BMW Full Maintenance Program – 2006 325i, 330i

Full Maintenance Programs are a benefitdesigned to help reduce the cost of owner-ship.

2006 3 Series vehicles purchased from any

Authorized BMW center in the United Statesor Puerto Rico are covered by FullMaintenance for 48 months or 50,000 miles,whichever occurs first. Coverage begins onthe date of first retail sale or the date thevehicle is first placed in service as a demon-strator or company vehicle, whichever isearlier.

Any authorized BMW center in the UnitedStates or Puerto Rico will perform the sched-uled maintenance services on your vehicle at

no expense to you. The maintenance sched-ule intervals are based on average drivingconditions and operation. Should yourequest more frequent maintenanceservice, the cost of these services will notbe covered by the Maintenance Program.

Coverage

Full Maintenance covers all factory recom-mended maintenance, as determined by theCondition Based Service System. Additionalitems that need replacement due to normalwear and tear, and that are not covered bythe original New Vehicle Limited Warranty -such as brake pads, brake rotors, and wiperblades inserts - are included, provided wearand tear exceeds BMW wear limits. Anyadjustments required due to normal operatingconditions are also included. See pages 6-7of this booklet for additional information.

Maintenance Intervals

Time intervals should be followed using the

maintenance interval as indicated by theBMW Service Interval Display.

This BMW Service and Warranty InformationBooklet should be presented to your BMWcenter when maintenance is required. YourBMW center will stamp this bookletdocumenting the services or maintenanceperformed.

Exclusions from coverage

- Items reimbursable under your NewVehicle Limited Warranty.

- Gasoline.

- Windshield washer additive (except whein conjunction with scheduled maintenance

- Tires, wheel alignment, tire balance androtation.

- Wear and tear of soft trim items, such asseats, carpets, moldings, headliner, doorpanels and all chrome trim.

- Damage detected when performing therust perforation inspection.

- Damage which results from negligence,improper operation of the vehicle, wear andtear or deterioration due to driving habits or

conditions, improper repair, environmentalinfluences, flood, accident or fire damage,road salt corrosion, alteration, installation onon-BMW accessories, or use of improper,poor quality or contaminated fuel.

- Altered or unreadable Vehicle IdentificatNumber (VIN) or odometer irregularities orvehicles where the true mileage cannot bedetermined.

- Maintenance or repair after the vehicle ideemed a total loss.

- Maintenance or repairs performed by oththan an Authorized BMW center within theUnited States or Puerto Rico.

- Vehicles used in competitive events.

- Oil changes performed outside the recommended maintenance intervals as indicatedby the Service Interval Display.

Maintenance System

The BMW Maintenance System has beendevised with the following objectives: tomaximize vehicle safety, reliability, and resalevalue by minimizing breakdowns resultingfrom wear, and minimizing cost and inconven-ience by computing maintenance intervals

based upon the specific manner in whicheach individual vehicle is driven.

Maintenance intervals on motor vehicles haveconventionally been specified based uponaccumulated mileage. However, driving condi-tions have a major influence on routinemaintenance requirements; distance traveledis only one of the significant factors. A vehicledriven for 50,000 miles of short trips in thecity with numerous cold starts, prolongedperiods of idling, stop-and-go driving, and

high engine speeds during accelerationrequires more frequent maintenance intervalsthan a vehicle driven for 50,000 miles for longdistances at low engine speeds primarily atoperating temperature.

The advanced technologies at BMW have ledto the development of the unique BMWCondition Based Service System (CBS)which computes the actual optimum mainte-nance requirements based not only upon theaccumulated mileage, but taking into account

important factors such as high or low enginespeeds, short or long trip driving, and condi-tion of the engine oil and brake pads.

The BMW Maintenance System

Condition Based Service CBS

CBS is a further development of the ServiceInterval Indicator System. Sensors andsophisticated algorithms take even moredetailed account of the various conditions ofvehicle use.

The remaining times for selected mainte-nance tasks as well as any legally prescribeddates are displayed to you individually:

Engine oil

Brakes – front and rear separately

Microfilter

Brake fluid

Spark plugs

Vehicle check

Required State Inspection(s)

CBS thus determines the current and futuremaintenance requirements. This data canalso be read from the vehicle key by yourBMW Service Advisor and used to proposethe optimum scope of maintenance.

