The proposed amend- ments seek to deter the prospective violators from vandalising and destroying public/private property during agitations and other forms of protests. The pro- posed amendments will also deter the office-bear- ers of these organisations. DU admission: 'Open Days' to beginNEW DELHI

Delhi University's counselling sessions for admissionaspirants, 'Open Days', will begin on Thursday in whichstudents as well as parents can seek answers to theirqueries about the admission process for 2015-16 aca-demic session.

Every year before the admission process begins for itsundergraduate courses, Delhi University conducts'Open Days', or sessions to give prospective applicantsand their parents an idea about what awaits them.

Students and parents are invited for these sessions toget their admission-related queries addressed by DUstaff.

"The Open Day sessions beginning tomorrow will beheld to counsel students and their parents about thechoice of courses in different colleges and the eligibili-ty criteria for admission to various undergraduate pro-grammes," DU's Deputy Dean of Students' WelfareGurpreet Singh Tuteja said.

"The sessions will be held till May 30 from 10 AM to1 PM except Sundays, in varsity's Conference Centresituated opposite Botany Department in NorthCampus," he added.

DU is also mulling to make recordings of these ses-sions available online so the prospective students whoare unable to visit the campus can now turn to its web-site for clearing any doubts regarding the process.

The varsity has also prepared a set of Frequently-Asked Questions (FAQs) based on queries from stu-dents in previous years, Tuteja said. The FAQs will beavailable on the website soon and students visiting thecampus will also get the same in the form of hand-outs.

Admissions to over 54,000 seats in DU's undergradu-ate courses will begin from May 28. The online registra-tion process will be open from May 28 to June 15 whileoffline forms will be accepted at the registration centresfrom June 5 to June 15. The first cut-off list will beannounced on June 25.

Justice Sunil Gaur tagged Pitroda'a petition with oth-ers, including Congress President Sonia Gandhi and herson Rahul Gandhi, who have also challenged the trialcourt's June 26, 2014 order summoning them as accusedfor allegedly cheating and misappropriating funds of acompany that used to publish the now defunct NationalHerald newspaper.

mons issued against all the accused.Pitroda, who served as chairman of the National

Man beaten to death in Delhi'sConnaught PlaceNEW DELHI

A man was beaten to death at Shankar Market inConnaught Place area of New Delhi on Tuesday night,police said.

Police said the deceased Biju Varghese hailed fromKerala. He was staying in Chilla village in east Delhi,with his family. He used to run a courier company here.

At around 11.30 p.m,. two miscreants attackedVarghese allegedly with a helmet and fled the sceneleaving him badly injured. Immediately after the attack,Varghese`s helpers informed the police about the inci-dent.

Police took Varghese to a hospital where doctorsdeclared him brought dead.

NDMC sets 15-day deadline forremoval of illegal adsNEW DELHI

Alongside proposing its new outdoor advertisementpolicy, the North Delhi Municipal Corporation(NDMC) today decided to crack the whip against illegalads in its area and set a deadline of 15 days for theircomplete removal.

NDMC Mayor Ravinder Gupta held discussion with agroup of advertisers and also sought suggestions fromthem to improve the situation.

The Mayor said modes of outdoor advertising wouldbe divided into 36 clusters to regulate business, elimi-nate corruption, improve the quality of advertisements,beautify the city and augment the revenue to improvethe financial conditions of the cash-strapped corpora-tion.

"Under the scheme, the new advertisement siteswould also be created in respective zones, parks andeven on streetlight poles. The advertisers would also begiven the powers to remove the illegal advertisements.The scheme under finalisation would be well within theguidelines of the Supreme Court," a senior official if theNDMC said.

Wednesday declined togive its approval to a DelhiPolice proposal to install6,630 CCTV cameras in 44red-flagged areas of thenational capital at a cost ofRs.404.32 crore.

A division bench ofJustice B.D. Ahmed andJustice Sanjeev Sachdevasaid it would not give its"stamp of approval" to theproject and said "the cost isa bit pricey".

"We won't give ourstamp of approval to theproject. Rs.404 crore forthe CCTV cameras seemsto be on the upper side, tosay the least," the benchremarked. The bench,which posted the matter forfurther consideration forJuly 29, said Delhi Policewere "more interested" inputting up CCTV cameras"as it involves money".

The court's observationcame after advocate MeeraBhatia said Delhi Police inan affidavit said a surveywas carried out byBroadcast EngineeringConsultants India Ltd.(BECIL) in all the 44 areasto identify spots where

CCTV cameras could beinstalled.

BECIL conducted a fieldstudy in consultation withthe respective joint com-missioners of police andother concerned officers inthe vulnerable areas wherecrimes against womenwere on the rise.

It projected a tentativecost of Rs.404.32 crore forall accessories, camerasand apparatuses etc.required for the installationof 6,630 CCTV systems.

On the basis of the proj-ect report, a proposal forobtaining administrativeapproval and expendituresanction of the competentauthority during the cur-rent financial year 2015-16was sent to the home min-istry, Delhi Police counselRajesh Mahajan told thecourt. Police said theprocess of installing theCCTVs in the identifiedareas will be taken upimmediately on theapproval from the centralgovernment. The red-flagged areas were identi-fied after police conducteda first-of-its-kind 'crime-mapping' exercise, particu-larly for crimes against

women.The court was hearing a

public interest litigation(PIL) initiated by it afterthe December 16, 2012,gang rape.

