Sources say on April 24, 2012, the day of the mur- der, Indrani Mukerjea called Sheena in the evening and asked to meet with her to discuss some- thing. Earlier this month, onAugust 12, several mediaoutlets reported that the

Gujarat government’sDepartment of Social Justice andEmpowerment withdrew fourlakh copies of a Gujarati text-book meant for students of class-es VI to VIII, titled RashtriyaMahapurush Bharat Ratna Dr. B.R. Ambedkar. The book,authored by Dalit scholar P.A.Parmar and published by SuryaPrakashan, Ahmedabad, wasselected and assigned by thesame government department tomark the 125th anniversary ofDr. Ambedkar (1891-1956),starting from his birthday onApril 14, 2015 and continuingfor one year.

According to a statementgiven to members of the press byK.D. Kapadia, the Director ofScheduled Caste Welfare, “Thepublisher added some things inthe book that were seen as send-ing a wrong message to theimpressionable mind of primaryschool students… Some matterspertaining to religious conver-sion that are there in the 22 vowsof Dr. Ambedkar were added bythe publisher, which were seenas going against the message ofnational integration.Government’s action will be inthe interest of the public.”

The withdrawal of this book— which had been printed inhuge numbers and had arrived atvarious district headquarters forfurther distribution — raises theobvious issue of the necessityand propriety of book bans in ademocratic culture. It alsoreminds us of the unwarrantedinterference by government bod-ies that are, strictly speaking, notmeant to be dealing with educa-tion policy or implementation, inmatters of syllabus creation,textbook content and socio-political “messaging” that tar-

gets young students, to use Mr.Kapadia’s language.

Conflict over textbooks

The banning of books and thecontinuous conflict over schooland college textbooks are prob-lems that have come up repeat-edly in Indian public life, acrossStates, and political parties, fromthe Left through the Centre tothe Right. These actions are not“in the interest of the public”,although they are invariablysought to be justified on thesegrounds.

More worrying in this case isthe stated reason for the with-drawal of the book. Dr.Ambedkar announced his deci-sion to convert to Buddhism,took a formal diksha fromBuddhist monks and, in turn, ledthe conversion of close to half amillion people on October 14,1956, in Nagpur.

He called the faith Navayanaor the New Way, a protestantBuddhism based on his reinter-pretation of classical Buddhism,his re-reading of its canonicaltexts, as well as his reorganisa-tion of its central doctrines,tenets, practices and institutions.In the last year of his life, hewrote a massive work titled TheBuddha and His Dhamma, tomake the teachings of theBuddha accessible to modernreaders. As part of the publicceremony of joining this newreligion, followers collectivelytook 22 vows, written byBabasaheb himself.

In the weeks following theNagpur initiation, and themonths following Dr.Ambedkar’s death on December6, 1956, close to four millionpeople, mostly Dalits, (predomi-nantly Mahars fromMaharashtra), adopted this faith.

The purpose of AmbedkariteBuddhism is to liberate Dalitsfrom untouchability and otherforms of social exclusion andhumiliation, all of which flowfrom the low status assigned tothem in the orthodox Hinducaste system. Dr. Ambedkar’svows are meant to both inductconverts into a genuinely egali-tarian society and enable them toleave behind modes of living,thinking and believing that werehierarchical, violent and humili-ating.

It is clear that the vows servethe dual purpose of discardingthe old and adopting the new.They help Neo-Buddhists rejectthe Hindu way of life that hadoppressed them for centuries,and, at the same time, asserttheir adherence to an emancipa-tory creed.

Dr. Ambedkar’s Buddhismwas as much an indictment ofHindu varna dharma as it was amodern statement of equality,intended to deepen the vision ofthe Constitution while alsorecalling the original critique ofthe Buddha against Vedic ortho-doxy. When the laws and prom-ises contained in the liberalstatute books proved inadequate,he tried to place vulnerable com-munities on an equal footing byendowing them with a positiveidentity and a separate pro-gramme of action.

