Most professions as well as successful organizations are judged on their rules and policies that determine the manner in which individuals within these organizations conduct themselves. The police are entrusted with enormous authority, which causes justifiable concern on the part of the public. The potential for errors and abuse and the resulting consequences demonstrate the need for formal policy guidelines to help govern police discretion and insure uniformity. Individual adherence to the directives and guidelines presented in this manual enables the Department to function in the most effective manner and will provide the people of Fairfax with the knowledge that they are receiving quality police service based upon professional standards set forth in this document. Since no arbitrary rule or procedure can be established that will embrace all possible situations, some matters must necessarily be left to the discretion and sound judgment of the individual officer using the guidelines of established policy. To this end, the Fairfax Police Department includes policies, procedures, regulations and general information for the assistance and guidance of the members of the department. This manual is a living document that is subject to yearly review, reflecting the changing needs and methodologies brought about by new laws, court decisions and policy modifications deemed appropriate by the Department, including suggestions brought forward by the employees. Each employee is provided a copy of this manual and is responsible to be thoroughly familiar with its contents.     LAW ENFORCEMENT CODE OF ETHICSAs a law enforcement officer, my fundamental duty is to serve the community; to safeguardlives and property; to protect the innocent against deception, the weak against oppression orintimidation and the peaceful against violence or disorder; and to respect the constitutional rightsof all to liberty, equality and justice.

    I will keep my private life unsullied as an example to all and will behave in a manner that doesnot bring discredit to me or to my agency. I will maintain courageous calm in the face of danger,scorn or ridicule; develop self-restraint; and be constantly mindful of the welfare of others. Honestin thought and deed both in my personal and official life, I will be exemplary in obeying the lawand the regulations of my department. Whatever I see or hear of a confidential nature or that isconfided to me in my official capacity will be kept ever secret unless revelation is necessary inthe performance of my duty.

    I will never act officiously or permit personal feelings, prejudices, political beliefs, aspirations,animosities or friendships to influence my decisions. With no compromise for crime and withrelentless prosecution of criminals, I will enforce the law courteously and appropriately withoutfear or favor, malice or ill will, never employing unnecessary force or violence and never acceptinggratuities.

    I recognize the badge of my office as a symbol of public faith, and I accept it as a public trust to beheld so long as I am true to the ethics of police service. I will never engage in acts of corruptionor bribery, nor will I condone such acts by other police officers. I will cooperate with all legallyauthorized agencies and their representatives in the pursuit of justice.

    I know that I alone am responsible for my own standard of professional performance and will takeevery reasonable opportunity to enhance and improve my level of knowledge and competence.

    I will constantly strive to achieve these objectives and ideals, dedicating myself before God to mychosen profession . . . law enforcement.

    Law Enforcement Authority100.1 PURPOSE AND SCOPEThe purpose of this policy is to affirm the authority of the members of the Fairfax PoliceDepartment to perform their functions based on established legal authority.

    100.2 PEACE OFFICER POWERSSworn members of this [department/office] are authorized to exercise peace officer powerspursuant to applicable state law (Penal Code § 830.1 et seq.).

    100.2.1 DELIVERY TO NEAREST MAGISTRATEWhen an officer makes an arrest pursuant to a warrant with bail set, and the warrant was issuedin a county other than where the person was arrested, the officer shall inform the person in writingof the right to be taken before a magistrate in the county where the arrest occurred (Penal Code§ 821; Penal Code § 822).

    100.2.2 ARREST AUTHORITY OUTSIDE THE JURISDICTION OF THE FAIRFAX POLICEDEPARTMENTThe arrest authority outside the jurisdiction of the Fairfax Police Department includes (Penal Code§ 830.1; Penal Code § 836):

    (a) When the officer has probable cause to believe the person committed a felony.

    (b) When the officer has probable cause to believe the person has committed amisdemeanor in the presence of the officer and the officer reasonably believes thereis immediate danger to person or property or of escape.

    (c) When the officer has probable cause to believe the person has committed amisdemeanor for which an arrest is authorized even if not committed in the presence ofthe officer such as certain domestic violence offenses and there is immediate dangerto person or property or of escape or the arrest is mandated by statute.

    (d) When authorized by a cross jurisdictional agreement with the jurisdiction in which thearrest is made.

    (e) In compliance with an arrest warrant.

    On-duty arrests will not generally be made outside the jurisdiction of this [department/office] exceptin cases of hot or fresh pursuit, while following up on crimes committed within the Town, or whileassisting another agency.

    On-duty officers who discover criminal activity outside the jurisdiction of the Town shouldwhen circumstances permit, consider contacting the agency having primary jurisdiction beforeattempting an arrest.

