Sumario


This annual report presents UIA’s achievements in 2016, the year during which I had the great honour and responsibility of chairing the orga-nisation, with the support of the management team, in particular the UIA President’s Office.

It is, indeed, a major innovation over the last few years that a major part of the UIA Pres-ident's duties is shared between the present, future and previous Presidents. We wanted this development to take place in particular to allow for continuity in UIA’s policies, beyond the duration of a president's term in office. While decisions may be taken within a given term in office, time then has to be given for them to produce their effects.

We therefore continued to provide support to the UIA Institute for the Rule of Law (UIA-IROL), created under the previous President's term, so that it could fully play its due role in the protection of lawyers, the independence of the profession and the promotion of the rule of law in the world. Laurence Bory, who had taken an active part in establishing this body, is conti-nuing the work.

During my term, we adopted the Charter on Refugee Rights and Obligations in Budapest (the “Budapest Principles”), to which the CCBE and several bars have adhered. Our activities are continuing in this regard as well, and our annual meeting at the UN, in 2017, was devoted to this subject.

Ce rapport annuel vous présente les réalisations de l’UIA pendant l’année 2016, pendant laquelle j’ai eu le grand honneur et la responsabilité de la présider, avec l’appui de l’équipe de direction et plus particulièrement du bureau de la prési-dence.

C’est en effet, une innovation importante depuis quelques exercices que la présidence de l’UIA s’exerce collégialement pour une part impor-tante, entre les présidents actuels, futurs et précédents. Nous avons voulu cette évolution notamment pour permettre la permanence de la politique de l’UIA, au-delà de l’annualité du mandat présidentiel. Si les décisions prises peuvent se réaliser au cours d’un même mandat, il faut ensuite leur donner du temps pour pro-duire leurs effets.

Nous avons ainsi poursuivi l’accompagnement dans sa montée en puissance de l’Institut UIA pour l’état de droit (« UIA-IROL »), créée sous le mandat précédent afin qu’il prenne pleinement sa place de défense de la défense, de l’indépen-dance de la profession et de promotion de l’état de droit dans le monde. Laurence Bory qui avait pris une part active dans cette création, poursuit cette action.

Pendant mon mandat nous avons adopté à Budapest la charte des droits et obligations des réfugiés, (les « Principes de Budapest »), à laquelle le CCBE et plusieurs barreaux ont adhéré. Ici également, l’action se poursuit et notre réunion annuelle à l’ONU, en 2017 a été consacrée à ce sujet.

Este informe anual presenta las realizaciones de la UIA durante el año 2016, durante el cual tuve el gran honor y la responsabilidad de presidirla, con el apoyo del equipo de dirección y, más concretamente, del gabinete de la presidencia.

Ésta es una innovación importante desde hace varios ejercicios: la presidencia de la UIA se ejerce en buena medida conjuntamente entre los presidentes actuales, futuros y anteriores. Este cambio está destinado a permitir la per-manencia de la política de la UIA más allá del año que dura el mandato presidencial. Aunque las decisiones tomadas pueden llevarse a cabo durante un mismo mandato, después hay que darles tiempo para que produzcan sus efectos.

Así pues, acompañamos el desarrollo del Ins-tituto de la UIA para el Estado de derecho («UIA-IROL»), creado bajo el mandato anterior, para que desempeñe plenamente su función de defensa de la defensa, de la independencia de la profesión y de promoción del Estado de dere-cho en el mundo. Laurence Bory, que participó activamente en su creación, continúa esta labor.

Durante mi mandato se aprobó en Budapest la carta de los derechos y obligaciones de los refugiados (los «Principios de Budapest»), a la que se adhirieron el CCBE y varios colegios de abogados. También seguimos trabajando en ello; nuestra reunión anual de 2017 en la ONU estuvo dedicada a este tema.

Cuando asumí mi cargo, en el congreso de Valen-cia en 2015, expresé mi deseo —compartido por los demás presidentes— de continuar con

When I took office at the Valencia Congress in 2015, I had expressed the wish to continue our work in three areas: the rule of law, lawyers’ training and service to lawyers’ organisations across the world.

With regard to the rule of law, there is still a long road to follow and the detention of a number of lawyers (over 400 in Turkey) for rea-sons related to their professional practice and despite UIA-IROL's efforts is far removed from our objectives. For instance, the emblematic situation of Waleed Abu Al Khair is still a cause for concern, with the international community’s efforts failing to put an end to his arbitrary detention.

An important battle awaits us: in the name of transparency, our solicitor-client privilege will once again be attacked, particularly with the obligation to reveal “aggressive fiscal arran-gements” being advocated by the OECD and European institutions. Without professional secrecy, there is no rule of law.

We have continued with our training activities, with more than 28 sessions held in 2016 in 19 countries, with special efforts made in African countries. In this regard, UIA's cultural plurality and multilingual character are a great strength. Opening the doors to the world for lawyers and sharing our profession's practices beyond our borders is a reflection of the profundity of our profession, which is not limited to any “single thought”.

An important part of the President’s work has been to come closer to and work together with the profession’s representative organisations in order to offer them better assistance in their work and to share their concerns.

Much remains to be done. Whether in order to put a stop to all kinds of attacks against the profession and on the freedom and physical integrity of lawyers or magistrates, to enforce our principles, which are designed to protect clients, or to spread a high level of knowledge and ensure the constant upgrading of our own knowledge.

I wish my successors, Laurence Bory, Pedro Pais de Almeida and Issouf Baadhio a great deal of courage and success. They know that if they need me, I will be at their side.

Lors de ma prise de fonction, en 2015, au congrès de Valence, j’avais exprimé mon sou-hait, partagé par les présidents, de poursuivre nos travaux dans trois domaines : l’État de droit, la formation des avocats et le service aux orga-nisations d’avocats dans le monde.

Sur l’état de droit le chemin est encore long et le maintien en détention de nombreux avocats (plus de 400 en Turquie)pour des motifs liés à leur exercice professionnel et quels que soient les efforts de l’UIA-IROL, est bien loin de nos objectifs. Par exemple, la situation, embléma-tique, de Waleed Abu Al Khair est toujours aussi préoccupante, les efforts de la communauté internationale ne parvenant pas à faire cesser sa détention arbitraire.

Un combat important nous attend au nom de la transparence, notre secret professionnel va, à nouveau, être attaqué, notamment par l’obligation de révéler les « montages fiscaux agressifs » que prônent l’OCDE et les institutions européennes. Sans secret professionnel, il n’y a pas d’état de droit.

