Case Committee Each year's FDI Moot Case Committee begins its work the preceding June. Liaising with the FDI Moot's Board and Organisers, it develops a fact scenario and procedural background. Generally, the case evolves on the basis that the home and host State are parties to an IIA (BIT, MIT, etc), the New York Convention of 1958 and the Washington (ICSID) Convention of 1965.Generally, each year's case will involve one or two "procedural" issues (e.g. jurisdiction, admissibility, interim measures, disqualification of arbitrator) and one or two "substantive" issues (e.g. expropriation, denial of justice, discriminatory treatment, violation of fair and equitable treatment and/or full protection and security standards). The Case Committee submits its final draft to the FDI Moot Organisers and Board for approval at the end of the preceding year, and the case is then published in February each year. The Case Committee remains responsible for responding to any requests for clarification (if scheduled) between June and August of each year.

The 2019 case involves the Respondent State blocking social media platforms for their alleged part in fomenting civil unrest. The three Claimants allege expropriation and violation of fair and equitable treatment, while the Respondent objects to the ICSID tribunal’s jurisdiction on the basis of its denunciation of the ICSID Convention and the plurality of Claimants. The Respondent also seeks to enjoin the Claimants’ international media campaign against it while the proceedings are in progress.

Bench Brief Committee Each year's FDI Moot Bench Brief Committee begins its work in March. It analyses the fact scenario and procedural background of the case and may submit confidential requests for clarification to the Case Committee (contemporaneously with the requests of the competing teams) and may liaise with the Case Committee and the Organisers regarding proposed responses to the requests. The FDI Moot's Bench Brief Committee submits its final draft of the Bench Brief to the Organisers one week before the memorial deadline each year. The Bench Brief Committee may submit a revised draft one week before the orals if it believes the teams' memorials have raised relevant, not previously considered arguments.

National Rounds FDI Moot National Rounds 2019 listed in alphabetical order.

Egypt National Orals

Matouk Bassiouny & Hennawy’s arbitration department hosted the first Egypt National Round of the FDI Moot on 6-7 September 2019 in their office in Garden City, Cairo.

The Egypt National Orals are qualifying rounds, all teams from Egypt must participate with the top National team advancing directly to the Global Rounds. Teams do not need to submit skeleton briefs, and are evaluated on their oral performance only.

The winning team was Ain Shams University who participated under the team alias of Caicedo and subsequently proceeded to the Global Orals as team Visscher.

Ethiopia National Orals

The Ethiopia National Orals are qualifying rounds.

All teams from Ethiopia must participate with the top national team advancing directly to the All Africa Regional, or in case of overwhelming Internet and electricity problems, directly to the Global Rounds.

They do not, however, need to submit skeleton briefs, and are evaluated on their oral performance only.

Haramaya University is the local organiser and host of the Ethiopia National Orals which took place 12-13 October 2019 for the first time.

Having participated in the FDI Moot since 2014 it was no surprise that Haramaya University also won the National Orals as team Callinan. Unfortunately, due to visa issues the team could not participate in the Global Orals in Miami.

Kenya National Orals

The Kenya National Orals are qualifying rounds.

All teams from Kenya must participate with the top national teams advancing to the (virtual) All Africa Regional. They do not, however, need to submit skeleton briefs, and are evaluated on their oral performance only.

Africa Nazarene University is the local organiser and host of the Kenya National Orals which took place 16-17 July 2019. The organizing committee furthermore consists of representatives of

Mount Kenya University and Strathmore University as well.

The best teams from Kenya were Strathmore University (Higgins, Winner of the Kenya Oral Finals) and Africa Nazarene University (Fischer, Runner Up of the Kenya Oral Finals) with both teams advancing to the All Africa Regional Rounds.

South Africa National Orals The South Africa National Orals are qualifying rounds.

All teams from South Africa must participate with the top national teams advancing to the (virtual) All Africa Regional. They do not, however, need to submit skeleton briefs, and are evaluated on their oral performance only.

The Student Litigation Society was the local organiser of the South Africa National Orals which took place 3-6 July 2019.

The best teams from South Africa were University of KwaZulu-Natal, Pietermaritzburg (Aranguren, Winner of the South Africa Oral Finals) and a second team from University of KwaZulu-Natal, Pietermaritzburg (Schwebel, Runner Up of the South Africa Oral Finals) with both advancing to the All Africa Regional Rounds.

Viet Nam National Orals The Viet Nam National Orals are qualifying rounds.

All teams from Viet Nam must participate with the top national teams advancing to the Asia Pacific Regional. They do not, however, need to submit skeleton briefs, and are evaluated on their oral performance only.

The Vietnam Society of International Law VSIL is the local organiser of the Viet Nam National Orals which were hosted

in Ha Noi 7-10 July 2019.

The best teams from Viet Nam were Hanoi Law University (Rigaux, Winner of the Viet Nam Oral Finals) and Foreign Trade University (Guggenheim, Runner Up of the Viet Nam Oral Finals) with both advancing to the Asia Pacific Regional Rounds.

Clifford Chance Singapore covered registration for winner and runner up. Sidley Austin Hong Kong covered accommodation for the winning team at the Seoul Regional.

