Approvals ( Reference: Ease of Doing Business - Manual of Procedure for Slum Rehabilitation Scheme (S.R.S.) Approvals dated 9"^ Mareh 2017. containing circular ^ and process document released by Hon'blc Minister of Housing Shri Prakash Mehta The Government of India’s initiative of Ease of Doing business aims to simplify the process of building approvals and to remove bottlenecks for the same to ensure faster development. 7'his is also in line with the Pradhan Mantri Aawas Yojna's target of creating a large housing pool by 2022. In normal course permissions under SR schemes are granted in various stages like LOI, layout, lOA, CC, further CC. OC etc. Time lag between the two stages often extends beyond acceptable limits which in turn delays the actual implementation of the project. Often this time lag is misused by the scrupulous builders who are not serious about implementation of the scheme and scout for new purchasers for the project. This is not a desirable situation for expeditious r/cl^abilitation of slum dwellers and to achieve the target of slum free Mumbai. Under ease of doing business sclf-certification was found to be acceptable to grant various permissions and reduce the number of steps involved by giving maximum permissions at one go subject t(3 some basic compliances. f. To further these ‘mandates the MCGM and SRA had published requisite Circulars and Manuals to s*implify the building approval processes. The Ease of Doing Business - Manual of Procedure, for Slum Rehabilitation Scheme (S.R.S.) Approvals dated 9'^ March 2017. containing circulars and process documents released by Hon’blc Minister of Housing Shri Prakash Mehta was the first step towards achieving the mandated objective. Taking into account the spirit of the above directions and desirability of achieving expeditious completion of rehab buildings so as to fulfill the mandate of government, it is directed that referred Ease of Doing Business - Manual of Procedure for Slum Rehabilitation Scheme (S.R.S.) Approvals dated 9‘^ March 2017 shall be implemented immediately in its entirety in manual format till the time requisite infrastructure to implement online is not available. Vision:

To achieve standardized and sim plified processes and to bring about predictability thereby ensuring the goal o f Slum free M um bai in shortest possible time.

Pream ble:

To speed up the approval process this circu lar envisages parallel approvals o f m ajority o f the requirem ents o f the S .R .S ., so that different processes operate sim ultaneously and converge at the tim e o f approval. The circular read w ith m anual aim s to ensure tim e-bound approvals in a transparent m anner.

The M anual o f S.R.S. A pproval has been prepared based on w ide consultations w ith all the departm ents w ithin S.R .A . The procedures relating to M .C .G .M . departm ents have been adopted from a sim ilar m anual for approval o f building approvals adopted by M .C.G .M .

The M anual for S.R.S. A pproval (version I) is the first step tow ards achieving the vision as m entioned in this circu lar. T h e m anual shall be updated periodically for further im proving effective im plem entation. It will ensure speedier construction perm its resulting in overall cost reduction for the Industry and increasing overall efficiency. T his circu lar and m anual shall be fo llow ed by all the departm ents o f Slum R ehabilitation A uthority m eticulously.

I) A cceptance o f the Proposal:

A rchitect/L .S . shall subm it A nnexure 1 (Technical & FSI D etails), II (List o f Eligibilities. Slum Plan, A nnexure - II C ertificate etc.), 11(a) (Plane T able Survey Slum Plan prepared by Surveyor A rchitect and List o f existing Slum dw ellers and com m ercial users w ith their areas). A nnexure-IIl (F .C .’s N O C ) along with w orks/schem e in hands, IV (O w nership D etails - C TSO ), V (A RS C ertificate). VI (T ow n P lanning N O C ) & VII (T itle C ertificate from advocate and undertaking cum

affidavit from developer, prom oter and society office bearers) as m entioned in m anual for S.R. Schem e approval version I for subm ission o f proposal to an accepting officer, designated by S.R.A. for this purpose along w ith the registered undertaking staling that all docum ents subm itted are in order. D esignated officer will check the no. o f the docum ents as per the check list m entioned in M anual for Approval o f S.R. Schem e version(I). The Certified check list along w ith the proposal shall be subm itted to the concerned Sub Engineer w ithin a calendar day. The concerned Sub Engineer shall scrutinize and com m unicate his findings within seven w orking days to the A rchitecl/L .S.. Schem e should be accepted i f it is prima facie found com plete in all respect and confirm ing that there is no overlapping o f schem es.