Have maintenance and repair work performedby your BMW center. Make sure that themaintenance work is stamped in this Serviceand Warranty Information Statement. Theseentries are the evidence of regular mainte-nance of your vehicle and a requirement forwarranty claims.

Disconnecting the battery during periodsof long-term storage will interrupt the

calculation of time-based services. Have allitems requiring time-based maintenance,such as brake fluid and possibly also theengine oil and microfilter, brought up to dateby your BMW center. Also see the section onbattery care on page 16 of this statement.

The Info Display immediately switches toits compute mode when you press one

of the two buttons in the turn signal indicatorlever.

You can view additional information onservice and maintenance procedures byselecting the “OB data” menu.

The vehicle’s current service status is auto-matically saved in the vehicle’s ignition key.The Service Advisor at your BMW center hasa device called a key reader. When yourService Advisor inserts your key into the keyreader, all pertinent vehicle and servicingdata will be available, and a customizedmaintenance checklist is printed out based onthe specific operations called for by theCondition Based Service.

The performance of certain subsequentmaintenance elements, as required by theBMW New Vehicle Limited Warranty, will bespecified at intervals computed by the BMWService Interval Indicator as follows:

 – Oil Service: Engine oil should be changedwith the engine at operating temperature.Note: Change oil at least once a year.

All 2006 model year 325i and 330i arefactory-filled with BMW High PerformanceSynthetic oils. At the time of the printing ofthis booklet, the following oils are stronglyrecommended and approved by BMW:

• BMW High Performance 5W-30 SyntheticOil (BMW part number 07 51 0 017 866)

• Mobil 1 5W-30

• Mobil 1 5W-40

BMW is evaluating various synthetic oils forinclusion in our list of recommended engineoils. For the most current list of synthetic oils,please contact your BMW center, or callBMW of North America, Inc. at 1-800-831-1117. You can also obtain this informationfrom our website, www.bmwusa.com/.

If you need to add oil between oil changes

and are unable to obtain BMW HighPerformance Synthetic Oil, Mobil 1 or anotherspecial oil on the list, use a synthetic oil withan API rating of SH or higher.

The following maintenance elements must beperformed at the mileage/time stated (timeintervals begin from the vehicle’s productiondate):

- Brake Fluid Service: Change brake fluidevery two years, or when specified by CBS.

- Oxygen Sensor Service: The oxygen

sensor deteriorates strictly on a mileagebasis and must therefore be replaced asfollows to maximize vehicle fuel economyand minimize exhaust pollution: 120,000miles.

- Spark Plug Service: Replace at 100,000miles, or when specified by CBS.

For your convenience, you may also wish tohave your BMW center perform any neces-sary operations to fulfill any state inspectionrequirements in your area concurrent with themaintenance elements specified above duringother repairs.

Make sure that confirmation of maintenance

work is always entered in this Service andWarranty Information Booklet. You may needthis for any warranty claims that becomenecessary, and later on as evidence that yourcar has been given the correct and regularmaintenance that justifies its resale or trade-in value.

Battery Care

If your car is driven only for short distances ofless than 10 miles over a prolonged period oftime, without an occasional drive at highwayspeeds, the engine’s charging system will notmaintain the battery. Insufficient use of thevehicle could result in short term starting

problems and in the long term could damagethe battery.

In case the car is not operated for severalweeks it is advisable to:

a) slide battery switch to “Off” position. Referto “Battery Switch” in vehicle owner’smanual.

b) consider using a proper trickle charger,following the charger manufacturer’sinstructions, to maintain the battery’s state

of charge; orc) consult your BMW center regarding battery

removal. Once removed, the battery mustbe charged and stored in a cool, dry placewhere it can be protected from freezing. Ifthe battery will be stored for over 3months, it must be recharged every 3months, or else it will become damagedand useless.

Corrosion Protection

Extensive corrosion protection measuresimplemented by BMW now make it possibleto offer a twelve-year unlimited milage anti-corrosion warranty against rust perforation onyour vehicle provided that the vehicle ismaintained in accordance with the provisions

of the New Vehicle Limited Warranty asoutlined in the Warranty Section of thisBooklet (page 32).