    100.2.3 ARREST AUTHORITY INSIDE THE JURISDICTION OF THE FAIRFAX POLICEDEPARTMENTThe arrest authority within the jurisdiction of the Fairfax Police Department includes (Penal Code§ 830.1; Penal Code § 836):

    (a) When the officer has probable cause to believe the person has committed a felony,whether or not committed in the presence of the officer.

    (b) When the officer has probable cause to believe the person has committed amisdemeanor in this jurisdiction and in the presence of the officer.

    (c) When the officer has probable cause to believe the person has committed a publicoffense outside this jurisdiction, in the presence of the officer and the officer reasonablybelieves there is an immediate danger to person or property, or of escape.

    (d) When the officer has probable cause to believe the person has committed amisdemeanor for which an arrest is authorized or required by statute even though theoffense has not been committed in the presence of the officer such as certain domesticviolence offenses.

    (e) In compliance with an arrest warrant.

    100.2.4 TIME OF MISDEMEANOR ARRESTSOfficers shall not arrest a person for a misdemeanor between the hours of 10:00 p.m. of any dayand 6:00 a.m. of the next day unless (Penal Code § 840):

    (a) The arrest is made without a warrant pursuant to Penal Code § 836 which includes:

    1. A misdemeanor committed in the presence of the officer.

    2. Misdemeanor domestic violence offenses (See the Domestic Violence Policy).

    (b) The arrest is made in a public place.

    (c) The arrest is made with the person in custody pursuant to another lawful arrest.

    (d) The arrest is made pursuant to a warrant which, for good cause shown, directs that itmay be served at any time of the day or night.

    100.2.5 OREGON AUTHORITYSworn members of this [department/office] who enter the state of Oregon in order to provideor attempt to provide law enforcement assistance have Oregon peace officer authority within50 miles from the California-Oregon border (ORS 133.405). Such authority shall only applywhen officers are acting:

    (a) In response to a request for law enforcement assistance initiated by an Oregon sheriff,constable, marshal, municipal police officer or member of the Oregon State Police.

    (b) In response to a reasonable belief that emergency law enforcement assistance isnecessary to preserve life, and circumstances make it impractical for Oregon lawenforcement officials to formally request assistance.

    (c) For the purpose of assisting Oregon law enforcement officials with emergencyassistance in response to criminal activity, traffic accidents, emergency incidents

    or other similar public safety situations, regardless of whether an Oregon lawenforcement official is present at the scene of the incident.

    Fairfax Police Department officers have no authority to enforce Oregon traffic or motor vehiclelaws.

    Whenever practicable, officers should seek permission from a [department/office] supervisorbefore entering Oregon to provide law enforcement services. As soon as practicable, officers exercising law enforcement authority in Oregon shall submit any appropriate written reportsconcerning the incident to the Oregon agency having primary jurisdiction over the area in whichthe incident occurred.

    100.3 POLICYIt is the policy of the Fairfax Police Department to limit its members to only exercise the authoritygranted to them by law.

    While this [department/office] recognizes the power of peace officers to make arrests and takeother enforcement action, officers are encouraged to use sound discretion in the enforcement ofthe law. This [department/office] does not tolerate the abuse of law enforcement authority.

    100.4 INTERSTATE PEACE OFFICER POWERSPeace officer powers may be extended to other states:

    (a) As applicable under interstate compacts, memorandums of understanding or mutualaid agreements in compliance with the laws of each state.

    (b) When an officer enters an adjoining state in close or fresh pursuit of a person believedto have committed a felony (ARS § 13-3832; NRS 171.158; ORS 133.430).

    The person arrested out of state must be taken without unnecessary delay before a magistrate ofthe county in which the arrest was made (ARS § 13-3833; NRS 171.158; ORS 133.440).

    100.5 CONSTITUTIONAL REQUIREMENTSAll members shall observe and comply with every person’s clearly established rights under theUnited States and California Constitutions.

    Oath of Office104.1 PURPOSE AND SCOPEThe purpose of this policy is to ensure that oaths, when appropriate, are administered todepartment members.

    104.2 POLICYIt is the policy of the Fairfax Police Department that, when appropriate, department membersaffirm the oath of their office as an expression of commitment to the constitutional rights of thoseserved by the Department and the dedication of its members to their duties.

    104.3 OATH OF OFFICEAll department members, when appropriate, shall take and subscribe to the oaths or affirmationsapplicable to their positions. All sworn members shall be required to affirm the oath of officeexpressing commitment and intent to respect constitutional rights in discharging the duties of alaw enforcement officer (Cal. Const. Art. 20, § 3; Government Code § 3102). The oath shall beas follows:

    “I, (employee name), do solemnly swear (or affirm) that I will support and defend the Constitutionof the United States and the Constitution of the State of California against all enemies, foreignand domestic; that I will bear true faith and allegiance to the Constitution of the United Statesand the Constitution of the State of California; that I take this obligation freely, without any mentalreservation or purpose of evasion; and that I will well and faithfully discharge the duties uponwhich I am about to enter.”