In case, observations are received and the A rchitect/ L.S. has subm itted his say, a consolidated report shall be subm itted to C.E.O. (S .R .A .) w ithin seven w orking days by Engineering Section. The proposal shall be accepted/ recorded on the 15'^ w orking day as per orders o f C .E.O . (S .R .A .) and the sam e shall be com m unicated to A rchitecl/L .S , by the D eputy C h ie f Engineer.

II) Pre LOI Stage:

O n acceptance o f the proposal, all A nnexures shall be forw arded to respective departm ents w ith in 3 w orking days by Engineering section.

A fter the proposal is accepted, it shall be sim ultaneously scrutinized by th5 Finance D epartm ent and the Engineering D epartm ent, w ithout w aiting for A nnexure II as per the provisions o f cl 3.12 o f A ppendix IV to regulation 33(10) o f D C R 1991 H ow ever, i f any discrepancy is noticed in the certification from C om petent authority w ith respect to num ber o f slum dw ellers, slum schem e boundary, area o f slumschem e or any other m atter, the LOI shall be revised at that tim e and the sam e willbe binding on society/developer.

1) A nnexure<ll (C om prising o f A nnexure-H (a) and final A nnexure>ll):

i) F inal A nnexure II (com plete list o f eligib le slum dw ellers along w ith certifled slum plan, consents and A n n ex u re-ll certificate) -O n acceptance o f the proposal, S .E .(SR A ) shall forw ard the draft A nnexure-lI (com prising o f A nnexure-II(a) and final A nnexure-II) subm itted by the A rchitect / L.S. to Dy. C ollector (SR A ) within 3w orking days o f acceptance. The Dy. C ollector (SRA) shall forwardthe sam e to the respective com petent authority w ithin 2 w orking days o f receipt from Engineering section. C om petent A uthority shall verify and certify the list o f slum dw ellers and area only, w ithin I m onth for area up to 500 huts, 1 1/2 m onths for area up to 1000 huts and 2 m onths for area above 1000 huts in the fo rm o f A nnexure-ll(a). T hereafter the com petent authority shall certify the eligibility o f slum dw ellers and consents thereto in the form o f final Annexure-II, This certified final A nnexure-II shall be issued w ithin 3 m onths from receipt o f the Draft A nnexure-II from SRA,

ii) A nnexure-II(a) (part o f A nnexure-H - com prising only o f certified slum plan and list o f existing slum d w ellers w ith areas o f com m ercial users) - A nnexure-II(a) certified by the com petent

• authority shall be subm itted to SRA im m ediately on receipt o f the sam e from com peten t authority.

2) A nnexure III:

On acceptance o f the proposal, S.E. (SR A ) shall forw ard the Pro-form a A nnexure - III subm itted by the A rchitect/L .S . to F.C. (SR A ) w ithin 2 days o f acceptance. A ssistant A ccounts O fficer (A A O ) shall scrutin ize the docum ents and com m unicate the shortcom ings if any to A rch itect/ L.S. and D eveloper w ithin 5 w ork ing days o f receipt o f papers. A rchitect/L . S. or developer shall com ply and subm it requisite papers w ith in 5 w ork ing days to F inance D epartm ent.

• The A A O shall verify financial statem ents and other docum ents subm itted aJong w ith Pro-Form a A nnexure III by the L .S ./D eveloper for that num ber o f tenem ents as com m unicated by AE/EE. A A O shall subm it the A nnexure - I l l file to the A ccounts O fficer in 4 days, after verify ing residual capacity o f the developer, as per net w orth certificate issued by C.A. A ccounts O fficer shall verify the sam e and subm it w ith com m ents, if any, to Finance C ontroller (S .R .A .) w ith in next 2 days. F.C. (SR A ) shall verify the sam e and certify A nnexure-IIl. A nnexure-III shall be issued w ithin 15 days o f receipt o f ail com pliance/docum ents by the D eveloper/A rchiteci/LS.

3) A nnexure IV (O w nership D ocum ents - C T SO N O C ):

A nnexure IV shall be subm itted to D esignated O fficer appointed by C EO (SR A ) w ithin 15 days from subm ission o f the proposal.

I l l ) LOI Stage;

The A fchitect / L.S. shall subm it the draft note for consideration and approval o f C E P (SR A ) w hich should include all the details, concessions sought for and schem e param eters.

