Former Prime Minister Ehud Olmert was sentenced to six years in prison on Tuesday f or his conviction on two counts of bribery in the Holylandcorruption case.

"A public servant who accepts bribes is akin to a traitor," Judge David Rozen said in his opening statements, which were read in t he Tel Aviv District Court on Tuesday morning. The defendants, he said, deserve a severe punishment that will help uproot corruption.

In March, Olmert was found guilty of accepting bribes when he served as mayor of Jerusalem, in exchange fo r helping the developers of t he city'sHolyland Park residential project.

Olmert, who sto od quietly in the courtroom with his head bowed, said he will appeal both the verdict and the sentence to the Supreme Court. Inaddition to the prison sentence, Olmert was fined one million shekels ($290,000).

Ahead of the sentencing, Rozen praised Olmert and his work for the public good, saying he is "an impressive, warm, and very intelligent man whoknows how to convince others. He is a respectful man who made a large contribution to the country." He then went on to harshly condemn theformer prime minister's "noxious" offenses.

"The defe ndants acted in a closed space, hidden from the public eye," Rozen said, ref erring to Olmert and Uri Sheet rit, Jerusalem's former chief

engineer, who was convicted of receiving bribes and sentenced to seven years in prison.

"But the putrescence they pro duced there did not stay confined to that space... Olmert took advantage of his position as a public servant andaccepted massive amounts of money, as detailed in the conviction... This is a man who was on top of t he world – he served as prime minister, themost important position, and from there he reached the position o f a man convicted of criminal off enses."

Olmert and Sheetr it, said Rozen, "are not run-of-the-mill criminals, mired in the crime world, but rather criminals who operated while workingin their public roles, for the public good. Their talents and the important work they did propelled them to summits - but were used as a platformfor the corrupt offenses they engaged in, in parallel to their normative work."

The defendants, said the judge, "deserve punishment that will express contempt, and help to uproot a contagious affliction that is not limited tothe theoret ical realm."

'A sad day'

President Shimon Peres, on an official visit in Norway, commented on Olmert's sentence. "This is a legal process that takes place in democraticcountries. I don't have a role in t he legal system, and it is clean from per sonal influences. This is a sad day for me, personally."

Finance Minister Yair Lapid, meanwhile, said it was a sad day for Israeli democracy. "A day in which a former prime minister is sent to jail is a sadday for Israeli democracy as well as a sad day for me on a personal level," he said. "But at t he same time, it is an important day in which the legalsystem showed that no man is above the law."

Olmert, ahead of the sentencing on Tuesday morning, released a statement: "This is a sad day in which an unjust and severe sentence is expectedto be handed down on an innocent man."

Olmert had denied wrongdoing in the Holyland apartment complex deal, as well as other corruption allegations that forced his resignation aspremier in 2008.

The maximum sentence handed down for comparable bribery o ffenses is a seven-year prison term. T he prosecution was seeking at least six yearsfor Olmert.

The ruling related to seve n of the 10 individuals convicted in the Holyland case, which concerns bribe-taking in the development of Jerusalem’scontroversial residential project: Those who bribed – Hillel Cherney, Avigdor Kellner, Meir Rabin and Danny Dankner – as well as those whotook the bribes – Uri Sheetrit, Ehud Olmert and Eli Simhayoff.

Cherney, owner of the Holyland complex, who was convicted of bribing Jerusalem officials, received three and a half years in prison and a fine of 2 million shekels. Kellner, one of the founders of "Holyland Park" company, who was convicted of briber y charges but acquitted of o ther

offenses, was sentenced to three years in prison and fined 1 million shekels.

Rabin, right-hand man to state witness Shmuel Dechner, who was also convicted of bribing Jerusalem officials, was sentenced to f ive years inprison.

Rozen ordered all those sentenced to appear before the prison service on September 1. Sentencing for former mayor of Jerusalem UriLupolianski and former committee member in the Jerusalem municipality Avraham Feiner will be given on June 9.

The prosecution asked Rozen to sentence Olmert to at least six years in prison for accepting a 500,000-shekel ($144,000) bribe on behalf of his brother, and two to f our years in prison for taking some 60,000 shekels ($17,000) in bribes to cover his personal expenses. The prosecution saidthere could be some overlap between the sentences.

“The defe ndant is not a symbol,” prosecutor Y onatan Tadmor said, quoting fro m the judgement in the case against for mer president MosheKatsav, who is in prison for rape and other sex crimes. “The fact that the defendant served in the highest position does not serve as immunity forhim in the face of punishment as for all people. Judge David Rozen says Zaken deserves 5 years in prison for her part in Holyland

scandal, but he must accept plea deal as per Supreme Court.

Grudgingly, Judge David Rozen accepted Shula Zaken’s plea deal with the prosecution in the Holyland trialon Thursday, sentencing her to 11 months in prison on multiple bribery convictions.

The deal saw the former bureau chief to former prime minister Ehud Olmert receive a reduced sentence inexchange for providing taped conversations of Olmert that allegedly incriminate him in the other cases he was

investigated for or is under investigation for. She was also fined NIS 25,000, with a NIS 75,000 forfeiture,noticeably lower than the seven-figure fines given to many other defendants in the case. She is due to starther prison sentence on September 1.