Nous avons poursuivi nos actions de formation et c’est plus de 28 sessions qui ont été tenues en 2016 dans 19 pays, avec un effort particulier vers les pays africains. Ici, la pluralité culturelle et le plurilinguisme de l’UIA sont des forces. Proposer aux avocats une ouverture sur le monde et sur les pratiques de notre profession au-delà de nos frontières, c’est refléter la richesse de notre métier sans « pensée unique ».

Une part importante des travaux de la prési-dence a été consacrée au rapprochement et au travail en commun avec les organisations représentatives de la profession, afin de mieux les aider dans leurs travaux et de partager leurs préoccupations.

Il reste encore beaucoup à faire. Que ce soit pour faire cesser les attaques de toutes natures contre la profession, les atteintes à la liberté et à l’intégrité physique des avocats ou des magis-trats, pour faire respecter nos principes, qui sont destinés à protéger les clients et pour répandre un haut niveau de savoir et une mise à niveau constante de nos connaissances.

Je souhaite beaucoup de courage et de succès à mes successeurs, Laurence Bory, Pedro Pais de Almeida et Issouf Baadhio. Ils savent que s’ils ont besoin de moi je serai à leurs côtés.

Sobre el Estado de derecho todavía tenemos mucho recorrido por delante y el hecho de que muchos abogados sigan detenidos (más de 400 en Turquía) por motivos relacionados con su ejercicio profesional y a pesar de los esfuerzos de UIA-IROL, nos sitúa muy lejos de nuestros objetivos. Por ejemplo, la situación emblemática de Waleed Abu Al Khair sigue siendo preocupante; los esfuerzos de la comu-nidad internacional no logran poner fin a su detención arbitraria.

Nos espera una lucha importante: en nombre de la transparencia, nuestro secreto profesional se verá de nuevo amenazado, por la obligación de revelar los «montajes fiscales agresivos» que predican la OCDE y las instituciones euro-peas. Sin secreto profesional no hay estado de derecho.

Hemos continuado con nuestras acciones de for-mación y en 2016 se han celebrado 28 sesiones en 19 países, con un esfuerzo particular en los países africanos. Aquí, la pluralidad cultural y el plurilingüismo de la UIA son sus puntos fuertes. Dar a los abogados una apertura al mundo y al ejercicio de nuestra profesión más allá de nues-tras fronteras es reflejar la riqueza de nuestra profesión sin un «pensamiento único».

Una parte importante de los trabajos de la pre-sidencia ha estado dedicada al acercamiento y al trabajo en común con las organizaciones de representación de la abogacía, para ayudarles mejor en sus trabajos y compartir sus preocu-paciones.

Todavía queda mucho por hacer. Tanto para poner fin a los ataques de todo tipo contra la profesión y a los atentados contra la libertad y la integridad física de abogados o magistrados, como para hacer que se respeten nuestros principios, que están destinados a proteger a los clientes, y para difundir un alto nivel de conocimientos y una actualización constante de los mismos.

Deseo mucho coraje y éxito a mis sucesores, Laurence Bory, Pedro Pais de Almeida e Issouf Baadhio. Saben que si me necesitan estaré a su lado.

Jan Eliasson,Vice-secrétaire général des Nations Unies au Sommet UIAdes Présidentsde BarreauxL’UIA a eu l’extrême honneur de recevoir Jan Eliasson, Vice-secrétaire général des Nations Unies lors de son sommet UIA des Présidents de Barreaux, le 16 mai 2016. Jan Eliasson a ouvert les débats consacrés cette année à la prévention des atrocités de masse, au droit international à l’égard des migrants, des réfugiés et des personnes déplacées internes et au développement durable.

First UIA/LexisNexis Rule of Law Award The U IA “Ru le o f Law Award” was created in cooperation with LexisNexis to honour individuals and organisations w h o a c t i v e l y c o n t r i b u t e t o t h e advancement of the rule of law within the legal community. The inaugural Award was presented to the Malaysian Bar and its President Steven Thiru for its strong commitment to the defence and promotion of the rule of law as well as its vigilance in demanding and supporting law and justice reforms in Malaysia.

Partnership with

On February 1 1 , 2016 , the U IA and LexisNexis concluded a three-year partnership agreement signed by UIA President Jean-Jacques Uettwiller and Nigel Roberts, Vice-President, Global Associations, LexisNexis. Through this partnership, LexisNexis will cooperate in the field of rule of law, and bring to the UIA some publishing and editorial assistance, marketing support for the UIA congress and other events, as well as some member benefits.

Seminario sobreel derecho de asiloy refugiados:la perspectivade los abogados

El 27 de octubre de 2016, la UIA organizó una jornada de formación y discusión sobre “Derecho de asilo y refugiados: la perspectiva de los abogados”, en Budapest, para informar a los participantes sobre cómo los abogados y los colegios pueden contribuir de manera eficaz a los debates sobre la cuestión de los refugiados.

En octobre 2016, l ’UIA a recruté une société de consulting en stratégie basée à Londres afin de mener une analyse qui permettra d’établir les orientations stratégiques de l’association jusqu’en 2020. Un comité de pilotage, composé de 5 membres de l ’association et du directeur administratif, assiste le Comité de Direction dans cette réflexion.

Primera mujer comopresidenta de la UIA

Por primera vez en 89 años de existencia, la UIA ha elegido una mujer como presidenta. Laurence Bory, abogada suiza, muy dedicada en la asociación.Antes de ocupar este puesto, Laurence Bory ha ocupado diversas funciones en la UIA: presidenta de la comisión derecho bancario de 1995 a 1998, secretaria general de 1998 a 2003, presidenta del congreso de Ginebra en 2004 y vicepresidenta en 2014, fecha en la que fue elegida para ocupar la Presidencia en Budapest.

Burkina FasoArrestation de l’ancien Bâtonnier Mamadou TraoréLe 25 avri l 2016, l 'ancien bâtonnier du Burkina Faso, Mamadou Traoré, a été interpellé à Ouagadougou. I l aurait été incarcéré à la maison d'arrêt de correction des armées (MACA), suite à son audition. L’UIA a fait part de son inquiétude au barreau burkinabé et s’est adressée aux autorités du Burkina Faso pour exprimer sa préoccupation concernant la prolongation de la détention de Me Traoré, malgré l’existence manifeste d’irrégularités ayant entaché la procédure.

ChinaMass arrests of human rights lawyers

Since July 9, 2015, hundreds of lawyers, jurists and law firm staff, all committed to human rights, were arrested and/or detained by the police in several Chinese provinces (the ‘709 Crackdown’). From the start of their interrogations, the UIA has mobilised itself to strongly support them, meeting with Chinese lawyers in exile, prompting human rights defence lawyers to share their experiences, and supporting the candidacy of Mrs. Wang Yu, a human rights lawyer in Beijing, for the Ludovic Trarieux Prize in addition to co-signing emails, some of which have been widely covered by the media.

