2.4 Overall Adjustment Factor (OAF)

OAF = (AF1+ AF2+ AF3) 3.0

3. Total Honoraria = BA x (OAF + 1.0)

Note: Total honoraria may be adjusted by the PDRCI Board upon the Secretariats recommendation

based on any of the following factors: 1) ability of parties to pay the said fee, 2) complexity of the case and

3) qualifications of arbitrators. Please note that these fees exclude the administrative fees of the PDRCI

and miscellaneous expenses.

SCHEDULE OF ADMINISTRATIVE FEES

(Effective 1 November 2012)

The amount of the Administrative Fee (AF) shall be based on the sum in dispute (SID).

The SID is the total monetary claim of the claimant against the respondent or the amount of therespondents counterclaim. The AF will be shared equally between the claimant and the

respondent.

In all cases, the Claimant is required to pay upon filing of its claim a minimum fee (MF)

of P50,000.00.

The SID shall initially be determined from the pleadings of the parties and the

corresponding AF paid. The SID shall be subject to upward or downward adjustment after the

preliminary conference of the parties and their respective counsel with the arbitrator/s

appointed for the dispute.

The AF shall be based on the following schedule:

SID up to P1,000,000 (1M) - P50,000.00 (MF)

Over 1M to 5M - P55,000.00+ 1.68% of amount in excess of 1M



Over 50M to 100M - P250,700.00 + 0.17% of amount in excess of

50M

Over 900M to 1B - P1,665,700.00 + 0.16% of amount in excess of

900M

Over 1B to 2B - P1,830,700.00+ 0.16% of amount in excess of 1B,

but in no case to exceed P2.5 Million.

Over 2B - P3,435,700.00+ 0.16% of amount in excess of 2B,

but in no case to exceed P5 Million.

NOTE: The Administrative Fee covers all clerking and secretarial services similar to

that provided by a Clerk of Court.

For exceptional or unusual circumstances which will result in additional cost or

expenditure (not normally encountered), PDRCI reserves the right to issue and assess

additional administrative and/or arbitration fees. Prior to issuance of such assessment, PDRCI

will explain the same to the parties.

ARBITRATOR/S FEES

The arbitrator/s fees shall be subject to agreement by the parties with the arbitrator/s

which shall be negotiated by and through PDRCI.
