■Starting 7/1, there are new limitations to submitting Certificates of Correction in person at the Administrative Enforcement Unit
■AEU Service tickets (same day response) are available from 9:00 – 2:30 (for named respondents and those with a DOB ID card), and can submit three per person, per day
■Express Service (next business day response) can be submitted by anyone, and can have tickets for bulk submissions (4 – 10) or 1 -3.
■There are no limitations on submitting Certificates of Correction via the mail

■Penalty is $5,000 per noncompliant device■Late inspections can be submitted up to 12 months
after the due date with a corresponding late fee of $250/month

■Chapter 8, Title 24 RCNY: DOHMH Requirements■This is separate from and in addition to Local Law 77
of 2015■Two main parties: qualified person and responsible
person■Each individual is responsible for different tasks■Tasks range from daily to quarterly/biannually
■All records must be kept and stored for at least 3 years

Cooling Tower Maintenance Basics

■DEP Triennials (Registrations and Certificates to Operate) are undergoing an adjustment
■The threshold for registrations is now increased from 2.8 million btu/hr to 4.2 million btu/hr
■Boilers that meet this threshold (Boiler Registration II) will now be eligible for Registrations (which can be completed online)
■Boilers that fall into this range must meet additional standards – contact your boiler vendor/insurance company to review and discuss.

■3 RCNY §505-01 outlines room identification/directional markings for Group 1 and Group 2 buildings
■These requirements outline identification for entrance doors and floors
■Required markings must be in place for existing buildings by March 30, 2017
■Markings for buildings seeking a final or temporary Certificate of Occupancy on or after 6/1/16 must be compliant prior to issuance
■Inspections must take place annually to make sure markings are in good repair, and records of the same must be kept

■3 RCNY §505-02 outlines emergency markings for Group 1 and Group 2 buildings with exceptions:
■8 or fewer dwelling units on a floor; buildings protected throughout by a sprinkler system; an occupancy within a building if protected throughout by a sprinkler system
■These requirements are separate from other regulations
■Required markings must be in place for existing buildings by March 30, 2018, except multi-floor dwelling unit emergency markings, which must be in place by March 30, 2017
■Markings for buildings seeking a final or temporary Certificate of Occupancy on or after 6/1/16 must be compliant prior to issuance

■This applies to elevators that service multiple units in a multifamily dwelling
■ If the DOB re-inspects a Class 1 immediately hazardous elevator violation, and the owner/manager has failed to correct it, they must refer the violation to the HPD commissioner
■The HPD commissioner will determine if the elevator violation is dangerous to human life and safety, or detrimental to health
■HPD may then initiate enforcement under the emergency repair program (in addition to DOB penalties)
■Referred elevators will be included in an annual report to the Mayor/Speaker, and publish their findings

■DOF is organizing a 90-day program incentivizing named respondents to pay outstanding judgments against them
■START DATE: SEPTEMBER 12th ■Participants can pay base penalties for defaulted
fines, and 75% of base penalties for non-defaulted fines, waiving interest in either case
■Participants must pay for all eligible penalties within the 90 days
■Participants must also enter into a written agreement for violations that require correction, and conditions must be certified correct within 6 months of the agreement

■What should I do now?■Compile reports of outstanding fines across your
portfolio, and organize by building and named respondent
■Make this recurring so you can see updated information through September
■Gather a list of all the addresses in your portfolio for possible submission to the DOF
■Begin making necessary corrections on any violations that remain open
■Bottom Line: The end of the year is always busy (safety notices, boiler and elevator inspections, and more) – don’t let this program sneak up on you. Make sure you’re prepared, and that you take advantage of it!
