Olsen The 2009 Florida Legislature faced a daunting task in setting Florida’s budget. With the downturn in the na- tional economy, Florida’s real estate market collapse, abundant home fore- closures, and tax collections far below expectations, the Florida Legislature made many extremely difficult deci- sions as it fashioned the 2009-2010 State budget. The budget crisis could not be resolved within the 60-day nor- mal session period, and consequently the 2009 session was extended one week to finish the budget. With the budget crisis, the Legislature focused most of its energy on funding related matters and thus, the Legislature passed only 235 general bills, down from usually double that amount. Below is a summary of some of the bills that passed that may be of inter- est to Section members: HB 73 - Expedited Permitting, the “Mike McHugh Act” HB 73 directs the Department of Environmental Protection (DEP) and the water management districts to adopt a program to expedite the review of applications for environ- mental resource permits (“ERP”) or wetland resource permits for econom- ic development projects local govern- ments identify as a target industry business under section 288.106, F.S. This is intended to provide these proj- ects with a 45-day permit application review period, which is one-half the standard 90-day review period. To be eligible, a permit applicant must re- ceive a resolution from the applicable city or county commission identifying the business as a target industry business. Projects that also require Board of Trustees of the Internal Improvement Trust Fund authori- zation to use submerged lands are ineligible for this expedited review. Additionally, for projects located in charter counties with a population greater than 1.2 million (Broward, Miami-Dade, Orange, Hillsborough and Palm Beach Counties) that have sought delegation of the ERP pro- gram, the county commission may request its economic development agency to determine the project’s eli- gibility as a target industry or busi- ness. Effective Date: July 1, 2009. CS/CS/HB 227—Impact Fee Leg- islation HB 227 modifies the legal burden of proof in impact fee challenge cases to one which requires local govern- ments to prove by a preponderance of the evidence that there is a ratio- nal nexus between the fee charged and the impacts resulting from the project. The bill also prevents impact fee increases through July 1, 2011, except in cases necessary to retire pledged debt. Effective date: July 1, 2009. CS/CS/SB 360 - Growth Manage- ment “The Community Renewal Act” This legislation creates transpor- tation concurrency exception areas (“TCEAs”) and DRI exemptions for projects within certain dense urban land areas. “Dense urban land areas” (“DULAs”) are defined as municipali- ties with 1,000 people per square mile with a minimum population of 5,000 and counties (including municipali- ties therein) with 1,000 people per square mile or with a population of one million. The bill creates statutory TCEAs for all municipal DULAs, all county DULAs in those areas of quali- fying counties with an adopted urban service area (“USA”) meeting a new USA definition, and all counties with a population of at least 900,000 but without an adopted USA. USAs may be designated using the alternative state review process. Statutory exemptions from these TCEAs were created for Dade and Broward Counties. For statutory TCEAs, local governments have two years to develop strategies to sup- port and fund mobility within the

Thebilldelaysupdatestodemon-stratefinanciallyfeasiblecomprehen-siveplansuntilDecember1,2011.Forpublicschools, thebillallowsthe5-yearcapitaloutlayFTEgrowthratetoexceed10%whereenrollmentdoesnotexceed2,000studentsoverthe10-yearcapitaloutlayperiod,andtheschooldistrictcapacitywillnotexceed100%overthe10-yearplanningperiod.De-velopersmayusecharterschoolsasmitigation requiredby school con-currencylaws,assumingthecharterschoolsmeetcertainsafetystandards.Local schooldistrictsmust includerelocatablesacquiredafter1998 inavailablecapacitywheretheschooldistrictutilizesthesamerelocatablesin itsreported inventoryofstudentstations.Thebillremovestheprohi-bitionagainst comprehensiveplanamendmentswherelocalgovernmentsfailtoenterintointerlocalagreementsor otherwise fail toaddress schoolconcurrencyrequirements. HB 707 -Management of Waste-waterThislegislationrequirestheDepart-mentofHealth(“DOH”)toalertlocalgovernmentsand localDEPofficeswhenever theDOH issues specifichealthadvisories regarding swim-minginbeachwatersduetoelevatedlevelsoffecalcoliformorenterococcibacteria.ThelocalDEPofficesmusttheninvestigatenearbywastewatertreatment facilities todetermine ifthe facilityexperiencedan incidentthat contributed to thecontamina-tion and report the results to therelevantlocalgovernment.Releasesfromwastewatertreatmentfacilitiesare required tobe reported to theDOHasa condition of theplant’soperatingpermitasisareportofanycorrectiveaction.Additionally, thislegislationallowstheDOHtoassigncertainlistedresponsibilitiesrelatedtopublicswimmingpoolsandbathingfacilitiestomulti-countyindependentspecialdistrictsundercertaincondi-tions.Effective Date: July 1, 2009.

