Effect of the Prohibition of Competition in the Labor Law
Abstract: Freedom to work is a fundamental principle of labor law and in-
cludes the right of individuals, in accordance with their abilities, to chooses em-
ployment or independently to perform certain activities. The introduction of
bans, among which include the prohibition of competition is restricting the free-
dom of labor. The paper outlines the nature and effect of the prohibition of com-
petition in the labor law with extract of the most important legal comparative
elements. The aim is to show that the legitimacy of the prohibition of competi-
tion involves striking a balance between the business interests of the employer
and the employee's freedom to work. The conclusion is that domestic law does
not provide sufficient imperative protection of employees in the context of con-
tracting prohibition of competition, with the suggestion that it is expedient to
specify the minimum amount of compensation for the duration of this ban to em-
ployment.