Left to himself, Dr. Ambedkarmight have preferred a “civicreligion”. For him, Buddhismsupplemented the new republic’sguarantees of equal citizenship,universal adult franchise, funda-mental rights, reservations, free-dom of religion and a secularstate that he had struggled toestablish. But the main difficul-ties of Dalits stemmed from thevery structure of Hindu society,which did not change muchdespite Independence and the

Constitution. As he said in aspeech to the ConstituentAssembly, the political revolu-tion was not accompanied by asocial revolution. He also recog-nised that ordinary people inIndia, across castes and commu-nities, drew strength from tradi-tional religious faiths of variouskinds. Babasaheb hoped that theNavayana would have the two-pronged effect of addressingboth the problem of inequalityand the desire for a religion —one that generated self-respectand a distinct identity — amonghis followers.

Distinct purposeIn arranging the vows in a par-

ticular order, Dr. Ambedkarseems to have wanted to firstclear the ground, ensuring thatample distance is createdbetween the Hindu faith (andalong with it, the outcaste status)that the seeker was born into andthe new Dhamma that is going tobe embraced. The condemnationof Hinduism is unequivocal, andtakes precedence over the utter-ance of Buddhist vows.

The break amounts to a“rebirth”, as is stated in nouncertain terms in the penulti-mate vow (Vow 21: “I believethat I am having a re-birth”). TheGujarat government official’swords call this “going againstthe message of national integra-tion”, but obviously, it’s therather more forceful refusal ofthe Ambedkarite Buddhist toremain integrated within theHindu fold that has caused thediscomfort and led to a with-drawal of the textbook in ques-tion.

The government in Gujaratand the Centre want to appropri-ate the legacies of modern his-torical figures like Sardar Pateland Dr. Ambedkar even thoughthis makes little ideologicalsense, given the values these

stalwarts espoused and their lackof congruence with Hindutvapolitics. The BJP also has cyni-cal designs on Dr. Ambedkarwith the aim of capturing a shareof Dalit votes. The government-sponsored celebration of his125th anniversary — but theinability to actually stomach hiscritical views on the caste sys-tem or on Hindu deities, ritualsand beliefs — is an excellentillustration of the hollowness ofthe Hindu Right’s claims tospeak in favour of Dalit rights,national integration or the publicinterest.

Mr. Parmar, the book’s author,went on to tell journalists that hewould rather that the textbookhave a few blank pages or con-tain more photographs of Dr.Ambedkar, than that the publish-er, one Dharmesh Kothari,include the vows of his ownaccord, without consulting withhim. Withdrawing the bookseems like a defensive ploy onthe part of an implicitly Hindu— and Hindu majoritarian —government to shield what Mr.Kapadia called “the impression-able mind” of the student readerjust as it is about to encounterthe radical force and fiercelyanti-assimilationist tendency ofthe Navayana doctrine.

This is unacceptable. Studentsin Gujarat and elsewhere mustbe allowed to learn howBabasaheb sought to make a bet-ter, more equitable India. If toachieve this goal, he had toattack the worst aspects of socie-ty, religion and politics, whether“Hindu” or Indian, so be it. Ouryoung, the future citizens of thiscountry, have to be made awareof the courage it took Dr.Ambedkar to seek to annihilatecaste.

Questions of timing and context

Owning Ambedkar sans his views

After much initial confu-sion, it is now clear thatthe Muivah-Ravi agree-

ment or the Peace Accord ofAugust 3, on the Naga issue, isnot a “historic accord” as wasoriginally claimed by PrimeMinister Narendra Modi andhis colleagues. The UnionMinister of State for HomeAffairs, Kiren Rijiju, and theNagaland Chief Minister, T.R.Zeliang, have now both clari-fied that it was only a “frame-work agreement”, which meansthat it is an agreement to pavethe way for a final settlementby laying out the framework onwhich it will be worked out.

So why the drumbeating thatis becoming a signature tune ofthe government? Why the rushto the media to proclaim some-thing that has not happened?Why call an agreement “his-toric” when the final agreementis yet to be signed? Why makethe claim of there being “signif-icant casualties” in a raid ‘deepinside Myanmar’ when Indianpara-commandos only hit tworebel bases, one of them aban-doned, and then killed only afew rebels? Jumping the gun isbecoming a dangerous habit,something better avoided, espe-cially on sensitive issues likethe Naga problem.