HB 1021 - Transportation HB1021 includesadefinitionof“backlog”forpurposesofcalculatingadeveloper’s transportation costs.Thebill clarifies thatnewdevelop-mentcannotbechargedproportion-atesharefeestoaddressexistingorprojected backlogs resulting frombackgroundtrafficand future traf-fic growth not attributable to thedevelopmentunderreview.ThebillalsocontainsaprovisionexemptingcertainseaportrelatedprojectsfromDevelopmentofRegionalImpactre-view if theproject iswithin threemilesof theseaport.Effective Date: July 1, 2009.

CS/CS/SB 1078 - Limitation of Liability/Water Management Dis-tricts Thisbillexpandsthe limitationson liabilityenjoyedbywaterman-agementdistrictsregardinginjuriesresulting from the use of districtowned land to includeparkareas,waterareas,andotherareasusedbythepublicforrecreationalactivities,regardless ofwhether thoseareaswereexpresslymadeavailableorac-cessibletothepublic.Theseareasaresubjecttothelimitationsonliabilityso longas thewatermanagementdistrictcontrols,possesses,ormain-tainstheseareas.Thislimitationonliabilityaffordedtothewaterman-agementdistricts isalsograntedtoprivatepartieswhohaveprovidedeasementoruserightstothewatermanagementdistrict,who in turnmakes those landsavailable to thepublicforoutdoorrecreationalactivi-ties.Effective Date: July 1, 2009.

CS/CS/HB 1423-Florida Fish and Wildlife Conservation Commis-sion Thisbillincludesthesubstantivelegislative package of the FloridaFishandWildlifeConservationCom-mission (FWC). HB 1423 clarifieslocalgovernments’authoritytoregu-lateanchoringandmooringofves-sels.Thebillrevisesexistingprohibi-torylanguagestatingthatwhilelocalgovernmentscanprohibitorrestrictthemooringoranchoringof float-ingstructuresorlive-aboardvesselswithin their jurisdictionsorofanyvesselswithinthemarkedboundar-iesofpermittedmooringfields, lo-calgovernmentsareprohibitedfromregulating theanchoringofvesselsother than live-aboardvesselsout-

