President’s Message
As the longtime owner of a small business, from time to time I
was asked to give money to various causes. My intention
was always to help, but in the back of my mind there was
always a nagging question - where exactly is the money going?
Better Business Bureau piloted an early version of charity
reporting. Through this I was able to learn more about the
organizations I supported through donations. What I learned
changed the way I looked at philanthropy forever.
With BBB’s information, I was able to give in more meaningful
ways. When I learned the Council of Better Business Bureaus
developed uniform charity evaluation standards and BBB
Foundation of Upstate New York had the option of
providing this service, I jumped at the chance.
I brought this program to Upstate New York
because I truly believe that our communities
want to give but need better information in
order to do it in a meaningful way.
I believe the information in the
Upstate New York Giving Guide will help
both charities and donors as they work
together to create a positive change in
Upstate New York. n
About Warren Clark:
Clark is currently president and CEO of Better Business Bureau serving Upstate New York and BBB Foundation of Upstate New York. He served on the board of directors for both organizations. A former small business owner for over 30 years, Clark also served on the New York State Assembly Council on Small Business, and was a board member for the Council of Better Business Bureaus. He also volunteered and served on boards of several other organizations.

This guide includes a compilation of the latest evaluation conclusions completed by Better Business Bureau Foundation of Upstate New York. For the benefit of charities and donors alike we have also included local offices of national charities; which are covered by their national evaluation completed by BBB’s national Wise Giving Alliance.

a charity’s practices in the areas of governance and
oversight,effectiveness,financesandfundraisingby
a highly respected accrediting organization. Meeting
BBBs comprehensive 20 Standards for Charity
Accountability helps position organizations to
successandencouragesconfidentcharitablegiving.
There is no cost for being
reviewed. Completed reports
are valid for two years and
posted on BBB Foundation of
Upstate New York’s website as
well as published in the Upstate
New York Giving Guide. n
Is it bad if a charity misses a Standard? Each donor values individual Standards differently. BBB welcomes you to decide which Standards are most important to you.
As many charities go through BBB’s Charity
Review process, some will miss a standard. BBB
applauds every organization that works to be
evaluated. It means that the organization took
steps to provide BBB with the in-depth information
and supporting materials needed to conduct a
comprehensive evaluation. The organization
made a commitment to disclose information for
the public to consider; even in the event that a
standard was missed.
Some charities use what they learn through the
Charity Review process to take a fresh look at their
organization and the way
it is run. Perhaps some
smallbutsignificant
changes can be made that will allow them to meet
missed Standard in the future.
Many factors determine whether or not an
organization will earn your support. BBB encourages
donors to use an organization’s Charity Review
as a research tool. BBB simply presents factual
information in an effort to help provide donors with
the information they need to determine whether or
not a charity is worthy of their resources. n
Looking at how a charity spends money is just one piece
of the puzzle. BBB also looks into their board oversight,
policies for evaluating the effectiveness of their work, and
transparency to the public—the critical infrastructure that
underlies the way they conduct themselves.
Research Finding: Meeting BBB Standards Is Associated with Greater Fundraising Results
A study by the Baruch College School of Public
Affairs found that “meeting BBB Standards for
Charity Accountability is positively associated with
increased levels of public support as measured by
fundraising revenue.”
The study showed that that meeting all BBB
Charity Standards was associated with a 13.5%
increase in fundraising revenue for the Metro
New York charity sample and an 8% increase in
fundraising revenue for the national charity
sample, controlling for key documented variables.

