The revised and updated version of 'Handbook on Recruitment Rules' as on 31st December.1993 is in your hands. In this compendium an attempt has been made to update and consolidate variousinstructions on framing/amending the recruitment rules issued from time to time to serve as a handy/guide to the users. To make this task still easier, various orders having bearing on recruitment/recruit-ment rules have also been included for easy reference.

It is expected that the users will find this compilation as a comprehensive reference book and will nowfeel the task of framing/amending recruitment rules much ea.>ier. With this the delay in getting therecruitment rules/amendments approved is also expected to be cut-down to a great extent.

3. There could still be some gaps and we welcome any suggestions by users to make the Handbookstill more useful.

1.1 As soon as decision is taken to create a ne~post/service or 'to upgrad~ any post or re-structure anyService, action should be ' taken immediately' byt,heAdministrative Ministry/Department concemed tQframe Recrui.tment Rules therefor.

The provisions of the recruitment rules governingupper age limit or qualifications for direct 'recruitmentwhich :are geljerally"basetl on the policy guidelinesissued by tihe Department of Perso1l#1el& Training,should not, however, be relaxed without prior concur-rence of that Department.

2.2 Recruitment Rules for Groups 'A' & 'B' posts/services as approved by the Administrative Ministry /Department should be referred to the DeparqneJ,lt. ofPersonnel & Training first for clearance as. early. aspossible and not later than one month from th~ dat~ of

the creation of post/service. This is- gellOHUydQJ1.8:by referring the file to the administrative Ministry :witha self-contained note, accompanied by inter-alia, thefollowing:

(i) Draft recruitment rules (for pasts other thanthose in the established service8) in tJ1epr0-forma i#:l Annexure'.!.

(ii) SUPl-'lOrtingparticulars in Annexure II.

(iii) Recruitment Rules for the feeder poif(a)and the higher post, if any.

(iv) Present sanctioned strength of the po.t forwhich rules are being framed as also of thelower and higher paitS.

2.3 Mood Recruitment rules for a number of postsill consultation with the Uilion Public Service Com-mi~jon have been circulated to all Ministries. Thesehave bcen included in Part III of this compilation.While framing recruitment rules for such Posts, theModel Rules should be adhered to.

2.4 In respect of framing of recruitment rules· forpOjts-~which are not covered by any of the organisedServices. the format of a Notification accompanied bythe 14 Column Schedule as given in Annexure I willbe used As for organised Services, Comprehensiveservice. l\lIes shall be framed covering inter-alia, thefollowing aspects :-

CONSULTATION· WIlli D. P. & T.2.5 Ordinarily, the dr~ recruitment rulei will be

returcned by the Department of Personnel and Train~IDg;;\"iththeir comments, withip a month from the dateof reference to that Department. If tIle circumstancesof ~ cue require more time for scrutiny / diiCl.lSloion,the administrative Mini~tryIDepartment will beinformed of the same and where there are manypoinl~ for ch¢.fication, tpe Ministries may also berequested to discuss the case with the officers of thoDepar;uncnt of Per&oo,1el& Trainin&.

CONSULTATION WITH UPSC

2.6 After obtainjng tile concurrence of the Dep~rt-ment of Personnel & Training, the AdmillistrativeMinistry/Department should refer the draft recruit-ment rules for pos.tsl services which are within thepurview .of the UPSC in a self<qntained letter 1,0 theCommission, alongwith the infOIllUltion in the pre;-scribed proforma (Annexure II). It should be statedin the letter to the Commission whether t,he clearanceof the Department of Personnel & Training (and alsothe Department of P~ion & Pensioners' Welfarewhere required) has been obtained in respect of theproposals in question. Where the procedure for con-SUlt.atiOllwith theCommi"sion hast?een followed andinformation necessary for consideration of the pro-posal has been fully given, it should be possible forthe Commission to convey their advice ordinarily with-in 4 to 5 weeb. If tlJ,e Commission's advice is notra-.eived within this time, the administrative Ministry /Department may settle the matter by personal discus-sion with the officers cOllc~med in the Commission.

PART-III

GUIDELINES ON PREPARING SCHEDULE &NOTIFICA TlON

A. GENERAL

INITIAL CONSTITUTION3.1.1. In cases where a new service is formed and

the recruitment· rules are framed for the first· time andthat there are officers aiready hwdipg different cate-gories of posts proposed to be included in the serviceon,a regular/long term ·basis, a suitable 'Initial Con-stitution' Clause may be inserted in the Notificationso as to count the regular s~rvice rendered by suchofficers before the date of· notification of the Rules.