sideofsuchmooringfields. HB1423alsodirectsFWCtoes-tablishananchoringandmooringpilotprogram to explorepotentialoptionsforregulatingtheanchoringormooringofnon-live-aboardves-selsoutsidethemarkedboundariesofpublicmooringfields.Thegoalsofthepilotprogramincludepromotingtheestablishmentofpublicmooringfields;promotingpublicaccesstothewatersofthestate;enhancingnavi-gationalsafety;protectingmaritimeinfrastructure; protecting thema-rineenvironment;anddeterringtheimproperstorageandabandonmentofvessels.ThebilldirectsFWCtoidentifyatleastfivelocationsforthepilotprogrambyJuly1,2011,andtoset forthaprogrambywhich localgovernmentscanestablishanchoringandmooringregulationsforallves-sels.LocalgovernmentsmustdeveloptheordinancesincoordinationwithFWC,DEP,organizationsrepresent-ingvesselownersoroperators,andother entities; and theFWCmustapprove the ordinances.The pilotprogramexpiresonJuly1,2014,andtheFWCmustprovidea report totheLegislatureandtheGovernorbyJanuary1,2014. InSeptember2008,Florida’sSec-ondDistrictCourtofAppealsuphelda trial court decision overturningFWC’sexistingproceduresforapprov-ing local government-promulgatedboatingrestrictedareas.See Collier County Bd. of County Com’rs v. Fish & Wildlife Conservation Com’n,993So.2d69(Fla.2dDCA2008).Inre-sponse,HB1423providesaprocedurewherebyFWCmustapprove localgovernmentboatingrestrictedareassolongastheordinanceisbasedonsubjective factors, like traffic con-gestion;however, itallowsnon-sub-jective-basedordinances togo intoeffectwithoutapproval.SubsequentrulemakingwillestablishtheFWCapproval process details.The billclarifiesthatFWCcannotapproveasubjective-basedlocalgovernmentor-dinanceunlessFWCdeterminesthatthe localgovernmenthasproducedcompetentsubstantialevidencethat“theordinanceisnecessarytoprotectpublicsafety.” HB1423alsoestablishesanon-criminalinfractionfor“propeller-scar-ring”certainseagrassspeciesoutsideofamarkedchannel inanaquaticpreserve,andfinancialpenalties forvesseloperatorsthatstrikeoranchor

uponcoralreefs,althoughoperatorsofrecreationalvesselswillonlyreceiveawarning for first-timeanchoringincidents.Effective date: July 1, 2009, except as otherwise provided.

SB 2080 - Water Management Dis-trict Reauthorization SB2080reenactssection373.069,F.S., to reauthorize the fivewatermanagementdistricts.TheOckla-wahaRiverAdvisoryCouncilwithintheSt.JohnsRiverWaterManage-mentDistrictiseliminated.Thebillalsorepealssections373.465 (LakePanasoffkeeRestorationCouncil)and373.466(LakePanasoffkeeRestora-tionProgram),F.S.Thebillmakesminorchangestothewatermanage-mentdistrict governingboardap-pointmentprocess.SB2080grantsGoverningBoards,basinboards,wa-termanagementdistrictcommittees,andadvisoryboardsthe latitudetomeetbyelectronicmeansratherthaninperson.Thelegislationmandatesthatdecisions to issuepermitsbedelegated fromthewatermanage-mentdistrictgoverningboardstotheagencystaff. SB2080providesthatalternativewatersupplyprojectsresultingfromaprivate-publicpartnershipbetweenlocal governments, regionalwatersupplyauthoritiesandutilities,andaprivate landownerwhomakesanextraordinary contributionof landor fundsmay receive consumptiveusepermits forup to50years.Nosuchauthority isprovided ifoneofthepartiesisapublic-privateutilitycreatedafterApril1,2008.Thelong-termpermitissubjecttoafiveyearcompliancereport.Similarly,SB2080authorizeslargescalerenewableen-ergyprojectstoreceiveconsumptiveusepermitsforatleast25yearsifthereasonablebeneficialusetestismet.Theselong-termpermitsarealsosub-jecttofiveyearcompliancereports,butwithdrawalsneednotoccur forup to fouryearsbeforerevocationscanoccurduetonon-use. SB 2080 encourages “Florida-friendlylandscapes”anddirectsDEPtodevelopa“Florida-FriendlyLand-scapeGuidanceModelforOrdinances,Covenants,andRestrictions.”Theterm“Xeriscape”isnowreplacedthrough-outtheFloridaStatuteswiththeterm“Florida-friendlylandscape.”Thebillrenders invalidandunenforceablecovenantsandrestrictionsprohibitingtheuseof“Florida-friendlylandscape.”