“This fresh evidence is an important
confirmationthatbothnationallyandlocally
soliciting charities demonstrate greater success with
their fundraising efforts when they meet all BBB
Standards for Charity Accountability,” said Claire
Rosenzweig, president and CEO of both BBB Serving
Metropolitan New York and the NY BBB Education
and Research Foundation.
Professor Greg Chen from Baruch College
School of Public Affairs, City University of New
York, conducted the research. He studied multiple
datasets, including data from nationally soliciting
charities that are reported on by BBB Wise Giving
Alliance and regionally soliciting charities that
are reported on by the Metro New York BBB’s
Education and Research Foundation. These two
Better Business Bureau organizations are legally
separate and independently staffed, but use the same
standards and implementation guidelines in their
charity review programs. Both national and Metro
New York BBB Charity Reports are completed at no
charge to charities, and BBB Charity Reports are
available online for free public access.
Thestudyreinforcesthefindingsofaprevious
2009 academic study by Professor Chen that used
a previous dataset from the Metro New York BBB
Foundation’s Charity Review Program. In that
study Professor Chen also found “that meeting BBB
standards is associated with higher levels of
public support.”
“As the charitable sector struggles to increase
fundraising revenues year after year, this is an
indicator that trust can be a game-changer when it
comes to giving decisions,” said Warren E. Clark,
president and CEO of both Better Business Bureau
of Upstate New York and Better Business Bureau
Foundation of Upstate New York. “This trend is
encouraging and we are excited to offer the BBB
CharityReviewprogramtononprofitorganizations
in Upstate New York.” n
The study findings were released in September of
2013. This research project was jointly funded by BBB
Wise Giving Alliance and the Education and Research
Foundation of the Better Business Bureau of Metropolitan
New York.

it is important for charities to distinguish themselves as organizations that are committed to
transparent and accountable practices.

Park Alliance
Foundation

experience to improve clinical care and
quality of life for its patients. Donors of the
Roswell Park Alliance Foundation know
they support the promising and impactful
initiatives of Roswell Park, the only
comprehensive cancer center in Western
and Upstate New York.
The Torch Award for Philanthropic

Some of the organizations were reviewed by Better Business Bureau Foundation
of Upstate New York; others are covered by a review of the national organization
conducted by BBB’s Wise Giving Alliance, but all are operating within Upstate
New York.
This list includes information on charities that have reached the threshold of public
inquiry, required to start the review process. The list also includes charities that
have reached out to be reviewed voluntarily, as well as those that have entered into
the process as the result of a complaint.
l There is no charge for charities to be evaluated or for donors to inquire about
a charity
l Inclusion on or omission from this list should not be interpreted as approval
or disapproval
l The Upstate New York Giving Guide should be used as a research tool and only as one part of a
donors giving research

Standards Not Met – Charity provided information requested by BBB in order
to be evaluated, but did not meet one or more Standard. BBB encourages donors
to visit our website to view the organization’s full Charity Review and determine
whether or not the Standard missed is important to them.

Q & A about the Charity Review Program
Q. What does Charity Review mean for nonprofit organizations in our community?
A. BBB’s Charity Review program provides information to the public about charities operating within the BBB Upstate New York region. In doing so, Charity Review’s help charities communicate information about their mission and programstothecommunityaswellaspromotetheirethicalpracticeswithinthenonprofitsector.
BBB’s Charity Review program encourages all organizations to participate in the evaluation process to provide donors with the valuable information they need to make informed giving decisions.
Q. What is involved in the review process?
A. BBB works with charities to complete the review process, which is done through a questionnaire within BBB’s online portal.InordertodetermineifacharitymeetsStandards,BBBreviewsfinancialstatements,taxfilings,annualreports, solicitations, direct mail pieces and special event information that is provided by the organizations. Once the questionnaire is submitted, BBB prepares a draft Charity Review and works with the charity to help it meet any Standards that may be missed.
Q. Is every organization required to be reviewed?
A. BBB’s Charity Review program is voluntary and BBB only reviews an organization after public inquiry. In the event a charity does not wish to participate, it has the option not to, however BBB will notify the charity this decision will be on their Charity Review. BBB reports when a charity chooses not to participate with a red exclamation mark signaling non-disclosure. If a charity has non-disclosure language it is not necessarily negative; but rather an indicator that donors will need to conduct thorough research on their own.
Q. Where are the Charity Reviews and who can see them?
A. BBB Charity Reviews are available online at bbbfoundationupstateny.org, by email [email protected] or by calling800-828-5000Ext.295.ThefinalevaluationofCharityReviewswithinBBBFoundationofUpstateNewYorkwill also be made available annually through the Upstate New York Giving Guide.
Q. How long has BBB been reviewing charities?
A. BBB’s Charity Review program expanded into Upstate New York in 2013, but the program is not new. In fact, it has been around through BBB Wise Giving Alliance since the 1920s. The Charity Review program has been available to national charities within Upstate New York for a number of years and now covers local charities.
Q. Where did criteria for the 20 Standards for Charity Accountability come from?
A. The 20 Standards for Charity Accountability were developed by BBB Wise Giving Alliance (WGA) with professional and technical assistance from representatives of small and large charitable organizations, the accounting profession, grantmakingfoundations,corporatecontributionsofficers,regulatoryagencies,researchorganizationsandBBBs.BBBWiseGivingAlliancealsocommissionedsignificantindependentresearchondonorexpectationstoensurethattheviewsofthegeneralpublicwerereflectedinthestandards.WGAisanaffiliateoftheCouncilofBetterBusinessBureausthatreviewsandreportsonnationalnonprofits.