The major degree of corrosion protection isdue to the electrophoretic dip paintingprocess which cathodically deposits paintparticles on all body parts, attracting paintparticles into the minutest cavities or seams.Body parts are designed to provide optimumcorrosion protection.

During manufacture, exterior body partsreceive an additional corrosion protectioncoat. Hood, trunk, doors and other bodyparts are coated with PVC and sealed fromthe outside.

All floor panels receive a resilient coating ofPVC for maximum protection against damagedue to stones, etc.

Corrosion protection materials tested overmany years are applied to the surfaces ofcavities and to the entire underside of thevehicle during and after assembly.

Requirements for maintaining the 12-yearunlimited mileage anti-corrosion warranty areoutlined in the Warranty Section of thisBooklet (page 34).

Restoring corrosion protection

Please take care that anti-corrosion materialis replaced when your car is repaired afterbody or chassis damage.

BMW will not accept any liability for any

parts and accessories not approved byBMW.

Underbody maintenance

The underbody has to be cleaned at leastonce a year, in spring, with plain water inorder to remove mud, chemical sedimentsand other deposits. If those materials are nremoved, corrosion (rust) will occur on metacomponents.

Your BMW center will do this anti-corrosionservice for you.

WARNING

Do not apply additional undercoating or rusproofing on or near the exhaust manifold,exhaust pipes, catalytic converter or heatshields. During driving, the substance usedfor undercoating could overheat and cause fire.

Customer Assistance –Notification

During a specific period (usually the earlier of12 months or 12,000 miles, though this periodvaries by state), some states require us orour authorized BMW center, to repair in areasonable number of attempts, any defect orcondition which substantially impairs the use,value, or safety of a new vehicle sold, leasedor registered in that state.

A “reasonable number of attempts” is gener-ally defined as (i) two or more attempts torepair the same defect (the number ofattempts may vary by state) or (ii) that thesame defect has caused the vehicle to be outof service by reason of repair for more than30 days (this period may vary by state),except for delays created by conditions

5. BBB AUTO LINE staff may try to helpresolve your dispute through mediation. Ifmediation is not successful, or if you do notwish to participate in mediation, claims within

the program’s jurisdiction may be presentedto an arbitrator at an informal hearing. Thearbitrator’s decision should ordinarily beissued within 40 days from the time yourcomplaint is filed; there may be a delay of 7days if you did not first contact BMW aboutyour problem, or a delay of up to 30 days ifthe arbitrator requests an inspection/report byan impartial technical expert or further investigation and report by BBB AUTO LINE.

6. You are required to use BBB AUTO LINEbefore asserting in court any rights orremedies conferred by California Civil CodeSection 1793.22. that BMW has had a reasonable number ofattempts to conform the vehicle to its applica-ble express warranties if, within 18 monthsfrom delivery to the buyer or 18,000 miles onthe vehicle’s odometer, whichever occurs firstone or more of the following occurs:

• The same nonconformity has been subjectto repair 4 or more times by BMW or itsagents AND the buyer has notified BMW ofthe need for the repair of the nonconformity;OR

• The vehicle is out of service by reason ofrepair of nonconformities by BMW or itsagents for a cumulative total of more than30 calendar days after delivery of thevehicle to the buyer.

The BMW Roadside Assistance Programreflects BMW’s commitment to yourcomplete satisfaction with the BMWownership experience.

It is available for U.S. version BMWs in all 50

states, Canada, and Puerto Rico 24 hours aday, 365 days a year.

It is a valuable benefit provided to you at noadditional cost. (Subject to certain limitationsand exclusions noted on page 30).

Owner’s Eligibility

You are covered if your vehicle is:

 – A new BMW automobile, distributed byBMW NA, and purchased at an authorizedBMW center, OR;

 – A new BMW automobile, purchased underthe BMW NA European Delivery Plan, OR;

 – A new, U.S. version, BMW automobilepurchased under the Diplomatic or MilitarySales programs, operated in any of the 50states, Canada and Puerto Rico.

Coverage is provided for the vehicle itself,regardless of the driver. Protection is concur-rent with the New Vehicle Limited Warranty.

