July 2009 – Water Supply Plan found to be “not in compliance” by Florida DCA
Objections from the South Florida Water Management District were focused on population (demand) projections and long-term needs.The Long-term (2020) Capacity Deficiency is the most difficult issue.Alternative source must be identified.

Regional Activity Center Amendment proposed in March 2009. (DCA#09-2AR)
Re-designates the various land use uses within the boundaries of the CRA to “Regional Activity Center”.
SFWMD notified the City of its Objections to the proposed RAC Amendment on October 22, 2009
The objections are the same as those that were placed on the Water Supply Plan Amendments.
Broward County Planning Council hearing for the RAC Amendment is December 3, 2009
All outstanding issues need to be addressed prior to November 18, 2009 in order for the Broward County Planning Council to recommend approval.

The deadline for resolving the
Water Supply Plan Objections
has been shortened by two months

Staff response to the shortened deadline
has taken Three Simultaneous TracksA Lobbying effort to attempt to have the SFWMD’s Objection removed from the RAC Amendment.
Staff has pursued an amendment to the City’s existing Agreement with the County to Purchase Raw Water Capacity from the South Regional Wellfield (Brian Piccolo).
Staff has negotiated an Agreement with Hollywood for the purchase of Potable Water Capacity.

Initial Hollywood proposal assumed estimated demands for future CRA increases:
550,000 GPD (Average)715,000 GPD (Maximum Day)
Reserved Capacity Charge: $2,492,460
Flow Fee Monthly: $33,099 - Starts Immediately
Reserved Capacity Charge could be paid over 5 years

The Current Hollywood Option is for Reserved Capacity of 300,000 GPD for a Perpetual Term
Reserve Capacity Cost: $1,045,540 paid as lump sum or over 5 years starting October 1, 2010
Flow Charge:$18,305 per month for the first 12 months effective upon contract execution
Flow Charge would be reduced by 10% when Reserve Capacity payments begin October 1, 2010 Monthly Charge = $16,474

Dania Beach’s request for an Escape Clause within One Year with 90 day Notice and Acceptance by the SFWMD has been rejected.

Recommend the Dania Beach City Commission
Hold a Special Meeting on November 17, 2009 to Discuss and take Action on a final resolution to the RAC Amendment Water Supply issue
orSchedule a workshop after final resolution of the Water Supply Plan and Comprehensive Plan Amendments have been found in compliance to develop a strategy for Future Development and Redevelopment Infrastructure Planning
