State of the Judiciary AddressGood morning, judges of the Commonwealth

and guests. To my fellow judges, it is an honor to be your colleague in the judiciary. Being selected to be a judge is recognition of professional achievement. A high level of con�dence is placed in you to serve the citizens of the Commonwealth in matters of great importance to them. Chief Justice John Marshall famously and succinctly summarized the enterprise we are in. He said:

“The judicial department comes home in its e�ects to every man’s �reside; it passes on his property, his reputation, his life, his all. Is it not to the last degree important that he should be rendered perfectly and completely independent, with nothing to in�uence or control him but God and his conscience?”

Recently, The New York Times carried an article about what it called the “partisan warfare over control of the Supreme Court.” Interestingly, the article was not addressing the current vacancy on the United States Supreme Court; rather, it was directed at the battles currently being waged in the various states. These controversies have enormous consequences for the independence of the judiciary.

“Ground-zero” for the controversies appears to be in Kansas where the executive and legislative branches have been angered by particular state supreme court decisions. Among

these rulings, the Kansas Supreme Court held that their Constitution required more equitable distribution of funding for public schools and declared that the state’s public schools must shut down altogether if poorer districts do not get more money. The governor and the legislature responded by threating to suspend all funding for the Kansas court system. Additionally, a bill has passed the Kansas Senate that expands the basis for impeachment of judges. A few of the new provisions, stated in vague terms, provide for impeachment for:

1. Failure to perform adequately the duties of o�ce;

2. Attempting to subvert fundamental laws and introduce arbitrary power;

3. Attempting to usurp the power of the legislative or executive branch of government;

4. Exhibiting discourteous conduct toward litigants, jurors, witnesses, lawyers, or others with whom the judge deals in an o�cial capacity;

5. Exhibiting wanton or reckless judicial conduct; or

6. Failure to properly supervise, administer, or discipline judicial personnel.

�nanced campaigns in support of special interests. Thirty-eight states have popular elections for their justices either directly or by retention elections. Spending on television ads for the election of two justices in Arkansas this year reached over $1.2 million with the candidates being attacked as being too cozy with trial lawyers.

Ads in Wisconsin from out-of-state groups from the political right and the political left have pushed campaign spending to more than $3.2 million dollars for one seat in 2016.

The cost of television ads from unions and plainti�’s lawyers in Pennsylvania reached $16.5 million in a recent election for 3 of its supreme court seats.

In Oklahoma, where the court ruled that a Ten Commandments monument must be removed from the Capitol, bills have been introduced to give the governor and the legislature more control over the election of the court, and another bill has been introduced to increase the size of the court. Of course it is being called a “court-packing” bill.

These e�orts are often referred to as a means to make the judiciary more responsive to the people and to make the judiciary more “democratic.”

I believe we are witnessing a fully engaged battle over the fundamental role of judges in America.

In “Federalist 78,” Hamilton states that “the judiciary, from the nature of its functions, will always be the least dangerous to the political rights of the constitution; because it will be least in a capacity to annoy or injure them.” Arguing that the judiciary has “no in�uence over either the sword or the purse,” Hamilton concludes that the judiciary is “the weakest of the three departments of power” primarily, he states, because it has “neither Force nor Will, but merely judgment.” If he were transported in time to this era in our nation’s history, perhaps Mr. Hamilton would revise his analysis. At the very least, we can see that not everyone in America agrees with him.

There are those who forcefully maintain

that the judiciary has strayed beyond its designated role in the American system and usurped the powers of the two other branches, showing little regard for democratic majority rule. There are those who are informed by the Madisonian principal of protection of fundamental rights and minority interests who assert that the judiciary is the only place where protection of such rights and interests will be found. The debate is not new. It has gone on since our founding. It is a particularly hot topic today.

Despite the di�culties of the selection process for a justice of our Supreme Court during this last session of the General Assembly, we do not have nearly the tension experienced in other states. The judiciary has a good, cooperative relationship with the other two branches of government in Virginia, and we should all be grateful for that.

There are many things of signi�cance to report; however, time constraints permit only the inclusion of highlights.

Last fall, I proposed to the chairs of House and Senate Courts Committees that a presentation be made to a joint meeting of the committees concerning the Judicial Performance Evaluation Program. The suggestion was well received; and, on the �rst day of the 2016 General Assembly Session, Justice Powell and Pat Davis, the JPE coordinator, joined me at the Capitol. I told the members that we desire transparency

in the process, and a good start to achieve that objective would be to give them up-to-date information on how we are implementing the program. I am pleased to say that the meeting was extremely productive and resulted in members of the Courts Committees volunteering to reciprocate in this e�ort at transparency by appearing at our Judicial Conferences. Today we have a special portion of the Judicial Conference’s agenda devoted to this topic. In my opinion, the JPE program is a good thing. It is here to stay. We need to embrace it and continue to improve it.