Getting Started

A temporary Roadside Assistance card canbe found inside of your vehicle portfolio. Itcontains the 24-hour toll-free number forRoadside Assistance.

For your convenience a decal, showing thesame information as the Roadside Assistancecard, has been affixed to the tool kit cover onthe trunk lid.

In a few weeks you will receive a permanentRoadside Assistance card by mail. The date

of purchase and the vehicle identificationnumber (VIN) are embossed on the card.

This card should be carried by the driver ofyour BMW automobile.

Calling For Assistance

The toll-free BMW Roadside Assistancenumber (800-332-4269) is answered by aBMW Roadside Assistance service represen-

tative. In order for you to receive quick andreliable services, it is essential that youshould provide detailed and accurate informa-tion to the service representative.

Be prepared to give:

1. Your name and address.

2. Your complete Vehicle IdentificationNumber (found on your vehicle registrationor your permanent Roadside Assistancecard).

3. Model description of your vehicle.

4. Date of purchase.

5. License plate number of your vehicle.

6. Vehicle location (including nearby cross-roads/intersections, highway mile markers,street numbers, landmarks, etc.).

7. Location you are calling from (including atelephone number where you can bereached). If you are calling from a publicphone wait there for the return call. Do noleave this location without informing theRoadside Assistance service representa-tive.

8. A description of your vehicle’s problem.Specific and accurate information willenable the Roadside Assistance servicerepresentative to provide the proper help.

Auto Valet Service. Should there be a needbeyond BMW Roadside Assistance, AutoValet will provide a personal assistant whowill help in every way to get you to your finaldestination. Auto Valet will help you locate arental car or taxi agency, hotel or even helpprocure airline reservations. In event of anemergency, this service will assist you ingetting information out to the proper partywhether its business or personal. If unable tocontact, the message relay service willdocument the information, and will makereasonable efforts to deliver the message tothe message recipient.

Personal Trip Routing. Leave the planning tous. Simply give one of our RoadsideAssistance service representatives a call, andwe’ll provide you with detailed, easy to read,computerized trip itinerary and companionmap package.

Dispatch Service

A service provider will be dispatched to thesite of your disabled vehicle.

On-Site Assistance

On-site service for vehicle disablements suchas flat tires, dead batteries, and out of fuelconditions is provided up to a maximum of$100.00 per incident by BMW RoadsideAssistance.

The cost for parts and fuel, when used on-site, are the responsibility of the owner/driver.The New Vehicle Limited Warranty does notcover any of the above on-site services.

Lock-Out

For security purposes, the driver will need toprove ownership by presenting properdocumentation, i.e., a valid drivers license,registration, etc. Lock-out service will beprovided up to a maximum of $100.00 perincident.

Towing Service

In the event of a mechanical breakdownnormally covered under the New VehicleLimited Warranty, your vehicle will be trans-ported (at no cost) to the nearest authorizedBMW center.Your vehicle is also covered inthe event of an accident or collision.

If a breakdown occurs after normal businesshours, your vehicle will be transported to asecure location and transported to thenearest authorized BMW center on the nextbusiness day.

If you request that the vehicle be taken to alocation other than the nearest authorizedBMW center, any additional expense will beyour responsibility.

However, you may request (at no cost) to betaken to a different BMW center as long as itis within 50 additional miles of the "nearest"BMW center.

If it is necessary for you to have your vehicltowed through your own arrangements, youmust contact BMW Roadside Assistance

for prior authorization and instructions oclaim procedures. All claims must besubmitted within sixty (60) days of thedisablement or occurrence, accompanied bthe original receipts. Claims received afterthat time period may not be honored and asubject to the full discretion of BMWRoadside Assistance. If BMW RoadsideAssistance is not contacted for "prior" authozation, the maximum coverage for towingsituations is $100.00.

Sign-and-DriveIn most instances, services provided underthe BMW Roadside Assistance Program donot require immediate payment.

Usually, you will be able to sign a receipt, sthe provider of the service can be reimbursdirectly by BMW Roadside Assistance.

Parts, materials and fuel should be paid byyou directly to the provider of the services.