CONSIDERATION OF SENIORS3.1.2. It may 10 happen that in SIOme casCi of pr0-

lRETENTION OF EXISTING ELIGIBILITY: SERVICEi 3.1.3 Where the eligibilitLY service for promotion',pres~ribed in the existing rules is being enhanced (tobe in conformity with the guidelines issued by thisDepartment) and the change is likely to affect adverselysome persons holding the ft:.eder grade posts onregular basis, a note to the, effect that' the eligibility

CONSIDERATION OF ,TIIEWHILE UPGRADA nON

3.1.4. When the posts are upgraded and conse-quently the recruitment rules are being amended, asuitable provision may be made to the effect that thefitness of the iiucumbent in the feeder grade with therequisite service shall be considered by the competentauthority or Commission (in respect of Group 'A' &'B' posts). In case he is considered fit, he shall bedeemed to have been promoted to the higher grade.In case he is not! considered fit, his case will be revie-wed every year, till such time, he will continue to hold~he pos~ in the lower grade.REVIEW OF RECRUITMENT RULES

3.1.5 The Recruitmcnt Rules should be reviewedonce in 5 years with a view to effect such changes asare ,necessarv to bring them in conformity with the.changed position, including additions to or reductionsin the strength of the lower and higher level posts.

SAVING CLAUSE3.1.6 A revised "Saving Clause" as given below

may be inserted in the covering Notification."Nothing in these rules shall affect reservations,

relax3.tio.n of age-limit and other concessions requiredto he provided for the Scheduled Casts, the ScheduledTribes, Ex-servicemen and other sepedal categories ofpersons, in accordance with the orders issued by theCentral Government from time to time in this regard".

B. SCHEDULE

NAME OF POSTS

3.2. Column 1: (Name of posts)Name of the oost may (with sub-title, if any) be,

3.3 Column 2: (No. of posts)

The exact number of posts (with the relevant yearin brackets) may be indicated. The number of postsis an integral basis for determining the method ofrecruitment to any category of posts in as much as thequota of direct recmitment, promotion etc., is to bedecided after taking into account the number of posts.Therefore, whenever there is a substantial change inthe number of posts, the administrative Ministryshould initiate action to review the existing rules,particularly the method of recruitment. The effect ofthe change in the strength on the method prescribedin the rules for the next higher and lower categoriesof posts should also be studied. There should be anasterisk and in a foot note below the asterisk, it shouldbe stated "Subject to variation dependent on work-load".

3.4 Column 3 : (Classification)

Classification of the post/service may be shown inthe order indicated below :-

l(a) If it is a Service, Central Civil Service, GroupA, B, C or D as specified in Rule 4 of the CentralCivil Service (Classification Control and Apeal)Rules (not its nomenclature as Indian MeteorologicalService Group A).

(b) If it is a post, General Central Service GroupA, B, C or D as specified in rule 6 of CCS (CCA)Rules, [D.P. & A.R. Notification No. 21/1I74-Est1,(D) dated 11-11-75].

2. Whether Gazetted or Non-Gazetted.3. Whether Ministerial or Non-Ministerial.

SCALE OF PAY

3.5 Column 4 : (Scale of pay)

The full scale of pay should be indicated. Specialpayor non-practising allowance (in respect of medicalposts), if any, should also be mentioned.

3.6 Column 5 : (Whether s~lection post or non-Selection post).

When promotion is proposed to be made on thebasis of merit, the word "Selection" may be used andwhen promotion is to be made on the basis of senioritysubject to the rejection of the unfit, the word "Non-Selection" may be used. In the case of direct recruit-ment or deputation or transfer, the entry should be

"Not Applicable". In the case of composite methodof recruitment (i.e. Promotion/transfer 011 deputation),the words 'Not Applicable' may be used.(MHA OM No. l/4/55-RPS dated 16-5-57).

