Hello and welcome to the final edition of the year of our property magazine.

New-builds and buying off-plan have once again built up real momentum in recent years following the financial crisis. Almost 50% of our sales are now new-builds.

Besides advances in digital technology, with considera-ble progress being made in producing renditions ena-bling you to see everything from how properties and areas look today to how things will look when they are fi-nished, it is also often possible to watch videos and even virtual tours of your future home.

The introduction of the requirement for property develo-pers to have a bank guarantee has made it more secure and easier to purchase a property off-plan than ever be-fore.

This edition showcases some of our projects, but as ever, Serneholt Estate is on hand to provide help free of char-ge in purchasing anything that is available on the market.

Besides new developments, agents have had a roller-coaster year with a strong start, followed by a pre-sum-mer lull, before picking up once again in September. This may or may not be linked to reports on the reality of Bre-xit. We are currently witnessing strong demand in finding new properties in Spain, and in recent months there has

been an increase in demand from countries such as Bel-gium, the Netherlands, Denmark, Germany and France.

Here at Serneholt Estate, we have seen many unfortunate cases where people have not received guidan-ce and advice from their agent when buying a property in Spain. If you have any questions about this, pop into one of our offices (in Marbella, Estepona, Fuengirola, Malaga, Alicante and Mallorca) and have a chat about buying a property with us.

1. Not having enough money – It isn’t just the purchase price you need to take into account. There are also a number of additional costs, such as legal costs, taxes and Spanish notary service and land registry costs. We recommend that you allow for an additional 12-15% on top of the purchase price for these. Serneholt will help you to calculate the cost when you buy a property through us.

2. Buying in the wrong location – It’s vital that you plan your purchase carefully. It’s easy to be charmed by a property and forget details like where you’ll buy food or whether you’ll be happy living in a particular area. Take the time to find out which areas will suit you best. 3. Misunderstanding your lawyer – Choose a lawyer you can communicate with when you need to. It’s important to find a lawyer who looks after your interests and who can answer your questions in a language you understand. Be sure to find someone with a good reputation, who comes recommended, and who is experienced in property purchases.

4. Purchasing too quickly – The fourth of our pitfalls when purchasing in Spain. Perhaps you have come here to check out the market or you have a limited amount of time to find a property in Spain. If so, you might feel pressured into making a decision. In the current market, it’s unlikely you’ll lose out on the property you have found at the last minute, so take your time.

5. Signing a contract you don’t understand – Or even worse, one that hasn’t been checked to see if it’s in your interests. Private contracts are often drawn up first in Spain and a de-posit is paid. Don’t sign anything until your legal representa-tive has checked the contract for you, as it is legally binding.

6. Thinking you can purchase a property in a different way – Consider the purchase process in your home country. Most likely, you’ll perform numerous checks, investigations and inspections. These also need to be done in Spain. A good lawyer will check the legal situation of the property.

7. Not having your documentation in order – You are pur-chasing a property in another country, and sometimes the pitfalls of buying in Spain come as a surprise. You must make sure you have all the necessary documentation in order, otherwise you cannot purchase a property here. One of the most important documents is the NIE number (Número de Identificación de Extranjeros). You cannot buy a property wi-thout this. However, it is possible to obtain this number even if you are not in Spain if you have granted power of attorney.

8. Forgetting the finer details – You must remember various other legal formalities once you have purchased your proper-ty. These include setting up electricity and water agreements in your name, along with direct debits to pay for them.

9. Believing you have fulfilled all your obligations – Re-member to establish routines to pay income and property taxes, such as the municipal property tax, and make sure you always have enough money in your Spanish account to cover the cost of these. Remember that there is an additional tax to pay in certain cases and non-residents must also submit an annual declaration.

10. Not purchasing because it’s too risky – We thought we’d throw this one in as our final warning. When you read the above on the pitfalls of purchasing a property in Spain, you’ll notice there’s nothing here that isn’t common sense when it comes to purchasing a property.

AVOIDING PITFALLS WHEN BUYING A PROPERTY IN SPAIN


What is buying off–plan?Buying a property that has not yet been built and exists only on paper.

What are the benefits of buying off-plan?

Price – The main benefit is the lower price compared with an existing property. The value of the com-pleted property will often be higher because many buyers are looking for a property that already exists.

Location – If you are early enough, you’ll also get the chance to choose the most attractive property with the best view.

Cost – New properties often consume less energy and have lower maintenance costs than older pro-perties.

Payment – The construction period, often 12-24 mon-ths, gives you time to arrange financing.

Fittings – You can sometimes choose the colour, mate-rials and layout of the property.

Considering purchasing off-plan?Research – Make a thorough comparison of the proper-ty with other similar properties in the area, in terms of both price and quality.

Guarantee - Make sure the developer has a separate bank guarantee as required by law. This comes into force when the developer obtains planning permission for the development.

Insurance – Make sure the developer has an individual insurance policy for any damage that may arise during construction.

Certificate – Request a copy of the cadastral certificate (Certificado Catastral). This contains information on the land, the plot boundaries and the size of the plot in square metres. You should also request a certificate which sets out the planning situation.

Construction site – If you are purchasing a property on an urbanisation, you should anticipate that public areas may not necessarily be complete when you move in.

Time – In many cases, construction does not commen-ce until a specific number of properties have been sold. This means that the start of construction will depend on this.
