    As one might sense from t he history Fox relates about th e place, it is own ed by hisfamily , specifically his fath er. Many supporters of drilling in the area hav equestioned any implication tha t Fox is a local, say ing h e is a New Yorker wh osefamily has a weekend property in the ar ea.

    Neither of his paren ts or h is siblings liv e on th e property . Fox say s it is his prim ar y residence.

    According to the Way ne Coun ty Bureau of Elections, Fox registered to v ote inMilanv ille in December 2 002 . Fox is foun der and ar tistic director of Interna tionalWOW Co., w hich lists its address on it s website as Grand Av enue, Brookly n.

    In conv ersations and e-mail exchanges, Fox said he considers him self to hav e grownup in both Pennsy lv ania and New York.

    He say s "Milanv ille is the only consistent home I'v e had m y wh ole life" and calls theproperty "the centerin g point of my life." He adds that he did not h ide his New York roots, wearing a Yankees cap for m ost of the film .

    Nearby landowners who hav e leased their land hav e frequently questioned Fox'sassertion that he stood to make $100,000 t o allow drillin g on the land. Foxforwarded to Greenwire a proposed lease agreem ent th at w ould hav e added up to asmu ch a s $90,000, assum ing 5 acres of land distu rbance bey ond the basic, 5-acre

    The oil and gas industry enjoys exemptions from port ions of those env ironmenta llaws. But it is not completely exempt from a ny of them.

    A one-paragraph section of the 550-page energy bill exempted hy drau lic fractu ringfrom the Safe Drinking Water Act (SDWA) bu t only the u nderground injectioncontrol (UIC) prov isions. Oil and gas companies can be sanctioned under otherprov isions of the law . And one has been recently in Texas ( Greenwire , Dec. 8, 201 0).

    Industry has contended that the bill does not "exempt" hy drau lic fractu ring from thelaw, because EPA ha d not prev iously regulated fractur ing under SDWA. But th e2005 bill specifically excluded fractu ring stat ing th at the regu lation "excludes ...undergr ound injection of fluids ... pur sua nt t o hy drau lic fractu ring operat ions."

    Also, EPA complied with a 1 99 7 appeals cour t order instruct ing it to require thatAlabam a regu late fractu ring u nder SDWA. The 2005 legislation ended thatrequirem ent for EPA an d prev ented the precedent from being used elsewh ere.

    Howev er, outside Ala bam a, EPA ha d imposed no restrict ions on fractu ring un derSDWA before the exemption in the 2005 bill.

    The energy bill, called the Energy Policy Act of 2005, origina ted from a 2001 WhiteHouse energy plan, dev eloped by a t ask force led by Vice President Dick Cheney , w hoheaded Halliburton at the time of the Alabama ru ling. The Los Angeles Timesreported in 2004 that Cheney 's office wa s inv olv ed in discussions about how fractu ring should be portr ay ed in th e 2001 report and th at it resisted EPA'sat tempts to inclu de concern s about its effects on th e env ironment ( Greenwire , Oct.

    1 5, 201 0).

    Passage of the bill wa s a policy achiev ement for the George W. Bush admin istra tion.Barack Obama , a senator a t th e time, v oted for th e bill.

    The 2005 energy bill also exempted oil and gas drilling from th e storm waterprov isions of the Clean Water Act . Drilling was already exempt from CWA's

    The 2 005 act a lso made it easier for oil and gas projects on federa l lan ds to bypass the

    most exhau stiv e federal rev iews under the National Env ironmenta l Policy Act(NEPA). If a broader env ironmental analy sis, such as an env ironm ental impactstatement, has alr eady been done for the g as field, the la w allowed a "categoricalexclusion" for dr ill pads less than 5 acres, a nd m ost drill pads are less than 5 acr es.

    Hazardous wa ste creat ed by drilling is exempt from t he federal hazardous wa steregu lat ions of the Resour ce Conserv at ion an d Recov ery Act (RCRA), bu t th isexemption w as gran ted long before 2 005. Under federal law, it is treated as regu larwaste headed to a landfill. Stat es can h av e stricter stan dards.