    104.4 MAINTENANCE OF RECORDSThe oath of office shall be filed as prescribed by law (Government Code § 3105).

    Policy Manual106.1 PURPOSE AND SCOPEThe manual of the Fairfax Police Department is hereby established and shall be referred to asthe Policy Manual or the manual. The manual is a statement of the current policies, rules andguidelines of this department. All members are to conform to the provisions of this manual.

    All prior and existing manuals, orders and regulations that are in conflict with this manual arerescinded, except to the extent that portions of existing manuals, procedures, orders and otherregulations that have not been included herein shall remain in effect, provided that they do notconflict with the provisions of this manual.

    106.2 POLICYExcept where otherwise expressly stated, the provisions of this manual shall be consideredas guidelines. It is recognized that the work of law enforcement is not always predictable andcircumstances may arise which warrant departure from these guidelines. It is the intent of thismanual to be viewed from an objective standard, taking into consideration the sound discretionentrusted to members of this department under the circumstances reasonably available at thetime of any incident.

    106.2.1 DISCLAIMERThe provisions contained in the Policy Manual are not intended to create an employment contractnor any employment rights or entitlements. The policies contained within this manual are for theinternal use of the Fairfax Police Department and shall not be construed to create a higher standardor duty of care for civil or criminal liability against the Town, its officials or members. Violations ofany provision of any policy contained within this manual shall only form the basis for departmentadministrative action, training or discipline. The Fairfax Police Department reserves the right torevise any policy content, in whole or in part.

    106.2.2 STAFFStaff shall consist of the Chief of Police and the sergeants. Staff shall review all recommendationsregarding proposed changes to the manual at Staff meetings.

    106.2.3 OTHER PERSONNELAll Department employees suggesting revision of the contents of the Policy Manual shall forwardtheir suggestion, in writing, to their Chief of Police who will consider the recommendation andforward to staff.

    106.3 AUTHORITYThe Chief of Police shall be considered the ultimate authority for the content and adoption ofthe provisions of this manual and shall ensure compliance with all applicable federal, state andlocal laws. The Chief of Police or the authorized designee is authorized to issue DepartmentalDirectives, which shall modify those provisions of the manual to which they pertain. Departmental

    106.6 PERIODIC REVIEW OF THE POLICY MANUALThe Chief of Police will ensure that the Policy Manual is periodically reviewed and updated asnecessary.

    106.7 REVISIONS TO POLICIESAll revisions to the Policy Manual will be provided to each member on or before the date the policybecomes effective. Each member will be required to acknowledge that he/she has reviewed therevisions and shall seek clarification from an appropriate supervisor as needed.

    Members are responsible for keeping abreast of all Policy Manual revisions.

    Each Chief of Police will ensure that members under his/her command are aware of any PolicyManual revision.

    200.2 DIVISIONSThe Chief of Police is responsible for administering and managing the Fairfax Police Department.There are two divisions in the Police Department as follows:

    • Support Services Division

    • Field Operations Division

    200.2.1 SUPPORT SERVICES DIVISIONThe Support Services Division is commanded by a Lieutenant, whose primary responsibility is toprovide general management direction and control for the Support Services Division. The SupportServices Division consists of Technical Services and Administrative Services.

    200.2.2 FIELD OPERATIONS DIVISIONThe Field Operations Division is commanded by a Lieutenant, whose primary responsibility is toprovide general management direction and control for the Field Operations Division.     200.3 COMMAND PROTOCOL

    200.3.1 SUCCESSION OF COMMANDThe Chief of Police exercises command over all personnel in the Department. During plannedabsences the Lieutenant will serve as the acting Chief of Police. In the absence of a Lieutenant,the Chief of Police will designate a Sergeant to serve as the acting Chief of Police.

    Except when designated as above, the order of command authority in the absence or unavailabilityof the Chief of Police is as follows:

    (a) Field Operations Lieutenant

    (b) Support Services Lieutenant

    (c) Watch Commander

    200.3.2 UNITY OF COMMANDThe principles of unity of command ensure efficient supervision and control within the Department.Generally, each employee shall be accountable to one supervisor at any time for a givenassignment or responsibility.     200.3.3 ORDERSMembers shall respond to and make a good faith and reasonable effort to comply with the lawfulorder of superior officers and other proper authority.

    200.4 ORGANIZATIONIn order to accomplish our goals the Police organization is divided into two divisions, FieldOperations and Support Services.

    200.5.2 INVESTIGATION PROGRAMThis activity includes the detective, who provides secondary follow-up and investigation servicesfor all serious criminal and civil investigations.