Thebillalsorequires“Florida-friendlylandscaping”forlandscapingonstate-ownedproperties. The legislation notes that theSouthernWaterUseCautionArea(SWUCA) locatedwithin the terri-toryoftheSouthwestFloridaWaterManagement District (SWFWMD)hasexperiencedsignificantdeclinesingroundwaterandacceleratedsaltwater intrusion.Consequently, theWest-CentralFloridaWaterRestora-tionPlanwasdevelopedtoaddressSWUCAwaterquantityandqualityissues,withmultiplecomponentsaf-fectingagriculture,minimumflowsandlevels,andecologicalrestoration.ThebillrequiresSWFWMDtoprovide

areportontheWest-CentralFloridaWaterRestorationPlanto theLeg-islaturebefore the2010 legislativesession.Effective Date: July 1, 2009.

CS/HB 7053-Rural Agricultural Industrial Centers Thisbilldefinesruralagriculturalindustrialcentersasthose facilitiesinunincorporatedareaswhichareexistingagriculturalindustrialopera-tionsandwhichemployatleast200personsfulltime.Suchfacilitiesmustbelocatedwithin,or10milesfrom,adesignatedruralareaofcriticaleco-nomicconcern.Thebillallowsfortheexpeditedreviewofplanamendmentstoexpandsuch facilitieswhere theexpansionwillcreateatleast50newjobsandwillbeservicedbyexistingorplannedinfrastructure.Theexpansioncannotexceed320acresor50%ofthesizeoftheexistingfacility,whicheverisgreater.Applications foramend-

mentstoaccommodatesuchexpan-sionsmustbesubmittedtotheDCAwithinsixmonthsofreceipt.TheDCAisprohibitedfromapplyingtheurbansprawlcriteriatoapplicationsmeet-ingtherequirementsofthisstatute.Effective date: July 1, 2009.

HB 7157 -Conservation Lands Property Tax This legislation implements theconstitutionalamendmentapprovedbythevotersinNovember2008pro-vidingforspecialpropertytaxtreat-mentforlandusedforconservationpurposes.The bill provides a newpropertytaxexemptionforlanddedi-catedinperpetuityto“conservationpurposes.”Qualifying conservationpurposesincludeservingasthebasisfora contributionunder26U.S.C.s. 170(h), retention of substantialnaturalvalueofthelandorretentionforhabitat,waterqualityenhance-ment,orwaterrecharge.Specialre-quirementsapply toparcelsunder40acres.Thebill requiresbaselinedocumentationoftheland’senviron-mentalconditions.Improvementstothepropertyareassessedseparately.Ifan“allowedcommercialuse”occursontheproperty,theexemptionisforonly50%oftheassessedvalueoftheland. HB7157provides that landown-ersmustfileanapplication for theexemptionor classifieduse statusbeforeMarch1st eachyearunlessthecountywaivedtherequirementforrenewalapplications.Landown-ershaveanaffirmativeobligationtonotifypropertyappraisersifthelandbecomesineligiblefortheexemption,andsubstantialpenaltiesresultfromthe failure todo so.Effective date: January 1, 2010.

