4.1 (2) Attached Garage FireSeparation

Doors

The 2006 edition of the InternationalResidential Code (IRC) states thefollowing concerning doors that separategarages from living areas:

R309.1 Opening Penetration

Openings from a private garage directlyinto a room used for sleeping purposesshall not be permitted. Other openingsbetween the garage and the residenceshall be equipped with solid wood doorsnot less than 1-3/8" (35 mm) inthickness, solid- or honeycomb-coresteel doors not less than 1-3/8" (35 mm)thick, or 20-minute fire-rated doors.

While not required by the IRC, it ishelpful if there is at least one stepleading up to the door from the garage.Gasoline fumes and other explosivegases are heavier than air, and they willaccumulate at ground level. Their entrybeneath a door will be slowed by anelevation increase.

Doors should have tight seals aroundtheir joints to prevent seepage of fumesinto the living areas of the house.Carbon monoxide, with the sameapproximate density as air (and oftenwarmer than surrounding air), will easilyrise above the base of an elevated doorand leak through unsealed joints.

Doors should be self-closing. Manyhomeowners find these doorsinconvenient, but they are safer thandoors that can be left ajar. While thisrequirement is no longer listed in theIRC, it is still a valuablerecommendation.

Pet doors should not be installed in fire-rated doors. Pet doors will violate theintegrity of a fire barrier.

Walls and Ceilings

The 2006 edition of the IRC states thefollowing concerning garage walls andceilings:

R309.2 Separation Required

The garage shall be separated from theresidence and its attic area by not lessthan ½-inch (12.7 mm) gypsum boardapplied to the garage side. Garagesbeneath habitable rooms shall beseparated from all habitable roomsabove by not less than 5/8-inch (15.9mm) Type X gypsum board orequivalent. Where the separation is afloor-ceiling assembly, the structuresupporting the separation shall also beprotected by not less than ½-inch (12.7mm) gypsum board or equivalent.Garages located less than 3 feet (914mm) from a dwelling unit on the same lotshall be protected with not less than 1/2-inch (12.7 mm) gypsum board appliedto the interior side of exterior walls thatare within this area. Openings in thesewalls shall be regulated by Section309.1. This provision does not apply togarage walls that are perpendicular tothe adjacent dwelling unit wall.

In addition, inspectors can check for thefollowing while inspecting walls andceilings:

In garages that have access to the attic,a hatch cover made from an approved,fire-rated material should protect thisaccess at all times. Missing or opened

covers should be called out, as shouldcovers made from flammable materials,such as thin plywood. Garage attic doormust be constructed such that the 45minute rating is maintained; any drywalledges on both the hatch and thesurrounding area exposed to physicaldamage are protected. The cover ordoor is installed so that it is permanent(non removable) with hardware tomaintain it in a closed position withlatching hardware to maintain it in aclosed position. This could beaccomplished by the use of springloaded hinges, door closer, or hardwarethat will not allow it to be left in an openposition when not in use. A single bolttype or hook and eye hardware does notprovide a positive closure since thesewould allow the door to be left open.Likewise drywall screws are "fasteners"and not hardware so they cannot beused as the only means of keepingaccess doors closed.

The living space is separated from thegarage by a firewall that extends fromthe floor to the roof. If the ceiling materialis fire-rated, the firewall can terminate atthe ceiling.

Drywall joints shall be taped or sealed.Joints shall be fitted so that the gap is nomore than 1/20-inch with joints backedby either solid wood or another layer ofdrywall such that the joints arestaggered.

8.1 (2) Are Circuit Breakers Interchangeable?

Circuit breakers and service panels, or breaker boxes, are made by many different manufacturers and may come inmany different models. To the untrained eye, most breakers and panels may look very similar, so much so that youmight be tempted to use any old breaker in your panel, as long as it seems to fit. But this is a very bad idea and canbe dangerous because breakers are not designed to be interchangeable.

How Breakers Differ

From time to time, there may be a need to change a breaker or add one to your electrical service panel. Mostelectrical devices, like switches, outlets, and light fixtures can be swapped out with another brand without anyproblems. Breakers, however, are brand-specific and require the exact replacement type to function properly in theelectrical panel. Breakers can have different mounting systems, and panels can have bus bars of differentthicknesses, and you never know whether a breaker will function as designed if it's used in a different manufacturer'spanel.

