STATEMENT ISSUANCE FOR CALVERT CLIFFS NUCLEAR POWER PLANT, UNIT 3 COMBINED LICENSE APPLICATION

Dear Mr. Gibson: The purpose of this letter is to inform Calvert Cliffs 3 Nuclear Project, LLC, and UniStar Nuclear Development, LLC (collectively referred to as UniStar), of items related to environmental regulatory compliance to be addressed after the completion of the final environmental impact statement (FEIS) for the combined license (COL) application for the Calvert Cliffs Nuclear Power Plant, Unit 3. The U.S. Nuclear Regulatory Commission (NRC) staff, in cooperation with the U.S. Army Corps of Engineers (USACE or Corps), have completed NUREG – 1936, “Environmental Impact Statement for the Combined License (COL) for Calvert Cliffs Nuclear Power Plant, Unit 3: Final Report”. A Notice of Availability” regarding the issuance of this report will be published in the Federal Register on May 20, 2011. The items that the NRC is aware of, as of the date of this letter that remain open after the FEIS issuance are outlined in the enclosure. The NRC staff will be completing its Air Conformity Determination which is required under the Clean Air Act (42 U.S.C. 7401 et seq.) outside of the National Environmental Policy Act (NEPA) process. The NRC cannot make a decision on the COL until the air conformity determination is completed. In addition, the NRC staff will need to be informed of any new and significant information relevant to environmental concerns so the staff can determine if a supplement to the final environmental impact statement is warranted under the requirements of Title 10 of the Code of Federal Regulations, Part 51.92. More details on these items and any actions required to complete them are also outlined in the enclosure. If requested, the NRC staff will schedule meetings with UniStar, the Corps, and State agencies to review and discuss the open items and the steps necessary to resolve the issues, as needed.

DEVELOPMENT, LLC, OPEN ISSUES FOR THE ENVIRONMENTAL REVIEW

OF THE COMBINED LICENSE APPLICATION FOR

CALVERT CLIFFS NUCLEAR POWER PLANT, UNIT 3

DOCKET NO. 52-016 The following items do not affect the final environmental impact statement (FEIS) schedule but the U.S. Nuclear Regulatory Commission (NRC) staff considers the following items as open issues with regard to issuance of the combined license, if issued, and as such the NRC is providing guidance: 1. Submittal of New Information for the Project after Issuance of the FEIS

Title 10 of the Code of Federal Regulations (10 CFR), Part 51.92(a) states that, “If the proposed action has not been taken, the NRC staff will prepare a supplement to a final environmental impact statement for which a notice of availability has been published in the Federal Register as provided in § 51.118, if:

(1) There are substantial changes in the proposed action that are relevant to environmental concerns; or

(2) There are new and significant circumstances or information relevant to environmental concerns and bearing on the proposed action or its impacts.”

10 CFR Part 51.92(c) states that, “[t]he NRC staff may prepare a supplement to a final environmental impact statement when, in its opinion, preparation of a supplement will further the purposes of the National Environmental Policy Act.”

Actions Needed: The NRC is requesting that the environmental project manager continue to be copied on correspondence for all information regarding the Calvert Cliffs Unit 3 project. This correspondence includes but is not limited to correspondence between Calvert Cliffs 3 Nuclear Project, LLC, and UniStar Nuclear Development, LLC (collectively referred to as UniStar) and the NRC safety review, the U.S. Army Corps of Engineers (Corps), and the State of Maryland. The NRC will then review the correspondence to determine if a supplement to the FEIS is warranted per the requirements in 10 CFR Part 51.92(a) and 51.92(c). In addition, the NRC staff must be notified when a determination of the Federal consistency is made by the State of Maryland under the Coastal Zone Management Act. The NRC staff must also be notified when a decision on the Section 401b Certification is made under the Clean Water Act by the State of Maryland. The NRC staff cannot move forward on its Federal action until these certifications are obtained by the applicant.