S ub-E ngineer shall scrutin ize the proposal w ithin 15 days o f subm ission o f proposal in tjie form at hereinabove and subm it a report to the A ssistant Engineer. A ssistant Engiigeer shall subm it a report to Executive Engineer w ith com m ents w ith in seven days. E xecutive Engineer shall subm it the report to Dy. C h ie f Engineer w ith com t^ents w ithin four days. Dy. C h ie f E ngineer shall subm it the report to Secretary (S.R :A .) w ith com m ents w ith in tw o days. Secretary (S .R .A .) shall subm it the proposal to C .E .O .(S .R .A .) w ith com m ents w ithin two days. C E O (SR A ) shall approve/reject the proposal, as the case may be. In the event o f approval, LOI shall be issued w ith in 3 days o f receipt o f proposal for grant o f LOI.

All concessions necessary for approval o f Layout, buildings (Sale and R ehab) shall be obtained at the tim e o f approval o f LOI, itself, so that the proposal can be processed and approved by C .E .O .(S.R ,A .) at one go.

Thereafter, Layout, lO A will be issued concurrently subject to N O C s from Govt. A uthorities w hich bar the developm ent. O n subm ission o f 70% consents/individual A greem ents from eligible slum dwellers, C C /Further CC shall be issued*for Rehab building/s for construction area up to 20,000 sq.m t. for a height w ithin a perm issible AG L max. up to 24.00 Ml. till subm ission o f CFO N O C and subject to com pliance o f the requisite conditions. *

Thereafter, in case o f G overnm ent/M H A D A /M .C .G .M . lands, a letter in form o f 2.8 N O C as per clause no. 2.8 o f A ppendix-IV shall be sent to the respective land ow ning authority . D eveloper shall publish the LOI in at-least tw o new spapers, one English and one in M arathi published from M um bai. The sam e shall also be published on the w ebsite o f SRA.

The LOI, layout, plans o f building (lO A ) shall be approved and issued without waiting for certified annexure-II to VI i f the sam e is not received till the LO I is taken up for processing and approval by Engineering D epartm enf. H ow ever, all the A nnexures duly approved and certified by respective authorities m ust be furnished before dem olition o f any slum s structures or issue o f CC to first rehab building w hichever is earlier.

IV) A ppointm ent o f Consultants:

The O w ner/D eveloper shall appoint qualified consultants for technical guidance and design o f the various aspects o f the S.R.S. as m entioned in the Table 1 and w'ho shall offer detailed reports for subm ission to S.R.A . The certificate to that effect will be subm itted to SRA . The C onsultant’s Rem arks, Design, and C om pletion Certificate subm itted by the developer shall be considered sufficient for prgcpssing the proposal. The details o f the consultants offering rem arks and com pletion cerbficate and the qualification o f consultants shall be furnished along w ith application for grant o f LOI.

The design, laying & providing o f internal services w ithin a single building or w ithin a Layout proposal shall be the responsibility o f the D eveloper/Consultant. D eveloper/A rchitect shall obtain remarks./design from consultants for each o f the Internal Services for full potential o f developm ent on the Land under D evelopm ent incorporating guidelines and specification as laid dow n by the A uthorities. The com pletion certificate o f the w ork done in accordance w ith the rem arks shall also be insisted from the consultants only. A rchitect/developer shall subm it such rem arks/design/com pletion to S.R.A. for record purpose only. M CG M shall issue rem arks-'com pIetion/NOC within seven (7) days & only in respect o f connectivity o f each such service to the M CG M facilities.

VI) T ree A uthority N O C / Superintendent o f G arden (S.G .) Rem arks:

(i) In ca.se o f cutting and transplantation o f trees:

The application along w ith the Tree Plan prepared by the Consultant for N O C from Tree A uthority shall be accepted by S.G . Dept, o f M .C .G .M . The A rc h ite c t L.S. can m ake application before subm ission o f S.R. Schem e and

S.G . shall process such application w ithout insisting for L.O.I. o r building perm ission. S.G . shall process such applications received as per norm s laid dow n by M .C .G .M . in this regards for approval o f build ing proposals in M .C .G .M . Tree A uthority N O C shall be insisted by Engineering Section at the tim e o f issue o f C.C. o f first rehab build ing/ P linth C C o f any other

- bu ild ing in the schem e, w hichever is earlier. The revised Tree A uthority N O C shall be required only in case the foot print o f the proposed building

(ii) ■ In case o f no cu tting o f trees:

A rchitect/ L.S and O w ner/D eveloper shall subm it the certified copy o f the T ree plan prepared by the consultant, show ing the trees on the plot as per the site condition, w ith details o f trees as per the A nnexure V o f m anual, duly signed by both consultant & ow ner/developer, to Executive Engineer (S .R .A .), along w ith the B uilding Perm ission application. C onsultant and O w ner/D eveloper will be responsible for correctness o f num ber and location o f trees show n the plan and will be held responsible for m isrepresentation or for providing false Inform ation. Executive E ngineer (S .R .A .) shall forward the copy o f tree p lan w ith details to Superin tendent o f G arden O ffice for their 'inform ation, record & N O C in such cases w ill not be required.