ColombiaCaravana de Juristas 2016Como lo lleva haciendo desde 2010, la UIA, representada por el abogado Max Adam Romero, participó en la 5ª edición de la Caravana de Juristas que estuvo en Colombia del 20 al 28 de agosto de 2016 para evaluar la situación de los abogados colombianos contra los que el número de crímenes lamentablemente no disminuye. 53 delegados, de 15 nacionalidades distintas, acudieron a Colombia y visitaron en grupo diferentes localidades colombianas para reunirse con defensores de los derechos humanos, con asociaciones de víctimas - a menudo representando a minorías -, con representantes de organismos oficiales y con autoridades nacionales y extranjeras presentes en este país. El contexto en el que se desarrolló esta Caravana 2016, presentaba un interés especial por el acuerdo de Paz que se había negociado con las FARC.

FranceConvocation de Me Brel et Me Francos,du Barreau de Toulouse

Le 7 mars 2016, les avocats Julien Brel et Benjamin Francos ont été convoqués par l'Inspection générale de la police nationale (IGPN) dans le cadre d’une enquête ouverte suite à une plainte déposée par des policiers pour « rébellion et dénonciation calomnieuse ». L’UIA a écrit au bâtonnier du barreau de Toulouse pour lui faire part de son soutien ainsi qu’à l’ensemble des avocats toulousains.

Interpellation et poursuites disciplinairesà l’encontre de Me Bernard Ripert

L’UIA est intervenue auprès des autorités françaises regrettant le caractère disproportionné et outrageux du traitement qui a été réservé à Me Bernard Ripert, interpellé le 23 mai 2016 à son domicile en Savoie, et par la suite, interné temporairement sous la contrainte après examen psychiatrique pratiqué à la demande du procureur.

HondurasDía del abogado amenazado 2016 Apoyo a los abogados hondureñosLa UIA, que apoya el Día del abogado amenazado desde su creación, participó en este evento que fue dedicado en 2016 a sensibilizar a la comunidad jurídica y al público en general sobre la situación de los abogados de Honduras, país que vive una situación de extrema violencia generalizada. Con más de 120 casos de muertes violentas de profesionales del derecho desde 2010, de los cuales un 90 % todavía está impune, en Honduras la práctica del derecho es, en sí, generadora de riesgos. Para denunciar esta situación, la UIA se movilizó activamente creando material de difusión y de soporte para el evento así como una petición de apoyo, llamando a la acción a sus miembros y haciendo una publicación en un periódico local.

KenyaMurder of the lawyer, Willie Kimani

The UIA sent a letter to the Law Society of Kenya (LSK) to express its solidarity with the LSK members, following the murder of human rights lawyer Willie Kimani.Mr. Kimani, his client Josphat Mwendwa and their taxi driver were found dead in a river 73 kilometres northeast of Nairobi. The three men had disappeared on June 23, 2016, just after a court hearing in Mavoko. They were reported to have been abducted by agents of the administrative police.

Le 5 février 2016, les avocats Zeinab Dahboul, Zeinab El Hajj, Raed Hamdan et Zaher Azoury, membres du Conseil de l'Ordre, ont été agressés par un groupe d'individus armés. Ils se rendaient, dans le cadre du mandat de représentation donné par leurs clients, à une assemblée générale de copropriétaires à Beyrouth.Les Ordres des avocats de Beyrouth et Tripoli ont fait un appel à la grève le 8 février. L’UIA, de son côté, a condamné les agressions et a exprimé sa solidarité avec les avocats libanais dans un communiqué de presse diffusé quelques jours plus tard.

PakistanBomb attack in BaluchistanThe UIA firmly condemned the suicide attack in front of the Civil Hospital in Quetta where 200 persons, including many lawyers and journalists, were gathered to collect the body of Bilal Anwar Kasi, a resident and member of the Baluchistan Bar, who had been shot dead a few hours earlier. The attack caused at least 70 deaths and wounded about a dozen others. The UIA expressed its solidarity with Pakistan’s community of lawyers and particularly the Baluchistan Bar Association.


République démocratique du CongoAssassinat de Me Jean Kisumbule Muteba

L’UIA a exprimé son soutien à M. Edouard Mukendi Kalambayi, Bâtonnier de Kinshasa/Gombe, suite à l’appel lancé aux autorités compétentes afin que toute la lumière soit faite sur le crime de Maître Jean Kisumbule Muteba, assassiné le 20 février 2016 dans la commune de Bandalungwa à Kinshasa. Les raisons exactes de cet assassinat restent encore inconnues.

RumaníaArresto del abogado Robert RosuTras el registro de la sede del bufete Tuca Zbarcea & Asociatii en Bucarest y el arresto del abogado Robert Rosu por hechos manifiestamente relacionados con el poder de representación dado por uno de sus clientes, la UIA remitió a las autoridades rumanas un escrito para recordarles, concretamente, los principios y las condiciones aplicables a los registros en bufetes de abogados, además del principio que prohíbe cualquier identificación de los abogados con sus clientes o con la causa de sus clientes por el mero hecho de representarlos.

The UIA intervened several times in the case of the lawyers Ayşe Acilinikli, Irfan Arasan, Hüseyin Bogatekin, Sefik Çelik, Adem Çalisçi, Tamer Dogan, Ramazan Demir, Mustafa Ruzgar, and Ayşe Gösterislioglu, who were members of the Lawyers’ Association for Freedom (OHD). These lawyers were charged with violating anti-terrorist laws when in fact, it appears that they were being persecuted for their legitimate practice of law and human rights defence activities. The UIA has reminded the Turkish authorities of their international obligations and asked them for explanations. It has also closely followed the proceedings and sent observers. It has invited its members to join the actions in support of the lawyers being prosecuted, expressing its concerns to the Turkish authorities and sending a post card to two of the lawyers arrested, Ayşe Acinikli and Ramazan Demir, to their places of detention.

He is currently serving a 10-year prison sentence, following a mass trial of 94 activists known as the “UAE 94” trial, which is widely

criticized for violating international standards of fair trial. The UIA has urged Emirati authorities to release Dr. al-Roken and to refrain from harassing him, and invited its members to follow its example.

