Made by the Governor in Executive Council.

1. Citation

These regulations are the Combat Sports Amendment Regulations 2018.

2. Commencement

These regulations come into operation as follows — (a) regulations 1 and 2 — on the day on which these

regulations are published in the Gazette; (b) the rest of the regulations — on the day after that day.

3. Regulations amended

These regulations amend the Combat Sports Regulations 2004.

FIREBREAK NOTICE

Important Notice to All Owners and/or Occupiers of Land within the City of Vincent

Pursuant to the powers conferred in Section 33 of the Bush Fires Act 1954, you are required on or before the 31st day of October 2018, and thereafter up to and including the 30th day of April 2019, to clear inflammable matter on land owned and/or occupied by you in accordance with the following requirements—

1. All land which is 2000m² or less in area—

Remove inflammable matter from the whole of the land, except living trees and shrubs; plants under cultivation and lawn, by means of ploughing, cultivating or slashing to a height of no more than 50mm.

2. All other land within the City of Vincent exceeding 2000m² (larger than average residential block size)—

(i) Firebreaks of a minimum width and height of 3 metres are to be cleared immediately inside all external boundaries of the land;

(ii) Firebreaks to a minimum width of 3 metres and height of 3 metres are to be cleared immediately surrounding all buildings situated on the land; and any place where inflammable liquids and gas products are kept.

In addition to the requirements in this notice, the City may, by notice in writing, require an owner and/or occupier to act as and when specified in the notice with respect to anything which is upon land and which in the opinion of the City is or is likely to be conducive to the outbreak of a bush fire or the spread or extension of a bush fire.

The term “Inflammable Matter” for the purpose of this notice includes bush (as defined in the Bush Fires Act 1954), timber, boxes, cartons, paper, rubbish and any other combustible or inflammable matter, but does not include buildings, green standing trees and bushes or growing bushes or plants in gardens or lawns.

All land within the City of Vincent must be cleared on or before the 31st day of October in any year and thereafter maintained clear of inflammable matter up to and including the 30th day of April in the following year.

If, for any reason, an owner and/or occupier considers it impractical to clear the land or comply with other fire protection measures in accordance with the notice, the owner and/or occupier may apply in writing to the City no later than the 31st day of October in any year for a variation. If permission is not granted in writing by the City or its authorised officer, the owner and/or occupier must comply with the requirements of this notice. Any variation granted by the City will apply only for a single Firebreak Period. A variation granted by the City shall only remain in force until the 30th day of April in the following year.

The penalty for failing to comply with this notice is a fine of not more than $5,000.00 and a person in default is also liable, whether prosecuted or not, to pay the cost of performing the work directed in this notice if it is not carried out by the owner or occupier by the date required by this notice.

Pursuant to Sections 24G(2) and 25(1a) of the Bush Fires Act 1954, the burning of garden refuse and lighting of fires in the open air is prohibited within the districts of the City of Vincent between the 31st of October 2018 and the 30th day of April 2019.

PROHIBITED AND RESTRICTED BURNING

All Areas in the Shire of Collie

Pursuant to section 24G(2) and section 25(1a) of the Bush Fires Act 1954, the burning of garden refuse and camp and cooking fires is prohibited in all areas within the Shire of Collie during the Prohibited Burning Period. Furthermore, pursuant to section 24G(2) the burning of garden refuse is prohibited within the Shire of Collie during the Restricted Burning Period unless a permit to burn has first been obtained from a Fire Control Officer. The local Bush Fire Control Officer will note the relevant conditions you must comply with on your burning permit. Furthermore, pursuant to section 24G(2) the burning of camping and cooking fires is allowed in the Shire of Collie during the Restricted Burning Period unless otherwise sign posted or fire danger rating is very high or above.

You are advised that Burning Permits are automatically invalidated on days of “very high”, “severe”, “extreme” or “catastrophic” fire danger.

Call for Public Submissions

The Western Australian Planning Commission (WAPC) is seeking public comment on a proposal to amend the Metropolitan Region Scheme (MRS) for land in the local government area of Cockburn.

This amendment proposes to rezone approximately 47.68 ha of land in the Treeby locality from the Rural-Water Protection zone to the Urban zone under the MRS, minor rationalisation of Bush Forever site 390 (addition: 1.79 ha and removal: 0.30 ha) and reserve 0.52 ha as Primary Regional Roads (includes Water Catchments reservation adjustment) associated with Armadale Road.

The amendment will allow for the residential development of the subject land, following a local scheme amendment, structure planning and subdivision approval, as outlined in the Western Australian Planning Commission amendment report.

The WAPC certifies that, in its opinion, the proposed amendment does not constitute a substantial alteration to the MRS.

5. Building envelopes to the satisfaction of Department of Biodiversity, Conservation and Attractions and the Local Government are to be identified prior to subdivision.

6. As a condition of subdivision, vegetative buffers to the operating orchards are to be implemented to the satisfaction of the Department of Health and the Department of Primary Industries and Regional Development, noting the requirements of the Bushfire Management Plan.

1. Development of the site shall be subject to an approved Local development Plan, in accordance with Part 6, Schedule 2 of the Planning and Development (Local Planning Schemes) Regulations deemed provisions 2015.

(i) adequate hazard sep-aration/defendable space provided to ensure siting and design of development minimises the level of bushfire impact; and

5. A Foreshore Management Plan is required to be prepared at Local Development Plan stage to address the increased usage of the North Knobby Head foreshore area.

ACCREDITATION CANCELLATION AND SUSPENSION NOTICE 2018

I, Richard Sellers, in my capacity as Commissioner of Main Roads, for the purpose of section 46(3) of the Road Traffic (Vehicles) Act 2012, hereby give notice of the effect of the cancellation or suspension of accreditation.

If section 33(4) or 40(2) requires a person to be accredited for a mass or dimension requirement to be modified or for an access approval to be given, and the accreditation is subsequently cancelled, the modification or approval is of no effect on and from the day of the cancellation of the accreditation.

If section 33(4) or 40(2) requires a person to be accredited for a mass or dimension requirement to be modified or for an access approval to be given, and the accreditation is subsequently suspended, the modification or approval is of no effect for the period of the suspension.
