    2. All operations shall conform to the Code of Federal Regulations, 43 CFR 3160, Bureau ofLand Management Onshore Orders and the Nevada Division of Minerals Oil and Gas chapter 522 Oil and Gas General Provisions.

    3. A complete copy of the approved APD must be at the drill site during the construction of the roads and drill pad, the drilling of the well, and the completion of the well.

    4. The spud date will be reported orally to the Authorized Officer 24 HOURS PRIOR TO SPUDDING, unless otherwise required in site specific conditions of approval.

    5. Verbal notification shall be given to the Authorized Officer at least 24 hours in advance offormation tests, BOP tests, running and cementing casing (other than conductor casing), and drilling over lease expiration dates.

    6. A progress report needs to be filed a minimum ofonce a week starting with the week the well was spud and continuing until the well is completed. This report may be by mail, fax or email. A complete set ofdaily drilling reports must be submitted upon completion of the well. The report will include the spud date, casing information such as size, grade, weight, hole size, and setting depth, amount and type of cement used, top of cement, depth of cementing tools, casing test method, intervals tested, perforated, acidized, fractured and results obtained and the dates all work done.

    7. Deviation from the approved APD must receive prior approval. If you want to change your operations in any way, you must first receive approval from the BLM and from the NDOM.

    8. Any information you desire to be held confidential must be clearly marked "CONFIDENTIAL "on each page.

    9. All survey monuments found within the area of operations shall be protected. Survey monuments include, but are not limited to: General Land Office and Bureau of Land Management Cadastral Survey Comers, reference comers, witness points, U. S. Coast and Geodetic benchmarks and triangulation stations, military control monuments, and recognizable civil (both public and private) survey monuments. In the event ofobliteration or disturbance of any

    3. PRESSURE CONTROL EQUIPMENT: (SCHEMATIC ATTACHED)

    Plains Exploration and Production Company's minimum specifications for pressure control equipment are as follows:

    Ram Type: Hydraulic double w/annular - 5000 psi w.p.

    Ram type preventers and associated equipment shall be tested to 3000 psi. Pressure shall be maintained for at least 10 minutes or until requirements of test are met, whichever is longer. If a test plug is utilized no bleed-off pressure is acceptable. For a test not utilizing a test plug, if a decline in pressure of more than 10 percent in 30 minutes occurs, the test shall be considered to have failed. Valve on casing head below test plug shall be open during test of BOP stack.

    Annular type preventers (3000 psi) shall be tested to 50 percent of rated working pressure (1500 psi). Pressure shall be maintained at least 10 minutes or until provisions of test are met, whichever is longer.

    As a minimum, the above test shall be performed: a. when initially installed; b. whenever any seal subject to test pressure is broken c. following related repairs; and d. at 30-day intervals

    Valves shall be tested from working pressure side during BOPE tests with all down stream valves

    open.

    When testing the kill line valve(s) the check valve shall be held open or the ball removed.

    Annular preventers shall be functionally operated at least weekly.

    Pipe and blind rams shall be activated each trip. however, this function need not be perforrned more

    than once a day.

    A BOPE pit level drill shall be conducted weekly for each drilling crew.

    Pressure tests shall apply to all related well control equipment.

    All of the above described tests and/or drills shall be recorded in the drilling log.

    The choke manifold, BOP extension rods and hand wheels will be located outside the substructure. The hydraulic BOP closing unit will be located at least 100 feet from the well head, with the remote control unit on the rig floor. The casing head and BOP will be flanged 5,000 psi w.p. Kill line will be 2M Ld. with burst pressure rating of 5,000 psi. These items will be pressure tested concurrently with BOP's. The BOP will be tested when the stack is first installed on the well. It will also be tested at each casing shoe and at least every 30 days. BOP and choke manifold sizes will be in accordance with API-RP-53 as per the attached. See attached schematic of choke manifold.

    a. The size and rating of the BOP stack is shown on the attached diagram.

    b. A choke line and a kill line are to be properly installed. The kill line is not to be used as a fill-up line.

    c. The accumulator system shall have a pressure capacity to provide for repeated operation of hydraulic preventers.

    d. Drill string safety valve(s), to fit all drill string connections in use, are to be maintained on the rig floor while drilling operations are in progress.