UIA’s Actions against the Death Penalty

In 2016, the UIA continued its commitment towards the abolition of the death penalty worldwide through both individual and general actions: l On the eve of the execution of three men in Malaysia, the UIA supported and joined the position of the Malaysian Bar calling on the government to abolish the mandatory death penalty and, more generally, to implement a moratorium on any and all executions. l The UIA, recalling Turkey’s regional and international obligations and commitments, also co-signed a statement addressed to Turkish authorities in response to the country’s statements regarding the re-establishment of capital punishment.l The UIA participated in the 6th World Congress Against The Death Penalty held in Oslo (Norway) from June 21 to 23, 2016, gathering 1300 participants from over 80 countries to discuss issues such as the death penalty, terrorism, and protection of migrants, minorities and individuals with mental disorders from the death penalty. A workshop for lawyers on effective legal representation for persons facing the death penalty was also proposed. The UIA joined the final resolution on the death penalty and terrorism.l The UIA is now a member of the World Coalition against the Death Penalty.

EU - Turkey Agreement on MigrationOn March 17 and 18, 2016, the 28 heads of state or government of the EU's member states met in Brussels to discuss further steps to address the migration crisis and the EU-Turkey cooperation agreement on this subject. The UIA has expressed its deepest concerns about the outcome of these discussions and the consequences that this agreement may have on the protection of human rights and respect of international humanitarian law.

Interdiction d’accès aux avocatslors du démantèlementdu bidonville de CalaisSelon les informations reçues par l’UIA, les avocats présents le 24 octobre 2016, jour de l’opération d’évacuation des camps de réfugiés à Calais, dans le Nord de la France, n’ont pas pu entrer dans le bidonville pour apporter des conseils juridiques aux migrants.Alertée de cette situation par le Conseil National des Barreaux français, l’UIA a exigé la fin de cette situation de violation du droit des migrants à être informés de leur situation juridique et d’autoriser les avocats à pénétrer dans le camp. Une réponse du Ministère de l’Intérieur français invitait les avocats à se rendre de préférence dans les centres d'accueil et d'orientation (CAO) qui accueillent désormais les migrants.

Ratification of Basic Principleson the Status of Refugees

At its 60th annual congress in Budapest, the UIA General Assembly ratified the Basic Principles on the Status of Refugees (the “Budapest Principles”), which are part of UIA’s efforts to contribute to the dialogue and actions undertaken with regard to large movements of refugees and migrants.

Following the explosive rise in the number of people who are forced to flee their homes to escape violenceand seek refuge in their own countries or abroad, the need for legal assistance for refugees has dramatically increased.

Therefore, the UIA resolved to develop its infrastructure and capacities in support of mass migratory movements,reflecting the initiatives that the legal profession should take for refugees and displaced persons.

7th Session of the Open-ended Working Group on Ageing - December 12 - 15, 2016This working group considered the existing international framework of the human rights of older persons and identified possible gaps and how best to address them, including by considering, as appropriate, the feasibility of further instruments and measures.

Bar Leaders’ Briefing at the United Nations

The U IA organ ized a Bar Leaders ’ Br ie f ing at the headquarters of the United Nations in New York on May 16, 2016. This event, addressed to collective members of the association, gathered 126 participants from 29 countries. The topics presented dealt with Preventing and Ending Atrocity Crimes, International Law and Policy Responses to refugees, Migrants and Internally Displaced Persons and the 2030 Agenda for Sustainable Development in particular Sustainable Development Goal 16 (Rule of Law).Speeches were delivered by UN High Officers, including H.E. Jan Eliasson, Deputy Secretary-General of the United Nations, Karen Obada Mosoti, Head of the Liaison Office of the International Criminal Court to the United Nations, Stéphane Dujarric, Spokesman for the United Nations Secretary-General, Fabrizio Hochschild, Deputy to the Secretary General's Special Adviser for the Summit on Addressing Large Movements of Refugees and Migrants at the United Nations, Chris Richter, Migration Officer, International Organization for Migration, Office of the Permanent Observer to the United Nations, among others.

UNCITRAL

In 2016, UIA representatives attended the 49th and 50th sessions of the UNCITRAL Working Group V (Insolvency Law) . Dur ing these sess ions , the Working Group V addressed the analysis of the various issues mandated by UNCITRAL, and in particular:l Facilitating the cross-border insolvency of multinational enterprise groups(1);l Directors’ obligations in the period approaching insolvency: enterprise groups(2);l Cross-border recognition and enforcement of insolvency- related judgements(3)

The UIA has been active in discussions of UNCITRAL, trying to provide a practical view on the practice of law in a sector such as insolvency law, having even contributed to the presentation of papers for analyzing the Panel of United Nations. In particular, the UIA has been active leading the ad hoc group of UNCITRAL delegations interested in studying the feasibility of developing a convention on international insolvency law. The UIA Delegation has decided that an

international convention should provide at least a practical solution to the following issues: l Granting of access to courts to foreign insolvency representatives; l Recognition of foreign insolvency proceedings; and l Communication, coordination and cooperation between insolvency representatives and courts.

It should be remembered that this issue originated from a proposal for future work submitted by the UIA in Vienna in November 2009, supported in the Fourth UNCITRAL International Insolvency Law Colloquium held in Vienna in December 16-18, 2014.

Statuts de l'Association du Barreau auprès de la Cour Pénale Internationale (ABCPI)

Une lettre conjointe à l'initiative de l'UIA et co-signée par le Barreau de Paris, AVOCATS.BE, la Fédération des Barreaux d’Europe (FBE), la Conférence des Barreaux des États Membres de l’OHADA, et le Conseil des barreaux européens (CCBE) a été adressée le 17 juin 2016 au comité de rédaction des statuts de l’ABCPI.Les préoccupations qui y sont exprimées concernent notamment l’absence d’indépendance de l’ABCPI du Greffe de la CPI, l’absence de consultation avec les organisations représentatives de la profession et les barreaux et l’absence de vision claire et prospective quant à l’articulation entre les compétences de cette association et celles des organes de la cour en matière de discipline.Ces préoccupations générales se doublent de commentaires spécifiques sur un nombre conséquent de dispositions des statuts.Au début du mois de juillet 2016, le Président de l’ABCPI, le Comité exécutif et les différents comités de travail ont été élus. Le Président de l’ABCPI, David Hooper, a entamé des débats fructueux avec les organisations mentionnées ci-dessus. Plusieurs rencontres ont eu lieu en vue de mettre en place un système de collaboration ou de partenariat qui permettrait aux organisations représentatives de la profession et barreaux de participer aux travaux de l’ABCPI. Par ailleurs, la légitimité de l’ABCPI est aujourd’hui largement établie et l’efficacité de son travail reconnue tant par les avocats pratiquant devant la Cour que par les différents organes de la Cour. Il y a donc lieu de saluer cette avancée dans la prise en compte des intérêts de la défense devant cette juridiction qui ne dispose d’aucun barreau reconnu en tant que tel. L’ABCPI et les organisations représentatives de la profession doivent néanmoins continuer à rester extrêmement vigilantes et actives sur la défense des droits des avocats devant la CPI. La question de l’aide judiciaire est au centre des préoccupations puisque celle-ci a fait l‘objet de réductions drastiques, plaçant

les avocats pratiquant devant la Cour dans une situation inacceptable en terme de rémunération. Un expert indépendant a été désigné pour évaluer le système de l’aide légale et a formulé d’importantes critiques sur le système existant. L’UIA a participé aux débats autour de cette question.

