Tenants run risksin renting rooms

Many New Yorkers rent out their digs for some extra dough CityCouncil wants to strengthen law that makes it illegal to charge ‘guests’

One Park Slope couple has made $10,000 renting out this spare room on Airbnb.

This month, thousands ofNew Yorkers will handover their apartment keysto strangers, making a fewextra bucks by renting outtheir homes when theyhead out of town.

But they might not knowthey’re actually breaking acity law. A law that went in-to effect this past May bansrenting out apartments forfewer than 30 days.

The law was created totarget residential buildingsillegally converted intomakeshift hotels, but stillapplies to those who rentout their room for a nightor two on popular siteslike Airbnb.com.

Enforcement is based oncomplaints, so the city canissue violations and fines— but only after a neigh-bor calls 311 and com-plains, said city spokesmanMarc LaVorgna.

And New Yorkers whorent out their rooms onAirbnb have indeed beenfined, said LaVorgna. OneClinton Hill youth hostel,Loftstel, which advertisedon Airbnb, was slappedwith a full vacate order inMay, he said.

Fines for illegally rent-ing out rooms can rangefrom $800 to $2,500, butit's not the renter whopays, it's the landlord.

Tomorrow, the CityCouncil will mull increas-ing the penalties to illegalhotels, said City Council-woman Gale Brewer, up-ping the fines to as high as$25,000.

Airbnb.com encourageshosts to investigate locallaws and make sure theyare in compliance.

“Given the growingnumber of people whorent their extra space, there's obviously a demandin New York that’s notbeen met,” said Airbnbspokeswoman Kim Rubey.

Adopt a petwith MetroHi! My name is Levi, andI’m a 1-year-old Schipperkemix.

The ASPCA’s Cruelty In-tervention Advocacy pro-gram rescued me, alongwith a whole bunch of myfriends, from a hoardingsituation, so I’m still get-ting used to the big world.

I’m trying to move onfrom my past, but being afamily dog is a new thingfor me — so I’m scared ofnew things (which is prettymuch everything). If youcome play with me at theAdoption Center, I’m goingto be pretty shy. But Ipromise I will try and openup if you stick with me!

I loved to play with myprevious roommates, buthaven’t had much interac-tion with other dogs. Ihaven’t quite learned howto play with toys yet, but Icould become more playfulonce I find a good home. Ifyou’re an experienced and

patient dog owner in a qui-et, adults-only home,please give me a chance.

I am neutered and up todate on all vaccinations. Icome with a microchipand free follow-up vet ex-am. So stop by the ASPCAAdoption Center and takeme home as your new bestfriend today!

The U.S. Copyright Office is“re-evaluating” its stanceon yoga copyrights, addingfuel to a feud between anEast Village-based yogi andhis guru.

Last month, internation-al guru Bikram Choudhurysued New York's Yoga tothe People for infringingon what Choudhury says ishis copyrighted sequenceof sweltering yoga moves.Choudhury demanded a $1million payout.

On Dec. 9, Greg Gumu-cio, owner of Yoga to thePeople, filed his responseclaiming Choudhury doesnot have the copyright.

Included in Gumucio'sresponse is an e-mail fromLaura Lee Fischer, actingchief of the PerformingArts Division of the U.S.Copyright Office: “We de-termined that exercises, in-cluding yoga exercises, donot constitute the subjectmatter that Congress in-tended to protect as chore-ography," wrote Fischer.

Previously, the U.S.Copyright Office consid-

ered yoga sequences a typeof choreography, which issubject to copyright.

Gumucio heralded the e-mail as evidence thatChoudhury lacks a validcopyright, but RobertGilchrest, Choudhury’s at-torney, called it “inconse-quential fodder to the liti-gation.”

Gingrich, described bysome critics as rash andpetulant, kept his cool ashis Republican rivals criti-cized him for making up to$1.6 million from housinggiant Freddie Mac, for say-ing Palestinians were an“invented” people and forhis troubled marital past.

Mitt Romney, the for-mer frontrunner and oncethe presumed nominee, contrasted his business ex-perience with Gingrich’sbackground in Washing-ton.