City of Jacksonville v. Coffield, 34 Fla. L. Weekly D704 (Fla. 1st DCA Apr. 3, 2009). Coffield’ssuccessfuldevelopmentofatwo-acrepropertyintoaresidentialsubdivisiondependeduponaccesstoanearbypublicroadintoanadjoiningJacksonvillesubdivision,Windsong.WindsongpetitionedtheCityofJack-sonville (the“City”) toabandontheroad.Ifgranted,Windsong’spetitionwouldhaveresulted in theconver-sionofthepublicroadintoaprivate,gatedroad,therebyprecludingpublicaccesstoCoffield’sproposedsubdivi-sion.NotwithstandingWindsong’spetition,Coffieldproceededwithac-quisitionoftheparcelandhisdevel-opmentplans,apparentlyassumingthathewouldbeabletoproceedeveniftheroadwereclosed.TheCityis-suedcertainpreliminaryapprovals(includingaConcurrencyReserva-tionCertificate)toCoffield,butalsosubsequentlygrantedWindsong’spe-titiontoabandontheroad.TheCitythennotifiedCoffieldofthisdecisionandrequiredhimtodemonstratethathisproposedsubdivisionmaintainedpublicroadaccess. Unabletosecureaccessandpro-ceed,CoffieldfiledaclaimagainsttheCitypursuanttotheBertJ.HarrisAct.Thetrialcourtconcludedthat(1)theCityhadmaderepresentationsthatwouldleadareasonablepersontobelieve thatdevelopment couldproceeddespiteWindsong’spetitionfor abandonment of the roadway;(2)Coffieldhada“vested right” todevelopthesubdivision;(3)thesub-divisionwasan“existinguse”ofthepropertyundertheHarrisAct;and(4)theCity’sactionshadinordinatelyburdenedthatexistinguse. Onappeal,the1stDCAreversed.The1stDCAdeterminedthatCoffield

applicationdeficient, but theALJstatedthathewouldrecommendtheissuanceofthepermitifIMCwouldamenditsapplicationtomeetcertainspecified conditions.The opposingpartiesfiledexceptionstotherecom-mendedorder.DEPconcluded thatadditionalfindingswerenecessarytoconditiontheissuanceofthepermit,asrecommended,andsoremandedforadditionalfindings.Baseduponthe resulting recommended order,DEPissueditsfinalorderauthoriz-ingtheissuanceofthepermitsandseveralpartiesappealed. The2dDCAaffirmedthefinalor-derandissuanceofpermitswithoutdiscussion,writingonly toaddressDEP’s arguments concerning theproprietyoftheremandprocedures.Afteradiscussionof thestatutorypermittingprocessatissue,thecourtfolloweda1stDCAholdingthatDEPhasauthoritytoconsideradditionalconditionsfromrecommendedorderswhentheyarerelativelyminor—andindeedmustconsiderthemif,ashere,DEP had a history of consideringsuggestedconditions.Next,thecourtexplainedthatremandforadditionalfindingsoffactsisproperwhenthoseissueddonotariseduringtheoriginalhearing.Finally,the2dDCArejectedanynotion thatdueprocess rightswereviolatedsincebothsidesweregiven the chance to present addi-tional evidenceand cross-examineaftertheremand.

Water supply authority had standing to challenge the with-drawal of water from a site up-stream of its withdrawal site. un-der the plain language of section 373.414(8)(b), Florida Statutes, if offsetting mitigation is located in the same drainage basin as the impacts, the cumulative im-pacts test is satisfied as a mat-ter of law. Peace River/Manasota Reg’l Water Supply Auth. v. IMC Phosphates Co., 34 L. Weekly D348 (Fla. 2d DCA Feb. 10, 2009). This was a companion case toCharlotte County v. IMC Phosphates Co., detailedabove.Thepertinentfactsarethesame:afterIMCapplied

standing.The2dDCAagreed,rulingthattheAuthorityhadasubstantialinterestintheproceedingsinceitwasdownstreamof thesite fromwhichIMCproposedwithdrawingwater.Further,theCourtruledthatthena-tureofthepotentialinjuryassertedby theAuthoritywasprecisely thetypeprotectedby theadministra-tive process because it concernedtheprotectionand conservationofFlorida’swater resources.Second,theAuthorityargued that its evi-denceofcumulativeimpactsshouldhave been admitted.The 2d DCAaffirmedtheALJ’sreadingofsection373.414.(8)(b),FloridaStatutes.Onthefaceofthisprovision,theCourtheld,itisclearthatwhenproposed,offsettingmitigationislocatedinthesamedrainagebasinastheadverseimpacts,thecumulativeimpactstestis satisfiedasamatterof law.TheCourtsawnoreasontodiscredittheALJ’sfindingsoffactonthisissue.