The 15th session of the Assembly of States Parties to the Rome Statute of the International Criminal Court [ICC-ASP] took place on November 16-24, 2016 in The Hague. A special highlight in 2016 was an expert seminar held in The Hague by the Ministry of Foreign Affairs of the Netherlands to mark the official opening of the permanent premises of the ICC (April 19, 2016). One topic of special interest to the UIA at the 15th session of the ICC-ASP concerned developments with regard to the International Criminal Court Bar Association (ICCBA). The ICCBA had been created only a few months earlier: June 30/July 1, 2016.

MalaysiaConcerns About the Reform Proposalto the Legal Profession Act (LPA)

The Malaysian Bar, which has always been combative and committed to defending the rule of law, has for some time experienced successive attacks on its independence from the government.Particularly on April 6, 2016, during the session of Dewan Rakyat (House of Representatives – Lower House of the

Malaysian Parliament), one of the parliamentarians suggested that the attorney general be automatically appointed President of the Council of the Order of the Malaysian Bar. The parliamentarian had made this suggestion after criticizing the Bar for asking the government to assume further responsibilities.

Towards the end of May 2016, the President of the Malaysian Bar, Me Stephen Thiru, revealed that the Malaysian government had proposed a list of reforms to the Legal Profession Act 1976, which would be presented to Dewan Rakyat during the next parliamentary session in the following October and November. President Thiru warned of the risks that these reforms would pose to the Bar’s independence if they were adopted. Among the proposals for reforms are:l inclusion of two government representatives nominated by the Minister in charge of legal affairs as members of the Bar;l increase in the required quorum for general assemblies of 500 members to 25% of all the members, meaning 4000 members;l rights of the Minister in charge of legal affairs to set electoral standards and regulations for the Malaysian Bar;l other reforms to the election process of the Council of the

Order, such as postal voting and supplementary limitations to the eligibility of certain persons such as members of the Council of the Order or to hold a position within the office.The UIA has sent a letter to Malaysian authorities to express its concerns about the proposed reforms to the Legal Profession Act 1976, which may represent risks for the independent and democratic functioning of the Bar, and is closely following the situation.

Principes essentiels de la professionEn 2016, le sous-comité Code mondial de déontologie s’est transformé en sous-comité « Principes essentiels de la profession » afin de préciser son champ d’action. Ce sous-comité, présidé par le bâtonnier Georges-Albert Dal, met sur pied en un premier temps un projet de Charte de ces principes. Il passera ensuite à la rédaction d’un recueil des principaux arrêts de jurisprudence et des grands textes de doctrines, en se focalisant sur deux grands thèmes : l’indépendance de la profession et le secret professionnel et en comparant les systèmes des droit civil et de common law.

Memoranda of Understanding

In the framework of its international activities, the UIA works hand in hand with other professional organisations.

On June 13, 2016, a memorandum of understanding was signed with ICSS (International Centre for Sports Security), with the objective of cooperating, through the UIA Sports Law Commission on recognition of good governance, financial integrity and transparency in sport, as well as facilitation of the development and protection of children and young people in sport and through sport; and on the establishment of an independent, neutral global integrity alliance for sport (SIGA).

The UIA also signed an agreement with NYSBA (New York State Bar Association) on October 19, 2016 with the objective of strengthening the cooperation between both organisations in order to more effectively address international legal issues.

The UIA also renewed its memorandum of understanding with the ABA – SOL (Section of Litigation) on January 20, 2016 and with the ABA-SIL (Section of International Law on April 14, 2016.

On July 7-8, 2016, the yearly L4 meeting, which gathers the 4 leading international organisations of lawyers: ABA, CCBE, IBA, and UIA met in London, hosted this year by the IBA.The themes that were discussed were: l Protection/promotion of professional secrecy of lawyers after the Panama Papersl Diversity and Inclusion: What does it mean for our respective organisations? Main Theme 1: Compliance

Compliance is one of the most important aspects of a company’s structure and operations, as highlighted by recent public scandals involving corporate reputations.

The presentations during the first session introduced the participants to compliance, its fundamentals, the challenges involved, the benefits of a thorough compliance program and its building blocks, as well as how they can be included in corporate operations, review and reporting mechanisms, and how to conduct internal investigations if an issue arises. They also highlighted the importance of this area of law for the legal profession.

The specific areas in which compliance is relevant were covered in three separate workshops. The subjects included anticorruption measures and what happens when companies are faced with multi-jurisdictional investigations (potentially severe financial penalties, criminal convictions for directors and/or companies and possible cross-debarment): the stakes have never been higher for companies facing corruption allegations.

The second workshop addressed the competition law aspects of compliance. The participants discussed what is required for compliance efforts to be truly successful and effective.

The third and final workshop organised by the Foreign Investment commission covered international trade controls.

Budapest fut le théâtre de débats passionnants relatifs à la surveillance massive des données personnelles dans le secteur public sous l’égide de la lutte contre le crime et le terrorisme ainsi que dans le secteur privé avec le profilage opéré par les grands opérateurs du net.Du côté de la surveillance étatique, les discours des orateurs furent à l’unisson : la lutte contre la criminalité notamment contre le terrorisme, est d’une importance primordiale pour garantir la sécurité publique et son efficacité peut dépendre dans une large mesure de l’utilisation des techniques modernes d’enquête. Toutefois, un tel objectif d’intérêt général, aussi fondamental qu’il soit, ne saurait à lui seul justifier une surveillance massive des données personnelles visant de façon indifférenciée des personnes qui n’ont aucun lien avec les infractions pénales visées. Il faut donc en matière de sécurité nationale, des règles claires et précises régissant l’ingérence à la protection des données personnelles.

Du côté de la surveillance opérée par les acteurs privés, les grandes lignes directrices du règlement (UE) 2016/679 du 27 avril 2016 furent rappelées. Ce règlement, qui entrera en vigueur au printemps 2018, encadre avec plus de précision le profilage. Le profilage est souvent mené à l’insu des personnes concernées au travers de diverses techniques comme les cookies et permet d’évaluer ou de prédire certains aspects des individus comme le rendement du travail, la situation économique, la santé, les préférences personnelles, les intérêts, les fiabilités, le comportement, la localisation géographique. Les profils ainsi générés peuvent entrainer des discriminations et des exclusions surtout lorsqu’ils traitent de données sensibles. Un encadrement strict du profilage était donc plus que nécessaire.