    4. PROPOSED CASING AND CEMENTING PROGRAMS:

    a. The proposed casing and cementing program shall be conducted as approved to protect and/or isolate all usable water zones, potentially productive zones, lost circulation zones, abnormally pressured zones, and any prospectively valuable deposits of minerals. Any isolating medium other than cement shall receive approval prior to use. The casing setting depth shall be calculated to position the casing seat opposite a competent formation which will contain the maximum pressure to which it will be exposed during normal drilling operations. Determination of casing setting depth shall be based on all relevant factors, including; presence/absence of hydrocarbons; fracture gradients; usable water zones; formation pressures; lost circulation zones; other minerals; or other unusual characteristics. All indications of usable water shall be reported.

    b. Casing design shall assume formation pressure gradients of 0.44 to 0.5 psi per foot for exploratory wells (lacking better data).

    c. Casing design shall assume fracture gradients from 0.70 to 1.00 psi per foot for exploratory wells (lacking better data).

    d. Casing collars shall have aminimum clearance of 0.422 inches of all sides in the hole/casing annulus, with recognition that variances can be granted for justified exceptions.

    e. All waiting on cement times shall be adequate to achieve aminimum of 500 psi compressive strength at the casing shoe prior to drilling out.

    f. All casing except the conductor casing, shall be new casing that meets or exceeds API standards for new casing.

    g. The surface casing shall be cemented back to surface either during the primary cement job or by remedial cementing.

    h. All indications of usable water shall be reported to the authorized officer prior to running the next string of casing or before plugging orders are requested, whichever occurs first.

    i. Surface casing shall have centralizers run as follows: 1on the shoe joint, 1on the first collar from the bottom and 1on the second collar.

    j. Top plugs shall be used to reduce contamination of cement by displacement fluid. Abottom plug or other acceptable technique, such as a suitable preflush fluid, inner string cement method, etc. shall be utilized to help isolate the cement from contamination by the mud fluid being displaced ahead of the cement slu rry.

    k. All caSing strings below the conductor shall be pressure tested to 0.22 psi per foot of casing string length or 1500 psi, whichever is greater, but not to exceed 70 percent of the minimum internal yield. If pressure declines more than 10 percent in 30 minutes, corrective action shall betaken.

    I. On all exploratory wells, and on that portion of any well approved for a5M BOPE system or greater, apressure integrity test of each casing shoe shall be performed. Formation at the shoe shall be tested to a minimum of trle mud weight equivalent anticipated to control the formation pressure to the next casing depth or at total depth of the well. This test shall be performed before drilling more than 20 feet of new hole.

After cementing but before commencing any test, the casing string shall stand cemented until the cement has reached acompressive strength of at least 500 psi at the shoe, except that in no case shall test be initiated until the cement has been in place at least 12 hours.     b. Mud monitoring equipment to be used is as follows:

    1. Periodic checks will be made each tour of the mud system. The mud level will be checked visually.

    c. The concentration of hazardous substances in the reserve pit at the time of pit backfilling must not exceed the standards set forth in the Comprehensive Environmental Response, Compensation, and liability Act of 1980 (CERCLA).

    d. All oil and gas drilling related CERCLA hazardous wastes/substances removed from a location and not reused at another drilling location must be disposed of at an EPA approved hazardous waste facility.

    6. EVALUATION PROGRAM:

    The antiCipated type and amount of testing, logging and coring are as follows:

    a. Drtll stem tests will be run as needed. If drill stem tests are run, following will be adhered to:

    Initial opening of drill stem test tools shall be restricted to daylight hours unless specific approval to start during other hours is obtained from the authorized officer. However, DST's may be allowed to continue at night if the test was initiated during daylight hours and the rate of flow is stabilized and if adequate lighting is available (Le. lighting which is adequate for visibility and vapor-proof for safe operations). Packers can be released, buttripping shall not begin before daylight, unless prior approval is obtained from the authorized officer. Closed chamber DSTs may be accomplished day or night.