The Naga journalist, BanoHaralu, has quipped that if 18years has only led to a “frame-work agreement”, it left onewondering how much longerthe Nagas and India wouldhave to wait for a final settle-ment. Her poser: Is it “historic”because this accord has takenthe longest to work out? Surelywe will need to wait a whilebecause contentious issues stilldog the agreement to settleIndia’s longest running ethnicinsurrection. The haze has notyet lifted over many of the con-tentious issues involved.

Sovereignty and federalism

While Mr. Rijiju told TheHindu recently that theNational Socialist Council ofNagalim (Isak-Muivah) orNSCN(I-M) has given up on“Naga sovereignty”, theNSCN’s Thuingaleng Muivahsaid the opposite on August 14,at the 69th Naga IndependenceDay in his Hebron headquartersnear Dimapur town inNagaland. The Naga rebelchieftain clarified thatthe NSCN hadnever given upon Naga sover-eignty. But heclarified thatthe Indo-Naga finals e t t l emen twill be basedon the conceptof “shared sov-ereignty” becauseif India recognises the“unique history of theNagas”, the Nagas shouldrecognise India’s problems andlimitations. That spirit of give-and-take is most welcome butshould not be misconstrued as acompulsion instead of a choice.

“Shared sovereignty” is not abad idea because it can takeIndian federalism forward tonew heights. The Naga settle-ment can provide a new bench-mark to fulfil autonomist aspi-rations elsewhere in theRepublic and actually strength-en the bonds that hold this hugecountry together, because“shared sovereignty” within theIndian constitutional frame-work is an acceptance of themultiplicity of the Indian iden-tity as a historical fact. In thissubcontinent that straddles thecrossroads of Asia, there aremany with unique social identi-tites and who have a uniquehistory and a distinct way oflife despite an acceptance of

trans-regional religions and anover-arching post-colonial statethat many feel is rooted in anancient civilisation. Yet, thereare others who feel that it grewout of the British colonial expe-rience that produced a uniquenationalism that was federal inaspiration but unitary in termsof the state structure. A uniquefederalist solution wouldm e a n

g r e a t e rautonomy andmore powers to the Naga state(and to other Indian States aswell in future), whatever itsfinal territorial shape is. But,Mr. Muivah’s insistence thatthey have not given up onNagalim does complicate thescenario.

Regional reactions

The Assam Chief Minister,Tarun Gogoi, and the ManipurChief Minister, Okram IbobiSingh, have already issuedwarnings that they will opposeany final agreement on theNaga issue that has adverseimpacts on the interests of theirrespective States. While therehas been a war of wordsbetween the Bharatiya JanataParty and the Congress over theCongress Chief Ministers being

provoked, the truth is neitherMr. Gogoi nor Mr. Ibobi Singhcan accept an accord that willmake Nagalim a reality througha territorial reorganisation. So,the Indian government’s inter-locutor R.N. Ravi and Mr.Muivah will have to work hardto find a “non-territorial solu-tion” to meet Naga aspirations

of unity and one that does notupset neighbouring Assam andManipur. The “supra-statemodel” that Mr. Ravi’s prede-cessor, R.S. Pandey, worked onto provide cultural integrationfor the Nagas may find its wayinto a final settlement because aterritorial solution will be diffi-cult to sell to stakeholders.

The secrecy surrounding theAugust 3 accord is understand-able because the claims about itdo not clearly match what wasachieved. So, unlike all the pre-vious accords the Indian gov-ernment signed — like inPunjab, Assam, Mizoram and,finally, Tripura, between 1985and 1988 — the August 3accord was kept under wraps.The signing of the previous

accords, many of which I havepersonally covered as a fieldjournalist, were immediatelyfollowed by the text beingreleased to the media and intothe public domain. Secrecyonly triggers speculation andmakes no sense in a democracylike India, where even a“framework agreement” shouldbe subjected to some public

debate.

send a group of Nagaelders and lawmakers toMyanmar to speak to theMyanmar Naga rebel leaderS.S. Khaplang and get him toaccept the agreement. This wasa smart move by the Modiadministration — instead ofoutlawing the Khaplang groupof NSCN as was initially pro-posed. But Mr. Khaplangrefused to meet them andinstead deputed his militarywing chief, Niki Sumi, to speakto the visiting delegation. Thatupset the Modi administration.Now, India has asked Myanmarto hand over Mr. Khaplang andthree of his commanders,including Mr. Sumi, to India fortheir involvement in theambushes that killed more thantwo dozen Indian soldiers. InMarch this year, the Khaplangfaction broke the ceasefire with

India and is suspected to bebehind a series of violentattacks in Mizoram andArunachal Pradesh where per-sonnel of the 6 Dogra Regimentwere killed in an attack on anArmy convoy.