Department of Environmental Protection lacks statutory au-thority to be appointed as re-ceiver of abandoned wastewater treatment facility. Dep’t of Envtl. Prot. v. Landmark Enterprises, Inc., 34 Fla. L. Weekly D435 (Fla. 2d DCA Feb 25, 2009). Landmark owned and operatedawastewater treatment facility. In1999, theDepartment ofEnviron-mentalProtection (the“DEP”)andLandmarkentered intoanadmin-istrative consent order to correctthefacility’smanyproblems,includ-ing improperreleaseofwastewaterwithoutpropertreatment.By2002,Landmark had not complied withtheconsentorder,andDEPbroughtsuit.InAugust2007,thecircuitcourtgrantedtemporaryinjunctiverelief,andwhenLandmark failedtocom-ply,DEPfiledamotionforcontempt.LandmarkabandonedthefacilityinApril2008, complyingwithpropernotificationprocedures.Thecircuitcourt grantedHighlandsCounty’spetitiontoappointDEPasreceiverofthefacility.DEPobjected,butthecircuitcourt foundthatDEPwasa“person”withinthemeaningofsec-tion367.165,FloridaStatutes.Thisprovisionallowsacourt toappointanypersonitdeemsappropriateasareceiverofanabandonedfacility. The2dDCAreversed,rulingthatthe circuit court’s focuswas inap-propriateandthat itsrulingwould

totheDepartmentofEnvironmentalProtection(the“DEP”)forphosphateminingpermitsandDEPissuedno-ticesofintenttoapprovethepermits,severalparties challenged theper-mitsandasubsequentmodificationinJanuary2003.Inlate2003,IMCmodifiedapermitagainbasedonaDEPfinalorderdenyingotherIMCpermitapplications.Priortothehear-ingreferenced inCharlotte County,IMCfiled,andtheadministrativelawjudge(“ALJ”)granted,amotioninli-mineseekingtoexcludeanyevidenceofthecumulativeimpactsoftheproj-ectandothersonthePeaceRiverandthesurroundingbasinbasedonsec-tion373.414.(8)(b),FloridaStatutes.IMCalsofiledamotionchallengingthePeaceRiver/ManasotaRegionalWaterSupplyAuthority’s (the“Au-thority’s”)standing,allegingthatitssubstantial interestswouldnotbeaffected if thepermitwere issued.Thepartiesstipulatedthisissueun-tilafter thehearingon themerits.Afterthehearing,theALJreaffirmedhisexclusionofcumulativeimpactsevidenceandfoundtheAuthoritydidnothavestanding(butnotedthiswasmootbecausetheAuthorityhadfullyparticipatedintheproceedings).Fur-therfindingsandproceedingswereexplainedinCharlotte County. Onappeal, theAuthority raisedtwoarguments.First,itarguedthattheALJerred infinding ithadno

forceDEPtoactultravires.Examin-ingDEP’sgoverningstatutes,the2dDCAheldthatDEPhadnoauthoritytoactasreceiversincethispowerhadnotbeengrantedtoitbytheLegisla-ture.ThecourtnotedthattheLegis-laturehaddemonstrateditsabilitytoappointagenciesasreceiversinothersituations.

