Featured SpeakerS - ScientiFic expertSDr. Jimmie L. Valentine, B.S., M.S., Ph.D. of Ocean Springs, Mississippi is a retired Professor of Pediatrics, Pharmacology, and Myeloma Research from the University of Arkansas College of Medicine and now serves as a Consultant in Medical Pharmacology and Toxicology. Dr. Valentine was a pioneer in utilizing gas and liquid chromatography for analysis of human physiological fluids and tissues. Dr. Valentine has published 59 articles in peer-reviewed scientific and medical literature, 12 monographs in forensic newsletters, 11 chapters in books and is co-author of 3 books. He has presented many talks on the correlation of drug use and behavioral effects in relationship to levels determined in physiological fluids both in living and post-mortem situations. Dr. Valentine has testified in numerous civil and criminal trials and administrative hearings concerning drug findings and has been qualified as an expert witness in 14 different states as well as Federal courts.

Janine Arvizu of Tijeras NM, is a chemist and Certified Quality Auditor. She managed an analytical laboratory for the Department of Energy and audited laboratories for the US Navy. After reading the Inspector General report on the FBI laboratory and meeting Fred Whitehurst, she turned her attention to the lack of quality in the forensic industry. She conducts data quality assessments of forensic results, and has testified in state, federal, military, and international courts -and before a horse racing commission!

Mary Catherine McMurray, a Forensic Breath Test Expert out of Blue Mounds WI, started as a chemist in the WI breath alcohol program in 1986 and learned that “hiding the salami” and avoiding direct answers that would hurt the State’s case is part and parcel of being a State’s Expert. When ordered by the breath alcohol program to answer tough questions about instrumental issues with “no instrumentation is infallible” she knew she had to get out from under the State’s thumb and spread the word that not all breath alcohol tests are reliable. Mary has been working with the defense bar since 1995 and has qualified in courts in 18 states, 3 provinces of Canada and is on the Military’s list of approved experts.

Dr. Fran M. Gengo, Pharm.D., FCP, is a clinical pharmacologist. He is an Associate Professor of Neurology and Pharmacy at the University at Buffalo. His clinical practice is at the Dent Neurologic Institute where he sees patients as part of the Stroke, Dementia, Epilepsy and Substance Abuse Clinics. He has training for SFST, DRE and several breath test devices. He provides consultation and expert testimony in civil and criminal cases in the field of clinical pharmacology/forensic toxicology.

Dr. Alfred E. Staubus, Pharm.D., Ph.D., is an emeritus faculty member of The OSU College of Pharmacy and provides consulting and expert testimony in civil and criminal cases in the area of forensic toxicology. He has specialized training in the use of the Intoxilyzer 5000, BAC DataMaster, Intoxilyzer 8000, Intoximeters EC/IR II BAT Training Course and the Intoximeters EC/IR II.

Dr. Andreas Stolz has a Ph.D. in Physics (summa cum laude) and is an Associate Professor at the National Superconducting Cyclotron Laboratory at Michigan State University. With over 15 years of experience in nuclear physics, including statistical data analysis and metrology, he has provided expert testimony for OWI and OWID cases in Michigan and other states. He is the co-author of the 2012 chapter on DUI Mathematics in the “Inside the Minds: Understanding DUI scientific evidence” series.

Featured SpeakerS - LawyerS Evan Levow of Levow & Associates in New Jersey and Eastern Pennsylvania, represented the lead defendant in State of NJ v. Chun, the leading case on source code litigation in the United States, which involved the Draeger

Alcotest breath analyzer. His practice is 100% DUI defense. He has lectured throughout the country on breath testing, blood testing and field sobriety testing issues, and is a New Jersey Super Lawyer in 2011 & 2012.

Scott Joye of Joye, Nappier, and Risher, LLC, in Murrells Inlet, SC, practices throughout Horry and Georgetown Counties along SC’s Grand Strand. He is a Sustaining Member of the National College for DUI Defense, a Benefactor of the South Carolina Association of Criminal Defense Lawyers (SCACDL), and a longtime Member of the NACDL. In 2010 Scott was honored as the SCACDL Member of the Year. In 2012 and 2013 he received a Superlawyer designation by Superlawyers Magazine, and Lawyer of the Year by TheLocalNewspaper.com. A two time presenter at the Reese I. Joye SCACDL DUI Seminar, he has also hosted several seminars in South Carolina.

Drew Carroll practices law in Charleston SC, a graduate of the University of South Carolina University and School of Law he was a staff attorney with the Public Defender’s Office from 1997-1999. In private practice ever since he founded the Carroll Law Firm in 2010. Drew is a frequent lecturer on the defense of DUI cases, has successfully completed courses on the DataMaster & DataMaster DMT at National Patent Analytical Systems, NHTSA SFST Practitioners Course and NHTSA/IACP DRE overview course. Drew is a past President of the SCACDL, a member of the NACDL, the National College for DUI Defense and the South Carolina and the Charleston County Bar Associations.