Principes de base du statut des réfugiés

L’UIA a adopté le 28 octobre 2016 les Principes de base relatifs au statut des réfugiés lors de son Assemblée Générale à Budapest. Ces principes ont vocation à contribuer activement au dialogue et aux actions entreprises autour de la « crise migratoire ». Afin d’obtenir un consensus aussi large que possible, l’UIA propose à la collectivité mondiale des avocats d’adhérer à ces principes.

Las mujeres que asistieron al congreso tuvieron la oportunidad de reunirse en un ambiente informal. Las keynote speakers del encuentro fueron la Profesora Márta Fülöp (Hungarian Academy of Sciences, Budapest, Hungría), quien presentó un estudio sobre la competición entre grupos de género y Ouafya Sidhoum (Decana del Colegio de Abogados de Bouira, Argelia), quien compartió su experiencia sobre la evolución de las mujeres de África en el ámbito laboral.

UIA - LexisNexis Rule of Law Award

The UIA “Rule of Law Award” was created in cooperation with LexisNexis to honour individuals and organisations that actively contribute to the advancement of the rule of law within the legal community.

The inaugural Award was presented to the Malaysian Bar for its strong commitment to the defence and promotion of the rule of law as well as its vigilance in demanding and supporting law and justice reforms in Malaysia.

The Award was presented to Steven Thiru, the President of the Malaysian Bar, during the opening ceremony.

The commissions and working groups organised by the UIA work in specific areas in the fields of business lawand general practice, as well as human rights law.

These commissions and working groups publish newsletters and contributions from members who would liketo see their work read by other lawyers who work in the same field in other countries.

In addition, the commissions offer members a forum for exchanging information and expertise,especially at the annual congresses but also at seminars or other events.

In 2016, the UIA was composed of 43 scientific commissions headed by Sebastiaan Moolenaar as Director of Commissions and Matthias Stecher & Eduardo Lorenzetti Marques as Deputy Directors of Commissions.

A new commission designated as Corporate law and Mergers & Acquisitions commission was created as a merger of the commission on Corporate law and Mergers & Acquisitions.

The Computer & Telecommunications law commission changed its name to Information Technology law.A new working group on Food Law was also established.

Por su tercera edición, el premio fue entregado a la comisión Derecho Laboral presidida por Sonia Cortés García (Madrid, España). El premio recompensa el trabajo científico de la comisión y todas las actividades desarrolladas a lo largo del año 2016.

“La Comisión de Derecho Laboral ha sido designada comisión del año 2016. Todos los miembros de la comisión han recibido este galardón con gran entusiasmo. Es el reconocimiento a este amplio grupo de miembros unidos por el interés en el derecho del trabajo, y que año tras año hemos venido organizando intensos debates sobre temas de actualidad en esta rama del derecho. Premio Internacional Jacques LeroyDerechos humanos y mundode los negocios

En 2016, Serge Théophile Bambara de Burkina Faso recibió el 7° Premio Jacques Leroy por su trabajo sobre los impactos del cambio climático en los derechos humanos y la búsqueda de soluciones que las empresas pueden aplicar.

F u e r e c o m p e n s a d o c o n u n a participación gratuita al congreso de Budapest, su adhesión a la UIA y la publicación de su trabajo en la revista Juriste International.

Asimismo, Serge Théophile Bambara presentó su estudio en la sesión de la comisión Empresas y derechos humanos.

UIA - LexisNexis Rule of Law Award

El premio UIA “Rule of Law” fue creado en colaboración con LexisNexis para homenajear a individuos u organizaciones que contribuyen al progreso del Estado de Derecho. El primer premio fue entregado al Colegio de Abogados de Malasia, representado por su Decano Steven Thiru.

Premio Monique Raynaud-Contamine

Durante la ceremonia de clausura del congreso el 31 de octubre, el Premio Monique Raynaud-Contamine fue entregado a Ian de Freitas (Londres, Reino Unido) por su informe titulado “Towards an international regulatory approach for mass surveillance and profiling – Striking the balance between national security and privacy”.

La mención “Joven abogado” del premio fue entregada a Ingrid Bourbonnais-Jacquard (Marsella, Francia) por su informe titulado “Les actions directoires contre les assureurs – Le droit d’action directe contre le P&I Club, conception française”.

Finalmente, Barbara Bandiera (Vimercate, Italia) recibió una mención especial por su informe “How to Survive Compliance? The Financial Institutions of the 21st Century and their Challenges”.

Juriste International

Quatre numéros du Juriste International ont été publiés en 2016. Chaque numéro est tiré à près de 3000 exemplaires. Au-delà des membres de l’UIA, le magazine du Juriste est envoyé à quelques universités aux États-Unis et en France.

Au total, 88 articles ont été publiés en 2016

représentant un total de 308 pages. Parmi les 94 auteurs d’articles, 34 % étaient des femmes et 66 % des hommes.

En 2016, un dossier spécial a été publié sur les droits des réfugiés.

Comité de rédaction 2016

Après 4 années à la rédaction en chef du juriste, Bénédicte Querenet-Hahn a laissé la main à Nicole Van Crombrugghe, qui a également renouvelé une partie de l’équipe des directeurs de rubrique.

Deux postes de correspondants ont été créés : un correspondant Afrique pour alimenter le magazine de sujets en lien avec le continent africain et rédigés par des Africains ; un correspondant jeunes avocats dont le rôle est de motiver les jeunes auteurs à faire publier leur article dans le Juriste International.

In 2016, the website recorded an average of 8,549 sessions per month according to Google analytics, a decrease of 11% from 2015. This decrease can be explained not only by the fact that the Internet is becoming increasingly social (the figures on social network profiles attest to this) but also by the fact that the current website is too old.For this reason, the UIA has launched a project for a new website scheduled for 2017.The current website is most frequently accessed in France, the United States, Spain, Algeria, Italy, the United Kingdom, India, Morocco, Belgium, Hungary, and Germany.

Nouveau site Web

L’UIA s’est lancée dans un projet de refonte de son site Web, consciente que l’outil actuel nécessitait d’être repensé et modernisé pour répondre notamment aux utilisations nomades sur smartphones et tablettes, et permettre une meilleure opérabilité entre les différents services proposés (agenda, contacts, localisation, etc.)

L’année 2016 a débuté par une grande consultation destinée à identifier la future agence responsable du projet.