Trip Interruption Benefits

Trip interruption benefits are provided formechanical breakdowns as follows:

 – Breakdowns that are warranty related,and;

 – Must occur in excess of 100 miles from driver’s residence, and;

This warranty does not apply to the following:

Damage which results from negligence,improper operation of the vehicle, improperrepair, lack of or improper maintenance,environmental influences, flood, accident orfire damage, road salt corrosion, or use ofimproper or contaminated fuel.

Damage to the engine, transmission or anyrelated component caused by improper shift-ing of the transmission.

Modification of the vehicle or installation ofany performance accessories or componentsattached to the vehicle which alters the origi-nal engineering and/or operating specifica-tions or which result in damage to the otheroriginal components, electrical interference,electrical short, radio static, water leaks andwind noise.

Tires are warranted by their respectivemanufacturer as detailed in the applicable tiremanufacturer’s warranty statements.Instructions for proper tire care and mainte-nance are contained in the Owner’s Manual.Should you experience difficulty in obtainingwarranty service from a tire manufacturer,your authorized BMW center will assist you inresolving the difficulty.

Limited Warranty –Rust Perforation 2006 Models

BMW NA warrants this original vehicleagainst defects in materials or workmanshipwhich will result in rust perforation of thevehicle body for a period of 12 years unlimtedmileage, commencing on the date of firstretail sale, or the date the vehicle is firstplaced in service as a demonstrator orcompany vehicle, whichever is earlier.

To obtain service under this warranty, thevehicle must be brought, upon discovery ofany rust perforation, to the workshop of anyauthorized BMW center.This BMW centerwill, without charge for parts or labor, eitherrepair or replace the defective part(s). Thedecision to repair or replace said part(s) issolely the prerogative of BMW of North

America. Parts for which replacements aremade become the property of BMW of NorthAmerica.

REQUIRED MAINTENANCE:

In order to keep this warranty in effect, thevehicle must be inspected at least every twoyears. Any areas requiring preventativemaintenance must be repaired. (THISINSPECTION/MAINTENANCE IS AT THEOWNER’S EXPENSE).

The Inspection/Maintenance consists of:

a. Washing the chassis before inspection, ifnecessary, due to dirt accumulation.

Federal Emissions SystemDefect Warranty (Valid only inthe U.S.A. and Puerto Rico)

This warranty applies only to U.S. specifica-tion vehicles distributed by BMW of NorthAmerica (BMW NA) or sold through the BMW

NA European Delivery Program.In accordance with the defect warranty provi-sions of section 207(b) of the Clean Air Act,BMW NA warrants to the first retail purchaser,and each subsequent purchaser, that the car(a) was designed, built and equipped so as toconform, at the time of sale, with all regula-tions of the U.S. Environmental ProtectionAgency applicable at the time of manufactureand (b) is free from defects in materials andworkmanship which would cause it to fail toconform with applicable regulations for aperiod of 2 years or 24,000 miles, whicheveroccurs first, except for specific emissioncontrol components (as listed on page 38),for which the warranty period is 8 years or80,000 miles, whichever occurs first.

This warranty begins on the date of first retailsale, or the date the vehicle is first placed inservice as a demonstrator or companyvehicle, whichever is earlier.

Warranty claims must be made as soon as

reasonably possible after a defect is discov-ered. To make a claim, the car must bebrought to any authorized BMW center duringnormal business hours.

The BMW center will, without charge for partsor labor (including diagnosis), either repair orreplace the defective part, if any. Thedecision whether to repair or replace saidparts is solely the prerogative of BMW NAand must be expected to correct the failure ofthe warranted part. Parts for which replace-ments are made become the property ofBMW NA. In all cases, a reasonable timemust be allowed for warranty repairs to becompleted after the car is received by theBMW center.

For assistance in determining which specificparts or components of your vehicle arecovered under this warranty, please contactyour BMW center.