Every year before the General Assembly convenes, the chief justice and the executive secretary meet with the governor and with members of the General Assembly to discuss budget priorities and legislation. I am pleased to report that the General Assembly provided that all judges and full time judicial branch employees will receive a 3% pay increase e�ective November 10, 2016. I expressed to the governor and his sta� and to key members of budget committees how grateful we are for these increases; however, I pointed out that those judicial department employees at the lowest end of the pay scale needed a one-time adjustment in compensation so that the percentage increases would be much more meaningful to them. I am pleased to report that the General Assembly approved the sum of $2.5 million to provide an additional increase to our deputy district clerks at the lower end of the pay scale. The legislature accepted our suggestion that the Committee on District Courts develop a plan for allocation of these pay increases.

We also continue to make progress on the number of funded judgeships in the Commonwealth. As you may recall, a Weighted Caseload Study was conducted by the National Center for State Courts and submitted to the General Assembly in 2014. At the time that study was submitted, there were 402 authorized judgeships in the Code of Virginia, but only approximately 350 were funded and �lled. The Weighted Caseload Study indicated a need for 429 judgeships. This session, the General

Assembly �lled 23 vacant and newly-created judgeships, bringing the funded number of judgeships to 408. I congratulate and welcome all of our new judges to the bench.

The General Assembly has also asked us to update the weighted caseload model, with a report due by the 2018 session. Additional factors to be considered are use of interpreters, law clerks, retired or substitute judges, pro se litigants, and population growth or decline.

Last year, at this conference, I noted that one quarter of Virginia’s judges were newly elected to their positions. That presented a signi�cant training challenge. I would like to thank Dr. Caroline Kirkpatrick and her sta� for all the work they did to meet those increased training needs. One key component of our new judge training is the mentor program. I would also like to thank Judge Marla Decker, Chair of the Mentor Program Advisory Committee, and the 57 judges who participated in the new mentor judge workshop in March. This program would not be possible without the many volunteer hours put in by our mentor judges.

For a number of years, court appointed counsel seeking a waiver of the statutory cap were denied payment of the waiver if the funds appropriated for waivers were exhausted at the time the case was concluded. Typically, this meant that court appointed counsel submitting their vouchers in the latter months of the �scal year may not have received the approved waiver amounts they were expecting. I am happy to report that the appropriation for waiver of the statutory caps for court appointed counsel has been increased by $450,000 to $4.65 million each year of the biennium budget.

Like many other states, we are experiencing an unfortunate surge in heroin use in the Commonwealth. Judges, medical professionals, police, legislators, and executive branch leaders have joined together to seek solutions. For the �rst time in over a decade, in this session of the General Assembly, drug courts received new funding. First, $100,000 was allocated to pilot programs in Norfolk and




Henrico in each year of the biennium budget for the utilization of a non-narcotic, non-addictive, injectable prescription drug treatment regimen that has been successful in other states. In addition to support drug court dockets, $300,000 the �rst year of the biennium and $960,000 in the second year was appropriated for jurisdictions with high drug-related caseloads.

I have often pointed out that when we speak of drug courts, what we are really talking about are dockets in the court system. The legislature creates courts. Courts create dockets to manage caseloads. In addition to drug court dockets, many localities have sought to create other problem solving dockets. Among them are veterans’ dockets and mental health dockets. First, we must remember that the localities must desire and request such problem solving dockets. Additionally, the interests of public safety require that local commonwealth’s attorneys retain a veto over participation in these dockets. We must have approval, oversight, and supervision of these dockets by the Supreme Court. These well-meaning e�orts will be subject to deserved criticism without best practices being observed and implemented. The General Assembly has requested that the Supreme Court develop a Rule of Court to accomplish this objective. In response to that request, I will be appointing a Problem-Solving Dockets Taskforce to assist with drafting such a Rule and preparing best practice guidelines.

Justice Bernard Goodwyn and his co-chair, John Whit�eld, continue to provide impressive leadership to the Access to Justice Commission. Let me share some highlights with you.

