III. CONFIDENTIALITYYou may find it beneficial to inquire about confidentiality and privilege at the start of your conversation with any resources.

Confidential The University has designated these resources as confidential. This means that these individuals below do not need to notify the Title IX Coordinator when someone discloses concerns of sexual harassment and/or other sexual misconduct; however, these resources may be required to reveal the information that was disclosed to them in a criminal or other external proceeding: • Campus counseling staff • Clergy members providing religious or spiritual advice or comfort

Private Information disclosed to these resources is shared only on a need-to-know basis: • Title IX Coordinator• Deputy Title IX Coordinators

UNIVERSITY RESOURCESIf you, or a friend, or a colleague, have experienced sexual harassment (which includes sexual assault) or other sexual misconduct, or are a party in a formal complaint involving sexual harassment or other sexual miscon-duct, University resources are available to provide both immediate and long-term support measures. You may find it useful to ask about confidentiality and privilege at the start of your conversation with a campus resource.

Title IX OfficeThe University’s Title IX Office is responsible for addressing disclosed incidents of sexual harassment and other sexual misconduct in University’s programs and activities. The Title IX Office monitors and oversees the University’s compliance with Title IX and related laws in the prevention of sex harassment and discrimination, including the coordination of education and training activities and the response to Title IX complaints. The Title IX Coordinator and Deputy Title IX Coordinator(s) are available to meet with members of the cam-pus community who want to speak about incidents that either involve them directly or may have impacted a friend or colleague. Discussions may include information about supportive measures, the University’s policies addressing sexual harassment and other sexual misconduct, and available resources and options.

Coordinators are specially trained to handle sensitive information relating to incidents of possible sexual harassment, including sexual assault, and other sexual misconduct with appropriate discretion and to help arrange supportive measures which allow an individual to continue with studies or work and take advantage of all that the University has to offer. The Title IX Coordinator also facilitates access to confidential resources.Sharing information with the Title IX Coordinator is not the same as filing a formal complaint. As described in the University Policy, it is ordinarily up to you to decide whether you wish to file a formal complaint, although in very rare circumstances, where a community safety concern has arisen, the Title IX Coordinator may need to take steps to initiate a formal complaint.

ARE MY CONVERSATIONS CONFIDENTIAL? While conversations with the Title IX Coordinator and Deputy Title IX Coordinator(s) are not confidential, they will handle any information that you provide with the utmost discretion and sensitivity and will share it with others only on a need-to-know basis.

Employee Assistance Program (EAP)University’s Employee Assistance Program (EAP) offers confidential consultation, assessment and referral, and short-term counseling to help staff, faculty, and their household members with personal or work-related concerns including sexual harassment and other sexual misconduct.

ARE MY CONVERSATIONS CONFIDENTIAL? EAP staff hold a legal privilege of confidentiality when providing services. EAP will not share information unless its staff has permission from the person seeking services. Absent special circumstances, when providing services, EAP is prohibited from sharing information in legal proceedings.

University Counseling The Counseling Office provide students individual counseling and mental health for a variety of concerns, including anxiety, depression, stress, crisis management, transitional issues, grief, and sexual, or relationship concerns.

ARE MY CONVERSATIONS CONFIDENTIAL? Counselors assure each patient that all health information is treated confidentially and protected to the fullest extent permissible by law. Conversations with counselors, acting in their professional capacity, are privileged under the law, meaning that counselors are prohibited from disclosing what you have shared with them, unless you give them permission; however, this resource may be required to reveal the infor-mation that was disclosed to them in a criminal or other external proceeding.

University Student HealthUniversity Health Services is dedicated to caring for students. Services include primary care including immuni-zations, physicals, STD testing, health education and programs, and mental health assistance.

University Safety and SecurityThe University Safety and Security is committed to maintaining a safe and secure campus by providing secu-rity in partnership with the Minot Police Department. If you are in immediate danger and need help or want to speak to an officer about your situation, call Safety and Security. Contacting Security does not obligate you to file charges or to testify in court. You may also consult with Security to help determine whether an incident may constitute a criminal offense.