    (a) Gathering and disseminating intelligence data as it relates to criminal activity in thecommunity;

    (b) Evidence and property control;

    (c) Conducting preliminary follow-up crime scene examinations for physical evidence;

    (d) Conducting plain clothes patrols and surveillance for specific crimes;

    (e) Maintaining liaison with both the residential and business community by providingintelligence data for the prevention of criminal acts; and utilizing scientific investigativeequipment to verify criminal complaints.

    200.5.3 DOCUMENTSThis program is responsible for the collection and processing of all warrants, bails and thepreparation of all police reports, as well as all departmental correspondence including staff andconfidential research generated by departmental personnel.

    This unit also provides back-up support to the Communications program when Dispatchers areabsent. Other activities include relieving sworn Peace Officers of duties which do not requirePeace Officer status, such as towing and impounding vehicles, court runs and other miscellaneousduties.

    200.6 FIELD OPERATIONS DIVISION

    200.6.1 PATROLThis activity includes the other sworn positions which include a Lieutenant, Sergeants, Corporalsand Police Officers. Patrol is the principal activity of the Police Department for the regulation ofcriminal activity and for the provision of emergency and public services.

    Examples of patrol duties include:

    (a) Preventive patrol, security inspections, vacation house checks, field contacts andresponse to alarms;

    (b) Investigation into and apprehension of the perpetrators of crimes against personsand property, vice, traffic violations, offenses against public peace and order, publicintoxication, disorderly conduct, and nuisance offenses;

    (c) Control of traffic by preventive traffic patrols, accident investigation, enforcement ofparking ordinances, traffic regulation, school and traffic safety education;

    (d) Maintenance of public order in connection with parades, special events, civicdisturbance and civil defense assistance;

    (e) Public and emergency services as they relate to assistance and rescues, missingpersons, lost and found property controls, abandoned auto control, taxi inspection andother non-criminal investigations;

    (f) First level rehabilitation treatment for juvenile offenders, both traffic and criminal;

    (g) Vehicle maintenance of the department fleet and;

    (h) Reserve Officer supplement.

    200.6.2 PARKINGThe Parking Program is responsible for providing the vehicle abatement and parking complianceservices to the Town.

    200.6.3 COMMUNICATIONSThis activity includes four permanent Dispatcher positions, one part-time Dispatcher and reservedispatchers. One Dispatcher is assigned to each watch. The on-duty Dispatcher receives,prioritize and dispatches all requests for police, fire and medical services; assigns equipment andpersonnel; sends and receives information from other local, state and national law enforcementagencies via radio, telephone and computer; processes and routes reports; prepares the DailyLog, and maintains appropriate files and indexes.

    200.6.4 TRAININGThe training activity provides for all necessary training in order to qualify for, and retain, PeaceOfficer's Certification, as well as to meet the particular needs of the Fairfax Community.

    The Training program provides for overall planning and implementation of the training of bothsworn and non-sworn personnel. State mandated training consists of the Basic Academy,Advanced Officer, Field Training Officer, Supervisory, Middle Management and Executivedevelopment courses. These are all required and controlled by State law and the Town has littlecontrol in this area. All required courses are partially reimbursable by the State. In-service trainingconsists of approximately seven hours per month per person and includes areas such as firearms,qualifications, psychiatric training, police community relations, Town and department policy, newlaws and court decisions, communications, police technology, emergency medical proceduresand other refresher courses as may be necessary. Each member must satisfactorily complete alltraining in order to retain the benefits of his training/educational achievements as well as meritstep. The evaluation procedure consists of performance ratings, written and oral examinations,as well as recommendations of the Chief of Police. The Training Program itself is evaluated bythe Commission on Peace Officers Standards and Training as required by State law.

    Watch Commanders - 25

    Watch Commanders203.1 PURPOSE AND SCOPEEach patrol shift must be directed by supervisors who are capable of making decisionsand communicating in a manner consistent with departmental policies, procedures, practices,functions and objectives. To accomplish this goal, a sergeant heads each watch.

    203.1.1 DESIGNATION AS ACTING WATCH COMMANDERWhen a sergeant is unavailable for duty as watch commander, a corporal should be utilized. If acorporal is unavailable, in most instances the senior qualified officer shall be designated as actingwatch commander. This policy does not preclude designating officers with less seniority as anacting Watch Commander when operational needs require, or training permits.

    Departmental Directives204.1 PURPOSE AND SCOPEDepartmental Directives establish an interdepartmental communication that may be used bythe Chief of Police to make immediate changes topolicy and procedure consistent with thecurrent Memorandum of Understanding and as permitted by Government Code § 3500 et seq.Departmental Directives will immediately modify or change and supersede sections of this manualto which they pertain.

    204.1.1 DEPARTMENTAL DIRECTIVE PROTOCOLDepartmental Directives will be incorporated into the manual as required upon approval of Staff.Departmental Directives will modify existing policies or create a new policy as appropriate and willbe rescinded upon incorporation into the manual.

    All existing Departmental Directives have now been incorporated in the updated Policy Manualas of the below revision date.