    Clean Air Act prov isions implemented long before 2 005, a ccording to theenv ironm ental gr oup Earth works, prev ent oil and gas wells from being lu mpedtogether when m easur ing a ir pollution to determine what kind of protections areneeded.

But the u pwar d trend star ted before passage of the 2 005bill.

    drinking w ater. EPA studied the use of hy drau lic fractu ring fluids in "undergr oundsources of drinking water" to produce coalbed methane and determined in 2004 thatit posed "litt le or no thr eat. " Tha t finding formed the basis of the SDWA exemption forfracturing in the 2005 law.

    But n ot a ll underground sour ces of drinking water are aquifers that produce potablewa ter. Some are reserv oirs and considered potent ial sour ces of water in th e fut ur e,but t hey are far too salty to be used for potable wa ter now.

    If a driller injects hazardous ma terials into a reserv oir th at people use for drin kingwater, EPA an d state regula tors still hav e the au thority to step in, stop the drillingand sanction the company .

    In a nother wr inkle in th e complex law , EPA is allowed to requir e a company to get aperm it before fractu ring with diesel fuel.

    When Reps. Diana DeGette (D-Colo.), Maur ice Hinchey (D-N.Y. ) an d John Salazar(D-Colo.) in troduced their bill in 2008, it w as not called th e "FRAC Act." It did a lit tle

    more tha n simply "take out" the exem ption for fra ctur ing. The 4 9-word, onesentence bill (pdf) rev ersed it to say the definition of underground injection control"includes" fracturing. Before 2005, the statute had been silent on whetherfractu ring w as cov ered by SDWA.

    In 2 009 , DeGette's bill (pdf) was renam ed th e "Fractur ing Responsibility andAw areness of Chemicals Act." It w as expanded to requir e public disclosur e of thechemicals used in fra ctur ing fluid.

    There are easier w ay s to find the chemical ingredients of fractur ing fluid thantra cking down t ru cks. For exam ple, the Pennsy lv ania Depar tm ent of Env ironmenta l Protection h as a list (pdf) of some of the chemicals used on itswebsite.

    But th e inform ation wasn't as readily av ailable in 2003 when Theo Colborn star tedresearching the chemicals (pdf) being in jected into wells in western Colora do wh ereshe liv es. As for chasing down trucks, th e website for her group, the EndocrineDisru ptor Exch ange, states tha t to research the ingredients used in gas drilling, th egroup has sifted through numerous sour ces of inform ation, inclu ding accident andspill r eport s.

    In 2 002, EPA ha d published a draft of its fractur ing study tha t listed fractur ingfluid ingredients gath ered from m ateria l safety data sheets and th e Bureau of Land

    Mana gement. Little-known at the t ime, it listed ingredients such as benzene,2-butoxy etha nol ("2-Be") and diesel fuel. It also noted that early fractu rin gtechnology inv olv ed injection of napalm .

    Pennsy lv an ia's DEP released its list of chemicals in Mar ch 2 009. It was updated andposted to the agency 's website in June 201 0. New York's Depar tm ent of Env ironmenta l Conserv ation published a m ore detailed list in a 2009 study (pdf)(page 1 30). Energy In Depth cites its sour ce as inform ation gath ered in 2009 .

    Some state gov ernm ent lists lack importa nt inform ation or giv e v agu e nam es forpotentially hazardous chemica ls ( Greenwire , June 21 , 2010).

    The m ost complete public disclosure is in Wy oming, where the state's Oil and GasConserv at ion Commission began la st year t o demand tha t driller s disclose eachchemical that they are putting in each well ( Greenwire , Dec. 20, 2 01 0). Ev en there,though, the state allows companies to withhold the name of some chemicals, if they can prov e tha t the inform ation constitutes a "tra de secret."

    smorgasbord th at drillers can choose from. But in a ny giv en "frack job," the figure ismore like a dozen.

    A quick rev iew of the deta iled disclosures being filed in Wy oming shows a ra nge of between eight a nd 1 4 different chemicals mixed with w ater a nd sand for each "frack

    job."