An exaction case is cognizable when landowner refuses to agree to an improper request from the government resulting in denial of the permit. St. Johns River Water Mgmt. Dist. v. Koontz, 34 Fla. L. Weekly D123 (Fla. 5th DCA Jan. 9, 2009). Koontz requested permits fromtheSt.JohnsRiverWaterManage-mentDistrict(the“District”)in1994todevelopmoreofhis commercialproperty thanwasallowedat thattime.Koontzreportedthatthewet-landsonhissitehadbeenseriouslydegradedbythedevelopmentinthevicinityofhisparcel,includingresi-dentialandcommercialdevelopment,transmission lines, and roadways.TheDistrictagreed toapprove thepermits ifKoontzagreedtooff-sitemitigation,and itgaveKoontz twooptions. Koontz could develop 3.7acres, ashehadproposed, subjecttodeedingtheremaining11.3acresinto a conservation area and per-formance of off-site mitigation byeither replacing culverts4.5milesaway fromhispropertyorbyplug-gingdrainagecanals7milesaway.Alternatively,Koontzcoulddeveloponly1acreanddeedtheremaining14acres intoa conservationarea.KoontzrejectedtheDistrict’soffersasunreasonable. Afterdenialofthepermits,KoontzfiledaninversecondemnationclaimagainsttheDistrictforanimproperexaction.The trial court concludedthattheDistricthadeffectedatak-ingandawardeddamages.Itdeter-mined that theproposedexactionshadnoessentialnexustothedevel-opmentrestrictionsinplaceandwasnotroughlyproportionaltothereliefrequestedbyKoontz. The5thDCAagreedwiththetrialcourt,citing liberallyto itsopinion.The court first explained that anexaction isaconditionsoughtbyagovernmentalentityinexchangeforitsauthorizationtoallowsomeuseoflandthatthegovernmenthasoth-erwiserestricted.Then,itaddressed

eachoftheDistrict’sarguments,not-ingthatthiswasthefourthtimethiscasehadbeenbeforeit.TheDistrict’sprimaryargumentwasthatanexac-tionclaimisnotcognizablewhenthelandownerrefusedtoagreetoanim-properrequestfromthegovernmentresultinginthedenialofthepermit.Although the5thDCArecognizedthattherehasbeenconsiderablede-bate and disagreement regardingthisissue,itheldthatthisargumenthadalreadybeenimplicitlyrejectedby themajority inDolan v. City of Tigard,512U.S.374(1994),whereinithadbeen raisedby thedissent,anddirectlyaddressedandrejectedinParks v. Watson,716F.2d646(9thCir. 1983), which was relied uponby theSupremeCourt inNollan v. California Coastal Commission,483U.S.825(1987).Finally,the5thDCArejectedtheDistrict’sattempteddis-tinctionbetweenexactionsrequiringphysicaldedicationsoflandandthoserequiringmonetaryexpendituresasadistinctionwithoutlegalsignificance,whichagainitsaidhadalreadybeenforeclosedby theSupremeCourt’sdecisioninEhrlich v. City of Culver City,512U.S.1231(1994).

Bert J. Harris Act claim that county inordinately burdened property was readily ascertain-able when county redesignated property at a lower density in its comprehensive plan and on its future land use map, even though county failed to redesignate the property in its land development code, making a claim after one year untimely. Citrus County v. Halls River Dev., Inc., 33 Fla. L. Weekly D2710 (Fla. 5th DCA Mar. 20, 2009). Halls River purchased an elev-en–acreproperty inCitrusCounty(the “County”). Nearby land usesincluded low intensity coastalandlakes (CL) and a 360-unit mobilehomepark,restaurant,and lounge.While the County formerly desig-nated the eleven-acrepropertyasmixeduse (MXU),whichpermittedmultifamilycondominiums,thelanduse changed to CL upon adoptionoftheCounty’sEARamendmentin1997.TheCountyneverupdateditsLandDevelopmentCodebecause itapparentlybelieveditcouldstillap-proveMXUdevelopmentontheprop-erty.OnmanyoccasionsbeforeandafterHallsRiver’spurchaseof the