    Any Departmental Directives issued after publication of the manual shall be numberedconsecutively starting with the last two digits of the year, followed by the number "01" For example,08-01 signifies the first Departmental Directive for the year 2008.

    204.2 RESPONSIBILITIES

    204.2.1 STAFFThe staff shall review and approve revisions of the Policy Manual, which will incorporate changesoriginally made by a Departmental Directive.

    204.2.2 CHIEF OF POLICEThe Chief of Police shall issue all Departmental Directives.

    204.3 ACCEPTANCE OF DEPARTMENTAL DIRECTIVESAll employees are required to read and obtain any necessary clarification of all DepartmentalDirectives.     Emergency Siren System - 27

    Emergency Siren System205.1 PURPOSE AND SCOPEThe Town maintains an Emergency Siren System for public notification in the event of a disasteror other large scale hazard to the community. The system is maintained and operated by theFairfax Police Department.

    The purpose of the Emergency Siren System is to notify the public of an immediate threat tosafety and that they should seek additional instructions via public news media, 1610 AM, or NOAAWeather Radio Emergency Alert System. The system is not intended to notify the public of a needto immediately evacuate.

    205.2 ACTIVATING THE EMERGENCY SIREN SYSTEMThe Emergency Siren System shall be activated by the Fairfax Police Dispatch Center. With theexception of monthly testing, the siren shall only be activated upon receiving orders from the PoliceWatch Commander. The Police Watch Commander should take necessary steps to coordinatethe activation with the on-duty Ross Valley Fire Chief or Battalion Chief.

    Sufficient steps should be taken to ensure public instructions are in place prior to the activationof the siren system. This should include some form of instructions for the public such as a pressrelease, 1610 AM updates, or other forms of mass dissemination of information. Additional alertinformation and procedures may be located in the Uniform Evacuation Protocol section of theFairfax Emergency Operations Plan.

    The activation codes and instructions for the system shall be maintained by the DispatchSupervisor and located in the Police Records Management System.

    205.3 LOCATIONS OF SIRENSThe primary siren is located behind the Fairfax Police Department. An additional siren is locatedon Fairfax Grade, in the 600 block of Bolinas Rd, adjacent to the MMWD Water Tank. The FairfaxGrade Siren should be utilized when there is a need to alert residents in the Cascade Canyon Area.This siren may also be used to alert citizens in the MMWD watershed or other adjacent areas.

    205.4 TESTING OF SIRENSThe Emergency Siren System shall be tested on the first Friday of each month at 11:45 AM.

    Based on environmental concerns, the Fairfax Grade Siren shall not be audibly tested betweenFebruary 1st and July 31st.

    Emergency Management Plan206.1 PURPOSE AND SCOPEThe Town has prepared an Emergency Management Plan for use by all employees in the eventof a major disaster or other emergency event. The plan provides for a strategic response by allemployees and assigns specific responsibilities in the event that the plan is activated (GovernmentCode § 8610).

    206.2 ACTIVATING THE EMERGENCY PLANThe Emergency Management Plan can be activated on the order of the official designated bylocal ordinance.

    206.2.1 RECALL OF PERSONNELIn the event that the Emergency Management Plan is activated, all employees of the FairfaxPolice Department are subject to immediate recall. Employees may also be subject to recallduring extraordinary circumstances as deemed necessary by the Chief of Police or the authorizeddesignee.

    Failure to promptly respond to an order to report for duty may result in discipline.

    206.3 LOCATION OF THE PLANThe Emergency Management Plan is available in Support Services and the Watch Commander'soffice. All supervisors should familiarize themselves with the Emergency Management Plan. TheSupport Services supervisor should ensure that department personnel are familiar with the rolespolice personnel will play when the plan is implemented.

    206.4 UPDATING OF MANUALSThe Chief of Police or designee shall review the Emergency Management Plan Manual at leastonce every two years to ensure that the manual conforms to any revisions made by the NationalIncident Management System (NIMS) and the Standardized Emergency Management System(SEMS) and should appropriately address any needed revisions.

    Disaster Response207.1 PURPOSE AND SCOPEIn the event of a natural or man-made catastrophe, all off duty Public Safety personnel shall contactand/or respond to the Fairfax Police Department for assignment.

    207.1.1 DEFINITIONSA catastrophe may be defined as a major fire, major flood, hurricane, major earthquake, majorexplosion, or any other unusual occurrence that poses a significant threat to life and property.

    207.2 POLICYOnce it is apparent that a catastrophe exists or is imminent and the off duty employee has securedhis or her individual home situation, he/she shall contact the Fairfax Police Department includingthe communications center, for instructions, as soon as possible. Employees should anticipatethat in times of such a catastrophe that normal means of communications including hard linetelephone, cellular phone and paging systems may be inoperable. In the event that the normalexisting communications systems fail, the employee shall report to his/her Department, if it iswithin the county, if not, they should proceed to the pre-designated staging area, in their Countyof residence or in which they are presently located. The ranking Marin County Peace Officer willbe the officer in charge of each staging area.

