    12 Mar 08, P02 HACHE reviewed all of the provided documentation and notedthat only the TFA Crndr or designate can authorize the release or transferof a Detainee. Further, the individual was captured atand was not released from CF custody untilindividual was in CF custody forP02 HACHE learned that Capt WORS was e MP PHUDSON'was the MP Coy PM during the aforementioned dates.

    on 31 Mar and 4 Apr 08, P02 HACHE conducted formal interviews of bothCapt WORSFOLD and Sgt UTI'ON. During the course of these independentlyconducted interviews, both Capt WORSFOLD and Sgt UTTON stated that theyrecalled Detainee It confirmed that he was held at the KAYDetention Facility for an extended period of time. Furthe~ore, bothindividuals stated that the Detainee was provided excellent medical carefor an ongoing medical condition and that at no time was the Detainee evermistreated. Furthermore, it was learned that KAF MP members did everythingthey could to make the Detainee as comfortable as possible, although theclimatic conditions were hot and dry. Additionally, both Capt WORSFOLD andSgt UTI'ON stated that they were well aware of the TFA TSO, which indicatesthat all Detainees are to be either transfered to the Afghan Authorities orreleased within 96 hours. Furthermore, both individuals, in particularCapt WORSFOLD, stated that the MP Coy Chain of Command was well aware ofthe aforementioned. However, the TFA Cmdr MGen GRANT, who was responsiblefor ordering the transfer or release of all Detainees, for whatever reasondid not provide a verbal order to release Detainee _until07. Both Capt WORSFOLD and Sgt UTI'ON believe that~ release wasdue to a court injunction filed by both Amnesty International and the BCCivil Liberties Union.

    8 Apr 08, P02 HACHE contacted Maj HUDSON in an attempt to gathersupporting information regarding the delayed release of Detainee... however, Maj HUDSON was unable to provide any information ofrelevance.

    8 Apr 08, P02 HACHE contacted Maj LAFLAMME, and gathered additionalinformation not originally forwarded to CEFCOM from the KAF MP Pl. Oncethe information was received, it did not provide any relevant informationwith respect to why there was a delay in the release of the Detainee.

    8 Apr 08, P02 HACHE contacted LCdr SIEPKA, who stated the only commentshe could make on the matter was that reference should be made to the TSOthat was in effect during the period in question, regarding the release ortransfer of Detainees. She further added that MOen GRANT or CEFCOM J3 (atthe lowest level), should be contacted if any additional information wasrequired.

MrLENTON further stated that the issue was brought forward as a matter ofconcern as a result of his review of an SIR and previous ihterview{s).Hence, he felt that the CFNIS should be advised.

    2. P02 HACHE advised Mr LENTON that he had conducted 2 X Interviewsrelating to the MPCC's concern, and that there was no information learnedto suggest that Detainee had been mistreated and that MP's involved notonly conducted themselves in a very professional manner but alsodemonstrated their humanity towards this particular Detainee. Also, withrespect to the extended period of time that this individual was in CFcustody, MP (capt WORSFOLD and Maj HUDSON) demonstrated due diligence inattempting to determine if the Detainee was either to be transfered orreleased within the 96 hour period.

    NOTE: The aforementioned conversation between P02 HACHE and Mr LENTON wasconducted in very general terms. No specific mention of locations and orindividuals involved were used, as Mr LENTON had indicated that he was on acellular telephone. Further, P02 HACHE and Mr LENTON agreed to speak On 7Apr 08, at which time specific details regarding this matter can be openlydiscussed .

Further, Maj HUDSON, who did recall the aforementioned Detainee, statedthat at _07, Annex F was received by MP Coy HQ from the KAFMP Pl.~d not confirm the following, he believed that theinformation was then hand carried to the Detainee Liaison Officer (DLO) MajMacKAY, who would have then provided it to the Chief of Operations (CHOP)Col BRADLEY. Also, Maj HUDSON indicated that the file currently held byP02 HACHE may not be 100% complete and that the original file and that heldby CEFCOM may differ, which may explain why the Use of Force Report andpolice notes of Sgt UTTON are not included in the Detainee file.

    3. Regarding the 96 hour detention issue, Maj HUDSON stated that hebelieved that this was an agreement between the Canadian and AfghanGovernment. He further believes that it is derived from the customs andpractices of ISAF.

    4. P02 HACHE advised Maj HUDSON that there is a possibility that he maytravel to Kingston, ON, in order to interview him formally. Maj HUDSONindicated that other than a couple of weeks in May 08, he would beavailable.

    1. P02 HACHE contacted Maj LAFLAMME (CEFCOM PM), at which time it waslearned by P02 HACHE that the Detainee File forwarded to him by CFNIS HQ,originated from CEFCOM (scanned as an image). As a result, P02 HACHEconfirmed thatCEFCOM had no additional information regarding this specificfile.

    2. Maj LAFLAMME also advised P02 HACHE "that once a Detainee File isconcluded in TFA,- it is scanned and converted to pdf format, then forwardedto CEFCOM. P02 HACHE then advised Maj LAFLAMME that in review of the file,neither he nor Sgt UTTON could locate the Use of Force Report and/or policenotes (as per Sgt UTTON's verbal statement to P02 HACHE on 3 Apr 08). MajLAFLAMME stated that it is possible that some documentation (ie. Use ofForce Report), may have been added to the original Det~inee File inAfghanistan. after the file was sent to CEFCOM. Maj LAFLAMME added thatalthough a possibility, if this would have been the case, the file shouldhave been re-scaIUled and another copy sent to CEFCOM. There should be nodifference between the file held in TFA and the file held by CEFCOM.