An application filed byadvocate Bhatia said theCCTV cameras installedfor US President BarackObama's security duringhis Republic Day 2015visit should not beremoved. At the outset, thebench came down heavilyon the home ministry andthe city police for failing tomake any headway intorecruitment of additionalpersonnel in the force, say-ing the authorities were"dilly-dallying" over theissue as 15 proposals toincrease the number ofpolicemen were not yetapproved. The benchslammed the ministry andpolice and said they were"playing badminton" withthe proposals by sendingthem back and forth overvarious queries. "How longwill you play the game ofbadminton? Either they areidiots sitting there who donot understand, or they aredoing it on purpose," thebench said.

Delhi HC says no to Rs.404-crore CCTV camera plan

agreed to hear a plea against the risingnumber of road rage incidents in the capi-tal, and for direction to the government toamend the Motor Vehicles Act and make"deterrent provisions" on road rage.

A division bench of Chief Justice G.Rohini and Justice R.S. Endlaw posted thematter for August 5 and clubbed it with thesuo motu cognizance it took last week ofthe road rage issue where a traffic policeman hurled a brick at a woman scooterist.

The public interest litigation (PIL) filedby two high court advocates -- AbhishekChoudhary and Harsh Ahuja -- told thecourt there was "no awareness pro-grammes, workshop, campaign, advertise-ment, banners, hoardings, posters whichwould describe road rage as an offenceand the consequences of committing suchoffences".

It sought direction to the governments tospread awareness through advertisements,FM radio, social media, print media etc.about the consequences or effects of roadrage. "The people on the road of Delhi,including motorists, commuters andpedestrians, have become so violent andaggressive towards each other that in thepast such encounters have turned brutaland fatal," the two lawyers argued. "Suchincidents are mostly called as road rage,"they told court. They said road rage wasuncontrolled anger that results in violenceor threatened violence on the road, and,therefore, was a "criminal behaviour".

Choudhary said the registered cases ofroad rage were increasing every year and itwas imperative to mention that these fig-ures were "very alarming" and a "matter ofgrave concern".

Mentioning a report by IANS about theincreasing number of road rage cases reg-istered in past years, the plea said therewere 36 cases in 2010, 34 in 2011, 49 in2012, 53 in 2013, which increased to 93 in2014 (till November).

The plea sought direction to the Delhigovernment to have "prior temperamental/behaviour analysis test" of people beforeissuing driving licences.

It also mentioned a few recent road rageincidents highlighted by the media.

It said that in May 2012, a metropolitanmagistrate accompanied by two otherjudges became the victim of road ragewhen their car was attacked by four bikersnear the court complex in south Delhi. InSeptember 2013, a 40-year-old advocatewas stabbed and injured by two collegestudents when his car brushed their motor-cycle. In June 2014, a chartered accountedand his wife were beaten up by two men inVasant Kunj when their car bumped into avehicle behind them while reversing. Theplea added that earlier this month (May2015), a DTC driver was beaten to deathby a biker, a traffic policeman hurled abrick at a woman scooterist and a sub-inspector was slapped by a woman in pub-lic when he intervened in a quarrel to stopher from physically assaulting a taxi driv-er whose car grazed her vehicle.

Only aforensic test will now clar-ify the point, police offi-cials say. Investigators saythey are trying to ascertainwhether it was a bulletfired from Vashisht`s pistolor that fired by Sub-Inspector Bhoop Singh thatkilled him.

Two bullets were firedinside the south Indianfood chain Sagar Ratnarestaurant in New RajenderNagar during a scufflebetween InspectorDharmendra Kumar of theSpecial Cell and Vashisht.

Police investigation andthe statements of 13 wit-nesses said the first bulletwas fired by Vashisht,while the second one camefrom Sub-Inspector Bhoop

Singh`s firearm. NineSpecial Cell officers hadraided the restaurant toapprehend Vashisht.

However, police said "noone knows" which bullethit Vashisht`s head leadingto his death.

Special Commissioner ofPolice (Special Cell) S.N.Srivastava told IANS thathe was not investigatingthe alleged shootout as thecase was already beingprobed by an SIT (SpecialInvestigative team), but itis clear that without aforensic report it would bevery difficult to knowwhose bullet hit Vashisht.

Srivastava said BhoopSingh also did not knowwhether it was his bulletthat hit Vashisht.

In his statement, BhoopSingh said that InspectorDharmendra, along withhim and six other officers,entered the restaurant. Twoother officers were outsidethe restaurant.

"Vashisht took out his

pistol and pointed it atDharmendra who, in self-defence, caught his hand,and a scuffle ensued. Bothfell on the ground and abullet got fired. S-I BhoopSingh and constableJitendra were a few metresaway."

"Bhoop Singh then fireda bullet on Vashisht as hethought that InspectorDharmendra was hit byVashisht," a police sourcesaid, citing Bhoop Singh`sstatement. Others presentin the restaurant could notsee whose bullet hitVashisht. Vashisht waskilled in an allegedshootout of Special Cellpolicemen -- an elite unitspecialised in combatingterror activities -- at 8.15p.m. on May 16.

A number of officialssaid they were upset withthe AAP government asthere were attempts to"publicly humiliate" sen-ior bureaucrats.

