesandcountiestorequiremitigationofschool facilities impactsasa conditionofapprovingnewdevelopmentandprovided theauthority forschooldistrictstolevyfeesatthreedifferentlevels:

• LevelIfeesarethecurrentstatutoryfeesallowedunderEducationCode17620.Thiscodesectionprovidesthebasicauthorityforschooldistrictstolevyafeeagainstresidentialandcommercialconstructionforthepurposeoffundingschoolconstructionorreconstructionoffacilities.Thesefeesvarybydistrictforresidentialconstructionandcommercialconstructionandareincreasedbiannually.

• LevelIIfeesareoutlinedinGovernmentCodeSection65995.5,allowingschooldistrictstoimposeahigherfeeonresidentialconstruction ifcertainconditionsaremet.Theseconditions includehaving a substantial percentage of students on multi-track year-round scheduling, having anassumeddebtequalto15–30%ofthedistrict’sbondingcapacity(percentageisbasedonrevenuesources for repayment), having at least 20% of the district’s teaching stations housed inrelocatableclassrooms,andhavingplacedalocalbondontheballotinthepastfouryearswhichreceivedatleast50%plusoneofthevotescast.AFacilityNeedsAssessmentmustdemonstratethe need for new school facilities for unhousedpupils is attributable to projected enrollmentgrowthfromtheconstructionofnewresidentialunitsoverthenextfiveyears.

• Level III fees are outlined in Government Code Section 65995.7. If State funding becomesunavailable,thiscodesectionauthorizesaschooldistrictthathasbeenapprovedtocollectLevelIIfeestocollectahigherfeeonresidentialconstruction.ThisfeeisequaltotwicetheamountofLevel II fees. However, if a district eventually receives State funding, this excess feemay bereimbursedtothedevelopersorsubtractedfromtheamountofStatefunding.

TheKindergarten-UniversityPublicEducationFacilitiesBondActof2002(Prop47)ThisactwasapprovedbyCaliforniavoters inNovember2002andprovidesforabond issueof$13.05billiontofundnecessaryeducationfacilitiestorelieveovercrowdingandtorepairolderschools.Fundswillbetargetedatareasofgreatestneedandmustbespentaccordingtostrictaccountabilitymeasures.FundswillalsobeusedtoupgradeandbuildnewclassroomsintheCaliforniaCommunityColleges,theCaliforniaStateUniversity,andtheUniversityofCaliforniainordertoprovideadequatehighereducationfacilitiestoaccommodategrowingstudentenrollment.

CaliforniaDepartmentofEducationTheCaliforniaDepartmentofEducation(CDE)SchoolFacilitiesPlanningDivision(SFPD)preparedaSchoolSiteSelectionandApprovalGuidethatprovidescriteriaforlocatingappropriateschoolsitesintheStateofCalifornia.SchoolsiteandsizerecommendationswerechangedbytheCDEin2000toreflectvariouschangesineducationalconditions,suchasloweringofclasssizesanduseofadvancedtechnology.TheexpandeduseofschoolbuildingsandgroundsforcommunityandagencyjointuseandconcernforthesafetyofthestudentsandstaffmembersalsoinfluencedthemodificationoftheCDErecommendations.

SpecificrecommendationsforschoolsizeareprovidedintheSchoolSiteAnalysisandDevelopmentGuide.Thisdocumentsuggestsaratioof1:2betweenbuildingsandland.CDEisawarethatinanumberofcases,primarily inurban settings, smaller sites cannotaccommodate this ratio. In suchcases, theSFPDmayapproveanamountofacreagelessthantherecommendedgrosssitesizeandbuilding-to-groundratio.

CertainhealthandsafetyrequirementsforschoolsiteselectionaregovernedbyStateregulationsandthepoliciesoftheSFPDrelatingto:

• Proximitytoairports,high-voltagepowertransmissionlines,railroads,andmajorroadways;

• Presenceoftoxicandhazardoussubstances;

• Hazardousfacilitiesandhazardousairemissionswithinone-quartermile;

• Proximitytohigh-pressurenaturalgaslines,propanestoragefacilities,gasolinelines,pressurizedsewerlines,orhigh-pressurewaterpipelines;

• Noise;

• Resultsofgeologicalstudiesorsoilanalyses;and

• Trafficandschoolbussafetyissues.