V II) Insecticide T reatm ent C harges from Pest C ontrol O ffice (P .C .O .):

The insecticide treatm ent charges shall be one tim e for a block o f five years and shall be calculated on the total built up area o f the proposed build ing under construction. T he said charges shall be as m ay be prescribed by the M C G M from tim e to tim e. T his paym ent shall be m ade at the office o f M .C .G .M . The paym ent receipt shall ac t as sufficient com pliance o f requirem ents by PCO.

VIII) N O C fo r availability o f w ater supply:

The applicant m ay subm it the application for R em arks for availability o f w ater Supply from the M C G M considering the full potential o f the p lo t under developm ent along w ith the C onsultan t’s report specifying the requirem ent o f w ater supply for the project. The Executive Engineer (P lanning & R esearch) W ater W orks, M .C .G .M . shall accept and process such application w ithout insisting L.O.I. o r build ing approvals and shall issue its R em arks w ithin 7 days o f the receipt o f the application, as is being done in case o f M .C .G .M . build ing proposals.

IX) R em arks for U nderlying W ater main / W ater trunk / A qua D uct / Sew erage L ine etc.:

The applicant m ay subm it the application for R em arks for w ater m ain / w ater trunk / aqua duct & sew erage line, underneath the plot under developm ent. T he Executive Engineer (P lanning & R esearch) W ater W orks, M .C .G .M . & Executive Engineer (SP),. M .C .G .M . respectively shall accept and process such application without insisting L .O .I. o r building approvals and shall issue its R em arks w ith in 7 days o f

the receipt o f the application, as is being done in case o f M .C .G .M . building proposals.

X) ULC NOC:

The developer/ow ner shall be responsible for com pliance o f the ULC NOC for the land under developm ent. The developer/ow ner shall subm it the registered undertaking cum indem nity bond on stam p paper as applicable indem nifying SRA & as per the directives & along w ith draft for the sam e issued by Dy. D irector(U D ) u/no-U LC-10(2008)/CR-l/2008/ULCA-l d t . l .3.2008.

XII) R em arks from C onsultants;

All rem arks by the consultants will be subm itted by the A rchitect/ L.S. along w ith the application for building perm ission for records o f the S.R.A . The respective C onsultant & O w ner/D eveloper shall be responsible for any defects in the internal services w hich may crop up due to any shortcom ings / m istakes in the rem arks by the consultant. The design, adequacy and execution o f all internal services whose rem arks are issued by the Consultant will strictly be the responsibility o f the respective consultant and O w ner/D eveloper. A rchitect/L .S . shall be res^ionsible for ensuring the incorporation o f all the rem arks given by various consultants for various services (except, R .C .C . details) required for the proposal.

3) The application for further CC shall be subm itted along w ith clearances ( if any) required . In case o f proposal w here construction area exceeds 20,000 Sq.m t., the application shall be accom panied w ith clearance from M OEF.

^ 4) The further CC for height o f proposed build ing beyond 70 M t. or asperm issib le as per C ivil A viation requirem ent, w hichever is lower, shall be

1 issued, after ob tain ing clearance from High R ise C om m ittee (H R C ) and CivilA viation A uthority.

5) The developer shall obtain N O C from E lectrical Service Provider for Substation / R eceiving S tation for the full potential o f the plot at the tim e o f Further C C o f last bu ild ing in the layout.

6) C o-rela tion betw een R ehab com ponent and sale com ponent shall be m aintained as per D C R or as decided by C EO (SR A ).

XVI) For Layout / Subdivision / Am algam ation:

The layout proposal along w ith plan subm itted, by A rchitect / L.S. shall be scrutinized by S.E .(S .R .A .), A .E .(S .R .A .) & E .E .(S .R .A .) w ithin 10 days. Based on the scrutiny R eport o f the Layout A pproval subm itted by S .E .(S .R .A .), A .E.(S.R .A .) & E .E .(SR A ) will be approved by Dy.Ch.E.(S.R .A .) w ithin 03 days thereafter.

On approval o f the layout by Engineering departm ent, the sam e shall be forwarded to C ity Survey D epartm ent o f S.R.A. for processing the subdivision/am algam ation proposal for entering the sam e in R evenue records, w ithin 15 days and shall be put up for approval o f CEO (SRA). On receipt o f approval o f CEO ( S ^ ) the sam e shall be com m unicated to concerned C .T.S.O . for doing the needful ip the case.