"We view with greatanguish the way IAS offi-cers have been treated,publicly humiliated and

subjected to characterassassination. We con-demn it. We urge the LtGovernor and the ChiefMinister to create a con-ducive atmosphere whereofficers can function in afree and impartial man-ner," a resolution passed atthe meeting said.

"Let them (Pachauri andDelhi Police) file theirresponses then we willthink over it. There is nopoint of cancelling thebail application immedi-ately," the court said.

based firms, the Supreme Courton Wednesday stayed a penaltyof Rs 139.85 crore imposed onthem by National Green Tribunalfor "illegal and unauthorised"construction in the vicinity of theAgara lake in the city.

A vacation bench of justicesAK Sikri and UU Lalit, besidesstaying the levy of fines, askedthe tribunal to decide the pleas ofthe firms on merits.

Senior advocates GopalSubramanium and Kapil Sibal,

who appeared on behalf of thecompanies, said that the tribunaldid not hear and considered thearguments on merits.

"It has been submitted that thetribunal has allowed construc-tion only on payment of afore-said penalty. We leave it open tothe tribunal to decide it," thebench said while disposing ofpleas of Mantri Tech Zone PvtLtd and Coremind Software andServices Pvt Ltd.

Earlier, cracking the whip ontwo commercial projects, the tri-bunal had imposed Rs 117.35

crore and Rs 22.5 crore as dam-ages on Mantri Tech Zone PvtLtd and Coremind Software andServices Pvt Ltd respectively fordegrading the environment.

The tribunal had also directedthe Centre to stop sanctioningany venture on wetlands andcatchment areas of water bodiesin the city.

A bench, headed by NGTChairperson Justice SwatanterKumar, had termed the projectproponents as "intentionaldefaulters" and constituted acommittee to make a survey of

the the ecologically sensitivearea on the land betweenBellandur and Agara lakes, inBengaluru.

The four-judge bench had saidthe compensation amount wouldbe paid to Karnataka StatePollution Control Board, whichshall maintain a separate accountand would spend the money forenvironmental and ecologicalrestoration and restitution.

The judgement came on a peti-tion filed by The ForwardFoundation, Bangalore, PrajaRAAG, Bangalore andBangalore EnvironmentTrust.

Though Swacchh BharatAbhiyaan was launchedwith great fanfare onOctober 2, 2014, the Modigovernment has reducedallocated funds for themission (including drink-ing water and sanitation)by Rs 9,025 crore, heclaimed, adding theCongress has called uponthe people to unite andoppose a "regressive, ret-rograde and anti-poorModi government."

Stating that agriculture

and irrigation, which con-tribute 17 per cent of theGDP and engage 49 percent of the workforce, wasworst hit by "Modinomicsof crony capitalists,"Singh said the RashtriyaKrishi Vikas Yojana hasseen a reduction in fundsto the tune of Rs 7,426.50crore.

Animal Husbandry andDairy Vikas has seen a cutin funds to the extent of Rs685 crore, while thePradhan Mantri KrishiSinchai Yojna has seen areduction of around Rs8,156.22 crore, he said,adding funds for theNational LivelihoodMission have beenreduced by Rs 1,632.50crore.

"Not surprisingly, agri-culture growth has gonedown from 4.7 per cent in2013-14 to 1.1 per cent in2014-15 under the BJPgovernment. Area undercultivation has gone downby 33.22 lakh hectares in2014-15," he said.

Scheduled Castes andScheduled Tribes, Singhsaid funds for SC sub planhave been reduced by Rs13,208 crore and tribal subplan was cut by Rs 7,714crore.

Describing thePanchayati Raj and itsinstitutions as the last mileconnectivity of the nation'sdemocracy, the Congressleader said budget of PRinstitutions has beenreduced by Rs 3,306 crore- by about 98.6 per cent asallocation for PR institu-tions was now only Rs94.75 crore.

Charging the NDA gov-ernment with systemati-cally killing the MGNRE-GA by not releasing fundsto the states, he said theCentre has not releasedover Rs 6,000 crore tostates in 2014-15.

the Sunanda Pushkar mur-der case, a Delhi court onWednesday allowed poly-graph test on three "sus-pects", who are beingaccused by the DelhiPolice of lying in the case.

The court gave its nod toa lie detector test afterthree – Shashi Tahroo'sdomestic help NarainSingh, driver Bajrangi andfriend Sanjay Dewan –agreed to go through thetest. They have demandedthat Supreme Court andNational Human RightsCommission (NHRC)guidelines be followed bythe police, while they aresubjected to polygraph test.

The police has accusedthem of concealing materi-al facts about Sunanda’s

mysterious death onJanuary 17, 2014.

Citing specific instancesto claim that they are lying,the police told the courtthat the three wereTharoor’s close associatesand were in present atHotel Leela Palace justbefore Sunanda’s death.

"During investigation, ithas been found that thethree persons are conceal-

ing material facts and didnot disclose several issuesrelated to the death ofSunanda Pushkar," the pleafiled by SHO of SarojiniNagar Police Station said.

It said that on January17, Tharoor's close friendSanjay Dewan came to thehotel at 5 pm and remainedthere till the discovery ofPushkar's death. He couldnot give plausible reason

for cancelling his trip toMumbai and his coming tothe hotel in Delhi, itsaid.

Among the other pointsraised by the police was hissilence about a power cutin room no. 345 just beforethe discovery of Sunanda’sdeath and, despite beingthere, they failed to explainthe injury marks onSunanda’s body.