Safety and Security provides timely warnings to the University community when a significant criminal incident occurs within the University’s geography (as defined pursuant to the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act, commonly known as the “Clery Act”) and represents a serious or continuing threat. However, there may be situations in which an alleged assault occurs between two students, but there is no ongoing threat to other University community members; in these instances, a timely warning notice would not be distributed. Similarly, sometimes sexual assaults are reported long after the incident oc-curred, so it is not possible to distribute a “timely” warning notice to the community.

Clery Act Crime StatisticsThe Clery Act is a federal law that requires colleges and universities to disclose information about campus crime. Each year, the University files a report of campus crime statistics with the United States Department of Education. Crime statistics for the past three calendar years are also available upon request. These statistics do not include any identifiable information (e.g., names, addresses, telephone numbers, etc.). ARE MY CONVERSATIONS CONFIDENTIAL? As a general matter, Safety and Security does not publish the names of crime victims or include identifiable information about victims in the University Crime Log, in campus timely warnings, or online. Safety and Security will not disclose the name of any alleged victim of rape or sexual assault, and will maintain all reports in a manner that will ensure their confidentiality. When applicable, reported incidents will be included in the Clery Act annual crime statistics without any identifying information.

COMMUNITY RESOURCESDomestic Violence Crisis CenterThe Domestic Violence Crisis Center (DVCC) operates a free, confidential, 24-hour hotline for anyone who has experienced sexual assault and domestic violence and their families and friends. DVCC also provides medical advocacy, legal services, counseling services, counseling and education groups, and case management.

Minot Police DepartmentThe Minot Police Department responds to request for service and provide services in response to needs of the community for assistance.

North Central Human Service CenterNorth Central Human Service Center provides services to benefit children, adults, elderly and families experiencing emotional problems, mental illness, family relationship concerns, addiction and disability issues. Services are intended to help people maintain or enhance their quality of life.

IV. FOLLOW-UP CAREIf you have experienced sexual harassment and/or other sexual misconduct, you have options. You may choose any combination of the options listed in this section that you feel is right for you.

ACCESS MEDICAL & SAFETY OPTIONSIf you have experienced sexual harassment, sexual assault, dating violence, domestic violence and other forms of interpersonal violence that can result in medical and safety issues, you may consider getting medical care. Although you might not identify urgent medical concerns following an incident, it can be helpful to speak with a provider about reducing the risk of sexually transmitted infections, HIV-transmission, and pregnancy. Members of the campus community have several on and off campus options:

Trinity Hospital Emergency DepartmentTrinity Hospital provides a range of care pertaining to: treating violence-related injuries, forensic evidence collection (Sexual Assault Nurse Examination (SANE)), screening for, preventing and treating infection and HIV, and pregnancy prevention services.

Note: Many services related to sexual assault and other crimes may be accessed free of charge or may be eligi-ble for reimbursement. If you have concerns about using insurance, or need assistance in accessing resources, please speak to medical staff or SANE personnel.

University Student Health Services If you have a health problem (physical or emotional) that requires prompt attention but is not a life-threaten-ing emergency, you may seek care and discuss further options with the University Student Health Services.

University Safety and SecurityIf you are not currently in a safe place or if you have an emergency, you can call Campus Security. Community members are encouraged to store Security’s phone number in their cell phone contacts.

Medical CareIf you suspect that you were given any type of drug, testing should be administered as soon as possible as different drugs will be detected for different periods of time after they have been ingested. Similarly, clinicians can best retrieve medical evidence within only a few days after an assault.

If you think you would like to have forensic and/or DNA evidence from a trained Sexual Assault Nurse Examiner (SANE), it’s important that you seek services at a qualifying hospital emergency department as soon as possible within 96 hours, or 4 days. SANEs are skilled in performing exams and collecting evidence from patients who may have experienced a sexual assault. They also can help you address pregnancy, HIV, STI, and related concerns.

GUIDELINES FOR EVIDENCE PRESERVATION:• Though it is understandable that you may wish to, try not bathe, douche, urinate, change

your clothes, eat or drink, or clean the area where you were assaulted before evidence is collected.