Mike Nichols of East Lansing Michigan spoke at the seminar last year about “Uncertainty in Scientific Testing.” He followed up to his game-changing “uncertainty” success with another win that sent shockwaves through Michigan’s courts: a judge ruled that the Michigan State Police did not reliably analyze THC in human blood even though the report claimed the concentration was 11 ng/mL. Nichols has a statewide DUI/DUID practice, wrote the West practice book for Michigan and is an adjunct professor at Cooley Law School of DUI Law.

Deandra Grant of Dallas Texas is co-author of “The Texas DWI Manual” 2012 edition, has SFST, DRE, and Forensic Sobriety Assessment Certifications and has studied DWI forensic blood and urine testing as well as Gas Chromatography. Deandra, an NCDD member, was named to D Magazine’s list of Best Women Lawyers in Dallas 2010, Best Lawyers in Dallas and a Texas Super Lawyer in 2011.

Allen Trapp of Carrollton GA currently serves as the Georgia Delegate to the National College for DUI Defense. He is the author of Georgia Criminal Law Survival Guide, is board certified by NCDD, and is the veteran of 200+ jury trials. Two vehicular injury/homicide cases he won in the Georgia Supreme Court are routinely cited in courtrooms across the state. He has also appeared on NBC’s “Dateline”, CNN’s “Talk Back Live”, and numerous local (Atlanta) news programs.

Bruce Edge of Tulsa OK, is one of only two Board Certified DUI Defense Attorneys in Oklahoma. He is the co-author of Oklahoma Dui Defense, the Law and Practice. Additionally he is the co-author of 12 state editions of The DUI Survival Guide. Bruce is trained in all aspects of DUI defense and had presented nationally and internationally on various topics.

John Hunsucker of Oklahoma City OK is the Oklahoma State Delegate for the National College for DUI Defense and is the co-owner of the only 2 Intoxilyzer 8000s in private hands in Oklahoma. He is the co-author of Oklahoma Dui Defense, The Law and Practice and 12 state editions of The DUI Survival Guide. John has been featured as a DUI expert on Court TV as well as almost all of the local stations in Oklahoma City. He is trained in all aspects of DUI defense and has instructed lawyers nationally and internationally on various DUI topics.

Eric H. Sills of Albany, New York, is a criminal defense attorney whose practice focuses on DWI defense. He is a partner in the law firm of Gerstenzang, O’Hern, Hickey, Sills & Gerstenzang and the co-author of the book Handling the DWI Case in New York. Eric is one of three lawyers in New York State who have been Board Certified by the National College for DUI Defense (“NCDD”).* He is currently the New York State Delegate to the NCDD, and is also a member of the NACDL’s DUI Committee. Jeff Meadows is a graduate of the University of Miami School of Law and has practiced in Ohio since 1997. His practice is approximately 98% OVI defense where he has fought OVI charges in 10 counties but can regularly be found trying cases in Butler, Warren, Clermont & Hamilton Counties. Jeff has spoken at or chaired over 30 OVI defense seminars and is also a regular speaker at multiple 72 hr. DIP programs. When not arguing with prosecutors, he can be found SCUBA diving with sharks (which leave him unharmed, as a professional courtesy).

Patrick T. Barone of The Barone Defense Firm in Birmingham MI, is a sustaining member of the NCDD and the author of Defending Drinking Drivers and The DUI Book – A Citizen’s Guide to Understanding DUI Litigation in America. He is an adjunct law professor, frequent lecturer and has provided expert commentary in the media. Pat has certified on the DataMaster and as an SFST instructor.

Michael J. Boyle of the Barone Defense Firm, has trained extensively with Gerry Spence’s Trial Lawyer’s College and obtained persuasive speaker’s training through Dr. Paul Homoly. Mr. Boyle is certified as an SFST practitioner, is a graduate of a course in Forensic Chromatography, and has received training on the DMT Datamaster. Mr. Boyle obtained a Not Guilty jury verdict on a Felony OWI with what is believed to be the highest BrAC in Michigan (.28/.25).

Dennis Evans served as a Columbus Police Officer before receiving his and has established himself as a premier advocate of persons charged with driving under the influence with particular experience in the machines used for breath testing.

Daniel J. Sabol began his legal career with the Franklin County Public Defender’s office and is now in private practice dealing with charges ranging from speeding to aggravated murder.

Andrew R. Bucher of Toledo Ohio is a NCDD, the ABA, the OSBA and is an OACDL Board Member. He has received extensive training in OVI matters including training on the DataMaster, Gas Chromatography, the NHTSA SFSTs and DRE protocols.

Marcos Garza of Knoxville, Tennessee. He is a former United States Marine Corps Judge Advocate, is trained in all aspects of DUI defense, and was Super Lawyer Rising Star in 2010, 2011 & 2012. He is an NCDD Sustaining Member Board Member of the TACDL, NACDL Life-member of NACDL, and devotes the majority of his practice to DUI defense.