    ADST that flows to the surface with evidence of hydrocarbons shall be either reversed out of the testing strtng under controlled surface conditions, or displaced into the formation prior to pulling the test tool. This would involve provided some means for reverse circulation.

    Separation equipment required forthe anticipated recovery shall be properly installed before a test starts.

    All engines within 100 feet of the wellbore that are required to "run" during the test shalf have spark arresters or water cooled exhausts.

    Open hole completion with packer, tubin 9 and seating nipple(s}. Possible acid stimulation. In the event that water is encountered in the open hole interval, PXP may elect to run and cement a4-1/2" production liner that will require perforating.

    7. ABNORMAL TEMPERATURES OR PRESSURES:

    a. The maximum anticipated bottom hole pressure is estimated at approximately 6,000 psi (calculated at 0.5 psVfoot for 12,000' planned TO) resulting in a calculated maximum anticipated surface pressure {MASP} of approximately 3400 psi based upon a partially evacuated hole at TO with an average fluid gradient of 0.22 psilfoot. (4.23 ppg EMW)

    b. No hydrogen sulfide gas is anticipated during drilling, however the logging unit will have an H2S detector for monitoring purposes.

    8. ANTICIPATED STARTING DATES AND NOTIFICATION OF OPERATIONS:

    a. Drilling is anticipated to commence approximately April, 2007. Completion is anticipated to begin within 30 days of drilling rig release.

    b. It is anticipated that the drilling of this well will take approximately 30 days.

    c. The following shall be entered on the driller's log:

    1. Blowout preventer pressure tests, including test pressures and results;

    2. Blowout preventer tests for proper functioning;

    3. Blowout prevention drills conducted;

    4. Casing run, including size, grade, weight, and depth set;

    d. Section 102 (b) (3) of the Federal Oil and Gas Royalty Management Act of 1982, as implemented by the applicable provision of the operating regulations at Title 43 CFR 3162.41 @), requires that -not later than the 5th business day after any well begins production on which royalty is due anywhere on the lease site or allocated to a \ease site, or resumes production in the case of a well which has been off production for more than 90 days. the operator shall notify the authorized officer by letter or sundry notice, Forms 316(}S or orally to be followed by aletter or sundry notice, of the date on which such production has begun or resumed."

    The date on which production is commenced or resumed will be construed for oil wells as the date on which liquid hydrocarbons are first sold or shipped from a temporary storage facility, such as a test tank, and for which a run ticket IS required to be generated or, the date on which liquid hydrocarbons are first produced into apermanent storage facility. whichever first occurs; and, for gas sales as the date on which associated liquid hydrocarbons are first sold or shipped from a temporary storage facility, such as a test tank, and for which a run ticket is required to be generated or, the date on which gas is first measured through permanent metering facilties, whichever first occurs.

    " the operator fails to comply with this requirements in the manner and lime allowed, the operator shall be liable for a civil penalty of up to $10,000 per violation for each day such violation continues. not to exceed a maximum of 20 days. See Section 109 @) (3) of the Federal on and Gas Royalty Management Act of 1982 and the implementing regulations at Trtle 43 CFR 3163.4-1 (b) (5) (ii).

    The following standards apply to the abandonment of newly drilled dry or non-productive wells in accordance with 43 CFR 3162.3-4. Approval shall be obtained prior to the commencement of abandonment. All formations bearing usable-quality water, oil, gas, or geothermal resources, and/or a prospectively valuable deposit of minerals shall be protected. Approval may be given orally by the authorized officer before abandonment operations are initiated. This oral request and approval shall be followed by awritten notice of intent to abandon filed not later than the fifth busine 5S day following oral approval. Failure to obtain approval prior to commencement of abandonment operations shall result in immediate assessment under 43 CFR 3153.1 (b)(3). The hole shall be in static condition at the time any plugs are placed (this does not pertain to plugging lost circulation zones). Within 30 days of completion of abandonment, a subsequent report of abandonment shall be filed.