Dear Chairwoman Savoy: The purpose of this letter is to inform you that the U.S. Nuclear Regulatory Commission (NRC) and the U.S. Army Corps of Engineers, as a cooperating agency, have completed the final environmental impact statement (FEIS) for the Calvert Cliffs Nuclear Power Plant Calvert Cliffs Nuclear Power Plant (CCNPP) Unit 3 Combined License (COL) application. In a letter dated April 15, 2010, the NRC staff informed the Piscataway Conoy Confederacy and Subtribes, Inc., that it had completed the draft environmental impact statement (DEIS) (NUREG-1936), as part of its review of the application submitted by Calvert Cliffs 3 Nuclear Project, LLC and UniStar Nuclear Operating Services, LLC, for a COL for one new nuclear unit at its CCNPP site near Lusby, Maryland. Pursuant to Title 36 of the Code of Federal Regulations, Part 800.8©, Protection of Historic Properties, a copy of the DEIS was enclosed for your review and comment under the provisions of Section 106 of the National Historic Preservation Act of 1966, as amended (NHPA), and the National Environmental Policy Act of 1969, as amended. The NRC also sent the DEIS to the Advisory Council on Historic Preservation (ACHP), the State Historic Preservation Office (SHPO), other Tribes, and potentially interested consulting parties. The comment period on the DEIS ended on July 9, 2010. No comments were received by the NRC from the Maryland Commission on African American History and Culture, the ACHP, any other Tribe, or any potentially interested consulting party. The comment period on the DEIS ended on July 9, 2010. By letter dated March 10, 2011, the SHPO, informed the NRC that they reviewed the DEIS in accordance with Section 106 of the NHPA and §§ 5A-325 and 5A-326 of the State Finance and Procurement Article and concurred with the findings presented in Section 4.6 of the DEIS relating to the assessment of effects on historic properties. A copy of the FEIS, NUREG-1936, “Environmental Impact Statement for the Combined License (COL) for Calvert Cliffs Nuclear Power Plant, Unit 3: Final Report,” is included with this letter for your information. A notice of availability of the FEIS is anticipated to be published by the NRC and the U.S. Environmental Protection Agency on May 20, 2011, in the Federal Register. The FEIS is available for public inspection at the NRC Public Document Room, located at One White Flint North, 11555 Rockville Pike (First Floor), Rockville, Maryland 20852, or from the Publicly Available Records component of the NRC’s Agencywide Documents Access Management system (ADAMS) under the accession numbers ML11129A167 and ML11129A179. In a letter dated April 15, 2010, the NRC staff informed the Piscataway Indian Nation that it had completed the draft environmental impact statement (DEIS) (NUREG-1936), as part of its review of the application submitted by Calvert Cliffs 3 Nuclear Project, LLC and UniStar Nuclear Operating Services, LLC, for a COL for one new nuclear unit at its CCNPP site near Lusby, Maryland. Pursuant to Title 36 of the Code of Federal Regulations, Part 800.8(c), Protection of Historic Properties, a copy of the DEIS was enclosed for your review and comment under the provisions of Section 106 of the National Historic Preservation Act of 1966, as amended (NHPA), and the National Environmental Policy Act of 1969, as amended. The NRC also sent the DEIS to the Advisory Council on Historic Preservation (ACHP), the State Historic Preservation Office (SHPO), other Tribes, and potentially interested consulting parties. The comment period on the DEIS ended on July 9, 2010. No comments were received by the NRC from your Tribe, the ACHP, any other Tribe, or any potentially interested consulting parties. In a letter dated April 15, 2010, the NRC staff informed the Susquehanna River Basin Commission (SRBC) that it had completed the draft environmental impact statement (DEIS) (NUREG-1936), as part of its review of the application submitted by Calvert Cliffs 3 Nuclear Project, LLC and UniStar Nuclear Operating Services, LLC, for a COL for one new nuclear unit at its CCNPP site near Lusby, Maryland. Pursuant to Title 10 of the Code of Federal Regulations, Part 51.74, a copy of the DEIS was enclosed for your review and comment under the provisions of the National Environmental Policy Act of 1969, as amended, and the Fish and Wildlife Coordination Act of 1934, as amended. The comment period on the DEIS ended on July 9, 2010. The NRC did not receive any comments from the SRBC. A copy of the FEIS, NUREG-1936, “Environmental Impact Statement for the Combined License (COL) for Calvert Cliffs Nuclear Power Plant, Unit 3: Final Report,” is included with this letter for your information. A notice of availability of the FEIS is anticipated to be published by the NRC and the U.S. Environmental Protection Agency on May 20, 2011, in the Federal Register. In a letter dated April 15, 2010, the NRC staff informed the National Marine Fisheries Service (NMFS) that it had completed the draft environmental impact statement (DEIS) (NUREG-1936), as part of its review of the application submitted by Calvert Cliffs 3 Nuclear Project, LLC and UniStar Nuclear Operating Services, LLC, for a COL for one new nuclear unit at its CCNPP site near Lusby, Maryland. Pursuant to Title 10 of the Code of Federal Regulations, Part 51.74, a copy of the DEIS was enclosed for your review and comment under the provisions of the National Environmental Policy Act of 1969, as amended, and the Fish and Wildlife Coordination Act of 1934, as amended. The comment period on the DEIS ended on July 9, 2010. Pursuant to Section 7 of the Endangered Species Act of 1973, as amended, the NRC initiated consultation with NMFS by transmitting the biological assessment (BA) for the CCNPP Unit 3 COL application as part of the DEIS. Also included in the DEIS was the Essential Fish Habitat (EFH) Assessment that was transmitted to the NMFS pursuant to the Magnuson-Stevens Fishery Conservation and Management Act of 1986, as amended. By letter dated August 17, 2010 (ML102360364), the NMFS concluded the EHF assessment and recommended mitigation for the project. Comments on the DEIS were also included in the August 17, 2010, letter. The NRC responded to the NMFS recommendations by letter dated September 17, 2010 (ML102530102). The NRC received a letter on April 15, 2011, (ML111080809) from NMFS concluding the Section 7 consultation. In addition, the Calvert Library, Southern Branch, located at 20 Appeal Lane, Lusby, Maryland, and the Calvert Library, Prince Frederick, located at 850 Costley Way, Prince Frederick, Maryland, have agreed to make the final environmental impact statement (FEIS) available for public inspection. As discussed in the FEIS, the NRC staff’s recommendation related to the environmental aspects of the proposed action is that the COL should be issued. This recommendation is based on: (1) the Environmental Report (ER) submitted by Calvert Cliffs 3 Nuclear Project, LLC and UniStar Nuclear Operating Services, LLC, as revised; (2) consultation with Federal, State, Tribal and local agencies; (3) the NRC staff’s independent review; (4) the staff’s consideration of comments received during the environmental review; and (5) the assessments summarized in the FEIS, including the potential mitigation measures identified in the ER and in the FEIS. In addition, in making its preliminary recommendation, the NRC staff has concluded that there are no environmentally preferable or obviously superior sites in the region of interest.