The police claimed hedid not wake up Pushkarfor two and a half hoursand also not explained whyhe preferred Dr RajanMohan, who came all theway from Patel Nagar, overthe hotel doctor who couldcome within a short span oftime.

ble for the Aam AadmiParty (AAP), the DelhiHigh Court on Wednesdayissued a notice to MLASurender Singh to file aresponse to a BJP leader'splea seeking setting asideof his election overalleged wrong declarationof educational qualifica-tion in his nominationpaper.

The HC has given fourweeks time to the AAPMLA from Delhi Canttregion to file his response.

The court's order cameafter BJP leader KaranSingh Tanwar filed anapplication, saying thatSingh had provided wronginformation in his electionaffidavit that he is a grad-

Abhimanyu was inShubhadra’s womb whenhe heard Lord Krishna

reveal the secret of how to enterthe Chakravyuha. But he did notlearn how to exit it, and that isthe reason why he was finallykilled in fierce battle in the heartof the enemy’s army. Not soGandhiji, who triumphed overthe Chakravyuh effortlessly. Notonly was he able to enter andexit it with ease, he did so at atime and place of his choosing,dissolving it with ahimsa andcreating independent India.

Jawaharlal Nehru largelydesigned the Chakravyuh of themodern Indian state. Eventhough not as easily as Gandhiji,he did succeed in entering andexiting it — democratic and sec-ular India was the consequence.Indira Gandhi got trapped in theChakravyuh. Like Abhimanyu,she got to the sixth circle, butwas felled by the Emergencyand, becoming increasinglyauthoritarian and paranoid,found the circles closing aroundher and she succumbed to thearrows from enemies both imag-ined and real.

We could continue preparing areport card for all the PrimeMinisters and theirChakravyuhas but the cominganniversary of Modi’s first yearin office is an opportunity tospeculate on his chances of suc-cessfully negotiating theChakravyuha of government.

Abhimanyu heard Krishnasaying that the trick was toattack and destroy the soldiers tothe left and to the right, so thatirrespective of which way thecircle turned, one would be ableto enter it. The Prime Ministerhas attacked the politics on theLeft but is not quite decisive inhis support for the economicpolicies of the Right. While theLeft is rebelling against hissocial and cultural policies, the

Right is beginning to grumblethat nothing has changed on theeconomic front. 'Nothing ischanged on the ground’ said Mr.Deepak Parekh.

In the Mahabharata, theChakravyuh was a seven-spi-ralled, impenetrable battle for-mation. Let us see what theseven circles of Indian polityare.

The seven circles

At the outermost seventh circleis foreign policy. This is thecountry’s interface with theworld — the neighbourhood, theregion, and the global politicaland economic order. Here, Mr.Modi has been the most effec-tive, gaining the attention of dif-ferent international powergroups and having them competefor India’s friendship. From get-ting the UN to declareInternational Yoga Day on June21 to having the US President asChief Guest for Republic Day toestablishing a BRICS develop-ment bank to land swaps withBangladesh, Modi has passedthe first circle by neutralising theLeft and ignoring the Right.There is a distinct Nehruviantouch to his foreign policy.

“ Mr. Modi has now reachedthe third circle of governance.Here, the struggle has justbegun, with some people-friend-ly initiatives, and some question-able decisions. ”

The second circle too Mr.Modi has been able to penetrate.This is building a political coali-tion for governance. By winningelections with a single partymajority and ending the era ofcompromise and coalition poli-tics and then winning severalState elections, Mr. Modi hasinaugurated a new phase of deci-sive national politics. Somepolitical resistance remains,from within his party and with-out, but these won’t stop him

from going through this circle.

His penchant of concentratingpower in the PMO when colle-gial governance is required maypresent difficulties during thereturn journey, since the feed-back mechanism of politics thatis required to manage such adiverse polity will be consider-ably enfeebled, but there is littledoubt that Mr. Modi has built apolitical coalition to give domes-tic politics a decisive turn. Atthis point of time he is limitedonly by his will and his imagina-tion.

Mr. Modi has now reached thethird circle — the instruments ofgovernance. Here, the strugglehas just begun. There are somegood policies, such as thePradhan Mantri Jan Dhan Yojana(bank accounts), the PradhanMantri Jeevan Jyoti BimaYojana (life insurance), thePradhan Mantri Suraksha BimaYojana (accident insurance), andthe Atal Pension Yojana (pensionfor the unorganised sector), butthese have to be seen in tandemwith plans to reverse the socialimpact assessment and consentclause of the Land AcquisitionBill, the hasty environmentalclearances, and the near-zerointeraction with the media inIndia. Thus, some very good ini-tiatives that are people friendly,with some questionable deci-sions that are people hostile. It isunclear whether his moves todefeat the warriors on the Leftwill be as successful as in earliercircles. Equally, the warriors onthe Right are voting with theirfeet. Corporate India is begin-ning to speak about a ‘direction-less’ economic policy steeped inhyperbole. Mr. Modi’s magic islosing its sheen.

It is at the fourth circle — therespect for democratic and par-liamentary institutions — thatModi’s achievements begin tolook thin. Ordinances are fre-quently resorted to. In his fort-

nightly letter to Chief Ministers,Nehru wrote on 16 August 1948,“Nevertheless, (ordinances are)a dangerous path to tread andgovernments get used to veryspecial measures which theycannot do without later. For us,with our past record in regard tocivil liberty, this is a particularlydistasteful course.”

