Terms and Conditions

1. The student, applicant, consumer, candidate, account/fee payer, lawful guardian and/or sponsor are herein collectively referred to as the “Student”. By acceptance to Aleph Learning Academy the Student shall be jointly and severally responsible for the fulfilment of all terms of the agreement.

2. Student's right to rescind/terminate the agreement

2.1. Full-time Certificate and/or Diploma Applications

Unless a student completes his/her diploma qualification at the end of

an academic year, his/her enrolment at ALEPH Learning Academy shall

be renewed on the latest enrolment terms and procedures and at the

then applicable tuition and other fees customarily payable by the

student in respect of the qualification in question, subject to ALEPH

Learning Academy and the student concluding a new credit agreement

in respect thereof at that time.

3. Cancellation

3.1. The student registered for the first time to study in an academic

year and wishing to cancel their enrolment for that year.

3.2. A student may cancel his/her enrolment for the current academic

year of study as a whole excluding the registration fee and the

cost of study material which remain payable, and default

administration charges of 25% that ALEPH Learning Academy will

be entitled to levy, provided that ALEPH Learning Academy is

informed in writing no later than 4 (four) weeks prior to the

commencement of the academic year in question and with

written notification of receipt of such cancellation having been

furnished by ALEPH Learning Academy to the student by that

date. Should a student wish to cancel his/her enrolment

subsequent to the commencement of the academic year, he/she

will be liable for the full tuition and other fees for the academic

year in question. Tuition fees are not transferable.

4. Deferral of Programmes

All students wishing to defer their studies, or part thereof, may apply in

writing to ALEPH Learning Academy within 14 (fourteen) days of the

start of the course/offering whereupon flexible study options may

be considered, at the sole discretion of ALEPH Learning Academy. A

deferral charge of 25% (twenty five percent) of the original cost of the

course/offering to be deferred will be levied against the student as a

precondition to ALEPH Learning Academy approving the application for

the deferral. A full “Deferral Policy” document will be made available to

the student by ALEPH Learning Academy and forms part of this contract

enrolment.

5. General

5.1. The student shall not, by reason of his/her failure to attend

lectures, be entitled to a reduction in fees, nor will it absolve

the student from full liability for the payment of fees and other

charges.

5.2. No consensual or other cancellation of this contract shall be of

any force or effect without written consent thereto by an

authorised director or official of ALEPH Learning Academy.

5.3. The right to attend lectures and write examinations is not

transferable. Accordingly, the student shall attend all lectures in

person and shall be the only person entitled to write

examinations in respect of the subjects forming part of the

course/offering for which the student has enrolled.

5.4. The student accepts that ALEPH Learning Academy shall have the

right to vary the programme syllabus at any time, without prior

notification and without furnishing reasons therefore. ALEPH

Learning Academy shall further have the right to alter timetables

and programme commencement dates at its own discretion, on

written notice to the student.

5.5. ALEPH Learning Academy shall have the right in its sole discretion, to postpone or cancel tuition in any programme initially advertised and offered, on the basis of insufficient demand. ALEPH Learning Academy shall be entitled to combine classes of a similar academic level and content.

5.6. ALEPH Learning Academy shall be entitled to create and apply rules (including due performance requirements,) and the student hereby agrees to be bound by such rules. ALEPH Learning Academy shall be entitled to exclude the student from lectures and examinations (without in any way detracting from the right of ALEPH Learning Academy to recover fees payable), and to withhold a student's results (or the student examination results) or to terminate the student's enrolment should the student, as the case may be, fail to comply with any such rules or the terms of this agreement.

5.7. The student shall be liable for all costs incurred by ALEPH

Learning Academy, including but not limited to attorney and client fees, collection charges and tracing charges in enforcing the obligations of the student under this agreement, to the maximum extent permitted by the National Credit Regulator.

5.8. The fees and other charges reflected on the invoice do not

include external institute membership fees, external provider fees, examination fees, notes, books, stationery or any other items, which shall be for the account of the student.

5.9. The student is responsible for ensuring that he/she has been properly registered with any relevant external institute or examining body, where applicable, and that he/she has been registered for examinations with such institute or body.

5.10. In the case of an extraordinary event or circumstance beyond the control of such parties, such as war, strike, riot, crime, act of God (e.g., flood, earthquake, volcano), liquidation or sequestration, ALEPH Learning Academy shall be entitled to suspend lectures and temporarily close the campus affected thereby. The student shall not by reason of such suspension or closure be entitled to terminate this agreement or claim a refund, fees paid or a reduction on fees payable or any compensation from ALEPH Learning Academy.