X V II) T he L abour / T ransit Cam pyTem porary Structures like RM C P lant, m aterial storage shed, site office etc.:

The perm ission for construction w ork o f T em porary Structures like R M C Plant, m aterial storage shed, site office etc. shall be scrutinized by S.E .(SRA ), A :E.(SRA) and approved by E .E .(SR A ) for the slum dw ellers w ithin 10 days on receipt o f the proposal from A rchitect/L .S.

The validity o f such perm issions shall rem ain till com pletion o f project or com pletion o f rehab com ponent as m ay be applicable w ithout any necessity o f applying for renew al but subject to paym ent o f renew al charges as m ay be applicable at the tim e o f grant o f perm ission itself.

X V III) A m endm ents to Building Plans and Layout:

B uilding plans approved are required to be am ended w hile the construction is being carried out. The A m endm ent are required to be done for m any reasons, including site conditions, m arket requirem ents, Tenants/occupants requirem ents and many other reasons. S ince w ork is ongoing, and any stoppage o f w ork will result into financial loss because of, custom er and slum dw ellers com plaints and claim s, and such other reasons, it is noticed that such am endm ent are incorporated at the site, but are subm itted to S.R.A . for its approval at the tim e o f seeking OCC o f the building o r a w ing. The S.R.A. is intending to create an environm ent o f com pliance and for such reason states, that any am endm ent to building plan or layout o f the ongoing project shall be approved w ithin 15 days by E .E .(SR A ) if the proposal does not contain concessions beyond w hat is already approved. O therw ise it shall be

approved w ithin 30 days and such cases shall be taken up on priority to any othernew or m iscellaneous proposals.

Fact Sheet shall be scrutinized by S.E. (S .R .A .) w ithin 4 days o f subm ission and shall be fu rther scrutinized by by A.E. (S .R .A .) w ithin 7 days. T he R eport o f the am endm ent to p lans shall be sim ultaneously scrutinized by A.E. (S .R .A .) and forw arded to E .E .(S ,R .A .) w ho shall approve the p lans o f building approval w ithin 10 days o f the subm ission o f application for am endm ent to

* build ing approval.

4) W here am endm ent to B uilding Plans require revision o f concession alreadyapproved, and then the A rchitect/ L.S. shall subm it the F act Sheet for am ended build ing perm ission as per the Form 20 o f Section I-E o f the M anual. T he fact sheet shall be subm itted along w ith Revised R em arks ( if any) from C.F.O . and S. G. and the am ended plans shall be scrutinized by Sub E ngineer (S .R .A .) and A ssistant E ngineer (SR A ) and approved by E .E .(SR A ) w ithin 10 days from dale o f subm ission o f proposal by the A rchitect/L .S . T he concession report for am ended plans subm itted by the A rchitect /L .S . shall be scrutinized by S .E .(SR A ), A .E .(SR A ), E .E .(S .R .A .) & D y.Ch.E . (S .R .A .). and sam e shall be subm itted for approval o f C E O (SR A ) w ithin 15 days from the receipt o f proposal.

5) . T he approval to am ended B uilding Plans shall be issued by E .E .(S .R .A .) f ’ w ithin 4 days o f receipt o f approval to concession report and receipt o f

rev ised rem arks o f C .F .O . ( if any) and N O C from S.G. ( if any).

A m endm ent to Layout, shall be subm itted by A rchitect /L .S . to Engineering S ection and shall be processed in accordance w ith para XVI o f this circular.

XIX) M unicipal Services:

Ail perm issions/ services to be offered to S.R.A . projects by M .C.G.M - agencies like w ard office, H .E. D epartm ent etc, shall be offered as per the procedure specified for building proposals by M .C.G.M .

XX) O ccupation C ertificate (O C) / Building C om pletion C ertificate (BCC ) Stage:

The A rchitect /L .S . shall subm it com pliance reports along w ith com pletioncertificate obtained from the consultants to the CFO and Tree AuthoAty w hereverapplicable.

1. The CFO and Tree A uthority shall com plete the site inspection w ithin 7 days o f receip t o f such application along w ith the com pletion rep o h s o f the C onsultant through the A rchitect. On the satisfactory com pletion o f the site visit, the CFO and S.G. shall issue com pletion certificate w ithin 7 days thereafter. In case the com pletion certificate is not issued w ithin 15 days o f the dale o f application by the A rchitect or any obser\'ation/objection is not com m unicated to the A rchitect / L.S., then the application requesting for the com pletion certificate shall be deem ed to have been approved by the S.G. and CFO respectively.