It is the owner’s responsibility to have allscheduled inspection and maintenanceservices performed (at the owner’s expenseas prescribed in the maintenance schedulefor the BMW Emission Control System.Service intervals are computed by theonboard BMW service interval indicator anddisplayed on the instrument panel.Theinstructions for proper maintenance and uscan be found in the Owner’s Manual. It isstrongly recommended that any replacemeparts used for maintenance, repair or replacment of emission control systems be certifieBMW Service Parts or BMW AuthorizedRemanufactured Parts. Without invalidatingthis warranty, the owner may elect to havemaintenance, repair or replacement of theemission control systems performed by anyautomotive repair establishment, or elect to

use parts other than certified BMW ServiceParts. However, the cost of such service oparts will not be covered under this warrantexcept in emergency situations. In anemergency situation, where an authorizedBMW center or a warranty replacement paris not reasonably available (within 30 days)repairs may be performed at any availableservice establishment using any equivalentpart. BMW NA will reimburse the owner forsuch emergency repairs (including labor,parts and diagnosis not to exceed BMW NA

rates for labor, parts, and diagnosis in saidarea) that are covered under this warranty.Replaced parts and paid invoices must bepresented at a BMW center as a conditionreimbursement for emergency repairs notperformed by a BMW center.

The use of replacement parts, which are noof equivalent quality, may impair the effectivness of the emission control system. If oththan certified BMW Service Parts orAuthorized Remanufactured Parts are used

for maintenance, repair or replacement ofcomponents affecting emission control, theowner should obtain assurances that suchparts are warranted by their manufacturer tobe equivalent to genuine BMW parts inperformance and durability. BMW NAassumes no liability under this warranty witrespect to parts other than genuine BMWparts.

However, the use of non-BMW replacementparts or non-EPA certified parts does notinvalidate the warranty on other components,unless non-BMW parts or non-EPA certifiedparts cause damage to warranted parts.

What is not covered

This warranty does not cover malfunctionscaused by any of the following: accident,flood, misuse, improper adjustment, modifica-tion, alteration, tampering, disconnection,improper or inadequate maintenance, use ofleaded fuel or fuels containing more than10% ethanol, or other oxygenates with morethan 2.8% oxygen by weight (i.e., more than15% MTBE or more than 3% methanol plusan equivalent amount of co-solvent).

The replacement of maintenance parts, suchas spark plugs, filters and similar items usedin required maintenance services, the repairor replacement of maintenance parts beyondthe first required inspection/maintenance, or ifthe part has been replaced earlier for reasonsother than it being defective.

The car or any part of the car unless a failurecauses the car to fail to conform to applicableemission regulations.

Any car on which the odometer has beenreplaced or altered and the true mileagecannot be determined.

The car, if the vehicle identification number isaltered or cannot be read, or if the car hasbeen declared a total loss or sold for salvagepurposes.

In those states and jurisdictions that haveestablished periodic vehicle emissions teststo encourage proper vehicle maintenance and

require the car to pass an emissions testapproved by the U.S. EnvironmentalProtection Agency and:

1. The car was distributed by BMW of NorthAmerica (BMW NA), or sold through theBMW NA European Delivery Program; and

2. The car has been maintained andoperated in accordance with the instruc-tions for proper maintenance and use setforth in the Owner’s Manual supplied withthe car; and

3. The car fails to conform to the applicableemissions standards of the EPA as judgedby an EPA approved emissions test; and

4. The failure to conform results or will resultin the owner of the car having to bear apenalty or other sanction (including thedenial of the right to use the car) underlocal state or federal law if the non-conformity is not remedied within a speci-fied period of time.

Then, in accordance with the provisions ofsection 207(b) of the Clean Air Act, BMW NAwarrants that if the car is eligible for coverageunder this warranty, any non-conformities inthe car, which cause it to fail an EPA-approved emissions test will, without chargefor parts or labor (including diagnosis), beadjusted, repaired, or replaced, at the optionof BMW NA to proper specifications, in orderto make the car comply with applicableemissions standards. The decision to adjust,repair or replace parts is solely the preroga-

tive of BMW NA and must reasonably beexpected to correct the failure of thewarranted part.

This warranty begins on the date of first retailsale, or the date the vehicle is first placed inservice as a demonstrator or companyvehicle, whichever is earlier. This warrantycontinues for a period of 2 years or 24,000miles, whichever occurs first, except for

specific emissions control components (aslisted on page 38), for which the warrantyperiod is 8 years or 80,000 miles whicheveroccurs first.

