For our last SIBA meeting of the year, I look forward to the opportunity of thanking the many people responsible for making this association what it is today. Even through a tough year with many roadblocks to maneuver, we remain a strong group that understands the importance of affordable housing for our community. Without our staff, officers, board of directors, associates, committee members and their leaders, and leaders-in-waiting (general membership) , we would be nothing but a bunch of people getting together once a month. We need to salute each other.

It is hard to believe that the year (from hell for many) is almost gone. We started with tremendous financial uncertainty from the stock market, and shortly thereafter came an ice storm that shut the area down. Days for some, weeks for others. Past history has not been useful in trying to forecast the future. Many outside forces have made it very difficult to run our businesses as we have in the past. I doubt there are many who will be sorry for this year to pass. But it will.

I would like to share an article that was sent to me that I found very timely for my business and my attitude. After several attempts to identity him/her, I’m still unable to credit the author. I recently had a person tell me about a home builder they knew. Said they didn’t care for the builder too much. “Everyone’s different”, I permitted, “nobody likes everybody.” I was hoping this was generalized enough to end it before things got ugly.

In a flash, they proceeded to tell me that the builder simply had “too much ego”.

A builder with too much ego? Is there such a thing?

Of course builders have ego. Almost all successful entrepreneurs do. It’s how they survive the rest of the population. Perhaps there used to be entrepreneurs without an inflated self-image. But if there were, the state of the economy has thinned them from the herd.

Following this pattern of thought, today’s home builders might be the only ones capable of surviving the hardships of the industry. And there are many hardships that come with this business. And the hardships keep coming – based on anything from product developments, to no-growth preferences.

I recall one attorney speaking to a group of builders. He commended them because in his opinion, residential construction crossed more parts of the law than any other industry. That’s one reason there seem to be so many regulations.

Another is that the end-user is rarely present at the time policies are determined. This means the builder, or land developer, is required to put up a fight for future residents. Typically, it’s one dude against a large group. The most wise lawmakers are ones who appreciate future residents, although silent, the same as boisterous remonstrators.

If one listens to no-growthers only, development has become unacceptable in any form. A larger portion of the community that benefits from the growth, is hardening against the growth – especially if it’s remotely near them. I hear so many forms of the same message - how bad new development is. Usually it’s cloaked in the form of traffic congestion, spot-zoning, or lack of need. And it usually comes from those are already causing congestion. Afterall, the new folks aren’t there yet. How can we blame them?

I don’t think I’ve ever heard a supporter of development speak in favor of the positive features it can bring – you know, jobs, tax base, jobs, improved safety, and jobs. Maybe everyone who sells supplies and services to new construction should attend the same meetings, and voice how important their job is these days. Just a thought.

Except there wouldn’t be near enough room or time to hear from all those who livelihoods depend on construction moving forward.

And in case you’re thinking, it doesn’t matter, think again. Maybe it does matter. And maybe it matters a whole lot.

From just two years earlier, new home starts have been reduced by 2/3. The work and business hasn’t been lost to a competitor. Not lost to another community with better tax abatement. Nor another country. This work is simply gone! Customers are uncomfortable, and choosing not to buy.

I wonder how many other industries would survive if their workload were cut to 1/3, meanwhile everyone’s margins are trying to outlast the buyer’s demands. I’m hearing more and more that “something-for-nothing” has grown into “something-BIG-for-nothing”.

Who can survive something like this? Only those with a certain kind of mentality. There are some people in the world who are immobilized when they facing a project of great proportion. When it’s time to build, they do nothing. Builders are the opposite. In the face of challenge and struggle, that’s when they go to work. Builders eat elephants, because they can do it – one bite at a time.

It’s a true asset for a community to

have professionals who have the vision to build homes, subdivisions, and community projects. If you asked a builder to take on a large project, they just want to know when they can start.

Is this ego? Confidence? Fortitude? Whatever its name, I think it comes from being forced to produce results. Builders, as they say, have to kill it and drag it home – they don’t eat. Doing this these days is truly a remarkable feat. When I hear someone take exception to this, I think back to Steve Martin’s famous cry, “Well, excuuuuuuuuuuuuse me!”

sEIsMIC REQUIREMENTs pAss, ARC-FAULT

DOEsN’TThe IRC Review Committee is in the

process of amending the 2009 IRC. The IRC Review Committee includes eight representatives from Building Officials, eight Home Builders, and eight voters from the general public.

The IRC Review Committee approves amendments, then sends them to the State Building Commission for approval.

At its most recent meeting, a package of amendments was approved, which will maintain the current standards for residential construction in southwestern Indiana. The package passed the committee 11 votes in favor, 11 votes against, and 1 abstention. In such a rare case, the Chairman of the committee casts the tie-breaking vote. Chairman Mike Christoffersen voted in favor of the amendment package.

Also, a proposal to require arc-fault circuit interrupters in entire house, or in bedrooms only, was defeated.

Never before had one group of volunteers gotten so much of the preparations for the thousands of dinners delivered to the needy on Thanksgiving Day done in one evening. There are two separate proposals being considered that would directly affect developers.