5.11. No relaxation, variation, or indulgence granted by ALEPH Learning Academy to the student shall constitute a waiver of any rights vesting in ALEPH Learning Academy in terms hereof, and no reliance may be placed by the student or other signatory hereto or any statement or representation (whether oral, tacit or otherwise) not contained herein.

5.12. All correspondence must be by way of registered mail or by hand delivered to ALEPH Learning Academy’s premises. All correspondence must be received and signed for by ALEPH Learning Academy prior to the applicable cut-off date as stated elsewhere in this agreement.

6. In the event of the signatories to this agreement, other than ALEPH Learning Academy, having completed this form incorrectly, or the payment details herein not being in accordance with the requirements of ALEPH Learning Academy, ALEPH Learning Academy shall be entitled to reject the student’s application or to require the student to complete a new application.

7. Any student who receives a promotional item as a result of this

enrolment contract hereby acknowledges that ALEPH Learning Academy is not responsible for any repairs, service issues, warranties or performance on relation thereto. These must be referred to the promotional item manufacturer, service provider, network or agent(s) thereof, as the case may be.

8. The student accepts, as stipulated in the ALEPH Learning Academy

Assessment Policy (which shall be deemed to form part of this agreement) that as part of the assessment of the programme, the student must fulfil certain academic requirements which may include (but are not limited to) the completion and/or sign - off a Portfolio of Evidence or other forms of assessments. The student understands that submission of any academic work should be the intellectual work of the student. Should submission of any academic work not be that of the student, it will constitute fraud which may result in the expulsion of the student.

9. Student will be temporarily suspended from attending lectures, writing tests and exams when the student’s account is in arrears.

10. Address for receiving of documents

10.1. ALEPH Learning Academy and the student respectively choose as their address for service of legal documents the address listed at the top of this agreement. Any party to this agreement may change its address by delivering to Aleph Learning Academy a written notice of the new address in the manner specified in the National Credit Regulator.

11. Client Data 11.1. I undertake to notify Aleph Learning Academy in writing of any

changes in my contact details, including but not limited to: my business, postal or residential addresses, my home, work or cell phone number(s), and my e mail address, within 7 (seven) days of such change.

12. Legal Declaration and Indemnity

12.1. Neither ALEPH Learning Academy nor any official employee or

representative of ALEPH Learning Academy acting in his/her capacity as such shall be liable for any damages arising out of:

12.1.1. the death, bodily harm, loss of health or illness of any student howsoever caused; and

12.1.2. The destruction of or damage to any property owned by or in the custody of any student, howsoever caused.

13. The student hereby indemnifies ALEPH Learning Academy against any

claim made (whether for damages, costs, or otherwise) against ALEPH Learning Academy in respect of any action and/or omission of the student.

14. Accompanying documents The following material must accompany this application namely:

14.1. Copy of the front page of student's valid identity book (if a South

African citizen);

14.2. Copy of front page and/or valid passport book of person(s)

responsible for payment of account;

14.3. Certified copy of student’s study permit and front page of valid

passport (if not a South African citizen);

14.4. Where applicable, certified copy of Matriculation (Grade 12)

Certificate, or symbols, or School Leaver's Certificate. If the

student is awaiting matriculation results, these must be furnished

as soon as they become available;

14.5. If a payment option other than cash is selected, the student must

submit proof of income, being in respect of permanently

employed persons the most recent salary advise and 3(three)

months bank statements for self-employed persons; and

14.6. Supporting documentation should the student require additional

time for examinations.

15. Certificates

15.1. Students will receive their results from ALEPH Learning Academy

in the form of a results letter which will not be accompanied by

the programme certificate. Official Programme

Certificates/diplomas issued by the various ETQA’s and Providers

will only be furnished to students upon receipt of the

certificates/diplomas from these ETQA’s and Providers and, once

ALEPH Learning Academy has confirmed that the student’s

accounts are up to date.

15.2. No certificates/diplomas will be issued to students or a third party

if there are monies due to Aleph Learning Academy. Should a

student require a re-print of their certificate, the applicable

charges will be for the student’s account. All certificates/diplomas

must be collected from the ALEPH Learning Academy office in

Secunda by the student, certificates will not be delivered by hand,

mail, registered mail or courier or any other form of delivery.

16. Capacity to enter into Agreement

16.1. For a Business: The contracting party (the business) hereby warrants to Aleph Learning Academy that the signatory (representing the business) has the required legal capacity to enter into, and be bound by these terms and conditions. The business accepts all the terms and conditions of the entire agreement.

16.2. For the individual: I hereby declare that there is no legal impediment to my concluding this agreement and that I am legally bound to this contract, and accept all the terms and conditions of the entire agreement.

17. The student acknowledges that this agreement shall only come in force

once the enrolment form is duly completed, all the relevant and correct documentation is attached and approved and/or accepted by Aleph Learning Academy.
