The reasons stated in the appeal as submitted are: the Official Plan amendment has not been duly assessed under all applicable provisions of the Official Plan, including those which apply to commercial lands; the Official Plan amendment will undermine the ability of the remaining NSA lands to function in the manner intended; the amendments have not addressed compatibility issues that arise in an established area; is not justified; deficient and would permit incompatible development to occur; provide for a form of redevelopment which is inefficient and inconsistent with the Provincial Policy Statement; constitute poor planning. A date for the Ontario Municipal Board hearing has not yet been scheduled. Planning staff have reviewed the appeal letter and see no reason for Council to alter its decision relating to this matter. 1

BACKGROUND 11 On November 16, 2009, a report was brought forward to Planning Committee 'which recommended an Official Plan and Zoning By-law amendment for 352 Ridout Street South (see Appendix " A location map). The purpose and effect of the recommended action was to permit an 8 unit mixed use development comprised of cluster residential townhomes (7 units) with an integrated medical office. Municipal Council passed the Official Plan and Zoning By-law amendment on November 23, 2009.

Barry Card, representing the owner of 350 Ridout Street South (immediate neighbour to the north), Proto Investments Limited, submitted an appeal letter on December 18, 2009 in response to Council's decision (see Appendix "B" appeal letters attached). The reasons stated in the appeal as submitted are: the Official Plan amendment has not been duly assessed under all applicable provisions of the Official Plan, including those which apply to commercial lands; the Official Plan amendment will undermine the ability of the remaining NSA lands to function in the manner intended; the amendments have not addressed compatibility issues that arise in an established area; is not justified; deficient and would permit incompatible development to occur; provide for a form of redevelopment which is inefficient and inconsistent with the Provincial Policy Statement; constitute poor planning.
