We are transmitting to you for your action, approved as to form and legality, a final draft of ordinance regarding the above-described subject matter. The ordinance will amend the Central City West Housing Trust Fund (Los Angeles Administrative Code Section 5.115.6) by deleting the requirement to form a Trust Fund Allocation Advisory Committee.

CEQA Findings

Regarding a finding pursuant to the California Environmental Quality Act (CEQA), we believe that the City Council could determine that the proposed ordinance is exempt from the California Environmental Quality Act (CEQA), pursuant to Article 111, Section 1 of the City's CEQA Guidelines because it can be seen with reasonable certainty that this project could not possibly have a significant effect on the environment. If the City Council concurs, it must make this finding prior to or concurrent with its action on the ordinance.

In February 1990, the Central City West Housing Trust Fund (Los Angeles Administrative Code,

Section 5.115.6, Chapter 5, Article 23) was created for the purpose of supporting the production of

affordable housing within the Central City West Specific Plan area bounded by the Harbor Freeway, the

Hollywood Freeway, Olympic Boulevard and Glendale Boulevard, Union Avenue and Witmer Street on the west, or within other housing target areas identified in the Central City West Specific Plan. The Fund is administered by the Los Angeles Housing Department (LAHD).

Sub-Section F (LAAC, 5.115.6(f)) of the abovementioned Trust Fund created an Allocation Advisory Committee to make recommendations to the Council for expenditures from the Fund for the Central City West Specific Plan Area, as delineated below:

(f) A Trust Fund Allocation Advisory Committee, hereinafter referred to in this article as "the

Committee," shall be established to make recommendations to the City Council for expenditures from the Fund for

the Central City West Specific Plan area. The Committee shall make recommendations until a housing development

corporation for the Central City West Specific Plan area is created. The Committee shall consist of seven (7) voting

members and four (4) non-voting members. Three of the voting members shall be appointed by the City Council

member from Council District 1; three voting members shall be appointed by the City Council member from Council

District 9; one voting member shall be appointed by the President of the City Council. The non-voting members shall

be representatives of the following agencies: Los Angeles Housing Department, Director of the Office of

Administrative and Research Services, Chief Legislative Analyst, and the Planning Department. The City Attorney

shall serve the Committee in an advisory capacity.

The Committee shall submit annual reports to the City Council describing all projects assisted with Fund

monies.

LAAC Section 5 .115 .6( f) needs to be updated and amended inasmuch as redistricting of Council

District boundaries has changed representation of the Specific Plan area since the Plan's enactment and future redistricting could further change Council representation. In the meantime, the First Council District is investigating the possibility of creating a non-profit housing development corporation as

originally envisioned by the Specific Plan to facilitate the production of affordable housing leveraging Specific Plan Trust Fund and other resources.

I THEREFORE MOVE that the Council adopt the attached Ordinance prepared by the Office

of the City Attorney which amends Section 5.115.6 of the Los Angeles Administrative Code (LACC), Central City West Housing Trust Fund, by deleting only Subsection F, the Trust Fund Allocation

Advisory Committee, inasmuch as redistricting of Council District boundaries has changed representation of the Specific Plan area since the Plan's enactment and future redistricting could further

change Council representation.