Other winners included: Ho Chi Minh University of Economics (Guillaume) as the Most Popular Team; University of Economics and Finance (Sandjabi) was deemed the Most

Impressive Team; Ho Chi Minh University of Foreign Languages - Information Technology (Mvubidi) was the team with the Best Spirit

Individual winners were as follows: Best Advocate of the Finale: Nguyen Mai Huong (Member of Team Rigaux - Hanoi Law University); Best Advocate of the National Rounds: Nguyen Son Hoang (Member of Team Guillaume - Ho Chi Minh University of Economics); Best Advocate for the Claimant: Nguyen Hai Anh (Member of Team Riphagen - Diplomatic Academy of Vietnam); Best Advocate for the Respondent: Nguyen Nu Hong Duong (Member of Team Rigaux - Hanoi Law University) ex aequo Nguyen Thi Phuong Anh (Member of Team Riphagen - Diplomatic Academy of Vietnam); Most Stylish Advocate: Le Thi Tam Dan (Member of Team Quintana - Vietnam National University, School of Law).

Regional Rounds

All Africa Regional

The 2019 All Africa Regional were held via in early August as a virtual round, judged by renowned international arbitrators and featuring the national champions of the participating African countries. The video conference hearing times for the All Africa Regional were scheduled on conclusion of the African National Rounds.

Wilmer Hale has sponsored (2017, 2019-21) a US$1500 annual prize for the winner of the All Africa Regional. This multi-year sponsorship now gives us a solid foundation from which to seek additional support to give international opportunities to promising young lawyers in Africa.

The International Academy of Trial Lawyers (IATL) has been a prize sponsor for the Africa Regional in 2016 and 2018 and has now agreed to sponsor the US$500 annual Noël Ferris Prize for the Best Advocate of the Final Match (2019-21).

Three Crowns has donated US$3000 to the 2019 Wälde Fund earmarked to support the top teams advancing from All Africa Regional. Three Crowns has also provided coaching assistance to the winner of the FDI Moot’s All Africa Regional. Africa Nazarene University (Lalonde) prevailed in the final match against Strathmore University School of Law (Brownlie) with the Best Advocate of the Final Match being deemed to be David Salaton of ANU.

Asia Pacific Regional Orals The Asia Pacific Regional Orals took place 20-22 August 2019 and were organized by KCAB International and hosted at Seoul National University in Seoul, Korea (Republic).

Teams from the Asia Pacific Region may participate in the Global competition either via the Regional or register directly for Global participation which is limited to a maximum of four teams. The top Six Regional Orals teams advance to the Global Orals if they confirm plans on doing so. If they do not

confirm, teams move up to the vacant slots in order of rank (7th ranked oral team, quarter finalists).

If either of the top three teams confirms global participation, it also receives a monetary support from the FDI Moot Administration for travel and/or stay at the Global Orals. Teams not among the top performers may re-register if any of the four direct Global places are available still. The FDI Moot distributed a total of €5000 in prize money to top teams of the Asia Pacific Regionals for their participation at the Global Orals in Miami.

South Asia Regional Orals

The South Asia Regional Orals took place 30 August - 1 September 2019 and were organized by Kachwaha and Partners and hosted at The Indian Society of International Law, and The India International Centre in New Delhi, India.

The South Asia Regionals are qualifying rounds and all teams from the region must participate via the Regional with the top four teams advancing to the Global Rounds and eligible for support from the Thomas Wälde Team Fund.

The South Asia Regional host has arranged for subsidised registration fees for teams from India, Sri Lanka and Bhutan and for teams from Bangladesh, Nepal and Pakistan.

Teams not among the top performers in New Delhi may still top up their registration fees to take part in the Globals and are admitted to the Global Orals subject to overall capacity restrictions at the Globals, in which case such teams will be accepted according to the Regional ranking and first-come, first serve.

Global Rounds The Global Orals are organized by the Center for International Legal Studies and were hosted at University of Miami, School of Law in Coral Gables, Florida, United States.

Written Phase Memorials for claimant and respondent are each read by a minimum of three and a maximum of six memorial judges in three consecutive rounds. The results of the first round provide the basis for the grouping of memorials for the second round, and staggered results of round one and two form the basis for the grouping of memorials for the final round. Budapest Pre Moot

The 5th annual Budapest Pre Moot was hosted and organised by Eötvös Loránd University Law School, Budapest, Hungary 11-12 October 2019.

Dublin Pre Moot

The 1st annual Dublin Pre Moot was organised by Arbitration Ireland at the Dublin Dispute Resolution Centre on 1 November 2019.

Saint Petersburg Pre Moot

The 3rd annual St Petersburg Pre Moot was hosted and organised by Saint Petersburg State University, Saint Petersburg, Russia; in co-operation with The International and Comparative Law Research Center and supported by The Russian Arbitration Center 4-5 October 2019.

São Paulo Pre Moot

The 4th annual São Paulo Pre Moot was organised by Luísa Quintão and Lucas Diniz and hosted by Mattos Filho Advogados 18-20 October 2019. The winning teams were awarded a total of three flight tickets (two to the winner, one to the runner up) for a round trip in economy class sponsored by IBRACHINA.

Warsaw Pre Moot

The 9th annual Warsaw Pre Moot was organised by University of Warsaw and held at 26-27 October at the offices of Allen & Overy Warsaw.

The Thomas Wälde Team Fund

In October 2008, the late Prof. Thomas Wälde and Ian Laird initiated a fund to support teams’ participation in the FDI Moot. In 2019, €7000 were distributed among six teams. For teams from many countries, travel expenses to and accommodation costs at the hearing venue remain significant obstacles, thus we would like to thank those that responded to our appeal: Professor William Fox, Professor Shimpei Ishido, the Center for International Legal Studies (CILS), the International Academy of Trial Lawyers (IATL), the Society of International Economic Law (SIEL), and Skadden as well as Wilmer Hale and Three Crowns without whose substantial support the teams thus supported may otherwise not have been able to join the rounds in Miami.