BBB’s 20 Standards For Charity Accountability
GOVERNANCE AND OVERSIGHT
The governing board has the ultimate oversight authority for any charitable organization. This section of the standards seeks to ensure that the volunteer board is active, independent and free of self-dealing. To meet these standards, the organization shall have:
1. A board of directors that provides adequate oversight of the charity’s operations and its staff. Indication of adequate oversight includes, but is not limited to, regularly scheduled appraisals of the CEO’s performance, evidence of disbursement controls such as board approval of the budget, fundraisingpractices,establishmentofaconflictofinterestpolicy,andestablishmentofaccountingproceduressufficienttosafeguardcharityfinances.
2. A board of directors with a minimum of five voting members.
3. A minimum of three evenly spaced meetings per year of the full governing body with a majority in attendance, with face-to-face participation. A conference call of the full board can substitute for one of the three meetings of the governing body. For all meetings, alternative modes of participation are acceptable for those with physical disabilities.
4. Not more than one or 10% (whichever is greater) directly or indirectly compensated person(s) serving as voting member(s) of the board. Compensated members shall not serve as the board’s chair or treasurer.

5. No transaction(s) in which any board or staff members have material conflicting interests with the charity resulting from any relationship or business affiliation. Factors that will be considered when concluding whetherornotarelatedpartytransactionconstitutesaconflictofinterestandifsuchaconflictismaterial,include,butarenot limited to: any arm’s length procedures established by the charity; the size of the transaction relative to like expenses of the charity; whether the interested party participated in the board vote on the transaction; if competitive bids were sought and whether the transaction is one-time, recurring or ongoing.
MEASURING EFFECTIVENESS
An organization should regularly assess its effectiveness in achieving its mission. This section seeks to ensure that an organization has defined, measurable goals and objectives in place and a defined process in place to evaluate the success and impact of its program(s) in fulfilling the goals and objectives of the organization and that also identifies ways to address any deficiencies. To meet these standards, a charitable organization shall:
6. Have a board policy of assessing, no less than every two years, the organization’s performance and effectiveness and of determining future actions required to achieve its mission.
7. Submit to the organization’s governing body, for its approval, a written report that outlines the results of the aforementioned performance and effectiveness assessment and recommendations for future actions.
FINANCES
This section of the standards seeks to ensure that the charity spends its funds honestly, prudently and in accordance with statements made in fund raising appeals. To meet these standards, the charitable organization shall:

8. Spend at least 65% of its total expenses on program activities.

9. Spend no more than 35% of related contributions on fund raising. Related contributions include donations, legacies, and other gifts received as a result of fund raising efforts.
Formula for Standard 9:
Total Fund Raising Expenses should be at least 35% Total Related Contributions
10. Avoid accumulating funds that could be used for current program activities. To meet this standard, the charity’s unrestricted net assets available for use should not be more than three times the size of the past year’s expenses or three times the size of the current year’s budget, whichever is higher.