    207.3 PROCEDURESThose personnel equipped with pagers or cellular telephones should check their operationalstatus of their equipment. It is anticipated that during any such catastrophe that the Marin CountyEmergency Operations Center will be open. The Marin County Sheriff's Office of EmergencyServices shall be the lead agency tasked to make transportation arrangement to get Marin CountyPublic Safety Personnel into the County. Information may be obtained by listening to KCBS radio(740 am). KCBS is the designated region wide public address radio station for public safetyemployees to respond to their pre-designated staging areas in the time of emergency. Off dutypersonnel should prepare to return for work up to 72 hours and should report to their work locationor staging areas with all needed personal necessities.

    If no contact is made or any notification is received within two hours of the event, all personnelshall report to the pre-designated staging area within their respective County of their residenceor location. All employees with City owned vehicles shall report to the staging area, with thosevehicles, as available.

    In the event that normal communication infrastructure has failed members of RACES will be taskedto staging areas to facilitate communications to the EOC.

    Training Policy208.1 PURPOSE AND SCOPEIt is the policy of this department to administer a training program that will provide for theprofessional growth and continued development of its personnel. By doing so, the Department willensure its personnel possess the knowledge and skills necessary to provide a professional levelof service that meets the needs of the community.

    208.2 PHILOSOPHYThe Department seeks to provide ongoing training and encourages all personnel to participatein advanced training and formal education on a continual basis. Training is provided within theconfines of funding, requirements of a given assignment, staffing levels, and legal mandates.Whenever possible, the Department will use courses certified by the California Commission onPeace Officer Standards and Training (POST).

    208.3 OBJECTIVESThe objectives of the Training Program are to:

    (a) Enhance the level of law enforcement service to the public

    (b) Increase the technical expertise and overall effectiveness of our personnel

    (c) Provide for continued professional development of department personnel

    208.4 TRAINING PLANA training plan will be developed and maintained by the Training Manager. It is the responsibilityof the Training Manager to maintain, review, and update the training plan on an annual basis. Theplan will address the following areas:

    (Agency-specific training areas)

    208.5 TRAINING NEEDS ASSESSMENTThe Training Bureau will conduct an annual training-needs assessment of the Department. Theneeds assessment will be reviewed by staff. Upon approval by the staff, the needs assessmentwill form the basis for the training plan for the fiscal year.

    208.6 TRAINING COMMITTEEThe Training Manager shall establish a Training Committee, which will serve to assist withidentifying training needs for the Department.

    The Training Committee shall be comprised of at least three members, with the senior rankingmember of the committee acting as the chairperson. Members should be selected based on theirabilities at post-incident evaluation and at assessing related training needs. The Training Managermay remove or replace members of the committee at his/her discretion.

    The Training Committee should review certain incidents to determine whether training would likelyimprove future outcomes or reduce or prevent the recurrence of the undesirable issues related tothe incident. Specific incidents the Training Committee should review include, but are not limited to:

    (a) Any incident involving the death or serious injury of an employee.

    (b) Incidents involving a high risk of death, serious injury or civil liability.

    (c) Incidents identified by a supervisor as appropriate to review to identify possible trainingneeds.

    The Training Committee should convene on a regular basis as determined by the TrainingManager to review the identified incidents. The committee shall determine by consensus whethera training need exists and then submit written recommendations of its findings to the TrainingManager. The recommendation should not identify specific facts of any incidents, such as identitiesof employees involved or the date, time and location of the incident, but should focus on the typeof training being recommended.

    The Training Manager will consider the recommendations of the committee and determine whattraining should be addressed, taking into consideration the mission of the Department andavailable resources.

    208.7 TRAINING PROCEDURES

    (a) All employees assigned to attend training shall attend as scheduled unless previouslyexcused by their immediate supervisor. Excused absences from mandatory trainingshould be limited to the following:

    1. Court appearances

    2. First choice vacation

    3. Sick leave

    4. Physical limitations preventing the employee’s participation.

    5. Emergency situations

    (b) When an employee is unable to attend mandatory training, that employee shall:

    1. Notify his/her supervisor as soon as possible but no later than one hour priorto the start of training.

    2. Document his/her absence in a memorandum to his/her supervisor.

    3. Make arrangements through his/her supervisor and the Training Manager toattend the required training on an alternate date.

    Lobby Safety209.1 PURPOSE AND SCOPEThis policy establishes procedures for dealing with emergency calls for service in the lobby areaof the Fairfax Police Department. It lists those safeguards, which are in place and designed toprovide a safe and secure environment for Police Department personnel.

