    the introduction of additional non-compatible land uses;

    c. Program measures would not createan undue burden on interstate or foreigncommerce, unjustly discriminate againsttypes or classes of aeronautical uses,violate the terms of airport grantagreements, or intrude into areaspreempted by the Federal Government;

    andd. Program measures relating to the

    use of flight procedures can beimplemented within the period covered

    by the program without derogatingsafety, adversely affecting the efficientuse and management of the navigableairspace and air traffic control systems,or adversely affecting other powers andresponsibilities of the Administratorprescribed by law.

    Specific limitations with respect toFAAs approval of an airport noisecompatibility program are delineated inFAR Part 150, section 150.5. Approvalis not a determination concerning theacceptability of land uses under Federal,State, or local law. Approval does not byitself constitute an FAA implementingaction. A request for Federal acton orapproval to implement specific noisecompatibility measures may berequired, and an FAA decision on therequest may require an environmentalassessment of the proposed action.Approval does not constitute acommitment by the FAA to financiallyassist in the implementation of theprogram nor a determination that allmeasures covered by the program areeligible for grant-in-aid funding from the

    FAA. Where federal funding is sought,requests for project grants must besubmitted to the FAA Detroit AirportsDistrict Office in Romulus, Michigan.

    Columbus Regional Airport Authoritysubmitted to the FAA on December 21,2006 the noise exposure maps,descriptions, and other documentationproduced during the noise compatibilityplanning study conducted from 2005through 2006. The RickenbackerInternational Airport noise exposuremaps were determined by FAA to be incompliance with applicablerequirements on January 25, 2007.

    Notice of this determination waspublished in the Federal Register onFebruary 6, 2007 (FR Doc. 07507 Filed2507; 8:45 am).

    The Rickenbacker InternationalAirport study contains a proposed noisecompatibility program comprised ofactions designed for phasedimplementation by airport managementand adjacent jurisdictions starting in2007. It was requested that the FAAevaluate and approve this material as anoise compatibility program asdescribed in section 47504 of the Act.

    The FAA began its review of theprogram on January 25, 2007 and wasrequired by a provision of the Act toapprove or disapprove the programwithin 180 days (other than the use ofnew or modified flight procedures fornoise control). Failure to approve ordisapprove such program within the180-day period shall be deemed to be an

    approval of such program.The submitted program contained

    thirteen (13) proposed actions for noisemitigation on and/or off the airport. TheFAA completed its review anddetermined that the procedural andsubstantive requirements of the Act andFAR Part 150 have been satisfied. Theoverall program, therefore, wasapproved by the FAA effective July 9,2007.

    Outright approval was granted for allof the specific program elements. Theseelements were: Straight out departuresof itinerant aircraft from Runway 23L/Runtil reaching 3,000 feet mean sea level

    before turning on course; Formalizecivil noise abatement procedures whichinclude: right turns to a 070-degreeheading after departing to the northeast;and observing a preferential reverseflow runway use for civil jet aircraft;Formalize military noise abatementprocedures, which include: right turnsto a 070-degree heading after departingto the northeast; preferential southwestflow for touch-and-go operations; andobserving preferential reverse flow use;Develop an Airport Land UseManagement District (ALUMD) based onthe most recent Future 60 Day-Night

    Average Sound Level (DNL) NoiseExposure Map/Noise CompatibilityProgram (NEM/NCP) noise contour,natural geographic and jurisdictional

    boundaries; Implement land usecontrols to discourage residentialdevelopment and encourage airportcompatible development within theALUMD; Offer acquisition to eligibleundeveloped properties within the 65-DNL noise contour of the Future (2011)NEM/NCP; For those undevelopedproperties that are offered but unwillingto be acquired through LU20, offeravigation easements to restrict the

    development of incompatible land useswithin the 65-DNL noise contour of theFuture (2011) NEM/NCP: Seekcooperation from the Board of Realtorsto participate in a voluntary fairdisclosure program for the propertylocated within the ALUMD; Establish aNoise Abatement Committee; Establish/continue a noise complaint responseprogram; Periodic review and update ofthe NEM and NCP; Develop a publicinformation program to communicateinformation about the NCP; and Providefor updates/enhancement of the CRAA

    Airport Noise & Flight Track MonitoringSystem.

    These determinations are set forth indetail in a Record of Approval signed bythe Great Lakes Region AirportsDivision Manager on July 9, 2007. TheRecord of Approval, as well as otherevaluation materials and the documentscomprising the submittal, are available

    SUMMARY: Section 1114 of the Safe,Accountable, Flexible, EfficientTransportation Equity Act: A Legacy forUsers (SAFETEALU) (Pub. L. 10959;119 Stat. 1144) continued the highway

    bridge program to enable States toimprove the condition of their highway

    bridges over waterways, othertopographical barriers, other highways,and railroads. Section 1114(f) amends23 U.S.C. 144 by adding subsection (r),requiring the Secretary ofTransportation (Secretary) to publish inthe Federal Register a report describingconstruction materials used in new

    Federal-aid bridge construction andbridge rehabilitation projects.

The FHWAsFinancial Management InformationSystem (FMIS) and the 2006 NBI wereused to identify the material types for

    bridges that were rehabilitated withinthe defined time period. Currently

    preventative maintenance projects areincluded in the rehabilitation totals.The report, which is available at

    The tables provide data for 2 years:2004 and 2005. The 2004 data isconsidered complete for new andrehabilitated bridges, with a minimallikelihood of upward changes in thetotals. The 2005 data is consideredpartially complete for new bridges andcomplete for rehabilitated bridges,

    because many new bridges built in 2005will not appear in the NBI until they areplaced into service the following year.

    Therefore, next year

    s report willinclude 2005s data on new bridgeconstruction, because the data will becomplete.

    Each table displays simple counts ofbridges and total bridge deck area. Totalbridge deck area is measured in squaremeters, by multiplying the bridge length

    by the deck width out-to-out. The datais categorized by the following materialtypes, which are identified in the NBI:Steel, concrete, pre-stressed concreteand other. The category Otherincludes wood, timber, masonry,

    aluminum, wrought iron, cast iron andother. Material type is the predominatetype for the main span(s).