Graynor goesBroadwayGraynor is currently star-ring in the Broadway play“Relatively Speaking,”which features three one-act plays. Alongside worksby Ethan Coen and ElaineMay is Woody Allen’s play,

“Honeymoon Motel,” inwhich Graynor stars.

“Woody Allen would bedoing Woody Allen to meand then I’d be doing itback to him and then I’drun on onstage,” she saysof her workingrelationship with the leg-endary director. “We’d

have notes after everyshow in the theater. Thatin and of itself is worth itsweight in gold. And, if Ihappen to find myself inone of his movies, theneven better.”

If there’s one girl whoknows her way around therole of brash party girl, it’s28-year-old Bostonian AriGraynor. As a severely ine-briated best pal in “Nickand Norah’s InfinitePlaylist” and more recentlyas a “friend with benefits”to Jonah Hill’s character in“The Sitter,” Graynor’s gotthe formula for chemicallyenhanced flake down to ascience. But this timearound, with “Pineapple Ex-press” director David Gor-don Green at the helm andHill carrying the film,Graynor got to improviseher way through what wasalready a solid script.

“When you’re workingwith someone like Jonah, who is so talented and sosmart and knows how toguide improvisations thatwork for a character and forthe story, it’s much easier toloosen up and play around,”she says. “That’s the luxuryof working with such tal-ented people — that youhave a guide ... that youknow it’s going to be guideddown the right path. There’s an ease to it.”

One thing that was per-haps not so easy was theopening scene of the film,in which Hill’s character is,ahem, servicing Graynor ina very personal way.

“So, that’s always an in-teresting day at work —when you find yourselfwith a new friend’s head be-tween your legs and 100people standing around.Like, really?” Graynorlaughs. “This is what I’m do-ing? I have some friendsthat are becoming doctorsor social workers. “Both Ways OpenJaws,” the recently re-

leased album by The Dø,enters through a rare win-

dow in time where it willprobably make a lot of mu-sic publications’ “best of2011” lists. Then when writ-ers who don’t put it on thatlist see that some of theirpeers have chosen it, theFrench duo’s album will in-evitably make their “ones towatch in 2012” lists.

“Both Ways” is worthy ofboth. It instantly feels clas-sic and contemporary. Andlike the most exciting mu-sic, the album is rife withunexpected combinationsthat sometimes seem at op-posite ends of the spectrum— it is celebratory and it isagitated; it is majestic and itis raw; it is artsy and it is

poppy. Basically, it soundsthe way you’d expect LadyGaga to sound if you had on-ly ever seen photos of her.

There are free jazz freak-outs, stomping feet, woozyhorns, marimbas and softblankets of harmonies. What is most apparent isthat Olivia Merilahti andDan Levy are in love withsounds as well as songs.

“Usually, guitar is thefirst instrument I use forthe songwriting,” says Meri-lahti. “We think it’s reallyimportant to have a songthat also works with justguitar and vocals. ... But itusually gets eliminated bymore interesting soundsand there’s just no roomanymore for that guitar.”

This album is the secondfor The Dø. With their de-

but, “A Mouthful,” they be-came the first English-speak-ing French act to top thecharts in their homeland.

“I spoke Finnish andFrench when I started spea-king,” says Merilahti. “ThenI just listened to so manydifferent [English-speaking]singers and I really wantedto know what the songswere about, so I always readthe booklets very carefullyand wanted to learn thewords I didn’t know. That’show I built my vocabulary.”

She says the first songshe learned this way wasHole’s “Violet,” with itsopening line of, “And thesky was made of amethyst.”Merilahti makes similar po-etic leaps with her words.

“I really have a certaindistance with the lyrics and

they’re all so very intimate,”she says. “It’s very difficultfor me to describe.”

Upon further discussion, and being asked about the“Both Ways Open Jaws” ti-tle, Merilahti reveals more.

“It’s about feeling indanger from all parts, andit’s also like when you’rein danger, you start to pro-tect yourself, so it’s alsothe beginning of aggres-siveness,” she says. “I’mscared of a lot of things, and I think I’m starting tostruggle against that. …Dan is a very brave guy. When you’re exploringemotions and takingchances in the studio, it re-quires a lot of courage.”