    209.2 EMERGENCY LOBBY PROCEDURESThe following procedures shall be adhered to in the event of an emergency at the front counterarea of the communications office at the Police Department.

    (a) When police department employees working in the communications/front counter arearecognize a potential hazard the following steps shall be taken:

    1. Notification shall be made to other personnel immediately so that assistance willbe summoned to the scene as quickly and as safely as possible.

    2. The dispatcher may secure the bullet resistant window at the counter and ifnecessary seek refuge outside the Dispatch office.

    3. If necessary, the entry door into the lobby area may be secured, preventingaccess into the building.

    (b) The following building modifications and radio procedures have been put into place inthe event of a hostile/dangerous situation at the front counter/lobby area of the PoliceDepartment.

    1. Radio Code Alert. Two "Radio Code" designations shall be utilized in the eventan officer is needed at the Station for a volatile of dangerous situation. Thesecodes may be utilized by an assistant dispatcher or dispatcher over the internalpaging system of the Department to those officers in the building, or by thedispatcher, to alert those officers on the street. These codes will be as follows:

    (a) "11-19 A&D." The use of this code will designate that an armed and/ordangerous individual is in the lobby area of the Police Department.

    (b) "11-19." The use of this code will be for the same situation as listedabove, except there is no indication of the individual being armed and/ordangerous.

    2. Front Counter Window in the Dispatch Center. The window in the DispatchCenter is made of bullet-resistant polycarbonate for safety. Clerical personnelseeking refuge in this area should close and lock this window for maximumprotection.

    3. Door to Town Hall Complex. The door to the Town Hall Complex can beelectronically controlled and locked for safety and security.

    209.3 LOBBY SECURITY PROCEDURES

    (a) Front Lobby Doors. The front doors leading to the lobby area of the Police Departmentwill be open 24 hours a day, 7 days a week, including holidays minus an emergencysituation.

    (b) Lobby Bathroom doors. The lobby bathroom doors will be open at all times. Anyperson wishing to use these facilities will be admitted, except when they are closedfor cleaning or repair.

    (c) Front Lobby Employee Door. The employee door that allows access beyond the lobbyshall be kept closed and locked at all times.

    209.4 RECOMMENDATIONSIt is the duty and responsibility of any employee of the Police Department finding a situation theybelieve requires attention to maintain or increase lobby safety to submit written recommendationsto any supervisor. These recommendations will be reviewed and considered by the Chief of Police.

    Electronic Mail212.1 PURPOSE AND SCOPEThe purpose of this policy is to establish guidelines for the proper use and application ofthe Department’s electronic mail (email) system by employees of this department. Email is acommunication tool available to employees to enhance efficiency in the performance of job dutiesand is to be used in accordance with generally accepted business practices and current law(e.g., California Public Records Act). Messages transmitted over the email system must only bethose that involve official business activities or contain information essential to employees for theaccomplishment of business-related tasks and/or communication directly related to the business,administration, or practices of the Department.

    212.2 EMAIL RIGHT OF PRIVACYAll email messages, including any attachments, that are transmitted over department networks areconsidered department records and therefore are department property. The Department reservesthe right to access, audit or disclose, for any lawful reason, any message including any attachmentthat is transmitted over its email system or that is stored on any department system.

    The email system is not a confidential system since all communications transmitted on, to or fromthe system are the property of the Department. Therefore, the email system is not appropriatefor confidential communications. If a communication must be private, an alternative method tocommunicate the message should be used instead of email. Employees using the Department’semail system shall have no expectation of privacy concerning communications utilizing the system.

    Employees should not use personal accounts to exchange email or other information that is relatedto the official business of the Department.

    212.3 PROHIBITED USE OF EMAILSending derogatory, defamatory, obscene, disrespectful, sexually suggestive and harassing orany other inappropriate messages on the email system is prohibited and may result in discipline.

    Email messages addressed to the entire department are only to be used for official businessrelated items that are of particular interest to all users and must be approved by the Chief of Policeor a Chief of Police. Personal advertisements are not acceptable.

    It is a violation of this policy to transmit a message under another user’s name. Users arestrongly encouraged to log off the network when their computer is unattended. This added securitymeasure would minimize the misuse of an individual’s email, name and/or password by others.

    212.4 EMAIL RECORD MANAGEMENTEmail may, depending upon the individual content, be a public record under the California PublicRecords Act and must be managed in accordance with the established records retention scheduleand in compliance with state law.

    (a) At least one supervisor shall be deployed during each watch with the exception of thehours from 0300 to 0700, unless otherwise approved by the Chief of Police.

    (b) Minimum staffing levels should result in the scheduling of at least two officers duringFriday and Saturday nights between the hours of 2100 and 0300 and one officer atall other times.

    216.2.1 SUPERVISION DEPLOYMENTSWhen a supervisor or corporal, is not on duty, a qualified senior officer may act as watchcommander as outlined in Policy Manual § 203.