This warranty is made subject to the termsand conditions that apply to the EmissionControl System Warranty and the New

Vehicle Limited Warranty.No claim under this warranty will be deniedon the basis of use of a properly installedEPA certified emission part for maintenanceand repair.

A vehicle manufacturer may deny anemission performance warranty claim on thbasis of an uncertified replacement part usein the maintenance or repair of a vehicle onif the vehicle manufacturer presents evidenthat the uncertified replacement part is eith

defective in materials or workmanship or noequivalent from an emission standpoint to toriginal equipment part.

Maintenance, replacement, or repair ofemission control devices and systemsmay be performed by any automotiverepair establishment or individual usingany certified part.

Immediately after the car has failed an EPAapproved emission short test, your claim cabe made at any authorized BMW center. T

BMW center will honor or deny your claimwithin the time period specified by local orstate laws (not to exceed 30 days), to avoidfurther penalties or sanctions. lf the claim isdenied, the BMW center will notify you inwriting of the reason(s). California Emission ControlWarranty Statement*Your Warranty Rights andObligations

The California Air Resources Board andBMW of North America (BMW NA) are

pleased to explain the emission controlsystem warranty on your 2006 vehicle. InCalifornia, new motor vehicles must bedesigned, built and equipped to meet theState’s stringent anti-smog standards. BMWNA must warrant the emission control systemon your vehicle for the periods of time listedbelow provided there has been no abuse,neglect or improper maintenance of yourvehicle.

Your emission control system may include

parts such as the fuel injection system, theignition system, catalytic converter, andengine computer. Also included may behoses, belts, connectors and other emission-related assemblies.

Where a warrantable condition exists, BMWNA will repair your vehicle at no cost to youincluding diagnosis, parts and labor.

Manufacturer’s Warranty Coverage:

 – For 3 years or 50,000 miles whichever

occurs first:1. If your vehicle fails a Smog Check inspec-

tion, all necessary repairs and adjustmentswill be made by BMW NA to ensure thatyour vehicle passes the inspection. This isyour emission control system PERFOR-MANCE WARRANTY.

California Emission ControlSystem Limited Warranty*

This warranty applies to California certifiedvehicles distributed by BMW of NorthAmerica (BMW NA) or sold through the BMWNA European Delivery Program, registeredand operated primarily in California.

BMW NA warrants to the original purchaserand each subsequent owner that the vehicleis:

(a) designed, built and equipped so as toconform with the applicable California AirResources Board emission standards.

(b) free from defects in materials andworkmanship which cause any part thatcan affect emissions to fail to conformwith applicable requirements or to fail a

California Smog Check test or EPAapproved short test for a period of 3years or 50,000 miles, whichever occursfirst.

(c) free from defects in materials andworkmanship in emission related parts,which are contained in the CaliforniaEmission Warranty Parts List on page 42,for a period of 7 years or 70,000 miles,whichever occurs first.

This warranty begins on the date of first retail

sale, or the date the vehicle is first placed inservice as a demonstrator or companyvehicle, whichever is earlier.

To obtain service under this warranty, thevehicle must be brought, upon failure of aSmog Check test or upon discovery of thedefect, to the workshop of any authorizedBMW center, during normal business hours.The BMW center will honor or deny yourclaim within 30 days. If the claim is denied,the BMW center will notify you in writing of

the reason(s). The BMW center is requiredby law to honor the claim if notice is not givento the owner within 30 days.

The BMW center will, without charge for partsor labor (including diagnosis), either adjust,repair or replace the defective part and otherparts affected by the failure of the warrantedpart, if any. If your vehicle failed the CaliforniaSmog Check test or an EPA approved short

test, then BMW NA will repair your vehicle sothat it will pass this test. Items that requirescheduled replacement are warranted up tothe replacement interval specified in theService section of this Statement. BMW NAmay repair a part in lieu of replacing it whenperforming warranty repairs. Parts for whichreplacements are made become the propertyof BMW NA. After 3 years or 50,000 miles,and in accordance with paragraph (c) above,such repairs are limited to the repair orreplacement of those parts identified in theCalifornia Emissions Warranty List.