    The onsite inspection for the sub1ect well was conducted on Thursday, October 12, 2006 at approximately 8:30 a.m. Weather conditions were clear, cool and sunny. In attendance at the onsite inspection were the following individuals:

    1. EXISTING ROADS

    a. Directions to the location from Ely, Nevada are as follows:

    Proceed westerly on Highway 50 for 15.5 miles. Turn left onto an existing road and proceed westerly 0.3 miles. Tum right onto the proposed access road and proceed southerly for 0.3 miles to the proposed wellsite.

    b. For access roads, see Maps Aand B attached.

    c. All existing roads within a 1-mile radius are shown on Map B.

    d. Vehicles will travel only on deSignated travel ways shown on the map.

    e. Existing roads will be maintained and kept in good repair during all drilling and completion operations associated with this well.

    f. Ali proposed access roads are within the lease boundary and a road right of way will not be necessary.

    2. ACCESS ROADS TO BE CONSTRUCTED AND RECONSTRUCTED

    a. There will be approximately 0.3 miles of existing access road to be upgraded and 0.3 miles of new access to be constructed.

    b. The new access road will be constructed as a flat bladed road. Surfacing material will be placed along the new access to a depth of approximately 4 inches. The running surface of the road will be a minimum of 14 feet with a maximum disturbed width of 32 feet.

    c. Approximately 2or 3turnouts will be constructed along the proposed route to allow traffic to pass safely.

    d. Where the approach leaves Highway 50, it will be modified to meet NDOT standards. The approach will meet the highway at a 90 degree angle. For the protection of the Old Lincoln Highway (which parallels Highway 50 on the west side), the approach will be constructed by placing a minimum of 4" of fill material over the Old Highway road bed. This will prevent damage to the old road bed. In addition - approximately 6 inches of gravel will be placed on the fill material covering the Old Lincoln Highway. No topsoil will be removed from the old road bed.

    e. After the road crosses through the Highway fence line -the remainder of the road construction will include salvaging the top 12" of topSOil in a windrow along the edge of the road and immediately seeding it with the same interim seed mixture as used for the pad. Reclamation will be similar to that for the location pad: regarding, ripping the road surface, recovering with the salvaged topsoil, and final seeding.

    f. Gravel used for pad or access road construction may be placed only after the underlying topsoil has been salvaged. It may be removed prior to regrading and ripping or left to be incorporated in the reclamation procedures outlined above.

    g. Culverts, when deemed necessary by the location contractor, will be installed during construction.

    h. The existing gate in the Highway fence line will be replaced with acattle guard to meet NDOT standards. If requested by the BLM, agate will be constructed adjacent to the cattle guard.

    i. If production is established, the road to the tank battery site will be upgraded and graveled as necessary to provide for all weather use.

    j. Surface disturbance and vehicular travel will be limited to the approved location, tank battery site and approved access road. Any additional area needed will be approved in advance.

    3. LOCATION OF EXISTING WELLS WITHIN A l-MILE RADIUS OF THE PROPOSED LOCATION.

    a. Water Wells - none

    b. Injection or Disposal Wells -none

    c. Producing Wells - none

    d. Drilling Wells - none

    4. LOCATION OF EXISTING AND/OR PROPOSED FACILITIES IF THE WELL IS PRODUCTIVE.

    a. If production is established, aproduction facility layout will be submitted via Sundry Notice at that time. Anticipated production is not known at this time.

    b. All production facilities, including the pump, pump house, storage tanks, and treater will be painted an earthtone color to blend with the environment.

    c. All flowlines from the well site to battery site will be buried below frost line depth (approximately 48 inches).

    d. Adike will be constructed completely around trle production facilities (I.e. production tanks, water tanks, and/or heater-treater). The dikes for the production facilities will be constructed of compacted subsoil and hold the capacity of the largest tank.

    e. Produced hydrocarbons shall be put in test tanks on location during completion work.

    f. All site security guidelines identified in 43 CFR 3162.7 regulations will be adhered to.