    According to industry , those chemicals amount between 2 percent a nd half apercent of the mixt ur e. Fractur ing companies spend a lot of time and money on th atsmall fraction. Halliburton once estimated that public disclosure of its proprietary formulas could cost it $375 million.

    The chemica ls inv olv ed can be as mundane as ice cream thickener and as toxic asbenzene. Many of those toxins are harm ful in t iny quan tities.

    As for whether fracturing creates a "mini-earthquake," Anne Sheehan, a professor of geologica l sciences at the Univ ersity of Colorado, said, "I don't th ink that 's really exaggera ting." But , she added, "In fra cking , it would be too smal l to be felt by people."

    And she noted that "clean" renewable energy can cause the same "min i-earth quakes." Geotherm al energy production can cause the sam e seismic activ ity ,she said. In 2 009, a geotherma l project in Switzerlan d was shu t down when a study foun d ear thquakes generated by the project would likely cau se millions of dollar s indamage each y ear.

    The deep undergr oun d injection of drilling waste cau ses more seismic activ ity ,Sheehan said. Some a re looking a t u nderground injection a s they search for t hecause of an ear thquake "swarm " in Ar kansas, which has unnerv ed residents butcaused little dama ge.

    According to Fox's rebu tta l, he used inform at ion from an 800-page " supplementalgeneric environmental impact statement (pdf)" produced by the New York Depart ment of Conserv at ion. It is difficult to replicate his exact figu re from theinform ation, but it is squarely within the ra nge.

    That study estim ated tha t th e num ber of truckloads to construct a well pad and

    fractu re one well is between 890 an d 1 ,3 40 t ru ckloads. The av erage of those figur esis 1 ,11 5.

    The Energy In Depth critique m ocked the idea that ev ery "frack job" would take thesam e num ber of trips. Fox say s tha t he av eraged the figures.

    For one well pad with eight w ells drilled on it , th e New York study estimatedbetween 5,850 and 8,905 tru ckloads, for an av erage of 7 ,37 7 .

    The Marcellu s Shale Coalit ion's website, say s each fra ck job inv olv es "an a v erage of 400 trucks coming and going" to the site. It does not list a specific nu mber of tru ck trips.

    Fox cites these tru ck-tr ip figures in th e midst of his segm ent on drilling in westernWy oming, not Pennsy lv ania or New York. The Bureau of Land Managem ent'senv ironm ental studies for th at a rea estimated tha t building a m ulti-well well pad,drilling the first well and "fracking" it would require 2,020 t ru ck trips. Tha tassum ed it would take 45 or m ore day s to drill a w ell. Companies are now g etting

    them done in fewer th an 2 0 day s.

    Most states, including Pennsy lv ania , hav e ru les requiring drillers to keep wastewater from seeping in to the ground and groundwater, which m eans drillers shouldbe sanct ioned if their liners leak. But not all states hav e such ru les.

    ProPublica, a n ews organization t hat has run a series of art icles sharply critical of drilling, analyzed a report (pdf) on pit liners tha t is frequently cited by industry . Itfound that wh ile 23 states require pits to be lined with natu ra l or a rtificial liners tokeep fluids from seeping directly into the ground, at least four states do not.

    ProPublica also noted that 1 7 sta tes do not requir e tha t pits be kept at a distancefrom stream s and riv ers and that 1 7 states do not explicitly forbid pits fromintersecting the underground water t able. And fewer than half of the statessur v ey ed hav e a specific cleanu p stan dard when w aste fluids or pits do spill.

    Those gas fields are in the path of a longstanding migration corridor, but mule deerand an telope are not endangered. And the sage grouse in tha t a rea do not m igra te.

    The sage grouse, har d hit by oil an d gas dev elopment, is on t he decline. Subdiv isionsand wind power t ur bines are also a problem. Last y ear , federal officials determ inedsage grouse met th e quali fications for protection under the Endan gered Species Act .But th ey said there were too many other species tha t were in more dire stra its andtoo few resour ces to protect t hem . Th e Fish an d Wildlife Serv ice deemed sage grouse"warr anted but precluded" ra ther tha n th reatened or endangered.