The ordinance has become Mr.Modi’s instrument of choice notjust in the very visible landacquisition issue but also withrespect to his desire “to give agovernment job to just onesuperannuated officer”. Thisemasculation of institutions canbe seen in his returning theSupreme Court collegium’s rec-ommendations for elevation tothe Bench of an eminent senioradvocate; in the government’sdefence of Clause 66A of the ITAct, which was mercifullystruck down by the courts; or inkeeping important offices suchas that of the Chief InformationCommissioner vacant.

In the fourth circle, Mr. Modiis making little headway. It is tooearly to determine whether hehas the capability to strengtheninstitutions or undermine them— with early evidence pointingto the latter tendency — but weneed another year to find out.

The real test

It is in the fifth circle that Mr.Modi begins to lose his capabili-ty to determine outcomes. This isthe circle that concerns the pub-lic discourse of a plural society;the discourse required to build amodern democratic state.Entering it requires informedintervention, speech and actionsthat support and consolidate thecritical temper required by thehumanist aspirations of a mod-ern India.

By his silence, Mr. Modi hasallowed the regressive elementsamong his supporters to deter-

mine the terms of public dis-course. When the Chairman ofthe Indian Council of HistoricalResearch says that ‘What weteach today in schools and col-leges lacks both moral and mate-rial content, which could mouldcharacter and conduct... Our his-tory is deprived of Bharateeyata(Indianness)’; or when the RSSchief says that Mother Teresa’sservices were governed by con-version motives, Mr. Modi hasremained silent, allowing publicdiscourse to be dictated by a rab-ble-rousing minority.

If Mr. Modi gets through thefive circles described above, thereal test will begin in the sixth(political philosophy) and sev-enth (personal ethics) circles.One cannot govern a pluralistcountry like India with a philos-ophy crafted in a shakha. At itscore must be a commitment tosecularism and social justice.Perhaps a different secularismthan the partisan one practisedby the Congress, but secularismnonetheless.

A majoritarian mindset, whichMr. Modi seems comfortablewith, is unfair to both the major-ity and the minority in the popu-lation. What are Mr. Modi’s corebeliefs? What is his understand-ing of the relationship betweencommunities? What steps doeshe plan for the empowerment ofwomen? And Adivasis? Howdoes he see dignity achieved in asociety fissured by caste? Whatis his view on the rule of laweven if it penalises his closestadvisors?

These are not idle questions.They constitute the sixth circlewhere Indira Gandhi fell. Then,Mr. Modi will still have to facethe seventh circle of personalethics before finally emergingtriumphant.

The European Union’s Ambassador to New Delhi,Joao Cravinho, last week expressed keenness to pur-sue the India-EU Free Trade Agreement talks. The

desire is mutual. Despite the vigorous pace that theNarendra Modi government has marked in the matter of for-eign relations in general, this process has remained in sus-pended animation for two years now. Minister forCommerce and Industry Nirmala Sitharaman had assuredthe Ambassador in March of India’s willingness to resumetalks. As Mr. Cravinho mentioned, the meeting of theOECD countries scheduled for June offers an opportunityfor both sides to draw up a road map. The EU identifiedIndia as a ‘strategic partner’ in 2004. A Joint Action Planwas signed in 2005 and negotiations on the proposed Broad-based Trade and Investment Agreement (BTIA) werelaunched in June 2007. Eight years down the line, somecontentious issues still remain. In the backdrop of PrimeMinister Modi’s visit to France and Germany in April camethe cancellation of the India-EU summit, apparently for“logistical” reasons. Issues such as the EU ban on import ofmangoes from India announced in May 2014, and the legalproceedings in India involving the Italian Marines, are alsofactors that have left the relationship strained. The EU isone of India’s largest trading partners and a major source ofFDI. The value of EU-India trade grew from €28.6 billionin 2003 to €72.5 billion in 2014, while trade in commercialservices rose from €5.2 billion in 2002 to €23.7 billion in2013. India has concluded agreements with ASEAN, Japan,Singapore and Korea. With the EU the scale of the deal ismore ambitious, and consequently the disagreements. Forinstance, the EU is unhappy with India’s protectionism inthe automobile sector, and wants steep cuts in duties, andtariff cuts in things such as wine, spirits and dairy products.But tariff cuts in the agricultural sector would meanEurope’s heavily subsidised agro industry will dump its sur-plus here, hitting Indian farmers. India’s generic drug mar-ket also raises intellectual property concerns for Europeanpharmaceutical corporations. India, on the other hand, isunhappy with the EU not recognising it as a “data securenation”, and with what the EU has to offer in the area ofIT/BPO/KPO services (Mode 1) and the movement ofskilled professionals (Mode 4). But the EU is no doubt keenon partnering with India in programmes such as Make inIndia, Swachh Bharat and Smart City projects. Another crit-icism levelled against the FTA talks has been over lack oftransparency and inadequate consultations with civil socie-ty participants. These concerns will also have to be reme-died in future rounds of dialogue. It is to be hoped that thewhole process would now gain momentum and lead to anegotiated deal.

Not a single Indian institutionof higher learning figures inthe list of top 200 universities

prepared by The Times HigherEducation Supplement. These dismalrankings are quite often taken as ameasure of the crisis of higher educa-tion in India, notwithstanding theobvious limitations of the rankingexercise. But all is not well withIndian universities.