The Myanmar angle

Myanmar, clearly upset withthe mindless chest-thumpingafter the Indian para-comman-do raids, was trying to helpIndia in facilitating a dialoguewith Mr. Khaplang. Myanmar

has some stake in India’squest in finding its own

Naga solution because itexpects the impact ofthat to rub off on theNaga areas inMyanmar which theThein Sein govern-ment in Myanmar is

trying to control afteryears of failure. That is

something New Delhi wastrying to leverage. But now,

New Delhi’s move to have Mr.Khaplang and his commandershanded over to stand trial inIndia makes it difficult forMyanmar. The Thein Sein gov-ernment signed a ceasefire withMr. Khaplang’s group in 2012and it will find it difficult torenege on that unilaterally.Myanmar is facing enoughtrouble with the Kachins andthe Kokangs and would not liketo open up a fresh theatre ofoperations ahead of theParliament elections inNovember. These are the coun-try’s first general electionssince a nominally civilian gov-ernment was introduced in2011, ending nearly 50 years ofmilitary rule. Sources in theMyanmar government say itwould be best if India can bringMr. Khaplang back into the dia-logue process but that will notbe easy partly because he isupset with India signing thedeal with Mr. Muivah whichgives his bête noire a position

of primacy in the Naga move-ment. Defiant India-baiters likethe chief of the military wing ofthe United Liberation Front ofAssam, Paresh Barua, have alsobeen pushing Mr. Khaplang tokeep on the road to confronta-tion.

The trans-national and trans-border nature of the Naga prob-lem has not only helped fuelNaga insurgency for sixdecades but also complicatedthe issue, making it difficult fora final settlement to beachieved. The Modi adminis-tration must refrain from temp-tations to claim success for aproblem that has defied solu-tion for six decades — surelynot until a final settlement isworked out and implemented.Clarity of thought and brevityof expression are needed towork out a solution to India’slongest running ethnic insur-rection. Rhetoric is best avoid-ed even if that promises someimmediate political mileage.The human rights activist andlawyer Nandita Haksar, whohas intimate knowledge of theIndia-Naga negotiations, isright in saying that the realchallenge to a Naga settlementlies in its implementation —not the least because the Nagasare a divided people, onaccount of the tribal nature ofthe society, and also becausethe Indian state has playeddivide-and-rule to contain theonce powerful insurgency. So,the big push that the Modiadministration has given tosolve this problem is welcomebecause it gives a sense ofurgency to a dialogue that hasgone on for too long. But histeam must learn to hold fire andnot cross bridges before com-ing to them.

‘Historic’ is still some way away

Numbers lend themselves to words in myriad, com-plex ways. Data on population by religious com-munities in a country of India’s size and diversity

can be especially sensitive, with deep, long-term implica-tions for communal harmony and political stability. Goingby experience, population figures in terms of just religiousaffiliation will only serve as fodder for political groupspursuing conservative and majoritarian agendas. Withoutany correlation to other demographic features such asincome, education, occupation and mortality rates, tomerely present the rates of growth in the population ofspecific religious communities as stand-alone facts makesno sense at all. For a government to authorise the releaseof such potentially polarising data almost randomly, with-out taking any institutional responsibility, is highly ques-tionable. The Registrar General of India, who reports tothe Union Home Ministry, was given the clearance by thePrime Minister’s Office, but not enough thought appearsto have gone into the issues that might crop up consequentto the release of such data. The release came unannounced,almost as a matter of routine. Neither the Home Ministrynor the PMO took responsibility: there was no mediabriefing by any minister or official, just the release of rawdata without providing context. The inescapable conclu-sion is that the government was not worried about the sen-sitive nature of the data, and about their potentially divi-sive effects in the absence of explanatory addenda. All col-lections of data are value-neutral, but the manner of theirrelease and potential for use and misuse are not. Of course,even in 2004, when the Congress-led United ProgressiveAlliance government allowed the release of the data onpopulation by religious communities, the situation was notvery different. The then Census Commissioner, J.K.Banthia, defended the release of demographic characteris-tics based on religious composition as being in the publicinterest and resulting ultimately in public good. Thoughthe collection of data on religion has always been part ofthe census exercise, 2004 was the first time such data werereleased as a separate report. What is intriguing is that themanner of the release of the 2011 data is in sharp contrastto the care being taken in the release of the caste census ofgroups other than the Scheduled Castes and Tribes. If therelease of such data is to serve any purpose, that should beto better direct policy initiatives to target socio-economicbackwardness of specific groups. That the release wastimed close to the Bihar Assembly election injects anunnecessary political taint. But what is most disconcertingis that the government did not step forward to take institu-tional responsibility, or to provide an explanation of whyit was necessary to release such inherently polarising datawithout clear context. Governments are meant to upholdpeace among communities; law and order is their primaryresponsibility. It is therefore important that when sensitivedata of this kind are released, they take citizens into confi-dence on the context of such data.