If your California registered vehicle isbetween 7 and 8 years old and has beendriven less than 80,000 miles, then yourvehicle is eligible for additional warrantycoverage under the Federal EmissionsWarranty.

A repair performed as the result of a smogcheck test failure due to a defect in a part,which is warranted for 7 years/70,000 miles,is covered.

In all cases, a reasonable time, not to exceed30 days, must be allowed for a warrantyrepair to be completed, after the car isreceived by the BMW center.

It is the owner’s responsibility to have allrequired maintenance services performed (at

the owner’s expense), as prescribed in themaintenance schedule for the BMW EmissionControl System. Service intervals arecomputed by the service interval indicatorand displayed on the instrument panel.

However, BMW NA will not deny yourwarranty repair claims solely because you donot have maintenance records or you did notperform the required maintenance unlessBMW NA demonstrates that such lack ofrequired maintenance is a direct cause of theemission control system failure. The instruc-tions for required maintenance and use canbe found in the Owner’s Manual and in theService section of this Statement.

It is strongly recommended that any replace-ment parts used for maintenance, repair orreplacement of emission control systems begenuine BMW Service Parts or BMWAuthorized Remanufactured Parts. Withoutinvalidating this warranty, the owner may electto have maintenance, repair or replacementof the emission control systems performed byany automotive repair establishment, or electto use parts other than BMW AuthorizedRemanufactured or genuine BMW ServiceParts. However, the cost of such service orparts will not be covered under this warranty,except in emergency situations. In anemergency situation, where an authorizedBMW center is not reasonably available or awarranty replacement part is not availablewithin 30 days, repairs may be performed atany available service establishment or by any

individual using any replacement part.A repair not completed within 30 days consti-tutes an emergency. BMW NA will reimbursethe owner for such emergency repairs (includ-ing labor, parts and diagnosis not to exceedBMW suggested retail price for all warrantedparts replaced and labor charges based onthe manufacturer’s recommended timeallowance for the warranty repair and thegeographically appropriate hourly labor rate)that are covered under this warranty.Replaced parts and paid invoices must bepresented to a BMW center as a condition ofreimbursement for emergency repairs notperformed by a BMW center.

The use of replacement parts, which are notof equivalent quality, may impair the effective-ness of emission control systems. If otherthan genuine BMW Service Parts orAuthorized Remanufactured Parts are usedfor maintenance, repair or replacement ofcomponents affecting emission control, theowner should obtain assurances that such

parts are warranted by their manufacturer tobe equivalent to genuine BMW parts inperformance and durability. BMW NAassumes no liability under this warranty withrespect to parts other than genuine BMWparts.

However, the use of non-BMW replacementparts does not invalidate the warranty onother components, unless non-BMW parts

cause damage to warranted parts.

What is not covered

This warranty does not cover malfunctionscaused by any of the following: accident,flood, misuse, modification, alteration,tampering, disconnection, improper or inad

quate maintenance, except if performed by authorized BMW center doing warranty repwork, use of leaded fuel or fuel other than aspecified in the Owner’s Manual.

The replacement of maintenance parts, sucas spark plugs, filters and similar items usein required maintenance services or therepair or replacement of maintenance partsbeyond the first replacement interval.

Any car on which the odometer has beenreplaced or altered and the true mileage

cannot be determined.The car, if the vehicle identification number altered or cannot be determined, or if the chas been declared a total loss or sold forsalvage purposes.

General

The warranty gives you specific legal rightsand you may also have other rights whichvary from state to state.

THE DURATION OF ANY IMPLIED

WARRANTIES, INCLUDING THE IMPLIEDWARRANTY OF MERCHANTABILITY, ISLIMITED TO THE DURATION OF THEEXPRESS WARRANTIES HEREIN. BMWOF NORTH AMERICA HEREBY EXCLUDEINCIDENTAL AND CONSEQUENTIALDAMAGES, INCLUDING LOSS OF TIME,INCONVENIENCE, OR LOSS OF USE OFTHE VEHICLE, FOR ANY BREACH OF ANEXPRESS OR IMPLIED WARRANTY,INCLUDING THE IMPLIED WARRANTY OMERCHANTABILITY, APPLICABLE TO THPRODUCT.