3.7 Column 6: (Whether the benefit of added year,of service is admissible under rule 30 of the CCS(Pension) Rules, 1972.

In cases where ror the scientific, medical, technolo-gical and other professional posts and services, thebenefit of added years of service for pension underRule 30 of the CCS (l?ension) Rules, 1972 is con-sidered essential such posts should be identified inconsultation with the Department of Pension and Pen-

. sioners' Welfare and the Union Public Service Com-mission and a suitable provision shcmld be incorpo-rated in the relevant :ecruitment rules so that the bene-fit is automatically available to all the candidates whoare recruited in accordance with the provisions of theserules and it does not become necessary to take a deci-sion in each individual case at the time of recruit-ment. In cases where it is desired to allow this bene-fit in respect of a post for which recruitment rules a~ ..already existing, the administrative MinistryjDeptts.concerned may examine the admissibiilty of this bene-fit and refer the file to the Department of Pension &Pensioner's Welfare with a specific recommendation.If the proposal is approved by the Department of Pen-sion & P.W., the administrative Ministry may take upthe case for formal amendment of the recruitment rules(in Annexure-TII) direct with the tJPSC. Referenceto Estt. (RR) Section of the Department of Personnel& Training is not rquire<:l. In other cases where newrules are being framed, the administrative Ministry/Deptts. may examine and make their recommendationsin regard to the entry to be made in column 6 alongwith other columns of the draft rules. Such casesshould be referred to as usual to the Estt. (RR) Sec-tion of the DP&T and after examining the draft rules,Estt. (RR) Section will refer the case to the Depart-ment of Pension & Pensioner's Welfare for approvalfor grant of the benefit of "added years of service",wherever a proposal to this effect has been made.Thereafter, the approval of the Department of Per-sonnel & Training will be conveyed to the draft rulesas a whole. The administrative Ministry may thentake up the draft rules with UPSC for their concur-rence. as a whole including the entry in column 6.(No. 28jl5/Pension Unitj8,4, dated 25-8-84).

AGE LIMIT FOR DIRECT RECRUITS

EDUCATIONAL AND OTHER QUALIFICA-TIONS REQUIRED FOR DIRECT RECRUITS

3.9.1 Column B: (Educational and other qualifica-tion'Srequired for direct recruits).

The minimum educational qualifications and experi-ence required for dir~ct recruitment may be indicatedas precisely as possible, if necessary, these may bedivided into two parts, viz., "Essential Qualifications"and "Desirable Qualifications". These requirementsvary from post to po:,t depending uP9n ~e scale of payand the nature of duties. But they should be d~t~r-mined, as. far as possible, keeping in view the provi-sions in the approved recruitment rules for similarpos~s and higher and lower posts in th~ ~ame liier-archy.

PRESCRIBING CLASS OR DIVISION3.9.2 Prescribing class or division: Prescribing

first or second class/division in respect of an educa-tional qualification e.g. Degree may be avoided. Asimple Degree/Masters' Degree may be prescribed asthere is difference in the assessment by various Univer-sitie!l/Boards and there may not also be any unifor-

mity in the percentage of marks for deciding a classjdivision. It should hQweverbe ensured that qualifica-tions and experience prescribed should be the mini-mum required for th~ post. The mere fact that per-sons with higher qual!fications are available shouldnot be the ground f()r stepping up the minimum r~~quired qualification/ ~xperience.

3.9.3. The relaxation clause on the foHowing linesmay also be incorporated below the essential qualifi-cations:

3.9.4. Home Guard Volunteers are t~ail1ed iaUa-armed combat, crowd controi, guard duty, patrolling,Map reading, weapon training etc. Their training maybe useful in Group 'C' & "D' posts like Constables;Security Guards, Despatch Riders, Peons, Orderlies,Firemen etc. Similarly, the Civil Defence Volunte~rswho are trained in r~scue, fire fighting, first-aid andcasuality care, nursing, senitation and Public Healthetc. may be preferred to posts like Nurse, Attendant,Stretcher-bearer, Medical Attendant, Health Visitor,Postmen etc. In cases where the admininstraive Minis-tries/Departments consider that the service/training ofthe Home Guards and the CivH Defence Volunteerswill be useful in performance of duties of posts inen~tioned above, 3 years' servic3 as Home Guard/Civil.Defence Voluntetfs and training in at lea§t 'Basic' and'Refresher' courses in Home Guards and Civil Defencemay be prescribed as 'desirable' qualihcatiolJ..[DP&AR O.M. 3.9.5. In respect of Group 'C' posts, if the Minis-tries/Departments consider typing knowledge as essen-tial, typing speed of 30 words per minute in Englishor 25 words per minute in Hindi may be provided asan 'essential' qualitkation.[DP&AR O.M. No. 14017/26/85-Estt.(RR), dt.1-7-85].

EDUCATIONAL QUALIFJCATION FOR PRO·MOTEES

3.10 Column 9 (whether age and educational quali-fications prescribed for direct recruits will apply in theqase of promotees).