Although a breaker from another manufacturer may even fit in the panel you have, the differences that you don't seemay cause an electrical nightmare. Some breakers clamp over the bus bar, while others bolt onto the bus. Somebreaker bases clamp onto a mounting bar, while others slide into a groove. The tension that the breaker contacts areset for also may vary from product to product.

Electrical panels also come in different styles for residential, commercial, and industrial installations. While snap-intype breaker panels are used for residential and commercial installations, bolt-in breakers typically are used forindustrial installations where vibration may be a concern and continuously tight contact is needed.

Will Another Brand Fit?

In many cases, one brand of breaker can fit in another brand of panel. For example, some Bryant breakers will fit intosome GE panels. Breaker manufacturers may even tell you which of their breakers you can use to replace othermanufacturers' breakers. However, it's not recommended that amateurs choose this route since it's easy to end upwith an incompatible match. Also, breaker manufacturers typically disclaim any responsibility if you use their breakersin a different manufacturer's panel.

Same Manufacturer, Different Breakers

The specific model of breaker also matters. For example, Square D makes both Q0 panels and Homeline panels, buteach series of panels uses different breakers. Additionally, panels may specify one line of breakers for its branchcircuits and a different type of breaker for its main breaker or service disconnect.

How to Know What Type of Breaker to Use

If you open the door of your service panel and look on the inside cover of the door, there should be a label thatspecifies the types of breakers to use with the panel. Note that the model or series of breakers for the branch circuitsmay differ from the model specified for the main breaker or service disconnect.

If there is no label on the panel door (they're made of paper and don't last forever), the easiest way to ensurecompatibility is to use the exact same type of new breaker as the existing breakers in the panel. You can evenremove one of the old breakers to make sure the panel connections are identical, and you can test-fit the new breakerin the panel before you hook it up.

A ground fault circuit interrupter (GFCI) is a safety device installed toprotect you when using electrical devices in wet locations. When using an

California Senate Bill 183 was signed into law to regulate the installation of Carbon Monoxide detectors.

The law is a two-part law that requires an update to the Transfer Disclosure Statements used in a real estate transaction, and putsinto law the Carbon Monoxide Poisoning Prevention Act of 2010.

The first part of the new law requires that as of July 1, 2011, Transfer Disclosure Statements (TD forms) include a line itemregarding the presence or absence of a Carbon Monoxide detector in the same manner as Smoke Detectors, for all residentialunits that are sold. This applies to just about all types of occupancies from single family owner-occupied and rentals, to multi-family housing. If the property is being sold, it must now include a CO Detector if the dwelling has gas appliances, fireplaces,and/or attached garages as described below.

The second part of the law enacts the Carbon Monoxide Poisoning Prevention Act of 2010 which requires that all residentialproperties, not just those being sold, be equipped with a Carbon Monoxide detector when the property has a fossil fuel burningheater or appliance, fireplace, and/or an attached garage. All single-family homes in structures with 1-4 units (owner or tenantoccupied) must be equipped with a detector on or before July 1, 2011.

All other multi-family residential units must be equipped with a detector on or before January 1, 2013, not just those being sold.

For rentals, the Carbon Monoxide detector must be operable at the time the tenant takes possession. A tenant is responsible fornotifying the owner or owner's agent if the tenant becomes aware of an inoperable or deficient carbon monoxide detector withinhis or her unit. The owner or owner's agent must correct any reported deficiencies in the carbon monoxide detector and will notbe in violation of this section for a deficient or inoperable carbon monoxide detector when he or she has not received notice of thedeficiency or inoperability.

The bottom line is that ALL SINGLE FAMILY residential dwelling units as of July 1, 2011 must have a CO detector, even thosethat are not being sold. All other dwelling units (multi-family, dormatories, hotels, motels, etc) must have CO detectors installedby January 1, 2013.