    5. LOCATION AND TYPE OF WATER SUPPLY

    a. Produced water for drilling purposes will be obtained from awater well to be drilled on the well pad, at the south end of the reserve pit.

    b. All appropriate permits will be filed by the water well driller.

    c. The well will be turned over to the Bureau of land Management at the end of drilling operations for their continued use for wildlife and stock grazing purposes.

    d. A water well may be accepted by the Ely District upon completion of operations. Please submit the following information to the Ely District Office, Bureau of land Management, HC 33, Box 33500, Ely, NV 89301-9408:

    1. Profile 1Water Analysis 2. Type of inside diameter of casing used in well 3. Total depth of well 4. Depth of concrete seal 5. Depth of static water level 6. Water bearing formation or description of aquifer

    e. Operator requests that BlM allow operator to use water well for future well drilling, completion, or rework activities in the area.

    6. CONSTRUCTION MATERIALS

    a. If additional gravel is needed (other than that found in the access road or wellpad), then it will be purchased from apermitted BlM gravel pit or local private source.

    b. No construction materials will be removed from Federal lands unless previously authorized.

    c. All gravel pit permits will be filed with the BLM by the dirt contractor.

    7. METHODS FOR HANDLING WASTE DISPOSAL

    a. Drill cuttings are to be contained and buried in the reserve pit.

    b. The rnud tanks will be emptied into the reserve pit. The reserve pit and drilling fluids contained in the pit will be allowed to dry before backfilling, or pas will be siphoned out and dispOsed of in amanner approved by the authorized officer of the BLM before the reserve pit is backfilled. Pit walls will not be breeched so as to drain fluids to the surrounding surface.

    c. All wastes that accumulate during the drill ing operations will be contained in atrash cage or dumpster. Wastes will be removed periodically from the location and taken to an approved landfill.

    d. Immediately after removal of the drilling rig, all garbage (metal containers, etc.) and debris on the site will be removed from the site. The reserve pit will not be utilized for trash disposal.

    e. No burning of trash will be allowed.

    f. Chemical toilets with holding tanks will be utilized. All sewage will be disposed of in accordance with county and state regulations. The permittee will comply with all state laws and regulations pertaining to disposal of human waste.

    g. The produced fluids will be produced into a test tank until such time as construction of production facilities is completed. Any spills of oil, gas salt water or other produced fluids will be cleaned up and removed.

    8. ANCILLARY FACILITIES

    Atemporary camp may be located on site to house drilling and completion crews during operations. However, due to the close proximity to Ely, crews will be housed in local motels.

    9. WELLSITE LAYOUT

    a. Prior to any removal of topsoil along the access road or on the wellpad, snow will be removed and stockpiled adjacent to the road bed Dr well pad.

    b. Any large trees will be cut prior to construction. The remainder of the trees will be pushed off and stockpiled adjacent to the wellpad. These trees will be saved for use in final reclamation.

    c. The operator will be responsible for taking steps to mitigate the spread or increased densities of invasive weeds that result from implementation of the proposed action. The operator will implement the Ely Field Office Noxious Weed Prevention Schedule and SOPs for weed treatments, with special emphasis on the following actions. Prior to entering the site, all construction, drilling equipment, and vehicles will be washed down and cleaned to prevent the importation of noxious weed seeds from prior places of work. Vehicles will stay on roads and avoid driving through any weed patched. All seeds used in reclamation will be certified weed-free. The operator will assist in monitoring for noxious and invasive weeds during the life of the project, until reclamation is complete.

    d. The top 12" of topsoil, where available. from pad construction will be salvaged, stockpiled separately from any other material. The topsoil will be seeded immediately with the interim seed mix in order to stabilize the soil and help preventthe establishment of invasive and nonnative weeds. An additional interim seeding may be required.

