The Commission f u n c t i o n s under t h e T rea ty a re : ( 1 ) Q u a s i - j u d i c i a l - - I t approves a p p l i c a t i o n s t o c o n s t r u c t and opera te dams o r o t h e r works t h a t w i l l a f f e c t t h e n a t u r a l l e v e l s o r f l ows of waters s p e c i f i e d i n t h e T rea ty . Orders o f Approval c o n t a i n c o n d i t i o n s t o ensure s u i t a b l e p r o t e c t i o n o r indemni ty of a l l i n t e r e s t s which m igh t be i n j u r e d by t h e works approved. Beginning i n 1912 and i n t e r m i t t e n t l y up t o 1964, t h e IJC c a r r i e d ou t severa l i n v e s t i g a t i o n s o f wa te r q u a l i t y i n t h e Great Lakes a.nd t h e i r connect ing channels a t t h e reques t o f t h e two Governments. S tud ies begun i n 1964 on Lake Er ie , Lake On ta r i o and t h e I n t e r n a t i o n a l Sec t i on o f t h e S t . Lawrence R i v e r r e s u l t e d i n a 1970 IJC r e p o r t c o n t a i n i n g a d e t a i l e d assessment o f t h e wa te r q u a l i t y and comprehensive recommendations f o r a c t i o n by t h e Governments o f Canada and t h e Un i ted S ta tes .

The IJC recommendations were g e n e r a l l y accepted by t h e Governmentsr, and a p r i n c i p a l outcome was t h e Great Lakes Water Q u a l i t y Agreement which was signed by t h e Prime M i n i s t e r o f Canada and t h e Pres iden t o f t h e Uni ted S ta tes on A p r i l 15th . 1972.

The 1972 Agreement was unique. Whi le recogn iz ing t h e r i g h t s o f each coun t r y i n t h e use of t h e Great Lakes, i t expressed t h e de te rmina t ion o f each coun t ry t o r e s t o r e a n d enhance t h e wate r q u a l i t y o f t h e Great Lakes system i n t h e p rov i s i ons .of i t s va r ious a r t i c l e s . Water q u a l i t y ob jec t i ves , bo th genera l and s p e c i f i c , were enumerated f o r t h e boundary waters. Programs and o t h e r measures t o ach ieve t h e o b j e c t i v e s were t o be developed and i n t h e process o f implementat ion by December 31, 1975. A d d i t i o n a l powers and r e s p o n s i b i l i t i e s were g iven t o t h e IJC, which was t o . " a s s i s t i n t h e implementat ion of t h i s Agreement" by ana l yz i ng -and d issemina t ing i n fo rma t i on on water q u a l i t y and t h e e f f ec t i veness o f p o l l u t i o n c o n t r o l programs, and a d v i s i n g Governments on Great Lakes wate r q u a l i t y problems. New i n s t i t u t i o n s were created t o a s s i s t t h e IJC t o d ischarge these powers and r e s p o n s i b i l i t i e s . Though t h e Agreement was on l y between t h e Governments o f t h e Un i ted S ta tes and Canada, t h e Prov ince o f Onta r io and t h e S ta tes o f Ohio, New York, .Pennsylvania, Ind iana, I 1 1 i n o i s , Michigan, Wisconsin and Minnesota were a c t i v e p a r t i c i p a n t s i n i t s implementat ion.

On November 22, 1978 a revisSon t o t h e 1972 Agreement was signed. It prov ides new t h r u s t s , new programs and more s t r i n g e n t goa ls . The concept o f a Great Lakes bas in ecosystem' i s adopted, ' recogni z i ng t h a t wa te r qua1 i t y depends on t h e i n t e r p l a y o f a i r , land, water and l i v i n g organisms, i n c l u d i n g man, w i t h i n t h e system. Th is should lead t o more comprehensive assessments o f t h e Great Lakes c l ean up e f f o r t .

The new Agreement s t resses p r o v i s i o n s lead ing t o t h e e l i m i n a t i o n o f t o x i c substances and discharges and es tab l i shes an e a r l y warning system t o p reven t f u t u r e problems.

W i t h i n 18 months t h e t a r g e t s a re t o be conf i rmed and, based on them, load a l l o c a t i o n s and compliance schedules es tab l i shed . It has e igh teen members: one f rom each o f t h e e i g h t Great Lakes S ta tes and t h e Environmental P r o t e c t i o n Agency i n t h e l l n i t e d S ta tes and n i n e Canadian members f r o m Environment Canada, Transpor t Canada, t h e On ta r i o M i n i s t r i e s o f Environment and Na tu ra l Resources, and t h e Government o f Quebec.

I n 1972 the Commission es tab l i shed t h e I n t e r n a t i o n a l Reference Group on P o l l u t l o n from ,Land Use A c t i v i t i e s (PLUARG) t o c a r r y ou t s tud ies re,quired t o answer t h e f o l low-lng quest ions:

1. Are the boundary waters o f t he Great Lakes system being p o l l u t e d by land drainage from man-made and na tu ra l sources?

2. I f t h e answer t o ( 1 ) i s yes, t o what e x t e n t , by what causes and i n what l o c a l i t i e s i s t h e p o l l u t i o n o c c u r r i n g ?

3. What remedia l measures would be most p r a c t i c a b l e and what would be t h e i r c o s t s ?

The e igh teen member Reference Group had an equal number o f U n i t e d S t a t e s and Canadian members. Four t a s k groups, t h e i r t e c h n i c a l a d v i s o r s and e x p e r t committees a s s i s t e d t h e Group.

The s t u d i e s were designed t o :

1 . Assess problems, management programs and research on t h e e f f e c t s o f l a n d use a c t i v i t i e s on w a t e r q u a l i t y i n boundary waters : o f t h e Great Lakes.

2. I n v e n t o r y l a n d use and l a n d use p r a c t i c e s f o r t r e n d s and p r o j e c t i o n s t o 1980 and 2020.

3. Study i n t e n s i v e l y a sma l l number o f r e p r e s e n t a t i v e watersheds t o enable some e x t r a p o l a t i o n o f d a t a t o t h e e n t i r e Great Lakes b a s i n and r e l a t e s p e c i f i c l and uses and p r a c t i c e s t o con tamina t ion o f wa te r q u a l i t y by Great Lakes streams.

4 . Diagnose degree o f impai rment o f wa te r q u a l i t y I n . t h e Great Lakes r e s u l t i n g f rom l a n d use a c t i v i t i e s . . ..

S ince PLUARG's recommendations c o u l d p r o v i d e guidance f o r l a n d use p l a n n i n g e f f o r t s and water. usage w e l l i n t o t h e f u t u r e , l a t e i n 1976 t h e Group began an e x t e n s i v e p u b l i c information/participation program which was c a r r i e d o u t th rough t h e remainder o f i t s s t u d i e s and concluded w i t h t h e Commission's p u b l i c hear ings. PLUARG's f i n a l r e p o r t was presented t o t h e Commission i n J u l y 1978.