THE DØ

CAN DO NO WRONG

This French duo’s sophomore album, ‘Both Ways Open Jaws,’ is destined for late entry year-end ‘best of’ lists, as well as

early entry ‘ones to watch’ lists

Sounds kinda likeThere are hints of influencesall over “Both Ways OpenJaws,” but instead of rattlingthem off as reference points,we gave Merilahti a chanceto confirm or deny them.

Did you listen to Stereolab

growing up?

No, not at all, and someonetold me about them a cou-ple of days ago. They said,“You should tour with Stere-olab if they still played to-gether,” or something. May-be Dan has, but I’m not sure.Joanna Newsom?

Yeah, I love her so much. How about Radiohead?

It’s kind of a late referencefor both of us. ... Dan didn’tlisten to many songs whenhe was younger. He wasmore into instrumental and20th century classical musicor jazz, and I was always like,“Oh everyone’s listening toRadiohead,” so I wouldn’t.... But it’s kind of impossibleto ignore. What was the first band

you two connected with?

Wu-Tang Clan. There was alot of hip-hop. Eminem wasalso one of them. And EllaFitzgerald!

Why dø they call

themselves that?

The Dø pronounce theirname like “dough” as in thefirst note of the solfègescale, as in do-re-mi-fa-so-la-ti-do. But what is that littleslash through the o?

“We just wanted it to looklike a note, like when youwrite music in music theory,”says Merilahti. “It reallylooks like a musical symbol.”

“How f—ing amazing wasshe in this movie?” PattonOswalt asks breathlesslywhen one of CharlizeTheron’s particularly har-rowing scenes in “YoungAdult” is mentioned.Theron is, indeed, amazing. But really, this film — writ-ten by Diablo Cody, directedby Jason Reitman and co-starring Oswalt — is over-

loaded with talent. Playingthe impromptu sidekick toa woman on a mission to se-duce her former highschool boyfriend, who’snow married, Oswalt went

to great lengths to get hischaracter right. He evenhired an acting coach totackle the role, which issomething quite differentfrom what he’s used to inhis stand-up career or previ-ous film and TV appear-ances. The multi-hyphenatespoke to Metro in an exclu-sive interview about Gener-ation X and the dangers of

nostalgia. You used an acting coach for

the first time with this role.

Why did you think this

character merited that kind of

preparation?

Because the script was sogood, but there was somuch nuance and so muchof a delicate tightrope backand forth between despairand humor. The humor nev-er came out of “let’s stick ajoke here.” [It] came out ofreal human behavior. I hadthis mix of exhilaration forbeing offered the script andthen terror. I didn’t want todo wrong by it, because itwas so well-written.Both you and Cody fit so many

pop culture references into

your work. How do your

viewpoints relate?

“Juno” was, whether youlike it or not, a pretty accu-rate depiction of how youngpeople talk to each other. …[“Young Adult”] is moreabout Gen X getting olderand what do they have tojettison and what do theystill hold on to? I think theyremember being so self-con-

scious about people thatwere baby boomers andhow stupid they soundedusing their old slang. Nowthey’re almost overthink-ing, “Do I say the stuff Iused to say?” Like it or not,it is a very accurate portraitof “this is how Gen X getsolder.” If you thought thebaby boomers grew old in areally clumsy way, wait tillyou see how we do it. You’ve released comedy

albums and a book (“Zombie

Spaceship Wasteland”), and

there’s awards buzz for this

performance. Do you aspire

to achieve an EGOT (Emmy,

Grammy, Oscar, Tony)?

[Laughs] I just want to keepdoing creative work. Obvi-ously, I want to write, Iwant to do comedy. I wantto do films and TV. I mean,of course I’d love an Oscarnomination. Obviously, get-ting a nomination wouldhelp me get more work. That is true. And also, I’dlove to go to the Oscars.