    e. Cut slopes and fill slopes will be no steeper than 2:1.

    f. Cuts and fills and cross sections are also shown on the location layout.

    g. The location of the reserve pit, with respect to the pad and other facilities is shown on the location layout.

    h. A12 mil plastic liner will be installed in the reserve pit to prevent loss of drilling fluids through seepage.

    i. For the protection of livestock and wildlife, all pits containing toxic liquids will be fenced with 3-strands of barbed wire with one strand of smooth wire on the bottom. For the protection of migrating waterfowl, the pits will be flagged overhead during migration periods. Any oil on

    the surface of the pit will be burned off, or otherwise removed. In addition, white flagging will be tied on the top wire of the reserve pit fencing.

    10. RECLAMATION OF SURFACE

    a. The rathole and mousehole will be filled in immediately after the rig is removed.

    b. Interim seeding will be done as soon as possible on any topsoil piles or windrow piles. A seed mixture for interim reclamation will be provided by the BLM.

    b. Pad reclamation will consist of recontourin g, ripping, re-spreading the topsoil, and reseeding with the final seed mixture which should be planted between October 1 and March 15. Performance standards for revegetation success are that the reclaimed area will have at least 100% oft the perennial canopy cover of the existing adjacent plant cover. The site will be evaluated by the Ely BLM for vegetative progress after at least one full growing season. If not successful, the BLM reclamation specialist will review the reclamation procedures with the operator to decide on the best course of action to achieve success.

    c. The operator or his contractor will contact the Bureau of Land Management in Ely, Nevada (775) 289-1800, 48 hours prior to commence of site reclamation work and upon completion of restoration measures.

    d. All disturbed areas will be recontoured to conform as near as possible to the natural contour. This includes removing all berms and backfilling all cuts.

    e. All disturbed areas will be ripped in both directions (criss-cross) to break up the compacted soils. The stockpiled topsoil will be evenly spread over the disturbed area.

    f. The operator will be responsible for complete control of any noxious weeds that become established within the project area during the life of this project through final reclamation. This would include the responsibility for control of noxious weeds along the access roads, pad location, and any water and gravel sources.

    g. Noxious and invasive weeds, which may be introduced due to soil disturbance and reclamation, will be treated by methods to be approved by the authorized officer. These methods may include biological, mechanical, cultural or chemical. Should chemical methods be approved, the lessee must submit a Pesticide Use Proposal to the authorized officer 60

    days prior to the planned application date. All BLM and Ely Field Office SOPs for weed treatments will be complied with. Copies of al\ Pesticide Application Reports will be provided to the Ely Field Office Weed Coordinator and to the Nevada Department of Agriculture.

    h. ANotice of Intent to Abandon and a Subsequent Report of Abandonment will be submitted for abandonment approval. A Final Abandonment Notice must be submitted when the rehabilitation is complete and the new vegetation is established.

    i. If the well is plugged and abandoned, the surface casing will be cut off three (3) feet below reclaimed ground surface {with a metal plate affixed to the top. The metal plate will be inscribed with the operator's name, well number, well location (1/4 114, Section, TownShip, Range, etc.) aM federal lease number.

    j. If the water well on location is taken over by the BLM, then the access road will not be reclaimed and will be left in place for use by the grazing lessee.

    11. SURFACE OWNERSHIP

    12. OTHER INFORMATION

    a. AClass III archeological study has been conducted by Kautz Environmental. No significant cultural resources (eligible for the NRHP) were found during the field inspection and clearance for this project has been recommended. Acopy of this report will be submitted directly to the appropriate agencies by Kauthz Environmental..

    b. If sub-surface cultural materials are found during any work phase, the BLM must be notified immediately. Construction will cease until the resource has been properly investigated and mitigated.

    c. The BLM will be notified 48 hours in advance of any construction at the drilling or wellsite, unless otherwise authorized.