O n e p r o p o s a l w o u l d r e q u i r e developers of commercial development only with large parking lots to incorporate landscaped islands and/or space in exchange for a reduced number of parking spaces.

Another proposal is about street signs for all development. A policy as created about a year ago which requires the developer to provide street signs. In this existing policy, there are some points that need action to clarify procedures.

IN THE ‘NEW NORMAL,’ LOOK

AHEAD, NOT BACK, TO FIND

OppORTUNITIEsThe business landscape as we knew it

is gone and all of us have been affected at some level. Many industries are remaking themselves or disappearing entirely.

Some experts claim it’s not a recession we’re in but , rather, an economic “compression” — the painful process of reconciling an economy built on perceived value with its actual value.

As the economic upheavals continue, many people are wearing blinders, waiting for the storm to pass and life to return to normal. The reality is that they may have a very long wait. The “normal” of a year ago is not coming back. What we are experiencing is not merely another turn of the business cycle, but an entire restructuring of our economic order.

The landscape that emerges after this storm will be vastly different from anything we have experienced. But for those who see opportunity through the haze, the future is rich with new possibilities.Welcome to the “New Normal.”

To the astute observer, it’s becoming quite clear that the current downturn is fundamentally different from earlier recessions. In key sectors — manufacturing, financial services and retail — layoffs have accelerated so quickly as to suggest that many companies are not just “rightsizing,” but abandoning whole areas of business.

If we look back at America’s recessions, starting before the Civil War, we can see the boom-and bust cycle at work. Recessions have always been followed by periods of expansion and major change in our economic and industrial systems.

The sooner we recognize that this downturn is the precursor to another seismic shift in our economy and society, the quicker we can shift from a doom-and-gloom mindset to being excited about new growth and ready to embrace the next era of re-invention.

In many ways, managing through the loss of our current economic and industrial foundations is not unlike the classic five

stages of grief — denial and isolation, anger, bargaining, depression and finally, acceptance.

Hopefully, as most of us move beyond the first stages of denial and are closer to acceptance, our outlook will move toward the horizon and we will begin to visualize a New Normal.

Through our cumulative imagination, we will start to envision the industries, the positions and the new services that will emerge as part of our new economy and help to define the New Normal.

For those who are ahead of the curve, imagine what the opportunities could be in these real examples of the business landscape in a post-recession world:• Newspapers are vanishing almost before our eyes, replaced by digital delivery of news and information.• Retail will shrink, consolidate and morph from large-scale brick-and-mortar stores to a search-and buy economy.• Business travel will be hit hard and replaced by more efficient and less costly communications thanks to technology advances.• America may no longer be in the auto industry, if the industry survives in some form, there will be a graveyard of unneeded auto factories.

Many forward-facing leaders are already beginning discussions about what the new landscape will be. Some are saying “green” and “lean” will emerge as cornerstones. Others are theorizing on how massive events of late are fundamentally changing the psyche of the consumer, driving entire shifts in how industries position products and reach buyers. Still others are looking at the Internet and the disintermediation it is causing on entire industries — retail and news to name just two.

But what defines visionaries in uncertain times is a universal sense of optimism and a relentless search for opportunity:• They do not focus on the current problem, but on new solutions.• Their view is one of long-term growth, not short-term survivability.• They identify and exploit changing dynamics in the marketplace.• They see who is buying, what their priorities are, what needs they can satisfy now and where the buying loyalties lie.• They see downturns as an opportunity to “de-clutter,” re-evaluate and re-focus their strategy.

• Finally, they accept that “boom and bust” is a natural cycle and an opportunity to build capacity and resilience to face the next downturn. They use these down times to aggressively position, or reposition, themselves for the inevitable upturn.

Progress is painful when you focus on what’s changed.

If you’ve felt loss and frustration in this economic time, try to get to the acceptance stage and get excited about the New Normal.

2009 FALL TOUR DELIVERs TRAFFIC

Through the 2009 Fall Tour of Homes, builders renewed a friendship with an old acquaintance – traffic!

Thirteen SIBA builders entered 16 homes in the Fall Tour, which generated traffic statistics that we haven’t seen for quite some time. Recently builders reported anywhere between 0 - 6 groups during a Sunday open house. But some Fall Tour builders are gladly reporting as many as 22 groups of visitors each day – Saturday and Sunday.

On builder stated he was thrilled with the traffic, comparing it to the Parade of Homes. Okay – let’s not get carried away…

Homes were located from Newburgh and Warrick County, across to Evansville, and northern Vanderburgh County. The Fall Tour is a more relaxed program than the annual Parade of Homes, with no inspections, judging, or awards. The www.FallTourofHomes.com features information and photos for each home.

Expecting a smaller turnout, the Fall Tour of Homes Committee trimmed and targeted a smaller budget for media promotions. Homes were featured in a special promo section, on Fox 7, and on the Fall Tour of Homes website. And it seems to have worked.

Fall Tour builders are asked to return their entry yard signs to SIBA on or before November 2.

NAHB Lead Paint Fact Sheet The U.S. Environmental Protection Agency's “Lead: Renovation, Repair and Painting” rule governing the work of professional remodelers in homes with lead-based paint take effect in April 2010.