So far, the Narendra Modi govern-ment has done very little to addressthe crisis in higher education. Thegovernment started on a controversialnote. Prime Minister Modi’s selec-tion to head the Ministry of HumanResources and Development (HRD)raised questions about the importanceof education under this dispensationas it showed scant regard for educa-tion in spite of the fact that the SanghParivar takes education very serious-ly.

Lower budgetary allocation

The government’s first Budget hasnot delivered achhe din for highereducation in the country. The UnionBudget for 2015-16 has reducedfunds for higher education to the tuneof Rs.3,900 crore in its revised budg-et estimates for the financial year2014-15. The government hasrevised the figure to Rs.13,000 crore,as against Rs.16,900 crore for theplan allocation. The overall educa-tion budget of the Modi governmentis down from Rs.82,771 crore toRs.69,074 crore. The government hasalso revised allocation for theRashtriya Uchchatar ShikshaAbhiyan (RUSA) — which is aCentrally Sponsored Scheme (CSS),launched in 2013 that aims at provid-ing strategic funding to eligible statehigher educational institutions — toRs.397 crore as against Rs.2,200crore in the original Budget.

Despite the trend of passing on theresponsibility of education to the pri-

vate sector, there is a strong case toexpand state funding of education.The role of publicly funded educationin the democratisation of access tohigher education in India is indis-putable. Treating the higher educa-tion system as a public good, theIndian state has been successful inproviding access to institutions ofhigher learning to many groupswhich were hitherto not able toaccess it. This is only possible if thereis adequate state funding and publicregulation for the entire system ofeducation from school to university.Far from expanding publicly fundeduniversities with an increase in budg-etary allocation of education, statefunding is being steadily withdrawnfrom education in general and highereducation in particular so that privatecapital, both Indian and foreign, canbe encouraged. The privatisation ofhigher education is now an irre-versible trend in India, where amajority of the institutions have beenestablished by the private sector. Inthe midst of this trend, it is the artsand humanities that are being pushedaside.

Move towards centralisation

Besides cuts in state funding whichis a critical area of concern, theBharatiya Janata Party (BJP)-ledgovernment’s overall approach toeducation is destructive of autonomy,creativity and diversity. The mannerin which the state is intervening inhigher education is causing concernamong both teachers and students.There are alarming proposals tochange the very nature of higher edu-cation. The most disturbing is theproposal to revive the CentralUniversities Act of 2009 which willrequire the Central universities to fol-low a common admission procedureand common syllabus. Even thoughthe United Progressive Alliance(UPA) regime and the currentNational Democratic Alliance (NDA)government have been remarkablysimilar in their desire to introduce

changes in the higher education sys-tem, most of the UPA’s major propos-als got drowned in the Parliamentlogjam which continued till the lastsession of the 15th Lok Sabha. Also,there was some debate and opposi-tion within the UPA governmentwhich could be another reason whythe government couldn’t implementits agenda. This government is pursu-ing the reform agenda much moreaggressively leaving little scope fordissent and disagreement.

The Central University (CU) Actseeks to replace the existing Centraluniversities with one single Actwhich would require all universitiesto follow a “common” admission and“common” syllabus along with“transferable” faculty. India’s highereducation system, serving a large andheterogeneous population, shouldideally support a diverse and decen-tralised system. However, the CU Actwill do the opposite; it aims at cen-tralisation and homogenisation,ignoring the specificities and unique-ness of each university. EachUniversity’s Act has a specific con-text and mandate, and each has devel-oped its own pattern of knowledgeproduction and reproduction. Forexample, the Delhi University Act(1922) was in response to the need toprovide for the educational needs ofan emerging India and incorporates awide college network. The foundingideas of the Jawaharlal NehruUniversity, on the other hand arequite different from other institu-tions. The impulse for the JawaharlalNehru University (JNU) Act (1966)was to institutionalise the values andvision of “national integration, scien-tific temper, and humanism”. TheseActs have shaped their curriculum,academic ethos, teaching andresearch. Nullifying these Acts wouldbe a blow against diversity and plu-ralism as well as to minimum auton-omy without which a university can-not function and flourish. It will nar-row the space for innovation and cre-ate a teaching culture where creativi-

ty and critical thinking will becurbed.

No academic logic

The Ministry of HRD’s idea of“reform” is an egregious attempt tostandardise higher education andresearch by introducing a commonframework for Central universitiesbased on the myth that uniformitywill equalise quality and skills acrossuniversities. It is not at all clear thatuniformity will help in upgradingnew universities or the State universi-ties, which is the ostensible aim ofthis exercise.

Some of the good universities suchas JNU or the Ambedkar University,Delhi, are successful preciselybecause they value heterogeneity andvariation so that creativity and inno-vation can thrive. Many Central uni-versities reflect India’s extraordinarydiversity in their faculty compositionand student body, and, above all, theyoffer very different syllabi and cours-es which has helped in their academ-ic growth. The CU Act advocatestransfer of faculty between universi-ties. Nowhere in the world are “trans-fers” between institutions practised.There is no academic logic here.Besides, transfers increase the possi-bility of vindictiveness as it can beused as a punitive measure to silencedissent and independent voices.