Oswalt: ‘Goodtimes can keephappening, justnot the same ones’

Comedian, author and actor Patton Oswalt warns ofthe dangers of nostalgia Why the ‘Young Adult’ starhired an acting coach, but isn’t quite hoping for an EGOT

Q&A

Much of the film has to dowith sentimentality andtrying to bring the pastinto the present. Are youever tempted to do that?

It’s very dangerous. I’mjust as guilty of it as any-one else. I think FrankZappa said, “Some day,we’re all going to die ofnostalgia.” You have tokeep moving forward be-

cause a big part of life isloss. Things fall away andit’s very childish to turnaway from that. I havemixed feelings about it.It’s almost like if you wantthe same good times tokeep happening, that’swhat’s dangerous. Goodtimes can keep happening, just not the same ones. Ifyou expect to be the sameperson having the samegood time, then that’s alsoreally dangerous.

There’s something to besaid for glamour. Andthere’s precious little of it tobe found in “Bonnie &Clyde” at the GeraldSchoenfeld Theatre. Thebland musical with a scoreby Frank Wildhorn, book byIvan Menchell and lyrics byDon Black attempts to bringthe infamous couple downfrom their lofty perch in theiconic Arthur Penn movie— but they seem even fur-ther away. In this attempt athistorical accuracy, they’remore simplistic than acces-sible. Bonnie (Laura Osnes)wants to be Clara Bow andClyde (Jeremy Jordan) idol-izes Al Capone.

“Bonnie and Clyde” be-gins with a tease of their fi-nal shootout, then flashesback to them years earlier, alongside their childhoodselves (Kelsey Fowler asYoung Bonnie and TalonAckerman as Young Clyde)in Texas singing about theiraspirations. They meet afterClyde breaks out of jail andare immediately smitten.Their romance grows asClyde goes back inside, only

to break out again — thistime, with Bonnie’s help.Their life of crime beginssmall — robbing grocerystores and stealing cars —but eventually escalates tobank robberies and murder.

Wildhorn’s music is for-gettable, and, unfortunate-ly, so is Menchell’s script. Al-though the stakes get high-er as Clyde kills more andmore people, the story arcis flat. Even when they’rejoined by Clyde’s brotherBuck (Claybourne Elder)and Buck’s wife Blanche(Melissa van der Schyff),there’s no sense of urgency. The bloodletting escalates, but the onstage tempera-ture stays tepid.

You can start to feelbetter by knowingyou are not alone.Test it out — go and

poll 10 people about theholiday season. My guess isthat at least five would ex-press that it’s all too much.Accept the notion that welive in a society that is driv-en by the dollar — and dur-ing the holiday season, thisis all magnified by big-boxretailers and the like. Thismaterialism is not an ex-pression of what the holi-days truly represent, nor doextravagance and expensivegifts equal happiness. Youhave a choice: Participate init or don’t.

In light of your recentmoney woes, be creativeand spare the craziness ofthe shopping malls. Cook a

dinner for a friend, promiseto do some yard work orhousework for your par-ents, babysit a sibling’s kidor simply spend time with along-lost friend. The mostmemorable gift you cangive someone is an experi-ence, not a material item.People remember activitiesand experiences long afterthe fleeting excitement of atoy, article of clothing orother material gift.

As for the holidayparties, know thatyou actually havesome control over

what you participate in. Askyourself: Do I have to attendevery party? Are you sayingyes because you feel pres-sured to do so? Don’t feelcompelled to accept every

invitation. Get comfortablesaying “no” to what youdon’t want and “yes” to thethings you truly believe in. Iguarantee you’ll feel less re-sentful and much calmerduring the holidays.

Finally, examine yournegativity. Is it really allnonsense, or is there some-thing positive you can gleanfrom the season? By makingsmall changes to how youthink, you’ll be able tomake big changes in howyou feel.

Tackling your holiday stressIt’s the most wonderful time of the year — but not for everyone If

you’re overwhelmed, you’re not alone Celebrate the season your way

I’m finding myself really stressed out thisholiday season. Due to work issues, I hardly have any money this year to buy gifts and attendparties. I feelembarrassed about it. I just want to close myeyes and wake up onJan. 2. What can I do to feel better?