Summary of the Rule

1. Training and Certification Beginning in April 2010, firms working in pre-1978 homes will need to be certified. In addition to firm certification, an employee will also need to be a Certified Renovator. This employee is responsible for training other employees and overseeing work practices and cleaning. The training curriculum for certification, in development with the EPA, will be an eight-hour class with two hours of hands-on training. Both the firm and renovator certifications are valid for five years. A Certified Renovator must take a four-hour refresher course to be recertified.

2. Work Practices Once work starts on a pre-1978 renovation, the Certified Renovator has a number of responsibilities. Beginning with distributing EPA’s Renovate Right brochure to the homeowner and having them sign the pre-renovation form in the booklet. Before the work starts the Certified Renovator will post warning signs outside the work area and supervise setting up containment to prevent spreading dust. The rule lists specific containment procedures for both interior and exterior projects. It forbids certain work practices including open flame or torch burning, use of a heat gun that exceeds 1100°F, and high-speed sanding and grinding unless the tool is equipped with a HEPA exhaust control. Once the work is completed, the regulation specifies cleaning and waste disposal procedures. Clean up procedures must be supervised by a Certified Renovator.

3. Verification and Record Keeping After clean up is complete the Certified Renovator must verify by matching a cleaning cloth with an EPA verification card. If the cloth appears dirtier or darker than the card, the cleaning must be repeated.

A complete file of records on the project must be kept by the certified renovator for three years. These records include, but aren't limited to: verification of owner/occupant receipt of the Renovate Right pamphlet or attempt to inform, documentation of work practices, Certified Renovator certification, and proof of worker training.

4. Exemptions It is important to note that these work practices may be waived under these conditions:

The home or child occupied facility was built after 1978. The repairs are minor, with interior work disturbing less than six sq. ft. or exteriors disturbing less than 20 sq. ft. The homeowner may also opt out by signing a waiver if there are no children under age six frequently visiting the

property, no one in the home is pregnant, or the property is not a child-occupied facility. If the house or components test lead free by a Certified Risk Assessor, Lead Inspector, or Certified Renovator.

EPA Lists Approved Trainers

EPA has begun listing approved trainers on their Web site. Visit http://www.epa.gov/lead/pubs/trainingproviders.htm for the current listing of trainers available to prepare remodelers for implementation of the lead paint rule.

Training Dates

Training dates for earning certification to work under the new EPA lead rule are available on the National Center for Healthy Housing training calendar: http://www.nchh.org/training/calendar.aspx.

When looking at the calendar, select from the drop box on the left side "Lead", and all lead courses will be displayed. Then, look for LCR-I (or Lead Certified Renovator-Initial) for the training course to prepare for certification to work in target homes under the rule. Look for LCR-R (or Lead Certified Renovator-Refresher) if seeking only the refresher course after already having the initial training and certification from EPA.

Contract Language to Use Until April 2010

NAHB has developed contract language for remodelers to use in their contracts for work before the rule takes effect on April 22, 2010. This contract language is available only to NAHB members. It helps with liability protection prior to the rule and can be downloaded from the website at: Contract Notice and Disclaimer for pre-April 2010 remodeling contracts.

Held on December 8 at the Holiday Inn Conference Center, SIBA SEMINAR is offering two educational classes – personality selling in a Tough Market, with Charles Clarke; and Codes Workshop with Ben Miller. SEMINAR is the ability for attendees to renew their licenses right after the seminar. Typically, seminar attendees receive certificates for CEU’s and then must go downtown to renew their licenses. For SIBA SEMINAR attendees, a representative from the Evansville-Vanderburgh Building Department will be on-hand to renew licenses. Miller has been a building inspector with the City for 3 ½ years. He holds several certifications with the International Code Council including: Building Official, Building Plans Examiner, Building Inspector, Electrical Inspector, Plumbing Inspector, and Mechanical Inspector.

Miller was a building inspector in Warrick County for two years before he came to work for the City. Prior to his career in building code administration, Miller was in the residential and light construction industry. He has also taught building code education classes around the state for building officials and contractors.

sOFTWARE NOW sUppORTs MODEL HOME

ACT IN 2009In the 2009 Legislature, the Model Home

Act was made retroactive to benefit builders this year (for houses assessed 2008-pay-2009). This law makes builders eligible to deduct 50% of the improvements, not the land, for property tax on up to three model homes.THIs LAW WAs pAssED BECAUsE OF THE BUILDERs AssOCIATION!

Bill Fluty, Vanderburgh Auditor, was instrumental in getting this law passed for this year. Also, in a helpful memo to SIBA Builders, Fluty explained HB 1071 made the Deduction for Model Residences retroactive in 2008-Pay-2009. However, the benefit was put on hold when Fluty’s office was forced to wait for software changes that enable applications to be approved 1 year earlier than the law was originally passed. This only changed the processing of the tax bill – not the net amount.

The Model Home Act passed last year by the General Assembly will save thousands for home builders. It allows builders an exemption of 50% of the assessed value of the structure only, for up to three model homes.