2. The A rchitect / L.S, shall subm it com pliance reports along w ith com pletion certificate obtained from S.G. and C FO D epartm ent, as per the A nnexure VII and VIII o f the m anual respectively, to the Engineering Section.

3. The A rchitect/L .S . shall also subm it com pletion certificate in respect o f the building along w ith com pletion report from various consultants in respect o f internal services and self-certifications as m ay be required.

4. T he A rchitect /L ,S . shall also subm it A ssessm ent N O C or latest paid bill o fA ssessm ent Tax along w ith application for O C C /B C C in respect o f plot onwhich each o f the B uilding o r a w ing is constructed.

5. In cases o f single building:

O n subm ission o f BCC by A rchitect/L .S ., O C and BCC shall be issued sim ultaneously and w ithin 15 days by Executive Engineer (S .R .A .) subject to com pliances o f the approval conditions w ithout insisting certificate u/s 270 A o f M M C Act.

6. In case o f a B uild ing or w ing o f a Building in the layout.

On subm ission o f BCC by A rchitect/L .S . for each o f a building o r a w ing in the layout (except for the last building/ w ing in the layout) O C and BCC shall be issued sim ultaneously and w ithin 15 days by Executive Engineer (S .R .A .), subject to com pliances o f the approval conditions in respect o f such

build ing / w ing & w ithou t insisting certificate u/s 270 A o f M M C Act. Layout com pletion shall not be the precondition for issue o f OC and BCC for each o f a build ing or a w ing (except for the last bu ild ing / w ing) in the layout & on layout com pliance as stated in Para-IX , below. T he OC and BCC o f the last build ing o r w ing in the layout shall be issued sim ultaneously w ith layout com pletion certificate.

7. T he C om m unication o f refusal to O.C. and BCC w ith detail reasons, shall be issued w ith in 7 days from the date o f application and subm ission o f requisite com pliances

8. O .C. w ill be issued only after m aking all necessary paym ent due at that stage including m aintenance deposit.

9 .: A llo tm ent o f rehab tenem ent shall be m ade by draw al o f lots as detailed in ^ circu lar N o. 162.

The process fo llow ed by M C G M for grant o f OC shall be fo llow ed m utatis-m utandi.

X X I) L ay o u t, S u b d iv is io n , A m alg am a tio n C o m p le tio n :

1. A ll R eservations and Public A m enities provided w ithin Layout shall be * handed over to M C G M , on or before grant o f O C C /B C C for the area

exceeding 75% o f the approved Sale B uilt up A rea o f the Plot.

2. All in frastructures in L ayout shall be com pleted on o r before grant o f O C C /B C C o f area exceeding 90% o f the approved Sale B uilt up area o f the plot.

3. L ayout C om pletion C ertificate shall be issued by A .E. (S .R .A .) w ithin 15 days o f application being m ade for the sam e by A rchitect / L.S.

X X II) H a n d in g o v e r o f R e se rv a tio n s , A m en ity a n d A re a u n d e r D .P . R o ad .

All B uildable, N on-B uildable R eservations and area under D .P. R oads shall behanded over to D evelopm ent Plan D epartm ent o f M .C .G .M . as per the procedurelafd dow n in respect o f B uilding Proposals.

The copy o f the possession receipt o f Area under the Setback and application to theCity Survey O ffice shall be forw arded to S.R.A . for further action.

X X III) G e n e ra l:

1. A ll com m unications to A rchitects/ L .S ./ D evelopers shall be com m unicated by E m ail/ SM S along w ith letters.

2. A ll paym ents fo r fees, charges, deposits, prem ium etc. payable in respect o f the S.R. Schem e shall be paid at the finance departm ent o f SRA. W henever

Ihe online paym ent gatew ay for such paym ents is ready the developer will have option to m ake paym ent online.

3. The A rchitect / L.S. shall subm it the last paid assessm ent bill-receip t for property under developm ent, along w ith self-certification received from the D eveloper / O w ner to S.R.A. The N O C from A ssessm ent D epartm ent o f M C G M shall be insisted only for granting O C C /B C C for the last sale building. The N O C from A ssessm ent D epartm ent o f M C G M shall not be insisted for obtaining any other rem arks or perm issions o r connections from any departm ents o f M CGM .

