March 28, 2018 Dear Mr. Banks: As we have discussed often, 2017 was a year of reform for Harris County Pretrial Services. However, it also was a stressful year in which we witnessed the Department successfully deal with two significant challenges. The first challenge involved a sea change in the Department’s risk assessment, interview, and supervision processes, driven by implementation of the Laura and John Arnold Foundation’s Public Safety Assessment (PSA). This effort was part of a collaborative stakeholder retooling of the initial justice system processes that made possible: (1) earlier risk assessment of all defendants in custody, and (2) earlier release from custody by least restrictive means of defendants who were at low risk of failure-to-appear and/or new criminal activity. Implementation improved the quality of information available to judicial officers for release decisions. It also helped guide the development of a risk-based supervision protocol that allows Pretrial Services to optimize use of its resources. The second challenge, coming soon after PSA implementation, was closure of the Criminal Justice Center and relocation of the Department in the wake of Hurricane Harvey. Fortunately, the Department was afforded an opportunity to relocate nearby and to keep its divisions together, but the relocation space was far from ideal. The Leadership Team collaborated with other Harris County departments to address electrical, plumbing, and networking needs. Within weeks, the Leadership Team transformed a warehouse scheduled for demolition into functional workspace that could support the Department’s operations. The Leadership Team performed admirably in working toward reform and ensuring that Pretrial Services had a solid foundation. But throughout the challenges, the Department’s efforts were sustained by its line employees and supervisors. They are praiseworthy for their demonstrated willingness to embrace change and dismiss inconvenience in pursuit of the Department’s objectives. Pretrial Services could not exist without them. With this letter, it is my privilege to present Pretrial Services’ 2017 Annual Report. I look forward to a successful and productive 2018.

Greetings All,

The mission of Harris County Pretrial Services (HCPS) is to provide accurate and timely

information to assist the judicial officers in Harris County with making informed pretrial release

decisions and to monitor defendants released on bond to promote compliance with court orders,

court appearances, and to support public safety.

In an effort to achieve our organizational mission, 2017 was the Year of REFORM for HCPS.

Specifically, it was the year to make changes to our overall operations. The changes that we

implemented are aligned with best-practices in the pretrial justice industry. Using the context of

the National Institute of Corrections’ publication entitled, A Framework for Pretrial Justice:

Essential Elements of an Effective Pretrial System and Agency (2017), we implemented the

following either in our pretrial system and/or pretrial agency:

Elements of an Effective Pretrial System (8 of 8 implemented)

1. Pretrial release and detention decisions based on risk and designed to

maximize release, court appearance, and public safety.

Implemented fully in or before July of 2017.

2. Legal framework that includes: presumption of least restrictive nonfinancial

release; restrictions or prohibition on the use of secured financial conditions

of release; and detention for a limited and clearly defined type of defendant.

Implemented in-part in or before July of 2017.

3. Release options following or in lieu of arrest.


4. Defendants eligible by statute for pretrial release are considered for release,

with no locally-imposed exclusions not permitted by statute.


5. Experienced prosecutors screen criminal cases before first appearance.


6. Defense counsel active at first appearance.


7. Collaborative group of stakeholders that employs evidence-based decision-

making to ensure a high functioning system.


8. Dedicated pretrial services agency.

Defendant Report ActivityArrests in 2017 on a new charge

where the most serious offense was a class A or B misdemeanor offense were down 10% from the previous year and down over 19% since 2013. Arrests for new felony offenses saw a 3.7% decrease in 2017 compared to 2016.

There were a total of 77,025 arrests in 2017. This included 45,578 people whose most serious charge was a new misde-meanor and 32,447 people arrested for a new felony offense. Defendants charged with felony offenses accounted for 42.1% of arrests and misdemeanors for 57.9%.

The department compiled 60,929 defendant reports on incarcerated defen-dants, screening 79.1% of the arrested population. Staff prepared 32,495 reports on defendants arrested solely for a mis-demeanor offense, compiling information on 72.9% of that population. For those defendants arrested for a felony, the per-centage was 87.6%, or 28,434 reports completed.

Other defendants interviewed in-cluded 79 defendants who originally post-ed a financial bond and were interviewed after release for consideration for a per-sonal bond and 64 interviews conducted with non-incarcerated defendants who had an open warrant, usually on a motion to adjudicate or a motion to revoke pro-bation. In addition, 209 interviews were conducted for performance, appeal, and witness bonds.

For the First Chance Intervention Program (FCIP), 477 interviews and risk assessments were conducted during the period of January through June, 2017. Of those interviewed specifically for the pro-gram, 382 were pre-charge and 95 were post-charge. In 2017, 601 people were re-ferred to FCIP. Over 83% successfully com-pleted the program.

Supervision Caseload Review


defendants. This is a 82% increase in average casel-oad size compared to last year and a 101% increase since 2015. Defendants released on personal bond for a new case comprised 67% of the average caseload; those monitored while in a CSCD program were 19.4% of the caseload; 0.08% were on a performance bond, appeal, or motion to revoke or adjudication probation with pretrial services supervision; 17% participated in the FCIP from January through June; 3% in RIC; and 3% given an unsecured bond during the period of June through December 2017.