Myanmar, clearly upset with themindless chest-thumping after the Indian para-

commando raids, was trying to help India in facilitating adialogue with Mr. Khaplang. Myanmar has some stake in

India’s quest in finding its own Naga solution because it expectsthe impact of that to rub off on the Naga areas in Myanmarwhich the Thein Sein government in Myanmar is trying to

control after years of failure. That is something NewDelhi was trying to leverage.

Sheena Bora ...into the car when she refused to get in, on

spotting Sanjeev Khanna, Indrani's ex-hus-band, in the rear seat.

Sheena was allegedly strangled on the high-way by Indrani, as Sanjeev Khanna andIndrani's driver Shyam Rai held her arms andlegs.

Overnight, the body was in the car insidethe garage of Peter Mukerjea's Mumbaihome. The next day, the body was taken inthe same car to Raigad, 84 km from Mumbai,where Sheena's burnt body was found on 23May.

Rahul Mukerjea has told the police thatwhen he called Sheena on April 25, hermobile was switched off. Two days later, hewent to the police to file a missing complaint.Sources say the police called Indrani, whotold them that Sheena had gone to the USbecause Rahul was stalking her.

Rahul has also told the police that the dayafter he tried to file the complaint, hereceived a text from Sheena's mobile phone,which said she wanted a break-up. He calledback but there was no response. He saysIndrani told him to stop chasing Sheena.

On an anonymous informer's tip-off, thepolice had been quietly investigating Indranifor four months but hit pay dirt only afterarresting her driver in an arms case.

"During his interrogation, he confessed tomurder. He took us to the spot where the bodywas dumped," said Mr Maria, who interrogat-ed Indrani Mukerjea.

Until Indrani Mukerjea's arrest on Tuesday,most of their friends and relatives thoughtSheena was her sister.

Indrani Mukerjea...put him in touch with Sheena, heaping new

tension onto a relationship with the wobbliestof foundations.

"She told me directly on my mouth that'stop irritating me, I've told you again andagain she is in the US, she wants to get settledthere. Then she will come back. And for thatI cannot give you any contact of her'" he wasreportedly told.

Neither of the Bora children were allowedto refer to Indrani Mukerjea as their mother.After they were born, Ms Mukerjea entrustedthem to her parents who live in Guwahati.She married a second time, and then a third,always referring to her offspring as heryounger brother and sister.

The cover was blown earlier this week,when Ms Mukerjea was arrested in Mumbaion charges of murdering Ms Bora in April2012. The police claims she has confessed tothe killing. Mr Bora says he has no doubt that"I am the next target" and that his mother isguilty. "If the police will come today, I willgive the evidence to the police right away.100%. Because she was my elder sister. Iwant justice for my sister," he said before hewas interrogated by the Mumbai Police inGuwahati, where he still lives with MsMukerjea's parents in a big house in a richneighbourhood. Ms Mukerjea, he toldreporters, had warned him last year that if hedid not stop seeking information on Ms Bora,she would stop sending money to his grand-parents and him.

Indrani Mukerjea's Ex Was...Mukerjea. The lawyer says Ms Mukerjea

did not permit that meeting and that MrKhanna is innocent of any wrongdoing.