Deux chantiers ont été prévus :● La refonte du portail pour les internautes, avec un espace personnel dédié aux membres de l’UIA● La mise en place d’un CRM (Customer Relationship Management) pour améliorer la gestion de la base de données des membres et prospects

Les travaux de concertation ont débuté dès le mois de juin pour la partie CRM, puis en novembre pour la partie portail.

En novembre ont eu lieu des ateliers UX (User Experience) pour recueillir les avis des membres de l’UIA, leurs besoins et attentes du nouveau site. Ces retours ont permis de guider le travail de l’agence sur les orientations ergonomiques et esthétiques.

Les travaux de rédaction des spécifications fonctionnelles et techniques se sont déroulés sur la fin de l’année 2016 et se poursuivent en 2017.

La livraison du nouveau site est prévue pour septembre 2017.

In terms of Corporate Communication, the year 2016 was mainly dedicated to redrafting brochures introducing the UIA to a special audience.

Students and Young Lawyers

At the very beginning of 2016, the UIA edited a brochure targeting students and young lawyers, presenting the benefits of membership: special sessions at the congress, Jacques Leroy Prize, publication of articles in the Juriste International magazine, etc.

Law Societies and Bar Associations

To better address the concerns of Law Societies and Bar Associations, the UIA issued a new version of its brochure presenting the benefits of being a member as an organization. Various advantages were listed in the brochure such as participation in the Bar Leaders’ Briefing and the Bar Leaders’ Senate, possibility of interactions between Bars, hosting of UIA events, etc. This brochure was part of a larger campaign to gain new collective memberships and to retain current members.

During the congress in Valencia (Spain), the UIA interviewed several members and participants about what they thought about the UIA and why they were members. All answers were compiled in a short video entitled You and the UIA: why? posted on the UIA website and YouTube.

UIA Women’s Network

The UIA Women’s Network organized several events in 2016. Apart from the network’s regular meetings throughout the year (Venice in February, New York in May and Budapest in October), a special event about the gender gap took place in Paris on April 22. The presentation by Patricia López Aufranc, a partner at Marval, O’Farrell & Mairal (Argentina), attempted to depict women’s experiences as victims of stereotypes, which affect their abilities to advance in professional careers.

This event was followed by the publication of an article in the Juriste International magazine about women lawyers and pregnancy highlighting the difficulties of being a lawyer and a future mother.

L’UIA poursuit ses efforts pour réduire son impact environnemental répondant ainsi aux objectifs du millénaire définis par l’ONU dont l’objectif n°7 : Préserver l’environnement. Au siège de l’UIA, plusieurs mesures sont prises pour réduire l’impact environnemental des activités de l’association.

Énergie

● Les locaux administratifs de l’UIA sont éteints la nuit et le week-end. Aucune consommation électrique inutile n’est maintenue.● Les postes de travail sont éteints toutes les nuits de même que l’imprimante centrale

Déchets

1 - Papier :● La correspondance externe ne recourt au courrier traditionnel ou au fax qu’en cas de nécessité.● L’UIA encourage de plus en plus ses membres et participants aux événements à s’inscrire en ligne sur son site Internet évitant ainsi les formulaires papier.● Tous les emails envoyés par le personnel administratif de l’UIA comportent la mention « Please consider the environment before printing » incitant leurs destinataires à ne pas imprimer les courriers électroniques.● L’annuaire papier des membres de l’UIA est imprimé sur papier recyclé Cyclus Print à l’exception de ses pages de couverture

2 - Tri et le recyclage :● Les déchets papiers sont recyclés systématiquement par l’ensemble du personnel.● Les cartouches et les toners d’imprimante sont récupérés par une entreprise spécialisée dans le recyclage de ces éléments.

Autres mesures● L’utilisation de la vaisselle lavable est favorisée à celle de la vaisselle jetable.● Le personnel de l’UIA utilise les transports en commun ou le vélo pour se rendre à l’UIA.

Prestataires

● Les imprimeurs travaillant avec l’UIA répondent à la charte de la marque Imprim’Vert® qui a pour objectif de favoriser la mise en place d’actions concrètes conduisant à une diminution des impacts sur l’environnement.● Lors de ses congrès, l’UIA fait appel à des prestataires locaux (imprimeurs, concepteurs d’articles publicitaires, etc.), réduisant ainsi son bilan carbone en frais de transport.● Enfin, l’UIA en 2016 a choisi ses mallettes pour le congrès de Budapest chez un prestataire local qui les proposait en matériau dégradable et recyclable.

Basic Principlesof the Status of RefugeesAs the international community faces a huge challenge today – more than ever before in the past, a comprehensive, urgent and sustainable response to the migrants’ crisis was imperative. That is why the UIA General Assembly concerned with this extraordinary crisis and aware that the 1951 Geneva Convention today seems to have reached its limits, adopted the Basic Principles on the Status of Refugees. The subsidiary protection system established – in particular within the European Union – also no longer seems adequate to respond to all the particular situations that these migrants face. Bar associations and lawyers’ professional organisations are kindly invited to join via a declaration.

I am fu l ly aware of the d i f f icu l t ies and commitment involved in the post of UIA President, which I took up in Budapest in November 2016, all the more so because my nomination is particularly symbolic for the association, as I am the first woman at its head.

During my term of office, I wish to give UIA a new impetus, while continuing in the direction taken by my predecessors: defending lawyers persecuted in the exercise of their profession, strengthening the presence and role of lawyers in civil society, reaffirming the principles of a fair trial as well as the right of everyone to access justice and, lastly, reasserting the need to respect the rule of law.

President Uettwiller devoted much of his efforts to the cause of refugees last year, culminating in the adoption of the Basic Principles of the Status of Refugees in Budapest at the 2016 Congress. I intend to ensure that these principles are widely disseminated, noting in particular that free access to justice also applies to refugees, whose rights must be recognized by an independent court.

I am particularly concerned about the legal situation of refugee children, especially the issue of the recognition of their nationality, and I would like to see some reflection taking place on this subject in collaboration with the international organisations dealing with such issues, UNHCR and ICRC – a reflection that I plan to initiate during a meeting at the UN in Geneva in June 2017.

C’est pleinement consciente des difficultés et de l’engagement que la présidence de l’UIA représente que j’ai pris mes fonctions à Budapest en novembre 2016, ce d’autant plus que mon investiture est particulièrement symbolique pour l’association puisque je suis la première femme à sa tête.

Au cours de mon mandat, je souhaite donner à l’UIA de nouvelles impulsions, tout en poursuivant dans la voie tracée par mes prédécesseurs : défense des avocats persécutés dans l’exercice de leur profession, renforcement de la présence et du rôle de l’avocat dans la société civile, réaffirmation des principes du procès équitable ainsi que du droit de chacun d’accéder à la justice et, enfin, nécessité de respecter l’État de droit.

