The curriculum for this school changes every year. Your continued attendance establishes the commitment of both you and the bank to staying abreast of the most dynamic and pervasive compliance responsibility your institution has.How do you maintain your credentials for managing, auditing, or implementing the portion of your institution’s compliance func-tion that relates to money laundering, terrorist financing, or even national security? It is a question you will have to answer during every future BSA/AML regulatory examination. Your answer will serve as the regulators’ first impression of you and your bank’s compli-ance efforts.Every bank must provide ongoing training to those responsible for BSA and AML compli-ance. This school gives your institution an opportunity to listen to and interact with regulators from the federal functional regula-tory agencies and the Tennessee Department of Financial Institutions. It also provides a unique opportunity to get some rare how-to instruction in BSA/AML compliance issues.
THE MANUALAttendants receive a detailed manual with narrative explanations of regulatory require-ments and examination procedures. The manual is an excellent resource for future reference.
AUDIENCE/PROGRAM LEVEL/DELIVERY METHODThis live, overview program focuses on the many current BSA/AML issues fac-ing financial institutions and will assist financial institutions in meeting the annual training requirements imposed by the BSA regulations. It also provides attendants with the opportunity to network with other professionals interested in BSA compliance. Participants will have ample time to address issues/situations within their own financial institutions.This is not an introductory program. Atten-dants should have received at least 6 hours of formal BSA/AML training prior to at-tending this school. Each fall, TBA conducts a one-day BSA/AML overview program regionally across the state, which serves as excellent preparation for this school.
WHO SHOULD ATTENDThis school is designed for personnel who have management and/or functional level responsibilities for BSA compliance and/or operations. Individuals with retail banking, risk management, compliance, audit, operational, corporate banking, and training responsibilities will benefit from this program.

9:00 - 10:15 am What Happened Since Last Year? Ken Golliher, Principal, Pegasus Educational Services, LLC, Louisville, KYThis is a fast-paced review of the good, the bad, and the ugly BSA/AML compliance milestones we have all passed over the last 12 months. Insights are offered about how these developments may or may not affect your day-to-day compliance efforts. Golliher addresses the major enforcement actions, BSA reporting trends, proposed regulations, notices of proposed rulemaking, and interagency guidance.

10:30 am - Noon Regulatory Panel Discussion Representatives from each federal functional regulatory agency and the Tennessee Department of Financial InstitutionsRepresentatives from each of the federal functional regulatory agencies and the Tennessee Department of Financial Institutions have been invited to be present to review their agency’s current philosophies and practices. Each will provide an overview of their agency’s current approach to BSA/AML examinations. Attendants will have an op-portunity to ask questions and participate in give and take discussions.

1:00 - 2:30 pm How SARs Help & How Good SARs Help More Tennessee SAR Review Team Representative, Criminal Investigation Division, Internal Revenue Service A representative from the Tennessee SAR review team will discuss some generic situations in which SARs were filed, how the information was helpful, and how it was used in their investigations. They will offer their own observations about what type of information and analysis is helpful in the SAR narrative and what is not. You always wondered if anyone ever read the SARs you filed. You are about to get confirmation that they do plus some helpful tips on how to improve your institution’s SAR quality.

Ed Shemelya, Appalachia HIDTA, Office of National Drug Control, London, KYTennessee has the distinction of having several of its counties included in either the “Appalachia” or the “Gulf Coast” High In-tensity Drug Trafficking Area (HIDTA). Banks with bricks and mortar in those areas are affected in connection with their AML risk assessments. Banks whose customers live or operate in those areas are also affected. In this presentation, Shemelya will discuss the important role that banks can play in identifying and reporting suspicious activity. The presentation will center upon local problems and provide local information, exactly what banks in our state need to deny use of their facilities to drug traffickers.

2:45 - 4:00 pm Writing the SAR Narrative & Using the Spreadsheet Attachment Ken GolliherThe new FinCEN SAR: 1) reduced the amount of characters allowed in the narrative and 2) added an Excel® compatible spreadsheet. Banks need to re-evaluate the “5 Ws and an H” for the SAR narrative and how and when to incorporate the attachment, an excellent way to describe financial activity. This presentation focuses on tightening the narrative and using the attachment to provide the financial picture.

2:45 - 3:15 pm Reporting Suspicious Activity for Lenders Ken GolliherThis is a “train the trainer” session for you to take home. It is based on a set of PowerPoint slides and a brief handout. However, the discussion will focus on how you would do the presentation yourself for your bank’s lending staff. You will receive a copy of the slides after the program.
3:15 - 4:00 pm How to Help Your Customers Launder & Embezzle Money as Well as Cheat on Their Income Taxes Ken Golliher“What, we wouldn’t do that?!” There are a number of banking prac-tices that are very helpful to customers who want to skirt the law. These practices are often used by bank employees simply because they are more convenient or fall under the heading of “That’s the way we always have done it.” This presentation addresses many of those scenarios, shows how they assist customers in achieving their goals, and the attendant risks to the bank. Your goal is to make certain that you do not hear your institution’s practices addressed in the program.

10:45 - 11:30 am Preparing for Your Next On-site BSA/AML Examination Ken GolliherYou know your regulator will stop by eventually to evaluate your institution’s BSA/AML compliance program. This segment focuses on the idea that by actively preparing for that examination, not just waiting for it, you may be able to improve the results. It ad-dresses such things as staying abreast of regulatory hot buttons, reviewing the results of the previous examination, responding to the pre-examination questionnaire, the first on-site meeting, identifying contact personnel, and a variety of other things you can do to prepare for the inevitable and make certain the evalua-tion you receive is accurate.
11:30 am - Noon Financial Exploitation of the Elderly Ken GolliherBoth Tennessee and federal law impose upon banks a responsibility to report financial exploitation of an elderly customer. Interagency guidance issued by the federal functional bank regulatory agencies indicates that banks are, indeed, allowed to make these disclosures. Moreover, FinCEN guidance clearly indicates this type of activity is also reportable on a SAR. This presentation analyzes both report-ing issues and will help you understand and comply with both.

Ken GolliherTwo of the best resources available for direction in the completion of the CTR and the SAR are the FAQs FinCEN issued in May, 2013. This session reviews both publications and includes some additional insights based on the experiences that many discrete filers have had with the reports to date.