    License to Carry a Firearm218.1 PURPOSE AND SCOPEThe Chief of Police is given the statutory discretion to issue a license to carry a firearm to residentswithin the community (Penal Code § 26150; Penal Code § 26155). This policy will provide a writtenprocess for the application and issuance of such licenses. Pursuant to Penal Code § 26160, thispolicy shall be made accessible to the public.

    218.1.1 APPLICATION OF POLICYNothing in this policy shall preclude the Chief or other head of a municipal police [department/office] from entering into an agreement with the Sheriff of the county or preclude the Sheriff of thecounty from entering into an agreement with the Chief of any municipal police [department/office] to process all applications and license renewals for the carrying of concealed weapons (PenalCode § 26150; Penal Code § 26155).

    218.2 POLICYThe Fairfax Police Department will fairly and impartially consider all applications to carry firearmsin accordance with applicable law and this policy.

    218.3 QUALIFIED APPLICANTSIn order to qualify for a license to carry a firearm, the applicant must meet certain requirements,including:

    (a) Be a resident of the Town of Fairfax (Penal Code § 26150; Penal Code § 26155).

    (b) Be at least 21 years of age (Penal Code § 29610).

    (c) Fully complete an application that will include substantial personal information. Muchof the information in the application may be subject to public access under the PublicRecords Act.

    (d) Be free from criminal convictions that would disqualify the applicant from carrying afirearm. Fingerprints will be required and a complete criminal background check willbe conducted.

    (e) Be of good moral character (Penal Code § 26150; Penal Code § 26155).

    (f) Show good cause for the issuance of the license (Penal Code § 26150; Penal Code§ 26155).

    (g) Pay all associated application fees. These fees are set by statute and may not berefunded if the application is denied.

    (h) Provide proof of ownership or registration of any firearm to be licensed.

    (i) Be free from any psychological conditions that might make the applicant unsuitablefor carrying a firearm (Penal Code § 26190).

    (j) Complete required training (Penal Code § 26165).

    218.4 APPLICATION PROCESSThe application process for a license to carry a firearm shall consist of two phases. Upon thesuccessful completion of each phase, the applicant will advance to the next phase until the processis completed and the license is either issued or denied.

    218.4.1 PHASE ONE (TO BE COMPLETED BY ALL APPLICANTS)

    (a) Any individual applying for a license to carry a firearm shall first fully complete aCalifornia Department of Justice (DOJ) application to be signed under penalty ofperjury. Any applicant who provides false information or statements on the applicationwill be removed from further consideration and may be prosecuted for a criminaloffense (Penal Code § 26180).

    1. In the event of any discrepancies in the application or background investigation,the applicant may be required to undergo a polygraph examination, at no costto the applicant.

    2. If an incomplete application package is received, the Chief of Police orauthorized designee may do any of the following:

    (a) Require the applicant to complete the package before any furtherprocessing.

    (b) Advance the incomplete package to phase two for conditional processingpending completion of all mandatory conditions.

    (c) Issue a denial if the materials submitted at the time demonstrate thatthe applicant would not qualify for a license to carry a firearm even ifthe package was completed (e.g., not a resident, disqualifying criminalconviction, absence of good cause).

    (b) At the time the completed application is submitted, the applicant shall submit a checkmade payable to the California Department of Justice for the required California DOJapplication fee, along with a separate check made payable to the Town of Fairfax fora nonrefundable 20 percent of the application fee to cover the cost of processing theapplication (Penal Code § 26190).

    1. Additional fees may be required for fingerprinting, training or psychologicaltesting, in addition to the application fee.

    2. Full payment of the remainder of the application fee will be required uponissuance of a license.

    3. Payment of related fees may be waived if the applicant is a duly appointedreserve peace officer as defined in Penal Code § 830.6 (a) or (b) (Penal Code§ 26170).

    (c) The applicant shall be required to submit to fingerprinting and a complete criminalbackground check by the California DOJ. A second set of fingerprints may be requiredfor retention in [department/office] files. Two recent passport-size photos (2 inches by2 inches) of the applicant shall be submitted for [department/office] use. No persondetermined to fall within a prohibited class described in Penal Code § 29800, PenalCode § 29900, Welfare and Institutions Code § 8100 or Welfare and Institutions Code

    § 8103 will be issued a license to carry a firearm. A license shall not be issued if theCalifornia DOJ determines that the applicant is prohibited by state or federal law frompossessing, receiving, owning or purchasing a firearm (Penal Code § 26195).

    (d) The applicant should submit at least three signed letters of character reference fromindividuals other than relatives.

    (e) The applicant shall submit proof of ownership or registration of each firearm to belicensed.

    Once the Chief of Police or authorized designee has reviewed the completed application packageand relevant background information, the application will either be advanced to phase two ordenied.