• Save copies of email messages, text messages, instant messages, social networking pages, pic-tures, logs, or any other documents that could be helpful in an investigation of the incident.

• Write down everything you can remember about the other person, including the location and time of the incident, a description of the alleged perpetrator, and a description of any injuries.

• Trinity Hospital, the Domestic Violence Crisis Center, and or the Title IX Coordinator can advise and assist you in the preservation of evidence. Even if you do not believe you want to pursue criminal action, it can be helpful to retain evidence in case you want it available later.

Obtain Support MeasuresSupportive measures are individualized supports that help those who may have experienced incidents of sexual harassment, including sexual assault, or other sexual misconduct, to continue with their studies or work.The Title IX Coordinator will ensure that supportive measures are individually tailored to meet each individu-al’s unique needs.Supportive measures may be implemented at any time and may include but not limited to:• Course-related extensions and adjustments• University-issued and enforced no contact orders• Work and/or course schedule adjustments• Changes in housing or seating• Leaves of absence• Increased monitoring of specific areas on campus

IMPORTANT NOTE: You do not have to file a formal complaint with the University Title IX Coordinator or a report to Campus Security or Minot Police Department in order to receive supportive measures.

Reporting to the University’s Safety and SecurityMembers of the campus community are strongly encouraged to report instances of sexual harassment, sexual assault, domestic violence, dating violence, or stalking to Campus Security. On your request, University officials will assist you in notifying Security and/or local police.

By reporting to Campus Security, you are not committing to file charges or to testify in court. Individuals who report that they have experienced an incident of sexual harassment, sexual assault, domestic violence, dating violence, or stalking, whether on or off campus, will be provided with a written explanation of their rights and options as well as resources and services available both on campus and in the community.

DO YOU WANT TO REPORT THE INCIDENT TO THE POLICE? While the University encour-ages reporting incidents of sexual violence, the choice belongs to you.

What is a no contact order?A no contact order is issued by the University and is designed to limit or prohibit contact or communications between or among individuals. No contact orders generally are mutual, meaning that they restrict each party from contacting, or communicating with, the other. The Title IX Coordinator can provide you more information about no contact orders.

What is protection order?A protection order is a civil order that provides protection from harm by a family or household member, includ-ing someone you are dating.

If I possess a protection order, how can the University help me?The University complies with North Dakota law and out of state orders in recognizing protection orders.

If you obtain a protection order or have a copy of an existing protection order from domestic or dating abuse, harassment, stalking, or sexual assault from any state in the United States, you should provide a copy to Campus Security and to the Title IX Coordinator.

If you have a protection order, you may meet with Campus Security and or the Title IX Coordinator to develop a safety action plan.

V. PREVENTIONCampus community members have the power to influence peers and societal norms. Bystander intervention is one of the most effective ways to prevent sexual harassment and sexual misconduct. StepUP! is the University’s bystander intervention program to educate students about how to be proactive in helping others.

Safety is a PriorityBefore jumping into a potentially dangerous situation, be smart and think about your own safety.Ask yourself these questions:• How can I keep myself safe in this situation?• What are all the options available?• Who else might be able to assist me?

Aside from safety in numbers, you may have more influence on the situation when you work together with someone else or even several people.

The 3 "D"s of Bystander InventionRemember the 3 "D"s in your role as an active bystander: • Direct: Give commands or orders. • Distract: Draw away or divert attention.• Delegate: Appoint someone else.

Ways to Be an Active BystanderHere are three ways that you can StepUP: • StepUP to help someone who may be a target.• StepUP to stop friends or others from becoming an offender.• StepUP to either stop an assault in progress or intervene before the crime occurs.

Be aware of inappropriate touching, suggestive remarks, attempts to get someone alone, pressuring someone to drink, violent behavior, and targeting someone who is impaired.

Examples of Bystander Intervention• Direct: Point out threatening or inappropriate behavior in a safe, respectful manner.• Distract: Make up an excuse to help the friend get away from someone who might pose danger.• Delegate: Alert a bartender or party host that someone has had too much to drink.