4. Since the potential o f land exhausts on encum brance o f slum dw ellers theslum schem es do not perm it any zonal FSI w hile granting apprpvals. Thus, the value o f the land is independent o f the zonal FSI w hen the said land is encum bered w ith slum s, rather the value o f land w as initially being considered as zero at the inception o f SRA schem es. Benefits accruing out o f slum rehabilitation schem es for insitu rehabilitation o f slum dw sllers are restricted to only incentive FSI against the construction and handing over o f rehab com ponent free o f cost.

T herefore, the land prem ium shall be charged at ready reckoner rates applied to land area only.

5. L abour Cess:

i) In case o f single building before grant o f building perm issionii) In case o f m ore than one building in the project labour cess to be

charged @ ready reckoner rates for construction applied on built-up area (FSI) in stages along w ith M R & TP developm ent charge.'

6. Separate rem arks or N O C shall not be insisted from M .C .G .M . D epartm ents w here the rem arks from the consultants as detailed in serial num ber 1-3 o f th is circu lar o r self-certification as applicable are subm itted for ttie building proposal / layout on land under developm ent.

7. It is therefore proposed, in order to expedite the dem olition process forspeedier im plem entation o f schem e, SRA should itself grant the perm ission for dem olition o f toilet blocks captured in the slum plan subject to (i) paym ent o f cost o f toilet block w hich in turn w ould be transferred by SR.A to respective public authority and (ii) in case the to ilet blocks were beingused by neighboring slum dw ellers also then m aking provisions o f adequateM obile T oilet blocks w ith in the slum plot or outside at suitable place for the balance neighboring slum dwellers.

8. All A pplications, R em arks, Reports and com pletion certificates etc. shall be as per the standard form at prepared in the manual.

9. W herever the rem arks and com pletion have to be obtained from C onsultants, the sam e also shall be in accordance w ith the form at prepared in this m anual.

10. All R em arks by the M C G M shall rem ain valid for the entire project period.

11. All rem arks by M C G M and C onsultants, shall be issued for the full potential o f the project as requested by the applicant and shall be issued w ithout insisting for L ayout o r B uilding proposal approval. N o fresh R em arks shall be insisted in the event o f m odifications to the layout or building proposal p lans unless there is m ore than 10% variation in the param eters o f the rem arks. F or exam ple, in case o f R em arks issued for W ater requirem ent o f the project, no new R em ark shall be insisted /required unless the am endm ent o r m odification proposed to the layout o r p lan o f the build ing results in increase o f m ore than 10% o f the total w ater requirem ent o f the project from the total W ater requirem ent as per the rem arks issued earlier. H ow ever, this condition will no t be applicable C FO Rem arks w hich shall be obtained for all those am endm ents / m odification in the build ing proposal w hich requires revised approval o f C.F.O.

12. Site Inspections w herever required m ust be carried out w ithin 3 days o f receipt o f application.

13. • The form ats, requirem ents and checklists given in the M anual, shall befollow ed and no other docum ents or requirem ents will be asked for. H ow ever, in case o f any special need, any docum ent o r requirem ent are necessary to process the proposal then the reason for seeking such additional docum ent or requirem ent shall be com m unicated to the D eveloper/O w ner apd A rchitect/L .S . by S.R.A . The D eveloper/O w ner and A rchitect/L .S . can refer the m atter to the Secretary (S .R .A .) in case o f d isagreem ent to the

•reasons g iven for seeking such additional docum ents beyond those m 'entioned in the M anual for Slum R ehabilitation Schem es. The decision o f the Secretary (S .R .A .) shall be final and binding.

14. W herever the concerned officer has any observation in respect o f building proposal, he shall com m unicate the sam e to the A rchitect/L ,S . and B eveloper/O w ner, w ithin 10 days o f receiving application along w ith specific reasons and also w ith suggestion o f corrective m easures. Such com m unication in respect o f rem arks/ N O C s/ A pprovals/ C C /F urther CC etc. can be given only once along w ith valid reasons and on com pliance to these reasons in the form o f additional docum entation and /o r justification

15. The developer shall be entitled to change his consultants appointed provided n h e rem arks/ com pletion offered by the new consultants are in consonancew ith the rem arks offered by earlier consultant and the fees etc. o f the earlier consultant are paid in full by the D eveloper, The change in consultant appointed by developer i f any shall be com m unicated to SRA forthw ith

16. The num ber o f w orking days for processing o f the proposal staled in thiscircular shall be binding on the concerned officers. In case o f a failure o f com plying w ith the tim e frame by the officer, the next higher authority will assign the w ork to another officer. , • ^