The Tel Aviv District Court judge was highly critical of Zaken throughout the sentencing hearing, saying shedeserved at least five years in prison. But Rozen said he was ultimately bound by Supreme Court precedentin favor of honoring plea bargains agreed to by the state.

After standing by Olmert’s side for more than 30 years, including more than five years of trials, Zaken cut aplea bargain, just days before Olmert’s March 31 conviction in the Holyland real estate case, agreeing totestify and bring evidence against him for trying to secure her noncooperation with the state in all of the casesagainst him.

After the state and the defense argued in favor of accepting the deal, it was Zaken’s turn to read a pre-writtenstatement of regret. She started by noting that she was “as sorry as I can be” for her actions, which wentagainst “her values and values she taught her c hildren.”

Then something remarkable happened. What was expec ted to be a simple statement turned into anunrehearsed cross-examination by Rozen.

Under this questioning on Thursday, Zaken painted herself as a victim who was exploited by Olmert and hisattorney Roi Blecher, and by Shmuel Duchner, the key Holyland briberturned- state’s witness, who died lastyear during the trial. She said Olmert and his associates had made her lie, but that she had decided to come

forward and offer evidence against him because she could no longer take being exploited and made ascapegoat.

She slammed Blecher for saying on television that she had lied, saying “Of course I lied, he told me to lie,”although her lawyer corrected her by saying a different Olmert associate had told her to lie.

Zaken also said Olmert had told her not to cooperate with the state in the “Jerusalem case,” whichencompassed the court cases surrounding the Talansky, Rishon Tours and Investment Center Affairs,because prosecutor Uri Korb, metaphorically, would “kill her,” meaning he would fool her in a plea bargainand send her to jail for an extended period.

Leading up to the verdict, Zaken gave the state eight recordings covering several hours of conversations

between her and Olmert, mostly from the years 2011 and 2012. It appeared that one of the phoneconversations was from the period when she was said to have withdrawn from a much earlier,unconsummated, plea bargain at the very start of the trial.

reach an agreement around mid- March after weeks of negotiations.

One reason the state gave at the time for rejecting the deal, and in parallel, for accepting a deal with her about a week later, was that she had first refused to produce the tapes and later agreed to produce them.

Zaken’s lawyer revealed that she did not want to turn over the tapes of Olmert at first, and even wavered onadmitting they existed because she thought there was nothing useful on them. The lawyer then explained thathe had pushed her to let him listen to the tapes and that he was surprised to hear that there was significantuseful evidence on the tapes against Olmert – an assessment the state agreed with.

During Thursday’s sentencing, Rozen expressed skepticism of the value of Zaken’s new testimony, given thathe was “already sending a former prime minister to prison for six years.

“What else is there to do?” he asked rhetorically.

The judge expressed anger at the fact that she had recorded a prime minister without his knowledge.

Zaken’s lawyer claimed, alternately, that she had taped Olmert with his knowledge in the context of work, or that she had taped him at home without his knowledge to provide details to family members who wanted toknow what was being discussed – claims the judge said had “no basis.”

Rozen called Zaken a “major criminal” in the Holyland case who had taken a great deal in bribe money for herself in addition to what she handled for Olmert and what he knew about. He asked why he should showher mercy when she had blown earlier plea bargains and agreed to a deal only at the eleventh hour after testifying falsely about a romance with Duchner (a manufactured story to explain the bribes), and after the trialwas essentially over.

Zaken’s lawyer tried on Thursday to justify her reluctance to turn on her boss, given that Olmert was a former prime minister she had served for decades, and said that for Zaken it had been like “parting the Red Sea.”

In its defense of the plea bargain, the state said the information provided by Zaken might lead to as much asnine additional years in prison for Olmert, whom Rozen sentenced on Tuesday to six years incarceration for

his Holyland-related convictions.

While the state has tried to keep most of the new evidence against Olmert secret, showing the judge anoutline, Rozen on Thursday pushed the state, saying that “if Olmert already knows” and has been questionedabout the allegations against him, “then the whole world knows.”

Impatient as to why the Zaken deal should matter to him, he asked the state: “Doesn’t all of this [the secretevidence] only apply to the Jerusalem case [involving the Talansky, Rishon Tours and Investment Center

Affairs]? How does it impact us [the Holyland case]?” The state responded by saying that if the judge, whowas holding a hard copy of the secret evidence in his hand, noted one instance where Olmert took illegalaction regarding Zaken, he should assume that Olmert took similar action toward Zaken in the Holyland case.

Speculation has been rife that the evidence relates to associates of Olmert paying Zaken’s legal fees andfines, as well as a salary, and improperly discussing the case or telling her to make untrue statements inexchange for the financial support.

There also appeared to be further explicit proof against Olmert relating to the Holyland case and newevidence against him in the 2012 trial.

Holyland Law: David Rosen, the District Court judge in Tel Aviv, sentenced Avraham .Aryeh Feiner, to six months in prison, to be converted for service

Judge David Rosen noted that Feiner's actions to undermine public confidence in theintegrity of its leaders and security concerns.