• UpontheurgingoftheCommission,the Supreme Court amended the commentary to Canon 4B to make it clear that judges may participate in pro bono recognition e�orts and are permitted to encourage lawyers to provideprobonoservices;•Additionally,thecommentary to Canon 3B was amended to clarify the assistance a judge may provide to self-represented litigants;

• Practicepointsforjudgesconcerning

self-represented litigants have been developed, and you have received a laminated copy of these suggestions for your use;

• UpontheencouragementoftheCommission, the Virginia State Bar will host an on-line pro bono website which will permit low-income Virginians to ask legal questions in a private forum and have the questions answered by volunteer Virginia lawyers. The portal will be called Virginia.freelegalanswers.org and will begin operation in August 2016.

In March, the Civil Rights Division of the Department of Justice sent a letter to all chief justices and to all state court administrators to call attention to what was characterized as illegal enforcement of court �nes and costs in certain jurisdictions, and to share best practices with respect to imposition and collection of �nes and costs. This letter was certainly timely, as the General Assembly passed legislation providing for the Supreme Court to draft a new Rule regarding payment plans for court �nes and costs. I have put together a working group to craft such a rule, which will not only facilitate the collection of court �nes and costs, but also assure the fair treatment of the citizens of this Commonwealth, many of whom are indigent.

The Judicial Ethics Advisory Committee is up and running and is chaired by former Chief Justice Cynthia Kinser. The Committee provides a place where judges may ask judicial ethics questions and have them answered with opinions that are made public. The opinions do not reveal the name of the requesting judge. You may �nd the order creating the committee on the Supreme Court website. The process is described in detail in the order. I want to point out there is a provision for emergency requests. Kenney Grigg in the O�ce of the Executive Secretary is counsel to the committee. You may contact him directly with questions you may have. Please avail yourself of this advisory service. It was created to support and assist the judges of the Commonwealth.

All of you are subject to the provisions of the Con�ict of Interest Act. It is very clear


that COIA was enacted with the legislative and executive branches in mind, not the judicial branch. Many of you have expressed frustration in the attempt to interpret rules that do not seem to have you in mind but, literally construed, sweep you within its provisions. We have expressed our concerns and suggested that a separate statute applicable to the judiciary should be considered. I am pleased to share with you the language of House Bill 1362 and Senate Bill 692 which include an enactment clause that provides:

That the Supreme Court of Virginia shall report to the Virginia Con�ict of Interest and Ethics Advisory Council on the application of the State and Local Government Con�ict of Interests Act to members of the judiciary. Such report shall be made no later than October 1, 2016, and shall include an evaluation of the feasibility of creating separate statutory provisions applicable to members of the judiciary. In making its report, the Supreme Court of Virginia shall consult with sta� of the Virginia Con�ict of Interest and Ethics Advisory Council, statewide bar associations, and others as the Court deems necessary.

We are hopeful that our report will result in improvements to this Act so that its application to members of the judiciary will be more appropriate.

Finally, let me comment on a matter of concern to all of us that has received much attention in the media. I am speaking of the writ of actual innocence issued on behalf of Keith Allen Harward. I commend Olga Akselrod from the Innocence Project and Alice Armstrong from the O�ce of the Attorney General for their admirable cooperation in search of the truth. And the comprehensive reporting of Frank Green of the Richmond Times Dispatch deserves special acknowledgement. In recent years, the Supreme Court of Virginia has issued �ve writs of actual innocence based upon biological evidence. Nationwide, according to the National Registry of Exonerations, there have been 1,778 exonerations since 1989. All of us who have taken an oath to uphold the Constitution of the

United States and the Constitution of Virginia and to faithfully and impartially discharge our duties should be vigilant to the circumstances

that may cause a miscarriage of justice, and we must be alert to the possibility that others may be wrongly imprisoned. One innocent person who is imprisoned is one person too many.

The Office of the Executive Secretary (OES) provides administrative assistance and direction to the courts of the Commonwealth and to Virginia’s magistrates through its eleven departments and various related programs. The OES includes the office of the Assistant Executive Secretary and Counsel, the Court Improvement Program, Educational Services, Fiscal Services, Historical Commission, Human Resources, Judicial Information Technology, Judicial Planning, Judicial Programs, Judicial Services, Legal Research, and Legislative & Public Relations.

Secretary & Counsel supports the Executive Secretary, particularly with legal matters involving OES or the judicial branch.

Court Improvement ProgramThe office of the Court Improvement Program

is responsible for court activities relating to children and families and for the qualification of lawyers as guardians ad litem for children and for incapacitated adults.