In 2017, 63.6% of defendants arrested on a new charge were able to post bond. Most posted some form of financial bond while 14% posted a personal bond, 7.6% posted an unsecured bond, 4% early pre-sented, and 36 defendants were given an SB-7.

Of the 14,007 total defendants supervised for a new case, 1,164 (8.3%) defendants were released to the RIC docket on a personal bond.

Other defendants released on personal bond and supervised by Pretrial Services included 146 de-fendants whose appearance was required in court on a motion to adjudicate or revoke probation, who appealed a case disposition, who were required to participate in a Community Supervision & Corrections Department (CSCD) assessment program, or who were given a bond for a specific length of time after judg-ment was entered on a case before the execution of the sentence (performance bond). An additional 601 people were referred to the First Chance Intervention Program (FCIP), which ended in June 2017. During the same month, 357 defendants began receiving unse-cured bonds (BROR) for remainder of 2017.

One condition frequently ordered was the re-quirement to submit to drug testing, affecting 15% of defendants with a new case given a personal bond. A breath-alcohol analysis device, either in the form of an ignition interlock device installed in a vehicle or an in-home device, was placed on 11.3% of the defen-dants with additional conditions. The courts required 98 defendants to observe a curfew. Of those, 63 de-fendants were ordered to wear an electronic monitor-ing device.

Defendants who receive pretrial intervention through the CSCD are still on bond until the interven-tion program requirements are fulfilled and must ap-pear in court during their participation. Defendants under the department’s supervision who subsequent-ly receive pretrial intervention usually remain on a personal bond while participating in these programs and we continue to monitor their case and remind them of upcoming court dates. During 2017, 1,519 defendants were monitored for this purpose, along with 20 defendants with a motion to adjudicate or to revoke probation who were granted a personal bond with no supervision by this department other than that necessary to assure appearance in court.

While the department uses a point-of-col-lection test (POCT) to screen some defendants reporting for the first drug test after release, other specimens are sent directly to a labora-tory for analysis.

The department tested 5,230 defendants in 2017, over 227% more people than in 2016 where 1,600 defendants were tested. The de-partment performed a total of 8,129 drug tests, a 37.3% increase over last year.

There were 1,241 POCT specimens collect-ed and tested onsite, with 692 specimens, test-ing positive. . A total of 6,851 specimens were collected and sent to a laboratory for analysis, with 1,984 specimens, testing positive.

The department administered 9 tests on a deep-lung breath analysis device onsite as a re-sult of suspicion that a defendant appearing in court was intoxicated. There were no positives reported on deep lung breath analysis tests. Also, 24 transdermal patch tests were used on defendants who could not be tested by other methods,with 12 testing positive.


Drug Test Activity

The department scans the index finger of a defendant reporting for a drug test and submits it, along with the defendant’s system person number, to the Sheriff’s Department automated fingerprint identification system (AFIS). Pretrial Services then receives a pic-ture associated with those items and uses the picture to ensure the correct person reported for a drug test.

supervision accounted for 36% of all felony defendants exiting Pretrial Services supervision.

Defendants whose bonds are revoked for noncom-pliance are no longer part of the active supervision case-load; however, their cases are assigned to an FTA inves-tigator who locates fugitive defendants with outstanding warrants. Over 68% of all FTA warrants issued in 2017 were resolved by February 15, 2018.

Another 308 defendants who were monitored by the department while appealing a case disposition, ad-dressing a motion to adjudicate or revoke probation, or who were released after pleading guilty but before the imposition of a sentence saw their supervision end in 2017 - 60.4% successfully. Of 1,166 defendants enrolled in a CSCD program, 64.2% completed their diversion pro-gram or had a motion to revoke dismissed while 35.8% had their case adjudicated. Of the 1,208 people who completed the First Chance Intervention Program by July


There were 11,685 defendants under active supervision with a new case who exited supervision in 2017. Of those, 8,893 were charged with a misde-meanor offense and 2,792 had a felony offense.

Of the 8,893 misdemeanor defendants whose supervision period ended, 60.2% were not fur-ther incarcerated, 24.3% because their case was dismissed. Jail time was the sentence imposed on 4.8% of the remaining defendants. Another 34.6% had their bond revoked for noncompliance issues. Of those revoked for noncompliance, 28% were for failing to appear for a scheduled court date, 3.2% were for re-arrest on a new charge while on bond, and 3.4% for noncompliance with conditions of su-pervision (e.g., do not use drugs, abide by curfew restrictions). Fewer than 1% exited supervision for other reasons.

Of the 2,729 defendants charged with a felony, 63.6% received no additional jail time, 22.1% be-cause their case was dismissed or no-billed. Another 2.3% of defendants charged with a felony were or-dered to jail or prison. Noncompliance claimed 33% of defendants charged with a felony, 22.2% for fail-ing to appear in court, 4.8% for re-arrest on a new charge while on bond, and 5.9% for violating the conditions of release. The remainder, 1.1%, exited for reasons other than noncompliance (e.g., per-sonal bond replaced, bond was for a specific time period).

The most common sentence imposed included some form of community supervision, especially for misdemeanor cases with 21.8% entering a CSCD program. For defendants with a felony charge, CSCD