It should precisely be stated whether age and edu-cational qualifications prescribed for direct recruitsshould also apply in the case of promotees. Unlessthere are any specific grounds, the age limit prescribed

for direct recruits are not insisted upon in the cas9 ofpl;omotees. Regarding educational qualifications,these are not generally insisted upon in the case ofpromotion to posts of na:n-technical nature; but forscientific and technical posts, these should be insistedupon, in the interest of administrative efficiency, atkac;~in the case of senior Group 'A' posts in the scaleof Rs. 3000- 4500 and above. Sometimes the quali~fications for junior Group 'A' and Group 'B' postsmay not be ipsisted upon in fulll but only the basicqualification in the discipline may be insisted upon,for example, if a degree in Civil Engineering is theqUCl.lificationprescribed for direct recruits, the pro-motees may be required to possess at least a Diplomain Civil Engineering. specific cadre or Service, it is necessary toprovide for direct intake of officers at anappropriate level with a view to injectingfresh knowledge and experience that maynot be normally available in a particular Ser-vice or Department etc.

(v) the proper mix of the six months of recruit-ment mentioned at (a) to (f) above.

3.12.2 Promotion may be kept as a method of re-cruitment depending upon the availability of the fieldof consideration. Care should be taken to see thatthe base for promotion is strong, i.e., the departmentalcandidates are fully qualified for the responsibilitiesof the higher post and the field is also adequate, i.e.,normally the feeder grade should range from 3 to 5times the number of sanctioned posts in the highergrade, in case the post in the higher grade is to befilled on selection basis. For posts which are to befilled by seniority-cum-fitness, i.e. by non-selection,it is not necessary that the feeder grades should consistthree times of posts in the higher grade. For compu-ting the base for promotion and determining the ratioof higher grade to the feeder grade, the number ofsanctioned posts in the two grades (and not the num-ber of vacancies at anyone point of time) should betaken into consideration.

3.12.3 1£ direct recruitment is the only method ofrecruitment, it may so happen that the Ministries/Departments may not be able to fill up the vacanciescaused by the incumbents being away for a durationof one year or more due to proceeding on deputation,

, study leave etc. In order to avoid such a -:ontingency,the following "note" may be inserted :-

TRANSFER

3.12.4 "Transfer" may be kept as a method of re-cmitment when it is possible to get the services ofsuitable officers h-aving·the requisite qualifications andexperience within the Central Govt. Deptts. and StateGovts. "Short-term contract" is also a form of de-putation and this applies to officers from non-Govt.bodies. e.g. Universities, recognised Research Institu-tions, Public Undertakings, etc. for teaching, research,scientific and technical posts. This method maybe included in the ndes if it is considered desi-rable that the above noted non-Govt. bodies are alsotapped. Tn the case of isolated posts, it will be desi-rable to keep the method of ~ecruitment of transferon deputation/short-term contract, as, otherwise, theincumbents of the lower posts, if directly recruited,will not have any -avenue of promotion. In fact, itmay be worthwhile to bring such posts into an org21-nised cadre/service rather than fill them by deputa-tion from outside for limited periods from time totime. Car~ should always be taken to ensure thatthe officers holding posts, other than in an organisedService, have enough prospects for 'advancement intheir own line. For this purpose, the administrativeMinistry JDepartment should bring wgether all suchisolated posts requiring similar educational qualifica-tions, experience involving similar functions etc. intodifferent groups to provide enough channels of pro-motion.

3.12.5 "Transfer" 'and "deputation" are not syno-nymous and there is a substantial difference between"transfer" and "deputation". Under the provision"transfer", the officer who will come, may be per-manently absorbed in the post/grade. Such a "trans-fer" can be effected only in the case of officers fromthe Central/State Governments. lJnoer "deputationincluding short-term contract", an officer from outsidecan come for a limited period, by the end of which hewillhave to revert to his parent cadre.

by 'selection' and the field of promotion consists ofonly one post, the methOd of recruitment by"transfer" on deputation (including short-term cont-ract) /promotion" is prescribed so that the depl!1"tmen-tal officer is considered alongwith outsiders. If the de-partmental candidate is selected for appointment tothe post; it is to be treated as having been filled bypromotion; otherwise, the post is to be filled by de-put~tion/contract for the prescribed period of depu-tation/ contract at the end of which the departmentalofficer will again be afforded an opportunity to beconsidered for appointment to the post.

3.12.7 In cases where there are two or more feedergrades, a separate percentage for promotion may beprescribed to each of the feeder grade.

