At therequest of the Director, an independent study is being conductedby the RAND Corporation to thoroughly examine and identifyimplications of the strategy. In an effort to gather data insupport of this study, OTD has initiated'an information collection effort regarding cases where investigations havebeen negatively impacted by carriers1 inability to either (A)retain for a reasonable period and provide to law enforcementsubscriber and non-content transactional records relating totheir customers' communications, or (B) provide adequateassistance in the timely implementation of real time ELSURorders.

OTD understands that cases are often impacted by aninability of a communications carrier to provide adequateassistance, a communications carrier's insistence on chargingan exorbitant fee to process certain information, or acommunications carrier's business practice that inadvertentlythwarts law enforcement. However, much of this information hasbeen passed to OTD anecdotally. Concrete examples are neededfor-the purpose of more fully supporting the FBI's claims thatits investigative efforts are often frustrated by technologicalimpediments or outdated statutory constraints.

OTD needs the assistance of all Field Offices to helpdocument specific incidents where communications carriers'capabilities are not sufficient to meet the FBI' s investigativeneeds. This survey should be completed by either investigativeor technical personnel who have encountered the inability ofcommunications carriers to provide stored records or adequateassistance with electronic surveillance. AllField Offices are requested to complete the survey for FiscalYear (FY) 2008 and the first quarter of FY 2009.The collected data will be shared within the lawenforcement community and OTD will provide results from thisinformation collection effort to the RAND Corporation andinternally within the FBI. This collection effort is intendedto highlight areas where law enforcement needs additionalsupport and resources. OTD is actively pursuing the National Electronic Surveillance Strategy, commonly known as the 'Going Dark' initiative in aneffort to maintain and adv ance electronic surveillance capabilities. Th e front office would like to collect allaccom plishm ents m ad e in connection with the Going Dark Initiative five pro ng s listed below. Pa st acco m plis hm ent s willbe compiled by A/UC, C1U,| 1 Curre nt and futu re acc om pli sh m ent s will be solicited along with yoursignificant accom plishm ents on a monthly basis .