Air conditioner evaporator condensation drain line system

Air conditioner evaporator systems located in the attic have two drain systems that evacuate condensation water thatis produced by the evaporator. The primary system which is typically located at the lower exterior portion of the housewill drip condensation when the system is in operation. The primary condensation drain line can become blocked,usually by algae that grows in the trap that is built into the drain line located in the attic. When this occurs,condensation will back up through the evaporator and out the secondary drain line, either through the overflow plan ora secondary drain line coming from the evaporator to the exterior of the house. The secondary condensation drainline is typically located over a window so that if the primary condensation drain becomes blocked condensation canbe observed coming from this line. This is an indicator that the primary drain line needs to be cleaned.

1. Client requests a visual inspection of the structure identified at the above address by California Home Inspection hereinafter collectively referred

as the "Company" and Client hereby represents and warrants that all approvals necessary have been secured for the Company's entrance on to

the property.

2. Client warrants that (a) Client has read this Agreement carefully, (b) Client understands the Client is bound by all the terms of this Agreement,

and (c) Client will read the entire Inspection Report and follow every recommendation for repairs, maintenance, safety or further evaluation by a

specialist. Furthermore, Client agrees that if such action is not undertaken and documented that the Company shall be held harmless for any

subsequently alleged defects or deficiencies regarding that specific component/system or condition.

3. CONFIDENTIAL REPORT: Client understands that the inspection and the Inspection Report are performed and prepared for Client's sole,

confidential use. Client agrees that Client will not transfer, disseminate or otherwise disclose any part of the Inspection Report to any other

persons. The ONLY exceptions to this non-disclosure are as follows: (a) one copy may be provided to the current Seller (b) one copy may be

provided to the Real Estate Agent directly representing Client and/or Client's lending institution for the use in the Client's transaction only. (c) one

copy may be provided to the Attorney directly representing Client. IN THE EVENT THAT ANYONE OR ANY ENTITY CLAIMS DAMEGES AS

ARESULT OF THE RELIANCE UPON THE INSPECTION REPORT, AND SEEKS RECOMPENSE FOR SAID DAMAGES FROM THE

COMPANY, Client agrees to indemnify, defend, and hold Company and/or Inspector harmless from any third party claims arising out of Client's

unauthorized distribution of the Inspection Report, including, but not limited to, any claims caused by the alleged negligence, breach of contract,

fraud, misrepresentation, or any other theory of liability of the company.

4. Company agrees to perform a limited visual inspection of the structure at the above address and to provide Client with a written opinion as to the

apparent general condition of the structure's components and systems, including identification of significant observable deficiencies, as they exist

at the time of the inspection. The inspection will be performed in a manner consistent with the Standards of Practice of the American Society of

Home Inspectors (ASHI). A copy of these standards is attached to the Inspection Agreement

5. SCOPE OF INSPECTION: The inspection only includes those systems and components expressly and specifically identified in the inspection

report. Any area, which is not exposed to view, is concealed, is inaccessible because of soil, walls, floors, Carpets, ceilings, furnishings or any

other thing, or those areas/items, which have been excluded is not included in this inspection. The inspection does not include any destructive

testing or dismantling. In addition to the other LIMITATIONS provisions in this Agreement, Client agrees to assume all the risk for all conditions

which are concealed from view at the time of the inspection or exist in any area excluded from Inspection by the terms of this agreement.

Maintenance and other items may be discussed but will NOT form a part of the inspection report. The following areas/items, systems and

6. CLIENT UNDERSTANDS THAT THE INSPECTION AND THE INSPECTION REPORT DO NOT, IN ANY WAY, CONSTITUTE A/AN: (1)

GUARANTEE, (2) WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, (3) EXPRESS OR IMPLIED

WARRANTY, OR (4) INSURANCE POLICY. ADDITIONALLY, NEITHER THE INSPECTION NOR THE INSPECTION REPORT IS SUITABLE

FOR ANY REAL ESTATE TRANSFER DISCLOSURES THAT MAY BE REQUIRED BY LAW.

7. The written report to be prepared by Company shall be considered the final and exclusive findings of Company of the structure. Client

understands and agrees that Client will not rely on any oral statements made by the inspector prior or subsequent to the issuance of the written

Inspection Report. Client further understands and agrees Company reserves the right to modify the inspection report for a period of time that shall

not exceed two business days after the inspection report has first been delivered to the Client.