It is evident that the government iseager to control and direct universi-ties both at the Central and Statelevel. For this the HRD Minister ispushing the idea of a Choice-BasedCredit System (CBCS), first mootedby her predecessor, Murli ManoharJoshi, during the term of NDA-I,which would have a serious impacton the country’s education system.The University Grants Commission(UGC) has formulated the new pro-posals for a CBCS, a commonentrance test and a central rankingsystem ignoring the assurances givenby the government and the UGC that

it would hold wide consultations withall stakeholders before undertakingany subsequent educational reforms.A common syllabus is neither desir-able nor feasible as this will diminishcreativity and lower standards inorder to conform to common stan-dards. We need a university systemthat encourages diversity and decen-tralisation, not one that centralisesauthority or enforces lifeless unifor-mity.

Even as the government has set theball rolling for unveiling a newnational education policy, there is nopublic debate or consultation at thebehest of the Ministry. Majorchanges are being initiated andpushed without actually consultingthe professionals involved eventhough there is growing unease andopposition within Central universi-ties to the new education policy andthe manner in which the exercise isbeing done. So far, the MHRD’s con-sultations have been limited to post-ing information and asking people topost comments and filling out amygov.in survey on higher educationon the Ministry’s website. The right-wing agenda

The common syllabi system has tobe seen in the context of attempts tosaffronise the education sector, par-ticularly at a time when the RashtriyaSwayamsevak Sangh (RSS) is spear-heading the agenda of the presentgovernment. Even though the right-wing intelligentsia has failed to pro-vide a credible account of India’s pastand present, the Sangh Parivar is nev-ertheless busy reorganising educa-tional syllabi to reflect a view of his-tory and society gleaned frommythology and religious texts, ineffect giving an open licence to fanta-

sise history. Within weeks of formingthe government, the RSS held ameeting with the HRD Ministerwhere it pushed for introduction ofmoral education, correcting distortedhistory being taught in educationalinstitutions and giving proper repre-sentation to forgotten idols of thecountry from the pre- and post-Independence era. RSS ideologue,Dinanath Batra, unambiguously stat-ed this: Political change has takenplace, now there should be totalrevamp of education. Activists ofBatra’s Shiksha Bachao Andolan arereportedly firming up recommenda-tions for a revamp of education; theybelieve the formal education systemneeds some key changes: a greateremphasis on Indian knowledge tradi-tions and a blending of the materialand the spiritual in the curriculum.

Leaders of the BJP are on recordannouncing their intention to changethe textbooks and syllabus. The larg-er Sangh agenda includes substantivechanges both in the content of educa-tion and appointments in prestigiousinstitutions. Their aim is to influencetheir working to reflect the Sangh’sagenda by making key appointmentsof persons belonging to the RSS andaffiliate bodies in various institutionslike the Indian Council of HistoricalResearch (ICHR), the Indian Councilof Social Science Research (ICSSR),the Nehru Memorial Museum &Library (NMML), the IndianInstitutes of Technology, the Centraluniversities, the National Council ofEducational Research and Training(NCERT) and the State Council ofEducational Research and Training(SCERT), etc, who will loyally exe-cute such changes. Many of themwill exercise influence on public pol-icy, and will do so not due to theirscholarship, but due to their proximi-ty to the RSS.

In his written advice, Dhavan said: "It isabundantly clear that the Lt Governor hasexceeded his authority and has turned theentire relationship between himself and theCouncil of Ministers on its head to jeopardisedemocracy and the Constitution."

In her letter, Jaising said the political exec-utive was "constitutionally empowered" tochoose its own officers in accordance withthe cadre.

"Who will be the chief secretary or anyother secretary of the government is a matterin which the Governor has to yield to the willof the political executive which has beendemocratically elected," she said.

She also said the discretionary power toappoint a chief secretary can be found neitherin the Constitution nor in any statute.

AAP govt ...nearly three-hour-long meeting called by

In his letter sent to AAP government, theformer solicitor general said, "Given thisposition of law, it would be constitutionallyunviable for the Lt. Governor to act de horsthe aid and advice of the Council of Ministerson any such matter."

"Any such action would be clearly contraryto the provisions of Articles 14 and 239AA,as well as being ultra vires the provisions ofthe Government of National Capital TerritoryAct, 1991, and the Transaction of theBusiness of the Government Rules, 1993."

"For Lt. Governor to act in such a mannerwould completely undermine the mandate ofan elected government," he added.

A tussle between Delhi Chief MinisterArvind Kejriwal and Lt. Governor NajeebJung started over the appointment of seniorbureaucrat Shakuntala Gamlin as the actingchief secretary.

Escalating his confrontation with the AAPgovernment, Jung today cancelled allappointments made by it in the last four daysas he asserted that he was the sole authority inmatters of ordering transfer and posting ofbureaucrats.

The appointment of Shakuntala Gamlin asacting chief secretary had last week triggereda full-blown war between the ruling AAP andJung with Kejriwal alleging that the LG wastrying to take over the administration.

An RTI response received from the GeneralAdministration Department shows that theappointment was done on the bases of a 'note'received from the office of chief ministerArvind Kejriwal dated March 5, 2015.

According to the reply, parliamentary sec-retaries do not receive any remuneration orany perks of any kind from the government--meaning no burden on exchequer.

They, however, may use government trans-port for official purposes and space in theminister's office would be provided to themto facilitate their work, it said.

Mandeep Singh for a game-changing partnership as RoyalChallengers Bangalore elimi-nated Rajasthan Royals fromthe IPL-8 with a splendid 71-run win, here on Wednesday.