Le Président Uettwiller avait consacré l’an dernier une grande partie de ses efforts à la cause des réfugiés, aboutissant ainsi à l’adoption des Principes de base du statut des réfugiés à Budapest, lors du congrès 2016. Je compte m’assurer de la plus large diffusion possible de ces principes, en rappelant notamment que le libre accès à la justice s’applique aussi aux réfugiés, dont les droits doivent pouvoir être reconnus par une cour indépendante.

La situation juridique des enfants réfugiés, notamment la question de la reconnaissance de leur nat iona l i té , me préoccupe tout particulièrement et je souhaite qu’une réflexion soit menée à ce sujet en collaboration avec les organisations internationales qui gèrent ces questions, UNHCR et CICR, réflexion que j’engagerai lors d’une réunion à l’ONU à Genève en juin 2017.

Cuando asumí la pres idenc ia de la UIA en noviembre de 2016 en Budapest, era plenamente consciente de las dificultades y el compromiso que representaba, máxime por el especial simbolismo que mi investidura suponía para la asociación, pues soy la primera mujer que está a su frente.

Durante mi mandato, deseo dar a la UIA un nuevo impulso, continuando asimismo el camino marcado por mis antecesores: la defensa de los abogados perseguidos en el ejercicio de su profesión, el refuerzo de la presencia y del papel del abogado en la sociedad civil, la reafirmación de los principios de un proceso justo y del derecho de todos de acceder a la justicia y, por último, la necesidad de respetar el Estado de derecho.

El Presidente Uettwiller dedicó el año pasado gran parte de sus esfuerzos a la causa de los refugiados, dando lugar a la aprobación de los Principios básicos sobre el estatuto de los refugiados durante el congreso de 2016 en Budapest. Quiero asegurarme de que estos principios reciban la mayor difusión posible, recordando que el libre acceso a la justicia se aplica también a los refugiados, cuyos derechos han de poder ser reconocidos por un tribunal independiente.

Me preocupa en especial la situación jurídica de los niños refugiados, y particularmente la cuestión del reconocimiento de su nacionalidad, y deseo que se lleve a cabo una reflexión sobre este tema en colaboración con las organizaciones internacionales que se ocupan

Unfortunately, access to justice is becoming an increasingly frequent issue – and not just for refugees. Hence, during my term in office and through my official visits throughout the world, I will endeavour to remind everyone that there is no rule of law without access to justice for all, especially for the most fragile.

I would also like to remind you that there can be no rule of law until and unless everyone, regardless of race or gender, enjoys equal rights and that the rule of law is an absolute necessity for ensuring peace in the world.

To this end, I will strengthen UIA's relations with organisations working for the defence of the rule of law and with UIA's member bars so that they can take action vis-à-vis their respective governments and contribute to increase awareness of this fact and/or to a change in mindsets.

My year as President will be an anniversary year for the UIA, which will celebrate 90 years of its service to the profession in the world. Some major projects launched by my predecessor in 2016 wi l l be completed in the course of my mandate, whether they concern the implementation of a 2017-2020 strategy for our association, the relocation of our headquarters to new premises, or the total refurbishing of our website, www.uianet.org, which will offer new, interesting and practical features for our members.

Finally, the UIA's development will be at the heart of my activities in order to strengthen its presence among the world's lawyers through a lasting, unfailing commitment to our association and by reaffirming its values at every opportunity that I am given.

La question de l’accès à la justice se pose malheureusement de plus en plus souvent et pas seulement pour les réfugiés. Je m’attacherai donc, tout au long de ma présidence et de mes visites officielles à travers le monde, à rappeler qu’il n’existe pas d’État de droit sans accès à la justice pour tous et tout particulièrement pour les plus fragiles.

De même, je rappellerai inlassablement qu’il n’y a pas d’État de droit tant que toutes les personnes, quels que soient leur race ou leur genre, ne bénéficient pas de l’égalité des droits et que l’Etat de droit est une nécessité absolue pour assurer la paix dans le monde.

Dans ce but, je renforcerai les relations de l’UIA avec les organisations qui œuvrent à la défense de l’État de droit ainsi qu’avec les barreaux membres de l’UIA pour qu’ils agissent auprès de leurs gouvernements respectifs et contribuent de la sorte à une prise de conscience et/ou à une évolution des mentalités.

Mon année de présidence sera une année anniversaire pour l’UIA, qui célèbrera ses 90 ans au service de la profession dans le monde. Certains grands projets, lancés par mon prédécesseur en 2016, aboutiront au cours de mon mandat, que ce soit la mise en place d’une stratégie 2017-2020 pour notre association, le déménagement de notre siège dans de nouveaux locaux ou la refonte totale du site www.uianet.org qui proposera de nouvelles fonctionnalités intéressantes et pratiques pour nos membres.

Enfin, le développement de l’UIA sera au cœur de mon activité afin de renforcer sa présence auprès des avocats du monde, et ce par un engagement permanent et sans faille au service de notre association et en réaffirmant, chaque fois que l’occasion m’en sera donnée, ses valeurs.

La cuestión del acceso a la justicia se plantea por desgracia cada vez más a menudo, y no solo para los refugiados. Así que a lo largo de mi presidencia y mis visitas oficiales por todo el mundo, trabajaré en recordar que no existe el Estado de derecho sin acceso a la justicia para todos y, en particular, para los más débiles.

Asimismo, recordaré incansablemente que no hay Estado de derecho mientras no haya igualdad de derechos para todas las personas, cualquiera que sea su raza o su sexo, y que el Estado de derecho es una necesidad absoluta para garantizar la paz en el mundo.

Con este fin, reforzaré las relaciones de la UIA con las organizaciones que trabajan por la defensa del Estado de derecho así como con los colegios de abogados miembros de la UIA para que actúen ante sus respectivos gobiernos y contribuyan así a la concienciación y/o a la evolución de las mentalidades.

Algunos grandes proyectos, iniciados por mi antecesor en 2016, fructificarán durante mi mandato: la implantación de una estrategia 2017-2020 para nuestra asociación, el traslado de nuestra sede a unos nuevos locales o la remodelación total de la página web www.uianet.org, que ofrecerá nuevas funcionalidades interesantes y prácticas para nuestros miembros.

Por último, mi actividad se centrará en el desarrollo de la UIA, para reforzar su presencia ante los abogados del mundo, mediante un compromiso permanente e inquebrantable al servicio de nuestra asociación y reafirmando sus valores cada vez que la oportunidad me presente.