8. LIMITATION ON LIABILITY: It is agreed that the Company, its employees, officers, owners, and heirs, are not in anyway insurers of the property

inspected and that payments for the inspection services provided herein are based solely upon the value of those services, and it is not the

intention of the parties that the Company assume responsibility: (1) for any loss occasioned by malfeasance or misfeasance in the performance of

the services under this Agreement, (2) for any loss or damage sustained through burglary, theft, robbery, fire or other cause, or (3) for any liability

on the part of the Company by virtue of this Agreement or because of the relationship hereby established. If there shall, notwithstanding the above

provision, at any time be, or arise, any liability on the part of the Company by virtue of this Agreement, or because of the relationship hereby

established, whether due to the negligence, omission, breach of contract, misrepresentation of the Company or otherwise, such liability is, and

shall be limited to, a sum equal to the price charged for the inspection service, which sum shall be paid and received as liquidated damages. Such

liability is herein set forth as liquidated damages and not as a penalty, and this liability shall be complete and exclusive. THE COMPANY MAKES

NO WARRANTIES, EXPRESS OR IMPLIED, AND ANY SUCH WARRANTY IS SPECIFICALLY EXCLUDED AND DISCLAIMED.

9. DISPUTES: Client understands and agrees that any claim for failure to accurately report the visually discernible conditions at the subject

property, shall be made in writing and reported to the inspector within ten business days of discovery. Client further agrees that, with exception of

emergency conditions, Client or Client's agents, employees or independent contractors will make NO alterations, modifications or repairs to the

claimed discrepancy prior to a re-inspection by the Inspector. Client understands and agrees that any failure to notify the Inspector as stated above

shall constitute a waiver of any and all claims for said failure to accurately report the condition in question.

10. ABRITRATION: It is agreed that any dispute, controversy, interpretation or claim, including claims for, but not limited to, breach of contract, any

form of negligence, fraud or misrepresentation arising out of, from or related to, this contract or arising out of, from or related to, the inspection or

inspection report, shall be submitted to final and binding arbitration under the Rules and Procedures of Construction Dispute Resolution Services

LLC. The decision of the arbitrator appointed hereunder shall be final and binding and judgment on the award may be entered in any court of

competent jurisdiction. CLIENT UNDERSTANDS AND AGREES THAT IN ANY SUCH ARBITRATION, ALL OF THE LIMITATIONS OF LIABILITY

PROVISIONS OF THIS AGREEMENT SHALL APPLY.

11. Any legal action, including the arbitration proceeding more specifically described above, including, but not limited to, those proceedings involving

claims sounding in tort or contract, against the Company, or its officers, agents or employees, must be brought within one (1) year from the date of

the inspection, or same will be deemed waived and forever barred. Time is expressly of the essence herein. This time period may be shorter than

otherwise provided for by law. It is agreed and understood that the arbitrator, in rendering any decision above, is to apply the laws of the State of

California.

12. ATTORNEY'S FEES: The prevailing party in any dispute arising out of this agreement, the inspection, or Report(s) shall be awarded all

reasonable attorney's fees, arbitrator fees and other costs.

13. Client understands and agrees that if he or she is not present at the time of the inspection or do not sign this Inspection Agreement that this

Agreement will become part of the Inspection Report, and therefore delivery of the Inspection Report to the Client (by mail, in person or via

internet) will constitute acceptance of ALL the terms and conditions of this Agreement.

14. SEVERABILITY: If any portion of this Agreement is found to be invalid or unenforceable by any court or arbitrator the remaining terms shall

remain in full force and effect between the parties.

15. PAYMENT:Payment is expectedat the time of the inspection. A $50.00 fee will be added to returned checks.

16. ENTIRE CONTRACT: This Agreement represents the entire agreement between the parties. No oral agreements, understandings or

representations shall change, modify or amend any part of this agreement No change or modification shall be enforceable against any party unless

such changes or modifications are in writing and signed by the parties. This Agreement shall be binding upon and inure to the parties hereto and

their spouses, heirs, executors, administrators, successors, assigns and representatives of any kind whatsoever.
