HR 1219: The Hall- Schakowsky Optometric Equity in Medicaid Act

In1986,CongressapprovedandPresidentReagansignedintolawlegisla3onformallyrecognizingDoctorsofOptometryasphysiciansinMedicare(PublicLaw99‐509).Asaresult,for25years,America’sseniorshavebeenabletochoosetheirlocaloptometristforcoveredprimaryeyecare.

Unfortunately,inMedicaid,fortoolongtherehasbeenrestrictedaccessandfew,ifany,choiceswhenitcomestoessen3aleyehealth.Althoughoptometristshavelongprovidedthebulk–recentes3matesindicateupto81%‐‐ofprimaryeyehealthandvisioncarethroughMedicaid,theprogramtoooOenfailstofullyrecognizeoptometriststooffercoveredmedicalservicestheyaretrained,licensedandready,willingandabletoprovide.InaddiDontorestricDngaccesstocare,exisDnglawallowsbureaucratsand,increasingly,managedcarecompaniestomakeimportantmedicaldecisionsforpaDentswhoneedeyecare.Forworkingmenandwomen,thistypeofoutdatedproviderdiscrimina3oncanresultindelayedorevendeniedcareforaneyedisease.Inaddi3on,taxpayersul3matelypayevenhighercostswhenmuch‐neededaccesstoprimarycareisrestricted.

Reps.RalphHall(R‐TX)andJanSchakowsky(D‐IL)haveworkedwithalleyedoctors–optometristsandophthalmologists–onabi‐par3san,pro‐compe33veapproachtoge�ngexpandedaccesstoquality,essen3aleyecaretothecommuni3eswhereit’smostneeded.TheHall‐SchakowskyOptometricEquityinMedicaidAct(HR1219)seekstoavertapoten3alcrisisinaccesstoprimaryeyecareforMedicaidpa3entsbyamendingtheFederalMedicaidstatutetofullyrecognizeoptometriststoprovide“medicalandotherhealthservicestotheextentthoseservicesmaybeperformedunderstatelaw.”Thebillwouldnotchangethescopeofprac3ceofanyhealthcareprofessionalnorsupersedethelongstandingauthorityofstatestodeterminescopeofprac3ce.Thebilldoesnotauthorizeanynewspendingoraddanynewcoveredbenefit;itmerelygivespa3entsimportantchoiceandaccesstomedicaleyecarealreadycoveredbyMedicaid.

WhyisitSOimportantthatoptometristsarefullyrecognizedMedicaidstatute?

• Beginningin2014,therewillbeamajorexpansioninMedicaideligibilitytoincludeallnon‐elderly,non‐pregnantindividualswithmodifiedadjustedgrossincomesupto133%oftheFederalpovertylevel(FPL);actually,itwillbeupto138%ofpovertybecauseStatesmustdisregarddollaramountsequalto5%oftheFPL.

• TheAffordableCareActprovides100%FederalmatchingfornewMedicaideligiblesin2014‐2016,decliningto90%for2019andlater.Soinotherwords:federalmatchingforMedicaidbenefitswillbesignificantlyincreasingin2014,affec3ngbothstateandfederalbudgets.

• Statesmayalsoadopt“benchmark”or“benchmark‐equivalent”benefitpackages,whichmaycoverfewerbenefitsthantradi3onalMedicaid.Star3ngin2014,bothbenchmarkandbenchmark‐equivalentcoveragemustincludeatleastthe“essen3alhealthbenefits”tobedefinedbytheSecretary(these“essen3alhealthbenefits”willalsoapplytoprivateindividualandsmallgrouphealthinsurancemarkets).Essen3alhealthbenefitsinclude“ambulatoryservices”and“pediatricservices,includingoralandvisioncare”.TheSecretary’sproposeddefini3onofessen3albenefitswillbeopentopubliccommentduringtheusualrulemakingprocess.Westronglyfeelthattheessen3albenefitsshouldbeacomprehensiveeyeexamwithfollow‐upcareandhaveaskedsenatorswritealeZertoHHSSecretarySebelius

sta3ngso.Ifacomprehensiveeyeexamisrecognizedasanessen3alhealthbenefit,“benchmark”benefitpackages,privateindividualandsmallgrouphealthinsurancemarketswillincludecoverageforeyeexamsforpediatrics.With the Department of Health and Human Services (HHS) now implementing the provisions of the Affordable Care Act, Senators are urged to write to HHS Secretary Sebelius in support of making an annual comprehensive eye exam a foundation of the children’s vision care essential health benefit included in the law.

• Sec3on1905(e)oftheSocialSecurityActwasaspecialprovisionenactedin1972(CoshaZAmendment)thatappliesonlytooptometrists’services.Itsinten3onwastorequireaStatethatoncecoveredoptometrists’servicesunderitsMedicaidprogramandnowspecificallycoverseyecareprovidedby“physicians”(whichanoptometristisauthorizedtoprovide)tocoversuchservices,whetherrenderedby“aphysician”oranoptometrist.NotethatunderMedicaid,theterm“physician”isgenerallyviewedasreferringtodoctorsofmedicineorosteopathybecauseofhowthelawdefinestheterm“physicians’services”.Yetevenwiththisamendment,optometryiss3llconsidered“op3onal”.

refugeecampinamountainouscommunityjustnorthoftheMacedonianborder.Wehadtoflybyhelicopterbecausetheroadhadbeendestroyedbylandmines.Whenwearrivedwesetupourclinicinablown‐upschoolhouseandperformedeyeexamsonthevillagers.AboutmidwaythroughthemorningIhadjustfita70‐year‐oldmanwithglasses.Whenheputthemonhebegantocry.Beingonewhotakesgreatprideinhiswork,Ibecameabitconcernedthatperhapshedidnotlikehisglasses.SothroughmytranslatorIaskedifeverythingwasokayforhim.Themantoldmethathewascryingbecausehewassohappy.Ithadbeenmanyyearssincehehadbeenabletoseewell.Hesaidthatnowwithhisnewglasseshewasabletoseeagainhowbeau3fulhiswifewas,andhewasovercomewithemo3on.Itwasquiteamovingexperienceformeaswell,andoneIwillneverforget.Whatmakesthisdaypar3cularlymemorableisthatbythe3mewereturnedtothebasecamplaterthatday,wehadbeeninformedthattheUSwasunderaterroristaZackandtheWorldTradeCenterhadbeenbombed.ThemorningthatIhadspentrevelinginthejoyofarediscoveredapprecia3onforwhatwedoforpeople(asoptometristsandasAmericans)wasreplacedbyanaOernoonofmind‐numbingfearanduncertaintywhileIspenttherestoftheeveninginabunkerwithaloadedmachinegun.The11thofSeptemberofthatyeariscertainlyonethatnoneofuswilleverforget.Iamfortunatethatthedatealsomarksoneofmyfondestmemories.

The Albuquerque NM 2010 Special Olympics Summer Games is schedule for May 20, 2011 at the University of New Mexico Track stadium. As part of the Special Olympic Games Healthy Athletes venue we will again be offering the “Opening Eyes” *program. The “Opening Eyes” program provides a comprehensive eye and vision screening program to a group of athletes who seldom receive health care.

You and your staff are cordially invited to participate in the Special Olympics NM, Opening Eyes event on Saturday, May 20, 2011, 10-3. Stay the entire 5 hours or 2-3 hour blocks. Lunch, drinks and a T-shirt will be provided. Lions Club International members, Essilor and local opticians/technicians and others will be participating.

Join 100s of optometrists across the nation and the world in changing the lives of these remarkable Special Olympic Athletes by providing them eye and vision care.