Mr Khanna was Ms Mukerjea's second hus-band. Her daughter from an earlier relation-ship, Sheena Bora, was strangled and set onfire on the outskirts of Mumbai three yearsago, the police has said, by Ms Mukerjee, herdriver and Mr Khanna.

All her life, Ms Mukerjea presented MsBora as her sister. The murder has exposedthat the young woman was actually herdaughter, a relationship that Ms Mukerjea'shusband, Peter Mukerjea, says he wasunaware of.

After Ms Bora disappeared, her mother saidshe had moved to the US to study. The policelast week arrested Ms Mukerjea's driver inconnection with another criminal case.During interrogation, he allegedly confessedto killing Ms Bora on the order of MsMukerjea.

Earlier this month, Naveed was caught byvillagers after he attacked a paramilitary con-voy in Udhampur.

Naveed, who was in the Kashmir Valley fornearly two months before the attack, hasrevealed crucial details to investigators,including that he was trained in camps run bythe terror group Lashkar-e-Taiba in Pakistan.

India had planned to raise recent terrorattacks - in Udhampur and Punjab'sGurdaspur - and the revelations of Naveed ina meeting with Pakistan's National SecurityAdvisers scheduled for Monday; the meetingwas canceled at the eleventh hour amid sharpdisagreements. Islamabad has disownedNaveed, who had said just after his capturethat he belonged to Faisalabad in Pakistan.

Pak Terrorist...He is part of a group of five terrorists who

were intercepted yesterday close to the Line ofControl in north Kashmir. Four of them werekilled in the encounter in the higher reaches ofPanzala in Baramulla district and Sajjad wascaptured.

Sources said the terrorists were interceptedon a tip-off from Mohammad Naveed, thePakistani terrorist captured earlier this monthafter an attack on a Border Security Force con-voy in Udhampur, Jammu.

Naveed was captured by a group of villagerswho he had tried to take hostage after attack-ing the BSF convoy.

He had told interrogators that he was trainedby the LAshkar e Taiba in Pakistan and thensent across the border to launch terror attackson security forces in India.

The Jammu and Kashmir police have bustedseveral groups of terrorists based on informa-tion from Naveed, who was in India for abouttwo months before he was captured.

cess of its GSLV Mk II rocket to gain the con-fidence of satellite owners.

ISRO will also be launching four nano-satellites from US as a piggy back luggagefor its Astrosat to be launched next monthusing its another rocket polar satellite launchvehicle (PSLV).

ISRO successfully launched its communi-cation satellite GSAT-6 using its GSLV Mk IIrocket today.

"The launch proves that the successfullaunch of communication satellite GSAT-14last January was not a flash in the pan," saidMr Kumar.

ISRO officials told IANS that around 10satellites have been identified for launchusing GSLV-Mk II.

Queried about the status of testing areusable launch vehicle, Mr Kumar said theplan is to test fly a scaled down model (1/6thsize of real size model) later this year.

Prakash Javadekar...government's endeavour is to simplify the

administrative procedures without compro-mising on environmental safeguards.

"The module will end delays in the depositof compensatory levies. Technology must beused to the advantage of all and the govern-ment's endeavour has been to simplify admin-istrative procedures, without compromisingon environmental safeguards," the Ministersaid. The payment through the module has tobe made to the designated account dependingon the state in which the forest land which isproposed to be diverted is located.

The deposit of compensatory leviesthrough the e-portal will be optional tillAugust 31 this year. However, the payment ofthese levies by user agencies will be acceptedonly through the e-module route fromSeptember 1, 2015, an official statement said.

With the activation of the e-payment portal,no payments will be accepted other thanthrough the portal unless specifically orderedby ad-hoc Compensatory Afforestation FundManagement and Planning Authority(CAMPA).

CAMPA had been created by the SupremeCourt. Before Stage II under Forest(Conservation) Act, 1980, which is the finalapproval stage, ad-hoc CAMPA is firstrequired to certify whether the compensatorylevies have been credited to the respectiveaccounts. "Till now, the verification of receiptof compensatory levies in the ad-hocCAMPA has been done manually involvingvarious steps and is a time-taking process.The launch of e-payment module will endsuch delays," the statement said.

"The prosecution has come too early to thecourt seeking cancellation of anticipatorybail. They (crime branch) are having sleep-less nights. They should sleep well andcome," the defence lawyer said during thearguments.