At 83, Philip W. Jackson hasauthored dozens of bookson education philosophy, including the 1968 classic“Life in Classrooms,” stillused by education majorsaround the globe. “What IsEducation?” marks his re-turn to the basic questionshe pondered half a centuryago, beginning with his ini-tial fascination with semi-nal American educationtheorist, John Dewey.

How has your philosophy of

education evolved since you

first encountered Dewey?

I read Dewey’s 1938 [‘WhatIs Education’] speech when

I was training to become ateacher. It puzzled me be-cause he was addressingprofessional educators, andhe implored them to con-sider that basic question. Istarted to look at Dewey’searly training as a philoso-pher. He was a Hegelian. SoI tried to take Hegel seri-ously, and I eventually be-came more of a Hegelianthan Dewey. We hear a lot about the

United States falling behind

other countries in education.

The comparisons that aremade — which place us un-favorably, according tosome, on the international

yardstick — do so only insubjects that are very easilymeasurable. It’s in thosesubjects that the other na-tions are beating us, as itwere. But we’ve been wor-ried about that recurrently.I feel that’s unfortunate. It’s shortsighted. Are we re-ally helping our studentsbecome more thoughtful, better civic citizens? Arewe helping them to be-come wiser, rather thanjust full of information? Those are more interestingquestions.

Break out the gum — it’s fi-nals time! If you find your-self in a pinch before an ex-am, chew on this: A studysuggests that popping astick of your favorite stickystuff five minutes beforetaking a test could actuallyhelp improve your score.

About 80 undergrad stu-dents participated in thestudy. St. Lawrence Univer-sity Assistant Professor ofPsychology Serge Onyper, the lead researcher, foundthat gum-chewers did bet-ter on their tests than non-gum-chewers. Those whochewed experienced “masti-cation-induced arousal,”leading to a boost in per-formance, but it only lasted

for about the first 20 min-utes of test-taking.

Prior research has shownthat physical activity canboost the performance ofstudents in the classroom, but this study shows thateven mild activity, like gumchewing, can have a posi-tive effect on the brain.

Just make sure you spitout the gum before you sitdown for the test. The studyalso found that chewinggum could actually detractaway from performancedue to “a sharing of re-sources by cognitive andmasticatory processes.”

Why obscuredirty truths?RE: “NO DISCOURSE IN DRUGWAR?”: Common sense re-quires that at this time ofeconomic hardship, peo-ple should keep theirstrong beliefs away anddo their job or else hangon to their beliefs if theyinterfere with work. Ob-viously policemen are hu-man beings, not robotswho cannot take thebarometric readings oftheir environment. Whenthe Mexican presidentcame here and made itclear that his country’sdrug problem would begreatly curtailed if Ameri-can demand were cut

down, that was a power-ful message foreverybody — ourpresident, Congress andall of us, including lawenforcement agencies.Playing ostrich with suchan issue is most certainlynot what the policemenneed to do at this time.JOHN DINGA, VIA E-MAIL

Elementary schools, colleges and police acade-mies are routinely teach-ing lies about what weare all mandated to call“marihuana” since Aug.8, 1937. This upcomingyear will herald the 75thanniversary of marihua-na prohibition — andwe’ll have surpassed 23

Nothing like cutting itclose.

With the Giants’ seasonlikely on the line, trailingby 12 points late in thefourth, Eli Manning drovethe Giants for two touch-downs to win 37-34 andkeep their playoff hopesalive.

But it might have takenevery bit of the 6-foot-5 Ja-son Pierre-Paul’s wingspanto preserve it.

After the Cowboys took a34-22 lead with 5:41 left,Manning began his charge.New York marched downthe field for an easy Jake

Ballard touchdown to bringthem within five points. Af-ter forcing a three-and-out,largely in part due to anoverthrow by Tony Romo,

Manning drove 58 yardsdown to the 1, where Bran-don Jacobs scored the go-ahead touchdown. Theywent for two and convertedas well.

It was then up to the de-fense to hold the Cowboys

with 46 seconds left.Dallas marched it to the

30-yard line with ease, butPierre-Paul blocked the kickthat would’ve tied it.