Educational ServicesThe Educational Services Department’s

mission is to provide the Virginia judiciary learning opportunities for continued personal and professional growth. The department provides information and continuing education opportunities for judges, clerks, magistrates, substitute judges, special justices, and administrative hearing officers.

Fiscal ServicesThe Department of Fiscal Services is the

court system’s financial management center for the Supreme Court, Court of Appeals, circuit court judges, general district and J&DR district courts, magistrates, the Judicial Inquiry and Review Commission, and the Virginia Criminal Sentencing Commission.

Human ResourcesThe mission of the Human Resources

Department is to attract, develop and retain the most highly proficient workforce that supports the mission, vision, and goals of Virginia’s judicial system. We endeavor to address the diverse human resources needs of Virginia’s judicial system through guidance, consultation, and training.

Technology’s (DJIT) mission is to support Virginia’s Judiciary by providing and maintaining reliable, effective, innovative, and timely technol-ogy solutions for the courts’ business processes.

Judicial PlanningThe Department of Judicial Planning

develops and maintains an effective planning capability within Virginia’s judicial system. Working with judicial policy-making bodies (such as the Judicial Council of Virginia and the Committee on District Courts), the Department assists the Chief Justice and Supreme Court of Virginia in identifying present and future needs and developing and implementing innovative programs and solutions that address those needs. The Department is structurally divided between planning function staff and staff dedicated to specific programmatic or special projects.

Judicial ServicesThe Department of Judicial Services (DJS)

serves as the liaison between the Judiciary’s administrative offices and the courts throughout the Commonwealth, providing administrative services through publications, trainings, field vis-its, and the research and support of various pro-grams. The Department serves the courts of this Commonwealth through its six divisions: Circuit Court Services, General District Court Services, Magistrate Services, Foreign Language Services, Dispute Resolution Services, and Drug Treatment Court Services.

Legal ResearchThe Legal Research Department provides

staff support and direct assistance to the Office of the Executive Secretary and the judiciary.

Legislative & Public RelationsThe Department of Legislative & Public

Relations manages legislative matters, and handles media and public relations for Virginia’s Judicial System.

The General Assembly appropriated $435.3 million for the judicial system for fiscal year 2016-2017. This constituted an increase of 5.3% from the $413.3 million that was budgeted in fiscal year 2015-2016. These funds comprised one percent of the total state biennium budget.

Total judicial system expenditures in FY 2016 totaled $421.2 million. Of the total judicial system expenditures, 69.7% or $293.5 million was for operational costs: personal services (salaries, wage and fringe benefits) totaled $256.3 million (or 87.3% of operational costs) and automation needs, services, supplies, and equipment totaled $37.3 (or 12.7% of operational costs). Grant funds, Criminal Fund costs, and costs related to the involuntary mental commitment (IMC) process constituted the remainder ($127.6 million) of total court system expenditures in fiscal year 2016.

Judicial AdministrationUtilization of Substitute and Retired Recalled Judges in the District Courts

In order to meet demands placed upon the courts when a vacancy exists on the bench, when a sitting judge is asked to fulfill certain administrative duties, or when a sitting judge must disqualify or recuse himself or herself in conflict cases, the district courts must call upon

substitute judges and recall retired judges to assist in the processing of cases. During 2016, the total cost of the utilization of substitute and retired recalled judges in the district courts totaled about $1.7 million for a total of 7,638 days (30.6 full-time equivalency positions) equating to an average of 31.1 days per district court judge.

Utilization of Retired Recalled Judges in the Circuit Courts

The circuit courts also face the need to recall retired judges from time to time to assist with the caseloads of the courts and provide

adequate resources when temporary judicial vacancies exist. In order to meet these demands placed upon the courts, the circuit courts during 2016 utilized retired judges for 3,845 days. This represented 15.4 full-time equivalent positions.


The Honorable Harry L. Carrico Outstanding Career Service Award

In 2004, the Judicial Council of Virginia cre-ated an Outstanding Career Service Award in honor of the Honorable Harry L. Carrico, retired Chief Justice of Virginia. This award is presented annually to one who, over an extended career, demonstrates exceptional leadership in the administration of the courts while exhibiting the traits of integrity, courtesy, impartiality, wisdom, and humility. In 2016, the award was bestowed upon the Honorable Lawrence L. Koontz, Jr., Senior Justice of the Supreme Court of Virginia.

