    SECTION 3;

    DISPUTE RESOLUTION

    Question 1:

    Compare and contrast TWO dispute resolution methods.

    Question 2:

    A contractor has made a time and money claim arising from delays in respect of information. Upon

    your recommendation for payment, the Client informs you that he holds you liable for the claims

    and will recover the amount from your fees.Prepare a reasoned response to the Client.

    SECTION 4:

    BY-LAWS AND PLANNING CONTROL

    Question 1:

    i) The Building Code gives a set of Bye-Laws for the purpose of control of Building

    Construction Operations.What Acts of Parliament does this subsidiary legislation emanate,

    ii) What are the shortcomings of the current Building Code.

    Quetion 2:

    (i). Briefly describe the following terms:

    (a). Plot ratio

    (b). Plot coverage( c). Zoning

    (d). Building lines.

    (e). Obstruction to view

    (f). Waiver as to height(g). Right of light

    SECTION 5:

    REGIONAL AND INTERNATIONAL PRACTICE

    Question 1:

    A Mauritian investor has identified you as an Architect who could undertake consultancy work

    involving rehabilitation and new works at a sugarcane farm and sugar processing factory in Beira,

    Mozambique. The farm and the factory are acquisitions from the state through privatization. Youroffices are in Nairobi. You are not a registered Architect in Mozambique.

    Detail out how you would proceed to take up and consummate your commission.

    Question 2:

    Most countries of the world, including Kenya have associated with the requirements of the World

    Trade Organization (WTO) and have to this extent ratified the GATS (General Agreement on Tradeand Services) Treaty.

    What will this portend for the Architect at the Local, Regional and International Scenes.

    SECTION 6:

    PROJECT BIDDING:

    Question 1:The Board of Registration should liberalize Advertising by Registered firms in the Print and

    electronic media.

    Question 2:

    You have been approached by a large corporation as their Architectural advisor in running anArchitectural competition for the selection of a design team (consortium) to oversee the design and

    construction of their new headquarters building to be located in the Upper Hill area of Nairobi.

    a) Assuming you will accept, give a brief description of your terms of service. What advise

    would you give them to ensure that both you and other competing Architects do not go

    against the code of conduct.

    b) Draft a pre-qualification advertisement to appear in the local press to invite interested

    Architectural firms to submit their bid.

    c) Draft an invitation letter to the pre-qualified Architectural firms to submit their design bids

    for the above competition.