De Villiers hit a fighting 66and shared a match-winning113-run stand with MandeepSingh (54 not out) as Bangalorerecovered from a sluggish startto post a challenging 180 forfour after electing to bat.Rajasthan had the proceedingsfirmly under their grip but theyleaked 86 runs in the last sixovers to let it slip.

De Villiers' 66 came off 38balls with four sixes and asmany fours while Mandeeptook 34 balls for his unbeaten54, which had seven fours andtwo sixes. Rajasthan neverlooked convincing in theirchase as they kept losing wick-ets and eventually folded forjust 109 in 19 overs, builtaround Ajinkya Rahane's fight-ing 42. Rajasthan's surprisecapitulation reduced it to a lop-sided affair and their total wasthe lowest in the IPL Play-offs.

Thakur, flanked by chiefselector Sandeep Patil,confirmed that BCCI waslooking to fill in not justthe position of coach butalso other staff. “We are inthe process of finalisingthe coach. It will take timeto pick the right option.Good things come to thosewho wait. We want to picka coach who can deliver,”he added. The Sports Ministry hasasked the Sports Authority ofIndia (SAI) to set up a 24-hour helpline among imple-menting other correctivemeasures for well being ofthe trainees in the wake ofsuicide attempt by four girlathletes at SAI's Alappuzhacentre.

The corrective actions havebeen formulated by theMinistry after examining thereport submitted by SAI DGInjeti Srinivas on the contro-versial incident.

As per the recommenda-tions, SAI should empanelcounselling psychologists tovisit its centers once in a fort-night or once in a month, asmay be required, for the pur-pose of group counselling aswell as one-on-one coun-selling.

All girls hostels must com-pulsorily have a full-timelady warden and all centersshould preferably be run at

least by Assistant Director(AD) level officers.

The Ministry also wants tomake Yoga as a compulsoryactivity in all SAI centers.

"Part-time Yoga instructorsmay be engaged for this pur-pose. Organisations impartingYoga courses should be ropedin to provide training onYoga," said the Ministry in arelease.

The release further addedthat a two-day module onsports psychology should beprepared in consultation withAIIMS and introduced in allSAI centers.

The Ministry also recom-mended that all eligible SAItrainees should be coveredunder the newly introducedPradhan Mantri Jeevan JyotiBima Yojana (PMJJBY) andPradhan Mantri SurakshaBima Yojana (PMSBY).

"Expenditure on thesemeasures will be met fromthe allocated budget of SAI,"the release added.

Lewis Hamilton has agreed a newthree-year contract that will keep him atMercedes until the end of 2018, theteam announced on Wednesday.

Hamilton`s new deal ends months ofuncertainty about the driver`s future,with speculation swirling since the mid-dle of last year and increasing despiterepeated assurances that all was ontrack.

The champion has dispensed with theservices of a manager and has been con-ducting much of the negotiations, andreading through contracts, himself.

The Briton, who won his first titlewith McLaren in 2008, has been backedby Mercedes since his teenage yearsand all of his 36 grand prix wins havebeen with the German manufacturer`sengines.

Fifteen of those victories, including11 last year, have been for the Mercedesworks team.

"Mercedes-Benz began supportingme in 1998 so I am very proud that thiscontract means I will mark 20 yearswith Mercedes in 2018," he said.

Mercedes motorsport head Toto Wolffsaid continuity was a key factor indelivering success.

"Lewis enjoyed an historic WorldChampionship season with Mercedes-Benz last year and it was a priority forthis season to renew his contract for thenext term," said the Austrian.

Body builders have knownfor over eight decades that adiet rich in vitamin can help

build strong muscles, but scientistshave only now figured out oneimportant way the vitamin works.

One big problem for many cells,such as muscle cells, is that theplasma membrane, which essen-tially keeps a cell from spilling itscontents and controls what movesin and out, tears just from beingused.

Vitamin E helps repair thesemembranes and thus contributes tokeeping muscles healthy, the find-ings showed.

"Every cell in your body has aplasma membrane, and everymembrane can be torn," said corre-sponding author of the study PaulMcNeil, cell biologist at theMedical College of Georgia atGeorgia Regents University in theUS.

"Part of how we build muscle isa more natural tearing and repairprocess -- that is the no pain, nogain portion -- but if that repairdoes not occur, what you get ismuscle cell death. If that occursover a long period of time, whatyou get is muscle-wasting dis-

ease," McNeil explained.Good sources of vitamin E

include vegetable oils; nuts; seedssuch as sunflower seeds; greenleafy vegetables; and fortifiedbreakfast cereals, fruit juices, andmargarine, according to the USNational Institutes of Health.

For the new study, rats were fed

either normal rodent chow, chowwhere vitamin E had beenremoved, or vitamin E-deficientchow where the vitamin was sup-plemented.

The researchers found vitaminE-deficient rats were generallydeficient in their running abilitycompared with controls.

The scientists also administereda dye that could not permeate anintact plasma membrane and foundit easily penetrated the musclecells of vitamin E-deficient rats.

The study appeared in the jour-nal Free Radical Biology andMedicine.

Sarabjit was convicted of terrorismand spying by a Pakistani court andsentenced to death in 1991. His sisterstarted a campaign for his release.

Following to her efforts and that ofthe Indian government, Sarabjit’sexecution was indefinitely delayed.But, he was attacked in April 2013 ina Lahore jail and in May, wasdeclared brain dead.