17. Secretary (S .R .A .) shall m onitor that all the proposals are processed as per the m anual and as per the tim e period m entioned in this circular and this m anual. Any file o r proposal, w hich is delayed beyond the period m entioned in th is circular or m anual, shall be called for by the Secretary (S .R .A .) within a period o f 7 w orking days o f such delay and jo in t m eeting with- Concerned officers along w ith A rchitect/L.S. and O w ner/ D eveloper shall be called by Secretary (S .R .A .) w ithin next 4 days and it w ill be ensured that all issues are resolved in such jo in t m eeting. I f there are any issues which* cannot be resolved at the m eeting o f the Secretary (S .R .A .), then the m atter shall be referred to C .E .O .(S.R .A .) by A rchitect/O w ner or Secretary (S .R .A .), who shall give suitable directions to ensure that proposal is cleared w'ithin 10 days o f im plem entation o f such directions.

18. The H .O.D . shall subm it m onthly report o f all the pending proposals and m ovem ent o f each o f the Proposal Files in his D epartm ent and its status to Secretary (S .R .A .) and he should review the report and call for explanations and reasons from concerned officers for all proposals and files w hich are being delayed beyond the period m entioned in this circular o r nfanual.

19. The departm ents shall provide the details on S.R.A. w eb site in fo-ordinationw ith Secretary (S .R .A .) office so as to m ake available the data on line.

20. A rchitect/L .S . shall check & subm it quarterly progress report along withphotographs, about the construction o f the proposed building/s, stating that the w ork is carried out as per the approved plans. A rchitect/L .S . shall also inform im m ediately, in w riting to respective S.R.A. section in case the construction w ork is found to be deviating from the approved building plans and shall subm it the am ended plans for approval o f the B uilding Proposal Section.

21. A n n e x u r e -I I I

i. The total am ount o f bank guarantee shall be 5% o f the construction cost as directed by The Authority. Five B ank G uarantees each of am ount equivalent to 20% o f total bank guarantee am ount can be subm itted instead o f subm itting Single G uarantee. One Bank G uarantee, shall be released after com pletion o f the build ing for that part o f the schem e for w hich part O C has been issued. Other G uarantees can be released in sim ilar manner.

ii. The developer may deposit Fixed D eposit R eceipts o f equivalent am ount o f Bank G uarantee having auto renew al facility w ith a lien

m arked in favour o f SRA in any Scheduled Bank for a term o f five years. The FD shall be auto-renew ed for period o f one year thereafter till com pletion o f rehab com ponent, The developer w ill get the principal am ount o f such FD R along w ith interest accrued thereon afte r com pletion and N O C from Engineering D epartm ent to lift the lien. F ive F D R ’s each o f am ount equivalent to 20% o f total FDR am ount can be subm itted instead o f subm itting Single FDR. One FD R , shall be released after com pletion o f the build ing for that part o f the schem e for w hich part OC has been issued. O ther FD R can be released in sim ilar manner.

iii. D etails as requisite under incom e tax act o f current P artners/A O P ’s D irectors on record only shall be subm itted.

iv. B ank G uarantee shall be subm itted in the attached form at from any scheduled bank.

V . B anker/F inancing Partner/E xpert shall be allow ed to be Co-D eveloper at the option o f the developer after hearing m anaging com m ittee o f proposed society w ithout G B R from society, i f insisted by Engineering D epartm ent and Co-O p. D epartm ent.

vi. F or clubbing and am algam ation o f two or m ore SRA Schem es beingim plem ented by two or m ore different Entities / firm s/Pvt. Ltd. C om panies w ith com m on (at least 26% holding) partners or stakeholders, the said Entities / firm s/Pvt. Ltd. C om panies shall be considered for am algam ation/clubbing subject to furnishing o f

• registered undertaking cum indem nity bond regard ing jo in tdevelopm ent i f proposed by Engineering D epartm ent.

X X IV ) T ra n s it io n a l

1. All ex isting proposals o f Layout and Buildings shall henceforth be processed as per the M anual for B uilding A pproval and as per this circular.

2. The concession/ L .O .I. files w hich have been subm itted to C .E .O .(S .R .A .) can be processed as per the old system .

3. The D eveloper/O w ner shall have an option to appoint various consultants as per this c ircu lar and obtain fresh rem arks from such consultan t for the ongoing proposals. The consultant shall ensure that the earlier rem arks given

by the M C G M are considered, w hile issuing the fresh rem arks. W herever the D eveloper opts for the Consultant then the com pletion report shall also be issued by the C onsultant.