    3. As a result of the aforementioned queries by P02 HACHE, Maj LAFLAMMEstated that he would send an email to Afghanistan, to review the originalDetainee File to confirm that it was the same as the file held by CEFCOMand P02 HACHE. Further, he requested that attempts be made to locate theUse of Force Report and police notes compiled by Sgt UTTON. Further. MajLAFLAMME will attempt to locate the TFA TSO 32lA that was in effect during_07, which he believes was signed by the TFA CIndr Gen GRANT.

    4. P02 HACHE arranged for any classified documents to be sent via theif required.

This e-mail chainwas forwarded to the Lead Investigator (Sgt CHAMBERLAND) of OP CamelSpider, which was the first allegation into detainee. Due to the Op tempoof Camel Spider and several other complaints involving detainees, anotherproject (OP Centipede) was created. This file was part of OP Centipede.Investigators of OP Centipede prioritised, investigated and concluded mostof these files, however due to another unrelated very high profileinvestigation/project, this file was never investigated.On 16 Jan 09, Sgt CHAMBERLAND obtained from Sgt SCQliEN lex-OP Cent'ipede'smember) the notes and the e-mail chain that had initially been provided tothem.

    1. This report was initially created to investigate the allegations thatAfghans that had been capture by CF personnel were being abused. Theseallegations stemmed from two reports in the "Globe and Mail" dated 9 Mar 07and 23 Apr 07. In brief, these reports relate that prisoners, specificallythose who have captured by Canadian Forces and then later transferred toAfghan authorities, have been abused, tortured and even summarily executedby the Afghan powers that be. At that time and especially in considerationthat Operation Centipede had been recently formed to investigate similarcomplaints; it was decided that the aforementioned news paper articleswould be followed up on with the intention that an investigation(s) wouldensue to determine if any service'or criminal offences had been committedby CP-personnel. However, since these early articles, the media has beeninundated with countless reports of a similar nature. Paradoxically, manyof these articles report that none of the aforementioned maltreatment wasinflicted by Canadians, in fact most of the alleged captives have praisedthe Canadian soldiers on their civility, good manners and the relativelycomfortable detention centre located at KAF. Since then, the Governmentof Canada (GOe) has taken notice and has discussed these reports in greatfact. Subsequently the GOC, including the CF and DND have taken action onmany levels throughout its various parliamentary affairs in high levelnational and international menus .

    2. Although these newspaper journalists are reporting that they haveinterviewed former Afghan captives or at least received informationconcerning their treatment at the hands of the Afghans, considering thegeneral rules of evidence, the inadmissibility of statements as theypertain to hearsay information, and the lack of any other credibleevidence, there is no satisfactory justification to continue thisinvestigation. Likewise, even if these reports were some how deemed to becredible, the allegations of ill-treatment are directed against the Afghanauthorities. This alone excludes our jurisdictional interests and themandate of the CFNIS. As such, there is no satisfactory justification toproceed with an investigation that focuses on the actions of the Afghanauthorities and their handling of prisoners.

    3. upon reflection, it seems to be obvious that there will be additionalreports in the far reaching future that will address the manner in whichAfghan authorities handle their Afghan captives. To that end, any pendingmedia reports/articles concerning the treatment of Afghan prisoners byAfghan authorities which are void of any direct accusations of criminalwrongdoings of CF members, will not be investigated by this office. Thisfile is concluded.

    BACKGROUND

    On 7 April 06 three detainees were transferred from CF personnel to thecustody of GS MP GC at KAF. On B April 06 these detainees were transferredto the custody of the Afghan National Police (ANP). During the period oftransition at KAF, at least on~ of the detainees was provided medical careat the hospital for injuries incurred prior to his arrival at KAF.ISSUE

    The NIS is investigating the following allegations:

    1. That the MP failed to safeguard the well-being of three detainees intheir custody on 07/08 Apr 06 at KAF,2. That the MP failed to investigate and report the cause of injuriessustained by the detainees who were in their custody on 07/08 Apr 06 at KAF,3. That the actions of the CF personnel who took the detainees into CFcustody, and transferred the detainees to GS MP PC KAF on 07 Apr 06,violated the ROE's, or other policy or agreements pertaining to thesafeguarding of persons in their custody.

    ASSISTANCE REQUESTEDThe investigation is tasked with determining the facts and circumstances ofthe capture of the three persons, their detention prior to transport toKAF, their transport to KAF, detention and treatment of the three personwhile in MP custody at KAF, and subsequent transfer of the three personsto the custody of ANP. The investigation also seeks to identify and locatethe three detainees in question. Most, if not all personnel the NIS areseeking to interview with respect to this investigation are expected to beback in Canada at this time. The preliminary phase of this investigationis centered on the collection of information and documents at KAF, whichwill form the basis of determining who will be interviewed. This materialwill be required to present to various witnesses during the course of theirinterviews. The information and documents include (but are not restrictedto) ;1. The personnel posted at GS MP PC KAF durins the month of Roto 1, and theshift schedule for the month of April 06. .2. TFA MP Temporary Transfer of Detainees documents, Detainee TransferRecords, Sick Reports, TFA MP Property Seizure 'reports, photographs, andany other administrative or operational reports that pertain to the threeunidentified persons received at a GS MP PC FAF on 07 Apr 07, andtransferred to the ANP 08 Apr 06.3. Any documents at the hospital that pertain to the treatment to the threedetainees,4. Any documents that would assist in identifying the three detainees.5. Any documents that may be accessible in 'the possession of-the ANP, thatwould provide information pertaining to the identification and location of