An organization that does not meet Standards 8, 9 and/or 10 may provide evidence to demonstrate that its use of funds is reasonable. The higher fund raising and administrative costs of a newly created organization, donor restrictions on the use of funds, exceptional bequests, a stigma associated with a cause and environmental or political events beyond an organization’s control are among factors which may result in expenditures that arereasonablealthoughtheydonotmeetthefinancialmeasurescited in these standards.
11. Make available to all, on request, complete annual financial statements prepared in accordance with generally accepted accounting principles. When total annual gross income exceeds $500,000, these statements should be audited in accordance with generally accepted auditing standards. For charities whose annual gross income is less than $500,000,areviewbyacertifiedpublicaccountantissufficientto meet this standard. For charities whose annual gross income islessthan$250,000,aninternallyproduced,completefinancialstatementissufficienttomeetthisstandard.
12. Include in the financial statements a breakdown of expenses (e.g., salaries, travel, postage, etc.) that shows what portion of these expenses was allocated to program, fund raising, and administrative activities. If the charity has more than one major program category, the schedule should provide a breakdown for each category.
13. Accurately report the charity’s expenses, including any joint cost allocations, in its financial statements. For example, audited or unaudited statements which inaccurately claim zero fund raising expenses or otherwise understate the amount a charity spends on fund raising, and/or overstate the amount it spends on programs will not meet this standard.
14. Have a board-approved annual budget for its current fiscal year, outlining projected expenses for major program activities, fund raising, and administration.
FUND RAISING AND INFORMATIONAL MATERIALS
A fund raising appeal is often the only contact a donor has with a charity and may be the sole impetus for giving. This section of the standards seeks to ensure that a charity’s representations to the public are accurate, complete and respectful. To meet these standards, the charitable organization shall:
15. Have solicitations and informational materials, distributed by any means, that are accurate, truthful and not misleading, both in whole and in part. Appeals that omit a clear description of program(s) for which contributions are sought will not meet this standard.
A charity should also be able to substantiate that the timing and nature of its expenditures are in accordance with what is stated, expressed, or implied in the charity’s solicitations.
16. Have an annual report available to all, on request, that includes:
a. the organization’s mission statement,
b. a summary of the past year’s program service accomplishments,
c. a roster of the officers and members of the board of directors,
d. financial information that includes (i) total income in the past fiscal year, (ii) expenses in the same program, fund raising and administrative categories as in the financial statements, and (iii) ending net assets.
17. Include on any charity websites that solicit contributions, the same information that is recommended for annual reports, as well as the mailing address of the charity and electronic access to its most recent IRS Form 990.
18. Address privacy concerns of donors by
a. providing in written appeals, at least annually, a means (e.g., such as a check off box) for both new and continuing donors to inform the charity if they do not want their name and address shared outside the organization, and
b. providing a clear, prominent and easily accessible privacy policy on any of its websites that tells visitors (i) what information, if any, is being collected about them by the charity and how this information will be used, (ii) how to contact the charity to review personal information collected and request corrections, (iii) how to inform the charity (e.g., a check off box) that the visitor does not wish his/her personal information to be shared outside the organization, and (iv) what security measures the charity has in place to protect personal information.
19. Clearly disclose how the charity benefits from the sale of products or services (i.e., cause-related marketing) that state or imply that a charity will benefit from a consumer sale or transaction. Such promotions should disclose, at the point of solicitation:
a. the actual or anticipated portion of the purchase price that will benefit the charity (e.g., 5 cents will be contributed to abc charity for every xyz company product sold),
b. the duration of the campaign (e.g., the month of October),
c. any maximum or guaranteed minimum contribution amount (e.g., up to a maximum of $200,000).
20. Respond promptly to and act on complaints brought to its attention by the BBB Wise Giving Alliance and/or local BBBs about fund raising practices, privacy policy violations and/or other issues.
