ternational tribunal rejected China’sextensive claims in the South ChinaSea in a landmark ruling Tuesday thatalso found the country had aggravatedthe seething regional dispute and vio-lated the Philippines’ maritime rightsby building up artificial islands thatdestroyed coral reefs and by disruptingfishing and oil exploration.

While the decision is seen as a majorlegal declaration regarding one of theworld’s most contested regions, Chinaimmediately rejected it as a “farce”and the true impact is uncertain giventhe tribunal has no power of enforce-ment.

While the findings cannot reverseChina’s actions, it still constitutes a re-buke, carrying with it the force of theinternational community’s opinion. Italso gives heart to small countries inAsia that have helplessly chafed atChina’s expansionism, backed by itsmilitary and economic power.

“The Philippines strongly affirms itsrespect for this milestone decision asan important contribution to ongoingefforts in addressing disputes in theSouth China Sea,” Philippine ForeignSecretary Perfecto Yasay said inManila, calling on “all those concernedto exercise restraint and sobriety.”

Former Foreign Secretary Albert delRosario, who helped oversee the filingof the case, said the ruling under-scored “our collective belief that rightis might and that international law isthe great equalizer among states.”

Del Rosario stressed that it was im-portant for the ruling to be accepted byall.

“For the sake of maintaining interna-tional order, it is imperative that theAward and clarification of maritimeentitlements be accepted by all rele-vant countries - without exception - sothat we can work together on how re-maining issues can be peacefully re-solved,” he said.

Six regional governments have over-lapping territorial claims in the SouthChina Sea, waters that are rich in fish-ing stocks and potential energy re-sources and where an estimated $5trillion in global trade passes eachyear.

The disputes have also increasedfriction between China and the United

States, which has ramped up its mili-tary presence in the region as Chinahas expanded its navy’s reach fartheroffshore.

White House spokesman JoshEarnest reacted to the ruling by en-courage all parties to “acknowledge thefinal and binding nature of this tribu-nal.”

Earnest spoke to reporters aboardAir Force One as President BarackObama was flying to Dallas. He saidthe United States was not a claimantin the case and that it seeks a peacefulresolution to disputes and competingclaims in the region, while preservingthe U.S.’s ability engage in the freedomof navigation and commerce.

Earnest said the White House seesthe potential that the tribunal’s rulingcould aid in the resolution of the dis-pute in a way that doesn’t further in-flame the situation. He also urged theparties not to use the ruling as an op-portunity to engage in escalatory orprovocative actions.

U.S. Defense Secretary Ash Cartersaid the ruling is an opportunity foreveryone in the region to act in a sen-

sible way in accordance with the ruleof law in order to settle disputes.Carter spoke at a news conference inAfghanistan where he was meetingwith U.S. commanders.

The U.S. State Department called onboth parties to comply with their obli-gations, according to a statement fromspokesman John Kirby. The UnitedStates has not taken sides in the SouthChina Sea disputes but has worked toensure freedom of navigation andoverflight in the region are main-tained.

The Philippines, under a U.N. treatygoverning the seas, asked in 2013 forarbitration on a number of issues ithad with treaty co-signee China.

The five-member panel from thePermanent Court of Arbitration in TheHague, Netherlands, unanimouslyconcluded China had violated its obli-gations to refrain from aggravating thedispute while the settlement processwas ongoing.

It also found that China had inter-fered with Philippine petroleum explo-ration at Reed Bank, tried to stopfishing by Philippine vessels within

the country’s exclusive economic zoneand failed to prevent Chinese fisher-men from fishing within the Philip-pines’ exclusive economic zone atMischief Reef and Second ThomasShoal.

China, which boycotted the entireproceedings, reiterated that it does notaccept the panel’s jurisdiction. China“solemnly declares that the award isnull and void and has no binding force.China neither accepts nor recognizesit,” a statement from the foreign min-istry said.

It added that “China’s territorial sov-ereignty and maritime rights and inter-ests in the South China Sea shall underno circumstances be affected by thoseawards.” The ministry repeatedChina’s often-expressed stance that thePhilippines’ move to initiate arbitra-tion without China’s consent was in“bad faith” and in violation of interna-tional law.

A professor of Asian political econ-omy said the ruling could be a “trans-formative moment” in the region.

Speaking outside the Peace Palace inThe Hague, Leiden University profes-sor Jonathan London said the decisionwill “give countries with a common in-terest in international norms some-thing to point to and to rally around.”

He said they can say to China:“Look, here are the results of an inter-

national organization that has foundthat your claims have zero historicalbasis.”

Japan’s Foreign Minister FumioKishida said the tribunal’s decision is“final and legally binding” and that thetwo sides should comply with it. Hesaid in a statement that “Japan stronglyexpects that the parties’ compliancewith this award will eventually lead to

the peaceful settlement of disputes inthe South China Sea.”

China considers bilateral talks withthe other claimants the only way to ad-dress the South China Sea disputes.

It has said vast areas of the SouthChina Sea have been Chinese territorysince ancient times and demarcated itsmodern claims with the so-called nine-dash line, a map that was submittedunder the U.N. treaty. Manila broughtthe case to arbitration because China’sclaims infringe upon its own 200-mileexclusive economic zone.

The tribunal said that any historicalresource rights China may have hadwere wiped out if they are incompati-ble with exclusive economic zones es-tablished under the U.N. treaty, whichboth countries have signed.

It also criticized China for buildinga large artificial island on MischiefReef, saying it caused “permanent ir-reparable harm” to the coral reefecosystem and permanently destroyedevidence of the natural conditions ofthe feature.

Just before the panel announced itsruling, a busload of Chinese touristsarrived outside the court building inThe Hague and joined a handful ofother protesters in shouting downthree people calling for China to leavePhilippine waters. In Manila, dozensof rallying Filipinos jumped for joy,wept, embraced each other and wavedPhilippine flags after the news.