Fields of Selection

3.13.1 Column 12 : (Grade from which recruit-ment by proll1otion/deputation/transfer/short-termcontract r~-employment is to be made)

The fields of selection under the various methodsshould be clearly specified. If promotion is kept as:a method of recruitment, it is also necessary to laydown the number of years of qualifying service be-fore the persons in the field become eligible for pro-motion. Only regular, and not ad hoc, period of ser-vice is taken into account for purposes of computingthis service. With a view to making the positionclear, the field may be specified as '''with - _

years service in the grade rendered after appointmentthereto on a regular basis". The field for 'transferon deputation/short-term contract/transfer' should. asfar as possible, consist of officers holding analogolUposts on regular basis but may be widened to includ.officers working in the next lower grade also with thequalifying service on regular basis normally prescrib-ed for promotion.

In some cases, different periods of qU'alifying ser-vices in the respective grade/post on account of diffe-rent scales of pay are prescribed for promotion in therecruitment rules. In order to facilitatepreparatioJlof an eligibility list for promo+ion, in cases where noseparate quotas for each different grade have bee.prescribed. -a "Note" as under may be added :

"NOTE:-The eligibility list for promotioJ!shall be prepared with reference to the date ofcompletion by the officers of the prescribed·qualifying service in the respective grade/pos!."

Qualifying Service for Promotion

3.13.2 The qualifying service for promotion fromone grade to another is necessary so that there is nopremature promotion or undue jump in pay and alsoto ensure that the officer has sufficient opportunity todemonstrn!e his competence/potential for holding thehigher post.

The period of qualifying service varies from postto POStdepending upon the scale of pay and the ex-perience, required for manning the higer post. Broad-ly, the following qualifying service for promotiolifrom one grade to another may be followed as ,guide:

Deputation

3.13.4 III cases where 'transfer on deputation/short-term contract' has been prescribed as a methodof recruitment, the following provision may be madein respect of the period of deputation :

"(The period of deputation including the pe-riod of deputation in another ex-eadre postheld immediately preceding this appointmentin the same or some other organisation/ de-partment of the Central Government shall or-dinarily not exceed years)".

The period of deputation for a particular grade orcadre is dependent upon the pay scale of the post towhich deputation is being made. For the top leveli.e. for posts having a pay scale the maximum of whichis R~. 5700 or above, the period prescribed is '5years', for the Middle Manag-ement level i.e. for postshaving a pay scale with 'a maximum of Rs. 4500 orabove but below Rs. 5700/-, the period is '4 years'and for all other lower levels it is normally '3 years'.However, the Ministries/Departments, dependingupon their requirements, the field of availability andthe qualifications prescribed, should decide the periodof deputation in consultation with the Departmentof Personnel and Training and the Union Public Ser-vice Commission.

3.13.4.1 For the uurpose of determining the nefiodof deputation, the posts may be broadly divided intothe following 3 categories :-

3.15 Column 14: (Circumstances in which UPSCto be consulted in making recruitment)

The circumstances in which the Uillon Public ServiceCommission are to be consulted in making recruitmentto the posts within their purview should be dearly indi-cated. Cases in which the Commission are to be con-sulted are illustrated below :

.(i) Direct Recruitment.(ii) Re-employment.

(iii) In all cases of 'transfer', the Commissionshall be consulted. Su~h consultation isnecessary because permanent arrengementsare being made without resorting to themethod of open direct recruitment and theCommission would en.sure that the post has.been circulated widely as per the provisionsof tIle rules and the best peIlOll is aelected.

(iv) When the composite method of recruitment:is prescribed i.e. the deparimental candIdateis to be considered along with oULsiders,theselection shall be made by the CUJUmi~IOnonly.

AMENbMENtS AN]) RELAXATIONS

4.1 Amendment proposals should be sent to thisDepartment and UPSC in the format as given in Anne-xure-III. The reasons for making amendments shouldbe clearly indicated. A copy of the recruitmtnt rulesin which amendments are made should always be en-closed, duly referenced and flagged.

4.2 All recruitment rules should contain a 'Powerto relax' clause in the covering notification or in thebody itself (in th~',case of organised services).

4.3 Relaxation of recroitment roles is to be resortedto in respect of a class or category of persons. Rela-utionabould not1be reaorted to in respect of an iDdivi-

dual except in cases where an individual can betreated as a Class or Category of persons.

4.4 Relaxation of rules i3 to be resorted to on r~occasions. Such a. relaxation should not be a regularfeature.

4.5 Before resorting to relaxation of recruitmentrules, the Ministries/Departments should explore thefeasibility of filling up a post by other methods of Ie.cruitment provided in the rules.