LOCAL

CityofMantecaMunicipalCodeTheCityofMantecaMunicipalCode,FeeScheduleVIDevelopmentFeeincludesdevelopmentimpactfeestofundpublicfacilities,includingtheSanJoaquinCountyFacilitiesFeetofundpoliceservices.

CityofMantecaGeneralPlanTheexistingMantecaGeneralPlanincludesthefollowinggoalsandpoliciesrelatedtoschools:

PublicFacilitiesandServicesElement–EducationGOALPF-13.MaintainsufficientlandinventorysothattheMantecaUnifiedSchoolDistrictcanprovidefortheeducationalneedsofMantecaresidents.

POLICY PF-P-33. The City shall cooperate with the Manteca Unified School District and others inlocatingand reservingappropriate sites fornewneighborhoodwalkingdistance schools.Adequatefacilities shall be planned to accommodate new residential development and endeavor to createneighborhoodschools.

POLICYPF-P-34.TheCityshallcooperatewiththeMantecaUnifiedSchoolDistrictintheircollectionofschoolfacilitydevelopmentfeesfromnewdevelopment.

POLICYPF-P-35.Financingofnewschoolfacilitieswillbeplannedconcurrentwithnewdevelopment.

POLICYPF-P-36.TheCityandMantecaUnifiedSchoolDistrictwillworktogethertodevelopcriteriaforthedesignationof school sites and consider opportunities for reducing the cost of land for schoolfacilities.TheCitywillencouragetheschooldistricttocomplywithCitystandardsinthedesignandlandscapingofschoolfacilities.

POLICYPF-P-37.TheCitywillconsideropportunitiesforjoint-useoffacilitieswiththeschooldistrict.Whenfeasible,a joint-useagreementwillbepursuedtomaximizepublicuseof facilities,minimizeduplicationofservicesprovided,andfacilitatesharedfinancialandoperationalresponsibilities.

POLICYPF-P-38.Schoolsmustbelocatedawayfromhazardsofsensitiveresourceconservationareas,exceptwheretheproximityofresourcesmaybeofeducationalvalueandtheprotectionofresourcesisreasonablyassured.

SCHOOLSTheMantecaUnifiedSchoolDistrict(MUSD)providesschoolservicesforgradesKthrough12withinthecommunitiesofManteca,Lathrop,Stockton,andFrenchCamp.TheDistrictisapproximately113squaremiles and servesmore than 23,000 students.Within the City ofManteca, there are thirteen schoolsservingelementaryageandmiddleschoolstudents(gradesK-8),oneK-6school,fourhighschools(grades9-12),one7-12,andonevocationalhighschool(grades11-12).Table3.4-1listsMUSDschoolsinMantecagradesserveslocationandthemostrecentenrollmentforeachschool.

AsshowninTable3.4-1,theschoolsintheCityhadatotalenrollmentofapproximately14,279students,ofwhich9,416wereenrolledinelementaryandmiddleschool(gradesK–8)and4,863wereenrolledinhighschool(grades9–12).

Additionally,theMUSDcurrentlyoperatesthreeelementaryschoolsandzerohighschoolswithintheareaofManteca south of State Route 120.3 These three elementary schools have a combined permanentcapacityof2,560students.Duringthe2015/2016schoolyear,theenrollmentattheseschoolstotaled2,012 students, resulting in excess capacity of 548 future students. Further, excess capacity currentlyexistsattheschoolfacilitieslocatednorthofStateRoute120.

District-wideMUSDSchoolshasa total enrollmentof23,204 students for the2015-2016 school year.Table3.4-2providesasummaryofthepublicschoolenrolmentbygradewithinManteca.