property,CountyDevelopmentSer-vicesstaffconfirmedthatmultifam-ilycondominiumswereaproperusefor theproperty.Basedupon theseassurances, Halls River expendedatleast$1.5millioninpreparation,study,andplanningforthesite.TheCountyCommissionapprovedHallsRiver’sdevelopmentapplication,butuponathirdpartychallenge,thetrialcourtoverturnedtheCounty’sdeci-sionbecausetheuseofthepropertyformultifamily condominiumswasinconsistentwith theCL landusedesignation thatwasnow inplace.TheCountysubsequentlyreconcileditsLandDevelopmentCode to itsComprehensivePlanbutexemptedtheHallsRiverpropertyfromredesig-nationbecauseitbelievedHallsRiverhadvested rights.Evenso,due topublicopposition,theCountyrefusedtoconsiderHallsRiver’sresubmittedapplication.HallsRivermadeaclaimforcompensationunder theBertJ.HarrisAct,promptingtheCountytoissuearipenessdecisionidentifyingtheallowableusesof thepropertyanddeclining toextendanofferofsettlement.HallsRiver then suedtheCountyforcompensationpursu-anttotheBertJ.HarrisAct,allegingthat the County had inordinatelyburdeneditsproperty.ThetrialcourtfoundforHallsRiver,findingthatitwasreasonableforHallsRivertorelyuponCountystaff(whichwasitselfmistaken).ThetrialcourtindicatedthattheCounty’sattemptstocorrectitsearlier (incorrect)positionswithrespecttothedevelopmentpotentialofthepropertyinordinatelyburdenedHallsRiver. The 5th DCA reversed, agree-ingwith theCounty that its ordi-nance could not have eliminatedanydevelopmentrightssincethoserightswereeliminatedbyvirtueofthe County’s adoption of its EARamendmentin1997.Thus,anyHar-risActclaimshouldhavebeenfiledatthattimeandwasnowuntimely.TheCourtalsostatedthatanyre-liance by Halls River on Countystaffwasunreasonable,sinceHallsRivershouldhaveknownthattheComprehensive Plan would con-trolanydevelopment.Moreover,notheoryofvestedrightsbaseduponequitable estoppel was availablebecauseequitableestoppeldoesnotapply to transactions thatare for-biddenbylaw,suchasHallsRiver’sproposed development, which did

notconformtotheComprehensivePlan’s requirements. Finally, the5thDCAacknowledgedthatwhilein some circumstances the impactofgovernmentregulation(andthusthetimelinessofaHarrisActclaim)cannotbedetermineduntil anac-tual development plan has beensubmitted,inthiscasetheimpactofthedensity-reducingredesignationwasreadilyascertainablein1997.

The Florida Bar Professional Ethics Committee Takes Action on Staff Opinion Regarding Rule 4-4.2 In theMarch issue,we informedSectionmembersofFloridaBarStaffOpinion28193concerningRule4-4.2(CommunicationwithPersonRepre-sentedbyCounsel)beingconsideredforpublicationasaformaladvisoryopinionby theProfessionalEthicsCommittee(PEC).BecausetheOpin-ion involved communicationswithgovernmentalofficials,itwasthoughtthematterwouldbeofconsequenceto a significantportion ofELULSmembership.Readerswereadvisedthat thePECwouldbeconsideringthe reviseddraftOpinion inJune.Subsequently, theOpinionwasaf-firmedby thePECat itsJune26,2009 meeting held in conjunctionwithTheFloridaBar’sAnnualCon-ventioninOrlando.Withitsaffirma-tion,however,thePECdecidednottopublishtheOpinion;therefore,publiccommentwillnotbereceived.Thefol-lowingsynopsizesthechangesmadetotheOpinionbetweentheJanuaryandJunePECmeetings. The amended Opinion deems a“constituentoftheorganizationwhosupervises,directs,orregularlycon-sultswiththeorganization’slawyerconcerning the matter or has au-thority toobligate theorganization

• Generates tax-deductible contributions to provide legal assistance to needy Florida children. The $25 donation for each plate will go to The Florida Bar Foundation, a §501(c)(3) public charity.The Foundation will grant 100% of the funds to provide legal assistance to needy children.

• Grants to local legal aid organizations to provide direct legal assistance to needy children will be the priority.