    The nu mber of deer in the Sublette County mu le deer herd ha s declined 7 percentsince 2005, according to BLM. But on the Mesa w here drilling r igs ming le withprime w intering habitat for deer, th e num ber of deer rebounded 25 percent since2005 after several y ears of decline. BLM officials note th at there are other factorsaffecting deer in th e area, including drought and residential dev elopment.

    In 2 004, EPA was com pleting a multiy ear study of fractur ing. Researchers (notenforcement personnel) w ere looking into wh ether drillers contaminategroundwater when they inject hy draulic fracturing fluid into underground sourcesof drinking w ater. The study did not cover all ty pes of drilling, only production of metha ne gas from coal beds.

    EPA's Office of Water, not a panel, determ ined not to pur sue further study . Th e officewas headed by then-acting A ssistan t Adm inistrator Benjamin Grum bles, a GeorgeW. Bush appointee. The EPA study determ ined tha t fractu ring m ay releasepotentially hazardous chemicals into sour ces of drinking water but said there wa s noreason to study it fur ther . The study determ ined that fractu ring posed "little or nothr eat" because the w ater is sucked back up out of the g round and th e hazardouschemicals would likely be diluted or biodegrade on their own.

The cut wa s to the sta te-funded port ion of the DEP budget, said Jan Jarr ett, president a nd CEO of PennFutur e, a stat e-focusedenv ironm ental gr oup, but the agency gets money from other places such as federalgran ts and user fees.

    The "7 00 staff" figur e seems to corr elate t o the nu mber of sta tewide positions lost.The agency hired 37 new employ ees in 2009 and announced in Janua ry 201 0 that

    EPA's preliminary report in December 2 009 said a bloom of toxic a lgae wiped out

    alm ost a ll fish, mu ssels, salam anders and aquatic life along 43 m iles of the cr eek tha t snakes back and forth along t he Pennsy lv ania -West Virgin ia border. The salty conditions tha t a llowed the algae, EPA reported, w ere tied to mine tr eatm entdischarg es high in "tota l dissolv ed solids."

    Fox has questioned that finding, noting t ha t m ines hav e been draining into localcreeks for decades, and posed, "So, w ha t h as changed?" But in September 2 009, WestVirg inia Public Broadcasting reported a state officia l's contention, "One possibleculprit is a new borehole on t he Pennsy lv ania side that's injecting polluted wa ter

    into the mine v oid."

    State officials did not say wh at the borehole was. But in the weeks before th e fish kill,EPA h ad fined the min e owner m ore th an $1 50,000 for failing to properly staff acoalbed methane injection well in the v icinity .

    EPA said it wa s working to dev elop standar ds to protect aqu at ic life from m inewa stes. It said officials hoped the standard could be expan ded to cov er MarcellusShale drilling wa stes and coalbed methane wastes.

    The Colorado Oil and Gas Conserv at ion Commission told (pdf) Markh am , "There ar eno indications of oil an d gas related im pacts to your wa ter w ell."

    Markham's partner, Marsha Mendenhall, acknowledges the state's conclusion in thefilm. But she doesn't accept it. She tells Fox that state officials told her, "There'snothing wr ong w ith t he wa ter th at can be affected by oil and gas production in y ourarea." She adds, "I wa s a lit tle disappointed in the state. I mean, obv iously , we hav e aproblem here."

    The sam e agency found (pdf) that methane in the Ellsworths' well wa ter didorigina te from oil an d gas development. The Ellsworths settled with a g as company and Colorado officials replug ged a 60-y ear-old well located near their well tha t th eagency considered (pdf) to be a possible source of or conduit for migration of gasfrom drilling.

    Fox h as said that becau se of the settlement w ith the gas company the Ellsworths arenow prohibit ed from discussing the situ at ion.

    Dissatisfaction with state-lev el regu lation is comm on am ong critics of drilling, wh owa nt to see more U.S. EPA regu lat ion.

In 2 004,the commission said, it determined that seep was caused by a drilling error,specifically "an im properly cemented borehole." The operator was hit w ith a"substantial fine."