A native of Roanoke, Virginia, Senior Justice Koontz received his undergraduate degree from Virginia Tech and his law degree from the T.C. Williams School of Law at the University of Richmond. Senior Justice Koontz was appointed to the Roanoke Juvenile and Domestic Relations Court in 1967, where he served until 1976, when he was elected a judge of the Twenty-third Judicial Circuit. In 1985, Senior Justice Koontz was elected a judge of the newly formed Court of Appeals of Virginia and served as Chief Judge of the Court of Appeals for eight years from 1985 to 1993. First elected to a 12-year term on the Supreme Court of Virginia in 1995, Senior Justice Koontz retired from the Court and took Senior Justice status in 2011.

During his career, Senior Justice Koontz served as a president of the Virginia Juvenile Judges Association, the Roanoke Valley Mental Health Association, the first President of the Ted Dalton Inn of Court (Roanoke area), and as a member of the Judicial Council of Virginia.


Awards and Honors Senior Justice Koontz is a recipient of the Virginia Trial Lawyers Association Distinguished Service Award. Senior Justice Koontz has also served as a member of the Board of Governors, Family Law Section, Virginia State Bar, and as a faculty mem-ber of the Virginia State Bar’s Professionalism Course.

Judicial Council of VirginiaThe Judicial Council of Virginia is charged

with the responsibility for making a continuous study of the organization, rules and methods of procedure and practice of the judicial system of the Commonwealth. It is also responsible for examining the work accomplished and results produced by the system and its individual offices and courts. A report of the proceedings and recommendations of the Council is made to the General Assembly and to the Supreme Court on an annual basis.

The Chief Justice of the Supreme Court is presiding officer for the Council whose membership includes one Court of Appeals judge, six circuit court judges, one general district court judge, one juvenile and domestic relations district court judge, two attorneys qualified to practice in the Supreme Court and the Chairmen of the Committees for Courts of Justice in the Virginia Senate and House of Delegates. Council members are appointed by the Chief Justice and serve for four years or at the pleasure of the Chief Justice.

Committee on District Courts

The Committee on District Courts was created to assist the Chief Justice in the administrative supervision of Virginia’s unified court system. Among the statutorily mandated responsibilities of the CDC are recommending new judgeships and certifying the need to fill district court vacancies, authorizing the number of clerks, magistrates and personnel in each district, establishing guidelines and policies for court system personnel and fixing salary classification schedules for district court personnel and magistrates.

Membership of the Committee includes the Chairmen of the Committees for Courts of Justice in the Senate and House of Delegates, two members of each of the Courts of Justice Committees appointed by the respective Chairmen, the Speaker of the House of Delegates, the Majority Leader of the Senate of Virginia, one circuit court judge, two general district court judge and two juvenile and domestic relations district court judge. These judicial members are appointed by the Chief Justice and serve at his pleasure.

The Committee is fortunate to have the capable assistance of three Advisory Committees. In combination, these com-mittees provide expertise in every facet of court operation and provide invaluable advice concerning the establishment of administrative policy.

Virginia’s Judges andMagistrates

The Justices of the Supreme Court of Virginia are elected by a majority vote of each House of the General Assembly for a term of twelve years. Interim appointments are made by the Governor subject to election by the General Assembly at the next regular session. By law, the Chief Justice is selected by a vote of the seven members of the Court.

The Court of Appeals Judges are elected by a majority vote of each House of the General As-sembly. They serve for eight-year terms. Interim appointments are made by the Governor subject to election by the General Assembly at the next regu-lar session. The Chief Judge is elected by a vote of the eleven judges for a term of four years.

The Judges of the Circuit Courts are elected and receive interim appointments in the same manner as the Court of Appeals Judges. The Chief Judge of the circuit is elected for a two-year term by a vote of the judges serving in the circuit.

The Judges of Virginia’s District Courts are elected by a majority vote of each House of the General Assembly for terms of six years. Vacan-cies in district court judgeships occurring when the General Assembly is not in session are �lled by the circuit court judges of the corresponding circuit. The judges so appointed must be elected by the next session of the General Assembly. Each district has a Chief General District Court Judge and a Chief Juvenile & Domestic Relations District Court Judge, both elected by peer vote for a two-year term. The Chief Judge is the administrative head of the respective courts in the district and is responsible for the management of the courts.

Magistrates provide an independent, unbiased review of criminal complaints brought to the office by police officers or the general public. Their duties include issuing various types of processes such as arrest warrants, summonses, emergency protective orders, search warrants, subpoenas, mental health orders, and emergency medical orders. Magistrates conduct bond

hearings to determine bail in instances in which an individual is arrested and accept prepayments for traffic infractions and minor misdemeanors. Magistrates also serve as hearing officers for tax setoff hearings.
